sexual misconduct allegations. plus, there are two weeks to go until election day. early voting kicks off in four states, including one. many are watching this november. our washington insider breaking down the final push both presidential candidates are making. also, the push to bring a new costco to the south bay faces a consequential vote today. the hurdle the proposal needs to clear to move forward. this is today in the bay. good tuesday morning to you. 5:00 right now. thanks for starting your day with us. i'm laura garcia. and i'm marcus washington. we'll get a look at that commute with mike coming up in just a bit, but first let's talk about that forecast this morning. really nice and cool outside. yeah. and it's going to be a repeat of yesterday. so if you enjoyed that we are going to see pretty much the same conditions going into the morning as well as the afternoon. here's a live look outside in san jose where we're now at 56 degrees. we have a calm wind and it's also mostly clear we will see a few clouds

moving in within the next couple of hours, but then really starting to clear out around 10:00. the rest of the day is sunny and a gradual warm up as we head for the low 70s. today in some spots may be slightly cooler compared to yesterday, so we're still looking at some mid 70s for many of our inland valleys. we'll talk about what's ahead coming up. mike has a look at what's happening in walnut creek. yeah kerry i want to show folks how light the traffic is here south. 680 toward the walnut creek interchange on the map. it's right here. that's light traffic. that's why i was so surprised to see all the slowing south. 242 does have overnight road work. right in this stretch. is scheduled to be cleared right now. so we may see those sensors light up in the next few minutes. we'll watch that closely. but that will be a slower drive through concord. take the corner instead of cutting the corner. the rest of your maps show what you expect anywhere except for the altamont with a little slowing. back to you. well, in just a few hours, the controversy surrounding an embattled san jose city councilman could heat up. now, the council holding its regular meeting, and there will be a conversation about whether

councilmember omar torres can govern even if he doesn't show up for the city business today in the bay's kris sanchez joining us live this morning from san jose. so, chris, where do things stand as of this morning? well, you know, i think it's obvious that in order to govern, you have to be present. and city councilman omar torres already missed one official city council meeting. but he's also missed a couple of other committee meetings and community events since this whole scandal broke open. now, councilman omar torres said that he missed that last city council meeting because he was sick. so today, the council will vote on whether to accept that excuse for his absence. this is usually just a really quick clerical vote. today is going to be different if the council votes not to approve his absence, it could pave the way for torres's eventual removal from office. the city charter says that after five consecutive unexcused absences, the council person can be ousted and this will follow

the council and mayor's request for torres to resign. all of my colleagues, including the mayor, have asked for his resignation and i. i believe that if he if he resign, it would help our community bring us back to the trust and integrity. that's what we deserve. so why are we here? you might recall councilman torres is accused of sexual misconduct with a minor which came to light when tourists himself went to police to report that he was being extorted by a man with whom he had a previous relationship. that investigation revealed that the accused blackmailer was a minor when that relationship started. the investigation also uncovered references to another sexual act with a different minor, and a photo of an 11 year old child with text messages and references to the boy's privates. torres has maintained his innocence. he says that he wants to remain in place while the investigation plays out, but

again, in order to govern the city charter requires a councilman to be present, so we'll see if he shows up for that meeting, and we'll let you know how that vote goes in san jose. kris sanchez today in the bay. want to follow is a conversation happening across the bay area. what will happen with this one. all right. thank you chris. turning now to decision 2024. with early voting underway, more states are opening polls today. vice president kamala harris targets swing states with a former republican congresswoman. former president donald trump focuses on hurricane hit north carolina today in the bay's alice barr is live following the very latest on the campaign trail. here we go. just two weeks to go until election day. alice starting to feel real and a reminder that election day just means that's when voting ends. because it's underway in full swing already, and the nominees are out there doing their full court press, trying to make sure people do get to the polls. former president trump toured storm damage in north carolina

yesterday and courted christian voters alongside conservative pastors, while vice president harris appealed to a republican wary of a republican bloc that may be wary of the former president trying to get them to back her. instead. early voting begins in four states today, including battleground wisconsin, joining the record numbers in several states who've already had their say. i want to make sure my vote gets in. vice president harris spent part of monday in wisconsin attacking former president trump for refusing to debate her again, pulling out of recent interviews and raising eyebrows at his rallies. he is pulling out of interviews left, right and center. i think it does lead us and it should lead us to observe that he is increasingly unstable. she campaigned alongside former republican congresswoman liz cheney, with stops in michigan and pennsylvania sharpening her appeal to trump. skeptical republicans in must win states. we might not agree on every

issue, but but she is somebody that you can trust and someone that our children can look up to. former president trump focused on north carolina. i will end inflation. i will stop the invasion. touring damage from hurricane helene in asheville. i will support and totally complete the rebuilding of every region and town and city that was devastated by the hurricane. and both he and the republican national committee chairman saying they have not seen any signs of cheating in the election. we're so impressed. and i think they have a pretty good system here, though. at a rally, hours later, the former president renewed his claims without evidence that there could be widespread fraud. the vote counter is more important than the candidate. that's been true, unfortunately. raising doubts as the votes flow in. and coming up today, vice president harris will be interviewed by nbc's hallie jackson to air tonight on

superintendent, along with doctor carolyn aguilera ford as deputy superintendent. doctor sue served as executive director of the department of children, youth and families. well, the future of a new costco location in the south bay now lies in the hands of san jose leaders. at a meeting tonight, san jose city council will vote on moving forward with the new costco. this is on prospect road and lawrence expressway. now, the plan already got the green light from the planning commission, but neighbors oppose it, saying that that costco would just be too close to a high school. and it would also worsen traffic in that area. costco says that it plans to install a wall to reduce the noise and construct a sidewalk along lawrence expressway. now to a live look in oakland this morning. the chp is making progress in stopping illegal sideshows in that city. on saturday, the agency deployed more than 60 officers as part of an unannounced surge operation. it led to 22 arrests, five of which were connected to sideshows. 21 vehicles were impounded with 16 vehicles

recovered. then on sunday night, the chp made additional arrests at another sideshow. 16 people arrested, six cars impounded in that effort. the operations are part of a four month plan by governor gavin newsom to increase chp officers around the east bay to address crime. the agency says its resources are helping to address the problem. when we can bring more resources to the table and respond to these incidents, we have more personnel that we can utilize to either shut down sideshows as well as ultimately detain and arrest people, tow vehicles. the four month chp surge into the east bay is expected to end next month. it is 510 this morning as we take a live look. beautiful shot there. as you can see, the bay bridge looking over into the city. meteorologist kari hall is tracking what we can expect from those temperatures across the bay area. starting out pretty nice this morning. kari. yeah,

and it's been cool in some areas as we're heading out the door to temperatures in the 40s and much of the north bay. we're at 47 now in napa, but it's 57 in oakland and 56 in san jose. grab that jacket for the start of the day. you won't need it. so much for the afternoon, and we're going to see a few clouds moving in today as our high temperatures head for the mid 70s for the inland east bay, as well as upper 60s for the coast. we'll talk about what's ahead coming up. mike has a look at where you can fill up for a little bit less. yeah a little a little bit better by a penny. alameda county has taken the best spot with 388 on the sign in livermore at springtown. gas on blue bills drive. that's right by the doubletree in town in marin county. we have 397 for their low in the valley. in mill valley, that's arco on redwood highway and santa clara county keeps 399 is the best calling out sunny bills national petroleum on the bottom here. that's over at old san francisco road. you check your locations closest to you, or the best

it's tuesday. we also expect a bigger volume of traffic. we'll show you where things are slowing coming up. well good morning. very happy tuesday to you. general motors just opened its books to analysts and investors. and i mean, just we're still going through the numbers now, but they made a lot more money. gm has been topping expectations for nine quarters in a row. you think we'd change our expectations? donald trump said he expected mcdonald's stock to rise after his close down mcdonald's visit. he was learning to how make fries. the stock did not rise. mcdonald's for its part, has issued a statement trying to stay out of the fray, pointing out that location in pennsylvania was run by a franchisee owner operator and that anyone is welcome in a mcdonald's. the franchisee says he was asked by local law enforcement to allow trump to visit. the restaurant was closed for the day and trump served some prescreened customers. russian president putin meantime, in kazan, russia, holding the brics economics

conference, he can't travel outside russia not to most western countries because of a world court arrest warrant for crimes against humanity. so it's in russia. brics stands for brazil, russia, india, china and south africa, set up as a conference for developing countries like our g7, but for our g7, for bigger countries. the makers of the newest blade runner film, meantime suing elon musk and tesla for copyright infringement for using their images in the tesla robotaxi event. apparently, musk and tesla had asked permission to use an image from the film. the filmmakers said no, and then the suit says musk did it anyway. here's that moment. you see a lot of sci fi movies where the future is dark and dismal, where it's not a future you want to be in. so, you know, like, i love blade runner. that's the image the movie makers say. this image

san mateo and san jose at 56 degrees as you're heading out. also wanted to give you an update on the tropics. we've been watching tropical storm christi develop, and this is, well, far to the south and moving just to the west of acapulco, moving away from mexico, moving to the west northwest at about 15mph. this is expected to strengthen to a category three hurricane out in the open pacific. and then as it moves farther to the north, it encounters that cooler water and starts to weekend. so why am i talking about this? well, we possibly could see some of that moisture surging into parts of southern california as we go into next week. as we get some cooler temperatures and way down the line, there may be a chance of rain. so we'll be keeping an eye on that in the near term. it's going to be a really nice day. headed for 75 in martinez and also 75 in livermore. gilroy. we're going to hit a high of 80 degrees. one of the

warmer spots in comparison to the upper 60s in san francisco. and tomorrow it's going to be a touch warmer. we'll be on a warming trend over these next few days, and some of our inls w to mid 80s, which is a little bit above normal, but not really all that extreme. and then looking ahead once again, we will be watching out for rain chances and cooler temperatures with gilroy highs in the mid 80s this week will be dropping into the seconds for highs into next week, so cooler weather ahead, a few more days of some, a little bit of a taste of some late summer. we'll be watching those changes. and mike, you're watching the sensors change. yeah, i'm watching the speed sensors change over here for 242 where we told you krueger registered as clear from the lane closure status by caltrans, but we still see a little slowing as the crews finally clear the area. so we're going from red to orange to yellow. now speeds are improving, but the traffic is building. look at that highway 4. so that may not clear to green. we'll just watch that. meanwhile we've gone from

to bring a group of protesters who shut down the bridge in april to trial. the group was demanding an end to the war and killing of innocent palestinians in gaza. prosecutors charged 18 of 26 protesters with misdemeanors and felonies, including conspiracy and false imprisonment. attorneys for the protesters say the charges represent district attorney brooke jenkins. pro-israel bias. a judge denied a request to remo case. kari. laura, let's switch it up to our climate in crisis today, following two historic hurricanes, helene and milton. there is research that could shed light on why we're seeing stronger storms. the scripps institution of oceanography has taken data samples of the temperature and chemistry of the ocean along the california coas,

including just offshore of san francisco. and there are ten data centers taking daily measurements, some going back to 1916. meteorologist greg bledsoe from our nbc san diego station explains how warmer temperatures and global patterns like el nino are adding more to developing storms. as the ocean warms, it expands, causing sea levels to rise, which causes erosion. oh, and that warmer water means stronger hurricanes. that intensify more quickly. like recently with helene and milton and more el nino years that can change weather patterns around the globe. are you able to say el ninos are getting stronger or more frequent based on what you're measuring right here? yeah. what's really interesting is that we used to say that el ninos occurred every 5 to 7 years. more recently, that's been occurring every 3 to

morning. so let's take a look at our commute as we check out the san mateo bridge. and it is all clear. we haven't had many issues with fog. we will begin to see a few of those clouds moving in over the next couple of hours, and it's a chilly start, mostly in the mid 50s here, and we will see a gradual warm up as the sky clears and we're headed for the upper 60s here. we'll see a high of 73 in palo alto and 75 in napa and in san jose today the high 73. so looks really nice. and mike not so nice. there is a new crash at the walnut creek interchange. just heard about it. so i took our camera which shows southbound 680 right approaching 24. don't see anything on this live camera shot, but over on the left side of your screen, that's where we do see that slowing heading down toward that walnut creek interchange as the split happens at 24, reports that there may be activity in lanes. and we do see the slowing sensors. so that camera shot looks pretty good, but it may start to back up a bit out of pleasant hill. we're watching that crash with no major injuries reported, but it is a

time where we see contra costa county build standard build for the rest of the bay. overall, we're looking pretty good. east bay, tri-valley, and south bay does show that first slowing for 101 in san jose. back to you. thanks, mike. happening today san francisco's struggling schools try to turn the page as they're facing with multiple school closures. board members today will appoint a new interim leader, today in the bay ginger conejero saab live for us in san francisco this morning and ginger, this all comes in the wake of the serious upheaval about the sudden departure of that superintendent. just four days ago. that's right. marcus and laura, a former superintendent, matt wayne, officially resigned from his post on friday and not long after doctor maria su was named as his successor. she is now the interim superintendent. now, there has been a show of support and what some call some unity among local leaders the state superintendent, as well as sfusd staff around this new announcement. we expect that to

possibly continue later today as the school district or the school board, i should say, votes to confirm. the new superintendent of san francisco unified, maria su. doctor su was out yesterday at district headquarters at the center of a rally with local leaders. sfusd staff and tony thurmond, president su has served as executive director of the department of children, youth and families for a number of years, almost 18 years. and last month, she was appointed by sf mayor london breed to co-chair a school stabilization board to support the embattled district's leadership. now moving forward. su addressed the crowd yesterda, hopeful that sfusd will get over its many challenges. these challenges are complex. i wish there was a shortcut to it, but there are not. but i am confident that with the support of everyone behind me, we will get this done. we together can

chart a future where our children will succeed and thriv. doctor sue has her work cut out for her. the district is facing a budget shortfall, and one of the more immediate challenges for her will be to balance the district's budget and avoid a state takeover. now, state superintendent tony thurmond showed his support not only for maria su, but also the school district as a whole, emphasizing his hopes that sfusd will become a leading school district in the state. declining enrollment is a phenomenon that almost every district in the country is experiencing, but san francisco, because of its people, its leadership and vision, will be the premier district in this state. now, state superintendent thurmond also made it clear there will not be a state takeover in san francisco. that is a big statement coming after months of speculation and fear of that. so what is next?

claims about medicine. meantime, the latest calculation by cnbc says 93 million americans could escape federal taxes if there are tax breaks for tips, overtime and social security proposed by trump. the lack of income for the u.s. would shatter deficit records. a new calculation by the nonpartisan center for the responsible federal budget says shortfalls would drain social security in just six years under trump. to be fair, most economists say social security will be insolvent in ten years. one way or the other. just days after shocking some of his fans with tales of owner arnold palmer's anatomy, trump was speaking to evangelical christians in north carolina. it's also great to be back in this incredible state with so many proud american patriots who believe in faith and family, god and country. thank you very much. we need more of that in this nation,

don't we? we need more of that. vice president harris once again campaigned alongside republican liz cheney. this picture right here unimaginable a few years ago. not only is cheney a republican, she is one of the most conservative republicans in modern times, which she says is why she cannot tolerate donald trump. i'm a conservative, and i know that the most conservative of all conservative principles is being faithful to the constitution. and you have to choose in this race between someone who has been faithful to the constitution, who will be faithful, and donald trump in many, many ways, donald trump is an unserious man, but the consequences of him being president of the united states are brutally serious. there are things that he says that will be the subject of skits and laughter and jokes, but words

at 8:00 and a few clouds, and eventually clearing out today with highs reaching into the mid 60s and a breezy wind and much of the bay area is enjoying a nice little break from extreme heat. but we do have a slight warm up in our forecast. we'll talk about it coming up. and a bay bridge experiencing a little bit of a break from the typical tuesday backup. it's a little late for the backup to form, because i think all the traffic that's held up over in berkeley is helping folks out right here. we'll talk about the crash in berkeley and the other at the walnut creek interchange coming up. new this morning, new revelations about the physical health of disgraced hollywood mogul harvey weinstein. doctors have diagnosed him with chronic myeloid leukemia. this is a rare bone marrow cancer. sources also tell nbc news he is receiving treatment inside new york's rikers island prison. now, this is not the first recent health issue for weinstein. back in september, he had emergency heart surgery. and before that, in july, he was hospitalized for

covid and double pneumonia. but now to a follow up, about two navy fighter pilots who died last week in a crash in washington state. both women were from california. the navy identified the two as lieutenant commander lindsey evans and lieutenant serena wellman. both were just 31 years old. last tuesday, their plane crashed during a routine training flight near mount rainier. the navy veterans in washington spoke about the impact the deadly crash is having on their community. these are human beings that sacrificed their life for us and just it's just it's emotional and it's really hard to talk about because they are part of our community. lieutenant commander evans and wellman were part of an electronic warfare attack squadron known as the zappers. well, horrifying end to what one man thought was a date. police say that he ended up getting

kidnaped and robbed. san mateo police say that that man met up with a woman he met on facebook last thursday at a parking lot on hillsdale boulevard, told police that his date threatened his life, forced him to drive to a gas station in san carlos and withdraw $300 from the atm and she then made him drive back to san mateo, where she got away with the cash. in this day and age of online dating, you never really know someone unless you really have an opportunity to talk with them and get to know them over you know, a series of time or a period of time. this 2 to 3 days, even whether it's, you know, male or female, you're taking a risk. now, that suspect was arrested on friday, police are reminding people to use caution when meeting in person with someone from the internet. san francisco is now one step closer to installing dozens of speed cameras. san francisco municipal transportation agency recently approved a plan to install 33 speed enforcement cameras across the city. they

would go in areas prone to traffic accidents near schools, parks and commercial districts. supporters say the cameras will dramatically reduce crashes and save lives to make sure that there is certainty to people who are speeding on the streets of san francisco that they are going to get a ticket. i cycle everywhere i go, so i think holding people accountable to the speed limit is important. installation of the cameras starts in december. they are expected to be up and running by february, but drivers will just receive a warning for a couple of months come april. thearts fs will range from $50 to $500, depending on just how fast you're going. new efforts this morning from oakland to clean up the city. oakland public works is expanding its illegal dumping surveillance camera program. it plans to add 15 new cameras to read license plates. you can see one of those cameras here. the

photos take aim to help the city track down and prosecute illegal dumpers. fines for illegal dumping go up to $1,500. also new for you this morning. a high tech new program that aims to protect students on school busses and hold drivers accountable. so police have a powerful new set of eyes on the road. this is a tech company, bus patrol. it uses artificial intelligence to catch drivers breaking the law, illegally passing those school busses when they're stopped. so here's how it works. those busses using bus patrol, they have a camera on it. so every time that bus makes a stop, the cameras rolling. now, if a driver breaks the rules, it actually catches that incident on camera and actually report it to police. it can have every officer follow a thousand school busses. he could have stopped the two. three. four. five. so as a result, in miami, police issued fewer than three tickets a month for drivers

our north, and we may see some of those clouds moving through the bay area within the next couple of hours. but overall, we're looking good today with a high of 74 in cupertino and 75 in los gatos. we'll also see mid to upper 70s for much of the south bay and gilroy. a little bit warmer with a high of 80 this afternoon, and we'll see low 70s for hayward, 75 for martinez and 77 for concord near the coast. it is even cooler than yesterday, a high of 62 and half moon bay and 68 in san mateo, san francisco, will be in the low to mid 60s, even upper 60s for the mission district and downtown and for the north bay. it's also going to be very nice starting out with jacket weather, but comfortable for the afternoon with a lot of mid 70s all across the north bay looking ahead, we will have a slight warm up as high pressure builds, but eventually going into the weekend there will be a cold front and some rain very close to the bay area, and we'll be watching out for that slight

chance of showers, but other than that, we're going to transition towards some much cooler temperatures starting on sunday and continuing into next week. so here's a look at gilroy and what to expect over the next ten days. very warm from now into the at least the middle of the weekend. but then by sunday we're seeing those temperatures dropping and we're only looking at 70s for highs next week. and it looks like that cooler weather continues into halloween as well. i know that's well beyond this forecast, but we're making plans already. it will be warm with some low 80s in the inland areas through friday saturday. also a little bit warm for this time of year, but it will be cooling down a lot sooner in san francisco, the warmest day will be on thursday with highs in the mid 70s. mike, now you're tracking two crashes in the east bay. two crashes with two slowdowns in important locations. this is the east shore freeway as you're coming down through berkeley. so university's overcrossing right there. that's a critical point where things tend to slow down anyway, coming out of richmond,

you see the build going on out of san pablo and through el cerrito. this crash still in lanes here, as you're heading toward gilman, it looks like folks are able to get off of that bridge from san rafael into richmond just fine. but we're watching for that critical juncture. that's one slowdown, which is keeping the bay bridge actually lighter, even though the metering lights have been activated. getting to another bridge that's counter commute up toward the carquinez bridge, eastbound 80, we do have a crash in lanes right now heading toward that carquinez bridge right around the coming skyway. not a major issue, but i call it out because we don't usually see slowing over there. and then behind me here, this is the other critical point. the walnut creek interchange southbound 680. we've had a crash blocking a number of lanes as they have to move a couple of vehicles. and so until a crew can get there and clear both vehicles, we do have 680 jammed out of pleasant hill and concord. that makes all three of these routes slower out of contra costa county, heading down toward walnut creek. back over to you. thanks, mike. well, happening now. fire investigators will now turn to the task of determining exactly what started last
