cases to voters. our washington insider breaking down where both vice president harris and former president trump are focusing their efforts. plus, limiting his political power. the bold move from san jose city leaders as one of its councilmen faces sexual misconduct allegations. and fallout from niners injuries carries on the highly anticipated update from the team, expected today, the faithful look for hope ahead of sunday's game against the cowboys. this is today in the bay. good wednesday morning to you. i'm marcus washington and i'm laura garcia. let's start out this wednesday with a look at the forecast. meteorologist kari hall tracking what we can expect. i think this is the first morning i kind of had to put on a little light jacket. kari. yes. our mornings are getting more chilly, and we're also going to have still some mild weather for the afternoon. but today, looking at san jose and what to expect low 50s over the next several hours and then
5:02 am
as we go toward noon, it will warm up to 70 degrees. we're headed for the upper seconds here, and you will notice that it will be slightly warmer this afternoon compared to yesterday. and we'll see some more upper 70s for parts of the tri-valley, the inland east bay, and low 80s for much of the north bay, with santa rosa's high this afternoon up to 81 degrees. so we've made it easier for you to follow weather in your neighborhood with our nbc bay area app, we've just launched a redesigned weather section. it's the only way to get your local weather from the people you know. point your camera at the qr code on the screen to download that app right now. marcus and laura, thanks so much, kari. well, turning now to the race for the white house with election day less than two weeks away. the presidential hopefuls are making cases to voters who may still be on the fence. today, both vice president harris and former president trump head to battleground states to shore up support. today in the bay's alice barr joins us live from washington. as early voting is already well underway in several states. alice. well underway.
5:03 am
laura and marcus. and the numbers are just soaring. we've seen the enthusiasm across the country. more evidence in wisconsin, where early voting began yesterday and turnout was so high that there were some system lags that election officials say are now resolved, both of the nominees trying to ensure that it's their supporters getting out to vote. the presidential nominees are stepping up their outreach. former president trump holding events with faith leaders and latino voters before rallying in north carolina. we're going to take care of you. we're going to work together. looking to shore up a state. he's won twice. that's now in play. he went on the attack against vice president harris. she took a day off. she's got no energy at all. her speeches last for about 15 minutes. that as the vice president sat down with nbc's hallie jackson, who pressed her about the role of gender with fewer men supporting her than
5:04 am
did president biden. regardless of someone's gender, they want to know that their president has a plan to lower cost, that their president has a plan to secure america in the context of our position around the world, do you not see sexism as a factor in this race at all? i don't think of it that way. my challenge is the challenge of making sure i can talk with and listen to as many voters as possible and earn their vote. president barack obama, former president obama, who has suggested sexism is at play in direct appeals to men, campaigned in detroit overnight with rapper eminem the latest celebrity. harris endorsement. while the vice president acknowledged her campaign is preparing for the possibility. former president trump will again declare victory before all the votes are counted. of course, this is a person, donald trump, who tried to undo a free and fair election. both nominees looking ahead while staying
5:05 am
focused on the final two weeks before election day. vice president harris getting a boost from even more star power, with bruce springsteen set to perform at upcoming rallies, while former president trump will be appearing on the very popular joe rogan podcast, he campaigns today in georgia. vice president harris has a town hall in pennsylvania. lauren marcus all right, alice barr in washington this morning. alice, thank you. and for anyone at home, get your phones ready because we have a reminder for you. we're helping you get informed about our local races. all you have to do is scan that qr code there on your screen. it's going to take you to our full voter guide with info on all the key races, a follow up this morning, and a new blow for one in battle. san jose council member the council last night stripped omar torres of his committee assignments. torres did not attend last night's council meeting, his second straight no show since word dropped of lurid allegations he may have committed sexual misconduct with
5:06 am
a minor. the investigation is ongoing and torres has maintained his innocence. san jose mayor matt mahan called for the council to move on, saying it's time for torres to resign. i believe councilor torres is holding his seat hostage and denying representation to the 100,000 residents of district three, based on what he has said in his own words. that's reported out via the affidavit. i think he's lost the trust and respect of the community that he was elected to represent. the city council charter allows for council members to be removed only after five straight unexcused absences. and torres claimed he was sick last time around. the only other way members can be removed is through a recall election. that move would be up to voters. well, the push to recall alameda county's embattled district attorney is growing. today, pamela price's predecessor plans to endorse the recall. former alameda county district attorney

nancy o'malley will make an announcement during a virtual news conference planned for 1030 this morning. you may recall back in 2022, o'malley chose not to seek election. this is after serving three terms. also today, fire crews are planning controlled burns to help during fire season. marin county fire department will do a prescribed burn in the area of mount tamalpais and watershed lands. then in sonoma county, fire crews will burn about 120 acres at tolay lake regional park, and there will be a burn in the san gregorio and pomponio areas in san mateo county and upcoming san jose state volleyball matches being moved out of nevada. this is all due to concerns over players well-being. sjsu was supposed to take on nevada in reno. this is on saturday, but that match will be played at the university in san jose. so the university says that that decision was made in the best interest of both programs and the well-being of athletes, coaches and
5:08 am
spectators. sjsu teams have been facing controversy. this is after one of its own players joined a lawsuit seeking to overturn ncaa guidelines on transgender athletes. that lawsuit, outed one of sjsu players as transgender. well, today we'll get a chance to ask the 49ers about the devastating loss of kansas city chiefs, which was really painful in more ways than one. already, the armchair quarterbacks have been talking about trades and whether brock purdy is still the man today in the bay's kris sanchez joins us from levi's stadium with what the buzz is all about. kris. a lot going on for our niners. well hey good morning to you, laura and marcus. yeah. you know that saying boy, that escalated fast. and it certainly did as fans want to hear more about what this team is going to look like heading toward and closer to the postseason. we might get some answers today as the niners have a media availability, but already the
5:09 am
armchair quarterbacks are talking about the niners health. they're talking about trades, and they're talking about whether brock purdy is the man to lead this team. let's start there. sunday was brock purdy's worst game of his nfl career. after the game, purdy took the blame for that, and some fans were asking if he can handle the pressure. matt maiocco of nbc sports bay area reminds us that purdy, one for postseason games as the niners quarterback and threw six postseason touchdowns and just one interception. all that said of course, purdy did not play well sunday against the kansas city chiefs. it was his worst game in 34 nfl starts. but there is also zero question that moving forward for the rest of this season and into the foreseeable future. purdy is part of the solution, and he has rarely been part of the problem. all right, so when coach shanahan answers questions about
5:10 am
possible trades to fill a void, he, as he recovers from that hard to watch acl and mcl injury he sustained on sunday, he will likely hear about who it is that people want. there's also the question of deebo samuel and the pneumonia that sent him to the hospital. what the team will look like come sunday when the niners take on the cowboys is a very big question. and of course, you can catch the 49ers talk podcast wherever you listen. but fans definitely have lots of questions. we're hoping to get lots of answers as coach shanahan takes to the mic today in santa clara. i almost said san jose in santa clara. kris sanchez today in the bay at levi's stadium. all right. thanks, chris. all right. levi's stadium will be the place to be to watch the game, whether we'll cooperate. yeah, it looks like it's going to be really nice on sunday. our temperatures a little bit cooler out there. so if you will be going. here's how you plan what you'll wear at
5:11 am
kickoff. it will be in the low 70s and nice and sunny. but you know how it goes in the evening. once that wind picks up, the temperatures drop off quickly. so we'll be heading down to the mid 60s by the end of the fourth quarter. so just make sure you're planning accordingly. now we're going to see temperatures starting out cool here. this morning with some mid 40s now in walnut creek. and you're probably noticing that it is cooler in san mateo and san francisco. we're at 50 degrees and 52 now in san jose, but it will actually be slightly warmer this afternoon. and we'll see upper seconds and low 80s as we bring it up. a few more degrees over yesterday's highs. so we'll talk about the changes ahead coming up. mike has a look at where you can find some lower gas prices, where we had some changes over there in livermore. we're going to start in livermore, but we're going to go across the freeway from yesterday's best on the south side of 580. you're down nearly a dime from that price yesterday. 379 at dimond gas and mart on south front road, the best in the south bay. still 399. 390 9.8 cupertino's great

gas on north deanza boulevard for the middle price here and then jumping up to solano county. the low jumps to 415. we're looking at fairfield and bonfire on walters road. you can track those changes and maybe get some deals you didn't know about in your area. gasbuddy.com on the roadways, we're looking at a pretty smooth drive. i was watching a lot of slowing south. 242 just like yesterday, approaching the 5:00 hour, just at 5:00, things started to clear and now we're back at speed. overnight road work cleared there and a little slowing starts in typical spots for highway 437 and across the bay bridge span a bit. back to you. thank you mike. well, a slow drip for starbucks ahead for you this morning on today in the bay. the tactics the coffee giant says did not do much for sales this season. two most important liquids are coffee and gasoline. i'll tell you how to save a dime on a gallon of gas. can i add wine to that list? oh, yeah. okay. new heights for an nba legend. lebron's latest feat. accomplished last night.

san francisco is in crisis and we need real experienced leadership. we need mark farrell. our interim mayor who got things done. who showed we can clear tent encampments, fight crime, and address the drug crisis. who will make the tough choices for our city's future. "i'm mark farrell. i'm running for mayor because san francisco deserves better." "i'm ready to deliver that change on day one." mark farrell. a proven leader with the experience we need. temperatures in the 40s in the morning to low 80s today. that's a big range from the way you start your day into the afternoon. make sure you have a jacket and then short sleeves for later on. this afternoon.
5:16 am
we'll be tracking all of the changes for all of our microclimates, and talk about that slight warm-up coming up in a few minutes. i'm tracking changes to this is at the bay bridge. the sensors were yellow. then when i showed them on the screen, they turned to green, wanted to make sure everything had cleared up. maybe some overnight crews had to clear from that westbound span. we're seeing those taillights there moving just like the sensors say at the limit. we'll show you how things are shaping up. coming up. well good morning. very happy wednesday to you. there are so many changes ahead at starbucks. the company has decided to stop providing forward guidance to investors. that is very, very serious. marcus and laura are going to talk more about that in a second. mcdonald's stock under huge pressure after e coli poisonings were linked to quarter pounders in several states, the cdc says it could be the meat, but it could be the onions as well. there's also a huge frozen waffle recall. kodiak and betty crocker are among the brands. they're all made by a company called treehouse foods. there's a risk
5:17 am
of listeria now. the list is so long i can't read it all here, but if you have a box of frozen waffles, give them a google. big news from amazon this morning. it's going to introduce prime gas that will let prime customers save $0.10 a gallon at bp amoco and ampm gas stations. amazon plans to add discounted electrical charging at bp stations as well. tesla reports profits after the closing bell. this is going to be the first time experts can grill elon musk about his actual plans for a robotaxi. instead of those vague pie in the sky promises he made during that event. earlier this month. so actual concrete plans if musk cannot provide that, expect tesla stock to feel a lot of pressure. meta has suspended accounts on its threads and instagram apps that track airplanes. twitter had done this as well. they're particularly worried about one user who publishes the locations of

planes belonging to elon musk and mark zuckerberg. taylor swift to nothing illegal about tracking a plane. it's all publicly available government information. so, for instance, all you would need to do to track elon musk's plane is to know the tail number and 628. yes. speaking of airplanes, american airlines passengers report they've seen a change at the gate, with some ticket scanners now making a noise. if somebody in group seven tries to board with group three airline employees, call the people gate lice because they hang in front of the ticket taking area, even though they're not going to board for several groups later, gate agents are supposed to turn those people away when they cut in line, but they don't always check the ticket. now it's going to make a noise. i think this is a great idea because the people who they paid to get on the airplane first, so you can't just try to do it for free, right? makes sense. all right. it's been decided. all right.
5:19 am
well, you are speaking of starbucks early on in your report. so let's talk about this right here. a disappointing start to pumpkin spice latte season. kari said. say it isn't so she's gasping back there in the weather center. so here's the deal. shares of starbucks are sinking after reports weaker than expected with those sales for the most recent quarter. the company is also pulling its financial forecast for the next fiscal year to give its new ceo some time to work on a turnaround plan. customer traffic has been sluggish, and starbucks says that the fall product offerings such as the ice apple kris nondairy cream chai and the frequently asked promotions it just didn't drive people into the stores. pumpkin latte or pumpkin spice latte or psl, which is usually a booster for sales, also didn't seem to help out. well. there is some excitement going on right now for a lot of basketball fans right here in the bay area. warriors tip off their season opener tonight over in portland, but it was history made last night down in la that really has
5:20 am
a lot of folks everywhere talking this morning. yeah no kidding. all courtesy of lebron james and his 20 year old son bronny for the first time ever last night, a father and son duo took the same court in an nba game. the lakers this summer drafted bronny james in the second round. during the first half, he checked in with his old man, played for three minutes, never scoring. watching the rest of the game from the bench. dear old dad, meantime, scored 16 as the lakers won it 110 to 103. and that was a huge dream fulfilled for lebron james playing with his son. and yeah, he said don't call me dad during the game. so he's not like hey lebron, here's the ball. pop. pop it pops it. old man old man. yeah. when the old man scores a little bit more than you. yeah the young pups got some learning your highness. how about that dream fulfilled. very cool. yeah. all right, well, let's get outside and shoot some hoops today. it's going to be nice out there. terrible. speak for
5:21 am
yourself, laura. hey, hoop dreams. she was the cheerleader, so you know that's true. we are going to have some nice weather today. we're starting out clear. and it's also very chilly, so we do need jackets heading out the door. look at danville right now. 43 degrees. and we're at 46 in livermore, 51 in concord. and we're seeing a lot of low to mid 40s in much of the north bay, san francisco at 54. and this is where we're headed for this afternoon. it's going to be a little bit warmer than it was yesterday. we'll bring it up about 3 or 4 degrees. but you'll notice the difference in morgan hill today are high. they're up to 81 degrees. and we'll see upper 70s low 80s for much of the east bay with danville high at 79, also 79, in martinez and in oakland, some lower 70s. also low 70s for redwood city and san mateo, 72. in san francisco, the high 70 degrees downtown really perfect temperatures and
5:22 am
comfortably warm for much of the north bay, with highs up to about 79. in sonoma and in novato. so looking ahead, we will see a slight boost in temperatures through the end of the week. but then this weekend, a cold front will be coming in and each run of the computer models is putting a little bit more moisture. there, and the possibility of at least some spotty rain on sunday into monday. but much cooler temperatures coming in. and there will be a couple of waves and shots of these cold fronts coming in to just reinforce that cool air. so next week we're going from seeing highs in the 80s to highs in the low 70s for one of our warmer inland spots like walnut creek. and we are going to see that significant cooldown transitioning us into fall. more of a fall like feel. mike, you spotted some flashing lights on our camera in walnut creek. i did, we'll take a look at southbound 680. heading toward that 24 split the walnut creek interchange. flashing lights. i believe they're heading over there to take care of the report. the roadway

hazard. a disabled vehicle in the middle of the roadway, not a crash. although the icon does indicate that roadway hazard was reported. hopefully they can clear that lane without too much disturbance. it's early to see any slowing here at the walnut creek interchange, and we don't. we saw the earlier slowing clear from south 242 and highway four just has blips tapping breaks for highway 37, no backup at the bay bridge and anywhere south of there. still lighter traffic. back to you. back to you. thank you. mike. well, 522 for you, this morning. much more ahead next here on today in the bay nbc bay area responds. your next used car deal might be a clunker thanks to mother nature. i'm consumer inves

showing tens of thousands of ticking time bombs that might be on sale at a lot of car lots. good morning. two east coast hurricanes, milton and helene, basically back to back, just flooded a bunch of cars and we just got some eye opening data about them. carfax. the vehicle history company, estimates that an astounding 138,000 cars flooded during hurricane helene. hurricane milton will drive that number even higher. here's the problem shady used car traders will reliably polish up some of
5:27 am
those flooded cars and try to offload them out of state in places like sunny california. carfax says you do not want to buy a car that was in a flood. even a little bit of water damage can lead to electrical issues. it's really a ticking time bomb and then fixing those electrical issues would be very costly as well. on top of that, m warns that flooded cars are prone to mold. that's a whole other headache. carfax suggests extra scrutiny if you're buying a used car right now, especially if the vehicle history shows that car recently shipped west from the southeast. ideally, hire an independent mechanic to inspect the car. we made a video showing you the telltale signs of a flooded car and how to spot them, like foggy headlights and brake lights. you can watch that video on our website, our streaming channels, and our youtube page. just look for the to how playlist. thank yous. 527 this morning next here on

russia. the overseas military move being made overnight as russia's war with ukraine escalates. and we'll have the latest from the campaign trail, including a new warning about donald trump frosomeone who knows him best. plus, one east bay city is trying to lure home insurers back. the tactic they're considering in hopes of solving company's conces. this is today in the bay. good morning. thanks for making us a part of your morning. i'm marcus washington. and i'm laura garcia. let's start out with a look at that forecast for this wednesday morning. meteorologist kari hall tracking what we can expect. a little bit cooler in spots as you're heading out and getting this wednesday started. we will need a jacket for the morning and then short sleeves for the afternoon. big range in temperatures for all of our microclimates. take a look at your microclimate and the where
5:32 am
we're currently at, where we're at 51, in martinez and in oakland, while it's 41 in sonoma and 43 in santa rosa. here's a look at mountain view and what to expect with our temperatures going from 50 at 8:00 to mid 70s for today, we will see the slight warm up starting today and it will continue through the end of the week. so we'll talk more about that. mike, you are looking for a crash near the bay bridge. yeah, near the toll plaza. the original report was on the span, but i think they ant actual the overcrossing right here. we scan the cameras looking from both emeryville and from the bay bridge toll plaza. we don't see the incident, but we do see a little bit of slowing that shows up both at the berkeley curve and the incline. track it for more detail because chp did find something. so we're tracking no major injuries, no major slowing. we'll watch that as it builds. meanwhile, the walnut creek interchange continues to have that crash southbound 680 at 24 and northbound 680 at 242 in pleasant hill under behind that sign, there may be a crash.
5:33 am
there may be two actually heading counter commutehe rest of the bay light traffic back to you. thanks, mike. well, with a looming insurance crisis, orinda is taking steps to help homeowners who just are trying to make it in the bay. today in the bay's ginger conejero saab is live for us in renda. this morning. and ginger, this all comes as folks areeally feeling the impact there of policies not being renewed. that's right marcus. quite a number of folks that are feeling that the mayor here says that she estimates one third of the 19,000 residents here in orinda have gotten notices of non-renewals. so they're doing something about it. not the city, per se, but the fire district officials from the orinda moraga fire district are considering a new ember resistant zone, which would require that homeowners get rid of all flammable vegetation and material within five feet of their homes. now, that includes uprooting plants and grass, wood
5:34 am
fencing, and any other combustible materials. it has also been referred to as zone zero. now, the idea is to reduce the likelihood that embers from a nearby fire would land and flammable material. consequently setting it on fire. orinda mayor darlene gee, enforcing an ordinance or says enforcing an ordinance like this might get some backlash, but there is data that suggests it works, and it is very well researched. so it is based on actual science. it's not a it's not a theory, but it is also one that's going to be a very, very tough thing for people to accept if it's decided to be the best solution. well, that research that the mayor is talking about there suggests that ember resistant zones work best when more than 30% of homes on a block comply. the proposed ordinance would be some of the
5:35 am
most stringent rules to protect homes from wildfire risk, with the goal of getting insurance carriers back. now, earlier this year, california's largest insurer, state farm, announced that it would not renew tens of thousands of residential policies in the entire state. now, at least one city that's somewhat close to the bay area has already enforced something like this. south lake tahoe has pushed forward with a five foot rule for its 21,000 residents. so it will be really interesting to see where this goes. the next fire district meeting happens on november 20th in orinda. ginger conejero saab today in the bay. hopefully it makes some change. i know it's hitting a lot of homeowners there in that area. thank you ginger. we are following breaking news. the u.s. confirming north korea is sending troops to russia. defense secretary lloyd austin says there's evidence showing those troops were sent on monday. south korea leaders also say 3000 north korean troops are receiving training on drones and
5:36 am
other equipment before being deployed to battlegrounds in ukraine. austin also said it would be a serious issue if north korea's intention is to participate in this war on russia's behalf. with less than two weeks to go until the election, one of the people who knows donald trump best sat down with the new york times. scott mcgrew is here to talk more about that. we're talking about john kelly here. he was trump's chief of staff right hand man for pretty much what a third of his presidency. yeah that's right. trump had three chiefs of staff. good morning. general kelly was july 2017 to january 2019. now kelly has long warned about trump. you've heard from him before, but he just spoke very frankly with the new york times, saying if trump wins, he'll likely rule as a dictator. and that trump met the definition of a fascist as well as reconfirming that trump had called american soldiers who had laid down their lives losers and suckers. kelly said recent comments from trump that he
5:37 am
would use the u.s. military against american civilians was so disturbing, he had to speak out. now, kelly is one of several former trump officials to speak out. former marine four star general served as secretary of homeland security. trump's former defense secretary mark esper, his former national security adviser john bolton, his former military chairman of the joint chiefs of staff mark milley, have all warned about trump as well. so, too has vice president mike pence. president biden was campaigning in new hampshire and said that trump should be locked up. that's a very unusual and improper thing for a president to say. presidents should stay out of criminal cases. biden immediately tried to take it back. i mean, so i know this sounds bizarre. it sounds like i said this five years ago. you'd lock me up. we got to lock him up. political document. lock him

out. that's what we have to do. kamala harris, meantime, sat down for a long format interview in last night's nightly news on nbc. she's done a string of interviews. our hallie jackson asked her why, as only the second woman to run as president for president from a major party. she had not called more attention to gender. you've been reluctant to lean into, to talk about the historic nature of your candidacy on the campaign trail. why is that? well, i'm clearly a woman. i don't mean to point that out to anyone. the point that most people really care about is, can you do the job? and do you have a plan to actually focus on them? morning. the u.s. government says a false abuse accusation against democratic candidate for vice president tim walz was created by the russians, and that there's a russian plan to stir up violence in america following the election. speaking of walz, at this rally here, he used a

crass term to describe elon musk. i won't be repeating it. the department of justice, though, confirms it has received a letter from former republican officials asking it to investigate musk's million dollar giveaways for registered swing state voters who sign his petition. the doj has declined further comment and says it will not say if a formal investigation is underway or will take place. looking ahead to the campaigns this morning, trump will be in georgia. he has another town hall, this time in zebulon that's south of atlanta, and jd vance will start the day in las vegas and end up in reno. laura, very busy time. thank you very much, scott. and we're trying to help you get informed. before you vote to scan the qr code on your screen. it will take you to our full voter guide with info on all the key races, both national and local. 539 for you right now with controversy brewing around one candidate for san jose city council. his
5:40 am
opponents today plan to hold a rally. the mercury news is reporting district eight candidate tam truong is accused of felony mortgage fraud. this is tied to a civil claim he vigorously denies. truong is currently on administrative leave as a sergeant for the san jose police department, for reasons the department does not specify. opponents want him to end his candidacy. now, in a statement to the paper, his attorney says in part, quote, this single count complaint represents nothing more than an allegation. it is based on a misunderstanding of all facts. in this case, this matter has been settled through a civil proceeding, which is the appropriate venue. tonight, the rubber finally hits the road for the golden state warriors. the team went undefeated during the preseason, but that won't matter now. tonight, the warriors tip off the new season on the road in portland and without one popular player, klay thompson, now in dallas, instead, newcomers including buddy hield and de'anthony melton will line up alongside steph curry and
5:41 am
draymond green. the team is hosting a viewing party tonight outside the chase center. for fans who want to brave the fall chill in the air. all right so how cold are we looking. it will be in the low 60s at the time that the watch party begins. and people start to gather outside of the chase center, and it's going to also be breezy. so i think that makes it feel a lot cooler than 63 degrees. and then as we go late into the evening, it will cool down a few more degrees. so make sure you're bundled up for the most likely hours you'll be standing outside. but all that adrenaline pumping. so we're going to see temperatures today in the low 70s in san francisco and low 80s for much of the north bay. it will be 77 in san jose. it will be just a touch warmer than yesterday. and looking at tomorrow's temperatures, it's about a repeat of today with slightly warmer than normal highs going into the next few afternoons. mike, what's the update on that crash near near the bay bridge? yeah, the
5:42 am
