the accused shooter, 14-year-old colt gray, will make his first court appearance this morning. >> overnight, authorities revealing his father will also face charges including the involuntary manslaughter, second degree murder and child cruelty. sources telling nbc news he gave his son an ar-15 assault-style weapon as a christmas present. that was after authorities said they interviewed the father and son last year in connection with threats to carry out a school shooting. >> we got it all covered this morning. let's get started with priya sridhar in georgia for us this morning. good morning. >> reporter: good morning, savannah. 14-year-old colt gray appeared in court this morning, facing four felony murder charges for the four victims. he was wearing shackles and was soft spoken with the judge and just moments later, his father appearing in front of the same judge in the same courtroom. this morning, the accused school shooter at the courthouse. >> in essence, you're charged

with four counts of felony murder as outlined in the state warrants that have been issued against you. >> reporter: 14-year-old colt gray facing a judge in georgia, just hours ago, after the deadly morning that left four people dead including two students and two teachers. gray's father colin also appearing in front of the court. overnight, the father was charged with four counts of involuntary manslaughter, two counts of second degree murder, and 8 counts of cruelty to children. >> these charges stem from mr. gray knowingly allowing his son, colt, to possess a weapon. >> reporter: two law enforcement sources familiar with the investigation telling nbc news the father gave his son an ar-15-style rifle as a gift after they were interviewed by authorities last year, following an online threat. the same type of weapon was used in the mass shooting.

according to a incident report, following that interview last year, colin gray told authorities that his son was allowed to use his father's hunting rifles when supervised, but, quote, does not have unfettered access. investigators this morning are still searching for a motive, indicating gray was a brand-new student to the district. wednesday, just his second day at the high school. barrow county sheriff jud smith crediting a new implemented at the school with saving lives. >> they pressed it so many times and it alerts us where the incident is occurring. >> reporter: this morning, we're also learning of heroic acts by math teacher and football coach richard aspinwall, witnesses say he died protecting his students. >> if he wouldn't have gone out there and checked and seen what the commotion was, who knows if that kid would have been able to

come into a second classroom. so he is, by far, a hero. >> reporter: the judge still did tell colt gray he won't be facing the death penalty since he is still a teenager, however, he could face life in prison with or without parole. savannah, back to you. >> all right, priya, thank you very much. that shooting in georgia became an instant topic of conversation on the campaign trail yesterday, both candidates are getting ready to face off in their first presidential debate, now that is just four days away. our chief white house correspondent peter alexander has the latest for us. hey, peter. good morning. >> reporter: good morning. that's reignited this political debate over gun violence in this country, where the competing candidates have very different views about how this issue should be addressed going forward. we heard from mr. trump's running mate, who said among other things there should be new

actions to fortify schools and separately the harris campaign is pushing for tougher restrictions, including efforts to keep guns out of the hands of criminals. a political war of words breaking out overnight, after republican vice presidential candidate jd vance weighed in on the georgia school shooting. >> the kamala harris answer to this is to take law abiding american citizens guns away from them. clearly instruct gun laws is not the thing that is going to solve this problem. i don't like that this is a fact of life. but if you're -- if you are a psycho, and you want to make headlines, you realize schools are soft targets and we have got to bolster security at our schools. >> reporter: vice president harris focusing on the fact of life comment, writing, school shootings are not just a fact of life, it doesn't have to be this way. vance responding, instead of addressing her own failures, she lies about what i said. harris' running mate tim walz also on the attack calling the vance comments pathetic and

campaigning in the key swing state of pennsylvania. >> i think it is a brilliant quote, by your great governor josh shapiro. i hear him say this, whenever donald trump's talking about america, he's [ bleep ] talking america. >> reporter: while both presidential candidates are focusing on the economy this week, mr. trump promising to establish a government efficiency commission that would audit the federal government to cut waste. an idea floated to him by elon musk. >> elon, because he's not very busy, has agreed to head that task force. >> reporter: musk writing, i look forward to serving america if the opportunity arises. though any official role in a trump administration would likely raise conflicts of interest, because musk owns companies that have major contracts with the government. among mr. trump's other economic plans, higher tariffs on imports and eliminating taxes on social security benefits and tips. a proposal recently embraced by harris.

>> she is actually tapping a lot of my plan. we're going to send her a maga cap sometime in the next week. >> reporter: about mr. trump's plans, increase tariffs on imports, harris slammed that as a trump tax that would cost american consumers. mr. trump, we should note, also yesterday warned that a harris presidency would lead this country into what he called a 1929 depression, but you'll remember, he said the same thing during the last campaign against joe biden, a prediction that proved wrong. hoda? >> peter, in the meantime, there is a debate to get prepared for, both candidates i would imagine busy this weekend. how do things stand? >> reporter: that's right. the debate is four days away now and the rules here are going to be a lot like those we saw in the biden/trump debate earlier this summer. no prewritten notes allowed, no questions to each other, only moderators ask the questions, and the mics will be muted when it is not their turn to speak. harris, we're told, hunkering down yesterday in pittsburgh for a press session, expected to do more of the same there. mr. trump for his part is

expected to be back in a federal courtroom in new york city again today as he tries to challenge that massive jury verdict, finding him liable for sexual abuse and defamation against the writer e. jean carroll. hoda? >> peter, thank you so much. "meet the press" will have a lot more on this critical week ahead. moderator kristen welker sitting down for exclusive interviews with senators bernie sanders and north dakota governor doug burgum, all this sunday on "meet the press." now to a surprise move from hunter biden. the president's son unexpectedly pleading guilty in his federal tax case, just before jury selection was set to begin. nbc news senior legal correspondent laura jarrett joins us with more. >> reporter: the president's son showed up to court hoping to maintain his innocence to a rare conditional plea, but once became clear that was a nonstarter, he had to go all the way, a guilty plea with no more, no deal, no bargain. now only at the mercy of the judge. this morning, a new chapter for hunter biden.

pleading guilty to federal tax charges now, the last minute effort to avoid a potentially devastating trial, coming on the first day of jury selection in los angeles. the president's son faced nine counts, three felonies and six misdemeanors, including tax evasion, filing false tax returns and failing to pay his taxes on time. in a statement, hunter biden saying in part, i will not subject my family to more pain, more invasions of privacy, and needless embarrassment. like millions of americans, i failed to file and pay my taxes on time. for that, i am responsible. his attorney mark geragos saying he was prepared to go to trial, but recent rulings from the judge would have led to putting more of hunter's troubled past on display. was he conflicted about it? >> i think anybody would be conflicted about it. there is an old expression, you can beat the rap, but not the ride. i think that perfectly encapsulates what happened here. >> reporter: the last ride, a

rough one as hunter biden was convicted of federal gun charges in delaware in june. his past drug abuse playing a large part in that case, and this one too, as prosecutors accused him here of using his famous name to bankroll his drug addiction and lavish spending. his ultimate sentence in california and in delaware soon in the hands of the court, unless he's pardoned, something president biden has said he would not do. now, as vice president harris atop the ticket, the white house says -- >> well, you heard president biden make the commitment that wouldn't happen. i wouldn't imagine that changing with vice president harris. >> so it is in the judge's hands now but he's waiting on a sentence for the gun charges as well. how could this all play out together? >> what makes this tricky, when he had that case in delaware, he didn't have a criminal history. he now does, which is the judge both in delaware and california is going to have to consider. that one in delaware happening on november 13th. the one in california happening

stories. the driver accused in a deadly wrong-way crash in the south bay is expected to face a judge today. it happened on august 26th on highway 85, near the 87 interchange in san jose. investigators say 39 year old duncan macquarie was driving in the wrong direction when he slammed into a tesla, killing a mother and her 14 year old son. authorities booked him on in jail on murder charges after he was discharged from the hospital. i'm bob redell outside levi's stadium here in santa clara, where this monday night, the 49ers will open their season against the new york jets. 49ers rookie ricky pearsall will be watching from the sidelines after he was shot in the chest during an attempted robbery last saturday at union square in san francisco. and yet, here he was yesterday at levi's stadium. not dressed for practice, of course, but seeing up and about, standing, walking, playing with a football. and at one point hanging out with his fellow wide receivers. he will miss at least the next four games. let's get a

cities in the world stands corinthians arena. in 2014, host to the world cup. in 2016, some of the summer olympic games. in a matter of days, it has been transformed, from a brazilian soccer club's home pitch to a football field. the work behind the scenes to get this game covered and streamed live on peacock may be even more impressive. six days ago, this was an empty parking garage beneath the stadium. compared to super bowls and olympics, how unique has this undertaking been? >> probably the largest challenge has been the short period of time we had to complete this task in four days. we got a great crew. probably the best of the best. >> reporter: and some of the league's best talent will be on display. two of the highest paid quarterbacks for teams who both made the playoffs last year, back with supersized goals. so you saw the green and the yellow and the brazilian flag, a close match for the packers colors, right?

and eagles have their own shade of green too. but because of a really fierce rivalry between two brazilian soccer clubs, green is typically banne ened in corinthians arena. that does not apply tonight. we have seen green all over the town. vamos, a fun one tonight. >> thank you so much. the nfl opening weekend has become one of the biggest events on the sports calendar and that is adding to the excitement. >> friday night too. the game is no small undertaking and who better to give us some insight into this historic matchup and the season that is to come, the man in charge nfl commissioner roger goodell in brazil with us. good morning to you, sir. >> good morning. >> well, is it living up to what you hoped? the south american fan base, are they turning out? >> they sure are. the passion down here is just extraordinary. people are just really anticipating tonight and we are all anticipating tonight. i think it is going to be a

great show. >> can you tell us the goal here, so you picked brazil, they were talking about how much the fandom has increased overseas. what is the ultimate goal for the nfl in going to international cities? >> well, our intention is to make american football global. we're taking our game everywhere we can. we expect some day in the near future 16 regular season games over the season. this is our first time in south america, as you mentioned. the reception has been extraordinary. i think the real goal is to share our game. when we share it with fans, they love it. and this will be the spark that sort of lights the flame down here to really get this game in a different position. >> well, speaking of expansion, there is talk about potentially making the nfl regular season 18 games, which would make super bowl sunday usually on presidents' day weekend, which would make monday morning an off

day. we're not neutral on this issue. how confident are you this could actually get done and how soon? >> savannah, i think that would be great for your schedule and i think it would be great for all the fans. it is really -- it is something that has been discussed for a long time to get to 18 games, it would take a long period of time because what we do is we're working to make our game safer. we work with our players association on changes to the game. we have been very successful with that. we have seen tremendous strides in our safety of our game. and that's one of the things that we want to make sure we're doing correctly before we move to 18 games. but i can see this being discussed in the next collective bargaining agreement and get some type of an agreement. >> you feel like the will is there? >> i think the will is there in many ways. i also think, again, we have to be confident that what we do here is going to work for the nfl, for our players, for our

coaches, for our fans. but i think people look at the preseason, regular season and say would i like to have one more regular season and one less preseason? the i think the answer is yes. >> you talk about safety. the guardian caps are something that are offered to some players to protect them from conc concussions. how popular are those among the players? >> well, they weren't popular when we introduced them a few years ago. people felt like they didn't look right, they felt funny to them, we made adjustments to them. we required more players in the preseason to wear those. and they had a positive impact. but also the positive impact is trying to improve our helmets and we had six new helmets introduced this year. and the quality of those helmets really matched those of the older helmets, and the guardian caps. so, player choice. we may have a couple players that choose to do that in the regular season, but we'll see. >> well, last night was the kickoff game.

it lived up to the hype. a nail biter. the final score was taylor swift 42 to -- no, i'm just kidding. i don't know if you're over it, but serious question -- >> no, you're not, savannah. serious question, have you seen a swift effect? we know that her fans tune in because they want to see her. are they falling in love, are they getting in a relationship with football at the same time? >> yes, i think the great thing about their relationship is it created a new relationship with football. you know, any people that can come into our game and enjoy it, experience it, i think it has an impact on them and brings them in. so we welcome that. obviously they have a great relationship, they're very happy, and we hope that continues. but that's -- for us, we just want to make sure our games are available to as many people as possible. >> well, if there is a breakup with football, there could be a song. but that's all i'll say. commissioner, thank you so much.

gray facing a judge in georgia, just hours ago, after the deadly morning that left four people dead including two students and two teachers. gray's father colin also appearing in front of the court. overnight, the father was charged with four counts of involuntary manslaughter, two counts of second degree murder and eight counts of cruelty to children. >> these charges stem from mr. gray knowingly allowing his son, colt, to possess a weapon. >> reporter: two law enforcement sources familiar with the investigation telling nbc news the father gave his son an ar-15-style rifle as a gift after they were interviewed by authorities last year following an online threat. the same type of weapon was used in the mass shooting. according to an investigator incident report, colin gray told authorities colt was allowed to

he is still a teenager. savannah? >> all right, priya, thank you very much. also this morning, lawyers for bryan kohberger, the man accused of killing four university of idaho students, is making a new appeal this morning in an attempt to take the death penalty off the table. let's dig into that a little more. we'll bring in laura jarrett, nbc's senior legal correspondent. so, what are some of the argue. they're putting on the table? >> this is a blitz of multiple defense motions throwing everything they can at this. a court imposed deadline, that's why it is coming now. everything from routine things, they don't have enough time to prepare for trial, to really things maybe more of a creative stretch thing saying it violates international treaties to give him the death penalty. it is an aggressive move, but it is a death penalty case and so his public defender is taking it seriously. one thing i was surprised she did not hammer is how rare it is to get capital punishment in that stateapital punishment in that. i went back and looked. it only has been used three times. the last was 20 -- if they do it in this case, it would be
