at least 190 lives lost and one week after landfall, hundreds of people are still missing. and more than a million still without electricity from florida up to virginia. >> all right. adding to those concerns, even more rain headed to this region. we are tracking all of it this morning. >> let us get started with a new development tied to the race for the white house, now just 33 days away from the election. the special counsel now saying donald trump should still be tried for his actions on january 6th, despite a supreme court ruling granting him immunity for official acts, as president. we'll break everything down, starting with nbc's garrett hake, who covers the trump campaign. garrett, good morning. >> hey, hoda, good morning. this new filing from the special counsel draws heavily on testimony from former trump aides and from mike pence's own handwritten notes. at its core, the special counsel's argument that donald trump the candidate, not the president, committed crimes to try to hold on to an office that he knew he had lost. in a sweeping new court filing,

the special counsel is shedding new light on his 2020 election interference case against donald trump. arguing the former president is not immune from prosecution, because when he sought to overturn his 2020 loss, he was fundamentally acting as a private candidate, and resorted to crimes to try to stay in office. the filing, including trump's conversations with his former vice president, mike pence, including one where pence tried to convince trump to accept defeat and run in the next election. smith arguing that they were acting in a private capacity as running mates. on january 6th, as rioters stormed the capitol after trump's tweet saying pence, quote, didn't have the courage to overturn the election results, prosecutors say an unidentified aide rushed to the state dining room to inform trump that pence had been evacuated, in hopes he would take action, quote, to ensure pence's safety. trump's response, according to the filing, so what? prosecutors also point to the former president's repeated praise for january 6th defendants.

>> those j. 6th warriors. they were warriors. >> reporter: and outlined new conversations where a witness heard trump tell smith tell family members, it doesn't matter if you won or lost the election, you still have to fight like hell. prosecutor also saying trump operatives, quote, sought to sew chaos after the election, and one example that an unidentified aide told there may be unrest, allegedly responded, quote, make them riot. the former president pleaded not guilty to the charges filed last year and denies any wrongdoing. trump attacking the new filing as political. >> this was a weaponization of government and that's why it was released 30 days before the election. >> reporter: it all comes as trump's running mate, j.d. vance, is facing new scrutiny after his debate with tim walz, asked whether trump lost in 2020. >> did he lose the 2020 election? >> tim, i'm focused on the future. >> now, the department of justice has long maintained its

independence from political interference in criminal cases. i think it's fair to note, one major reason is this is coming to a head so close to the election is mr. trump's own strategy of seeking delay at every step of this legal process. savannah? >> i want to start with laura jarrett. let's start with this issue of timing. why did the special counsel file this now? >> at first glance, they had to do this, because the supreme court said, you have to figure out what's immune, what's not immune. and the basic distinction that they've defined here is what were things that trump was doing as an office holder while president and what was he doing really in his private capacity as an office seeker, on the campaign. none of that should be immune. so the special counsel's office is saying, all of the things that he's been charged with now, because there's a superseding indictment, a new indictment, anything he's been charged with now is completely game on. it's not immune, it shouldn't be shielded. so we're seeing some new details we hadn't seen in the january 6th investigation, we hadn't seen before. many of the same circumstances, but just a little more fleshing out here. >> this is basically the special

counsel trying to salvage its case after this supreme court decision, which set off limits, a lot of evidence in the case. >> yes. >> but again, why now? because the trump defense team is saying, it's 34 days before an election. there are guidelines from the department of justice saying, you shouldn't do this kind of thing right before the election. >> there's no question this was a choice. prosecutors know how to move fast when they want to move fast, and they had wanted this to go to trial. but it has no hope of going to trial. once you get to the point where you're now before -- >> before the election? >> before the election. and if you get to the point where it's now 34 days, you have a choice to make. you can say, judge, we want a little bit more time, we want to ask for a scheduling order that would push this out a little bit, but they didn't. and they're saying, well, the judge unsealed it, but they wanted it out there right now. and i think that's why this trump team is saying, wait a minute, there's a 60-day rule. they could say, arguably, it doesn't fall under the rule that says you don't take any major investigative step, because he's already been indicted. right? but again, this --

>> it's 160 pages of a narrative of the case against donald trump -- >> while he's running for re-election. >> -- 34 days before re-election. by the way, reminiscent of james comey reopening his investigation into hillary clinton in 2016 a couple weeks before the election. also -- you know, fought by the defense team. >> the specter of that goes, i think, certainly looms over this. and i think that's why they were leaning on the court unsealing it. but no question this will have continued fallout. >> laura, thank you very much. >> yep. let's turn now to the middle east, a region edging even closer to an all-out war. israel launching another deadly air strike in beirut and carrying out new attacks in gaza overnight, while also preparing its response to this week's unprecedented missile attack from iran. all of this addressed in an emergency meeting of the u.n. security council. nbc's chief foreign correspondent richard engel joins us now from lebanon. hey, richard, good morning. >> reporter: good morning, hoda. that new israeli strike was right in the center of beirut, but remarkably, the airport in beirut is still operating,

flights are still coming in and out. but very few carriers are going to beirut. tickets are almost impossible to find. the u.s. government has been chartering planes and another charter leaves today, carrying more than 100 u.s. citizens, as this entire region now, hoda, is bracing for further escalation. israel says iran's barrage of ballistic missiles, nearly all shot down by israeli and american air defenses, will not go unanswered. as u.s. and israeli officials tell nbc news, israel is preparing a swift response. at the united nations, israel's ambassador outlined what may be coming. >> the consequences that iran will face for their actions will be far greater than they could ever have imagined. >> reporter: president biden said he would not support an attack on iran's nuclear sites. >> they have a right to respond. they should respond -- >> reporter: overnight, vice president harris expressing her support for israel, saying that

there will absolutely not be a need for american troops to go into combat. >> it is in americans' interests to make sure that we take seriously the threat that iran poses. >> reporter: the administration is pushing to prevent a regional war, but israeli prime minister benjamin netanyahu says that he is already in one. we are in the middle of a tough war against iran's axis of evil, which seeks to destroy us, he said. in tel aviv overnight, a new attack. this time drones from the houthis. a yemeni militia, supported by iran. it caused no deaths and little damage. and appears to be retaliation after israel sent fighter jets more than a thousand miles to attack the houthi-run port city of hodeidah in yemen earlier this week, in what a former israeli prime minister described as a possible trial run for a strike on iran. and in beirut overnight, israel carried out more air strikes,

killing at least nine according to health officials. israel also has troops fighting in lebanon against hezbollah. >> israel's war here in lebanon is escalating, after initially holding back, apparently to assess israel's strength, hezbollah is now engaging israeli troops directly in close combat, as up tos and cities are emptying out. >> reporter: israel announced the loss of eight soldiers in lebanon. hezbollah promises there will be more. >> so this is kind of a powder keg, richard. what do we expect to happen during the next coming days? >> reporter: well, i think over the next coming days it is very likely we could see that israeli response. and a lot of people are looking at the calendar, looking at the jewish holidays. there are two jewish holidays in this period, and the time in between them, which is this weekend through next week, is a particularly sensitive time to watch what happens here in the middle east. >> all right, richard engel for us there in beirut. thank you. >> and one other note on that. new york city is beefing up

security near synagogues for the jewish holidays of rosh hashanah and yom ka pure. the nypd plan calls for increased aerial patrols. additional security sweeps by k 9 teams. the nypd says it is also monitoring communications online, looking for any kind of potential threat. we have a lot more to get to, including the devastate impact of hurricane helene still being felt one week after the category 4 storm crashed ashore, communities all across the south, some hundreds of miles from the coast, continue to struggle without vital supplies like food and water and gas. their deliveries slowed by the sheer amount of roads that remain impassable and now that area is bracing for even more rain. we're going to get to dylan's forecast in just a moment. but first, nbc's sam brock is on

the ground for us. hey, sam, good morning. >> reporter: hoda, good morning. the death toll for the region quickly approaching 200. nearly half of those fatalities here in north carolina. there are dozen of towns right now where the only ways to get supplies in and out are by air or mule. i direct your attention to the infrastructure hit, this massive hole on the main roadway here. the reality is that many residents don't know if it will be weeks or months before they have running water again. the full extent of helene's destructive toll, just now coming into focus. >> we have no water, we have no power. >> reporter: after the rising waters rushed through these communities, forcing some to puncture holes in their roofs, just to escape their homes. new satellite images show how floodwaters overwhelmed the french broad river. and video showing dramatic landslides in the mountains, all causing widespread destruction. as residents in swannanoa, just outside of asheville, north carolina, are getting their first look at the storm's

devastation. >> there's probably about 8 to 12 inches of mud. >> you basically would sink in mud. >> oh, yeah. >> reporter: in asheville, mission hospital's 100-bed er forced to take care of 200 patients, staff treating the sick and injured in triage tents with limited resources. >> everything that people see on the news, it's worse in person. it's worse. >> reporter: these trucks providing the only access to clean water. >> surgeries and procedures can't go on, because there's no water for the doctors to scrub in. >> reporter: hca health, which oversees the hospital, telling nbc news in part, they have remained open and caring for patients since the storm, adding, we are hopeful that the asheville community's infrastructure will be restored soon, but we have contingency plans in place and will continue to evaluate how best to take care of our patients and our colleagues. on wednesday, president biden surveying the damage from the air, saying relief will cost billions, but promising more aid is on the way. and while so many have lost so much, for those left with

something to clean up -- >> i'm so glad it survived. >> -- finding even a small memento is monumental. >> these are things you can't get back. there's no amount of fema that will put these pictures back in the frame. >> reporter: guys, significant challenges that lie ahead. there are roughly a million customers this morning that don't have power in three different states, south carolina, north carolina and georgia. folks here are being told they may get power by friday, but the reality again, they do not know if they'll have water or when. officials won't even give a guess on that. hoda and savannah back to you. >> sam brock for us there in nashville. thank you. >> one week and you still just can't get over the devastation in this area. >> and it's going to take many, many weeks, if not months to clean up all of that damage. the good news, i would say, we're not going to see anymore rain in the next five to seven days in the asheville, north carolina area. but we are still watching the gulf of mexico.

there's an area that's trying to gather itself into a tropical system. now it's gone down to a 30% chance of that happening. the set-up in the gulf of mexico, right now, the waters are a little cooler than they were with the last storm. and we have a lot of wind sheer. while we have scattered showers and storms, some of them tropical in nature producing heavier downpours, we're not going to see this really have a good chance of gathering into a tropical system. that being said, we are still looking at some scattered showers, some heavier downpours, thunderstorms in and around florida for the next several days. again, because it is tropical in nature, when those downpours develop, they could produce a lot of rain in a short period of time. that's why even in the tampa area, down to ft. myers, down to southern florida we could end up with 2 to 3 inches of rain. again, up into north carolina, there is no rain in the forecast any time soon. that's a look at the weather across the country. we'll get to your local forecast in the next 30 seconds.

alert. due to the extreme heat. i'm bob redell in livermore, where the national weather service has issued another excessive heat warning for today for everyone here in the bay area, which means places like livermore could hit 100 degrees or higher again today. this was the scene last night here in downtown for people who are celebrating witches night out. it's an annual event that brings out a lot of people. the owner of the fat pigeon bar behind me says, if this event was not taking place, things might have been a little different in terms of business because of yesterday's heat wave. so he was grateful. unfortunately, not the case in pleasanton at the mission plaza in nearby pleasanton. as i mentioned, the manager of fiesta tacos says his business has been struggling during this heat wave. so how hot is it going to get? let's check in with kari. it already looks hot this morning as we're taking a look at this live view in dublin. this morning. hot, hazy and more of these quickly rising temperatures going back to over 100 degrees today. and we're also looking at upper 90s for much of the north bay, mid

mark chavez is a san diego doctor who has now admitted that he knowingly obtained ketamine meant for matthew perry, who prosecutors say had become addicted to the drug. chavez's attorneys is now cooperating with prosecutors and could become a witness when two others go to trial next year. that includes a los angeles doctor, and the woman prosecutors say is known as the ketamine queen. >> anything you would like to say to matthew's family? >> reporter: san diego doctor mark chavez walking into san los angeles federal court, pleading guilty to conspireing to supply the late "friends" star matthew perry with ketamine, a crime that could come with a maximum ten-year prison sentence and $5,000 fine. >> mark entered his plea of guilty and that's now public record. >> reporter: the 54-year-old, now the third person charged in connection with perry's death to accept a plea deal, including perry's live-in assistant and

acquaintance erik flemming. as part of the agreement, chavez is admitting to supplying salvador plasencia with ketamine that was then sold to perry, including submitting a fraudulent prescription to obtain the drug. >> he's incredibly remorseful of what happened, not just because it happened to matthew perry, but because it happened to a patient. he is trying to do everything in his power to right the wrong that happened here. >> reporter: the beloved actor was found unresponsive in a hot tub at his los angeles home last october. the medical examiner's office determining he died from the acute effects of the ketamine, a drug perry had been using under supervision to treat depression and anxiety. but prosecutors say he died from unsupervised used after becoming addicted, and he gain obtaining ketamine from dr. plasencia and the ketamine queen, whose apartment they described as a drug selling emporium. >> she took advantage of mr.
