trial is now one of the many cases that could face delays. as soon as i sent it out, the group started responding. i don't have my ballot either. i don't have my ballot either. a mail truck targeted by thieves in berkeley and many voters are still without their mail in ballots as a result, the way local postal leaders are responding to another reported mail theft. all of this happening with less than two weeks to go until election day, former president trump's chief of staff has some harsh words about his former boss. the way vice president harris is responding this morning, this is today in the bay. and this is also thursday morning. thanks for starting your day with us at 5:00. right now i'm laura garcia and i'm marcus washington. let's get you out the door with a look at that forecast this morning. meteorologist kari hall is tracking what we can expect outside today. another cool start. yes. so before you do, step out the door, you want to grab a jacket? it's going to be a chilly start. and in san jose
5:02 am
we're now at 56 degrees 59 in san mateo and in walnut creek and in san francisco, we're at 53 degrees. a light wind for the most part, and we are going to see those temperatures back into the upper 70s and low 80s again today. and some of those low 80s will be in the south county, while much of the rest of the bay area is going to have a really comfortable day, tomorrow may be a degree or two higher compared to today, but overall, we're still looking at some nice conditions with a cool morning start and a nice and pleasantly warm afternoon that continues into your saturday. but then after that, things change. we'll talk about that and what's ahead in the full microclimate forecast. back to you. sounds good. we'll check in with you in just a bit. well, in just a few hours. court clerks in san francisco are preparing to strike, and that means a probable delay in a high profile murder trial today in the bay's thom jensen joins us live in san francisco. this morning. and, tom, the nima momeni trial could
5:03 am
be actually delayed, along with a lot of other court proceeding. right. that's right. and it's all because of the court clerks walking off the job. probably they say they're going to later today unless something happens in just the next couple of hours before the courts open. the union says that court management refuses to bargain in good faith over issues like staffing levels, hiring and training. they say it's already caused a backlog in cases and errors in some cases. now, 200 court clerks, members of the service, employees international union local 1021 say they will picket outside the courthouse beginning this morning at 830. they'll be outside the hall of justice on bryant street here in san francisco. these are workers who cover everything from juvenile to civil and criminal courts in the city. and that means everything from traffic violations to divorces, even murder trials like the nima momeni trial can't move forward. they say, without the support of these workers. and this comes at a crucial time in the trial of

this. but you have to wonder what this might do. and if this could cause any sorts of changes in the outcome of this. in this case, due to these delays. if this strike does move forward, it's set to start in just about three hours. now, back to you in the studio. all right. we'll continue to follow what could happen out there. thank you very much, tom. well, now to decision 2024. one day after former president donald trump's former chief of staff called him a fascist. vice president kamala harris is echoing those same sentiments. trump now hitting back today in the bays. alice barr joining us live from washington this morning. and alice, both campaigns, they're really working hard to gain support from just the final few undecided voters out there. that is certainly the name of the game here in this final stretch. and as the nominees battle to the finish line, these comments from a former trump staffer are roiling the race in the final stretch this morning, both

presidential nominees responding to new comments from former president trump's one time chief of staff, john kelly, telling the new york times his old boss is certainly an authoritarian and admires people who are dictators. he has said that. so he certainly falls into the into the general definition of fascist, for sure. let me ask you tonight, do you think donald trump is a fascist? yes, i do, yes i do, and i and i also believe that the people who know him best on this subject should be trusted. the retired four star general also claiming the former president, said complimentary things about nazi leader adolf hitler. he commented more than once that, you know, the hitler did some good things too. it is deeply troubling and incredibly dangerous that donald trump would invoke adolf hitler. former president trump firing back on social media accusing vice president harris of going
5:07 am
so far as to call me adolf hitler because he says she's losing and calling her a threat to democracy. also accusing john kelly of making up a story out of pure trump derangement syndrome. hatred. the trump campaign calling the kelly stories debunked and fabricated, while the former president campaigned in battleground georgia, encouraging christians to vote in a faith based town hall. we've really energized a lot of people this time because they've seen how bad it is. this last four years has been it's been a horror show. before talking immigration at a rally as the nominees make their final push. former president trump rallies today in arizona and nevada. vice president harris in georgia, alongside former president obama and bruce springsteen. and we're learning from a senior campaign official that the vice president is preparing for a closing argument speech on tuesday at the site where former president trump spoke directly before the

5:09 am
of his constituents now question whether he can effectively do his job. there's nobody representing the district. you know, and i don't you know, it's hard to say whether what kind of votes are going on that that we're not being represented right now. we need representation for district three. and i definitely believe that he. mister omar torres cannot represent us. the council will still have to approve his request. and it's not clear if that will happen this week. they stripped him of his committee assignments and called for him to resign. people in one east bay neighborhood who never received mail-in ballots are now learning a possible reason why it was likely part of a stolen mail haul for voters who live in berkeley area. this is near ashby and king say that mail in ballots never arrived for the upcoming election, and they recently learned about a theft involving their mail carrier, the local postal inspector confirming the theft, telling us
5:10 am
that it happened on october 9th when the carrier got back to the truck, saw that it had been broken into, and that some of the letter mail had been taken, taken out of the out of the truck. berkeley police confirming some of those ballots and other election materials were actually found inside that truck when they investigated in just a few hours. governor gavin newsom will host a virtual press conference to provide an update on the state's efforts to crack down on crime. the meeting starts at 1130 this morning. we'll follow the story and, of course, bring you updates on the progress of the crime crackdown. we'll talk about an accelerated learning curve. 49ers rookie ricky pearsall is now in the thick of it. just one game into his nfl career. big reason why injuries to the team's front line receivers when the niners host the cowboys sunday. it's not clear if deebo samuel will be back from his bout with pneumonia. jauan jennings is still nursing an injured hip, and perhaps the most crushing news of all, brandon aiyuk is now done for the season, but
5:11 am
pearsall says he's ready for the challenge. it hurt my heart to see him go down, but, you know, that's kind of what comes along with football. and so now we've got a lot of rookies that need to step up, including myself. so you know we're excited to do that. jennings may be available sunday and head coach kyle shanahan is not ruling out samuel's return. and don't forget sunday's game airs right here on nbc. bay area starting with a special pregame newscast from levi's at 3 p.m. and kickoff is at 530. immediately following the game, watch a special edition of sports sunday live from levi's. should be fun. meteorologist kari hall also tracking that game day forecast. and if you are going to be going, you want to make sure that you have lots of layers on. it will be kind of cool to start and temperatures in the low 70s, but we won't have much sunshine. there will be a mix of sun and clouds, and even a chance of some spotty drizzle throughout the game, and we'll be dropping down to about 64 degrees by the fourth quarter and mostly cloudy. we're watching this

system moving in, and this may bring about some change by the end of the weekend, so i'll have more on that coming up in a few minutes. mike's been watching gas prices and they've been holding steady in some cases around my house. i've seen a couple of drops in the last week. we're going to start, though, with contra costa county today. their low of 3.89 now showing up in richmond. quick serve on a quick service station on carlson boulevard. that's just off the east shore freeway. a south bay still stuck at 3.99 in the middle here. san jose shines brightly with diamond gas and market on winchester boulevard. this morning. and in san mateo county, the only station with their low price of 419. it's elite gas and mart on marsh road in menlo park. we spread our prices around the bay. you check around the bay with gasbuddy.com on the roadways. we have green sensors around and across the bay. we'll look at north 680, still have a crew heading through pleasanton. there may be more slowing over the next half hour. back to you. all right. thanks, mike. 512 right now, hundreds of tech jobs
5:13 am
are set to be cut just ahead on today in the bay. the new details just coming in about major layoffs here in silicon valley. and we've been promised air taxis since what, the jetsons. well, one step closer. and this was the big step. real close. and take a look at your screen right here okay. so we know the world series is happening. but some furry fans are really hoping that the dodgers make a big splash in the world series. the way dog owners are having their canine companions show out ahead of game one tomorrow. keep it right here. much more ahead
5:16 am
are going to be in the low 50s around sunrise and nice and clear, and we continue with sunshine today as our highs head for the mid to upper 70s. another really nice day and we'll see this continue at least into the early part of the weekend. we'll talk about changes ahead coming up in a few minutes. and across the bay while you're crossing the bay, those tail lights away from us. that's northbound. the cones have cleared from that portion of the roadway. saw that happen over the last half hour. should be clear from the northbound side. but heading into the city, there may be some more slowing as crews clear from the marin county side over the next few minutes. we'll track. well, good morning. very happy thursday to you. a lot of red on the markets yesterday boeing aircrafts

mechanics turned down a contract offer. mcdonald's will talk more about them in a second, but you can see that stock tesla absolutely caught everybody off guard with much better than expected quarterly financial report. it's making more money per car. it's making a lot of money off carbon credits because tesla doesn't make any cars that pollute. so it can sell its carbon credits to automakers like ford that do. this has been very important to tesla's income. $739 million in just the last three months alone. the department of justice, meantime, has warned tesla ceo elon musk his million dollar a day handouts to some of the people who signed his petitions in battleground states could break election rules. musk's pro-trump pac picks a random person every day. federal law prohibits paying somebody to vote. musk says he's not doing that. 23 nobel prize winning economists have signed a letter supporting kamala harris's economic plan,
5:18 am
saying it would lead to, quote, economic growth that is more robust, more sustainable, more equitable. that same letter predicts trump's plan to add tariffs to all imported products would lead to higher costs for american families. other economists have reached that same conclusion. the cdc is leaning towards the onions as the culprit in the e coli poisoning of customers who ordered a quarter pounder at mcdonald's. the agency and the restaurant chain say the beef came from various suppliers, but the onions from just one supplier. ten people have been hospitalized, none in california, and the consumer financial protection bureau has fined apple and goldman sachs, $89 million for misleading customers about the apple card, the agency says apple didn't pass customer complaints about incorrect charges to the bank, and that consumers were misled about interest free charges. apple says it disagrees, but will pay. and the faa has

finalized rules around air taxis and air taxi pilot training. bottom line this was the last big step before we can have air taxis. this is the bay area's joby flying around, so we ought to go out there and try it. i've signed us up, marcus. we're doing it in alphabetical order according to last name. i figured you'd be okay with that. so we're going from the bottom to the top. no no no no, we'll we'll end with you. and, you know, we'll just start with whoever's letter starts first, okay? what do you think you. i was like, yeah. you. when are you going to eat guinea pigs. go first. you go first. garcia. good luck. thank you. tell us all about it i will. well, new details this morning on the first layoffs. just announced over the summer by silicon valley giant intel. you may have heard about them earlier. we told you about it when the chip maker revealed plans to slash 15% of its global workforce, or 15,000 jobs globally. recent regulatory filings, or so-called
5:20 am
warn notices, indicate it includes nearly 1000 positions right here in silicon valley. some of those cuts are still being finalized. also, some of the impacted workers are being moved into other positions. 519 right now and trending this morning as the la dodgers get ready for the world series. so are those fans? yeah, the dodger diehards are really having fun with their fur babies because they are getting them all decked out in that dodger blue. so dog groomer services around southern california, they're actually getting those requests from pet parents to turn their pooches into dodger dogs. with pup safe dye, of course. right. so the color of their fur is turned into a shade of blue for the team. one woman who actually made her dog george, a dodger dog, hopes that he'll actually bring them some good luck. i won't say they're going to win solely because of george, but i'm sure he's going to have a hand in it. big part of it, i'm sure. george, game one of the world series starts tomorrow. dodgers will face off against
5:21 am
the yankees. wow, dodger, that is a true dodger dog right there. cute to taking a dog for a walk this morning. yeah, it's going to be chilly. so you do want to start out with a jacket for you and your pup. and then we're going to see those temperatures warming up as we go throughout the day. let's get a live look outside in dublin with all of the commuters heading across 580 and into much of the rest of the bay area through the east bay, we're seeing temperatures in the upper 40s and low 50s to get started, we're at 43. in sonoma, 45 in santa rosa. those are some of our cooler spots. we're at 55 in san francisco, and it's 56 in san jose and 62 in fremont. so as we take a look at the way we're starting and then our afternoon highs, big range in temperatures once again. so we've had these very cool mornings and mild afternoons. and we're headed for 76 in cupertino. but then it's going to be warmer in gilroy, a high of 84 degrees. looking at mostly some upper 70s for the east bay.
5:22 am
danville today, 78 degrees, also 78, in fremont. and it's going to be a really nice day for the coastline with half moon bay in the low 70s and mid 70s for redwood city and san francisco. we're also headed for the mid 70s downtown, while the outer sunset will be in the low 60s and 73 that high in mill valley today. santa rosa up to about 80 degrees. we're going to set this into repeat for tomorrow as well as saturday, but then we'll be watching a system approaching from the north that could bring in a lot of rain for far northern california. by the time it gets to the bay area, the system is kind of falling apart with the wet weather, but still may bring in a slight chance of rain, mainly for the north bay. and we'll be seeing this coming in starting on sunday morning into the afternoon. and then tapering off. but we're not, unfortunately expecting a lot of rain here. would be nice if we could get a nice little downpour, but it looks like a few hundredths of an inch of rain with cooler temperatures to

follow. we are going to see 60s in our forecast for highs for much of next week. mike, you have a nice view of the bay bridge. i do from emeryville. we're looking over here towards san francisco. i always love it when the reflection of the lights off the water and the traffic, which is what i really focus on, is moving very smoothly. great spacing, westbound and no backup yet at the toll plaza. still too early. we're looking at 522 now, so in about 20 minutes we should see some slowing on the incline. we'll watch for that. meanwhile, the overnight construction not happening on south 242 like it was the last couple of days. the bill for highway four and 37 right on schedule. the rest of the bay moves very smoothly. back to you. thanks, mike. 522 this morning next here on today in the bay nbc bay area responds. he's stuck with a broken fridge under warranty, but has no idea when the manufacturer will actually fix it. i'm consumer investigator

well, he says lg scheduled the tech a few times, but canceled every visit after eight weeks of zero updates. jim pinged us. our team contacted lg. it didn't comment, but it sent jim $1,802. that is a prorated refund. and jim is happy with that. this year we've done a few stories that have gone viral about fridge failures and an icy reception to repair requests. well, if you have a case to share, snap the qr code on screen right now to fill out our consumer complaint form online. thanks, chris. well, coming up next, the top stories we're following for you today, including paying more than $10 to cross the bay bridge. it is possible under a new proposal, the major toll increase now under consideration. and i'm kris sanchez. my story today is about sideshows on two fronts. one, how the chp surge in

to the other. the debate now getting underway on that proposal and eat much stronger words coming out of kamala harris about donald trump. we'll have the latest from the campaign trail. this is today in the bay. good thursday morning. thanks for making us a part of your morning. i'm marcus washington, and i'm laura garcia. let's start out with a look at the forecast for this thursday morning. we're creeping ever so close to that weekend. kari. yes, it's almost here. it's about time to make some plans. and our weather is acting accordingly to all of those outdoor activities and getting out to some of the pumpkin patches. so we're starting out chilly this morning. all clear as we take a look at san jose where it's 56 degrees. we may come down a few more degrees around sunrise, and then we start to see those temperatures creeping up. by noontime. we're at 73 degrees and headed for 77 for a high. we're also going to see a lot of upper 70s for much of the rest of the bay area, but
5:32 am
we will see some changes leading into the weekend, so we'll talk more about that coming up in a few minutes. mike, you were calling out some work in concord. yes, because we've been talking about 242 coming out of concord into pleasant hill. but this morning it's the opposite direction as we look at map closer, i've circled the area of northbound 680, where the crew should be clearing. over the next 90 minutes. they may be there, but right now we do see some slowing. i think they're going to clear by about 6:00 westbound. looking at highway four, with the typical slowing into concord as well. out of bay point, highway 37 at the top of the screen, and some slowing on the incline now, but no backup at the bay bridge. we're about ten minutes before the slowdown starts to be visible here on the camera. back to you. thank you. mike. well, sideshows shut down the governor and california highway patrol celebrating a victory. this is following a chp surge in oakland and smaller cities like morgan hill are using ai to maximize their enforcement. even when they don't have enough personnel. today in the bay's kris sanchez joins us live this morning from
5:33 am
morgan, morgan hill to show us a little bit more about it. kris. well, good morning to you, marcus and laura. so there's no question that having more officers on the roads, on the streets makes a difference. and just this weekend alone in oakland, we saw that firsthand. the chp deployed 60 officers in oakland as part of a unannounced surge operation. 22 people were arrested on one day, five of them connected to sideshows. then on sunday, another 16 people were arrested at a different sideshow. now, since this four month operation started, the governor's office says that more than 300 people have been arrested and more than 600 stolen cars recovered. when we can bring more resources to the table and respond to these incidents, we have more personnel that we can utilize to either shut down sideshows as well as ultimately detain and arrest people, tow vehicles, and now, without a surge like that,
5:34 am
smaller agencies like morgan hill maximize their reach through technology, through ai and machine learning agencies like morgan hill pd can integrate existing audio detection technology like shotspotter technology with the video cameras and license plate readers they might already be using. flock safety's raven system detects the screeching of tires and then determines whether that it's a momentary sound of a car crash or the sustained screeching of a sideshow, then that notifies officers while also starting to gather evidence. it actually triggers the cameras to capture vehicle evidence at the scene. law enforcement can then see all of this evidence together and piece together a case, so it gives them that additional situational awareness. because sideshow detection can be deployed in an area as small as a quarter mile, smaller departments like morgan hill, medium departments like vallejo can use it, but it's also in use in large departments like san
5:35 am
jose and san francisco. and in fact, because of a state grant, the chp and oakland pd, they are using it as well so that will be something that might be more critical as the chp operation in oakland comes to an end next month in morgan hill. kris sanchez today in the bay. all right. thank you, kris. 534 right now, vice president kamala harris not mincing words these days about donald trump scott mcgrew is here right now. and scott, she called him a fascist and last night's town hall on cnn, this is coming from the vice president. good morning. the vice president of the united states. and that comes after trump's former chief of staff once again warned trump would act as a dictator. here's harris last night. do you think donald trump is a fascist? yes i do, yes, i do. and i and i also believe that the people who know him best on this subject should be trusted. she's talking about
5:36 am
john kelly and mike pence, and mark esper and john bolton and rex tillerson, but mostly kelly, who you will remember, told the new york times trump was not fit for president. the former four star marine general also discussing trump's apparent admiration for german generals of the second world war and their allegiance to hitler. here's audio of that conversation with the new york times commented more than once that you know, hitler did some good things too. well, i tell him that i said, you know, it's very easy if you first of all, you should never say that nothing you did, you could argue was good. it is deeply troubling and incredibly dangerous that donald trump would invoke adolf hitler, the man who was responsible for the deaths of 6 million jews and hundreds of thousands of americans. meantime, donald trump was in the battleground state of georgia, speaking before a town hall and later, at this turning

point rally together, we're going to fix our nation and we're going to fix our nation fast. with your support on november 5th, america will be bigger, better, bolder, richer, safer, and stronger than ever before. now, there are a lot of clips from that turning point rally you just saw on social media this morning. but they're not trump clips, they're tucker carlson, who was introducing trump at the rally and comparing him to a dad who had come home from work to be met by unruly children. and when dad gets home, you know what he says you've been a bad girl, you've been a bad little girl, and you're getting a vigorous spanking right now. and no, it's not going to hurt me more than it hurts you. no it's not. i'm not going to lie. it's going to hurt you a lot more than it hurts me. and you earned this. you're getting a vigorous spanking because you've been a bad girl. opinions still split.

the latest wall street journal poll shows nationwide trump slightly ahead of harris. but within that two point margin of error marcus all right scott thank you. well with early voting already underway, we're helping you get informed about our local races if you haven't already voted. so all you have to do is scan that qr code there on the screen. it will take you to our full voter guide with information on all the key race. things are getting heated inside and outside the courtroom in the murder trial of nima momeni. he is the man accused of fatally stabbing cash app founder bob lee in san francisco yesterday. the defense wrapped up its cross-examination of mohini's sister, kathy vara, which included her firing off accusations prosecutors were trying to intimidate her and get her to lie under oath. later, outside the courtroom, lee's widow used expletives to slam azar's testimony. and because so much of it surrounded drug use, lack of sleep and memory lapses, legal expert stephen clark
5:39 am
believes it may not add much to support either side's argument. it will be difficult for this jury to unpack kisara's testimony, because it's not likely that they'll pick and choose what they want to believe. they may disregard the entire testimony, and that's something the prosecutors may argue later. in the meantime, san francisco court clerks this morning are planning to go on strike. it's not yet clear if the trial will be impacted. the trial is still on today's docket. our thom jensen is at the courthouse this morning. he'll have a live strike update in our next half hour. and of course, our entire team will continue to follow the twists, turns and testimony in this case until there is a verdict you can get complete coverage on the case on our homepage nbcbayarea.com. 539 for you this morning, as you see right here behind me, this is the bay bridge, looking nice and smooth. traffic moving along. but if you thought transit leaders were

done with their plans to raise bay area bridge tolls, well. think again. the toll authority now unveiling a new proposal to phase in a series of hikes over five years starting in 2026, at which point fastrak users would pay $8.50 for all bridges, including the golden gate. tolls would then increase by $0.50 each year over the following four years, meaning that the toll would be $10.50 in the year of 2030. drivers without fastrak will pay slightly more before the final decision is made. a series of public hearings will be held. the exact decision day is not yet known. it is 539 taking a peek outside, overlooking downtown san jose, waiting for the sun's arrival. certainly that feeling of fall finally in the air. kari got a peek at our weekend forecast for us. yes, and because we only have a few more days until halloween, this is the last week. last weekend before halloween, you have to head out to those family pumpkin patches and farms out there. if you're going to brentwood, it's going

to be in the low 80s on saturday, so a little warm during the middle of the day with those costumes, but cooling down nicely in the evening. and it will be slightly cooler on sunday with a high of 73 degrees. this is also a good time of year to head to the beach. we will see temperatures in the upper 60s and low 70s, but then by sunday, especially in the north bay and along the coast, we may see a little bit of some light rain coming in. so that may be the forecast for stinson beach. if you're going to tahoe this weekend, it's going to be cool. highs in the mid 60s, but watching out for that rain as you're heading back to the bay area on sunday. mike, you can see that backup at the bay bridge now. right on schedule just as we predicted. you can now see the backup as the lines approach the bay bridge toll plaza and more slowing shows up on our sensors as you hit the incline queued. because of the slowing into san francisco that's typically when we see those metering lights turned on and the visible backup a little slowing through richmond, but no other major surprises as traffic starts to continue and build through contra costa county. the rest of

the bay shows a nice smooth drive, including san jose, where we see that predictable northbound 101 slowing right on schedule. heading up toward oakland road from about two 8680. a note downtown san jose disney starts there. disney on ice show now through the weekend, so watch the area right around sap center. we know this is also coming to san jose. more crowds here and daytime closures continue around saratoga. highway nine, redwood gulch. watch that area back to you. thanks, mike. 541 right now, a man is murdered half a century ago in miami, and now investigators are zeroing in on the bay area for additional clues to try to crack the case. ahead on today in the bay. the new plea they're making and the faithful faithfully helping our climate in crisis with one project, the addition to levi's, which are assisting in a garden of energy solutions. plus, i'm wilk at five. i will survive after nearly 60 years in the music game, the grateful dead
