degrees, only a few low 80s here as we continue with the cooler trend, and we'll see that hold for the next few days. mike, you've got your eye on the tri-valley. >> we have some changes and that's where we typically have the most impact from overnight road work. highway 84 is moving much more smoothly than it was over the last half hour. there was slowing in both directions, even after crews are reported clearing. it looks like everything has smoothed out. 680 itself there may be an issue with a couple of on-ramps still closed from the overnight project, but overall the freeway moves slowly. back to you. >> thanks, mike. we begin with that breaking news, an emotional reunion near washington d.c. about an hour ago five americans landed on u.s. soil after years of imprisonment in iran. brie jackson is in washington

after he allegedly hit a man on a bicycle, then paid him off. video of the incident now going viral on social media. >> "today in the bay"'s kris sanchez is joining us with the latest. the public has a chance to ask questions about this today, right? >> reporter: right, the san jose city council will hold its regularly-scheduled meeting today. there's nothing on the agenda related to this. but we do know that people can show up during public comment and talk about anything that they would like to. so we could see somebody addressing the councilman. a downtown city worker is the one who witnessed this crash, though she didn't want to be identified, she did capture it on video. she shared it with san jose spotlight first, and it shows the councilman at the scene of that alleged crash at san fernando and 4th street not far from city hall last wednesday. the witness says she recognized the council member as the one getting out of his car and then talking with the man and then

handing over money, and that turned out to be about $40. we have a picture of the man's bike. he is unhoused. you can see the rear wheel is bent. the council member denies hitting the man's bike but says he did have a close call and he also admits giving the man $40 after he claims he was down on his luck. the councilman issued this statement to us, i am at city hall to work on my two top priorities, pedestrian and traffic safety, and homelessness. i'm glad i was able to personally help this man in some way. the city council meeting is coming up at 1:30 today. public comment usually starts first. we'll be tracking this story throughout the day and bring you updates. >> thanks, kris. well, a live look in oakland, this is where happening today council members consider a new resolution meant to boost the city's response to crime. council member dan kalb authored

the measure which includes increasing 911 dispatch staffing, new security cameras on ramps, funding for an academy for officers who transfer from other departments and help from the fed for certain crimes. the council meeting happens today at 2:00. emotions on display as people who live and work in san francisco's tenderloin demand a crackdown on crime and homelessness. attendees packed a meeting last night to send a message to supervisors. it took place the same day the medical examiner announced 84 fentanyl deaths in august, tying with january for the most fentanyl deaths ever. residents are angry about the crime and filth and the current injunction blocking the city from homeless sweeps. >> some federal judge living in her ivory tower can dictate

instead of having a democracy. >> my daughter says when she was walking to school, so much poop on the streets. it's very astonishing. >> i'm seeing it in my neighborhood. i'm two blocks from here. i'm worried about vigilanteism and i think we walk a dangerous line. >> the supervisor matt dorsey wants to have a limit of raising staffing levels from the current 1,475 to almost 2,200. a new deadline from striking auto workers threatening a wider strike if they don't reach a new deal with the big three automakers by friday. right now the strike impacts three plants, one for each, gm, ford and stellantis, which owns jeep, dodge and chrysler. it involves about 10% or 13,000 of unionized auto workers and gm says it's working to reach a

deal. stellantis also says it's continuing negotiations, but the latest impact includes u.s. steel idling a blast furnace in illinois due to the anticipated drop from automakers. taking a peek outside before the sun's arrival overlooking downtown san jose. nice and clear look there. kari has a look at our forecast for this tuesday morning. >> our days are getting shorter and we're also feeling slightly cooler. temperatures were heading towards fall, as we get a live look outside in san francisco. it's mostly cloudy and we're also at times going to see some fog and drizzle, at least the visibility is clear and it's mostly clear as you head toward brentwood. temperatures in the low 60s. we're going to have a cool morning not only here, but across the bay area, with a gradual warm-up and lots of sunshine. take a look at these high temperatures for this afternoon. morgan hill reaching 81 degrees and 79 in concord, upper 70s for

much of the north bay. we'll see about the same temperatures tomorrow, with very nice afternoons ahead. mike, these gas prices seem to get higher and higher. >> the ones i drive past, it looks like they rose overnight. sunnyvale's best to start is $4.87 at the costco, nothing below $5 in contra costa county, so we'll give you hayward in alameda county, $4.89 at the valero. and then the best i saw in solano county, $4.95 on sacramento street in vallejo. so tough picking out there. on a roadway, easy picking. a smooth drive for most routes. we are looking toward a disabled vehicle reported right around the bridge toll plaza, getting over from richmond to san rafael. you see how light the traffic is, just past the toll plaza

the time is 5:13. as we head to santa rosa, it is a foggy start. low visibility at times as you're heading out the door, and it's 51 now. it's going to be a cool start to the day, with a very mild afternoon. we're enjoying cooler than normal temperatures for many of our microclimates. i'll let you know if that continues coming up in a few minutes. from the north bay to the south bay, we're looking at san jose's live traffic. headlights northbound on 101. good, steady flow of traffic. no slowing right now. things have been getting busier earlier as we shift into the school year. tuesdays have shifted to a bigger commute. tough times yesterday. we'll see how things are shaping up coming up. good morning. very quiet on the market. the fed starts its two-day interest rate meeting today. there's no sense in making any

major money moves before we know what they're going to say on wednesday. we think we know what they're going to say, that they're not raising interest rates this time around. nevertheless, an unusual board this morning. the dow and nasdaq barely moved on monday. a lot of no movement. look at this, a small san francisco company is going to lay off 75% of its staff, according to the san francisco business times. no trading yet on cart, instacart, and it debuts on the nasdaq today starting at $30 a share, with its initial public offering or ipo. analysts say this is the driest year for ipos since 2009. and you remember what happened in 2009, the global financial crisis. the most recent ipo was arm, the chip manufacturer. shares in arm rose 25% on their first day of trading. elon musk says he may start

charging everyone to use x, what we used to call twitter. he says it's the only way to fight automated accounts for bots. it's also a way to make money, which x does not. x started charging for blue checks and that program was mostly a bust. musk denying tesla is in talks with the saudi government to build a factory there. he says a report by the "wall street journal" is utterly false. tesla needs to build new factories and saudi arabia has minerals critical to building batteries, but the kingdom owns the majority of the shares in the company lucid, which obviously competes with tesla. a federal judge has suspended a new california law that was designed to protect children online. the law known as the california age appropriate design code act got a yes vote from every single california lawmaker when it passed in sacramento last year. it would require creators of software and social networks to

assess ahead of time whether their product could harm children in some way before they release it to the public. it hadn't taken effect yet. if an app creator found the app might have some danger to children, it would have to ship that software with the filter set to maximum. you as an adult could turn them off, allow this sort of content, but the judge said this is a case of first amendment violations. we talk about that a lot, facebook is violating. that's not how the first amendment works. it does if you're california and telling software companies what to do. that's big time first amendment. >> thanks, scott. new this morning, a federal judge is allowing starbucks customers to sue over claims some of the chain's refresher fruit drinks are missing a key ingredient, fruit. the suit claims starbucks mango dragon fruit and others do not

contain the fruit. according to the claim, the main ingredients are water, grape juice concentrate and sugar. the claim goes on to argue that this is misleading, and have led to customers being overcharged. starbucks countered by saying that the products' names are only meant to describe the drink's flavors as opposed to their ingredients. but the judge rejected that claim. trending this morning, a new development in what some believe may be alien bodies recently presented to mexico's congress. a team of doctors actually are now performing x-ray scans to uncover more information. >> we have video of their work. doctors are calling the species mummified organic beings. each part of the single skeleton that was not put together. last week a journalist presented the remains during a hearing on ufos claiming they were found in

cooler. we'll continue to have some mild weather across the bay area. take a look at dublin. we're starting out in the low 60s here, a few clouds and sunshine, highs reaching into the mid to upper 70s. so it's definitely time to enjoy more time out there at the park, taking those long walks, as we are now seeing some cooler temperatures for the valleys. there won't be much of a change near the coast. in east san jose, expect a high today of 80 degrees. we're in the upper 70s, low 80s, antioch reaching 80 degrees. we're mostly in the upper 70s for martinez, pleasanton hitting 77, and in oakland today 71 degrees. low 70s for san mateo, while we'll see mid-60s in daly city. in san francisco, mostly mid to upper 60s for today. north bay temperatures hitting about 77 in santa rosa, novato, and 82 in ukiah. as we go through the forecast, looking ahead, daily showers and thunderstorms firing up for the

sierra, from today through thursday. but the good thing is that just in time for the weekend, and a lot of people from the bay area are heading there, it's going to be drying out. then we'll turn our attention to the potential of our first big rainmaker for the season next tuesday into wednesday. there could be scattered showers coming in, definitely looks like it's going to be wet for the pacific northwest. but also some rain chances for the bay area. that's towards the middle of next week, not this week. but we are looking at the possibility that some of our models are putting down some decent amounts of rainfall, anywhere from three-quarters of an inch of rain, to an inch of rain, for parts of the north bay. especially in the hills we could see higher rainfall totals. once again, that's beyond the seven-day forecast, so things could change between now and then. but in the meantime, it's nice and quiet, a steady weather pattern, and temperatures in the upper 70s and low 80s, even as we officially welcome in fall on the calendar, and looking at san

francisco's temperatures remaining in the upper 60s. mike, you're seeing a few changes? we're looking for little changes that we typically expect. highway 4, the last 15 minutes we've seen a few more yellow and orange sensors pop up out of antioch, toward pittsburg. highway 37 out of vallejo, right on schedule there as well. so no surprises. looks like the last couple of tuesdays have been pretty big commutes, so we're watching for that as folks go back to school, back to the office. yesterday's commute, honestly, there were a lot of problems here for 680, highway 4, the biggest for the early commute and 580 getting through dublin a little later on. we're watching spots, a little extra sensitive, no major issues as we take a look at the drive times. vasco drive at the limit here. highway 4 and 580 moving west, no problem. back to you. >> thanks, mike. 5:22 right now. very surprising, an unbearable

welcome back. it is 5:25 this morning. the recent exodus of businesses in san francisco now leaving an opening for ai companies to fill in some of the vacant space. the latest data shows about one-third of the city's office space is sitting empty, but city leaders are working hard to find new tenants, and right now they're seeing a spike in artificial intelligence companies. we spoke with the founder of one ai search company leaving miami for san francisco to be more in the center of things. >> san francisco is the beating heart of ai. it's the heart of the tech revolution right now. it made a lot of sense for us to move out here. we do recognize that the cost is higher here, but we think that the opportunity cost of not being in san francisco is greater. >> you may ask, what's enticing

those companies? for one thing, it's the money. san francisco is leading the charge in d.c. funding for ai artificial intelligence, which already pulled in more than $5 billion in investments. an unexpected visitor leads to surprise disruptions at the happiest place on earth. that's what happened when a bear sighting led to the partial closure of magic kingdom yesterday afternoon. wildlife agents eventually captured the bear. chopper video appears to show it being moved into a white tarp from a wooded area. visitors had no access to some areas of the park, leaving longer wait times in areas that remained open. experts tell "today" the bear was likely looking for food. >> there are approximately 4,000 bears in the state of florida now and the majority of the population is in the central part of the state. we're seeing more and more of these incidents where bears are seeing people and vice-versa. >> the bear was relocated to a

as we go throughout the late morning hours into the afternoon, a gradual warm-up as we head for upper 70s, reaching a high temperature at about 2:00 this afternoon, and already starting to cool back down by 4:00 to 6:00 today. so we are seeing some cooler than normal temperatures for many of our microclimates, with highs reaching into the upper 70s, and reaching 79 degrees in concord, while san francisco will reach a high of 68 degrees. we're going to settle into this pattern and we'll talk about any changes ahead coming up in the full microclimate forecast in a few minutes. >> we'll check with you, kari. we begin with breaking news. five americans detained in iran for years are now back on u.s. soil. new video of the emotional moment when the group touched down about 90 minutes ago at a military air field near washington. the group was freed as part of an agreement that gives tehran access to $6 billion in oil

revenues and five iranians detained in the u.s. brie jackson is following the developments and why the white house is taking some heat for the swap. she'll join us with a live report in our next half hour. homelessness at a crisis level in alameda county, and happening today supervisors may take new action. they're considering a state of emergency. "today in the bay"'s ginger conejero saab is live for us this morning. ginger, the county is saying that the current strategy that they have simply is falling short. >> reporter: that is correct, marcus. alameda county adopted a community plan that includes $2.5 billion of an investment in shelter, rental assistance and housing assistance for the county, but declaring an emergency declaration would extradite and focus resources on implementing and scaling it on a larger scale. as of early last year, 2022,

alameda county had at least 9,747 unhoused residents on a single night, 73% of whom were unsheltered. that number increased over 70% since 2017. the number of annual homeless deaths also grew considerably between 2018 and 2020. in 2021, over 1,100 alameda county residents died while experiencing homelessness. these are just some of the statistics that alameda county board of supervisors president cites in his recommendation to the board, urging them to approve a county-wide state of emergency on homelessness that would direct the office of homeless care and coordination to lead an emergency response and give recommendations within 60 days. now, if approved, the emergency declaration would provide additional tools to the county, including extradited procurement of critical items, expanded services, and the ability to request additional resources

from the state and the federal government. now, this would not be the first time that an emergency declaration on homelessness would be declared in the state. los angeles did so in december of last year, 2022, to help get people off of the streets. earlier this year there was a group of san franciscans urging mayor london breed to make a similar declaration. the vote on this emergency declaration is expected to happen at 1:00 this afternoon at the board of supervisors meeting. we'll be watching to see how this unfolds. in san francisco, ginger conejero saab, nbc bay area news. >> you drive around alameda county, and you see that there is a big issue there. ginger, thank you. oakland leaders suddenly facing an unexpected twist in the search to land a new police chief. it comes as they consider a new measure to combat crime in oakland. "today in the bay"'s bob redell joins us live this morning. bob, a new report finds former

police chief leronne armstrong should have never been fired. >> reporter: correct. this is according, laura, to a 57-page report by an independent arbitrator who was commissioned by the city, and this report that we learned about yesterday recommends that the discipline imposed on former oakland police chief leronne armstrong should be reversed and removed from his personnel record. you might recall that mayor sheng thao fired armstrong in february after an independent investigation claimed armstrong mishandled cases involving a sergeant who hit a parked car in a garage. but yesterday's report says the investigation was inaccurate and that internal affairs presented the parked car incident as an accident instead of hit-and-run. they suggest the city considers reinstating armstrong. the city says it will consider armstrong for a short list. a spokesperson for armstrong tells us his attorneys have reached out to city officials

about possible reinstatement. if that does not occur, armstrong could take legal action against the city. there was the former chief after yesterday's report came out. >> i think everything is on the table. i think i would be open to have discussions about what next steps are. >> reporter: yesterday oakland mayor sheng thao issued a statement saying her decision to fire the chief nine months ago was not based on the findings of that initial report. quote, my decision was based on mr. armstrong's knee-jerk response to the outside investigator's report and the poor judgment it revealed. now, this is a live look in oakland, where later today the city council will consider a measure put forth by council member dan kalb that would add more people to the 911 call center to cut down on hold times, would install new security cameras along on-ramps and pay for a lateral police academy for officers who transfer from other departments,

former city council members are urging the public to show up at today's 2:00 p.m. council meeting to show leaders they are fed up with the violent crime in oakland. reporting live, bob redell, "today in the bay." >> people want to be heard. thank you, bob, for the very latest. happening today, a benefit concert for farmworkers and their families who survived the shooting rampage in half moon bay. seven people died in january in the mass shooting, but organizers say the heavy winter storm also left many of the farmworkers without a job due to flooding. the nonprofit earth to table is organizing today's event, which will feature musical acts and speakers. it starts at 7:00 p.m. at menlo park's guild theatre. a small ray of light for the town of lahaina. the historic banyan tree is showing signs of life. it shows a group of leaves sprouting alongside charred

foliage, which experts call a positive sign in the tree's long-term recovery. it's said to be the largest banyan anywhere in the u.s. a volunteer team is trying to spur its regrowth. a live look at the state capitol, where unionized truck drivers plan to gather after car vanning from across the state. they're voicing support for a bill that would slam the brakes on potential automated hauling services. drivers fear artificial intelligence may soon lead to self-driving trucking services and they argue the risk is too great without human operators. they're now calling on governor gavin newsom to sign the bill approved by the legislature. they say it would preserve some 200,000 trucking jobs statewide. health workers are raising concerns about a recent cdc draft that would loosen hospital mask guidance. right now it is only a draft of

startup conference starts today. that event is considered a big deal for investors, and rookies alike. now, it's a chance for startups to connect with investors and learn the ropes of how to begin a tech business. and this year one of the speakers will be nba superstar shaquille o'neal. let's turn to a giant in her own right, meteorologist kari hall, with a look at what's going on weather-wise. a lot of people in town and they want to know what's going on. >> we're seeing typical san francisco weather right now. it's foggy, may be drizzling before it eventually clears up for a few hours into the afternoon. we are going to see the clouds linger through at least noon and then becoming mostly sunny. as we go into the day, only in the 60s for a high this afternoon, reaching the upper 60s there. you head across the bay to oakland, it will be 71 degrees, and reaching into the upper 70s for dublin and 77 for san jose. about the same in novato as well

as santa rosa, so we'll get a look ahead to the rest of the week in a few minutes. mike, the drive looks predictable as well. >> as far as the pattern goes. i'm concerned about the volume bumping up over the last couple of weeks. north 101 through san jose, traditional slowing right at 540. started about 5:35. we have more slowing here. this is because it looks like there's a minor crash. now there may be three lanes blocked as crews arrive on scene. this is westbound 580 right around spring town. it's just past where vasco joins in and folks are feeding out of brentwood, discovery bay, and now we're at about 25 minutes as you're driving through the area. more slowing off of marsh creek. but then this crash right around the bend, coming toward dalton, may be what's slowing things down as well. we'll track this critical section for contra costa county down toward alameda county. later on today, we're looking at 6:40, the a's are playing, but we always warn about the potential for more crowds

right now at 5:45, we head over to pleasant hill. as you're heading to work, temperatures in the upper 50s. we'll see the clouds linger through about 10:00. as we go through the day, it's going to be nice and comfortable. jacket for the morning, sunglasses and short sleeves for the afternoon. headlights a little lighter westbound 580 near the dublin interchange because some folks are held up near spring town. a number of lanes are blocked by a crash. we're also watching the buildup for the south bay and the bay bridge coming up. president biden will speak at the united nations in new york this morning, with a lot of world politics on the line. >> but not all world leaders will be there. >> no, not all world leaders. good morning. there are five permanent members of the u.n. security council, four of them won't show up. russia for obvious reasons, but

the leaders of the uk, france aren't coming, that's very unusual. it does mean president biden will have the stage to himself, at least when it comes to powerful countries. video of his address last year. but it also speaks, perhaps, to the weakening influence of the united nations at a time of crisis. president biden will speak a lot about the war in ukraine today, president zelenskyy will be there as well. zelenskyy is going to travel to washington after that. the other thing to watch at the u.n. today, the relationship between canada and india. yesterday canadian prime minister justin trudeau made a blockbuster revelation to the canadian parliament. agents, he says, from the government of india, are suspected of murdering a canadian citizen in canada. india denies this, but says they consider the sikh man who was killed a terrorist. america's close ally is very angry with india, at the same time the u.s. is trying to get

india more on its side and less on russia's side in the midst of fighting in ukraine. plus, the economic battle against china. the president of iran will also speak at the u.n. video here of the captives landing on american soil just moments ago. our brie jackson will have a live report on that situation coming up at the top of the hour. a plan put together by house speaker kevin mccarthy to keep the government open seems to be a bust. republicans to the right of mccarthy say they won't vote for it. the government runs out of funding at the end of the month. now, here is the problem and why you should plan for the government to shut down. as you know, you need agreements from both sides of congress. the house and the senate for anything to happen in congress. republicans have a majority in the house. democrats in the senate. the republicans on the house side of the capitol want to make big, big spending cuts. what kevin mccarthy is offering

them is not enough. so they're saying no to their own plan. if they do, the government shuts down. if mccarthy caves and agrees to something his party likes better and they pass it, it goes to the senate and they're going to say no. they're definitely going to say no, and the government shuts down. at this point it's not really a battle on the edges to keep the government open. it's a battle to shift the blame to the other guy. one way or the other, think about a government shutdown. passports are a good example. they're funded separately, so passport workers will keep working, but the federal building you might go to to pick up a passport would likely be closed. the mail will keep moving, the post office has its own funding. government workers will not be paid. their hundreds of thousands of those. we'll talk more about the effects as we get closer, but, again, end of the month. >> thanks, scott. happening today, oakland leaders vote on a plan that may soon lead to a new soccer stadium on coliseum property. the measure would authorize an

exclusive negotiation deal with the group that owns the roots men's soccer team and the oakland sole team. it's on vacant property. it would hold about 10,000 fans. the committee last week unanimously approved the plan, but there's one possible holdup. the current owners, the oakland a's have previously indicated an unwillingness to sell. tuesday morning already. weather-wise, it's been kind of nice. >> it's been really nice and it continues. we're not going to see things changing drastically over the next few days. and actually the temperatures we've been feeling is a little bit cooler than normal. take a look at santa rosa. we're headed up for 77 today. we're usually seeing highs this time of year in the low 80s. in concord, we're looking at a high of 79, the average high temperature for this date is 85 degrees. so we're also seeing cooler than normal temperatures in san

francisco. livermore, as well as san jose. we're getting a stronger ocean breeze, as showers and thunderstorms develop each day over the sierra. we're going to see that continue for today, tomorrow and thursday, and if you're going there for the weekend, it does clear up in time for the weekend. dryer air coming in, but that's as we watch another storm system approaching that could affect the bay area for early next week, with a possibility of some rain. and that could be our first big rainmaker for the season, if this does pan out. once again, with it being in the middle of next week, things could change between now and then. but it does show at least about a quarter to possibly an inch of rain for some of our north bay coastal ranges, so we will once again be keeping an eye on that for the middle of next week. in the near term it looks nice and quiet. we're going to officially welcome in fall late friday night. for the east coast, it's not going to be until saturday. we'll have our first day of fall

welcome back. you're watching "today in the bay." turning to our climate in crisis, california is the latest and largest government to sue major oil companies for, quote, lying about climate change, end quote. now more than two dozen u.s. cities and states from coast to coast have filed suit against big oil, and yesterday nearly 80,000 people took to the streets of new york to demand an end to fossil fuels, as the

climate crisis worsens. climate reporter chase cain talked to protesters as word of california's lawsuit spread throughout the crowd. [ crowd chanting ] >> reporter: a turnout four times larger than expected, the march to end fossil fuels kept a uniform message across a remarkably diverse crowd. basically a slice of anyone affected by the climate crisis, so everyone. the demonstration showed a lot of frustration at president biden, while celebrating at least two members of congress who joined the march through manhattan, and just a few blocks away, another politician made the kind of news this crowd demanded. five major oil companies sued by the state of california. [ crowd chanting ] >> reporter: accusing them of deception and inflicting billions of dollars of damages from climate fueled disasters. they want a disaster recovery

fund paid for by big oils. >> too many wildfires, too many droughts and floods. this is a serious moment, and we cannot address this issue, with all due respect, to all the conversations and panels unless we get serious about addressing the issue, and the issue is fossil fuels and the issue is the deceit from these companies. >> these fossil fuel corporations have been lying for decades, they've been conspiring to block action and spread disinformation. there could be a million lawsuits against them. >> i think it's historic, unprecedented, and it's absolutely awesome. >> kudos. i hope others join in. >> the oil industry does not want this pursued in court. both shell and the american petroleum institute told nbc they think climate change should be addressed by congress, not the court system, claiming that phasing out oil and gas will drive up energy prices and
