we'll have the timeline on the cool down and how much rain we're expecting in about 12 minutes. also tonight, more fallout from the racist text messages sent by a san jose police officer. he's no longer with the department. now the man who was shocked by the messages is speaking out. they have raised new questions about accountability and what should happen next. christie smith explains. >> i'm still processing. >> reporter: he spoke in oakland today along with his attorneys. this comes after racist text messages from a san jose police officer were made public friday. the officer is no longer with the department but was involved in a shooting last year that left green wounded. >> i've never thought somebody could just have that much hatred in their heart. >> reporter: the texts were discovered during an internal affairs investigator. the department says mark mcnamara, a six-year veteran of

the force sent the texts to a current and former officer. >> these were disgusting text messages, vile text messages. >> reporter: civil rights attorney pointer said they had words like "i hate black people". >> the tropes, the perspective that he brought to policing and expressed on this day, they don't match this young man, they never did. he's a hero. >> reporter: he says green was a college student who worked to disarm a gunman in downtown san jose in march of 2022. but police say they didn't know that when they saw green with the gun in his hand. they told him to drop the gun, and when he didn't comply that's when they shot and wounded green. some of the text messages show

mcnamara using slurs when apparently discussing the lawsuit and one particular text about his legal team. >> it's completely unacceptable. it's out of line. and frankly, i take it as criminal threat. >> reporter: they believe the messages show racial bias played a role in the shooting. this week the city's reaction was swift. the mayor and police chief condemning the texts many texts. meanwhile, another officer is involved. >> and late this afternoon, the san jose police officers association released a statement saying it is a testament to the culture that our internal affairs investigators found these texts, reported these texts to the chief of police and the chief took immediate action. tonight, tensions ran high as more than 500 demonstrators

the holocaust, and they're fighting to make sure history is not repeated. we reachedout to a representative who represents the group the idf. the search continues for the driver responsible for a hit-and-run that's being looked at as a hate crime. the student says he was walking to class when a driver hit him and yelled "f you and your people" and drove off. the chp is investigating. cair has released a statement saying in part, this disturbing apparent hate crime at stanford university underscores the urgent need to address islamophobia and hatred that have been plaguing our community and putting our students in

grave danger. they're urging the university to take action to protect its students. neighbors in san bruno are breathing a sigh of relief. officers were able to detain a suspect and no one was hurt. alyssa goard spoke about the tense morning. >> reporter: people say they woke up this morning to the sound of someone knocking on a door and yelling. it all happened at around 6:00 a.m. a neighbor shared this surveillance video with us. police say they got a call about a burglary, and when they arrived, they were able to get the people living inside that home outsafely. safely. but the suspect stayed inside for more than six hours. police had weapons drawn and were shouting out commands. neighbors said it was a scary

morning. >> there was a guy knocking on that house right there, on the windows, yelling "open the door, open the door", and then he broke the windows and got inside. >> it was extremely surprising and deeply unnerving, and i am hopeful that san bruno police have everything covered and i have no doubt they do. >> reporter: they have a photo of police detaining the suspect this afternoon. they say no one was injured, but they have not said anything yet about why the man entered the home. and the family inside that home said they didn't want to speak with us on camera today, but a family member did tell us they are all safe and doing okay. in san bruno, alyssa goard, nbc bay area news. the closed stretch of 680 southbound is set to reopen on time tomorrow morning. it stretches from southbound 680 pleasant to 580 to 84. been closed all weekend while

a dog trainer accused of failing to return a dog to a home is facing felony larceny charges in two states. >> we were first told about the german shepherd who disappeared from palo alto, and now a development in this bizarre story. >> our first story was in january. but recently, a man in massachusetts contracted a trainer who never returned his dog and believes it's the same woman he saw in our story. this is charlie, a 3-year-old french bulldog from north

reading, massachusetts. they hired the trainer, but at the end of the training, she didn't return their pet. >> i don't though exactly what happened. i don't know if he jumped out of the car or somebody took him, but he's gone. >> reporter: that's the story he says he got from the dog trainer when she sent this text saying her car had broken down on the side of the road. >> these are expensive breeds. i don't know if it was a negligence issue or a scam. >> reporter: after searching for charlie, speaking to animal control and law enforcement, bart hanson says he found our story online. >> there's a bizarre missing dog case on the peninsula. >> i go into google and see the story from nbc in san francisco and bay area. and i was like oh, my god. >> reporter: that's when hanson realizedhe dog trainer he knew as lily was really josephine ragland, who was being

investigated for another missing dog case in california. our story explained howpalo alto woman tried to replace her dog with a look alike. whether that didn't work the trainer said the dog was most definitely dead. >> it's like a son that disappear. you don't know where, if he's dead, i don't know where his body is. or if he's alive, where is he? maybe he's with another person. they sold, i don't know what happened to him. >> reporter: palo alto police didn't make arrest at the time. but in massachusetts, charlie's disappearance led to a multi-agency investigation. according to a north redding police department, after speaking to ragland, they determined charlie had died within a few days of being in her car and the body was dumped near ragland's home.

>> she was sending me texts and pictures after he was dead. >> reporter: a necropsy revealed that charlie was emaciated with no food in his system and likely died from a heatstroke. investigators found four other dogs in crates at the home that appeared malnourished. >> police told me that the main driving force was pure financial gain. >> reporter: according to the report, north redding police contacted palo alto police who had spoken to 18 of ragland's clients in the bay area who described a similar pattern and practice of abuse and neglect. they claim 28-year-old ragland executed a scheme, advertising with no intent to provide training. >> the defendant had misled people. >> reporter: ragland pled not guilty to two charges in

massachusetts. larceny and misleading police. >> i can't believe this. because all of her reviews in thumbtack were all positive. looked like a very, very legitimate thing. so it was devastating. >> reporter: thumbtack sent us a statement. just last week, after scott's dog's disappearance, ragland was also charged with two felonies. theft of a dog and personal property after value greater than $950. josephine ragland has not returned our messages. she was released on the massachusetts case in order to turn in her passport and not

swing states. so "new york times" and sienna college conducted the polls and got the results from hypothetical voters. in nevada, 52% support trump over biden. trump also narrowly beats biden in arizona and georgia and michigan. neither candidate has been officially nominated yet. so far, trump overwhelmingly remains the republican frontrunner, while biden is heavily favored for the democratic nomination. meanwhile, republican candidates will take the stage in miami for the gop's third presidential primary debate this week. seven candidates were on stage at the second debate in southern california last month. it is not clear how many will qualify again, but we know former president trump will not be there. and former carolina governor nikki haley has pulled out of the miami debate. lester holt and meet the press

aiming on the bay area, and with the southerly wind right now, that's the reason it's so muggy right now. warm air, super saturated, probably closing in on a half inch already. we're going to add to it tomorrow morning. 50s and 60s to start the day. still muggy. then cooler air starts to sweep in as we head toward the afternoon as the shower chances will be ongoing. highs, cooler than what we've got outside right now. that is an air mass change tomorrow. mid-60s around san jose. so areas seeing the rain, yes, oakland up towards walnut creek, downtown san jose, finally seeing rain showers, and into the santa cruz mountains as well. though the peak of the rain rates will likely come in after midnight tonight and on top of the morning commute. there's that first batch of showers. 3:00 a.m. to 5:00 a.m.

right over the central bay, these will be brief downpours that very likely will cause a little ponding on the road ways. by 8:00 that passes san jose. watch how this cloud band passes by with the clearing behind at that. that could set the stage for isolated thunderstorms mid afternoon into the north bay. as we approach sunset, atmosphere stabilizes and shower chances should start to wind down. most of the bay area picking up a quarter inch of rain. higher totals in the north bay mountains and santa cruz mountains. proof positive we have colder air coming in, a winter weather advisory for lake tahoe, could see six t 11 inches of snow. then the next chance of rain arrives right there, late thursday into friday. not a lot of rain. but it's reason enough to keep the umbrella on stand by as we head towards veterans day on friday.

the west bank. he met with the palestinian authority president to discuss humanitarian aid and stopping violence against palestinians. >> he traveled to baghdad to meet with the iraqi prime minister. the leaders spoke for about an hour, focussing on the war and the need to keep it from spreading. >> it was very important to send a very clear message to anyone who might seek to take advantage of the conflict in gaza to threaten our personnel here or anywhere else in the region. don't do it. i made very clear that the threats, attacks coming from the militia in iran are unacceptable and we will take every necessary step to protect our people. >> he will discuss the

beneath the rubble. we have yet to hear from the israeli military on that apparent airstrike. the israeli military continuing to urge civilians to evacuate from the northern portion of gaza to the southern portion of gaza. but it is worth noting that that refugee camp, where that strike took place last night is considered to be south of the gaza wadi, where they're telling civilians to evacuate. former president obama is weighing in on the war between israel and hamas and asking if his administration could have done more. >> so, if you want to solve the problem, then you have to take in the whole truth. and you then have to admit nobody's hands are clean. that all of us are complicit to some degree. >> the former president made the comments in an interview with

in an exclusive interview with meet the press, he said the war with russia has not reached a state mate. that comes as his military are struggling with a counter offensive and the war in the east threatens to slow down support. since russia invaded ukraine in february of 2022, the u.s. has provided $75 billion in military, humanitarian and financial aid to ukraine. >> how long should they expect to send more money? when do you anticipate you can end this war? president zelenskyy? >> i think that the next year with a challenges, because this is the year of your elections, now again, we see the critical situation in the middle east. i think your help is very important for the next year. and that's crucial. >> and can you watch more interviews like this one every

sunday morning on meet the press with kristin welker. tonight we are learning the main mass shooter was alive for most of the massive two-day manhunt. autopsy results just release show that the gunman died from a self-inflicted gunshot eight to 12 hours before his body was discovered. he opened fire inside a bowling alley and bar late last month in lewiston, maine. tonight medical officials in maine say four of the survivors in the hospital are improve tonight. more than dozen surgeons and health care professionals treated people on the night of the attack. they are grateful the survivors continue to get well. the trial of david depape,

jury selection starts tomorrow morning in san francisco. on friday, a hearing was held to clarify what questions each side can ask potential jurors. depape has pleaded not guilty to attempted murder and other serious charges related to the attack on congresswoman nancy pelosi's husband. depape is also facing state charges which will be tried separately. some other high-profile cases in court this week, former president donald trump is expected to testify in his $250 million fraud case brought by new york's attorney general. donald trump jr. concluded a second day of testimony on tuesday. video game developer epic is taking google to court. the latest anti-trust trial against google. epic is behind the game fortnight. they claim they launched a campaign after they exited the google play store to keep other developers from making a similar

a group of indigenous tribes are calling for a chemical used

in car tires to be banned. the tribes from california and washington sent a petition to regulators asking them to ban the use of a rubber preservative found in almost every tire. it washes into rivers, killing salmon as they return to spawn. tire manufacturers are already looking for an alternative that still meets federal safety requirements. a milk carton shortage is impacting school lunches. the problem isn't the milk itself but the cardboard cartons. now school districts are scrambling to find alternatives. schools are told to be flexible. they suggest himming milk choices and using bulk dispensers. it's unclear how long the shortage will last. catalytic converter thefts are headed down, way down from the peak we saw during the pandemic. in 2019, there were about 300

catalytic converter thefts per month. by 2021 the number is more than 4,000 thefts a month. wow. they peaked at more than 5300 a month in 2. likely deal with higher rain rates than what we're seeing outside now. it is enough to coat runways at sfo. the light rain that's falling and giving you a tour of the bay area. who's seen the most rain so far? mill valley, calistoga, santa rosa. mt. tam has already got up to about a half inch of rain. a little less obviously to san jose. but the numbers starting to move around the tri valley. danville, .500. and it's still muggy outside. low 60s in san francisco. 64 degrees in livermore. and the number we showed you a few moments ago, san jose, 70 degrees outside. temperatures outside right now will be warmer than the high temperatures tomorrow. as cooler air sweeps the tropical air out of the bay area.

rain at times, a chance of thunderstorms. that will be one of the reasons the rain rates will be higher. not seeing any 80s or upper 70s in the forecast for now. mostly light to moderate rain around those hilltops there, around the sunol grade. pretty good pockets on the higher hills at system moves to the north and east and more as we head to the santa cruz mountains. this is the first wave coming through right now, followed up by the actual front itself which will have higher rain rates, and behind it, increasing chances of thunderstorms. there go the showers. by 3:00 a.m. the next batch drops in, which may briefly have thunder. it's already passing through san jose tomorrow morning. but then we watch tomorrow afternoon with the cool air aloft and daytime heating.
