here and across the nation. this is "today in the bay." good morning to you on this tuesday morning. i'm marcus washington. >> i'm laura garcia. we'll get to the morning commute with mike in just a little bit. let's turn to the forecast with meteorologist kari hall. >> it starts out cool and mild for most of the bay area. yesterday we had that off and on rain. now there's still some rain in the nearby vicinity, but we're not looking at much activity here. there may be a couple of spotty sprinkles for parts of the north bay. as you can see as we take a look at the radar, there is nothing going on for now. so as we take a look around the bay area, some of our cameras show that we are in the low 50s as you get ready to step out the door. san francisco at 57 degrees. it's 50 in dublin and 54 in oakland. looking at our current temperatures, once again, it is a nice and mild start. mike, you were looking for something on that camera in dublin. >> i plucked that from your

screen there, the multi-cam and we're just focusing on westbound 580. i was looking for some sort of hazard marked by chp. i don't see any disruptions to the flow. the slowing did show up for a couple of seconds, so maybe a cone or car getting off of the freeway. we have construction picking up at the dublin interchange and southbound 680, things consolidated and then rippled back. there must have been a traffic break but nothing was in the chp grid. everything else looks just fine on the freeways. back over to you. >> thank you very much. 5:02 right now. breaking overnight, a horrific crash in oakland sends a car flying into a home, landing a woman in the hospital. it also highlights the city's ongoing problem with 911 response times. >> "today in the bay"'s kris sanchez is joining us with more on how two homeowners are describing what happened here. >> reporter: so they are very, very lucky that they decided to watch tv last night, because when that car landed on the roof of their bedroom and came

crashing down where they sleep, they were in the room next door. this is the aftermath of the crash that happened on the 400 block of worth street in a neighborhood off 880. witnesses saw a car speeding down 85th avenue before it crashed and went flying into a parked truck, then into a second car, before landing on the home. even with the chaos outside, a gentleman was afraid to open the door and see what happened, because given his neighborhood, he feared it was a shooting. >> i didn't know what's going on because i can hear splinters flying around, so i just ducked and crawled away, i went behind my couch, and then i heard people screaming. that's when i stood up and saw the car over here. >> reporter: his wife says when they finally did go outside, they saw a woman trapped in the

wreckage of that car. they saw their neighbors trying to pry her out. when they finally got her out, rodriguez says the woman appeared to be in and out of consciousness, bleeding, and also appeared to be pregnant. >> it took a whole hour before somebody got help. i'm sorry, i didn't want to fault anybody, but it took -- that person could be dying right this. >> reporter: as our investigative unit has reported, oakland has the second worst response time in the state in terms of 911. oakland is failing to answer 911 calls in a timely manner. people tell us they have been waiting 20 to 30 minutes on the line, if they get an answer, and the city stopped hiring dispatchers in a bit of a snafu. we'll have more information coming up at 6:00. >> perfect. we'll check back with you. 5:04 right now, a man accused in the gruesome murder of a 64-year-old grandmother in

santa rosa is scheduled to make his first court appearance. police say luis aroyo-lopez decapitated elvia lopez arroyo last thursday in her home. authorities discovered the victim's head saturday along a santa rosa creek. police took the suspect into custody the same day of the killing. he's being held without bail. investigators believe the incident was a targeted attack tied to drug cartels. a ballot plan to add more funding to hire more san francisco police officers now seemingly in question with a battle over endorsing it. supervisor matt dorsey authorized the original plan for a fully staffed police department that's more about 400 officers short. it also called for new funding through a $30 million budget set aside for new recruits and retention. but a supervisors rules committee altered the plan, generating new funding through a

brand new tax or redirecting other tax revenues. dorsey is blasting the change and calling it, a cop tax scheme. >> some feel like, no, we're not going to give voters that right, we're going to make sure they pay more taxes. >> if you take it from one thing, you're hurting something else. so the idea is, we're for this, i'm 100% for increasing our minimum police staffing, but i want to do it in a fiscally responsible way. >> a supervisor led altering the plan, arguing to set aside money is fiscally responsible. mayor london breed is also pulling her support for the original measure. the full board is still expected to take up the issue in the coming weeks. jetblue is reviewing how one of its planes collided with a service truck on the tarmac at sfo. it happened yesterday afternoon. no one was hurt. the airline says the

boston-bound plane was taxiing from the gate when it struck what's known as a push-back tractor or tug vehicle. one of the plane's engines was slightly damaged, but still taxied back to the gate and all of the passengers were placed on other flights. california voters are heading to the ballot box for a few key elections today. there are seats up for grabs on the solano, alameda and santa clara boards in different districts. in marin county, voters will decide on measure b, a real estate tax to pay for the permanent road division. it needs two-thirds majority to pass. across the country, abortion access takes center stage in ohio, while mississippi, kentucky voters, they will decide on governors. as "today in the bay"'s drew petrimoulx reports, the outcomes will be a preview of what awaits presidential hopefuls in 2024. >> reporter: voters in several states across the country heading to the polls in a preview of presidential and

congressional races this time next year. in virginia, republicans aim to take control of the state legislature. >> we are the party of hope. we are the party of low taxes. we are the party of small business. >> reporter: while democrats hope to win races in mississippi and kentucky. >> are you ready to win? >> one of the things that we've seen in this current off-year election cycle is two issues really manifesting, and for the democrats that's abortion, and for the republicans that's crime. >> reporter: the abortion issue being tested in ohio as voters decide whether to add abortion protections to the state's constitution. it's an issue democrats across the country are using to win over some republican voters. >> i'm not that much pro life. i'm sort of in the middle. so even though i tend to be more pro choice, i'm still a republican. >> reporter: all this as republican presidential candidates prepare to hit the debate stage tomorrow night in miami. five candidates qualified for this third debate, including ron

desantis, who got a boost monday from the governor of iowa, the first state to vote in the presidential primary next year. >> i am so proud to stand here tonight and give him my full support and endorsement for president of the united states of america. >> reporter: former president donald trump skipping the debate once again, after appearing in a courtroom monday to testify in his civil trial. from washington, drew petrimoulx, nbc news. a year from now voters will ultimately decide who wins the 2024 presidential election. top republican candidates are prepared to take the debate stage in miami in less than 24 hours. >> nbc news is hosting, five candidates will be taking the stage. former new jersey governor chris christie, florida governor ron desantis, former u.n. ambassador nikki haley, businessman vivek ramaswamy, and senator tim scott of south carolina. front-runner, former president donald trump, will not appear.

shares of roku. wework has declared bankruptcy. they were the former high-flying work space company. you don't have an office, you show up to a wework location. the big losers are the building owners. they leased the offices to wework, who rented them to us. they'll likely not get paid. elon musk has stepped into a big pile of controversy again, it's complicated but worth understanding. so the woman in this photo posted to x, what we used to call twitter. she is the online creator of an account called libs of tiktok. she's holding up the front page of "usa today," which features an article about her. this article is part of an investigation by the newspaper that whenever she posts, threats follow. not to her, to the people she posts about. here is a closer look at it. at the bottom, elon musk writes, congratulations. now, as you may recall, among

the targets of libs of tiktok was boston childrens' hospital, after she posted accusations it was offering gender care to children, the hospital and its doctors and nurses received death threats and bomb threats. "usa today" documented times where libs of tiktok posted something that was then followed by death threats, bomb threats, dozens of times. in fact, more than two dozen schools have been evacuated after she would make these posts. and then you've got the headline that "usa today" wrote, when libs of tiktok tweets, threats increasingly follow. she says she opposing violence and that nobody can prove the connection between the death threats and what she does. but to have elon musk then at the bottom congratulate her for her big front page article, which is really an investigation into her, and they weren't advertisers on twitter or x.

i don't know how they're going to get them. >> it's tough. you've seen it just disintegrate. interesting. thank you, scott. trending this morning, a race to the bottom of the sea. so there's a real life treasure hunt going on off the coast of columbia. >> the country's government just released video of the remains of the spanish galleon san jose, known by experts as the holy grail of ship wrecks. the ship was sunk by the british during the war of spanish succession back in 1608. it's believed to be complete with cannons and fine china, chest filled with gold coins, emeralds and silver are also believed to be onboard. the ship wreck is believed to be worth $20 billion. >> to have an intact galleon from 1708 that's completely intact with all of its cargo in one spot is really an archeological masterpiece, to be

honest with you. >> bloomberg reports columbia's president recently ordered it to be exhumed. he wants it completed by the end of his term in 2026. the columbian navy says they found it in 2018 and the exact location is still a secret. an american company says it located the wreckage in the 1980s. it's suing for 50% of the ship wreck's worth. doesn't it sound like a movie screen? >> james cameron. >> into the deep. >> we should call the goonies. >> bring them back. jewel of a day ahead? >> it's going to be really nice. starting out mild. we're going to see a lot more sunshine. as we go throughout the day, we are going to really enjoy a mild afternoon. but as we take a live look outside in san francisco, you can see a few of the clouds drifting by. after that storm system has cleared out, let's see how we're doing in terms of rain.

santa rosa is almost at an inch of rainfall, but that is an inch and a quarter below what we typically see. we are running a little dryer than normal, but it is early in our water year. looking at some of those numbers, we are below what we typically see in oakland by about an inch, in san francisco we are usually seeing an inch more, as well as in concord. san jose usually has another half inch of rainfall. now things are drying out, but we do still have activity nearby, and then our next storm system is well out there in the pacific, that will start to make its way closer heading into thursday. but we are looking out for that slight chance of an isolated shower or two for today, and then mostly sunny into the afternoon. and then the next system moves in, but it will be weakening, and it really only looks like the north bay may have a slight chance of rain, the rest of us staying pretty dry. our temperatures are in the upper 60s for highs, with east san jose headed for 69 degrees,

66 in los gatos, and fremont reaching 64 degrees, upper 60s for concord, and 66 in oakland today. 66 as well in redwood city, and a lot of 6s in san francisco, with mid-60s and upper 60s for highs in the north bay. as we go throughout the next several days, our mornings will be much colder, and take a look at what to expect by tomorrow morning. we're in the upper 30s, 39 in clear lake, but mostly low 40s across much of the bay area. be prepared for sweater weather that will be settling in as we go into the weekend. we make a nice recovery each day with upper 60s and low 70s for highs into early next week. mike, you were starting with some slowing in oakland. >> yeah, we had that westbound 580, so right behind me on the map here. it's starting to improve right now. i did look on the grid and there was one spot for construction as folks were working on a couple of lanes heading westbound. again, it's scheduled to pick up

good morning. gloria in berkeley used zell to send her landlord $11,400 from her wells fargo bank account. a couple months later she learned the landlord never got her payment. gloria checked into it and discovered she had entered the wrong number in zell, so her 11 grand went to another person. she tried to contact that person

but never heard back. gloria filed a claim with wells fargo, which owns part of zell. wells fargo denied the claim, saying the mistake in payment was processed accurately. so gloria wrote our team. we reached out to wells fargo. it declined to discuss specifics, but they did say they reached out to the recipient of the funds and are working toward a resolution with both parties. within a few days of that, gloria says wells fargo reversed the transactions and put her $11,400 back into her account. direct person-to-person money transfers are exploding. zell alone says people sent 2.3 billion payments in 2022 worth $629 billion. gloria's episode is a good reminder to double or triple-check you have the right recipient. zelle's page is clear, saying confirm your recipient's contact information, because once you authorize a payment to be sent,

with us. i'm laura garcia. >> i'm marcus washington. let's get you started with a look at that forecast. meteorologist kari hall has been tracking what we can expect. it's some pretty moderate temperatures this morning. >> it's a little warmer than we've seen recently and probably one of the warmer mornings we'll have in a while. we're going to see colder air settling in. for right now, we're in the mid to upper 70s in some spots like san francisco. it is 53 in san jose and 54 in oakland. then as we get a look at our day trend in cupertino, we're starting out in the upper 50s at 9:00. but then as we go into the afternoon, it's going to be very comfortable. our highs will hit the upper 60s. those are the numbers we'll see for many of our microclimates. we'll get a look at what's ahead for the rest of the week in a few minutes. we are following breaking news just coming into the newsroom, a deadly shooting under investigation this morning. this is near oakland's plaza, video showing police surround a black car we believe is part of

an ongoing investigation. surrounding streets are closed and an officer on scene is telling our photographer one person was killed. no other details are being released at this time. also breaking overnight in southern california, where firefighters are battling a raging fire at a former air base. the flames have been causing part of a historic air hangar to partially collapse. it started a little before 1:00 a.m. at the former air station in orange county. an nbc crew on the scene tells us firefighters are facing an added challenge because the base no longer has a worker water supply. the hangars have been featured in prominent television shows and movies including "pearl harbor" and the austin powers films. the cause is not yet clear. 5:32 right now. new overnight, police are investigating an accident that left a woman dead in san jose. it happened a little before 10:00 p.m. when the car struck the woman on blossom hill road.

it's not clear if the woman was in the crosswalk. police do say the driver stayed at the scene and is said to be cooperating with investigators. developments in the middle east, from israel and gaza border, today marking one month since the hamas terror attack in israel that killed more than 1,400 people. 240 people are still being held hostage in gaza. in gaza, meanwhile, the number of deaths recently shot past 10,000. israel is releasing new video of its military firing at hamas targets, and you can see the large plumes of smoke rising in the sky. gaza health leaders are saying the latest air strikes left dozens of people dead. israeli troops, meanwhile, are making new headway and encircling gaza city and isolating hamas militants. there's no sign of a possible cease-fire, despite pleas from the united nations and the u.s. israeli prime minister benjamin

netanyahu says he is open to small pauses in fighting, which would allow more aid to enter into gaza. and back here at home, emotions take a deadly turn during dual protests in southern california. mourners are expressing shock and sadness after the death of paul kessler in thousand oaks. we know it started as a fight sunday afternoon involving israel and palestinian supporters holding rallies at the same time, at the same intersection. ventura county deputies are expected to speak more about this investigation. investigators say kessler is an israel supporter. he got into some type of altercation with a counter protester and then fell backward, striking his head on the ground. he was taken to the hospital, but died yesterday. his community feeling the loss tremendously. >> obviously a tremendous tragedy, a sad day for our community. this is a beautiful community.

"today in the bay"'s bob redell joins us live from the east bay this morning to tell us who it is and how many people could potentially be impacted here, bob. >> reporter: we're talking about thousands of policies. good morning to you, laura. this morning we have confirmed through the state of california that farmers direct property and casualty insurance has stopped writing policies in the state. we're talking about policies for renters, homeowners, like the people behind me, and auto. according to the "chronicle," there are almost 58,000 auto and

close to 20,000 homeowner policies that will eventually be dropped once those policies expire and are not renewed. the paper reports that many policyholders will get offers for coverage from the farmers insurance group, the parent company. this summer, farmers limited the number of new policies due to record-breaking inflation, severe weather events and the higher costs for rebuilding. again, that's according to the "chronicle." recently allstate and state farm stopped writing policies, and four smaller companies have announced that they will soon stop offering coverage in the state. a consumer advocate for people with insurance tells nbc bay area that it used to be that insurance companies stopped covering people who live in the foothills, places like tahoe, at risk for wildfire. but now companies are also dropping people who live in the flat areas, the suburbs in the bay area. the "chronicle" reports that the

this wall, some important milestones for the a's. it's no wonder why fans want to keep the team in oakland and they are not giving up. later today, fans are showing up to city hall, along with oakland mayor sheng thao, and other city leaders, for a scheduled press conference, urging mlb owners to stop the move. the team needs 75% of owners to vote in favor of the proposal in order to make the move. the vote could come as soon as next week. now, oakland city council also has a scheduled vote tonight on a resolution reaffirming its support for the team, which includes adopting approvals for the howard terminal project and securing more than $400 million in grants to build a new stadium. this comes as well after a nevada judge tossed out a petition yesterday allowing nevada voters to decide if taxpayer money should be used to build the new a's ballpark in las vegas. now, a's fans believe there is

still hope to keep their team here. >> it's not a done deal. it will be a done deal when they put shovels in the ground somewhere. >> reporter: a's fans are looking to appeal to mlb owners. speaking of owners, raj mathai spoke with the warriors owner last night on our 7:00 p.m. newscast. he was asked if he would entertain the idea of buying the a's if he had the opportunity. this is what he said. >> they're not a team that's for sale. if they were, sure, we would be interested. we would be fools not to. it would be a potentially great opportunity. but they're not. they're moving to las vegas, as i understand it. i wish them the best of luck. >> reporter: well, that would be somewhat of a dream scenario for fans, a way to keep the a's here. but raj also spoke with a's owner a couple of months ago, john fisher. he said he is not looking to sell the team.

temperatures in san jose and los gatos, 68 today in novato and in santa rosa, while san francisco will reach 64 degrees. it may be slightly warmer tomorrow, especially for the inland valleys, up to 70 degrees, which i think is about the perfect temperature. we'll get a look at what's ahead coming up. mike, you've been watching the roads. >> we do have a few issues out here, and then, of course, we'll look ahead a little as well. right now we do see, as we speak, the backup building for southbound 680. the volume is building for 84 and 680 coming toward sunol and there are two crashes reported. both, i believe, have vehicles in the middle lanes. and then the rest of the crash activity is off to the shoulder. southbound 680 is starting to build, and hopefully no major injuries are reported and they can clear that quickly. we do see the build in contra costa county, highway 4, and then coming into alameda county, west 24 there's a crash as you're approaching 580 as well. that should get off to the

let's look at contra costa and alameda counties. highway 4 did show slowing i showed you a couple minutes ago. vasco road is building, 26 minutes out of marsh creek and to 580. that is showing a build. >> thank you so much. it's a quarter until 6:00 right now. the man in charge of prosecuting the president's son will face a congressional hearing this morning. >> scott mcgrew has been following this. some republicans accuse special counsel, david weiss, of going too easy on hunter biden. >> too easy, that's right. that's probably because weiss spent years and years investigating hunter biden and came up with very little. weiss, you remember, is himself a republican, appointed by a republican president, who investigated hunter biden during a republican white house. when president biden took office, the new head of the justice department, attorney general merrick garland, kept weiss where he was to avoid any

appearance of interference. throughout that, weiss was not able to come up with the kind of charges the president's opponents were looking for. eventually coming to a plea deal with the younger biden over allegations he didn't pay his taxes and lied on a firearms form. the plea deal fell through after a judge rejected it. weiss will testify behind closed doors to the house judiciary committee today. the doj had offered to make this meeting public. it's not clear what weiss would have been able to say even in private, because investigations into hunter biden are ongoing. former president trump may return for more testimony today in his new york city civil fraud trial. yesterday trump and his lawyers were scolded several times by the judge after he went on long rants instead of answering the questions posed to him on the witness stand. at one point trump unfolded a piece of paper and asked to read

from it. the judge said, quote, we are not here to hear what he has to say. we are here to hear him answer the questions. and most of the time he's not. trump posted the first part of the quote, we're not here to hear what he has to say on truth social. trump is accused of fraud for not telling banks the truth about the value of his properties. he said in court, the overall value is billions of dollars more than is in these statements, so whenever the bank gets them the bank is seeing a conservative statement. trump, in other words, accused of getting the numbers too high on his financial reports, and says, in fact, the numbers are even higher than the numbers on his financial report. >> this is a scam and this is a case that should have never been brought, and it's a case that now should be dismissed. >> it's election day. many of us here in california have maybe just one or two races on the ballot. one in my neighborhood. in ohio, they're going to decide

whether to protect abortion in their state constitution like we did in california. and the supreme court today will hear a case that could allow domestic abusers to possess guns. right now there's a federal law that says if you're convicted of domestic battery, you can't have a gun. a lower court ruled it's wrong to restrict someone's fundamental constitutional right just because you broke the law. to take it to the extreme, a speeding conviction doesn't affect your first amendment right to worship. some argue same thing for the second amendment. the court will hear the argument today, but won't publish its decision until the end of the term. >> very interesting. can't wait to see that. thanks, scott. new this morning, e-cigarette use is down amongst kids, but still fda is working to combat nicotine use before it becomes a problem for a new generation. the fda and cdc releasing a new report on to back oh and nicotine use among kids.

it shows e-cigarette use by high school students is down 4% compared to last year. the report found there was a slight uptick in use among middle school students. the major worry is flavor products. 90% of kids that use flavored products, experts say they often start a lifelong addiction to nicotine and it can start at a young age. >> we know that most adult tobacco users begin before the age of 18 and this is a critical juncture to make sure we're preventing another generation of tobacco product users. >> last week the fda issues new fines against stores that sell illegal tobacco and e-cigarettes and is working to federally ban fruit-flavored products nationwide. california has already banned fruit-flavored e-cigarettes and tobacco products. oakland leaders will consider establishing the first lgbtq cultural district in the city. last month the city gave its

approval for the proposal, which focuses on the city's lakeshore neighborhood. sponsors of the proposal say the district aims to provide a space for lgbtq families, allies, and community members that's free from violence and discrimination. they plan to gather ahead of this afternoon's expected vote by the city council. speaking of oakland, here is a live look. you see the morning commute out there picking up. we'll check in with mike to see how things are moving along out there, but first let's check that forecast with meteorologist kari hall. >> the roads are a little dryer this morning. yesterday morning we started out, it was a little damp, we had some off and on light showers. there's still rain nearby, but we're also turning our attention to what else is out there and what could be bringing in some rain. a closer look at some of the showers staying off the coast, a few showers and thunderstorms, but across the bay area not a drop of rain coming down. there may be spotty sprinkles lingering as we go into the morning, into the afternoon. watch out for that chance.

other than that, we're mostly sunny and we'll see the next storm system coming in by late thursday into early friday morning. and it mainly just looks like it's the north bay that has the chance of rain, with much of the rest of the bay area, once again, just left with sprinkles and a few hundredths of an inch of rain, maybe a little higher around ukiah, and farther to the north, while the bay area will continue on with some dryer conditions. and our temperatures today reach into the mid to upper 60s. these temperatures are just slightly below normal. overall it's going to be a very mild day, reaching 68 in walnut creek. we're up to 67 in palo alto, while daly city will hit a high of 63 degrees, and some mid-60s in san francisco. our north bay temperatures up to about 68 in sonoma and 64 in clear lake. and our morning temperatures are going to be cold these next few days, with mainly low 40s and then upper 30s for clear lake and ukiah. but we are going to really notice the drop in our morning temperatures over the next few

days, making a nice recovery for the afternoon, heading into veterans day, with some upper 60s for the inland valleys. san francisco will be in the mid-60s into the start of the weekend. mike, you have crashes along several key commuter routes? >> we do. highway 24, that crash i was hoping would clear quickly did not yet clear, and that's causing a bit of a backup as folks are approaching the maze. it's approaching the maze, west 24 picking up the volume out of contra costa county. highway 4, 242, 680, all feeding in that direction. do note that that one section of 24 is building up from 580 and highway 13. south 680, two crashes as well. one vehicle is still in the middle of the roadway. slow through sunol out of pleasanton. happening now, if you find yourself near the martinez refinery over the next few days, you're being told to not be too concerned about flaring or smoke
