sanchez. i'm in for marcus washington, and i'm laura garcia. we'll check that morning commute with mike in just a little bit. but let's talk about these temperatures. they're just not coming down. no. and if it does come down, it's a degree or two. so we're really not noticing the difference. yeah. and it's still record territory that we're talking about here. and it's another day of this excessive heat warning which has actually been extended into tomorrow and may be extended again into saturday because we are still looking at more of the hot valley temperatures into the weekend. right now, we're at 62 in san francisco, so we are seeing some milder mornings as well. but at least it is better than the temperatures that we are headed towards for the afternoon. so this is our break. we may once again get very close to record high temperatures for today, although in santa rosa we're looking at a high of 97. the record today is 105. and yeah, it was in 2020. and in san francisco 85 is the expected high today. but the record is 97. and we will be close but not

most likely setting records widespread. but we may tie that record in san jose as we're expecting the high to hit 97. that's a long standing record that was set back in 1917. so we'll be watching those numbers closely. mike, you're seeing that the bay bridge still looks pretty jammed. yeah, it is jammed up because of this activity right here. you see the flashing lights? they are just off to the right. the left hand shoulder. as you're making the bend around toward treasure island. the distraction, though, has caused the early backup. they've been working for about a half hour. looks like things may actually be stopped. there may be a traffic break. i hope that means they'll move it into the city. but for now, big backup in out of oakland. getting over toward treasure island. again, bart is a good option for you, and the richmond bridge is showing a lighter traffic flow there and nothing else. major, right here but in the south county, san martinez, a crash north 101 additional slowing back to you. all right. thank you. mike. well, developing in the middle east as israel is weighing its response to iran's missile attack in lebanon right now. more than 1 million people are displaced because of that. israeli assault on hezbollah. at

the same time, thousands of americans also trapped there. today in the bay ginger conejero saab is live in san francisco. and ginger do we know anything about these americans who are trying and managing to get out at this point? well, chris, we know that 100 americans and their families were among those who left on an evacuation flight out of lebanon recently. i would imagine that this may just be the beginning of u.s. citizens getting out of that country. we also do know that a u.s. permanent resident is among those dead. now, nbc bay area spoke with one bay area man who has been in lebanon recently. jonathan sagen is from san mateo. he's been in lebanon to visit his family with his parents. they received notice from the american embassy to get a flight, and they rushed to get out. here he is talking to our jason moran on that ordeal. as we're packing our bags. the news was on and beirut started

getting bombed, so we were kind of like, we're about to drive into this mess. we got to beirut. the first thing we noticed was the smell. you could smell the aftermath of the bombs and the aftermath of the destruction and. israel struck central beirut overnight. and it comes as israel celebrates rosh hashanah, the celebration of the new year for the jewish people who find themselves still in the middle of crisis and war. this is the deepest attack into the lebanese capital, at least nine people were killed, adding to the death toll of more than 1300. israel has also announced the deaths of eight of its soldiers. ground clashes saw hezbollah claim to have ambushed israeli forces in a border town. you know, this country is in chaos at this point, but i am sad to leave, you know, we've got dozens of family members and hundreds of friends here, so it

is upsetting and i know that, you know, given how fast the situation deteriorated in the last ten days, that the next 30 days or so are going to be very tough, you know, we're worried. but again, everybody here is very encouraging, telling us to leave. they're saying it's not safe. you have a way out. go, go back to america. and jonathan goes on to say that he hopes calls for a cease fire will strengthen. he is not hopeful for a de-escalation at this point, but says that a cease fire may give civilians who are caught in the middle some temporary relief. from what we understand, jonathan and his parents successfully boarded their flight last night to istanbul that is their next stop before heading home here to the bay area in san francisco, ginger conejero saab today in the bay. always so hard to leave the rest of the family behind. thank you ginger. turning now to decision 2024 a twist in the race for the white house

surrounding one of the many legal cases against former president donald trump. new evidence from the special counsel. election interference. prosecution is now public. today in the bay's alice barr joins us live from washington this morning. and alice, we're talking about a potential political storm here. it could be in the works for the trump campaign. laura, yet another twist this close to election day and this campaign season that's been like no other in this new court filing, special counsel jack smith accuses former president trump and knowingly spreading lies about the 2020 election. and then resorting to crimes to try to stay in power after he lost. the trump legal team is forcefully pushing back, arguing the case should be dismissed. a presidential race rocked by hurricane devastation and spiraling conflict in the middle east thrown another curveball with a court filing revealing new details of the allegations against former

president trump in his federal election interference case. special counsel jack smith, seeking to tailor the case to survive a supreme court ruling that found presidents cannot be prosecuted for official acts. smith's team writing that mr. trump's alleged scheme to try to stay in office after his 2020 election loss was a fundamentally private one, casting alleged interactions with former vice president mike pence based on mr. pence's notes as political running mates discussing private acts and detailing allegations that after mr. pence decided not to stop the certification of the election results on january 6th, aides told former president trump pence was in danger during the capitol riot and had been rushed to a secure location. smith says trump, quote, looked at the aide and said only so what? in a statement, a trump campaign spokesman called the filing falsehood ridden, unconstitutional and again

underway following hurricane helene, and it pummeled states from florida to virginia starting last week. and the death toll now is up to 190 people. help for people now having to contend with the aftermath is coming from the bay area. millions of people still without power, and the bay area is lending a hand in a number of different ways. later this morning, kids against hunger bay area will ship about 250,000 meals to areas just like those helene wiped out. other volunteers are helping on the ground with shelter and search and rescue efforts through fema, providing a cot and a blanket and a safe place to rest and try to gather your wits. we have a few locations where we have things that are stuck underneath bridges that still have flowing water, so we need to get into into the water effectively and pick things out of the out of the bridge so that we can pick

through everything and make sure that there's no one in, you know, in that trapped debris. president biden surveyed the storm damage yesterday, making stops in the carolinas. he also announced that he will deploy up to 1000 soldiers to reinforce the north carolina, north carolina national guard in order to deliver aid. new at 6:00, people trying to beat the bay area heat are flocking to the coast. this was the scene at twin lakes state beach in santa cruz yesterday, an ideal day for many trying to seek a little relief from the scorching temperatures. it's an escape, definitely. i saw the temperatures here were going to be pretty ideal and very hot over there. so i was like, i'm in, i'm over there, not here. today. when i looked over here, it looked like it was going to be like 85, which is still hot. that's hot over here. but then as soon as i came down the road here, it looked like 75. and it's very comfortable. it looks so inviting. libraries in santa

cruz as well open their doors to help people cool down any way you can get it. you know, i thought, well, that doesn't look that crowded, but it was a wednesday. i mean, that's a lot for a wednesday. the closest we are to the beach right now. yeah. feels nice even just looking at the picture. just trying to get i just yeah we're going to have to mentally. yeah. you know for us it's staring at the screen background on our computer. exactly. we are going to have still some warm temperatures along the coastline today. let's take a look at the beach forecast in case you are able to hit the road and go there instead of working today. or maybe you can work from the beach. stinson beach will be in the low 80s. upper 80s for santa cruz, even though the temperatures there are still warm. just think about how cool the water is. if at least you can dip your toes in, it's going to feel very nice to cool down. we do also have a fairly mild start to our morning in the 50s in the north bay, 60s and 70s elsewhere, and we're going to have a cool start. but another really hot afternoon, another

to be last month, but tesla delayed it and elon musk promised a fleet of, quote, 1 million robo taxis by the year 2020. obviously, that did not work out seeing as it's 2024. he promised a taxi with no steering wheel or pedals by 2024, so that's now. and that's maybe what we see next week with full production. tesla says by 2025. now you know this google. waymo has been running robo taxis around san francisco and phoenix and los angeles for quite some time now. they work well. they have to stick to certain areas and they're cheap to ride. they're very expensive to operate the jaguar car, they use costs about $100,000, and then all of the equipment. google's not making any money on this. they're just understanding how it all works. have you ridden in one? i have not, i have not. just downloaded the app, but i haven't. it's very cool. i mean, you know, it's like when you were a kid, you thought, this is what i'll be doing. true. but i was at a stoplight in san

to watch this too. for the first time because they were like five when that came out. yeah, yeah, they were too to young fetch. yeah. to be fetch. all right. well we do have some high numbers out there. we've been talking about the heat and it continues today. and we're also going to have to deal with some slightly more unhealthy air quality once again, as we deal with day after day of really not much wind. high pressure and a lot of pollutants out there to spare the air alert day. call someone up, carpool or catch public transit to try to keep from having all of this many cars out there on the roadways, and more pollution as we deal with this high heat. we may be close to some record highs once again. the past few days we've set records and in santa rosa it looks like today we will stay below this record high. thankfully, as we head up to the upper 90s and in san francisco, it will be in the mid 80s. oakland today 89. that's below that record high, as well as 102 in livermore, but the record is 106. and in san jose, we may tie

a long standing record as we hit 97. it will be 102 in los gatos and 106 in gilroy. much of the east bay will also see highs over 100 degrees. and when in hayward today, 94 there, 94 in fremont, as well as 94 in redwood city where we are starting to see the numbers decrease a bit will be near the coast, so half moon bay, upper 70s for the afternoon. san francisco still pretty warm and up to 85 downtown and in the north bay 100in sonoma, novato and santa rosa. today 97 degrees. let's focus on santa rosa, where we are still looking at more heat ahead. and this is going to be what we can expect. and a lot of our inland valleys up to 93 still on monday. but then we start to see those temperatures dropping off on tuesday and a little bit more of a fall feel toward the end of next week. it takes a while, but eventually we are going to have some much more comfortable temperatures. but it is going to be hot into the weekend, and

later found them being resold on stubhub. in nick's case, he could not get a response from ticketmaster. once our team stepped in, he got his tickets back. but nbc response teams across the country are reporting the same problem. a spokesperson for ticketmaster did talk with our chicago station and blames hackers, but unrelated to this year's massive ticketmaster data breach. he says it's important to change your password if you haven't updated your your password recently, and if you're using a password that you use in a lot of different places, they might be able to get into your account. i changed my password after they notified me of that, so maybe it's related, maybe it's not. i don't know, but i know that as of about two weeks ago, if you're looking at the reddit boards, that's when it started exploding. i mean, that's what people are feeling. ticketmaster, though, insists that user passwords were not exposed in that large scale breach. some customers question why the company does not yet use

to the downtown. the owner of the fat pigeon bar behind me. he says that if this event did not happen, things might be a little different in terms of business because of yesterday's heat wave. so he was grateful. unfortunately, that was not the case at the mission plaza in nearby pleasanton, where they didn't have this kind of outdoor event. the manager of fiesta tacos there says his business has been struggling during the heat wave. the owner of an indian cuisine restaurant in the same plaza says the heat is making customers opt for takeout instead of paying more by eating at inside the restaurant. the customers were not coming much outside. you know, they are like sticking to their homes only even you can cover, you know, the traffic outside. also there's like there's not like much cars. you know, the passing here because of the heat waves. this is horrible way to hot, way too hot. i'm melting. there's no people right here. you see this? it's empty because people don't want to stay out here anymore.

happen. happening today, san francisco's district attorney and city attorney will join sheriff paul miyamoto to lay out the future of the city's pretrial electronic monitoring devices in the wake of a recent court ruling. the program is now suspended for enrollees after a judge ruled that the ankle monitors violated warrantless search rules. the sheriff's office requires participants to allow the search of a person or property at any time, without warrant or probable cause. it also requires participants to share their gps location data. in a news release, the sheriff cited an inability to ensure public safety. the news conference is scheduled for 11:00 this morning. if you thought a locked mailbox was enough to deter thieves, this story might make you think twice. check out this security video. it is from outside a san jose apartment complex on communication hill. a pickup truck slowly drives up. two men get out and unbolt one of two mailbox bins, carting it to the back of the truck. residents could hardly believe what they saw. my son came to get the mail

and said, the box is no longer there. these are federal crimes. the stealing of the box, the stealing of the mail, potential penalty of up to five years in federal prison, up to $250,000. fine. this individual or the individuals responsible for this, if they hit this neighborhood, they've hit other neighborhoods. well, neighbors say it happened before dawn tuesday at about four in the morning. police and the postal service are now investigating. i looked way too easy. all right. turning now to decision 2024 and a new controversy in the race to replace south bay congresswoman anna eshoo. candidate evan low is blasting a federal election complaint filed by an advocacy group that claims he illegally used funds from his state campaign committee to pay for political ads in his bid for the house seat. national race. the ads include the one you see right here. the group defend the

vote also claims the ad was distributed online to voters outside lowe's district. the video ends with low saying, quote, thank you district 26 for fighting with me. let's keep california moving forward. that's his assembly district. the ad also has a disclaimer saying paid for by evan low for assembly 2024. that's state money. in a statement, lowe's campaign manager says in part, quote, sam liccardo campaign has once again put his endorser up to file false and meritless complaints to distract from sam's own ethical failings. sam liccardo, former san jose mayor, is, of course, lowe's opponent in the congressional race. it is important to note defend the vote is endorsing liccardo. we reached out to the liccardo campaign for a response. we have not yet gotten one. meanwhile, their much anticipated debate last night was abruptly canceled. liccardo withdrew hours before, citing laryngitis.

the university of miami, and there it's going to be a little bit milder dropping into the 60s by the end of the evening. and then early in the afternoon for the stanford game. well it's going to be hot there in palo alto. we're looking at temperatures in the low 90s throughout the game. and then the sunday. and it's well going to be in the low 90s. so really the heat is not easing up for our sunday football game for the 49ers. it's also going to be really hot out there. and so we're going to be tracking more of this heat into the weekend. i'll have another look at that forecast coming up in a few minutes. mike has the bay bridge recovered. the span has recovered nicely the earlier disabled vehicle was right around the tower. caused big backup along the span. we still have the backup at the toll plaza. i think they're speeding up the metering lights. i see a more movement in the backup right here, but still the commute bills with the east shore freeway feeding down toward the berkeley curve, richmond bridge saw a little more traffic flow as some avoided the bay bridge. so you can still do that if you want

long lasting. to get families, to get residents, to get neighborhoods back up and running. biden has also directed a thousand active duty soldiers to aid the north carolina national guard to distribute supplies, and warns the recovery is going to cost billions upon billions. the judge in donald trump's january 6th trial has released special prosecutor jack smith's legal briefing about the case. in it, smith lays out specific evidence against trump evidence the former president knew he lost the election but tried to overturn it anyway. trump resorted to crimes, says the legal brief. now note that is the prosecutor saying that, not the court, which has yet to rule on guilt. the reason this report exists at all is because the supreme court decided earlier this year some actions by presidents cannot be prosecuted, not for what the high court calls official acts, even if that act would be considered a crime under normal

circumstances, can't be prosecuted. in fact, the accusation can't even be brought up in court. that forced smith to drop some of the charges against trump, and then list out all the other things trump did that smith says are not official acts and thus are crimes that can be prosecuted. there's also a third mushy category presumptive immunity. the judge is going to have to rule on those. bottom line, it's a brand new report on what happened on january 6th at the capitol. and capitol police attacked and trump's role in it, as well as trump's effort to undo the election and the results of the american vote. the judge will go through it line by line. no doubt this will end up back before the supreme court. trump on his truth, social, wrote democrats are weaponizing the justice department against me because they know i'm winning. as for the campaign, former president trump will hold a rally in saginaw, michigan. vice president harris will be in wisconsin today accompanied by republican liz cheney. cheney at

one point was the third most powerful person in the republican party. but she now says carey. she supports harris. thanks, scott. turning to our climate in crisis new this morning, we have an update on one of our climate and crisis stories. we brought you back in august. it's about one of the first of its kind reusable cup programs in petaluma. you might have seen those purple cups labeled sip, return repeat around downtown restaurants and coffee shops. they're being used to study how the city of petaluma could move away from single use plastic cups and towards a system that's better for the planet. well, since the pilot program started, officials tell us, quote, the petaluma reusable cup project has hit over 100,000 cup returns as of september 16th. just six weeks since the project officially launched. and the nextgen consortium is also aggregating sales data from all 30

participating companies and plans to share insights publicly. the results after three months will inform the next rounds of scale up and future reuse programs that what that will look like in petaluma and beyond. yes, you still are producing those cups, but if you know, even if that cup just used is used ten times, you're reducing the amount of garbage that you're creating in sonoma county itself, i think is a really progressive area. and i think that once they show results from petaluma, i think that the local towns will, like, jump in and do the same. the pilot program will wrap in november, so we'll keep following this story to see if other bay area cities will do something similar, and to learn more about how climate change is impacting our region and the solutions, you can visit our website nbcbayarea.com and click on the climate in crisis tab. thank you kerry. that's impressive. it took off so well. next at six a heads up. if you are among people collecting lots of credit card points, they are

yesterday. and that set a new record 103 in napa. and then in san jose. it way outperformed the record high, which was 96. we hit 106 yesterday. this heat has been brutal and the air quality not so great. and that continues today with another spare the air alert day. want to limit your time outside, especially if you have asthma or any kind of heart condition? all of the pollutants out there will affect you. and taking a look at walnut creek and our temperature trend that quickly heats up, going from low 70s at 9:00 to upper 90s as we go into the next few days and the heat risk index, a major to extreme factor as we have day after day of these excessive temperatures and highs over 100 degrees, pretty widespread for the inland valleys. we were hoping for a bit of a cool down, but we're going from highs over 100 to mid to upper 90s, so it's still going to be hot and we're going to see that extend into the weekend. maybe even going up a couple of degrees on saturday with a high of 102 in gilroy and

98 degrees in napa. so still very hot and one of our usual hot spots. fairfield will stay in the triple digits through sunday. still in the mid 90s on monday, but it looks like it's not until the end of next week when we catch some real relief from all of this heat. several more days of hot temperatures for the inland valleys. and mike, now you have a look at the backup out of richmond. yeah, it looks like we're holding steady after the initial rush, folks trying to avoid the bay bridge. the incident cleared from the bay bridge, and we're holding steady out of richmond, so that's good news. with the east bay build for the eastshore freeway, standard flow of traffic through contra costa county, building again through walnut creek. big jams for 680 recovering south out of pleasanton and in towards sunol. just got word a text from our general manager. she says if you're trying to take mission from 880 over to 680, don't even try it. it is slammed down. so try one of your alternates to avoid that mission funnel right there and out of the south bay. the northbound routes continue with their build. back to you. thanks so much, mike. well happening now. marathon martinez

is oil refinery is being hit with new fines for alleged air quality violations. the bay area air quality management district issued a $5 million fine. that is the second highest fine it has ever issued. the air district cites penalties for the flaring that occurred during the covid pandemic. other violations allegedly involve smoking flares, excess air pollution emissions and delays in repairs. in its response, marathon referred to the air district, noting all violations in the case have now been corrected. we'll be right bacwith ak
