right now at 6:00, a high-profile case heads back to court. a former police officer shoots and kills a man in an east bay walmart. we're live with the unprecedented move alameda county district attorney may be poised to make. housing holdout. the key deadline san francisco may potentially miss, and why the state may soon step in to approve new projects. holiday travel boom. today is one of the busiest days of the year at airports around the nation. we're breaking down everything you need to know and keep in mind if you're heading out the door, from weather advisories to what's happening on the roads. this is "today in the bay." and this is tuesday morning, and a good tuesday morning to you. i'm marcus washington. >> i'm laura garcia. we'll check that morning commute with mike and see if folks are hitting the roads. busy day, busy time, busy week. >> absolutely. at least the weather is the least of your worries, because we're not seeing any big storms

locally. but we are also tracking those storms for the east coast, because that may impact some of those flight plans. looking at san francisco right now, it is all clear, nice and quiet. chilly start to our morning. as we go throughout the day, we go from low 50s to mid-60s with a mix of sun and clouds for this afternoon. then we take a look at our highs reaching into the upper 60s, with dublin and concord reaching 68 degrees, in oakland we're looking at a high of 69 and low 70s for mountain view, 73 in san jose. and mostly upper 60s for the north bay. we'll take a look at our thanksgiving forecast and also talk about what's happening beyond the bay area coming up. mike, how is the tuesday commute shaping up? >> it's there, it's relatively light for a 6:02 check of the traffic. the bay bridge toll plaza doesn't really look different. it's filled in here. it's getting here that's an easier drive through contra costa county. mild slowing for highway 4, holding steady for the last 20 minutes. highway 37, a little more build

around muir island. a blip richmond getting toward san rafael. we do still see vasco road starting to build up, under a half hour from marsh creek road to 580. better speeds than typical because of lighter traffic overall. some slowing into hayward and in san jose right down here. back to you. >> thank you. well, in just a few hours a high-profile case involving a former san leandro police officer charged with voluntary manslaughter goes back to court. >> bob redell joins us live with the issue before the judge today. >> reporter: good morning to you, laura and marcus. we know there's a hearing scheduled for 9:00 in oakland this morning in superior court, and we also know that d.a., alameda count district attorney, d.a. pamela price, is trying to remove one of the defense attorneys from this case, the

defense attorney who is representing the former san leandro police officer. the d.a. has charged jason fletcher with voluntary manslaughter for allegedly shooting and killing 33-year-old steven taylor inside a busy walmart store when responding to a call about an alleged shoplifting inside the store. the encounter shows taylor with a baseball bat in his hands when fletcher fired. according to court documents, taylor had allegedly grabbed the aluminum bat and a tend before trying to leave without paying. as the case moves to trial, d.a. price has filed an unusual motion. she wants the officer's attorney, michael rains, and his firm removed from the case. price claims rains illegally received inside information from a disgruntled prosecutor, also a former client of rains. according to a declaration filed by rains, the former prosecutor, butch ford, paints a picture of a d.a. team out to get fletcher. ford claims another prosecutor told him, quote, if it were up

to me, i would charge him with murder. here is d. amp price when she spoke last month exclusively with jody hernandez. >> rains should no longer be on this defense because he illegally, improperly violated his oath as an attorney and took advantage of another client to gain confidential information that belongs to this office. >> it's desperate, they want me off the case because they know they're going to lose the case while i remain on it, and they will. >> reporter: rains calls the motion to remove him from the case an act of desperation. he also claims the information the d.a. is referring to was taken from a formal complaint filed by ford and not obtained illegally. reporting live, bob redell, "today in the bay." >> bob, thank you. now, we will continue to follow this story throughout the day. be sure to stick with nbc bay area, both on air, as well as

online, as we update you on this case. new overnight, four people are injured after a gunman walked into an ohio walmart and opened fire. the shooter then took his own life. it happened about 9:30 last night at a dayton suburb called beavercreek. authorities are not saying if the shooting was random or if he knew the victims. there's no update on their injuries. this morning, hayward police still looking for a group of thieves who made off with four vehicles from a hayward car dealership over the weekend. that heist captured on surveillance video happening on sunday morning. investigators say the group targeted city motors on mission boulevard. those thieves used an axe to break open the lockbox filled with keys. they then drove off with the vehicles. one thief even crashing through the car dealership's glass front doors with a mercedes g wagon right there. the vehicle worth more than $100,000. now, the dealership's glass doors are now boarded up and you can see glass shattered on the

sidewalk and street. thieves also stole two other cars off the lot. the general manager says that damage is extensive. >> the vehicle stolen, plus the car that got damaged, i would say over $100,000, close to $200,000, and $30 to $40 in keys, damages to taking the keys, and remaking keys. >> the general manager also says the dealership was robbed a couple of years ago, but those thieves didn't take any expensive cars or cause much damage. 6:06 right now. a follow-up, leaders in pittsburg have approved a plan to expand and modernize its traffic surveillance camera network. the first cameras went in nearly ten years ago. last night city council members approved a $300,000 plan to boost the software and servers. they approved an additional three cameras on top of the nearly 180 also in use. police say it will only boost crime fighting efforts. san francisco is at a point where it could lose local

control of its housing approval process. the "chronicle" reporting that city leaders must move quickly to meet the state deadline six days from now. that's when the city must sign off on a new ordinance meant to reduce red tape and allow fast tracking or more housing construction, minus the interference from city planners. supervisors have yet to hear the ordinance and it may not be approved until next month at the earliest. planners believe that there may still be a lag time, including a warning letter from the state or other steps before the city would ever lose full control. now to a live look this morning at sfo and l.a.x. airports are bracing for record-breaking travel this holiday season. tsa preparing to screen 30 million travelers across the country, experts say a rise in remote work will likely contribute to an extended stretch of holiday travel. "today in the bay"'s brie jackson joins us live from washington this morning. brie, many travelers already rushing to get to those

destinations. i feel like they're leaving earlier and earlier every year. >> reporter: that's right. good morning, laura. some of them are leaving earlier. as you mentioned, remote work has made it easier for people to work anywhere, so they can also leave earlier. what we do know is that the travel season is here and kicking into high gear for thanksgiving. tsa expects to screen about 2.6 million travelers just today, and possibly set a new record over the holiday season. the holiday travel season is here. aaa predicts more than 55 million americans will travel at least 50 miles from their homes. >> we get out on a monday and we come right back after before the crowds come. >> reporter: the busiest travel times this week are expected to be today and wednesday, and the sunday after thanksgiving. the biden administration says steps have been taken to minimize disruptions, including adding new direct routes and

opening up military air space to commercial traffic. >> we've got people literally working around the clock and across the country on aviation safety. we're going to continue that and accelerate it. >> reporter: stormy weather across parts of the country could cause headaches for travelers this holiday. >> we are seeing some weather systems that could play a role and affect flights. so it's going to be especially important to build a little cushion into your plans. >> reporter: for drivers hitting the road, experts say you can expect to see the cheapest gas prices since 2020, and lower food prices are driving down the cost of thanksgiving dinner this year. >> because wages are rising, this thanksgiving dinner is the fourth cheapest ever as a percentage of average earnings. >> reporter: annual holiday traditions are already under way at the white house. president biden pardoned turkeys monday, while first lady jill

biden welcomed the white house christmas tree. for thanksgiving, president biden and the first lady will travel to massachusetts this evening, where they will celebrate the holiday with family on nantucket. >> very, very nice. happy thanksgiving to you early. mike has good news for those hitting the roads this week. gas prices are dipping nationwide. >> less bad news. it's not as bad. >> that's how we look at it, less bad news. we'll get a look at that in just a moment. we want to talk about what's going on weather-wise because we've got potential weather issues on the east coast. >> and sometimes when there are storms and flight delays on the eastern half of the country, it basically affects everyone, because the flights that are coming into the bay area and into the west have those delays. so we are seeing a widespread swath of rain and storms moving from green bay all the way over to detroit and cleveland, also charlotte, atlanta, one of the

busiest airports in the world, where we are going to see that possibly causing some delays. and then back behind that, it is looking nice, but chilly temperatures, and at least here in the bay area we've got some of the milder weather we are seeing anywhere. as of now, there are no major flight delays at our airports, especially for the east coast as we continue to monitor that. and then looking here at home, still no flight delays, but they did have those high winds in l.a. we'll have to keep an eye on that. we are going to continue with a partly cloudy, mostly sunny sky. i'll have more on that coming up. mike, where can we find lower gas prices? >> we have some better news for thanksgiving travelers, drivers can expect we believe the cheapest gas prices on thanksgiving since 2020, according to the data we're seeing. the average price for a gallon of gas is expected to fall to $3.25 on thursday. that's the national average. still here in san jose, the prices have been dropping for about three weeks due to low demand and a drop in oil prices.

good tuesday morning. the time is 6:16. let's get a look at our day planner for berkeley. it will be mostly cloudy today, a chilly start. only 50 degrees. then going into the afternoon with mid-60s. it's going to be a cooler day and we're also going to have more weather like this going into our thanksgiving holiday. we'll talk about any changes in our forecast, that's coming up in a few minutes. and no real change to this shot. the taillights heading southbound on 680 toward the split with 24. this is walnut creek. we're looking at contra costa county and the build that potentially could happen. it's a tuesday, and i call it traffic tuesday. well, good morning, very happy tuesday to you. we get the fed minutes today, existing home sales as well. the stock market rally continued

yesterday. those who doubted it may be regretting it. both microsoft and nvidia at all-time highs. nvidia, which makes those super powerful chips used in ai reports profits this afternoon. microsoft praised for handling the openai debacle so well. no real changes about that story to tell you about. sam altman is still out as ceo there. the openai board unexpectedly fired him on friday. hundreds of openai employees sent a letter saying they will quit and follow sam altman to microsoft.

app fees. the little star location on valencia in the mission will remain open. there's also a location in albany. you know the song, marcus, "the night the lights went out in georgia". >> i know it. >> for the next few weeks the lights are staying on in one small alaska town. >> that's because they won't see any more sunlight until january. this is located in the arctic circle, but it's actually alaska's 12th largest town with a population of about 4,000 people, and probably a whole lot of flashlights. during the summer months there's 24 hours of sunlight. my cousin was stationed there for a while and he said sometimes at 2:00 or 3:00 in the morning they would be out playing football. >> i wonder how that plays tricks on you mentally. >> i bet. >> my uncle had a fishing group that went up during the summer months, and he said i get how you can lose track of time and become so disoriented.

they had dinner, they were relaxing, they look at their watch, it's almost 11:00 p.m. >> it's like you're at a casino in vegas. >> 4:00 in the morning? we have a beautiful sunrise, it is 6:21. as we take a live look outside in san francisco, it's a nice, clear start to the day. i think you should get the camera ready. i think we're going to have an amazing sunrise as we get more clouds coming in. we have some clouds in the mix and increasingly it does become partly to mostly cloudy. look at our start this morning. you're probably feeling this before you peel back the covers. we're at 47 right now in martinez, and it is 39 in santa rosa. but after this cold start, take a look at the afternoon. we're going to have a nice recovery here, with our temperatures for the most part in the upper 60s and low 70s, even upper 70s for san martin, and oakland today 69 degrees,

and 68 in novato and san francisco. tomorrow it's about the same, not seeing much of a change. eventually we will see a cold front coming in. the models show a very slight chance of quick-moving showers early on thanksgiving morning, and then after that we're back to the dry conditions and we'll see the cold air just pulling down across the bay area with a very chilly weekend ahead. we're going to really feel the difference in the early morning hours. i want to show you santa rosa. we're going from highs in the upper 60s to low 70s, to highs in the low to mid 60s in the extended forecast. our mornings will be frosty and even freezing in some spots as we go into the weekend and early next week. we're preparing for that as our temperatures reach into the mid to upper 60s in san francisco. mike, how is that drive looking? >> it's looking bad but it's actually not. there's movement at the bay bridge toll plaza. the approach is looking really great. little tiny blips show up 242 and 680.

watch out for storms. it's very chilly as you're getting ready to head out this morning. we're seeing a lot of upper 30s in parts of the bay area, from the north bay to the east bay, down the peninsula to palo alto, it's 38 degrees, and 39 in san martin. but as we get a look at dublin, it is a clear start. eventually we'll start to see more high clouds moving in and our temperatures going from mid-50s to mid-60s, not bad. we are also going to have some warmer weather in the south bay. we'll talk about thanksgiving coming up. mike, you're seeing a backup out of contra costa county. >> this is the richmond bridge heading toward san rafael. take a closer look. this is a build that's pretty typical about this time, and actually getting to that spot not quite so bad off the eastshore freeway. the eastshore freeway itself, that's all green from top to bottom coming out of the north bay. the backup fills in the toll plaza. slowing south 880 coming through hayward, approaching the san mateo bridge. easing up a bit by the time you get to the dumbarton bridge.

there is a crash on the nimitz freeway. it looks like it's all right. mild slowing just starting to build for san jose on 101, the source down here in san martin, we do see a lot more traffic toward dunn, so that does mean more traffic into the south bay. but overall lighter. back to you. >> thank you very much. new overnight, one person is in the hospital after a fire destroys a home. firefighters say it was packed to the brim on the peninsula. it started a little after 11:00 p.m. on meadow lane near middlefield road in redwood city. firefighters described the home as being in hoarder-like condition. when they arrived, they encountered heavy smoke and a downed power line. we don't know the condition of the person hospitalized. it's believed there were others in the home who made it out safely. the cause of the fire is under investigation. firefighters say it may have started as an issue with the water heater. developing right now, new advice from the head of the cdc, urging everyone to go the extra mile when it comes to protecting

themselves from illnesses, including the latest covid variant. >> "today in the bay"'s kris sanchez joins us with a best way to get ahead of the respiratory illnesses. >> reporter: chances are you've heard someone at work or school pickup saying there's nothing going around. it turns out there are a few things going around. let's start with the new covid variant, hv.1, an omicron subvariant. as such, it is highly transmissible. the main symptoms for this one, congestion, sore throat, dry cough, really kind of in the upper respiratory part. people are reporting the other classic covid symptoms that we've come to know as well. an updated booster became available in september, but at this point only 14% of adults have gotten that booster, and just 5% of kids. there was a little supply issue as we transitioned from the federal government advertising it to getting it from your health care provider. those seem to be smoothed out.

75% of people skipped the booster last year as well. the cdc director was on the show this morning with three seasons to get up to date. >> the virus has changed and you want the most updated protection you can get. if you've had covid or been vaccinated, that protection has decreased over time. third, people are still getting long covid, the long symptoms from that virus, even if you get a mild case. >> on top of covid, the flu season got off to an early start. some people had it during the summer. the cases are still rising in california, also in seven other states. what you want to keep in mind as you travel around the country. at this point, just one-third of people are vaccinated against the flu. the new cdc director says i'm a parent, and i don't ask people to do anything that i don't do with my own kids. she said her kids are boosted

and have their flu shots. probably to their dismay, they're 9 and 11. she said testing is going to be critical. there are therapeutics for the flu, there's tamiflu and for covid there's paxlovid. >> keep in mind, the government is offering the covid tests for free. >> reporter: yes, you can get four of them. go to covidtests.gov. you can share that as well. >> it takes less than a minute. >> you get a package and you don't get in trouble. >> i can't get sick. i have a lot of family coming into town. >> thanks, kris. it is 6:36 for you this morning. and happening today, nine suspects tied to a statewide sex trafficking ring are due to be arraigned in a south bay courtroom. prosecutors announcing the arrests two weeks ago and the rescue of nearly 20 women.

investigators say some of the trafficking took place at a hotel in san jose, but the women were found from gilroy to hayward. authorities are calling it one of the largest sex ring busts in state history. six men, three women, are facing dozens of criminal charges, with more suspects and victims still believed to be at large. a former palo alto police sergeant is due back in court facing two misdemeanor charges tied to a controversial arrest. our investigative unit uncovered video of the arrest that shows police pulling alvarez from his palo alto home in 2018 on suspicion of driving with a suspended license. officers can be seen slamming him against a car and at one point a supervising officer appears to mock him for being gay. the former sergeant benetiz pleaded not guilty to the charges, which included lying on a police report. a source tells nbc bay area the case may wrap up today with some

kind of plea deal. reality is setting in for san francisco residents who had hoped the clean and safe streets they enjoyed during the apec summit last week would still be there. the state and city worked to make sure san francisco looked its best during the week-long international event. experts say the city pushed the unhoused into the tenderloin, soma and van ness corridor, but some are returning to other parts of the city, including this intersection at jones and mcallister. last week our cameras caught 15 to 20 people milling about. experts say that it would cost a staggering amount of money for the city to keep those changes in place. >> unless you're going to pay unlimited overtime all the time for everyone, or hire 700 more police officers, we aren't going to be able to achieve the type of scene that we got to witness last week because of apec.

>> now, the experts say that the city would also have to pay for thousands of recovery beds for the fentanyl addicted if it wants to permanently bring back the changes san francisco saw last week. new at 6:00, new comments from the elusive owner of the oakland a's, but it probably won't give much hope to bay area fans demanding he sell the team. john fisher yesterday spoke with the las vegas review journal. he says in part, quote, i want my family to own the a's long into the future. we are committed to building a state of the art ballpark on the strip and bringing more championships to southern nevada. last week, major league baseball owners unanimously approved the a's move to las vegas. oakland fans are vowing to continue their fight following months of pleading for fisher to sell. there are still some potential snags, including an effort by nevada teachers to block funding for the planned stadium. right now there's still no groundbreaking date, although leaders are promising to have

the stadium ready by the start of the 2028 season. well, get ready to hit the slopes. here is a live look at heavenly ski resort in south lake tahoe, which opens today. the opening was held up a bit. heavenly was supposed to open last friday, however warm temperatures in the mountains forced it to delay the opening until today. north star in truckee begins operations on thanksgiving day and its opening was also pushed back due to the weather. meteorologist kari hall has been telling us all about that. some juicy storms are needed, but for right now it's clear so you can make your way up there. >> you can make your way there and back, but we won't have mother nature making snow for us any time soon. i think at least the temperatures are cooling down as the cold front moves in. we are going to have some cold mornings and also chilly mornings in the sierra. here at home we're waking up to chilly temperatures and a mostly clear sky. a beautiful sunrise as you're

good tuesday morning. the time is 6:45. let's get a look at our current temperatures. it is a very chilly start for most of us around the bay area, with upper 30s and low 40s. but after this cold start, a really nice afternoon ahead. we'll take a look at that and some cooler weather in the

today and they can sing to me. i just want you to know it's difficult turning 60. it's difficult. >> earlier, the president posted a picture of his birthday cake, totally ablaze with candles. he says he hopes the candle factory has union labor and the workers got paid overtime to make so many candles. no matter your politics, most people can admit, president biden does a pretty good job of laughing at himself, and using the insults thrown at him to his advantage, whether that's cake that's a four-alarm fire or drinking from a brandon road. brandon was supposed to be an insult. or labeling his own economic plan bidenomics, which started out as an insult. but he adopted the word and uses it constantly. a federal court has struck down portions of the voting rights act, a move that will almost certainly put the whole law in front of the supreme court. civil libertarians and individuals have used the rights spelled out in that act to sue

to stop unfair voting practices. but a decision by the 8th circuit says the law as written doesn't allow groups and individuals to sue under the law, only the federal government and nobody else, which might be okay unless it's the federal government itself that's moving to stifle your vote. first lady rosalynn carter's funeral will be next wednesday. that will be private. there will be a public ceremony the day before. here is the head of the white house historical association speaking quite frankly about the health of 99-year-old former president jimmy carter. >> as close as they were, we don't know how long he may continue. but i imagine it's a deeply sad moment for him, of course for the family as well. but i think it's important that we take a moment at times like this, at her passing, at his passing that will be at some point in probably the not too distant future.

>> we'll keep you updated on nbc's plans to cover the public aspects of the first lady's funeral next week. >> thank you. there's new momentum this morning in the push to recall new sunol school board members who banned the flying of the pride flag. in september linda hurley and ryan jurgenson approved a policy allowing only the u.s. and state flags to fly at the school. a third board member voted it down. yesterday the sunol teachers union announced a vote of no confidence in both of them. it follows the launch of a recall campaign. he plans to vigorously fight the effort which he sees as being led by outside activist. hurley has not responded to our request. three people are recovering after a light pole fell at disneyland that happened yesterday morning on main street after a gust of wind blew through the theme park. one person was taken to the hospital to be treated for serious injuries.

>> what a difference a year makes. >> i would like to see biden do those moves, too. >> a little run. we're waking up this morning dancing to try to stay warm because it's cold out there. but it is a beautiful sunrise, so this gets your tuesday off to a great start as we take a live look outside in san francisco. a few high clouds moving in and those clouds will continue to move in today. also a picturesque sunrise as we take a look at walnut creek as well. don't get too distracted on your way to work. it is a very chilly morning, and even though we're seeing 30s and low 40s, here is a look at our highs we're seeing. we're headed for the upper 60s and low 70s, even mid-70s for gilroy. this is going to be the case across the bay area. pretty uniform temperatures. we will have a partly to mostly cloudy sky, once again, high clouds filtering that sunshine. as we approach our thanksgiving morning, it does show that there's going to be a cold front moving in and a very slight chance of rain. that may be moving through around 1:00 to 2:00 in the

morning. and then we go into the rest of our thanksgiving holiday with increasing sunshine and mild temperatures. even going ahead to see what else is going to be happening across the region, not a whole lot. we're going to see high pressure building, but also some very chilly temperatures, especially in our overnight hours into the early mornings as we go toward the weekend into early next week. so we take a look at livermore and our ten-day forecast going from upper 60s to low 60s. look at saturday's high. only 60 degrees. it's very likely that our mornings will be frosty, even freezing in some spots. so get ready for that. you might want to take a little bit of extra time to make sure any sensitive plants outside are moved indoors as our temperatures drop this weekend. mike, you were focused on a crash in san ramon. >> southbound 680 heading out of contra costa county toward alameda, there is a crash. the yellow barrels designed to

welcome back. we're moving you forward with a look at this morning's top stories, including one person in the hospital after a fire destroyed the home firefighters say was packed to the brim on the peninsula. >> it started a little after 11:00 p.m. on meadow lane near middlefield road in redwood city. firefighters describing the home as being one of a hoarder, and

when they arrived they encountered heavy smoke and a downed power line. at this point we don't know the condition of the person hospitalized and it is believed that there were others in the home who made it out safely. the cause is under investigation, but firefighters say that it may have started as an issue with a water heater. later this morning, a former san leandro police officer will return to court in connection with a deadly shooting inside a busy walmart store. jason fletcher is charged with voluntary manslaughter in the 2020 shooting of steven taylor, who was armed with a baseball bat. the alameda county district attorney pamela price is moving to remove fletcher's attorney, michael rains, from the case. price claims rains illegally received inside information about the case from a disgruntled prosecutor. a judge is expected to hear arguments surrounding that motion at 9:00 a.m. new advice this morning from the head of the centers for disease control as the rate of respiratory illnesses starts to
