descend to oakland. what we know about the response from police. also, california sues big oil. governor gavin newsom laying out allegations of deceptive tactics against some of the largest oil and gas companies. this is "today in the bay." good morning to you on this monday. i'm marcus washington. >> and i'm laura garcia. we're going to take a look at the forecast with kari in just a moment. first, we want to start with mike. he's been tracking a traffic incident on 880. >> a major crash which for a period of time had traffic stopped getting toward the bay bridge from the nimitz freeway. let's take a look at the camera over in emeryville. we've turned it toward the 880 northbound direction, and you can see traffic is slowly getting by. let me point out exactly what's going on. traffic northbound coming up toward the bay bridge, there's still activity here, at least one larger vehicle, i think it might be a tow truck. some more lights are arriving behind it.

there's still activity blocking one of those lanes. one is open. this has been going on for a while. this backup continues to slowly build coming toward grand avenue and northbound 880 toward oakland. if you continue up 580 instead of cutting over, but northbound does get by slowing toward the toll plaza because of a major crash. it sounds like someone has been taken from the scene by an ambulance already. there were reports there was someone unconscious at the scene. the rest of the bay, things are moving pretty well. there is one shutdown northbound 680 coming into pleasanton. typical road work. kari, chp said there might be a stronger breeze across the antioch bridge. >> we're transitioning to slightly cooler temperatures. we had that over the weekend. at times the wind does pick up just a bit. as we are looking at san jose's day planner and what to expect throughout the day, temperatures in the low 60s to start. as we go throughout the morning,

it's going to become mostly sunny and a really nice day ahead, as we only reach into the upper 70s in the south bay. we'll see some low 80s, but these numbers coming down, after some warm weather last week. take a look at our highs around the bay area today. it will be about the same tomorrow, with temperatures mostly in the mid to upper 70s, a few low 80s as you head to morgan hill, as well as toward concord. generally cooler temperatures, so make sure you have that jacket at least for the start of the day. another look at the forecast in a few minutes. >> thank you. well, first this morning, some breaking news out of san jose. this is video just into our newsroom. san jose police are investigating a reported shooting. it happened near coyote creek trail and capitol expressway. as you can see right here, there are emergency crews there at the scene. a person was seen on a gurney being put into an ambulance. now, we have reached out to san jose police to find out more about this investigation.

of course we're working to find out the condition of that person transported. we will bring you information as soon as we get it. also developing this morning, but in southern california, the manhunt continues following the ambush-style killing of an l.a. county deputy. authorities identify the deputy as 30-year-old ryan clinkunbroomer, found saturday night in his patrol car near the palmdale sheriffs station. >> last night mourners gathered outside of the station for that memorial to honor the fallen deputy. hundreds lit candles, sang songs, showing their support for his family and fellow comrades. as for the information and investigation into this, the sheriff's office is now offering a quarter million dollar reward to track down that shooter. >> i'm going to continuously refer to them as cowards, because that's what they are, cowards, to attack a deputy sheriff in uniform in a black and white just sitting there at a red light, about to go out and

serve our community. that is absolutely 100% unacceptable. >> now, investigators are poring over video evidence, including footage of a car that rolled up to the deputy's patrol car at about the time of the murder. that car is identified as a 2006 to 2012 gray toyota corolla. protesters are gearing up for the arrival of israel's prime minister meeting today with elon musk. it comes amid accusations that musk is allowing anti-semitism to fester on the social media network formerly known as twitter. kris sanchez joins us near the tesla headquarters this morning. this is a place where protesters plan to gather, kris? >> reporter: we do expect that protesters will gather here in fremont near the tesla station, tesla factory, at about 8:00 this morning. it is really tough to get close to that factory, because tesla owns the road in front of it. so we'll have to see where protesters start to gather.

but the organizer, the co-founder of a group called unacceptable, put out a statement that reads in part, it is deeply unacceptable that benjamin netanyahu, leader of the world's only jewish state who calls himself the protector of israel is flying across america to seek counsel and support from a notorious enabler of anti-jewish hate speech. this is from the co-founder of unacceptable. elon musk is expected to meet with the prime minister of israel to ease a growing war of words over claims of anti-semitism on x, formerly known as twitter. insiders say this meeting between prime minister netanyahu and musk is the latest step by executives for the social media site to head off what could be a legal battle over hate speech on the platform. several groups have accused musk of allowing anti-semitic groups to flourish on his site. musk has threatened to sue over those accusations, calling them defamation. netanyahu is coming to the u.s.

or is in the u.s. for the annual meeting of the united nations general assembly, which starts today. now, the group unacceptable also plans to protest in san francisco and in san jose, including at mineta san jose, where we expect arrivals later this morning. in fremont, kris sanchez, "today in the bay." >> could be a busy morning. thank you very much, kris. [ sirens ] oakland police with their hands full with sideshow activity last night. a crew caught cars gathered at 21st and later in west oakland near 17th. police do say officers were conducting high visibility enforcement, but so far there's no word on any arrests. and developing this morning, a big meeting on tap for oakland police commissioners dealing with the search for a new police chief. oakland has been without a chief for seven months now. this is since mayor sheng thao

fired leronne armstrong. last week things came to a head when the mayor suggested the commissioners are dragging their feet. the mayor also said that she's considering a state of emergency if a short list cannot be assembled by the end of the year. the meeting today is expected to provide an updated timeline. our bob redell is following developments and will have more in the next half hour. governor gavin newsom is opening up about his battle to take on oil giants. he spoke yesterday to help kick off climate week and talked about the lawsuit he's filed with state attorney general rob bonta. the state claims big oil has knowingly engaged in deceptive practices for decades and the governor says he's had enough. >> i'm sick and tired of this, and if california can make a dent with respect -- those of you from germany, soon to be the fourth largest economy in the world, the size of 21 american states combined, the scale and

scope of what the state of california can do, we think can move the needle. it sure as hell can do this, it can illuminate their deceit. >> in response to reuters, one of the companies named, american petroleum, calls this an issue that should be argued in congress, not the court system. every major oil producer is named in the suit. 5:08 this morning. taking a live look in downtown san jose. meteorologist kari hall has been monitoring what we can expect as we get this week started. nice and cool this morning. >> yeah, last few days of summer. we're going to officially kick off fall by the end of the week, and we're going to see cooler temperatures starting to settle in. as we take a live look at the golden gate bridge, it is clear visibility as you're driving across and coming out of the north bay. as we take a look at novato, it's in the upper 50s. we're going to have a cool morning start, a few clouds, and then see it clearing out around

10:00 to 11:00 this morning. then we'll be in the upper 60s at noon, 69 degrees and sunny, and eventually making it up to 79 degrees. you can see these numbers across the bay area look really great for today, with some upper 70s from san mateo to mountain view, 77 also expected in hayward, and 79 today in santa rosa. so we'll get a look at what's ahead for the rest of this last few days of summer. that's coming up. mike, how is it looking filling up at the station? >> i wanted to end summer on a good note. well, we have a note. we're going to start with the low in south bay, safeway at $4.85, still under $5, and that's what we try to find if they're available. alameda county has hayward's costco, the low of $4.95 in the middle. both costcos in hayward have that price. marin county, we cannot get below $5 in that county. hq fuels on shoreline highway at

out there to enjoy it. we'll get a look at the rest of the forecast in a few minutes. this looks great, now it looks great. northbound 880, we had that crash, a lane blocked here around the curve approaching the bay bridge, jammed up. it cleared in the last, i would say, 90 seconds. we have a smoother drive for the nimitz. that will mean more traffic arriving at the toll plaza. we will track that. meanwhile, we'll check in right now with bertha coombs. good morning, mike. here in new york we're bracing for a gridlock alert with the united nations getting going. i'm bertha coombs from cnbc. wall street looks like smooth sailing, although it looks like stocks are headed for a slightly lower open. the main event is going to be the federal reserve's policy meeting that starts tomorrow. the fed's decision is expected on wednesday afternoon and the central bank is widely expected to leave rates unchanged, but

leave the door open for another rate hike potentially in november, depending on how the data on inflation and jobs shake out. the markets are coming off a mostly negative week, with the s&p 500 and the nasdaq posting back-to-back weekly losses. in focus aside from the fed, we're going to get data on housing, jobless claims and manufacturing. october could be a month of big sales. amazon has announced its october 11th prime day. meantime, tiktok plans to offer black friday discounts in a month-long campaign that will kick off in late october. bloomberg reports the app aims to lure shoppers to its new online marketplace. the first shot in what many expect will be a price war with amazon and walmart. tiktok shop launched in the u.s. this past week and plans to sell about $20 million in merchandise globally this year. it's offering subsidized

discounts of up to 50% to encourage shoppers to participate in the program. meta's next pair of rayban smart glasses may be on the horizon. a listing of rayban's parent company has surfaced in the fcc's database. the original glasses let you capture photos and video and record and play audio. they haven't exactly been a bit. the "wall street journal" reports less than 10% of owners actually use them on a monthly basis. the new glasses will let you live stream video to facebook and instagram and they're scheduled to launch as soon as this fall. i don't know, marcus and laura. i get a little leery of the idea of somebody live streaming if i don't know what's going on, if they're just looking at me with glasses. >> exactly. i can understand that. >> i'll pass. >> one thing at a time. thanks, bertha.

5:17 right now. continuing coverage this morning of the auto workers strike against the big three automakers. now, striking workers, they are heading back to the picket lines this morning and there's still no deal. but they are negotiating. right now the strike primarily impacts three plants, one for each gm, ford and stellantis, which owns jeep, dodge and chrysler. it also involves about 10% of americans unionized auto workers. the white house is expressing support for the unions but so far remains on the sidelines. a sudden aboutface for drew barrymore after backlash for plans for her to resume taping her talk show. she is pulling back from plans. on instagram she apologized saying we tried to find our way forward and i truly hope for a resolution for the entire industry soon. technically she would not have violated rules as long as it did

not involve writers. it will continue airing repeats until a new deal is reached. ed sheeran may have never been named the mayor of santa clara, but you can call him the king of levi's. ♪♪ ♪ angels to fly ♪ >> so sheeran set a new attendance record for levi's saturday night when he had close to 80,000 fans pack the stadium there. so the exact numbers are still not announced, but it did shatter previous records when 77,000 people attended wrestlemania. maybe you've been wondering where swifties and the beyhive had fewer fans. the answer is space. so taylor swift, beyonce, their stages took up more space. sheeran had a circular stage there that allows more seating and pretty much the entire stadium. in a statement, 49ers president said, in part, we would like to thank the fans and staff who

made this show amazing and, of course, ed, for putting on a terrific performance. there is zero doubt that a crowd this large had an overwhelmingly positive effect on local businesses and hotels in our community who benefit from events at the stadium. >> santa clara has had a good run there. >> they have. >> spectacular shows. >> with the lights and everything, that looked amazing. i saw that jessica went to the show, too. >> sometimes you can live through others to see a concert. >> yeah. >> i've been to the last three without going. >> right. didn't pay a dime. >> and i go outside because of kari. >> there you have it. we have great outdoor weather for the next few days, and we're going to see cooler temperatures settling in for the valleys. there won't be much of a change for san francisco. we've had a lot of mild days here. as you make your way inland, take a look at what to expect. in concord, we're starting out with low 60s. at 8:00, we're at 62 degrees.

a slow rise in temperatures as we make it throughout the day. at 4:00, we're reaching high temperatures, reaching into the upper 70s. we may briefly touch the low 80s. as we look at all of our temperatures for today, reaching to the upper 70s in napa, novato reaching 79, about the same in santa rosa, and san francisco in the low 70s today, mountain view reaching 77 and los gatos headed for 82 degrees. tomorrow we see still the breezy wind and slightly cooler temperatures continuing. livermore staying in the 70s, so that's a nice little taste of fall that will continue throughout much of the week, with low 80s in our warmest spots inland. then we take a look ahead to see when we could see rain, and it looks like it continues for the next several days for the sierra, staying to the east of us. but for the bay area, we just get a strong wind coming off of the ocean and keeping temperatures down. we may see a chance of showers well beyond that seven-day

forecast. we'll be watching that. take a look at fairfield, one of our warmer spots we usually have in the inland areas. it's going to be in the upper 70s and low 80s throughout much of the week. you can expect for it to warm up by the end of the weekend, but that's upper 80s coming our way for the end of the weekend. fall officially begins late friday night and we'll see temperatures in the low to mid-80s this weekend. so still looking great out there, as our temperatures will be slightly cooler throughout the week, but a touch warmer for the weekend. mike, are you seeing changes now in the east bay? >> yeah, good change, the positive changes that the crash cleared, 880 north at grand. that was stopping things up for the short section approaching the bay bridge. i was worried that there would be too much traffic at one time at the bay bridge toll plaza, but it has remained smooth. the impact of the backup in oakland has cleared. we're back to your normal morning here, 5:22 at the bay bridge toll plaza. we should see metering lights on in the next 15 to 20 minutes. we see any slowing coming toward

5:25 right now. nbc bay area responds to a south bay author who encountered some real live drama while publishing his book. >> he asked consumer investigator chris chmura's team for help to turn the page. >> good morning. this writer asked us to withhold his name, but he has a mystery to tell. he penned and published a digital book on amazon's kindle direct publishing. well, ten months later, a cliffhanger, the author says kdp closed his account because it was related to another account that previously shut down. the writer said, no, he only has one account. he appealed, with no luck. lost cause, until he contacted us for some justice.

continues. we're live with the latest. controversial barriers along san francisco's capp street. the reason neighbors on a nearby street are speaking out and asking the city for help. this is "today in the bay." >> good morning to you on this monday. i'm marcus washington. >> i'm laura garcia. let's start out with a look at that forecast. meteorologist kari hall is tracking what we can expect for this monday. >> it's going to be a great day, starting out cool, a few clouds. then clearing out, with sunshine in the forecast for today. right now in the upper 50s and low 60s as you get ready to head out on this monday morning. it is a little bit cooler in palo alto, 54 degrees there. about the same in gilroy, and in martinez it is 58 degrees. as we head to cupertino, here is what to expect today, low 60s at 9:00, at 1:00 we're at 73 degrees, and some mid-70s for today. it's just going to be beautiful around the bay area, as our temperatures take a little bit

of a dip as we become in fall later this week. so we'll talk more about that. mike, are you seeing a bigger build on highway 4? >> we are. originally we had a disabled vehicle in the middle of highway 4 westbound, your commute direction at bailey. i believe there's a crash reported and maybe a second incident. let's get a look at the map closer up. it may be a second incident or the original vehicle that got hit by someone in traffic, because of the proximity of the two reports and the similarity. we're going to wait until chp gives full details. west highway 4 is jammed up. you see it slowing at railroad. we'll watch to see if that ripples down to folks cutting through bailey and toward kirker pass. we're looking at westbound highway 4, a bigger backup out of antioch, clearer through concord because folks are held up before san marco. at the bay bridge, the travel times are building for highway 4 to 680, some folks are going to undoubtedly head toward kirker pass road. developing right now in

oakland, new steps being taken, perhaps as soon as today, to try to lockdown a new permanent police chief. the drawn-out process has led to a war of words between the mayor and commissioners. >> bob redell joins us live. this follows another violent weekend. >> reporter: unfortunately, you are correct. good morning, marcus and laura. yes, after a mother was shot and killed by a stray bullet in oakland over the weekend, tonight the oakland police commission will hold a special meeting and they're expected to give the public an updated timeline in their search for a new permanent police chief. oakland has had eight police chiefs over the last 14 months, and has not had a permanent police chief in seven months, after mayor sheng thao of oakland fired chief leronne armstrong, who was found by an independent panel to have mishandled police misconduct. the mayor says the commission is not doing its job and has threatened to declare a state of

emergency. the commission blames the mayor for keeping the process in limbo. final candidates are set to be selected the week of oath 9th. on friday night the mother i mentioned was inside her home when she was struck by a stray bullet. paramedics rushed her to the hospital where she died. the councilwoman ram chandra says she was a mother of two young children and is worried about the spike in violent crime. >> i'm absolutely horrified. right now we're experiencing crime in every part of oakland and people are feeling unsafe, going out and about, being on the streets, and what happened on friday night makes me fear that people are going to fear being in their own home. >> reporter: at least 89 people have been killed in oakland this year, putting the city on pace to exceed the 113 homicides from

last year. now, later this morning, the oakland naacp are going to hold a news conference regarding the city of oakland and what the organization says was the city's botched application for millions of dollars in state funding to fight organized retail crime, as we reported on friday the city missed the deadline to apply and therefore missed out on that money. the city blames one of its departments for failing to submit the application online. reporting live, bob redell, "today in the bay." 5:35. we're also continuing coverage of the ambushed-style killing of a southern california deputy. we're learning about the tremendous loss being felt by so many in the community of palmdale. >> lauren coronado shows us that emotional vigil that took place last night and the latest on the manhunt. >> reporter: a tragic loss in the palmdale community and greater law enforcement community. i want to show you a memorial

outside the palmdale sheriff's station. more than 1,000 people gathered at a vigil here last night to show their support and honor the 30-year-old deputy, ryan clinkunbroomer. ♪♪ >>. ♪ i once was lost ♪ ♪ but now i'm found ♪ >> reporter: a touching tribute, loved ones sharing stories and reflecting on the young deputy's life and the impact he left on the community. deputy clinkunbroomer described to be full of life, serving eight years as an l.a. county sheriff's deputy, a third generation member of law enforcement, following in the footsteps of his father and grandfather. he was also newly engaged and had just proposed to his fiance days prior to his murder. it was saturday night when deputy clinkunbroomer had just left the sheriff's station. he was waiting at a red light in his patrol unit when he was shot and killed. the shooter on the run and the

community now demanding justice. >> shocking, it's tragic. i mean, these are people who wake up every day and leave their families to protect us, and for something so senseless, it's heartbreaking and it's nice to see the community coming together and supporting this man and his family and all of our laugh. because that's something that's not happening enough lately. >> reporter: sheriff luna vowing to find the murder. surveillance video shows a car pulling up to the deputy's car saturday evening and taking off. the sheriff called that car a vehicle of interest and it's described as a 2006 to 2012 toyota corolla, dark gray in color. a $250,000 reward has been established for anyone who has information that leads to an arrest. reporting in palmdale, i'm lauren coronado for "today in the bay." barriers installed in san francisco's mission neighborhood to deter sex workers has not

fixed the problem, it's only moved the issue to another area. that's what neighbors on nearby shotwell street say. they say ever since the barriers were installed on capp street, they're seeing a spike in sex workers. they shared video sharing activity between 9:00 p.m. and 6:00 a.m. and some say it gets aggressive. >> it doesn't let us sleep, it doesn't let us step out after sunset, which our friends, our family doesn't feel comfortable visiting us in the evening. >> some are asking for the same type of a collapsable barrier, which are now in place on capp street. in a recent email to neighbors, police shared the city is actively trying to reduce the number of cars and may consider the change. happening today in san francisco, israel's prime minister is scheduled to meet with elon musk. it comes in the wake of recent

controversy generated ever since musk bought twitter. some civil rights groups accuse musk of allowing anti-semitism to flourish on the site now known as x. musk denies the allegation and has threatened to sue for defamation. he recently blamed antidefamation league pressure for a big drop in ad revenues. today's meeting in san francisco is expected to cover artificial intelligence and tech-related issues. netanyahu then heads to new york for this week's united nations general assembly meeting. new signs of relief for bay area renters struggling to make it in the bay. not only are bay area rents dropping, but august numbers declined at the highest rates in two years. one bedroom rental prices in contra costa county dropped nearly 5% year-over-year. alameda county had a similar drop. in san francisco, rents fell

about 4%, and the decline is slightly less for the peninsula and the south bay. moving you forward on capitola's recovery from winter storms. here is a live look at the wharf near santa cruz, which has been closed ever since sustaining severe damage in january. this week, the rebuild is set to start. crews are planning to install new decking and railings to make the wharf more resilient against future storms. the work is expected to wrap up sometime next year. cleanup under way in new england from that large storm that rolled through over the weekend. at one point lee was a hurricane, but not by the time it hit parts of maine with force. one person died there in a weather-related traffic accident, and the brunt of the storm hit western nova scotia before moving out into the atlantic last night. meteorologist kari hall is here this morning. you've been tracking another storm brewing in the atlantic?

>> yes, we're currently at the peak of hurricane season. september 10th is when we typically see a lot more activity in the atlantic, and we do have another storm that's developed that is now a hurricane called nigel. you can see it's well out in the middle of the open water in the atlantic and we are not expecting this to have a huge impact on a lot of land areas. right now it is a category 1 hurricane, very warm water out there. we are expecting this to continue to intensify. it is moving to the northwest at about 12 miles per hour. this is what we like to call a fish storm, one of those storms that stays out over the water, doesn't have an impact on land, but it could strengthen to a major hurricane as we go into the next few days. taking a look at that list of names, we've exhausted all of the ones up to nigel at this point and we can see that there is one more row of names left in

alphabetical order for the rest of the season. so most likely we may have to go into the greek alphabet if this kind of activity continues, as hurricane season doesn't wrap up until november 1st. at home, we're looking at quiet weather, cooler temperatures, and we're starting out mostly around 60 degrees. take a look at your microclimate and where you're headed. in spots like concord it's going to reach up to 82 today, 84 in san martin and morgan hill. in the north bay, we're looking at upper 70s today. we'll talk about what's ahead coming up. mike, you've been tracking a number of issues on the roads. >> i have. they're in the commute direction. the big concentration over here, south 680 toward sunol, we have a crash that's moved from the middle of the freeway to the left lane. it's in the fast lane there as you're coming down, you see the jam from bernal all the way to past the sunol exit. the merge is moving smoothly, easy drive out of livermore and

there. we don't usually see dolphins out there. this is high up in the coast there. so those warm waters from el nino and the change, on one day, watchers saw a pod of almost 1,000 dolphins. if you want to catch a glimpse, all you have to do is take a road trip. >> you don't have to travel far, to alaska, hawaii, to see whales. we truly have the greatest gathering of marine mammals on the entire planet right here in monterey bay. >> whale watcher tours in monterey bay happen throughout the day. you can actually catch the sunset while watching majestic animals dine on anchovies. >> that is amazing to see. >> i didn't know the pods were that numerous. >> how do you count that many?

50s. as we go throughout the morning, it's going to start to clear out and temperatures headed for the upper 60s at noon, feeling really comfortable. as we go to the south bay, in los gatos, expect a high of 82. it will be 84 in morgan hill and 79 in san jose. it will be in the upper 70s for hayward for today, while we'll see temperatures mostly in the low 80s for the inland east bay. then for the peninsula, upper 70s from palo alto to san mateo. san francisco reaching mostly into the 60s. we may see low 70s in the mission district. napa reaching 77. clear lake today, 82 degrees. our numbers are coming down just a bit. as we take a look at gilroy and what to expect over the next ten days, how about low 70s for wednesday and thursday, a nice, breezy wind picking up. cooler air moving in, but it will be a little warmer for the weekend, as well as the start of next week. we're looking ahead to see that there will be a chance of daily showers and thunderstorms for

scientists. they looked at nine key environmental factors and found that six of them are, quote, now well outside the safe operating space for humanity, end quote. that includes climate change. the study claims two of the three remaining factors, ocean pollution and our air pollution, are worsening. the only signs of improvement is the ozone layer, which we know we were using cfcs, the aerosol sprays and hair sprays and air-conditioning and things like that. we realized that was depleting the ozone and we cut back, and that's the only thing that's improving right now. >> no hair spray, obviously. americans care less about children having good manners compared to other countries. this kind of upsets me a little bit. that is according to new findings from kings college in london, which surveyed people in 24 countries. parents in the u.s. were the least concerned with having
