we begin this hour with breaking news, the former ceo of abercrombie and fitch. >> arrested this morning in west palm beach, florida, appeared in federal court this afternoon. he and two of his associates are accused of organizing a sprawling sexual assault. >> in a press conference this morning, u.s. attorney general said jeffries abused his position to prey on young people. >> to anyone who thinks they can exploit and coerce others by using the cast couch system, this case should serve as a warning. prepare to trade that couch for a bed in federal prison. >> joining us here on set is tom winter and nbc news legal analyst danny cevallos.

tom, what more do we know about the allegations involved here and what are we hearing if anything from the people involved the allegations center around this idea that basically jeffries and two of his associates would approach young men and said, look, if you would like a modeling job, attend some events. they were instructed even if they were unwilling to engage in certain sex acts in return for that they might have been promised a job, if they did not carry out those sex acts at these events, they said their careers would be hurt. that court hearing just wrapped up. jeffries will be allowed out on bond, 10 million bond. as far as the people involved in this case, his attorneys said,

they'll handle a plea at some point. they'll address the charges. one of his associates is going to be held pending the outcome of this. >> danny, prosecutors are saying they have substantial evidence, like travel records, financial records, victim and witness testimony, so what do you make of these charges. >> some of the ed that you just described is critical evidence to these specific charges, when you look at the indictment the two charges are identical to the charges against diddy, the man act, a very old law, a very strange law with a strange history, born out of some very racist ideals originally but now today in modern era is used largely to combat not transporting across state lines but for transporting across

biden. mike, wisconsin is one of those blue wall states that democrats have relied on for decades to ultimately win the electoral college, new reporting that some inside the harris campaign see some cracks in that blue wall, what has them concerned? >> reporter: well, what we're hearing from senior officials on the campaign they're worried about these states, michigan, wisconsin and pennsylvania. they're particularly worried about michigan, because of the war in gaza has posed particularly vulnerabilities for them. two things notable what advisers are telling us, these blue wall states have all voted the same way since 1988. president obama won these states in 2012, 2008, president biden won all three three years ago. hillary clinton lost all three to donald trump in 2016.

i'm covering president biden today, as down as he was in the polls nationwide his team felt most confident about his status in those blue wall states, something particular where harris has been overperforming elsewhere, we'll see. harris will have an event with michelle obama in michigan later this week. >> garrett, so trump cancelled a planned speech that he had in georgia to make this event in north carolina tonight happen. does that say something about how critical north carolina is right now? >> reporter: i think it does, kate. no path back to the white house for donald trump that doesn't include north carolina, or at least not a simple one, his campaign has long believed that his best path to 270 electoral votes is to hold on to north carolina, which he won in both 2016 and in 2020, flip georgia back into the republican column a state where it has been for

prescriptions. apple ceo tim cook revealed something surprising about his iphone group chats. steve joins us now. we'll start with walmart, they'll start delivering prescriptions to customers' doorsteps soon, saying today, deliveries are available in six states and plans to expand the service to 49 states by the end of january. the move comes as cvs and walgreens cut stores. qatar airlines launched today, a novel flight with high-speed wi-fi provided by starlink, to celebrate the flight they held an in-flight call with starlink ceo elon musk. it plans to have 12 of its planes equipped with the free service by the end of the year and its entire fleet by 2025. tim cook doesn't name his e apple ceo said he's never named one and found it interesting that people often

voters about a.i.-generated deep fakes. in the psa organized by the nonpartisan group represent us, celebrities like michael douglas, like orlando bloom, or do you. they might be deep fakes. joining us now is ken dilanian. so, ken, nbc news got an exclusive early look at this ad campaign, what's the message? >> reporter: the message is don't be fooled by fake videos that are trying to confuse you about when and where to vote. that's the issue here. look, deep fakes have been used to discredit candidates, to target candidates in election campaigns, that's not what this is about the concern here is as election day approaches keeping people from the polls in a swing state could potentially decide the election, an example of it in new hampshire in the primary a fake audio of president joe biden went to 50,000 residents

ginger conejero saab joins us from the courthouse in san francisco with more testimony this morning. still revolves around the party scene, which was the backdrop of the lifestyle shared by césar mamani and other characters who have been introduced so far. miss mamani is the sister of nima momeni, who is the man accused of killing cash app founder bob lee, who is on trial for his murder. now miss mamani is back on the witness stand for a third day in a row. this morning, defense attorneys began their cross-examination of her. she testified throughout the day yesterday about the drugs, alcohol and party scene that did serve as the backdrop for her interactions with mr. lee. today, the defense also turns their attention to texts exchanged between miss mamani and mr. lee from his arrival in san francisco on march 29th, 2023, to the day of his death on april 4th of the same year. one by one lead counsel for the

defense team went through text messages to go through the tone and the undertones to those messages. they include multiple invites to hang out privately, as well as with others who were under the influence, as miss mamani testified. she also testified that she has been friends with bob lee for eight years, and that he was under the influence of drugs and alcohol when they met up at certain points, and she said that he acted, quote, aggressively. now it was apparent inside the courtroom the reaction to that testimony from miss mamani, from bob lee's family. they were very much in disagreement with that. members of his family are here as well this morning, as they have been in the past days. his father, his brother and his ex-wife as well, and moments ago, the defense also submitted surveillance video. it's now they're also now examining that surveillance video, which includes miss mamani, mr. lee

and a third party who has been identified as a drug dealer. we will have much more on our continued coverage on nbcbayarea.com, as well as our later newscast in san francisco, ginger conejero saab nbc bay area news. thank you. ginger. oakland leaders are taking a new look at the city's budget plan in light of the coliseum deal. the last meeting was abruptly canceled. mayor sheng thao says the sale of the coliseum will bring in $125 million and will address the city's budget crisi. however, the union representing oakland police officers has some concerns. the union says it's suspicious about the true details of the sale. it believes the city is teetering on bankruptcy, and it says oakland is covering up the real estate of the city's finances. this comes as the union is calling for answers from city hall about potential cuts to oakland's already depleted police force. plenty of sunshine across the bay area today. here's meteorologist kari hall with what to expect. our temperatures today will be nice and

comfortable with a lot of sunshine and a light wind. in san jose, we're looking at a high of 73 degrees and 78. in morgan hill, and we'll see upper 70s for much of the east bay. from concord to antioch. expect upper seconds there with mid 70s for much of the tri-valley with pleasanton and livermore up to about 75 degrees in palo alto, 73 will be the high today, while we will see a lot of 60s in san francisco, it will be breezy and sunny and mid 70s for the north bay, sonoma and santa rosa in the mid 70s. now we are going to have a little bit of a warm up over the next few days and we'll see a lot more 80s. a look at the 7-day forecast and when we will see the end of those warmer than normal temperatures coming up in about 30 minutes. thanks, kari. oakland continues its work to catch illegal dumpers. the city is launching a new cleanup push today by expanding its surveillance camera program. the public works department plans to add 15 new license plate

to pay a settlement a settlement to the family of black man who was shot and killed in 2022. police say walker refused to stop when he was asked to and they fired -- he fired a shot from his car before running away. his death sparked widespread protests across akron, in 2023, an ohio grand jury declined to indict the officers in walker's death, but walker's family filed a federal lawsuit accusing the officers of using excessive force. >> the exonerated central park five are suing former president trump the lawsuit alleges that trump made false and defamatory remarks during last month's presidential debate. he also claimed the victim ultimately died, however each man actually pleaded not guilty

and the victim survived. the five men are asking for the court to determine damages. and take a listen to this, a dog has been found alive after being buried in rubble of a home explosion. the explosion happened last week in a virginia neighborhood days later someone called 911 saying they could hear a dog barking under that rubble. fire officials responded and found the pit bull named brandy incredibly she was in good shape. reunited with her family and is expected to make a full recovery. we're learning new details now about what may have caused a helicopter to crash into a houston radio tower, killing all four people onboard. >> it created a fireball in the sky as the helicopter and tower came crashing down, now investigators say the federal aviation administration put out an alert just days before warning pilots that some of the lights on that tower were out. here's tom costello.

we're learning more about the final moments before this fiery helicopter crash in houston that killed four people onboard, including a child. new audio of what appears to be the pilot, talking with air traffic control, showing no signs of distress. >> just departed ellington. >> reporter: but just moments later, surveillance video captured the impact. >> the helicopter hit a red and white telephone tower. >> reporter: aerial video shows a mangled wreckage and a field of debris and fire. >> we're gathering all of the evidence we can. it's a pretty complex scene. >> reporter: on sunday night, the helicopter flew straight into a 1,200-foot radio tower, creating a fireball in the sky, and igniting the massive grass fire below. >> there was a lot of smoke. and my throat started getting scratchy. and my eyes -- the fumes were real strong. >> reporter: flight aware shows the chopper was flying from ellington general aviation

airport, towards downtown houston. it was just 600 feet off the ground, traveling at 108 miles per hour at impact. >> the faa rules indicate you need to stay at least 500 feet away from any structure or obstacle when you're flying in air space. it's the pilot's responsibility to maintain safe separation. >> reporter: the faa had put out a notam, or notice to air missions, just days earlier, warning that some of the lights on the tower were not working. but video appears to show one light was functioning as the chopper approached. >> that is something that a pilot should do before every flight is check all of the notams. >> reporter: in a statement to nbc news, sba communications, which owns the tower, said it acquired the site last month. as part of the standard process, had ensured a warning was in place in order to exercise caution during the change of ownership. local authorities have not yet

formally released the identities of those onboard. the ntsb and the faa investigate. the faa database shows the chopper was owned by porter equipment, a construction company there in houston. but the ntsb investigators say, it was operating as an air tour flight on sunday evening. craig? the father of former one direction star liam payne has met with prosecutors investigating his death in argentina, several reports said payne had multiple drugs in his system. here's sam brock. more details in the death of one direction star liam payne. preliminary toxicology reports show that payne had various substances in his system, when he fell to his death, according to outlets, abc news and tmz and pink cocaine, a cocktail of drugs that mixes ketamine and methamphetamine.

experts consider pink cocaine, tusi, a concern as its popularity grows in recent years. while authorities are still awaiting his final autopsy, initial findings show he could have fallen in a state of semi or total unconsciousness. just minutes after police were called about a, quote, aggressive man, that could be under the influence of drugs or alcohol. fans continue to mourn his life and legacy. fellow pop superstar, justin bieber, reposting an emotional video on instagram. >> you're allowed to cry. >> reporter: and payne's oldest sister, nicola, sharing the heartbreaking moment, that she learned he fell from a third floor balcony in buenos aires, argentina. when i saw the news popped up on my phone that he had left us, i went cold. i wanted so much for this to be untrue. nicola adding, this cruel world is always too quick to judge someone.

powerful, new set of eyes on the road, thanks to bus patrol, a company using artificial intelligence in school districts from pittsburgh to providence, to catch drivers in the act. here's how it works. every time the bus makes a stop, its cameras are rolling. and bus patrol's artificial intelligence is watching along. so, if a passing driver breaks the rules, they're caught on camera. and reported to police. >> he could have stopped. two, three, four, five. >> reporter: officers review video footage confirming violations. >> this person will be receiving a citation. >> reporter: before teaming up with bus patrol, miami-dade p.d. issued fewer than three tickets a month for drivers passing school buses. now, it's more than 40,000. we hopped on a school bus to see for ourselves how fast they can pile up. every vehicle has a stop -- this was our first simulated stop. >> they're all in violation. >> reporter: it's happening that quickly. >> it's happening that quickly.

>> reporter: sandra martinez, a miami-dade school bus driver for more than 20 years, says she sees this every day. >> are you going to stop, you can save a child's life. you know, that's a precious cargo. >> reporter: since 2000, more than 50 people have died, in crashes involving drivers illegally passing stopped school buses. almost half of those killed were pedestrians aged 18 or younger. the miami-dade program is only several months in. but bus patrol says its longer-term statistics are promising. >> over 90% of folks who get one violation in the mail never break the law again. >> reporter: bus patrol said they're working with school districts across 16 states. here this school district is not getting charged anything at the end of the day with this program because the cost of this technology is being covered by the fines that reckless drivers are paying. back to you.

we've some good news about the power of joy in times of hardship, a young boy using his personal health journey to support other kids in need. oliver was 9 when he started feeling strange during the covid pandemic. >> my mom heard me breathing heavily, like -- >> yeah. he was diagnosed with a rare form of leukemia. >> it was covid, it was like lockdown on top of lockdown, so for us my wife was like, we need to do something to get him off the sofa. >> reporter: his parents got creative. >> in the first month, we got over 2,000 patches in the mail. >> reporter: wow, you were like, patches would be fun, then you got flooded with patches. did you put them on a jacket? >> oh, yeah. this is actually my original jacket. for me it was like a sought of armor and it was kind of like an ice breaker when i was walking
