showed to our investigative unit overnight that seems to reveal more of the story. summer is over, but fire season is peaking. the latest reminder on why you need to stay prepared year long, and a look at the warmer temperatures you can expect to see this week. also, a historic swearing in. a live look at our nation's capitol, where today laphonza butler will become california's interim senator, replacing the late senator, dianne feinstein. we're live in washington breaking down what's on tap. this is "today in the bay." good tuesday morning to you. thank you for starting your day with us. i'm laura garcia. >> i'm marcus washington. we want to start with breaking news this morning, new details overnight in an accident involving a self-driving cruise taxi in san francisco. a woman pedestrian suffering life-threatening injuries. >> it happened late last night at 5th and market near the

powell street b.a.r.t. station. at the time police suggested a second car may be involved. overnight cruise representatives showed our investigative unit the video, and he tells us the video appears to confirm the claim from cruise that its car did not strike the victim initially, and it was actually another car that did, a black sedan, which then left the scene. that video has not been released. police last night would not confirm if the second car was found, but claims its car had started a hard brake before making impact. our thom jensen is working to find out more. stay with us. he'll have a live report at 5:30. if you're on the go, you can stream us online at nbcbayarea.com or on our app wherever you stream. now to the east bay, where two fires yesterday had a lot of folks nervous. those flames racing through brush, coming close to homes.

a reminder, we're not clear when it comes to fire season. this morning we have team coverage on the ongoing threat. meteorologist kari hall is tracking the warmer temperatures we expect to see this week, but first "today in the bay"'s bob redell is live for us in the east bay with more on the warning to residents out there. >> reporter: yeah, and the warning is, obviously, you want to have defensible space if you live in a wildland interface area, and the other warning is that we're not over yet with the fire season, even though it is october and right now it is cool out. but here in the east bay those temps are expected to rise this weekend into the upper 80s, low 90s. this was the scene yesterday afternoon in oakland, where a fire burned a two acre hillside behind several homes, and unfortunately set fire to one of those homes. the man who lives in that home was not hurt, but he tells us that he and his neighbors had been concerned about the weeds on that hillside for quite some

time, and says ironically, the owner of the hillside had cut down the weeds yesterday just before the fire. oakland fire says the cause of that fire is under investigation, but confirmed that, yes, workers were clearing out brush on that hillside prior to the fire. >> that's why there was such a fire, because the weeds had grown so high. i was just finishing lunch and i look out the window, expected to see blue skies, and all i saw was brown. >> september, october, and sometimes early november, can be some of our most dangerous times, so it's definitely not the time to let our guard down. >> reporter: also yesterday, another wildfire along a hillside in martinez. this one burned three acres and came close to homes, but they never caught fire. contra costa fire says that fire is also under investigation. meteorologist kari hall is here right now. we're expecting warmer

temperatures this week? >> yeah, it's going to feel very much like the middle of summer, with our highs inland reaching into the mid to upper 90s. so this is what's ahead, after such a nice break from the high heat, we're going to see our temperatures warming up starting today, but some of the warmest days will be tomorrow through saturday. once again, valleys reaching into the 90s, even the coast and the bay will heat up. we're looking at an elevated fire danger as we get breezy winds in the hills. for today, it's just a little warmer than yesterday, novato headed for 84 degrees and 83 in livermore, san jose reaching 82. as we take it into tomorrow, we'll see upper 80s and low 90s. once again, this will not be the peak of the heat. we are expecting to reach some of our hotter temperatures by thursday into friday. so i'll have more on that, as well as that fire danger and when we could see some cooler air coming up in the full microclimate forecast. >> we'll look forward to checking back with you.

in just a few hours, history will be made in washington when the woman tapped to fill the seat of late senator dianne feinstein will be sworn in. "today in the bay"'s brie jackson is live in washington with a preview. a lot of californians are really calling this a landmark moment for our state. >> reporter: yeah, that's a sentiment we're hearing around the country. good morning, laura. so laphonza butler is the first openly lesbian senator to serve california and the state's second black female senator. her appointment makes good on a long-held promise from governor newsom to appoint a black woman. she's set to be sworn in by vice president kamala harris at around noon pacific time. she's currently president of the emily's list super pac in washington but formerly served as an adviser to harris' 2020 presidential campaign. right now butler lives in maryland, but she owns a home in los angeles, where she is

expected to make her permanent residence. governor newsom is following through on his long-held promise to send a black woman to the u.s. senate, and speaking to reporters yesterday in san francisco, he expanded on what led him to appoint her. >> the ability to be a dynamic on the outside that moves the needle on the inside. few people as skilled as laphonza butler to understand the push-pull in terms of how to move things and actually accomplishing something. i think she's in many ways more qualified than a vast majority of folks that hold elected offices. >> emily's list raises money to help elect democratic female candidates who support abortion rights. butler is the mother of one child she shares with her domestic partner. meanwhile, final farewells to the woman butler replaces in the

senate, the late senator dianne feinstein. she lies in state at san francisco city hall tomorrow from 9:00 a.m. until 7:00 p.m., and the public is also welcome to attend her funeral on thursday afternoon on the steps of city hall. people will also be welcome to sign a book of condolences. feinstein died thursday night at the age of 90. she was the longest-serving woman in the u.s. senate. >> yeah, it is a big loss to our community. we also will stream that funeral on thursday, which is said to be private, live. thank you very much. later this morning, san francisco mayor london breed will help kick off fleet week, and some people in the bay area already got a sneak peek at what to expect in the skies above. the blue angels yesterday made a pass over san francisco before landing at oakland airport. the familiar roar certainly a sound of relief for those who feared that a government

we take a look at what to expect as we go into the weekend. we're looking at highs on friday reaching 85 degrees. that's really warm if you're just sitting out in the middle of the sun. and as we go toward the end of the weekend, we're going to see slightly cooler temperatures coming in. it will be warmer today with some upper 80s in morgan hill, low 80s for milpitas, and then for the east bay, we're headed for 87 in concord, walnut creek, and 78 in oakland, near the coast we're in the upper 60s and low 70s. palo alto will reach a high of 84 degrees, and low 70s in san francisco. we'll talk more about our microclimates and what's coming up. mike is trying to find cheaper gas prices. >> trying to confirm them. remember the low i questioned in san pablo? the owner just updated the report. it's still a low in the area, but it's $5.09 at great gas. that's 50 cents higher than reported yesterday. santa clara's best is $5.25 right here on washington street

instagram. europe has passed some strict laws about online advertising. a 22-year-old man is suing elon musk after he says musk promoted and endorsed misinformation about his identity. benjamin brody has hired the same lawyers who successfully sued alex jones. he was not involved in a fight caught on video and circulated on the internet. he wasn't even there. at one point, one of the fighters has his mask pulled off and internet users identified that fighter as ben brodie, even though it wasn't. musk never specifically identified or named him online, but did retweet and comment on tweets that claimed he was involved. the lawsuit against musk says, quote, ben and his family's experience of seeing him defamed bid one of the most powerful men on earth warped their entire sense of reality, leaving them stunned, confused and afraid.

the head of jpmorgan is already using ai to replace some work. jamie dimon says he predicts the next generation will work three and a half days a week. and a big snack company is holding a strategy meeting to try to figure out how to deal with ozempic and other drugs that depress appetite. less hunger, fewer cheez-its sold. the head of the company says says we are not complacent. ozempic prescriptions are up 300% last year. snackmakers say they haven't seen a change in their numbers yet. now, what is the plan for the cheez-it maker? they won't say. it's not clear they have one. but they're at least aware this exists as a problem, and it's one i hadn't really thought of. because this has been a huge trend, and if that's going to stick around, a lot like ai, companies better figure out how to deal with it. >> maybe the cheez-it prices will go down, which would be

bay, 47 right now in sonoma, and we're in the low 50s right now as you head out in dublin. as you're stepping out the door in oakland, it looks so nice today. all clear, temperatures in the upper 50s, and we'll reach into the mid-70s for the afternoon. los gatos reaching 84 degrees, we'll see 86 in east san jose, also 86 in pleasanton and danville, in oakland reaching 78 degrees. and we're going to head for the low 80s in redwood city. you're noticing these temperatures are definitely warmer than yesterday, and that's going to be the trend as we go throughout the week. as you take a look at the seven-day forecast at the bottom of the screen, we're going to reach 88 in ukiah and 86 in sonoma. and high pressure is going to be building, creating some hot, dry and breezy conditions, and then by next week we're going to be watching out for rain chances. until then, we'll have a higher fire danger as we do typically start to see it ramping up during october into november,

but if we do start to get those early season rainfalls going a lot more frequently, hopefully we can try to put an end to the wildfire season. but looking across the region, at least for northern california, next week's rain could be a decent one. we've already had a good rainfall farther to the north. the bay area may see a quarter inch of rain or less. but take a look at these temperatures. we've been talking a lot about the high heat ahead, the fire danger, and this is why. because we're seeing the vegetation drying out once again, and as we get these hotter temperatures, also lower humidity that will go along with temperatures in the mid-90s in our warmer spots inland. we will have some cooler temperatures into the start of next week as rain chances start to enter into the forecast on monday. so take a look at what to expect in the inland areas, upper 80s and low 90s from now through saturday, and it does get a little milder for sunday. san francisco is going to see a

ramp-up in temperatures as well. we talk about all the fleet week activities, people outside. low to mid-80s, it's going to be quite warm, especially under all of that sunshine. mike, are you seeing a couple of delays? >> a couple of significant spots. the carquinez bridge we're finally seeing, i believe, the last of the crews clearing now. the rest of them did clear earlier. traffic recovered for westbound 80 approaching the carquinez bridge out of the north bay. we see out of vallejo slowing for west 37. the timing is right for the slowing. highway 4 might be tough timing because we expect the build to come out of pittsburg and bay point, but toward concord we had the earlier construction. that crew cleared, so we'll see how that overlap is handled. we see extra slowing through bay point. a couple of minor incidents reported, but no major issues. the latest reported for 680, i'm a little concerned about the spot. it looks like it's northbound 680, though, opposite your commute, away from mission boulevard heading toward the

and taking a look at pittsburg and what to expect today, it's going to be bright, sunny, and temperatures warming up quickly, going from upper 50s to mid-80s by the afternoon. in fact, around the bay area, we do get a boost in temperatures in some spots, another 5 to 8 degrees, as we start our warming trend. but this will not be the last of it. it does continue to heat up and we'll start to see 90s on the map for tomorrow, with a high up to 91 in santa rosa, and reaching 90 in los gatos tomorrow afternoon. so we'll talk more about this, as well as the increased fire danger in the full microclimate forecast coming up. >> thank you. we do have some breaking news this morning out of san francisco. a woman in critical condition right now, after an accident involving a cruise self-driving taxi. but new video overnight from the company and viewed by nbc bay area is adding a new set of questions about exactly what happened. "today in the bay"'s thom jensen is live in san francisco this morning. so tell us what we know about this investigation.

where do things stand? >> reporter: good morning, marcus. well, that video has a lot to do with it, and the video seems to show there was another vehicle involved, a black sedan, and maybe the driver of that vehicle is to blame for this incident where this woman sustained life-threatening injuries. according to cruise, the owner of that car, which had embedded cameras in the vehicle, that video shows a black sedan hit the woman first and then catapulted her in front of their autonomous vehicle at 5th and market, about 9:30 last night. the san francisco fire and rescue team responded and used the jaws of life to rescue that woman trapped under the rear axle of the cruise autonomous vehicle, and then she was taken by ambulance to san francisco general with those life-threatening injuries. but there were no witnesses. >> because of the nature of the autonomous vehicles, there's no driver to speak with, and in this case there were no passengers inside the vehicle when rescuers arrived. there were also no witnesses on the street.

all we know is the vehicle was found beneath the vehicle and rescued. >> reporter: however, there was that video rolling in the av, and cruise told nbc bay area the initial impact was severe and launched the pedestrian directly in front of the av. the av then braked aggressively to minimize the impact. the driver of the other vehicle fled the scene and at the request of the police, the av was kept in place. our heartfelt concern and focus is with the well-being of the person who was injured, and we're actively working with the police to help identify the responsible driver. the nbc bay area investigative unit looked at the video, and their viewing does seem to show exactly what cruise said in that statement. we did reach out to sfpd, but they did not release the identity of the victim or let us know yet whether or not they have found the driver of that other vehicle. we're live in san francisco, thom jensen, "today in the bay." >> we're certainly wishing that

woman a full recovery. thank you so much. one person is in custody after a stabbing in front of the concord b.a.r.t. station. it happened last night at about 7:30. b.a.r.t. says the male victim suffered injuries that are not considered life-threatening. it's still not clear if the victim knew their attacker or what may have led up to the stabbing. a live look on capitol hill, where today history will be made. vice president kamala harris will swear in laphonza butler to fill the late dianne feinstein's u.s. senate seat. the 44-year-old butler will be the third black woman to serve in the senate and the first out black lesbian. for the first three years she served as president of emily's list, a washington-based super pac. now, she's never held public office before. most recently she's been living out of state, but maintaining her home down in southern california, which allows her to meet the qualifications. she's already announced plans to

re-register here. and tomorrow and thursday in san francisco mourners will be able to pay their last respects to senator dianne feinstein. tomorrow her body will lay in state at city hall from 9:00 a.m. to 7:00 p.m. her funeral will take place thursday at 1:00 p.m. on the steps of city hall. that ceremony now has been changed to open to the public. it will be streaming live as well. mourners say san francisco has lost a real icon. >> she was such a fantastic person and a great leader for us. she did a lot for our city. >> our coverage of senator feinstein continues on air, as well as online. you can visit our website, nbcbayarea.com. it is 5:36 right now. jury selection begins today in the criminal trial of sam bankman-fried. the former head of the ftx crypto exchange. scott mcgrew joins me now. he's covering it extensively. so this one is all about cryptocurrency and what's really interesting about it is that

juries normally aren't really having to deal with -- we don't understand it possibly. >> it possibly could be very complicated. crypto is complicated. i think prosecutors will likely frame the alleged crime for what it is, stealing. stealing is simple for people to understand, whether it's cars or diamonds or cash or cryptocurrency. sam bankman-fried is accused of stealing billions of dollars from the company he founded. he's pleaded not guilty to seven counts of fraud and conspiracy. prosecutors say he took depositors' money for himself and moved some of that into a different company he owned, and then committed fraud by trying to cover the whole thing up. at one point it was a huge company worth $30 billion, name on a basketball arena, commercial endorsements, sports heroes. >> it it was huge but then it came crashing down. >> and took cryptocurrency with it. there are a lot of us who doubted the idea of invented money to begin with. those that are fans of

cryptocurrency, the alleged fraud really hurt the whole industry, probably forever. >> it was a younger generation, too. they saw some of their star idols there. jury selection is today and michael lewis' new book comes out today as well. >> extraordinary timing, the same guy who wrote "the blind side", he spent months with him before and after the charges. one interesting takeaway, he mentioned bankman-fried considered offering donald trump millions of dollars not to run for president. there are some early critics that say lewis is gentle on bankman-fried in this book, maybe got too close. one reviewer writing in "the new york times," lewis had in the months leading up to the disaster a front-row seat, which which he could apparently see nothing. >> oh, interesting. >> after i get through the elon musk book, i will pick up the sam bankman-fried. >> and i'm thinking of the theranos book, the article, i should say.

>> absolutely, that brought down theranos. >> so interesting. thank you very much. a south bay tragedy still leaving many unanswered questions this morning, after two children drowned in a south san jose daycare. a third child remains hospitalized. this all hospital yesterday morning at happy happy daycare, which operates out of the home on fleetwood drive near almaden lake park. authorities say somehow those children ended up in the home's swimming pool. it's not clear if there was a locked gate or a pool cover. and a search by our investigative unit did not find any license issued for a daycare center at that address. so far, prosecutors have not announced criminal charges, but that investigation is still ongoing. happening today, oakland leaders will address plans to upgrade the city's troubled 911 emergency calling system. reports by nbc bay area's investigative unit this summer led to oakland mayor sheng thao taking action last month. we found long wait times in tens

saturday and the valleys are expected to hit the 90s, while even the coast and the bay will be warming up. dry and breezy conditions in the hills, meaning a higher fire danger. so take a look at the trend for gilroy. we'll be in the low 50s at 8:00, but then into the low 80s for the afternoon. so we're going from jacket weather to definitely short sleeves and shorts for later today, as our inland areas head for the mid-80s and will reach into the upper 80s in spots like fairfield. it gets even hotter tomorrow as we continue to see those temperatures ramping up, low humidity, and breezy winds will mean a high fire danger as well. i'm watching out for that. mike, you're tracking tough timing for a new crash. >> recovery at the carquinez bridge, probably the best we'll get because of the late pickup of the construction crew there, with the build out of vallejo. highway 4, we expect to see a build. there was recovery from late pickup in this section. willow pass. but now a new crash around

worst cities for air pollution? well, we are looking at what contributes to transportation pollution, and it's smog and soot, as well as greenhouse gases. the sources come from commuting, traveling, shipping. solutions would be some efficient fuels, electric vehicles and public transit. tomorrow is california clean air day. we want you to take some time today to prepare, and maybe use one of these methods to get to work tomorrow. if you can, walk or bike. in fact, 50% of all trips are about three miles or less. that's about a 20-minute bike ride. if you can, carpool, make some arrangements today to do that. it not only reduces carbon but it can save you money, especially if you split costs to get to work. also, public transit will be offering some events. make sure that you check ahead for some of those fares and schedules so you can help contribute to california clean air day. if you do that, make sure you
