woke up, i was hot. yeah that happens quickly doesn't it? so in the morning you need to open the windows. close them at around 8 to 9:00. it's going to be hot again today and we are going to have those temperatures ramping up quickly. the last day that we will see these kinds of temperatures. and then we get some slight relief tomorrow. more relief for the weekend with some wind and cooling temperatures. but the heat will be returning early next week, so we're not completely done with these kinds of temperatures, but we are seeing our highs headed back to 96 degrees for concord and livermore will be in the low 90s for much of the north bay and in the south bay san jose, hitting a high of 89 degrees. we'll talk about some cooler temperatures in our forecast coming up. and mike, you were watching the bay bridge toll plaza. yeah, not for the volume of traffic. i mean, i'm always watching to see any major changes. it was one set of headlights, which in the last i think 60s has been cleared from that overcrossing coming off the 880 approach. look at that. all right. well, i was watching a

backup potential issue over there. now it's no longer. so that's great news. there is a crash right here for the east shore freeway has been cleared for a while. as far as any slowing. that's just off of university. and we do have a report of a roadside fire. this is north 880 right around fifth. no slowing sensors. i'll see if any on ramps or off ramps are affected. back to you. all righ. thanks, mike. 502 right now. happening today. three men set to stand trial in the deadly shooting of oakland police officer twan lay. he died in late december after responding to a burglary call at a cannabis dispensary. today in the bay's ginger conejero saab is live for us this morning. and ginger, this case has already included some major revelations, including one of the three defendants. that is correct. good morning, marcus and laura. there are three defendants in this case that are charged with murder. a fourth that's charged with three counts of second degree burglary. but let me start with those three men who are accused of murder. mark sanders, brian russell and alan brown. will stand trial starting today after an alameda county

judge found that prosecutors presented enough evidence to show that the accused man, quote, knew or should have known that officer twan lay was a police officer engaged in his duties at the time of his murder. based on the court's finding at least one of the defendants, mark sanders, faces a possible sentence of life without the possibility of parole. now, earlier in the year, it was revealed that another defendant, brian russell, was on probation at the time of his arrest. court documents show alameda county district attorney pamela price dismissed charges against russell just months before officer lay's shooting, which included kidnaping, to commit a robbery or sex crime, and special allegations for use of a firearm. now, with regards to officer lay's murder, russell faces murder charges with a special allegation of felony murder and three counts of second degree burglary. in january, oakland police force or the oakland police force and other law enforcement agencies

paid a tribute and said their goodbyes to officer lay, who was shot in the head and died at a hospital just hours after responding to a burglary at a cannabis dispensary. lay was 36 years old. he was the first oakland police officer killed in nearly 15 years. now the trial begins at nine this morning in oakland. the three defendants who are accused of murder are scheduled to appear in san francisco, ginger conejero saab, today in the bay. certainly hit the oakland community hard when that happened. all right, ginger, thank you. angry parents and school workers expressing frustration with san francisco school board members. they packed last night's board meeting, which took place with new leadership after the former board president stepped down. the district is facing a decision on school closures due to declining enrollment. opponents made a desperate plea for them to reconsider the district maintains it's now working on its best plan to redistribute students to remaining schools. there's no excuse. there's an excuse to

close schools. and privatize is disgusting. maybe it seems to you that it's a drain on the money, but it's really not a drain. and if sacramento says it's not a drain, it's not a drain. the tie breaker for students who are enrolled in schools that are recommended for closure would go just below the sibling preference. and our current enrollment system recommended list of closures is due next month. and while the union is demanding the district fill its vacant positions, the district says it is committed to sustainable financial practices. new overnight new concerns of escalation in the middle east as israel launches a deadly military operation in the west bank. at least nine deaths are now confirmed. this is video that appears to show idf bulldozers clearing the streets overnight. palestinian health ministers say israeli forces have sealed off the city of jenin. israel considers the city a militant stronghold. palestinian leaders are calling

on the u.s. to intervene. turning now to decision 2024. both the harris and trump presidential campaigns ramping up stops in key swing states. and this all comes as the former president, facing new legal challenge and indictment from special counsel today in the bay's alice barr. joining us live from washington this morning with the latest on those new developments. alice good morning. this new indictment is bringing former president trump's legal battles back to the forefront at a critical time in the campaign. this morning, a new effort to hold former president trump criminally responsible for trying to overturn the results of the 2020 election, culminating in the january six capitol attack. in a revised indictment, the department of justice charging mr. trump with the same four counts, including conspiracy to defraud the united states and obstruct an official proceeding. but stripping out references to certain official acts to comply with last month's supreme court

decision that found former presidents are immune from prosecution for much of their official conduct while in office. former president trump slamming the new superseding indictment as persecution of a political opponent. he's long contended former presidents need absolute immunity to protect their power to act. you're not going to do anything if you don't have immunity, because otherwise you're going to be prosecuted after you leave office. in the new documents, special counsel jack smith strikes some conduct. the supreme court said was off limits, including the former president leaning on his justice department to support false claims of a rigged election. but it retains allegations about pressuring former vice president mike pence into not certifying the election results. what's added is lots and lots of language saying that pence acted as either a candidate or as president of the senate, in other words, not as an official piece of action, and that trump was acting also in an unofficial

way. it all comes as the former president's reelection bid hits a critical stretch, campaigning in wisconsin tomorrow as his rival, vice president harris and running mate governor tim walz kick off a bus tour in georgia today. the trump legal team is expected to try to get this new indictment dismissed, arguing it still has fatal flaws under the supreme court's reasoning and this entire appeals process, it's anticipated to stretch out for months well beyond election day. marcus, about former president trump's opponent, vice president kamala harris. well, she's been criticized for not doing interviews. have we seen any movement with that? we sure have. so she's kicking off this bus tour in georgia today and tomorrow night in georgia. she is going to have her first sit down interview alongside her running mate, minnesota governor tim walz. it's going to be on cnn and they are answering that criticism that you know, they

need to get kind of pinned down on a wider range of policy issues, something they've been sort of resisting to this point as they just keep trying to ride that momentum. all right. we will be watching to see what is said. all right, alice, thank you. we are also watching the weather. these days because summer made a comeback earlier this week. taking a live look outside downtown san jose, waiting for the sun's arrival. kari is here. another hot one on tap. yes, and it's even warmer this morning as we're starting out with some upper 60s in the south bay. we do have upper 50s and low 60s for much of the east bay. we're at now 65 degrees in hayward, and it's 56 in sonoma. so we do have our cool morning start. here's a look at the trend in antioch. our temperatures heat up quickly. and at noon we're going into the upper 80s headed for the mid 90s at 3:00 and a breezy wind picking up and then eventually temperatures will start to cool down again at 6:00. we're still at 90 degrees. pretty hot out there for several hours as we go throughout the day. and these

temperatures above normal all across the bay area as summer heat continues for us, for today, it will be 91, in santa rosa and in san francisco. we're staying in the upper 70s. we'll talk about some cooler temperatures ahead that's coming up in a few minutes. mike, i know your prices are probably rising ahead of the holiday. that's what it seems like, because even though a lot of the prices i'm looking at seem the same, they're lower as far as the ten best in the state. san jose still leads one with 379, but we'll focus on cupertino also in the south bay. their low for that city. 389 at great gas on north deanza boulevard. contra costa county will call out the low there of 389 as well. that's at clayton gas and wash on clayton road in concord. it's just north of the city line. and then a much higher low is in san francisco here at the bottom. best price is best gasoline mini mart on san jose avenue. 419 that's not far from the balboa park bart station, which might be cheaper. i don't know, you take out the timing

selling. many would say the best drones on the market. but dji is chinese and congress wants to ban their sales. so dji plans to license its technology to an american company and have that company build the drones. but a congressional committee says that's a drone clone, a workaround to get around the ban on chinese products. and finally, the nfl has changed its rules to allow private equity to buy into teams. private equity is just a pool of money. baseball and other sports have allowed this for years. the nfl has a has always preferred single owners, but they've gotten so expensive these teams. it's just not possible. there are restrictions. the nfl still has to approve the purchase. limited number of private equity firms allowed to participate, and no sovereign wealth funds. so you saw the saudis buy into golf. they essentially own golf. yeah they're saying, you know, to nfl that doesn't really stop the sovereign wealth fund from buying into private equity and

going to have that hazy sky again today with some slightly more unhealthy air quality in parts of the east bay. and it's also going to look hazy as we go into the afternoon for much of the bay area, as we get all these pollutants that are settling into the valleys and our temperatures will reach into the low 90s again today, we're not seeing as many upper 90s in the south counties. so we're making a little bit of progress here, and that's going to be the trend over the next few days. now we are still headed for the upper 90s in antioch, 96 in concord and walnut creek in fremont. today, we can expect a high of 88 degrees, and seeing a lot of 80s for the peninsula from 84 in san mateo to 87 in palo alto, san francisco will be in the 60s and 70s again today. a breezy wind, a lot of sunshine, but still very hot farther north, with ukiah again hitting the triple digits. we'll see a high of 92 today in sonoma. looking ahead, we are going to see the development of an area of low pressure off the coast that's going to help cool

us down. going into the next several days. if you're traveling north for the labor day weekend, you may encounter some showers and some gusty winds. but here we're just going to see more of the coastal fog and a sea breeze to help bring down some of those temperatures, at least for a couple of days. we'll see that as we go into the weekend. saturday, sunday, even labor day is looking pretty nice. but then after that it will start to heat up again and we'll see mid 90s for the middle of next week. and in san francisco mid 70s today. but we'll see some 60s at times throughout the weekend. mike, you're seeing a couple of slow spots developing. yeah one of those we would predict right right on schedule highway 37 shows the slowing out of vallejo in the north bay, heading over toward nevada where there is a crash, but it's on the shoulder 101 at the 37 junction. the other slower spot has been here. we've been talking about it the last two reports. now we see even more slowing, more distraction. and perhaps they did a traffic break north from 23rd up to fifth. the off ramp is closed. they're use the next downtown exit because that 1st

of the week. i'm marcus washington. good morning. when you say hump day. i think a camel, but maybe you need to be more of a tiger on a wednesday. let's check the forecast with meteorologist kari hall. i guess we are in the dog days of summer, though. yes, we are, and it's going to be very much of a summer feel as we go into the afternoon. those temperatures will be heating up quickly, but at least for the weekend as we're celebrating the end of summer unofficially with labor day, we are going to see those temperatures coming down. here's a live look in san francisco. the heat continues for the inland valleys, and more wind and cooling from friday into the rest of the weekend. but the heat will come back right after labor day. so here's a look at our highs for this afternoon. palo alto up to 88 degrees 86 in hayward and in vacaville today 96 degrees. you can see the range and temperatures there. we'll talk about what's ahead in a few minutes. and mike, we continue with a couple of active scenes. yeah. one of these hasn't been a major issue, but i see more slowing now. now there's a dump truck with that

back part raised up. i think it might have banged into the overcrossing there at 65, 86, 80, the dublin interchange. there's also a construction crew in the area from overnight road work. i think that's why they're slowing because they're clearing. but we'll follow up once the chp updates. anything to do with that dump truck. typical pattern though in the area here. a typical slowing. we don't expect to see this much slowing as you're approaching the fifth embarcadero off ramp for northbound 880, but we lose the slow lane. we also lose the exit if it's not available. by the time you get there and you need to use the embarcadero exit, continue to the oak exit. oak street will get you to city street. you loop back. it shouldn't be a problem right now. again, there's a car fire there taking care of north 880 at fifth. the rest of the bay. very easy drive right now. back to you. thanks so much, mike. well students at another bay area high school rattled by on campus violence. the latest incident happened at hayward high school. and that's where we find today in the bay's bob redell. this morning. bob, i'm sure the school is working to make students feel safe there, but there have been concerns of violence at many bay area

schools. you are unfortunately correct. good morning to laura and marcus hayward high. behind me here says they are going to have more campus security people on campus to make the campus feel more secure. this is after two kids here were stabbed during a lunchtime fight. that was this past monday. so a couple of days ago, three students were arguing when one pulled out a knife and cut the other two students. both of those students who were injured went to the hospital. they are expected to be okay. here's a parent who is concerned for her own child's safety. after hearing about monday's knife attack. you don't want to lose a child, especially to violence like this, especially when you trust the people you know, you drop them off here and they're responsible for taking care of our babies and they don't. hayward police is investigating. they did question the student who allegedly stabbed the other student. so far, no arrests. we've learned new details about an attack this past friday at dublin high school. police say a

15 year old student who was assaulted on campus was first confronted by a parent. investigators say the parent and four teens who were wearing hoodies followed a student into the boy's locker room. that's when the group allegedly assaulted him, then took off. paramedics did rush that student to the hospital with non-life threatening injuries. dublin police have not identified the teens involved in the attack, but say they are between the ages of 16 and 19 years old. pd does not believe that this was a random attack and they do continue to investigate and you might recall last week, a student at san francisco's galileo high school was shot just off campus. one witness says. witness says they saw two teenagers fighting when one of those teenagers pulled out a gun. the injured student was expected to recover. it's not clear if the suspected teenage shooter is also a student. police have not commented on whether they've identified the shooter or if there's been an arrest. reporting live here

outside hayward high bob redell. today in the bay. very, very concerning what's going on at these schools. all right. thank you very much, bob. 5.34 right now. new details. this morning on the mother and son killed monday in a wrong-way head-on crash in the south bay. authorities have still not officially identified the victims, but an email sent to the parents by san jose summit tahoma charter school confirms the 14 year old was a freshman there, and one of the mother's coworkers confirms she worked remotely and had gone to pick up her son from school. chilling video shows a pickup truck headed in the wrong direction on northbound highway 85 prior to this crash. the chp says the pickup driver is still in the hospital with major injuries at this point. now for this crash, we are definitely looking at felony manslaughter charges. there may be additional charges that that result as a as the investigation continues, officers are still looking into whether the driver was under the

influence of alcohol or drugs and say he has a previous arrest record, including a dui, earlier this year. they say he was cited for driving without a license. happening now a deadly shooting in the east bay is under investigation. this happened shortly before four in the afternoon yesterday on 25th and international boulevard in oakland. police say that someone shot the victim in the parking lot of a dollar tree store. if you have any information about this shooting, you are asked to call oakland police. well, the owner of a vallejo bridal shop is expressing new gratitude this morning. this is for a good samaritan who actually stepped in to help stop a suspected thief. that theft caught on camera. this happened in the early morning hours last friday at alexis floral bridal on tennessee street. now those cameras actually capturing the intruder, smashing the windows in the glass door, causing thousands of dollars in damage. well, the store owner says that workers were alerted by an alarm system and quickly responded.

but so did a man who lives nearby who actually saw what was happening and intervened. he actually stopped that suspect, and then helped them at the doorway until police arrived. we were able to communicate with the vigilante that a lot of people are, you know, calling the batman. you know, we've been in contact with them and, you know, we've we've, you know, said thank you. police tell us the unidentified suspect was already wanted for a previous burglary. they also say he had about $300 in stolen merchandise. now, to a live look at the state capitol. lawmakers have until midnight saturday to pass new legislation. one bill moving closer to the governor's desk may help people make it in the bay. a state senate committee is advancing a bill which would allow undocumented immigrants to apply for the state's first time home buyer assistance program. some republicans are expressing concerns over the bill, saying more applicants could take money away from veterans and documented immigrants. the full assembly must now give the

proposal the green light before it is sent to governor newsom's desk. well, excitement is hitting a fever pitch in the city of light paralympics began today in paris, and we are just a few hours away from the opening ceremony. now, the games have already set a record for the most tickets sold. 4500 athletes set to compete across 22 sports over 11 days. team usa swimmer olivia chambers will be a force to reckon with because she suffers from an eye condition and uses a guide dog, but she says being in the water brings out her own animal within. once i hit the water, i just get right into it. you know the feel of the water, as we say, and you just go. i like to cheer myself on a lot, just in my mind. there's just something different about diving in the water and being in your own lane. you're in your own world. being one with the water there. you can actually keep up with all the action on peacock. the opening ceremony streams live at

10:00 this morning. for a look at the paris forecast for day one of the paralympics, we want to turn it over to meteorologist kari hall. now, kari, it was a pretty hot during the olympics. before with the paralympics. how are they looking? it looks like it's still going to be a little bit humid, but we are seeing some cooler temperatures, at least for now. the highs will be very normal for this time of year. upper 70s partly to mostly cloudy into the day tomorrow because we know it's already afternoon there. we are looking at our temperatures in the upper 70s now. over the next few days we will have to watch out for afternoon showers, pop up thunderstorms, but overall we're not seeing any extreme heat there, which will be great for those outdoor events here at home. we have been dealing with some hot weather and we're starting out all clear as the sun rises this morning. we are going to see quickly warming up. and here's a look at some of our east bay high temperatures for today. oakland will hit a high of 81 degrees, but 91 in martinez, 95 in pleasanton in antioch at 98 degrees. in union

have the next few hours to get in those outdoor activities before temperatures, heat up at noon. we're at 84 degrees and we're headed back to close to 90 degrees. we'll get a look at all of our microclimates and cooler temperatures ahead coming up. and we are looking at a better situation. that dump truck that hit what it was part of a structure at the six 8580 at the dublin interchange. well, crews inspected the sign. that's all they were worried about. it's okay. all lanes just reopened. heading north on 680. should get better. but look at the slower drive right now from before you get to bernal. so just north of sunol boulevard, up to the dublin interchange, 680 will be recovering again as crews and the crash have both cleared at 580. thanks so much, kari and mike. it is 5:45 right now. new video to show you. searchers looking for a missing woman and her adult son in southern italy following a landslide. it happened in a small town about 20 miles northeast of naples. the pair were traveling in a three wheeler. crews found that

wreckage in the mud. the landslide also forced several people from their homes. well, now to decision 2024. and the controversy over donald trump's appearance at the arlington national cemetery earlier this week. yes, this is really interesting, scott mcgrew joins us now. the cemetery says there was some sort of incident. that's exactly how they're phrasing it. good morning, npr. the first to report a cemetery official tried to restrict a trump photographer. the cemetery will only say, quote, there was an incident and a report was filed, which obviously we're trying to see that report. cemetery rules say you are not supposed to use the cemetery as a backdrop for campaigns. trump was there on monday to mark the third anniversary of the withdrawal from afghanistan. it was a solemn ceremony as you see, at the tomb of the unknowns. and trump did not make any speeches there. but there were also photos taken in a restricted area called area 60, where some of the 13 u.s. service members who were killed on that last day are buried.

this picture taken by the governor of utah. a thumbs up with family members at the grave of marine taylor hoover from salt lake city. the trump campaign said it had written permission for a professional photographer to be in area 60, and that it had video proof. the cemetery worker was at fault for trying to stop them from taking photos. a despicable individual says the trump campaign spokesperson, steven cheung. special counsel jack smith has revised the indictment against trump, filed in washington, d.c. the one that covers trump's attempts to overturn the results of the 2020 election. smith narrowed the indictment, adjusting for the recent supreme court decision that presidents do have immunity for some acts. so i don't think that it's changing anything legally. i think it's clearly an effort to try to do more election interference from jack smith. he should be ashamed of himself. it's one of the reasons why we have to win, because he should not be anywhere near power. okay. on a much lighter note, something that's been on my

calendar for a while now. it was ten years ago today. president obama startled the world by wearing a tan suit. obama's press secretary defended the decision, pointing out it was just a few days before labor day, and historians point out ronald reagan wore brown suits all the time. but social media, which was somewhat new at the time, would not let it go. president obama even mentioned the moment years later. off the top of his very last press conference. good afternoon everybody. let me start off by saying that i was sorely tempted to wear a tan suit today for my last press conference. but michelle, whose fashion sense is a little better than mine, tells me that's not appropriate in january. the tan suit controversy. 50 shades of beige is so memorable. a lot of people took notice when kamala harris showed up to the first night of the democratic national

looking at a high of 92 and will be in the mid 90s for east san jose. look for those upper 90s again for antioch as well as concord walnut creek 96 degrees. martinez will hit a high today of 91. still really hot. there and some mid 80s for hayward, but it's going to be very comfortable for half moon bay and then for much of the peninsula, we're in the mid 80s in san francisco, 70 in the marina district, and for the north bay, 91 in santa rosa and 102 in ukiah. so look at what happens as we get closer to the weekend. we're seeing the high pressure now, but an area of low pressure, this will be a storm system with some cooler temperatures. and with its counterclockwise wind flow, that's going to help bring in some more of that cool sea breeze air into the bay area and bring down the temperatures, at least for a little while. so take a look at napa. it will be in the mid 90s today, low 90s through saturday, but then sunday we're going to drop it

down to the 80s and we'll see that continue into labor day. and then right after that it gets hot again. so we are not completely done with the heat, but at least we do get a brief break in time for the weekend. getting out there and enjoying a long holiday weekend. while san francisco will see some mild temperatures continuing through that 7-day forecast. mike, do you have another backup developing? we do now. it's about that time, right? we're approaching 6:00, so we expect to see the build up here at the toll plaza. the metering lights turned on at regular time. nothing dramatic. a smooth drive until you get to the end of the 880 overcrossing as well. that's developing. hopefully another actually, perhaps two more should be clearing as we speak. maybe by 615 we should see full recovery for westbound 24. there's a quick traffic break after a crash in the middle of the roadway. no injuries reported. i'll track that portion of 24. we see these speed sensors below me. they're all improving. northbound 880. this has been cleared from the blotter. the earlier car fire and closure of the slow lane, as well as the fifth exit there.
