has a plan to secure america. right now, at 6:00, the attacks escalate. we're live in washington as the race for the white house zeroes in on undecided voters in swing states. and taking a hit, the former bay area politician expected to come out in support to recall alameda county district attorney pamela price. plus, we're counting down to the 49ers and cowboys on sunday night football. the injury update expected today and the niners chance at turning the season around. this is today in the bay. the game this weekend. but it's only wednesday. good morning. halfway through our workweek. thanks for joining us. i'm laura garcia. top of the mountain there. that's right. as far as the week. workweek, anyway. all right. i'm marcus washington. we're going to get a look at that commute with mike coming up in a bit, but let's talk about that forecast this morning. a little chilly out there to start. yeah. but
6:02 am
actually today our temperatures will be climbing. so we are going to see a lot of changes as we go throughout the day in a wide range of temperatures. we're at 46 now in walnut creek. you may notice that it is a little bit more of a chill in the air. starting out today, and as we go throughout the day, we're going to see a gradual warm up in fremont. your morning commute starts out with upper 40s at 7:00. we're still at 49 degrees, but then at lunchtime it is 68 degrees. we'll continue to see those temperatures warming up into the low seconds there. 77 in san jose, and we'll see some low 80s for parts of the north bay. we've made it even easier to follow the weather in your neighborhood with our nbc bay area app. we've just redesigned the weather section. it's the only way to get your local weather from the people you know. point your camera at that qr code on the screen to download the app right now and mike, you've been tracking a new crash now in san jose. yeah, right where we see the first slowing right here, north 101 at mckee. now the timing is the volume should start to ease off for another hour or another 40 minutes
6:03 am
through the area. but the crash is in that zone between 280 and oakland roads should be to the shoulder. i'm watching. no major injuries reported 87 shows that were slowing easing up as well, but we'll have that next build as folks feed in out of south county. over here, we still have highway four actually holding pretty pleasantly out of the area through pittsburgh and bay point. we saw early slowing. it's kind of held steady there, slowing through richmond and toward the bay bridge. the earlier crashes have cleared. just the backup back to you. thanks, mike. well, turning now to the race for the white house. the election day, less than two weeks away, and presidential hopefuls are making cases to voters who may still be on the fence. but today, both vice president kamala harris and former president donald trump head to battleground states to shore up support today in the bay's alice barr. joining us live from washington this morning as early voting already well underway in several states. alice marcus well underway and breaking records in several states. and we saw evidence again of the enthusiasm out there yesterday when
6:04 am
battleground wisconsin had its first day of early voting and turnout was so high that there were some lags in the systems, though election officials say those have now been resolved. both nominees are working to make sure it's their supporters going out to vote for. the presidential nominees are stepping up their outreach. former president trump holding events with faith leaders and latino voters before rallying in north carolina. we're going to take care of you. we're going to work together. looking to shore up a state he's won twice. that's now in play. he went on the attack against vice president harris. she took a day off. she's got no energy at all. her speeches last for about 15 minutes. that as the vice president sat down with nbc's hallie jackson, who pressed her about the role of gender with fewer men supporting her than did president biden, regardless of someone's gender, they want to know that their president has a plan to lower cost, that their

president has a plan to secure america in the context of our position around the world. do you not see sexism as a factor in this race at all? i don't think of it that way. my challenge is the challenge of making sure i can talk with and listen to as many voters as possible and earn their vote. president barack obama, former president obama, who has suggested sexism is at play in direct appeals to men, campaigned in detroit overnight with rapper eminem. the latest celebrity harris endorsement, while the vice president acknowledged her campaign is preparing for the possibility former president trump will again declare victory before all the votes are counted. of course, this is a person, donald trump, who tried to undo the free and fair election. both nominees, looking ahead while staying focused on the final two weeks before election day. vice president harris getting a boost
6:06 am
from even more star power with bruce springsteen set to perform at upcoming rallies, while former president trump will appear on the very popular joe rogan podcast he's campaigning today in georgia, vice president harris has a town hall in pennsylvania. marcus less than two weeks, but still very busy. alice barr for us in washington this morning. alice. thank you. well, a push to recall alameda county's embattled district attorney is growing. today, pamela price's predecessor plans to endorse the recall. former alameda county district attorney nancy o'malley will make the announcement during a virtual news conference planned for 1030 this morning. you might recall in 2022, o'malley chose to seek not seek reelection after serving three terms. and a reminder we are helping you get informed about our local races. just scan that qr code there on your screen. it's going to take you to our full voter guide with info on all of those key races. 606 right now and a follow up this morning in a new blow for
6:07 am
one embattled san jose council member. the council last night stripped omar torres of his committee assignments. torres did not attend last night's council meeting. his second straight no show since word dropped of lurid allegations he may have committed sexual misconduct with a minor. the investigation is ongoing and torres has maintained his innocence. san jose mayor matt meehan called for the council to move on, saying it's time for torres to resign. i believe councilor torres is holding his seat hostage and denying representation to the 100,000 residents of district three, based on what he has said in his own words. that's reported out via the affidavit. i think he's lost the trust and respect of the community that he was elected to represent. the city charter allows for council members to be removed only after five straight unexcused absences, and torres claimed he was sick the last time around.
6:08 am
the only other way members can be removed is through a recall election, and that move would be up to voters in an upcoming san jose state volleyball match is being moved out of nevada. it's due to concerns over players well-being. san jose state university is supposed to take on nevada in reno on saturday, but the match will be played at the university in san jose. the university says the decision was made in the best interest of both programs and the well-being of athletes, coaches and spectators. sjsu team has been facing controversy after one of its own players joined a lawsuit seeking to overturn ncaa guidelines on transgender athletes. that lawsuit outed one of san jose state university's players as transgender. 608 for you, this morning and today. san francisco 49ers head coach kyle shanahan will be in the hot seat after a brutal showing on sunday. in addition to the loss on the scoreboard, the team lost a key player and maybe even lost faith in their quarterback.
6:09 am
today in the bay's kris sanchez joins us from levi's stadium. team has had a lot of injuries as well lately, but that's certainly not all. right. and we expect to hear from coach kyle shanahan this morning. but boy those armchair quarterbacks are brutal. they are talking about the team's health. they are talking about possible trades and they are talking about brock purdy. so let's start there. sunday was definitely brock purdy's worst game of his nfl career. he threw back to back interceptions even as the niners were trying to come back against the kansas city chiefs. and although he was without his three key receivers after the game, he took the blame for all of that. still, some fans are asking if purdy can handle the pressure of games like this. matt maiocco of nbc sports bay area reminds us that purdy won for post game postseason games as the niners quarterback and has thrown six postseason touchdowns and just one interception. all that said, of
6:10 am
course, purdy did not play well sunday against the kansas city chiefs. it was his worst game in 34 nfl starts, but there is also zero question that moving forward for the rest of this season and into the foreseeable future. purdy is part of the solution, and he has rarely been part of the problem. we expect coach shanahan will answer questions also about possible trades to fill brandon aiyuk's void as he recovers from that really brutally hard to watch acl and mcl injury he suffered on sunday. then there's the question of deebo samuel and the pneumonia that sent him to the hospital, and how soon he might be back on the field. now, fans will be looking for coach shanahan to kind of flesh out what the team is going to look like, come sunday when the niners take on the cowboys. and of course, if you are an armchair quarterback, you can join the rest of the armchair quarterback squad. you can listen to 49ers talk podcast, where you listen. definitely
6:11 am
looking forward to the game on sunday, hoping for a different outcome in santa clara at levi's stadium. kris sanchez today in the bay a win. we'll take a win. all right. thanks, chris. i win, i win. and maybe you're lucky enough to head out to the game on sunday. if not, you can watch it right here on nbc bay area. and the weather is shaping up to be pretty nice for the game on sunday. let's check out our forecast if you're planning ahead. kickoff at 520. it's going to be 72 degrees. a lot of clouds overhead but cooling down. and look at that wind coming in from the northwest at about 10 to 15mph. so you want to make sure you're wearing the layers as those temperatures cool off late on sunday evening. we know we have to get through the weekend. we have temperatures today that will be slightly warmer for the afternoon. we're headed for 79 in novato, 71 in san francisco and 75 in hayward. today, while in livermore, 79 degrees and mid 80s for gilroy. and tomorrow we're also going to see a bit of
6:12 am
the warmer than normal temperatures across the bay, but still really comfortable. and by friday we're seeing a few more of those low 80s for the inland valleys. while most of the inner bay and the coast will be in the low 70s. we'll get a look ahead to the weekend coming up in a few minutes. mike has a look at lower gas prices around the bay. yeah. kari we're going to start in livermore. they had the low last week. they also have it today or yesterday. they also have it today a little bit to the south across the freeway. we're looking at down a dime, nearly a dime at least to three. 79 at dimond gas and maher on south front road. the best in the south bay. next price is 399 here. same as we've been holding for about a week. we'll point out cupertino's great gas on north deanza boulevard. the bottom number is our top price. jumping up to solano county jumps up to 4.15. we're looking at fairfield bond fair on walters road. you can check your area. get those updates. gasbuddy.com on the roadways. let's update your commute. things are getting a little more

crowded in the south bay. north 87. the crash is at curtner and so we're watching as lanes do clear in a bit, but crews are still arriving on scene. north 101 at mckee. it looks like the activity may be in the center divide and on the shoulder. so distractions there. vasco road, you're over the half hour drive out of contra costa county to 580. back to you. thank you. mike. 612 this morning and more and more vacation homes are sitting empty in tahoe next year. the crucial measure set to go before the south bay tahoe voters and the impact it could have on your next booking on vacation there. and we'll drop the dime on how to save $0.10 on mike's gasoline. it's getting even cheaper out to the futures this morning. let's take a look at those numbers. it is going to be a tough day on the dow. tiktok going crazy for milk. and it's all thanks to a north bay creamery. we're going to introduce you to the company, as well as the tiktoker, which helped spark the milk tock craze. you're watching today in the bay.

fall in the number of its customers. mcdonald's stock, of course, will be under huge pressure after e coli poisonings were linked to quarter pounders in several states. the cdc says it could be the meat, but it could be the onions as well. there's a huge frozen waffle recall kodiak betty crocker among the brands. they're all made by a company called treehouse foods. there's a risk of listeria. the list is so long, i really can't read it here. but if you have a box of frozen waffles, give them a google. big news from amazon. this morning. it's going to introduce prime gas that's going to let prime customers save $0.10 a gallon at bp amoco and ampm gas stations. amazon plans to add discounted electrical charging at bp stations as well. tesla reports profits after the closing bell. this is going to be the first time experts can grill elon musk about his actual plans for a robotaxi, instead of
6:18 am
the vague pie in the sky promises, he made during that event earlier this month. actual concrete plans if musk cannot provide that, expect tesla stock to feel a lot of pressure. meta has suspended accounts on its threads and instagram apps that track airplanes. twitter had done this as well. they're all worried about one user who publishes the locations of planes belonging to elon musk and mark zuckerberg. taylor swift as well. there's nothing illegal about tracking a plane, by the way. it's all publicly available. government information. all you would need to do to track elon musk's plane, for instance, is to know the tail number end 628. yes. speaking of airplanes, american airlines passengers report they've seen a change at the gate, with ticket scanners now making a noise. if somebody in group seven tries to get on board with group three. airline employees call those people gate

lice because they hang around the front of the ticket area, even though they're not going to board for several groups later. gate agents are supposed to turn people away who cut in line, but they don't always check the ticket. and you know, you paid extra to get on first. you ought to be not cut in line. what i'm amazed by is that i'm not a group four, but you know, you stand there and then they call group four and all the people in line. you're like, are you, are you? they're like, no, go ahead, no. go ahead. i'm like, sit down. right. we're all going the same place and you're getting on last. and unless it's like one of the airlines where you can sit anywhere, it really doesn't matter for me anyway. it just doesn't matter. it matters when you have kids and little kids that you want to be together. yes, that matters, but we all know the voice of a mom chiming in. thanks, scott. you bet. well, new at 6:00 on election day, voters in south lake tahoe will decide if homes sitting vacant most of the time should face increased taxes. measure n is a vacancy tax for homes that
6:20 am
sit unoccupied for more than half the year. supporters believe it may ease the housing crisis by opening up more rentals. others call it unfair to the owners of second homes. some of the people we've talked to say, you know, if that's the way you want to treat me as a second homeowner in your community, i'm going to sell my home and i'm going to go somewhere where i feel more welcome. we still believe they're a valuable part of our community. there's just a cost to having almost half of all homes sitting unoccupied for the majority of the year. measure n does not mandate consistent occupancy. that means it can be a combination of owners, renters and guests living there over the course of the year. well, trending this morning in north bay dairy company is now going viral over its whole milk. so this all started when a san francisco based content creator and dairy fan, peggy xu, bought a bottle of whole milk from the petaluma based strauss family creamery. take a look, belen.
6:21 am
ooh! let's go. that looks so good. cheers. okay, so you saw right there she ate the solid cream top of the milk with a spoon, which caused a stir on tiktok. that video got more than 2 million views because of the viral video. xu actually got a tour of the strauss family creamery and according to the press democrat, strauss has been actually getting calls from people all over the world wanting to buy their milk. but it's only sold on the west coast. it also had to reassure people that their milk is pasteurized and safe to consume. i grew up my grandparents owned a dairy in the central valley. so let me tell you, i never had the cream on the top. that's why i'm. no, no. that's why you're so good at the. you won those milk milking contests. yeah, yeah, yeah, yeah. they had automated. but the cream on the

top is like. it's so delectable. is it. it's amazing because when i looked and i saw your face too. i looked at you guys too. your faces were. no, it was amazing. it reminds me of my childhood. i had that face too. but i'm like, who doesn't know that? that's how milk comes. but i guess. well, yeah, everybody's as old as me and had heard stories about it. if i saw that, i'd be like, oh, it's time to throw it out, you know? but, you know, cream rises to the top. that's right. you heard that phrase. look at me. yes. well, the tall can reach the top. this is true. well, it really is like it shows the power of tiktok, too. because, like, if i'd seen that, i'd be like, well, now i want to try it. you know? and. exactly. for all of the newbies out there. so support your local dairy. pick you up a bottle. all right. feeling like fall in the air this morning? yeah. so you want to put a little cream pumpkin spice in your coffee? that's all. kari personal. now, i've never seen a cow deliver that. you know, we'll have to find some. it'll be in the upper 40s as you're heading out. san

today. you may notice it's a little bit warmer for the middle of the afternoon in oakland today we're looking at a high of 73 degrees and 72 in san mateo and palo alto. in the mid 70s and san francisco today, in the low 70s, while in the north bay, we're looking at some low 80s. and going ahead into the forecast. we'll see several more cold fronts coming in. so we're expecting next week's temperatures to be much cooler. mike, you're tracking a hazard on the nimitz. yeah. this is adding to some slowing southbound 880. but it's actually not that bad. from 238 down to the san mateo bridge, we expect to see slowing there, but i think one lane may be affected by that. the rest of the bay shows a smooth drive. earlier crashes in san jose should be in clearing stages. we've g more news, trafotfi

back just flooded a bunch of cars and we just got some eye opening data about them. carfax, the vehicle history company, estimates that an astounding 138,000 cars flooded during hurricane helene. hurricane milton will drive that number even higher. here's the problem shady used car traders will reliably polish up some of those flooded cars and try to offload them out of state in places like sunny california. carfax says you do not want to buy a car that was in a flood. even a

little bit of water damage can lead to electrical issues. it's really a ticking time bomb, and then fixing those electrical issues will be very costly as well. on top of that, m warns that flooded cars are prone to mold. that's a whole other headache. carfax suggests extra scrutiny if you're buying a used car right now, especially if the vehicle history shows that car recently shipped west from the southeast. ideally, hire an independent mechanic to inspect the car. we made a video showing you the telltale signs of a flooded car and to how spot them, like foggy headlights and brake lights. you can watch that video on our website, our streaming channels, and our youtube page. just look for the how to playlist. thanks so much, chris. well, we've got a lot more ahead at 630, including another bay area superintendent stepping down. the reason for his sudden exit

the splash brothers, the newcomers stepping up on the court alongside greats like steph curry and draymond green. this is today in the bay. good wednesday morning to you. thanks for starting your day with us. i'm laura garcia. and i'm marcus washington. let's get a look at that forecast this morning. meteorologist kari hall has been tracking those temperatures across the bay area. beautiful start to the morning there in san jose. nice and clear, but it is chilly, so we have a bit of a more of a chill in the air as you're heading out, but it will actually be a warmer afternoon. so we're going to see a big range in our temperatures right now. starting out in the low 50s at 1:00. we're in the mid 70s and headed for the upper 70s for later today and in concord today we're back into the low 80s. 80 in napa and san francisco will reach a high of 71, slightly warmer than normal. temperatures continue through the end of the week, and we'll get a look ahead to the weekend coming up in a few minutes. laura. sounds good. we'll check back with you. well, we're following this breaking news. this morning. the u.s. confirming north korea is

sending troops to russia. defense secretary lloyd austin says there's evidence showing those troops were sent on monday. south korean leaders also say 3000 north korean troops are receiving training on drones and other equipment before being deployed to battlefields in ukraine. austin also said it would be a serious issue if north korea's intention is to participate in this war on russia's behalf. with less than two weeks to go until the election, one of the people who knows donald trump best sat down with the new york times, scott mcgrew joins us now. john kelly was trump's chief of staff. his right hand man for nearly a third of trump's presidency. that's right. trump had three chiefs of staff general kelly was july of 27 to january of 2019. he's long warned about trump, but just spoke very frankly with the new york times, saying if trump wins, he will likely rule like a dictator, and that trump met the definition of
6:34 am
a fascist as well as reconfirming. trump called american soldiers who laid down their lives losers and suckers, kelly said. recent comments from trump that he would use the u.s. military against american civilians was so disturbing he had to speak out. kelly is one of former several trump officials to speak out. he's a former marine four star general, served as secretary of homeland security as well. trump's former defense secretary mark esper, his former national security adviser john bolton, his former military chairman of the joint chiefs of staff, milley. they've all warned about another trump presidency for that matter. so, too has vice president mike pence. president biden was campaigning in new hampshire, said trump should be locked up. that's a very unusual it's an improper thing for a president to say presidents should stay out of criminal cases. biden immediately tried to take it back. i mean, so i know this sounds bizarre. it sounds like i

one south bay school district. the mercury news is reporting that bill sanderson will step down as superintendent for the los gatos saratoga union high school district. the plan calls for him to take leave immediately and officially resign next june, all in the wake of questions over his leadership style and decision making. board members have already approved an interim leader. the search is now on for a permanent replacement. meantime, today, the new leader in san francisco schools will join forces with mayor london breed to meet with students and answer questions about the district's future. this comes after board members monday confirmed the appointment of doctor maria su and the replacement of matt wayne, after he resigned last friday. su hopes to avoid the current plan to close some schools, all while facing a massive budget shortfall and the threat of a state takeover. amid an ongoing insurance crisis, orinda is taking steps to try to help homeowners position themselves to get their policies renewed. today, in the bay's ginger conejero, saab joins us live in
6:38 am
orinda this morning with more on the proposal for folks just trying to make it in the bay. ginger. that's right. laura. i mean, if you can't do something about the fire danger that exists, maybe you could do something about the fire risk a little bit closer to home. while also luring insurance companies to renew home policies. and that's something that the mayor here in orinda says people have really been impacted by. about one third of the 19,000 residents have have had their policies not renewed by insurance companies, and that's why the fire district is doing something about it. so officials from orinda moraga fire district are now considering a proposal that would create a new ember resistant zone, which would require homeowners to get rid of all flammable vegetation and material within five feet of their homes. now, that includes uprooting plants and grass, wood fencing, and any other combustible materials. it's also been referred to as a zone zero. now, the idea is to reduce the likelihood that embers from a
6:39 am
nearby fire would land in flammable material. consequently, then setting that on fire. orinda mayor darlene g. and says enforcing an ordinance like this might get some backlash, but there is data outside of the country that suggests it works, and it is very well researched. so it is based on actual science. it's not a it's not a theory, but it is also one that's going to be a very, very tough thing for people to accept if it's decided to be the best solution. well, speaking of that research, it suggests that ember resistant zones work best when more than 30% of homes on a block comply. this proposed ordinance would be some of the most stringent rules to protect homes from wildfire risk, with the goal of getting insurance carriers back earlier in the year. as we've reported,
6:40 am
california's largest insurer, state farm, announced that it would not renew tens of thousands of residential policies in the state and, of course, there are projections that there may be even more policies that are dropped by insurance companies. and there's actually one city that's a little bit closer to the bay area. laura, that's pushed forward with something like this south lake tahoe has gone forward with a five foot zone, something kind of similar. so we'll see how the fire district and the people of orinda react. the next fire district meeting is on november 20th. we're live in orinda. ginger conejero saab. today in the bay, a big concern for a lot of homeowners. thanks, ginger, for the latest. well, tonight the rubber finally hits the road for the golden state warriors. the team went undefeated during the preseason, but that won't matter now. tonight, the warriors tip off a new season on the road in portland. and without one popular player, klay thompson, is now in dallas instead. newcomers including buddy hield

as well as de'anthony melton, will line up alongside steph curry and draymond green. the team actually hosting a viewing party tonight outside chase center. for fans who want to brave that little fall chill in the air out there but still root on the team, right. they're going to have to generate some energy and some warmth. it's going to be kind of cool out there this evening, and we're at 63 degrees at the time that that watch party begins outside of chase center. you add in those breezy winds and it will probably feel more like the mid 50s out there. so we're going to have those temperatures dipping as we go into tonight. make sure you're dressed in layers. but it's going to be lots of fun excited about the start of basketball season. now we're also going to see in walnut creek a little bit of a clear start, chilly temperatures, and we're at 50 degrees right now. as you're heading out the door. may be even cooler than yesterday. and as we go throughout the morning, a nice gradual warm up. upper 60s at 11:00 and we're headed for the mid seconds for today. a
