and elon musk talking about charging everyone to use x, the former twitter. this is "today in the bay." and good morning to you on this terrific tuesday. i'm marcus washington. >> i'm laura garcia. we'll check that terrific commute, terrific traffic. it's not light out there just yet. we're waiting for the sun's arrival. the days are getting shorter and we're approaching fall. we're also seeing cooler temperatures. as we head to pittsburg and see our day planner with our temperatures this morning, starting out in the low 60s, at lunchtime a perfect 73 degrees, and reaching up to 80 for today in the 4:00 hour. as we go into the evening, temperatures start to drop, the wind picks up. we are getting that strong ocean breeze to help moderate temperatures. for san jose, expect it to reach

77, while san francisco will be in the upper 60s. we'll talk about any changes ahead. mike has a crash in san jose. >> it's northbound 101 at oakland road. now, no major injuries, from what i see. after the initial crash things sorted out to a smoother drive. so this is kind of what you would expect for the traffic flow. it's just north of where we typically see the backup. we see more slowing near sjc, typical for a tuesday. heavier volume expected for the roadways. west 580 is moving nicely. we have some lanes blocked by a crash just past vasco around spring town and that may be adding to traffic. we begin with breaking news. an emotional reunion near washington, d.c. just about three hours ago. that is when five americans landed on u.s. soil after years of imprisonment in iran. >> "today in the bay"'s brie jackson is live in washington

this morning. that swap leading to their freedom is drawing some praise, as well as criticism. >> reporter: that's right. good morning, marcus, laura. the white house celebrated the release of the five americans who touched down this morning at the military base right outside of washington, d.c. meanwhile, republicans criticized the bill -- excuse me, the deal, accusing the administration of paying a ransom, which they say would only encourage the taking of more americans in the future. [ cheers and applause ] >> reporter: five americans wrongfully imprisoned in iran now back on u.s. soil. >> our fellow citizens are free after enduring something that i think it would be difficult for any of us to imagine. >> reporter: their release is part of a controversial prisoner exchange that gives tehran access to $6 billion in oil revenues frozen by u.s. sanctions. the biden administration contends that money can only be

used for humanitarian needs. >> we have a very rigorous set of controls on the way the regime can request withdraws for funding. >> reporter: republicans criticized the deal. >> if you believe they're going to use this money only for humanitarian purposes, then i have a mountain and a ski slope to sell you in kansas. >> the biden administration's record of appeasement and squandered leverage has left americans less secure. >> reporter: today president biden meets with world leaders at the united nations. on the agenda, protecting human rights and tackling threats, including russia's war on ukraine. >> because of the support of the allies and partners, and let's not forget because of the leadership of this president, ukrainians have been able to really have some success on the battlefield. >> reporter: the president urging congress to approve an additional $24 billion in aid to ukraine. >> we'll look through it. the one thing i think the house

is concerned about is what's happening in america first. >> reporter: ukraine still fighting for freedom as a major foreign policy deal sets five detained americans free. and ukrainian president zelenskyy is scheduled to come to capitol hill on thursday to speak with lawmakers and to meet with president biden at the white house. >> so much going on. brie, thanks for the very latest. well, developing right now, a san jose council member facing some heat after allegedly striking a man on a bicycle and then paying him off. video of that incident is now going viral on social media. >> "today in the bay"'s kris sanchez has been following the story. she joins us from our newsroom this morning. it may set up for an interesting council meeting a few hours from now. >> reporter: this is just a regularly scheduled council meeting, so there's no action item related to what happened with the city council member. however, the way that it works, as you may know, is that public comment is open to anybody to talk about anything.

so we'll see if anybody shows up during public comment to address the councilman. a downtown city worker is the one who witnessed this, and although she did not want to be identified, she did capture the aftermath on video. the witness shared it with san jose spotlight, and it shows san jose city councilman arjun batra at the scene of the alleged crash at san fernando and 4th streets last wednesday. city hall is at 4th street and santa clara. the witness says she recognized council member batra as the one out of his car talking with that man, and then handing over money, and that turned out to be $40. we have a picture of the man's bike. and not that it matters, but that man is unhoused. you can see the rear wheel is bent. the council member denies hitting the man's bike but does say he had a close call with him. batra also admits to giving that man the $40 after he claimed that he was down on his luck. councilman batra issued a

statement reading in part, i am at city hall to work on my two top priorities, pedestrian and traffic safety, and homelessness. i'm glad i was able to personally help this man in some small way. now, that city council meeting is at 1:30 this afternoon. public comment usually comes pretty close to the beginning. we'll be tracking the story throughout the day. we'll bring you updates. >> thanks so much. a live look in oakland where happening today, council members consider a new resolution meant to boost the city's response to crime. council member dan kalb authored the measure. it calls for specific new actions, including increasing 911 emergency dispatch staffing to cut down on caller hold times, new security cameras along freeway on-ramps, funding for a lateral police academy for officers who transfer from other departments, and additional help from feds to solve certain crimes, as well as consolidate -- confiscate

illegal weapons. the council meets today at 2:00 p.m. emotions on display as people who live and work in san francisco's tenderloin demand a crackdown on crime and homelessness. attendees packed a public safety meeting last night to send a message to supervisors. the meeting took place the same day the city's medical examiner announced 84 fentanyl deaths in august, tying with january for the most monthly fentanyl deaths ever. people who live there are not only angry about the crime and filth, but the current injunction blocking the city from homeless sweeps. >> so the city is going to go to pock because some federal judge living in her ivory tower can dictate. >> my daughter, when she was walking to school, so much poop on the streets. it's very astonishing. >> i'm two blocks from here. i'm worried about vigilanteism,

and i think that we walk a very dangerous line if we get to that. >> supervisor matt dorsey today plans to proposal a charter amendment raising sfpd staffing levels by more than 700 over five years from the current 1,475 to almost 2,200. caltrans is getting the early word out, this is about a major highway closure this weekend in the south bay. starting at 9:00 p.m. friday, northbound highway 87 will be closed between julian and highway 85. that closure is scheduled to last through the early morning hours monday. now, this will allow crews to complete a makeover, including repaving and upgrading rails and barriers. some restaurants in san jose's san pedro square fear it will impact weekend business. >> this location really depends on the traffic flow from south to here, 87 is the main freeway

to come to here. so if they close, it's going to really affect the businesses. >> detours will be in place and a similar weekend closure next month is scheduled to impact the southbound direction. 6:08 right now. a new deadline from striking auto workers threatening a wider strike if they don't reach a new deal with big three automakers by friday. right now the strike primarily impacts three plants, one each for gm, ford and stellantis, which owns jeep, dodge and chrysler. it involves about 10% or 13,000 of unionized auto workers. automakers are not directly commenting on the deadline. a live look out in walnut creek. meteorologist kari hall is tracking what we can expect from the weather today. do we need to start the morning out with a jacket? >> yes, it has been pretty cool. temperatures mainly in the upper

50s, low 60s, and in some parts of the bay area we're waking up to clouds. we're seeing that over oakland right now as you get ready to head out, and temperatures in the low 60s with a light wind. we won't see much of a warm-up throughout the morning until we see the sky clearing and we'll reach a high of 71 degrees. but then very mild weather for the inland areas, with santa rosa reaching a high of 77 degrees. we'll see a high of 77 in san jose and livermore. we'll talk about any changes ahead as we go throughout the rest of the week coming up. mike, we're seeing gas prices going up. >> yeah, they're getting tougher. sunnyvale's best is $4.87 at the costco on lawrence station road. we couldn't get below the $5 mark in contra costa county, so we have alameda county, hayward, the $4.89 at valero. and the best in solano county, $4.95 on sacramento street.

the below $5 prices are getting tougher to find. on the roadways we find a big slowdown out of the altamont pass, west of 580, the crash still there blocking a couple of lanes, and that is causing quite a backup for 580 and folks coming down off of vasco road, brentwood, byron, discovery bay. in the south bay, a closure for 87, we wanted to show folks what's going on. starting friday night, it's closed. you can go south to 101 and back up around, or you can go toward 85, 17, and add some more miles. it will add more time. back to you. one of the most widely used kitchen staples is now experiencing a price surge. coming up, why you may want to stock up before prices go higher, and how climate change is being blamed. plus, turning fast food into fast fashion. we venture inside an art exhibit taking fan favorites and turning

good tuesday morning to you. it is 6:14. we're heading to the north bay with a look at novato, starting out cloudy, temperatures in the upper 50s. it's a cool start to the day. but it's going to be very comfortable for the afternoon,

and a lot of sunshine that continues in our forecast. we'll talk about that and what's ahead in the weekend forecast coming up. we're looking at the bay bridge where the earlier crash did look like it was completely cleared for all lanes near the toll plaza. it wasn't a major problem, but things are moving a little better now. over in walnut creek, there may be an issue coming out of pleasant hill, concord, and toward highway 24 there's a crash. we'll talk about the details coming up. happy tuesday. very quiet on the markets. the fed starts its two-day interest rate meeting today. there's no sense in making any major money moves until we know what they're going to say on wednesday. we think we know what they're going to say, that they're not raising interest rates this time around. nonetheless, kind of an unusual board this morning. the dow and nasdaq barely moving on monday. a lot of no movement. a small san francisco company, no movement there, they say they're going to lay off about 75% of staff. this according to the san francisco business times. cart, no trading yet.

that's because it's instacart and it debuts on the nasdaq today. it will start at $30 a share with its initial public offering or ipo. analysts say this is the driest year for ipos since 2009. you remember 2009, the global financial crisis. the most recent ipo was arm, the chip manufacturer. shares at arm rose 25% on their first day of trading. elon musk says he may start charging everyone to use x, what we used to call twitter. he says it's the only way to fight automated accounts for bots. it's also a way to make money, which x does not. they started charging for blue checks and that program was a bust. musk also denying tesla is in talks with the saudi government to build a factory. he says a report by the "wall street journal" is, quote, utterly false. tesla needs to build more factories if it wants to hit production targets and saudi arabia does have minerals

critical to building batteries, but the kingdom also owns the majority of shares in the electric car company lucid, which obviously competes with tesla. and a federal judge has suspended a new california law designed to protect children online. the law known as the california age appropriate design code act got a yes vote from every single california lawmaker when it passed in sacramento last year. it would require the creators of software and social networks and all those sorts of products you use on the computer to assess ahead of time whether they could harm children in some way before releasing it to the public. the law had not taken effect. the judge says state government restrictions are in violation of free speech. marcus and laura, youtube just demonetized russell brand's youtube channel. brand has been accused by four women of sexual assault. he can still publish on youtube, he just can't make money off the videos. nbc has not talked to the people

making allegations against brand and brand himself denies any wrongdoing. >> thanks, scott. new this morning, you may want to jump on making that italian dinner, olive oil supplies may be going dry before the end of the month. prices are soaring to record highs due to severe drought. it's due in large part to extremely dry weather in the mediterranean leading to a 130% price spike compared to a year ago. it's even leading to reports of large-scale olive oil theft in spain. some fear supplies may become exhausted before next month if stocks are not replenished, but october is usually the time of year when fresh harvests arrive. turkey has suspended its bulk exports until november 1st. trending this morning, a new exhibit putting food fashion in the spotlight. >> from jackets with pasta prints to dresses that look like chocolate wrappers, fashion and

food or food fashion is taking social media by storm. there's a new exhibit called food and fashion that opened up last week in new york's fashion institute of technology. it's mixing the two worlds for fashion foodies. creators say the beginning of the fashion starts with king louis who used fashion and high food to build luxury items export business in france. now food fashion has become more literal with food prints and bags, exactly like your favorite dishes. it looks like your favorite dishes, i think they're trying to say. >> maybe a bento box purse or something. >> in japantown in front of the restaurants, they have plastic foods. >> right, exactly. >> make a little hat. >> oh, that's nice.

it's fashion because they say it is. >> i guess so. i will not be wearing that. >> a scrambled egg jacket there? >> no mcdonald's sweater. >> the yolk is on us. we have beautiful weather, no matter what you're wearing today. i do think you probably need a jacket to start, as we're getting a mostly clear sky. as we take a look at berkeley, we are going to have a mostly cloudy start to our morning and temperatures in the low 60s. at 10:00 we're still about in the same place. a slow warm-up today as we remain in the 60s. we will get sunshine. it's going to be a pleasant afternoon. the seven-day forecast is coming up at the bottom of the screen. gilroy will hit a high of 79 degrees and about the same in cupertino. for much of the east bay, it's in the upper 70s, walnut creek

reaching 78 degrees, and mid-70s in redwood city. in half moon bay, we're back to the mid-60s again today, and also seeing those 60s continue for san francisco. in the north bay, sonoma reaching a high of 75, and 82 in ukiah. so as we go through the forecast, we're going to settle in this pattern and we're going to see showers and thunderstorms developing each day between today through thursday for the sierra. if you're going to tahoe for the weekend, all of that rain clears out just in time, and they were also talking about how green it is in september there. we're also maybe seeing some green on the radar for the bay area as we go toward the middle of next week, our first possible atmospheric river hits the pacific northwest. some of that could move into northern california, perhaps the bay area. we'll be watching that very closely. some of the early runs of our compute models for the middle of next week putting down about an inch of rain for some of our coastal ranges in the north bay,

while the rest of the bay area could possibly get about a quarter to three-quarters of an inch of rain. so once again, we'll be watching that. that's beyond the seven-day forecast. in the near term, we're getting ready to flip the calendar to fall. first day of fall really on saturday and we'll see temperatures in the low 80s throughout the weekend. mike, you're seeing trouble in the east bay again? >> a slow morning developing because of a couple of crashes. the latest one is southbound 680 just past the exit there, watching for more slowing. once it kicks off this time, this is when the build is happening getting toward walnut creek. we'll track that. meanwhile, the rest of the east bay shows a smooth drive but there may be a crash westbound 37 where things always slow down as well. 580, huge backup, and vasco road also slows as they meet over in the tri-valley. that's a big crash as well coming westbound 580. it keeps the dublin interchange lighter. back to you. >> thank you, mike.

one-third of the city's office space is sitting empty. but city leaders are working hard to find new tenants, and right now they're seeing a spike in artificial intelligence companies. we spoke with the founder of one ai search company who is now leaving miami for san francisco to be more at the center of things. san francisco is like the beating heart of ai, it's just the heart of the tech revolution right now. and so it made a lot of sense for us to move out here. we do recognize that the cost is higher here, but we think that the opportunity cost of not being in san francisco is greater. >> now, you may be asking what's enticing these companies. for one thing, money. san francisco is leading the charge with funding for ai, artificial intelligence has already pulled in more than $5 billion in investments. 6:26 right now. an unexpected visitor leads to some surprise disruptions at the happiest place on earth. that's what happened when a

black bear sighting led to the partial closure of disney's magic kingdom in florida yesterday afternoon. state wildlife agents eventually captured the bear. chopper video appeared to show it being moved in a white tarp from a wooded area. visitors had no access to some areas of the park, leaving longer wait times in areas that remained open. experts tell "today" td the bear was likely looking for food. >> there are approximately 4,000 bears in the state of florida and the majority of the population is in the central part of the state. so we're seeing more and more of these incidences where bears are seeing people and vice-versa. the bear was located to a remote area in a forest close by. a twist in the search for a police chief in oakland. >> we will exhaust all my legal

swap with iran just about 24 hours ago. the mission was to take the stuff and get out. >> a car plows into a lululemon store in berkeley overnight as thieves jump out to steal merchandise. new details this morning from witnesses at the scene. plus, an extreme measure. leaders considering a state of emergency to handle the flood of unhoused people living on their streets. we're breaking down their new plan to tackle the crisis. this is "today in the bay." good tuesday morning to you. thanks for starting your day with us. i'm laura garcia. >> i'm marcus washington. let's get a look at the forecast. meteorologist kari hall has been tracking that. sun is starting to come up over san jose. >> yes, and it's a great sunrise. all clear. we're keeping the comfortable temperatures. as we go throughout the morning, we're going to continue to see sunshine, but, yes, you do need a jacket for the start of the

day. this afternoon, not so much. take a look at our trend. we're going from upper 50s right now to low 70s at noon, and then as you're making your way home, going into the afternoon and into the evening, we're staying in the 70s today, hitting a high of 77 degrees. one of our warmer spots will be fairfield, reaching 82, and compare that to the 66 in half moon bay. still seeing a wide range in temperatures, but really settling into cooler than normal temperatures for the next several days. we'll talk more about this and what's ahead for the weekend in a few minutes. >> thank you very much. we do begin with breaking news, five americans detained in iran for years are now back on u.s. soil. this is new video of the emotional moment when the group touched down overnight at a military air field near washington. the group was freed as part of an agreement that gives tehran access to $6 billion in oil revenues in exchange for five iranians detained in the u.s.

just into our newsroom, police in berkeley are investigating a large-scale smash-and-grab at lululemon that happened on 4th street near the marina when thieves backed a car into the store. the guard tells our photographer six people in black hoodies grabbed merchandise and told them not to call police or they would shoot him. >> the only thing in my head is i hope they don't do anything to me. take what y'all want, just don't touch me. this is not my stuff, i just work here. >> the guard was not injured. so far, no details from police on possible suspects or the amount of stolen merchandise. homelessness now at the crisis level in alameda county, and happening today supervisors may take new action. they're considering a state of emergency. "today in the bay"'s ginger conejero saab is live for us this morning. ginger, the county's current strategy, a lot of people say is just simply falling short. >> reporter: that is correct,

marcus. alameda county has adopted a community plan that includes $2.5 billion of investment and shelter housing and rental assistance, but declaring a state of emergency would extradite and focus resources on implementing and scaling to the county's response. as of early 2022, alameda county had at least 9,747 unhoused residents on a single night. 73% of whom were unsheltered. that number increased over 70% since 2017. now, the number of annual homeless deaths grew considerably between 2018 and 2020, and in 2021, over 1,100 alameda county residents died while experiencing homelessness. these are just some of the statistics that alameda county board of supervisors president cites in his recommendation to the board, urging them to approve a countywide state of emergency on homelessness.

that would also direct the office of homeless care and coordination to lead an emergency response and then give recommendations within 60 days. now, if approved, the emergency declaration would provide additional tools to the county, including expedited procurement of critical items, expanded services, and an ability to request additional resources from the state and the federal government. now, this would not be the first emergency declaration on homelessness in the state. los angeles did so in december of last year to help get people off of the streets, and community groups have also urged san francisco mayor london breed to make a similar declaration. as far as alameda county is concerned, that vote is expected to happen at 1:00 this afternoon. we'll be keeping an eye out on how that vote goes later today. >> from alameda county to san francisco county, look, it is an issue out there. ginger, thank you. taking a look at oakland now, where leaders suddenly are

facing an unexpected twist in the search to land a new police chief. it comes as they consider a new measure to combat crime in oakland. "today in the bay"'s bob redell joins us live this morning. a new report finds former police chief leronne armstrong should have never been fired. >> reporter: correct. good morning to you, laura. this is a 57-page report by an independent arbitrator who was commissioned by the city that we found out about yesterday, recommends discipline imposed on former oakland police chief leronne armstrong should be reversed and removed from his personnel record. you might recall mayor sheng thao of oakland fired armstrong in february after an independent investigation claimed armstrong mishandled a case involving a sergeant who hit a parked car in a garage. yesterday's report says that investigation was inaccurate and that internal affairs presented the parked car incident as an accident instead of a hit-and-run. the independent report suggests the city considers reinstating

armstrong. the city's police commission, which is looking for a new police chief right now, says it will consider now armstrong for its short list. a spokesperson for armstrong tells us his attorneys have reached out to city officials about possible reinstatement. if that does not occur, armstrong could take legal action against the city. here was the former police chief after yesterday's report came out. >> i think everything is on the table. i think, you know, i would be open to have discussions about what next steps are. >> reporter: yesterday oakland's mayor sheng thao issued a statement saying her decision to fire the chief nine months ago was not based on the findings of that report, quote, my decision was based on mr. armstrong's knee-jerk response to the outside investigator's report and the poor judgment it revealed. let's go to a live look in oakland, where later today crime will be on the minds and the focus of the city council as the city council will consider a

measure put forth by council member dan kalb, that if approved would add more people to the 911 call center, would install new security cameras along freeway on-ramps and would pay for a lateral police academy for officers who transfer from other departments. a former city council member is urging the public to show up at today's 2:00 p.m. council meeting to show city leaders that they are fed up with the violent crime in oakland. reporting live, bob redell, "today in the bay." 6:38 this morning. let's take a live look at the state capitol, where unionized truck drivers plan to gather this morning after caravanning from across the state. they're voicing support for a bill that would slam the brakes on potential automated hauling services. drivers fear artificial intelligence may soon lead to self-driving trucking services. they argue that the risk is too great without human operators. they are now calling on governor gavin newsom to sign a bill

approved by the legislature they say would preserve some 200,000 trucking jobs statewide. maybe you felt some of the shaking late last night and early this morning, a series of small earthquakes, at least five in the central valley, but they were felt in parts of the bay area. the largest, a 4.4 around 9:15 last night, centered near modesto. a lot of people felt it from san francisco to redwood city, san jose, even capitola. my husband yelled, there's an earthquake! the most recent at 3:21 this morning was a 3.1 centered near patterson. i posted about all the earthquakes we were feeling, kind of like you see that cluster right there near the patterson area. >> all in one day. >> i got the alert on my shake alert app and the voice comes on and it's, like, shake alert, and they're telling you to drop, cover, hold. >> did you feel it?

>> i didn't feel a thing, but i was mad that it woke me up. okay, i don't feel anything, i'm going back to sleep. good to have that shake alert app. >> it is. we're starting out, hopefully things continue to be nice and quiet for the bay area. here is a look at our forecast for gilroy. we're starting out with a few clouds and temperatures in the mid-50s. and then at lunchtime it is 71 degrees. very nice. we're going to have a beautiful day ahead, once again, as we wrap up these last few days of summer for the next several days. so we're going to reach into the mid-70s in mountain view, 75 as well in fremont, and martinez reaching 77. we'll see about those same temperatures in santa rosa and novato, and san francisco in the upper 60s. mike, you've been tracking an alert for i-580. >> it was declared an alert by chp, and just as i changed the maps and lettering, we go back to blue because chp says, hey,

united nations at a time of crisis. president biden will speak a lot about the war in ukraine today. ukrainian president zelenskyy will be at the u.n. as well. zelenskyy will travel to washington after that. the other thing to watch at the u.n. today, the relationship between canada and india. yesterday canadian prime minister justin trudeau made a blockbuster revelation to the canadian parliament. agents from the government of india are suspected of murdering a canadian citizen in canada, he says. india denies this, but says they consider the sikh man who was killed a terrorist. so this comes at a delicate time, america's close ally, very angry with india, at the same time the u.s. is trying to get india more or less on its side, and less on russia's side in the midst of fighting in ukraine and the economic battle against china. the president of iran will

also speak at the united nations. video here of the american captives landing on american soil this morning. a lot more ahead on the "today" show in about 15 minutes. a plan put together by house speaker kevin mccarthy to keep the government open seems a bust. republicans to the right of mccarthy say they won't vote for it. the government runs out of funding at the end of the month. here is the problem and why you should plan for the government to shut down. as you know, you need agreements from both sides of the capitol, the senate and the house, and the president, for that matter, for anything to happen. republicans have a majority in the house, democrats have a majority in the senate. the republicans on the house side of the capitol want to make big spending cuts, and what mccarthy is offering them isn't enough. so they're saying, no, they say no long enough, the government shuts down. if mccarthy caves and agrees to something that his republican party likes better and they pass it, it goes to the senate, and then they say no, which they're going to say, and the government

shuts down. at this point it's not really a battle on the edges to keep the government open. it's a battle to shift the closure blame between the parties. one way or the other, be thinking about a shutdown. passports are a good example. they're funded separately, so passport workers at the state department keep working, but the federal building you might go to pick them up would be closed. the mail will still move, the post office has its own funding. government workers will not be paid during the shutdown, and there are hundreds of thousands of them. marcus and laura, we'll talk more about the other effects as we get closer and this gets more and more likely. >> thanks so much, scott. 6:48 right now. happening today, oakland leaders vote on a plan that may soon lead to a new soccer stadium on coliseum property. the measure would authorize an exclusive negotiation deal with the group that owns the roots men's soccer team and the oakland sole women's team.

it's on property currently used for overflow parking and will hold about 10,000 fans. a council committee last week unanimously approved the plan, but there's one possible holdup, the current owners. the oakland a's have previously indicated an unwillingness to sell. the next two games could be critical, one for the giants, they face the diamondbacks today and tomorrow in arizona. now, arizona right now has a two-game advantage in the race for a wild card spot. speaking of wild, a wild fourth quarter in last night's monday night football game. this is between pittsburgh and cleveland. t.j. watt scooped up a fumble to score the late touchdown as the steelers won the game 26-22. the steelers will head to las vegas to face the raiders sunday night. that game airing right here on nbc bay area. 6:49 right now. a install ray of light for the town of lahaina devastated by

the maui firestorm. the historic banyan tree in the center of town is showing signs of life. videos from hawaii's department of land and natural resources show a group of leaves sprouting alongside charred foliage, which experts call a positive sign in the tree's long-term recovery. the 150-year-old tree is said to be the largest banyan anywhere in the u.s. a volunteer team is working to care for it to try to spur regrowth. happily, i got to see the banyan tree with my family and maui is a really huge part of our lives. this is a picture we took -- actually, it was about a year ago, this time last year there of the banyan tree. my dad took me as a little girl to maui, i now take my kids. the tradition continues. hope to see new life to our region and our hearts go out to the people continuing to suffer there. >> and seeing your whole family in the tree gives an idea of how large the tree is. >> no kidding. it's pretty spectacular.

the new life is just wonderful to see. >> absolutely. >> nature is very resilient. let's get a look at our weather this morning, starting out beautiful as we are waking up to a few clouds here and there, especially in oakland, as you get ready to step out the door. it's going to clear out over the next few hours and it's going to be a beautiful day. we've enjoyed slightly cooler than normal temperatures and that continues with our highs here reaching into the mid-70s for later today. we'll see a high of 77 in san jose, cupertino reaching 79 degrees, and low 80s for morgan hill. also low 80s for antioch, mostly 70s for much of the east bay, with fremont reaching 75 degrees there, and 76 in redwood city. daly city, we're back to 65 degrees again today, and in the mid-60s for much of san francisco. we're going to have a breezy wind throughout the day, and starting out with clouds in parts of the north bay.

but as santa rosa clears out, we'll see a high of 77 degrees. each day we're going to see a chance of showers and possibly thunderstorms for the sierra. that stays away from the bay area, at least for now. but then as we open up the view, see what could be coming our way next week, there's the potential that we could see our first atmospheric river hitting the pacific northwest and some of the models bring it very close to the bay area, starting late next tuesday into wednesday, with a chance of rain that could be coming in. so looking early at some of those models, it does show the rain estimate for next week could be anywhere from about a half to three-quarters of an inch of rain for much of the bay area, to possibly over an inch for some of our coastal ranges in the north bay. so that's something we're watching beyond the seven-day forecast. let's enjoy the sunshine and mild weather for now as our temperatures continue to reach into the upper 70s inland. our first full day of fall will

u.s. soil. >> this is new video of that emotional moment when that group touched down overnight at a military airfield near washington. the group freed as part of a prisoner exchange agreement. it gives tehran access to $6 billion in oil revenue and returned five iranian citizens who were detained in the u.s. new this morning, police in berkeley investigating a large-scale smash-and-grab at a lululemon. it happened on 4th street near the marina when thieves backed a car into the store. the guard tells our photographer six people in black hoodies grabbed merchandise and told him not to call police or they would shoot him. the guard was not injured. so far, no details from police on possible suspects or the amount of stolen merchandise. alameda county supervisors are considering an extreme new measure to tackle the homeless crisis. today they'll debate declaring a countywide state of emergency. if approved, it would allow the office of homeless care and

coordination to lead an emergency response and provide new recommendations within 60 days. alameda county adopted a community plan, including a $2.5 billion investment for shelter, housing and rental assistance, but supporters say an emergency declaration would speed up the process. oakland leaders facing an unexpected twist in the search to land a new police chief. a 57-page bombshell report from an independent arbitrator recommends the firing of former police chief leronne armstrong should be reversed and the firing should be removed from his personnel record. mayor sheng thao fired armstrong in february after an independent investigation claimed he mishandled cases. the report also suggests the city is considering to reinstate armstrong as chief. yesterday oakland mayor sheng thao issued a statement saying her decision to fire the chief was not based on the findings of
