from donald trump working at a mcdonald's, to kamala harris visiting churches with lots of star power and elon musk offering voters money. we're live in washington, breaking down the back and forth with just 15 days to go. now in the clear after a fast moving fire scared residents in the east bay over the weekend. the concerning conditions, which remain for much of the bay area. this is today in the bay. good morning to you on this monday. i'm marcus washington. i'm laura garcia. we're going to check that morning commute with mike in just a little bit. but let's get to the forecast with meteorologist kari hall. and it's been really nice over the weekend, with the exception of the high fire danger. and we are going to see the wind calming down. and we're still keeping more of those same temperatures. but it is a chilly start as you're stepping out in walnut creek to 49 degrees. it is 54 in san mateo and 52 in san francisco. let's head to morgan hill, where we are now down to

46 degrees. yes, it is a very chilly start, but a nice little warm up coming. our way by late morning into the afternoon and overall it's going to be a mild day with highs here in the upper 70s. 75 will be the high today in dublin and 71 in oakland into the upper 70s for santa rosa. we'll talk about more changes ahead this week. mike, you're tracking a crash in the tri-valley. yeah, we pointed it out last report. there wasn't really much change in the sensor color, but you see all the red. that's where speeds are grinding down to about 15mph. maybe worse in some spots as you approach the crash blocking your three left lanes southbound, your commute direction on 680. so you're jammed up from that point at andrade all the way back past the highway 84, getting back past toward the sunol boulevard exit. watch that as you head south through the tri-valley. just for reference, the alternate, which would be 880, is clear, but it's a longer drive across the dublin grade and in toward the castro valley, y. everything else moves pretty much predictably, including the

backup at the bay bridge toll plaza, which has now filled the screen. back to you. thanks so much, mike. it is 602 right now in just a few hours. more critical testimony is expected in the trial of nima momeni, and it's coming from his own sister. he's the man accused of killing cashapp founder bob lee today in the bay's ginger conejero. saab joins us live in san francisco this morning. ginger. the sisters testimony really potentially dangerous for both sides. that's true. laura. and she is critical because of that. all eyes continue to be on kaza. omari the sister, as you mentioned, of nima momeni and a key witness to this case. now, for now, she is being called by the prosecution. but her testimony can be damaging for both prosecutors and defense attorneys as well. while her testimony on direct with the prosecution has been murky, and she frequently states, i don't remember or i was under the

influence, it will be interesting to see whether her testimony becomes more clear when the defense starts to ask her questions. that is, legal analyst stephen clark, who has been following this case. let's take a look back at what he calls murky testimony from kazaa. omari. it began last thursday. that was the last day this case was on trial. kazaa was asked questions by prosecutors about april of last year and what she remembered in the days and hours before her brother allegedly killed bob lee. they also asked questions about a series of texts that she received from her brother on the morning of lee's death. prosecutors believe an incident involving kazaa and lee is what led nima momeni to kill him. now, kassar's testimony ranged from details about drugs to allegations of sexual assault as well as one very direct message that her brother did not kill

bob lee. the prosecution knows she's a dangerous witness, and that's why they called her in their case, to control her testimony. and if she does testify in such a way that helps the defense, it hones in the prosecution that this case comes down to the forensics. the dna evidence that it was his dna on the handle of the knife. lee's dna on the blade of the knife and the. well, mr. clark also speculates that nima momeni may take the stand at some point in this trial, but until then, kathy vara testimony will be a key piece to this case. the trial continues at 930 here in san francisco, and the defense is expected to take over questioning at some point today. in san francisco, ginger conejero saab. today in the bay. all right. so interesting to see how it will all play out. thank you. ginger. now to decision 2024 vice president kamala harris and former president donald trump are pulling out all

the stops and critical ground battleground states now. harris spent her birthday visiting atlanta area churches, energizing voters there. meanwhile, trump took to a fry cooker at a mcdonald's in pennsylvania. today in the bay alice barr is live for us in washington this morning. and alice trump is really pushing the unfounded claims that harris never worked at the fast food chain. marcus, he has not presented any evidence to back this up, but he has continued to claim that that is untrue. and he went out to sort of try to troll her as he suited up at a mcdonald's that was not actually in operation, and that had pre-selected customers that came through the drive through over the weekend. but in any event, vice president harris is going to be back out on the trail today, sweeping through key suburban counties in three different swing states, again appealing to trump skeptic republicans, while former president trump, he's going to be touring hurricane damage in asheville, north carolina. that's an area where he's given a lot of focus before. he then rallies in greenville. just over

californians, they have already cast their ballots, according to the numbers from the data company targetsmart, 1.12 million ballots have been collected both in person and by mail. 49% of ballots were mailed in by registered democrats and 31% by registered republicans. more than 17 million voters in california have requested mail in ballots. police have made an arrest in the killing of a san jose of a student at san jose state. investigators say 22 year old colby tevis was shot and killed september 21st near cornerstone bar and grill. this was in sacramento's midtown. sacramento police have now arrested a man in connection with his death. the alleged gunman is being identified as 29 year old alex brown. tevis family attended brown's first court appearance friday afternoon. they say they're fighting for justice and the maximum sentence. my family members broke down again to just to see. we wanted to see who this person was that did this

senseless act. we wanted to see who he was. the questions are still not answered. why would you do this? and it was we were just angry and hurt. brown faces multiple charges, including murder. tevis family says they plan to be at each of brown's court appearances this morning. many are back home in the oakland hills after evacuation orders were lifted following the kelter fire. the 15 acre fire broke out friday along 580, then jumped to two homes in a eucalyptus tree grove. just those two homes were damaged. containment now up to 85%. and pg&e has restored power to all the homes affected. in addition to the fire in the oakland hills, firefighters were also forced to spring into action in castro valley over the weekend. flames there broke out just before three yesterday afternoon. three and a half acres burned as a result along 580 at eden canyon and palomares. investigators say the flames were likely sparked by a

car fire. luckily, no one was hurt. 611 for you this morning in developing now, oscar is now a tropical storm. this after making landfall as a category one hurricane in cuba last night. that storm bringing with it the heavy rain and high winds to the island, flash flooding and mudslides remain a concern this morning. cuba is dealing with widespread power outages and meteorologist kari hall has been tracking oscar's path. now it's just sitting there, right there between cuba and haiti. right now, it's really not moving very much, and it has continued to weaken. so that's the good news. and it's not directly over land. so we are going to see this mainly affecting the bahamas over the next couple of days and moving off towards the north and east. and as it does so for the most part, it's going to stay out over the open water. so this is not expected to hit the u.s. mainland over the next few days. good news there. as we take a look at what's happening here at home, some cooler temperatures and a little bit of rain moving from the pacific northwest

closer to the bay area, this rain will pretty much fall apart in the next couple of hours, and we're just going to continue with dry conditions. mostly sunny skies in san jose will go from temperatures this morning in the upper 50s to mid 70s for today, and a lighter wind, but we're still watching out for that elevated fire danger, so we'll talk more about that coming up. mike has a look at where we can find some lower gas prices around the bay. yeah we're looking at livermore to start. it's taking up the mantle as best in the bay with 389 at dimond gas and mart on south front road. next up is the south bay's best. it continues to be 399 in the south bay. let's talk about cupertino car wash today on north deanza boulevard. and the bottom number is solano county. the low is up a bit for 19, pointing to fairfield valero on north texas street. you can check your areas, see the changes that happened over the weekend. gasbuddy.com on the roadways. a good change for the tri-valley where all this red sensor read is going on. we should see less and less of it

this morning. hundreds of dogs nominated to be named the nation's hero dog, but only five pups remain in that competition. one of them is dayo. he's a therapy dog. nine year old rhodesian ridgeback from dublin. he's competing for american humane hero dog award, which recognizes canines who go above and beyond. and believe it or not, he started out as a companion dog in oregon. this is for a cheetah. yeah, well, now he supports young patients at george park children's george mark children's house in san leandro, a blue ribbon judge panel will now choose the pup who takes home the hero dog title. you just surprised me, marcus. how so? because you didn't say danielle. that is so you. i was saving that for our 8:00 streaming newscast. i'll see you there. good. rodeo though a lot of people voting for him. nice to see. yeah. it is. all right. good day to walk. any dog. yes. good. all around.

we are going to see calmer winds. nice weather. a little chilly to start out. we're in the upper 40s now in walnut creek. and it's 52 in san francisco, san jose now at 55 degrees. the wind has calmed down and we are going to have a mild day with highs in the mid 70s in san jose. it will be 74 in milpitas. and looking at some upper seconds for morgan hill. gilroy today 82 degrees a little bit warmer. there compared to the 74 in fremont and 78 in danville. vallejo today headed for 74 degrees and mid 50s for half moon bay, while redwood city will top out at 70 and also 70, in downtown san francisco. a breezy westerly wind. and for the north bay, it's going to be a lighter wind there. lots of sunshine and up to 74 in sonoma and 73 in clearlake. looking ahead, we are going to have a quiet week, slightly warmer than normal temperatures, but then toward the end of the week there will be some rain very close to the bay area, but just staying

to our north. and notice that as we go into next week, there's going to be widespread rain and even some upper elevation snow. so that means cooler temperatures coming in and we're going to feel that even if we don't get the rainfall. so take a look ahead for concord. we're going from highs in the 70s and 80s to seeing it peak on friday at 85 degrees, but then cooling down for the weekend and next week. we may only see those highs in the low to mid 70s. so this week it will be a little bit warm with highs in the mid 80s for some of the inland areas. lots of sunshine and cool overnights and then checking out san francisco. we'll be in the upper 60s and low 70s. at times that fog rolls in, but it looks like we also have lots of sunshine. and mike, you're starting with some timing in walnut creek. yeah, we talked about changes going on here. now westbound highway four getting over to 680. very slow compared to the drive down kirker pass road. so this is a big difference than a half hour ago when we took a look at this. some of that's because of the

voters. this is today in the ba. and here we go monday morning. hope you're coming off a great weekend. thanks for starting your day with us. i'm laura garcia. and i'm marcus washington. and a lot to get to for you this morning. first, the oakland hills. two families have nothing to return to. this is after the fire this weekend. and for the rest, the smell of smoke is not the only reminder of the kohler fire today in the bay's kris sanchez joins us now with the power outages, which really made things worse. i mean, we all know what it feels like when the power is out. it just feels extra eerie. but as we know that the power was out in that neighborhood as people were going to bed last night. but as of this morning, the lights are now back on again. what we know about the kelter fire is that it started along 580 and then burned into two homes, and then up into a eucalyptus grove. it is right now at 85% containment, and crews remain on the scene

just to make sure no hotspots flare up. now, everyone who was under evacuation order this weekend was allowed to go back home. mountain boulevard was closed on friday afternoon when that fire started. it is now open again. the cause of the fire is still under investigation, but again, it did end up destroying two homes and that's when people were forced from the neighborhood. something that wasn't lost on the people lucky enough to go back home is that they were among the lucky ones. it was a little emotional for me just to not be able to come home, you know? but thank god all is well. it was a relief. very happy to be able to walk through the door. i think i was the first one home so start flipping on lights start feeling a little sense of normalcy. oakland fire and cal fire crews will remain in place, watching for hotspots in those 15 acres that burned again, 85% contained is where the fire stands, right

now. the red flag danger behind us for now, as kari reminds us, october and november weather can be gusty and dry and until we get some rain kari, we all have to be fire ready. absolutely. and we were also monitoring the air quality over the weekend with those fires burning and including in oakland. but we are now seeing our air quality improving. the wind is lighter, humidity is higher, which tends to slow the spread of anything that may still be smoldering in the brush. so relative humidity and the dew point is quite high. we're now feeling temperatures in the mid 50s, and we're going to have a mild morning with a lot of clouds overhead. eventually it will be clearing out as our temperatures there head for the low 70s. it will be 73 in oakland for that high temperature today, 73 in hayward and palo alto, 75 in san jose. and we're looking at some pleasant weather across the bay area. so we'll continue to monitor any changes ahead with a slight warm up in the forecast

that's coming up in a few minutes. marcus. new overnight police so far are not commenting on what looked, and certainly sounded like a chaotic sideshow in the east bay. this is over in east oakland last night. it happened about 11 p.m. at the intersection of 98th and international boulevards. now, this new video, also showing spectators dispersing as police start to move in there. no word as of yet on whether police made any arrests or handed out any citations. well, today the sister of nima momeni is expected to continue her testimony in the high profile murder case of bob lee. césar mamani first took to the stand last thursday. she did not finish her testimony and court was not in session. on friday, prosecutors believe an incident involving césar and lee led to

maher mini niello nima momeni that is killing the cash app founder. back in april of 2023. the defense claims that it was lee who first pulled out the knife, forcing neymar to defend himself. césar has said that neymar did not kill lee, but some of her answers to questions appear to be contradictory. now, today in the bay's ginger conejero saab, she is speaking with legal experts as the highly anticipated testimony is expected. she'll have a live report coming up for us in our next half hour. and also today, preliminary hearings began for the protesters who blocked the golden gate bridge. you may remember they brought traffic to a standstill back in april. this is while protesting the war in gaza. 26 demonstrators face charges here, but their attorneys are asking the court to dismiss the case completely. they're also saying that san francisco district attorney has been handling the case with political bias. one of their attorneys says that protesters acted in good conscience like other historical movements. we have reached out to the da for comment but haven't heard back.

636 right now. turning now to decision 2024 and we're just 15 days out from election day, and the candidates certainly zeroed in on those undecided voters. neither candidate appears to be holding back on taking shots at each other as well. joining me now is political polling expert paul mitchell. he's from the sacramento based political data. thanks so much for waking up early with us so much. thanks for having me. boy, these jabs just really keep coming. in fact, seemingly in overdrive. in one case this weekend, former president trump actually made french fries at a pennsylvania mcdonald's, claiming it was meant to really make a point about his opponent. he's claiming she never worked at a mcdonald's. okay, where are we going with this? did it work? the point you wanted to make. well, this is kind of the stunt politics. and as we're getting to the last couple of weeks of the election, i expect to see more of this. there was famously a gubernatorial candidate in california, john garamendi, who did this working for california

plan, where he traveled up and down the state, taking on jobs of normal californians. not with this much publicity, but the same kind of idea trying to connect to voters. and like you're saying, make this snide comment about whether or not kamala harris ever worked at a mcdonald's. i don't know whether or not it works. i think partizans on both sides. you know, take take to twitter and they say either that this shows that he's a real person and really connects with voters, or this shows that he's kind of goofy and, you know, looks silly at mcdonald's. and, you know, there's something else that's generating a lot of controversy here, not to mention legal questions. tesla ceo and trump supporter elon musk promising to give away tens of millions of dollars to pennsylvania voters. talk about what the impact the potential impact is here, not only from us, but this tight race and the legal ramifications of it. well, elon musk is

definitely doing nontraditional ways of outreaching to voters through millions of dollars he's giving to pacs. and one big program. he has to get people to sign a petition supporting gun rights and saying they're going to vote in this election. not a lot of data to suggest that that's something that's going to effectively drive turnout. but he's offering $47 initially. then $100 to people to sign this petition. and now $1 million giveaway every day there is a law of federal law against an inducement to vote, meaning that if somebody goes to the polling place and votes and you're outside the polling place handing out donuts, thanking them for voting, it's technically illegal in federal elections. the question is whether or not this is an inducement to vote, or just an inducement for them to sign a petition, which wouldn't be illegal. so i know the lawyers are going at this, but i don't know whether or not there's anything to suggest it's going to actually, you know, significantly impact the election. interesting. okay, kamala harris, let's get to her. meantime, really trying to highlight her religious beliefs,

appearing at an atlanta church yesterday is one candidate or the other having more impact on faith based voters now, kamala harris also did not attend the catholic charities event last week. yeah, kamala harris didn't attend the al smith dinner. she ended up sending a video instea. but it's very common for presidential candidates, especially in this last couple of weeks, to attend, attend a church service or reach out to the more religious community and religion in politics since trump entered the you know, this stage three election cycles ago has really transformed. and, you know, trump has really done a lot to try to get out the evangelical vote. but then there has also been changes in how religious voters are, you know, thinking about elections and what values they think are the most important in selecting a candidate. so i would say that that event of her going to the church is probably one of the most normal things that we've seen this election cycle. it's something that goes back decades

today. but we do still have to be very careful because our elevated fire danger will continue. and then looking ahead by the end of the week, we may have some drizzle and cooler temperatures for the weekend. we're still headed for the upper 70s in morgan hill today, and 79 in fairfield, while san francisco will be in the upper 60s and 75 in napa. this afternoon. we'll talk about the rest of the week coming up. mike, you see some slowing across the san mateo bridge, right? nothing to be alarmed about. we have a smooth flow of traffic, a much more crowded. but see, the traffic is going without any disturbance. we see the slower sensors on our span as well on the map. no surprises. south bay. pretty standard here. the unusual issue is how much slowing we have through the tri-valley, but it's recovery speeds are actually improving. despite the build for southbound 680, a crash earlier on friday caused the initial slowdown. we do have more traffic building on the nimitz again feeding over toward the san mateo bridge. eventually, the dumbarton bridge as well. later on today we have a concert over at the oakland arena. so do note there will be some

fire with israel. given israel's most recent victories, have things changed enough to make a big difference this time? well, thanks for having me. the biggest change, of course, is the death of yahya sinwar. so right now we're still wondering, i would imagine, who we're going to actually negotiate with on behalf of hamas. i don't see a cease fire taking place. i do see israel having so much success that victory is near when it comes to this situation. but we have to remember, israel is not just fighting hamas. they're fighting hezbollah. the houthis, the iraqi militias, and ultimately they're fighting tehran and its proxies. absolutely. and israel, meanwhile, is now really forcing hezbollah's financial arm and says that it's planned, specific actions on targets in beirut and elsewhere. so what exactly do you think this strategy entails? well, i mean, we have to be impressed with what we've seen so far with the major attack,

where it targeted key leaders across hezbollah, basically taking out leaders at all levels of this 100 000 man organizatio. so, you know, if you have kinetic strikes like that or surgical strikes like that, and then you start targeting hezbollah's finances, you know, hezbollah has a lot of a lot of money inside of the cartel's. the drug trade in central and south america funds hezbollah terrorism. so anytime you can target those, those assets anywhere in the world, that will hurt the organization and ultimately hurts tehran as well. the strategy that israel has in place now is they are doing this by themselves. if they had more support from the united states when it comes to denying the us banking system to tehran and their proxies, that would help as well. and also having our european allies aid israel in basically defunding and dismantling these terrorist organizations. right. we've heard that for so many years now. but i want to ask you

before you go, you know, i want to talk about the recently leaked top secret american documents there on israeli military. and it's possible response to iran. so how easy do you think it will be for american authorities to really learn what happened here and how does this actually compromise national security? well, this should be a very closely held intel within our pentagon or within centcom down in tampa, florida, wherever, wherever this is. this this should be compartmentalized intelligence information that only few people have access to. so i would imagine we'd be able to find out who did this relatively, you know, in a, in a relatively timely manner. what's concerning here is the regime in tehran has friends inside of this administration, meaning rob malley was removed from his position as senior envoy to iran because he shared classified information with tehran. we have some anti-israel and pro tehran people. unfortunately, inside of

on, brandon aiyuk suffered what's feared to be a major knee injury and quarterback brock purdy threw three interceptions, including two in the red zone. the niners lost the game 28 to 18. afterwards, purdy admitted this was not his finest hour, but pearsall said he felt grateful to be back on the field. i got to play better, for sure, just with my throws, some decisions and that's that's pretty simple. all the adversity i just went through these past month, you know, it was really good to go out there with my guys again. you know, they did a really good job of rallying around me, making sure, you know, i stayed up and it was a huge blessing for me today. nice to see him back in the game. the niners now have lost five straight games to the chiefs, including two losses in the super bowl. the team should learn more today about whether or not aiyuk is done for the season. we're hoping not. well, this year's fall classic is shaping up to be a classic confrontation between baseballs. well, kind of biggest rivals.

yeah, the yankees and the dodgers squaring off now in the 12th for the 12th time in the world series, the dodgers last night scoring six runs in the first three innings to win, going away in game six of the national league championship series. now tommy edwin knocked in four runs, including the two home run. the win clinched the dodgers first world series appearance since 2020. dodgers fans celebrated late into the night on the streets of downtown los angeles. take a look at it here. so game one of the world series got to take place friday night in los angeles. that will be a good one. okay, my dad's already hinting. you know, i've never been to the world series. i'm like, are you? tell your dad about la traffic on a friday. oh, okay. well, we're keeping it right here in the bay area where the weather's been actually nice. it's been nice. the wind is calming down. we don't have as much of a fire danger, but we do still need to be very careful. and as we take a live look outside in san francisco, the fog is starting to roll back

in. we can see those low clouds over the city now, and eventually it may get a little bit more foggy over the next couple of hours, but we're watching some clouds approaching from the north with a storm system moving into the pacific northwest, rain now approaching eureka and moving toward redding. and as we watch this, it's going to basically just fall apart before it makes it into the bay area. so we're going to continue with sunshine, but just get a little bit more of a breeze as we go into the afternoon. and our temperatures headed for the mid to upper 70s in the north bay, 71 will be the high in oakland and 75 in dublin, and tomorrow it's about the same mostly sunny, comfortable temperatures, really nice conditions, but it will warm up slightly from wednesday through the end of the week and we may start to see some of those mid to upper 80s for some of our inland valleys. check out gilroy on wednesday 88 degrees. so warming up. but then for the weekend we're going to see another storm system moving very close by into early next week.

we're still missing out on the rain, but look at how much more of the rain and even upper elevation snow will be happening. and that is kind of a sign that we will have some cooler temperatures moving in. take a look at san jose and the next ten days are going from highs this week in the 80s to next week's highs in the 70s. so these may be our last few days to have some warmer temperatures, if that's what you like, because looking ahead, looks like it will be cooling down and we'll see a lot more 70s for those highs. and mike, you are taking a peek at the bay bridge. yeah, we have the backup here. and pretty much the bay bridge. and the approaches are looking relatively standard. look at this east bay map. contra costa county, we do have a crash actually in alameda county. looks like around gilman. so we'll check on that once chp gives us the update. but we've had early and consistent slowing in toward walnut creek for 680 here. and 680 has recovery. that continues pleasanton now building once again the earlier crash cleared from sunol. but we stick around with the early slowing that started. back to you. thank you

very much, mike. 654. happening now. two people recovering this morning after being shot in antioch. it happened after 9:00 saturday night on pepper tree way. officers found a 47 year old injured at the scene soon thereafter. a 20 year old man arrived at the hospital with a gunshot wound. police say both were involved in the same shooting and both are expected to survive. the shooting happened along sycamore drive corridor, which has become a hotspot for gun violence. earlier this month, the city approved half $1 million to bring in outside agencies to help police. we'll be right back with a look

the oakland hills. all evacuation orders are now lifted following the kelter fire. the 15 acre fire broke out friday along 580, then jumped to two homes and a eucalyptus tree grove. just those two homes were damaged. containment is at 85%. pg&e has restored power to the homes affected later this morning. the sister of nima momeni is expected to continue her testimony in the high profile murder case of bob lee. prosecutors believe an incident involving césar min and lee led to nima momeni to kill the cash app founder. in april of 2023. the defense claims that it was lee who first pulled out the knife, forcing neymar to defend himself. césar has said that neymar did not kill lee, but some of her answers to questions appear to be contradictory. today is the deadline to register to vote in california. you can check your registration status online at the secretary of state's website. for those
