that's when we'll see our valley temperatures in the 90s, and the coasts and the bay will reach into the 80s. we're also going to be watching out for a high fire danger by the end of the week due to the dry and breezy conditions. we're still enjoying the nice weather today. very comfortable as we head for the mid-70s in oakland, upper 70s in san jose, and we'll see some low 80s for fairfield and concord. we'll talk more about those hotter temperatures in just a few minutes in the full microclimate forecast. >> thanks. new overnight, oakland police are investigating a deadly shooting that happened last night around 9:30. an oakland police sergeant told our photographer on the scene that officers responded to the shooting on arthur street and the victim had died. police have not released any information on a person of interest, nor a motive, but we will bring you more information as it comes in. we are learning more about the tributes in place for late senator dianne feinstein. she'll lie in state at san francisco's city hall on

wednesday. that is open to the public. then thursday, a funeral service will be held at the war memorial and performing arts center. the service will not be open to the public, but will be streamed online. today city hall will be open for people to sign condolence books. the public is welcome between 10:00 a.m. and 4:00 p.m. last night, governor newsom appointed laphonza butler to fill the seat of the late senator. governor newsom issued this statement, quote, an advocate for women and girls, a second-generation fighter for working people, and a trusted adviser to vice president harris, laphonza butler represents the best of california, and she'll represent us proudly in the united states senate. laphonza butler is the president of emily's list, a political action committee that raises money to help elect democratic female candidates who support abortion rights. prior to leading, she served as president for the local 2015,

the union that represents thousands of nursing home and home care workers. ginger conejero saab will join us live ahead in our newscast with more on this developing story. payments on student loan debts are resuming, after a pause due to the pandemic. and it's going to impact millions of people who are just trying to make it in the bay, not to mention across the country. "today in the bay"'s bob redell joins us live from cal state east bay where students are waking up to the news. this comes after quite a long pause on those payments. >> reporter: you are correct. good morning. you'll recall that president trump paused repayments on federal student loans at the start of the covid-19 pandemic, this was a pause that was extended eight times, so we're talking about a period of roughly just over three and a half years for students at cal state, and colleges and universities across the country. yesterday the pause came to an end, which means these monthly

payments will start up again. however, not all borrowers' bills will be due starting right now. the department of education is encouraging people to log on to their student aid portals and check who their servicer is, because it could have changed over the past three years for those struggling to pay. the department has implemented the new save plan that's an income-driven repayment plan aimed to ease the burden on borrowers. it could significantly lower your monthly payment if you qualify. >> if you make less than about $15 an hour or more if you have a family to support, youdon't have to pay anything, because we don't think student loans should come before necessities. >> it's easier for people to qualify for, it's supposed to be easier to fill out the applications for it. >> reporter: if you miss a payment, the department of education also set up a 12-month

on-ramp program, that means borrowers won't be reported to credit or debt collection agencies for a year. however, your interest will still be accruing. all details can be accessed at the studentaid.gov website. reporting live, bob redell. >> boy, that interest really accrues quickly. thanks, bob. all eyes are focused on the manhattan courtroom today, a civil trial surrounding former president donald trump's business practices is expected to get under way this morning. "today in the bay"'s drew petrimoulx joins us live from washington to break down what this case is centering on, despite the looming legal case, trump not taking a break from that campaign trail at all. >> reporter: he's not. good morning, laura. ahead of today's trial, the former president was on the campaign trail and on the offensive, making stops in california on friday and iowa on sunday. a live look at trump tower this morning.

a $50 million civil suit brought by the new york attorney general, where prosecutors allege that trump, his businesses and some of his children, the value has been wildly exaggerated for years. last week a judge ruled that trump and his associates committed real estate fraud. a civil trial could determine whether mr. trump loses control over some of his famous properties. >> what are the implications of this civil fraud trial for mr. trump? >> well, if he loses, and the reason why he's apparently coming tomorrow is he doesn't want to lose, if he has to pay $250 million, if he and his sons can no longer conduct business in new york, that's a fatal blow. >> reporter: now, this is new video of trump arriving at trump tower last night ahead of the

trial. mr. trump has denied all wrongdoing and has called the judge in the case deranged. trump faces four criminal trials, including two at the federal level, one in georgia and another in new york state. this civil case will be heard as a bench trial, meaning no jury. the former president is expected to be in the courtroom today and tomorrow before leaving new york on wednesday. however, sources tell nbc news his plans could change. back to you. >> we'll continue to follow. thank you so much. 5:07 right now. the man accused of killing a san francisco tech executive is due back in court. momeni is charged with killing cash app founder bob lee. this morning a judge is expected to set a date for trial. lee was stabbed to death in april. a san jose man accused of killing his mother with fentanyl is due in court. 40-year-old bradley dexter is expected to be charged this afternoon. dexter admitted to lacing his

mother's drink with fentanyl back in june and he's accused of a violent attack on his father. good news for commuters this morning, highway 101 on the peninsula is back open hours ahead of schedule. caltrans reopened the southbound lanes around 8:00 last night, that's nine hours before the planned reopening at 5:00 this morning. the closure began friday night so crews could work to replace a bridge from the 1930s. caltrans says a similar closure of the northbound lanes is scheduled in two weekends. the agency says the weekend closures allow crews to build the new bridge in a shorter amount of time as opposed to over a three-year period. have you bought your ticket yet? the $1.04 billion powerball jackpot is the game's second largest this year. >> and the fourth largest in the history of the game. the drawing is tonight. good luck. we were talking about it in the newsroom today, what we would do. >> we've got to get a pot together. are we doing that?

>> let's get that going. >> feeling lucky. >> we're all lucky, we're all winners when it comes to the forecast. it was such a beautiful weekend. hopefully you had a chance to enjoy it outside. it was much cooler than what we sometimes see for this time of year. starting out cool this morning, temperatures in the upper 40s in parts of the north bay with santa rosa right now 48 degrees. it is 51 in fremont and 56 in san mateo. as you're heading to work in fremont, it's in the low 50s for now, jacket weather for the start of the day, and then the rest of the day temperatures will be nice and mild. it's going to be another very comfortable afternoon, with hayward reaching 75, although 75 in san mateo and mountain view, los gatos reaching 79 degrees, and also upper 70s for much of the north bay. tomorrow, some of those temperatures start to go up. we'll be in the low to mid-80s. we'll talk about how hot it gets by the end of the week. mike, i'm sure for you it's getting harder to do this part

good monday morning to you. right now at 5:14, as you head out in the north bay, it is a cold start. we're checking out napa where it's right now 49 degrees. we'll stay in the 40s for the next couple of hours, but once the sun comes up, we're in for sunshine and gradually warming temperatures. this afternoon is looking nice. we'll talk about some really hot temperatures ahead coming up in a few minutes. and we are looking at san jose north 101, just picked up the volume over the last ten minutes. a good burst of traffic. things calmed down right here, not unusual. the slowing doesn't usually slow up on our sensors for another 25 minutes. we'll continue to follow this and i'll let you know if there's anything weird on the south bay. good morning. very happy monday to you. it's the first day of the fourth quarter, october 2nd, the year is winding down. i usually send my adult children a reminder, the start of

october, christmas is much closer than it appears. get on it. i'll send it out today, but i figured you could use a reminder as well. the supreme court is back on the bench hearing cases today. one of those cases will be the constitutionality of the consumer finance protection bureau, a government agency that has really had wall street on its toes, and says it's helped return $16 billion to 192 million americans. never really been popular with conservatives. the entire idea belonged to elizabeth warren. a group of payday lenders have sued, saying the bureau is too independent. the head of microsoft expected to testify in the google antitrust trial today. microsoft's ceo satya nadella will describe the difficulty microsoft had with launching binge and the web browser in the face of what it may term unfair competition from google. and apple is releasing a

patch to its ios operating system to cool down those iphone 15s. some users, particularly those with the iphone 15 pro, say their phone got so hot in some situations they can't hold it. one of the things that apple discovered, other than just a bug in the operating system, was all of those apps in the background were updating themselves to have the new operating system. they're all doing it simultaneously, and that's really straining your phone and that's part of the heat. this software fix should take care of it. >> it's interesting it's a software issue. >> rather than send it in, they can just push out a software patch. >> i have to go back a couple of minutes, your reminder about christmas. my sons informed me yesterday that it's 85 days away.

possibly really ignite and spread quickly in a fire will definitely be much dryer. the warm weather stays throughout the weekend. it's been so nice to have a break from the hot temperatures, and we're in the upper 70s again today, upper 60s near the coast. as we take it into the day tomorrow, it already starts to heat up and we'll see parts of the south county, the inland east bay and north bay reaching into the mid-80s tomorrow afternoon. take a look at wednesday. if you thought we were done with summer, it's back. we're going to see temperatures in the 90s for the middle of the week and getting hotter as we approach the weekend. but we're also seeing a very active storm pattern across the pacific northwest. unfortunately, for now, that does stay away, staying well to the north of us, as high pressure builds, and our next chance of rain is not until next week. so we are going to eventually see some rain coming back to the bay area before now. it is going to dry out and really warm up over the next few days. take a look at morgan hill, what

to expect with our temperatures, up to 80 today, and then we'll be in the mid-90s for thursday, friday, saturday. it's going to be hot this weekend. hopefully you didn't cover the pool or drain it or anything, because we are going to have more hot weather coming our way. and temperatures will be heating up for the middle to end of the week, but then coming back down by the end of the weekend. mike, you have a new crash in richmond? >> we do. in the last few seconds i learned chp says it's a much more serious crash. they issued an alert for westbound 80. that's your commute direction coming through richmond, right around hilltop drive, reports of a crash, an overturned vehicle in the lanes right now. we see some quick slowing showing up. that will be a factor for the time being. the alert chp issued is called a sigalert and that means they expect it to be there at least 30 minutes in a major commute spot. we have another alert, but this is going away from the bay, and this is a deadly crash. i'm not even sure it's a deadly

morning. >> i told you there were missing details. i was hoping this was not a deadly crash. indeed, chp did confirm it is a deadly crash, and they're not sure if it's more than one person that may have suffered some life-threatening or deadly injuries. the slowing we saw eastbound 80 seems to be clearing. they may be clearing lanes. we're not sure exactly the details because the speed sensors and the details, again, don't match up 100%. this is eastbound, away from us, toward american canyon. that will be a factor in you're traveling in the north bay toward cordelia. this is a big deal as far as the commute goes, westbound 80, this crash involving an overturned vehicle and some debris in the roadway. this is at hilltop as you're traveling west in your commute direction, so this is not good for the morning commute, either. fortunately, we're not talking about as severe injuries, as best we can tell right now. this hopefully will see progress as we continue to follow. a build for highway 4 and 37, those are the trouble spots

typically, but richmond is proving to be extra slow because of that crash. the rest of the bay showing a smooth flow of traffic. i have seen low clouds floating around a bit. we are seeing that as you head toward the coastline and oakland as we take a live look at our camera, getting started with temperatures that are cool across the bay area. as you're stepping out in berkeley, it's in the mid-50s and partly to mostly cloudy throughout much of the morning into the afternoon. it's going to stay cool for this time of year, at least for another day. but we are in for some hotter temperatures after such a nice and cool weekend. today we're going to reach into the upper 70s in santa rosa, and also 79 in novato, with 79 expected the high temperature in martinez today. fremont, san jose, headed for 77 degrees, and mid-70s for much of the peninsula. we'll talk about midweek warming and an increased fire danger, and we'll talk more about that coming up in the full

microclimate forecast. 5:33 right now. laphonza butler was named late yesterday to late senator dianne feinstein's seat and the appointment is breaking barriers. the late senator made her final journey home over the weekend. ginger conejero saab is live in san francisco. ginger, good morning to you. a lot has transpired in just a few days, since the senator's passing. >> reporter: that is correct. good morning to you, kira. and some political experts are applauding governor gavin newsom's choice in laphonza butler and the speed he has named someone to fill the now vacant seat in the senate. laphonza butler expected to get to work very soon, as early as tuesday, to cast votes in the senate and take care of california's interests. now, governor newsom's choice is also being seen as one that is not interfering with candidates who have expressed their interest in running for senator

feinstein's seat in the next election, namely adam schiff, katie porter and barbara lee. some say this appointment will open the gates for butler's name to be thrown in the mix. butler will become the first openly gay u.s. senator from california and the second black woman to represent the state in the senate. butler is no stranger to the political world and her appointment is seen as a powerful one. the president of emily's list, butler has led the political action committee to raise money to help elect democratic female candidates who support abortion rights. butler has also served as a union president for seiu local 2015, the union that represents thousands of nursing home and health care workers. >> this is a solid pick by the governor. laphonza butler has impeccable credentials, she's well known from her work with emily's list, from her work on labor and campaigns in california.

she's well respected up and down the state. i think she'll make a great representative. she'll represent california well in the senate. >> reporter: as the welcomes come in, the nation also bids farewell to the longest-serving woman in the senate. senator dianne feinstein came home to the city she loved this weekend, san francisco. she will lie in state at san francisco city hall wednesday, which will be open to the public. then on thursday a funeral service will be held at the war memorial and performing arts center. that service will not be open to the public, but it will be streamed online and as early as this morning, those who want to continue to pay their respects to the late senator can do so at city hall. you can sign condolence books. that is open to the public and that will begin at 10:00 and last until 4:00 in the afternoon. so as you mentioned, a lot developing. we will continue to follow this story as the week progresses.

the value of their real estate holdings at trump's corporation when applying for loans. the new york attorney general says trump overestimated his own wealth by more than $3.5 billion. now, this is a civil trial. trump is not in danger of going to jail the way he is in his other four criminal cases. however, he's very much in danger of losing control of his own company. new york state could take away trump's licenses to do business in the state. he could even be forced to give up the trump tower. among the people expected to testify, trump's own former attorney, michael cohen, one of the very first to level the accusation that trump lies about real estate holdings, back when he testified under oath before congress in 2019. trump's children also listed for testimony, including ivanka trump. the purpose of his daughter's testimony a bit unclear.

she was not part of the trump company and she's named as a witness for the plaintiff. the new york state attorney general. but that may not be voluntary. we don't expect donald trump to testify today and the hearing is expected to last about 11 weeks. >> we'll continue to follow. always something happening. thank you, scott. a massive search effort at point reyes national seashore has come up empty handed so far. a shark attack was reported to the coast guard just before 11:00 yesterday morning at wildcat beach. it's a remote part of the park in west marin county, only accessible by walking five miles from one of two trail heads. a witness reported seeing a shark attacking three people. two were able to make it back to shore, but the third remains missing. kaiser workers are planning to strike this week. it would be the biggest health care strike in u.s. history. 75,000 kaiser permanente health care workers are set for the

three-day strike. it would begin wednesday. doctors and nurses aren't striking, but workers, including medical assistants, call center employees, and emergency department technicians could really impact the operations. they say they have faced staffing issues and have been asked to do double the work. >> we're calling kaiser executives to bargain in good faith and to fix our short staffing. >> kaiser says it has hired thousands of workers already to address the staffing issues and says if the workers do decide to strike, its hospitals will stay open. but some non-urgent appointments will be rescheduled. here we go, san francisco's fleet week moving forward, full steam ahead. yesterday the first navy ships arrived in the embarcadero. the navy destroyer is expected to come in later today. on wednesday, the public will be able to take tours onboard. then on friday the parade of ships will pass under the golden

the sky clearing out as we go into day, but of course today we're watching the bay. we're going to see temperatures in the mid-50s. it's a cool start. and then as we go throughout the day, it's going to head for the upper 60s, a mix of sun and clouds and breezy winds into the afternoon. across the bay in oakland, it will reach 75 degrees and also 75 in hayward and mountain view. a lot of these temperatures a little cooler than we typically see for the second day of october. and we are going to be heating up into the next couple of days. look at that, by tomorrow we're seeing some low to mid-80s, even upper 70s. we'll talk about the warming trend and also the fire danger in a few minutes. mike has been tracking quite a few major issues on the roads. >> the biggest impact to the traffic to your commute right here is westbound 80, three vehicles involved in a crash. one of them is overturned here westbound 80, your commute direction, coming down from highway 4 to the bay bridge. we typically track that travel time. we're at almost a half hour now because of this slow stretch.

we need at least two tow trucks is neither is on scene right now. that's in richmond. farther north i-80 has another crash, heading out of the area, counter-commute, and it's not showing any slowdown. it's a big concern because at least one person has been killed as a result of this crash. again, this is as you're heading toward american canyon. we have your typical slowing for your drive for highway 37 and highway 4 starts to show the build. this is not a surprise. these are right on pace for your typical morning commute. a little slowing showed up at the dublin interchange. more shows up now heading toward sunol out of pleasanton. there is a blockage for springtown if you're going eastbound 508, it's currently blocked by a disabled vehicle, so a note if you're heading off of the dublin interchange and trying to get toward livermore. we have early clearing for south 101, but northbound, in a couple

good monday morning. the time is 5:46, as you're heading out in antioch it is 59 degrees. all clear. may dip a few more degrees around sunrise. a nice warming trend as we have one more day of mild temperatures. we'll talk about warming ahead and the high fire danger in the full microclimate forecast. it's 5:46, so we might expect based on last week's traffic flow, more backup at the bay bridge. it is building, but a lot of this traffic is held up on westbound 80. a crash in richmond is slowing traffic down a lot as you're traveling down the upper eastshore freeway. we'll bring you any progress we have and maybe we'll try and get you some sort of timing as well. >> sounds good. 5:47 right now. the federal government is open for business. >> "today in the bay"'s scott mcgrew joins us. an absolute shocker, like the olden days when compromise came

into the story. >> compromise, bipartisanship. that's how you get things done in washington. some people really had forgotten that. president biden speaking about the continuing resolution, which keeps the government open another 45 days. so that's not a great solution, it doesn't solve any of the arguments over spending, but at least it means government workers will get paid and the doors to government offices will stay open. you recall there was a group of about 20 republicans who kept voting spending bills down, forcing house speaker kevin mccarthy to turn to democratic votes for this continuing resolution. as you might imagine, turning to the 20 democrats made the 20 ultra conservatives furious. they're planning to vote mccarthy out of the speaker's position, but he says somebody had to be in the adult in the room. >> are you worried? >> you know what, if somebody

wants to remove because i want to be in the adult in the room, go ahead and try. i think this country is too important. >> you could say political pundits did not give mccarthy enough credit. forced between choosing between his office as speaker and the country, a lot of people thought he would pick the office. he picked the country. bipartisanship, after all, is what keeps washington working. even if the conservative republicans in the house had convinced their colleagues to pass their version of a spending bill, it would never have gotten past the senate, which is majority democrat. the house has to give the senate something it can accept, and of course, vice-versa. critically missing from the cr is any mention of money for ukraine. it was left out to speed up the vote and dampen arguments. but president biden wants congress to vote on more money as soon as possible. most republicans and democrats actually do support more money to ukraine.

some in congress argue we should spend more money on our own border before we defend ukraine's borders. video of refugees crossing into eagle pass, texas, to present themselves to u.s. authorities. a reminder, that's how our immigration and border laws are set up. the people turning themselves into border patrol are doing it the way congress prescribed. congress makes the rules. it's up to congress to change it. last major change to u.s. immigration was in '86. a lot going on today. the u.s. supreme court returns to the bench to hear arguments, one of the biggies is abortion medication. another about the future of the consumer financial protection bureau. we'll talk about that in business news in a half an hour. and we were just talking about donald trump's return to court today in new york, as a judge tries to decide the civil punishment for trump for what the court says was his company's decades of fraud against banks. >> a lot to follow there. thank you, scott. 5:50 right now.

this week the nation, the entire nation, will hear the warning tone of an emergency alert. it will happen wednesday as a national emergency alert test. it will start at 11:20 a.m. and last a minute. two parts, one test will happen on radio, broadcast, cable. the other on cell phones. the emergency alert test is supposed to make sure if anything happens, the entire nation will get an emergency alert. this morning 49ers fans sure are riding that high this morning, after that record-breaking performance by christian mccaffrey. did you see it? the red and gold now one of only two undefeated teams in the nfl. right in the first quarter, mccaffrey takes no time getting into the end zone. it's his 13th consecutive game with a touchdown, breaking jerry rice's record. that's just the first of four touchdowns by cmc. the 49ers beat the cardinals 35-16, to improve to a perfect

4-0. you can watch the niners take on their long-time rivals the dallas cowboys at levi's stadium this sunday right here on nbc bay area. coverage starts at 4:00 p.m. now to the giants, brandon crawford may have hung up his cleats after 13 seasons. fans are speculating the long-time shortstop played his final game last night. the 36-year-old mountain view native is a free agent. he has not decided if he'll play next year, but he said numerous times he would like to continue playing for the giants. at oracle park last night, crawford was taken out of the game in the top of the ninth to a two-minute standing ovation from the crowd. crawford won two world series championships with the team. we already lost brandon and now we're looking at losing brandon crawford. i love the era of the brandons. >> what are you going to do? we'll see what they do.

we're saying good-bye to summer. >> it's been nice to have a cool down, but it will be heating up. we're not completely done with summer temperatures, as we talk about what's now and what we're going to see ahead. warmer temperatures from wednesday through sunday, where our valleys will hit the 90s, and even the coasts and the bay will be in the 80s. we're going to see dry and breezy conditions in the hills, which will elevate the fire danger. it's also something we quite often have to watch in the month of october. and our temperatures will head for the upper 70s in cupertino today, still some of the same weather we had from over the weekend. morgan hill reaching 79 degrees. we'll see a high of 80 in walnut creek today. a few more of those low 80s, and oakland today, 75, and we'll see 70 for a high in daly city. mostly upper 60s and low 70s in san francisco. for the north bay, we're headed for 82 in clear lake, while

santa rosa will see a high of 79 degrees. looking at what's happening across the region, still a very active storm pattern for the pacific northwest, but all of that staying well north of us, as high pressure continues to build. and that's going to make those temperatures ramp up as we go toward the middle to end of the week. but looking ahead to next week, there will be some rain chances moving in starting next monday. but in the meantime, we are going to have a big spike in temperatures. we are definitely not done with summer yet, with our highs in livermore going from low 80s to mid-90s for this thursday into friday, and then the weekend gradually the temperatures come down into next week. as we take a look at our inland highs, we're going from 80 today to 85 tomorrow, to 88 degrees on wednesday, and up to the low 90s by thursday and friday. mike is still tracking that crash in richmond. >> this is a big disruption to the morning commute. it's west 80, just about hilltop drive. we still have one, probably two
