good tuesday morning to you. i'm marcus washington. >> i'm laura garcia. we begin with breaking news, new details overnight in an accident involving a self-driving cruise taxi in san francisco. a female pedestrian suffered life-threatening injuries. it happened late last night at 5th street and market near the powell street b.a.r.t. station. at the time, police reportedly suggested a second car may be involved. overnight cruise representatives showed our investigative unit bigad shaban their video, and he tells us the video appears to confirm the claim from cruise that its car did not strike the victim initially, and it it was actually another car that did. a black sedan, which then left the scene. the video has not been released. police last night would not confirm if that second car was found, but cruise claims its car had started a hard brake before making impact. our thom jensen is in san

francisco. we're going to find out more about this investigation. stay with us for a live report at 6:30. if you're on the go, you can stream us online at nbcbayarea.com, or take our app with you wherever you stream. to the east bay, two fires yesterday had a lot of next nervous as those flames got really close to the brush, getting close to homes as well. a reminder, we're still in fire season and the danger is real. we have team coverage on the ongoing threat. meteorologist kari hall is tracking the warming temperatures. first, "today in the bay"'s bob redell is live for us in the east bay with new warnings to those residents. >> reporter: yes, and even though we're in october, we are still in the height of the fire season, so even though the temperatures right now, as i'm standing in the east bay, the temperatures are cool, the weather is still prime, unfortunately, for wildfire activity, especially later this week as kari has been mentioning, temperatures in the east bay are supposed to rise to

the upper 80s, possibly the low 90s. this was the scene yesterday afternoon along outlook avenue in oakland, where a fire burned the hillside near several homes and unfortunately set fire to one of the homes. the man who lives in the house was not hurt but tells us he and his neighbors had concerns about the weeds on the hillside for quite some time. he says, ironically, the owner of the hillside had cut down the weeds yesterday just before the fire. oakland fire says the cause is under investigation but confirmed that, yes, workers were clearing out brush on that hillside prior to the fire. >> that's why there was such a fire, because the weeds had grown so high. i was just finishing lunch and i look out the window, expecting to see blue skies, and all i saw was brown. >> september, october, and sometimes even early november can be some of our most dangerous times. it's definitely not the time to let our guard down.

>> reporter: this was the scene, also, yesterday. another wildfire along a hillside in martinez. this one burned three acres and came close to homes, but they were never caught on fire. contra costa county fire says that fire also under investigation. reporting live in the east bay, bob redell, "today in the bay." >> thank you. a lot of people, they equate the summer months with the heat and fire, but this is our fire season. this is when we see them typically. >> we haven't had the diablo winds or the santa ana winds that can fuel some of those fires and cause things to spread quickly. so we are going to also go back to summer-like temperatures. some of the valleys will reach into the 90s and the coast and bay will be warming up as well. dry and breezy conditions means an elevated fire danger, especially for the hills. we start the warming trend today, but it's still going to be fairly mild for the

afternoon. mid to low 80s, and tomorrow we start to see 90s in the interior valleys. we'll talk more about the impacts of that and what's ahead coming up in a few minutes. >> we'll look forward to it, kari. in just a few hours, history will be made in washington when the woman tapped to fill the seat of california's late senator dianne feinstein is sworn in. "today in the bay"'s brie jackson joins us live in washington with a preview. a lot of people are calling this a big landmark moment. >> reporter: that's right, good morning, laura. laphonza butler is the first openly lesbian senator to serve california and the state's second black female senator. her appointment makes good on a long-held promise from governor gavin newsom to appoint a black woman. butler is set to be sworn in by her long-time ally, vice president kamala harris, at around noon pacific time.

she's currently the president of the emily's list super pac in washington, but she formerly served as an adviser to harris' 2020 presidential campaign. right now butler lives in maryland and she owns a home in los angeles, which he is expected to make her permanent residence. governor newsom is following through on his long-held promise to send a black woman to the u.s. senate, and speaking to reporters yesterday in san francisco, he expanded on what led him to appoint butler. >> the ability to create a dynamic on the outside that moves the needle on the inside. few people as skilled as laphonza butler to understand that push/pull between those on the outside and how to move things in terms of setting an agenda and actually accomplishing something. so i think she's in many ways more qualified than the vast majority of folks in a lot of elected offices. >> reporter: emily's list is a

popular action committee that raises money to help elect democratic female candidates who support abortion rights. butler is the mother of one child whom she shares with her domestic partner. meanwhile, final farewells to the woman butler replaces in the senate, the late senator dianne feinstein. those farewells continue. she will lie in state at san francisco city hall tomorrow from 9:00 a.m. until 7:00 p.m., and the public is also welcome to attend senator feinstein's funeral on thursday afternoon on the steps of city hall. it was originally private, and is now open to the public. people will also be welcome to sign a book of condolences. feinstein died thursday night at the age of 90. she was the longest-serving woman in the u.s. senate. >> i'm glad they've opened it up so that it's public. no matter what side of the aisle you are, she made such great strides for women and the state. nice to see.

with a look at our forecast. the warm-up will include san francisco? >> absolutely. and sometimes we see those coastal areas heating up. it's going to be hot out there for the first part of the weekend. if you like cooler temperatures, you might want to wait until sunday, but then there will be issues with visibility because the fog will be returning. you'll have to pick your poison here. we're going to see temperatures reaching into the mid-80s on friday, saturday up to 82, and then sunday nice and mild with low 70s. we're starting a warming trend today as we are looking at low 70s in the city. it will reach 77 in san mateo, dublin, livermore, up to 83 degrees, and we'll see mid-80s for santa rosa and novato, and up to 82 for this afternoon in san jose. so we'll talk more about this and what's ahead in a few minutes. mike, you have a look at where we're trying to find lower gas prices. >> try as i might. yesterday i was a little concerned, the low i questioned in san pablo. according to gasbuddy.com, the owner just updated this morning.

the report says $5.09 at that same great gas. so 50 cents higher. santa clara's best is $5.25 at platinum gas on washington street. marin county, the best is $5.54, gateway gas and shop on north gate drive just off 101. everything is above $5 on this chart and mostly above $6 wherever i look. a smooth drive, except for a key spot on the peninsula. an alert was issued by chp. there was a full block off of the bridge, now we have one of three lanes open. no injuries, but three cars have to be cleared from the san mateo bridge and slowing because of the volume. 6:11 right now. a trio of scientists share the latest nobel prize. coming up, the new details announced while you were sleeping, and their landmark work in physics.

good tuesday morning. it is 6:14. let's head over to walnut creek. it is a clear start this morning and we're in for sunshine, but it's a cool morning right now, 54 degrees. it will be in the upper 60s at 10:00, and at noon 75 degrees. a nice warming trend. it will be warmer this afternoon, and we continue to see hotter temperatures ahead. so i'll have more on this and what the weekend looks like coming up in a few minutes. we are looking at the bay bridge, a pretty standard pattern here, a lot of slowing through contra costa county, heading into this span itself. now, across the san mateo bridge, we have the alert on the peninsula side, west 92 slows from the decline down through foster city. that crash blocking a majority of lanes west 92 at highway 101. good morning. very happy tuesday to you. the sam bankman-fried criminal trial starts today with jury selection. tesla dropping prices again by reintroducing a rear wheel drive model y. reports meta is talking about

charging european users $14 a month for an ad-free version of facebook and instagram. europe has passed some very strict laws about online advertising. a 22-year-old man is suing elon musk after he says musk promoted and endorsed misinformation about his identity. benjamin brody has hired the same defamation lawyer who sued alex jones. brody was not involved in a fight that was caught on video, circulated on the internet between two extremists groups. brody wasn't even there. at 1.1 of the fighters has his mask pulled off and internet users identified that fighter as ben brody. it wasn't. musk never specifically identifies or names brody online, but he did retweet and comment on tweets that claim that brody was involved. the lawsuit against musk says, quote, ben and his family's experience of seeing him defamed by one of the most powerful men on earth warped their entire

sense of reality, leaving them stunned, confused and afraid. no comment so far from musk. the head of jpmorgan, meanwhile, says the bank is using ai to replace some work, jamie dimon says he predicts the next generation will work three and a half days a week. he made the comments in an interview with bloomberg. and a big snack company holding strategy meetings to try to figure out how to deal with ozempic and other drugs that depress the appetite. less hunger, fewer cheez-its. the company that makes cheez-its says we are by no means complacent in their plans. ozempic prescriptions up 300% in the last year according to the drug company. they haven't done anything yet and it's not clear what they would do. lower prices, perhaps. we'll see. but it's something, when you think about it, we were talking

every day this week through friday. >> congratulations to them. a live look at oracle park where september hardly met the hopes of giants fans. and while the postseason may be starting today, you probably already know the giants came up just short. today fans may learn where the team goes from here, especially after they fired manager gabe kapler over the weekend. executives will hold their season wrap starting at 11:00 a.m. the giants, by the way, open next season march 28th in san diego. >> which pretty much says there's always next season. meanwhile, on the other coast, trending this morning, the miami marlins make history by hiring the first woman general manager, and now, with her team seeing world series prospects, she's making new history. >> it's huge. the postseason gets under way today and the miami marlins are in that pennant hunt. she's the first woman to lead her team to the playoffs in any

this morning with some mid-60s to reaching into the 80s today. and these temperatures we're expecting this afternoon will be about what's normal for this time of year. we've been a little spoiled after that break over the weekend and temperatures in the 70s. but today we're going to reach up to 84 in cupertino and los gatos, and east san jose headed for 86 degrees. we'll see some mid-80s as well for pleasanton, upper 80s for antioch, and in hayward expect a high of 81 degrees. san mateo up to 80 today, and half moon bay in the upper 60s, while in the mission district expect it to reach up to about 73. as you take a look at the seven-day forecast at the bottom of the screen, we'll have warmer days ahead. we're starting today with a high of 85 in napa and 88 in ukiah. as we go through the forecast, high pressure is going to ramp up across the region and it's going to take a while, but we are going to see the return of rain for the first part of next

week. our next chance of showers will be next tuesday and wednesday, but until then, we'll have to deal with some serious heat. we've already had a couple of storm systems across the pacific northwest that brought a decent amount of rain. for the next one, we're looking at about a quarter inch of rain or less for most of us, but, of course, that fire danger ramps up as we get the hotter temperatures, the lower humidity, as well as the breezy winds. as we take a look at brentwood, what to expect over the next several days, we're going from mid-80s to low 90s tomorrow, to mid-90s for thursday into saturday. if you do have weekend outdoor plans, i think sunday is going to be the most comfortable day, but it's still going to be pretty warm all the way up until that next storm system approaches early next week. so we are going to have some hot temperatures. for fleet week, look at how warm it's going to be in san francisco, reaching the mid-80s on thursday. mike, you're tracking an alert for highway 92. >> this is affecting the bridge, the backup from the decline here

welcome back. it is 6:25 right now. we are continuing hispanic heritage right here on nbc bay area. >> that's right, we're celebrating it. this morning shining a light on a san francisco skateboarder who has made quite a name for himself. this is pro skateboarder chico brenes, raised in nicaragua during a revolution. the violence hit home when his mother was shot during the war. she survived, but decided it was time to get out. after crossing the border, brenes landed in san francisco, speaking no english.

founder sam bankman-fried starts today. plus, a big day at the u.s. capitol. laphonza butler is set to be sworn in as california's new u.s. senator. the history she's already making. this is "today in the bay." good tuesday morning to you. thanks for joining us. 6:30 right now. i'm laura garcia. >> i'm marcus washington. we want to begin with breaking news out of san francisco, where a woman is critically injured. she's in critical condition right now, this is after an accident involving a cruise self-driving taxi. >> some new video overnight from the company and viewed by nbc bay area is adding a new set of questions about exactly what happened. >> "today in the bay"'s thom jensen is live for us in san francisco. where do things stand this morning with that investigation? >> reporter: good morning. what we do know, a lot of it is coming from cruise right now. we have not heard a lot back from san francisco police department. but we do know that cruise

provided our investigative unit at nbc bay area video from that car, the embedded video cameras they say showed a black sedan hit that woman first and catapulted her right in front of the autonomous vehicle. it happened at 5th and market street near the powell b.a.r.t. station, a san francisco fire rescue team responded and used the jaws of life to rescue the woman trapped under the rear axle of the cruise autonomous vehicle and she was taken by ambulance to sf general with life-threatening injuries. there were no witnesses. >> because of the nature of the autonomous vehicles, there's no driver to speak with, and in this case there were no passengers inside the vehicle when rescuers arrived. there were also no witnesses on the street. all we know is that the victim was found beneath the vehicle and rescued. >> reporter: however, there was that video rolling in the av, and cruise told nbc bay area the initial impact was severe and launched the pedestrian directly

in front of the av. the av then braked aggressively to minimize the impact. the driver of the other vehicle fled the scene, and at the request of police, the av was kept in place. our heartfelt concern and focus is the well-being of the person who was injured, and we are actively working with police to help identify the responsible driver. the nbc bay area investigative unit, as i said, did view that video, and it seems to show exactly what cruise said in that statement. we do know that the woman is in critical condition right now. we reached out to sfpd but they have not gotten back to us to tell us whether or not they have found the driver of that vehicle who fled the scene. we're live in san francisco, thom jensen, "today in the bay." >> critical condition. let's hope she recovers. thank you, thom. >> we first learned of the accident, we sent out an alert through our nbc bay area app. you can download it, that way you can stay informed with the latest breaking news. a south bay tragedy leaving many unanswered questions after

two children drowned at a south san jose daycare. a third child remains hospitalized. it all happened yesterday morning at the happy happy daycare, which operates out of a home on fleetwood drive near almaden lake park. authorities say somehow the children ended up in the home's swimming pool. it's not clear if there was a locked gate. a search by our investigative unit did not find any license issued for a daycare center at this address. so far, prosecutors have not announced criminal charges, but that investigation is still ongoing. one person is in custody, after a stabbing in front of the concord b.a.r.t. station. it happened last night at about 7:30. b.a.r.t. says the male victim suffered injuries not considered life-threatening. it's still not clear if the victim knew their attacker or what may have led up to the stabbing. a live look on capitol hill this morning. this is where history will be made. vice president kamala harris will swear in laphonza butler to

fill the late dianne feinstein's senate set. they will be the first black and out lesbian to serve. she's never held public office before. most recently she's been living out of state, but maintaining her home in southern california, which allows her to meet the qualifications. she's already announced plans to re-register here. tomorrow and thursday in san francisco, mourners will be able to pay their respects to the late senator dianne feinstein. her fun hal will take place at 1:00 p.m. on the steps of city hall. the ceremony was originally private but now is open to the public. mourners say san francisco has lost a real icon. >> she was such a fantastic person and a great leader. she really was. she did a lot for our city.

>> our coverage of senator feinstein continues over the next few days. we will be live streaming her funeral on thursday, both on air, as well as online. 6:35. jury selection begins today in the criminal trial of sam bankman-fried. the former head of ftx. scott mcgrew has been following the case. this is all about cryptocurrency and it's interesting, it's something that juries don't normally have to deal with. >> it would be a tough one to explain. it's complicated, crypto is, but prosecutors will likely just frame the alleged crime for stealing. stealing is simple for people to understand, whether it's cars or diamond or cars, or cryptocurrency. sam bankman-fried accused of stealing billions from the company he founded. he's pleaded not guilty to seven counts of fraud and conspiracy. prosecutors say he took depositors' money for himself and moved some to a different company he owned and committed fraud by trying to cover the whole thing up. ftx at one point, you'll remember, was a huge company.

it had its name on a basketball arena, commercial endorsements, including steph curry as well. >> but then it all came crashing down. >> it kind of took cryptocurrency with it. there were a lot of us who had been doubting this idea of invented money from the beginning. but the alleged fraud really hurt the industry in general and trust in cryptocurrency. >> exactly. nobody trusts it anymore. so jury selection is today. and this is interesting, michael lewis' new book about that disaster comes out today as well. >> and, of course, bay area guy, he wrote about the big short, he wrote about the blind side. he spent months with bankman-fried before and after the charges. he's mentioned that bankman-fried considered offering donald trump millions of dollars not to run for president. nothing ever came of that. to be honest with you, i've not read this book yet. it's out today. but early critics say lewis

feels kind of gentle on bankman-fried, that maybe they got too close. one reviewer writing, lewis had in the months leading up to the disaster a front row seat, from which he apparently could see nothing. >> that's interesting. big news happening there. thank you, scott. 6:37. happening today, san jose leaders are expected to vote on creating the city's own power utility. in august, council members first presented that proposal to create san jose power. supporters argue pg&e is too backlogged and has a lack of money to focus on future service in the south bay. opponents argue the move is a risky one that may leave taxpayers with a huge bill. if approved, the city would operate power for two lines set to be completed in 2028. taking a live look in walnut creek this morning. >> the sun is coming up. >> it is. meteorologist kari hall is here. i know this is probably one of your most favorite times of the day.

>> yeah, but it's getting later and later. sometimes it's after the show, we have this glorious sunrise, at least i can enjoy it in the evening, the sunsets as well. as we take a look at what you're feeling as you get ready to head out the door, it's in the mid-40s in parts of the north bay, as well as the south county. mid-50s elsewhere for the peninsula. then as we take a look at the trend for today, it starts out cool in morgan hill at about 50 degrees, the kids may step out wearing a jacket, but look at how warm it's going to be at pickup time. so make sure the name is on the tag. they will not be wearing it later on today, as those temperatures heat up. it's going to be a drastic change from what we had over the weekend to what we are going to see today and the next few days, as our inland areas, especially, get some really warm temperatures. we'll talk more about that and what's ahead in a few minutes. mike says you may want to avoid the san mateo bridge. >> yeah, the backup continues to build, gradually. two of the three lanes are blocked right now, so coming

good tuesday morning to you. right now at 6:43, let's move over toward the east bay, as we get a look at pleasant hill. it's a cool start, only in the low 50s, but we are going to see a nice warming trend at noon at 75, and we're headed for the mid-80s today. a much warmer forecast ahead. i'll have more on that coming up in the full microclimate forecast. and, unfortunately, we continue to see a slowing trend for the san mateo bridge, once you pass the high-rise at the top of the screen it really starts to jam up toward foster city. the alert continues for westbound 92, two out of your three lanes are blocked by a non-injury crash, as crews are still not there to hook up those three vehicles. the alternate is the dumbarton bridge. we'll track the ripple effect coming up. it is 6:44 right now. happening today, oakland leaders will address plans to upgrade the city's troubled 911

emergency calling system. reports by nbc bay area's investigative unit this summer led to oakland mayor sheng thao taking action last month. we found long wait times and tens of thousands of calls abandoned last year, more than double the rate from the prior year. a scathing civil grand jury report added fuel to the fire. last month mayor thao fast tracked $2.5 million to upgrade the system. council members will talk about where that money is going in terms of staffing and new technology. again, investigative reporter candice nguyen has been looking into this issue for a while. you can watch her latest investigation right now at nbcbayarea.com/investigations. the president's son hunter biden will be back in court today. >> scott mcgrew joins us now. he's facing charges of falsifying a firearms application. >> yes. good morning to you. for which he will be arraigned today. these are not new charges. they were part of an old plea that prosecution offered hunter

upcoming weekend. it was so nice to get that break. we were thinking, yay, it's like fall. >> iced pumpkin latte now. >> especially this afternoon. we're seeing more clouds coming in, right over the golden gate bridge, while much of the city is clear. we're watching because of fleet week and the ships that are going to be rolling across the bay. but as we move into the south bay, take a look at our highs this afternoon. headed for the mid-80s, and even upper 80s for morgan hill. we're looking at a high of 87 for this afternoon. we'll also see a high of 87 in concord and walnut creek, and as well in livermore, while hayward will reach a high of 81 degrees. as you're taking a look at that seven-day forecast at the bottom of the screen, it's going to be hot these next few days. it just starts to get a little warmer for this afternoon, still pretty mild for san mateo, reaching 80 degrees there, 70 for daly city, and low to mid-70s for san francisco. much of the north bay reaching

the mid-80s, napa headed for 85 degrees. over the next ten days, san jose going from low 80s to mid-90s. we'll see the peak of the heat on thursday and friday. on sunday it's hot, but it will start to feel much more comfortable by the end of the weekend. beyond the weekend, we'll be watching out for rain chances. it's going to not move in until about next tuesday to wednesday, but we've had several storm systems across the pacific northwest that brought in beneficial rain. as we approach the peak of our wildfire season, we hope to get more storms going so that we don't see much of that activity. but we are looking at across the region some higher amounts of rainfall to the north, while much of the bay area is going to get about a quarter inch of rain based on some of the current estimates that we have for rainfall for next week. in the meantime, we are still going to have to deal with fire danger due to the heat, the low humidity and breezy wind in the hills. it's going to reach into the
