"i'm ready to deliver that change on day one." mark farrell. a proven leader with the experience we need. clerks in san francisco prepare to walk off the job. the demands they're making as a high profile murder trial could now face delays. plus, a new request in the case of an embattled san jose councilman accused of sexual misconduct with a minor. the plea he's now making to his own peers, who are actually calling for his job. do you

think donald trump is a fascist? yes, i do. yes, i do. harsh word for former president trump this coming after his own former chief of staff issues a public warning to voters as the election nears closer and closer. this is today in the ba. and here we go. thursday mornin, 6:00 right now. thanks for starting your day with us. i'm laura garcia. and i'm marcus washington. we're going to get a look at that commute with mike coming up in just a bit. but first let's talk about that forecast this morning. cold starts will bring the jackets. yeah. once again it starts out cold but then it shapes up to be a nice day. we're going to see that once again. it's basically a repeat of yesterday's weather. a live look outside in san francisco and a look at what to expect today. we're going from upper 50s at 9:00 to seeing lots of sunshine today, and we're headed for the low 70s here with a breezy wind that will continue. so we're looking at highs in the upper 70s for much of the north bay. napa today 77,
6:02 am
also about 77, in martinez and 77 in san jose. and low 80s for the south county. tomorrow it's slightly warmer for parts of the tri-valley and the south county, but overall we're still in the seconds and it looks really nice. our saturday is also going to be warm with some cooler changes ahead for sunday. i'll talk more about that in a few minutes. but mike, you're hearing about a new crash now in oakland. i am kari we're looking from the coliseum northbound with these taillights heading up toward fifth. that's in downtown. that's where the crash is reported. no slowing here for to show up. we'll have to see quite a bit of backup. the crash just north of the coliseum. coliseum down in this area. so we'll track carefully. so far, there are no build on the sensors. the crash we talked about over off the bay bridge and off of the maze is actually off of the freeway. it's on city streets. no major concern for the morning commute on the east shore freeway, which is building pretty, pretty much predictably through the area we're holding. with the slowdown toward the richmond bridge. no incidents reported, but the eastern
6:03 am
direction is also showing some slower drives. we'll check it out. back to you. thank you. mike. well, happening now. 200 court clerks in san francisco walking off the job and going on strike. now, this is going on and going to put the brakes on all court cases, everything from traffic violations to divorces, even a high profile murder trial. today in the bay's thom jensen joins us live in san francisco this morning. and, tom, this strike means the nima momeni trial could also be delayed. good morning. marcus and laura. yeah, everything could be delayed at least for a while. the union members, we were able to talk to them just in the last half hour, and they told us the courts will likely try to move ahead as best they can. but with all of the court clerks in the union going on strike, it will be very difficult. the union says that court management is not bargaining in good faith when it comes to staffing levels, hiring and training. it's caused backlogs in cases and even a lot of errors in some cases. they
6:04 am
say. and you're right, 200 of them are planning to picket members of the service employees international union local 1021 say they will picket outside the hall of justice beginning at 830 this morning on bryant street. these workers cover everything from juvenile to civil and criminal court cases in the city and even murder trials like the nima momeni trial could be delayed and might not even move forward without the support of these workers. departments, including the trial department, where many trials are happening right now. i guess the managers will do the best they can to try to make the courts function at a bare minimum, but stuff will get delayed and stuff will slow down and if this does come at a crucial time in the murder trial of alemany, who is accused of killing cashapp founder bob lee in her fourth day of testimony, prosecutors pushed sister casar about memory lapses over some issues, saying that she
6:05 am
remembered quite a bit more when her brother's lawyers questioned her. they're chipping away at her credibility and it will be difficult for this jury to unpack, cazares testimony because it's not likely that they'll pick and choose what they want to believe. they may disregard the entire testimony, and that's something the prosecutors may argue later, the defense said. kazama. many may have remembered more during her direct examination because they provided her with specific texts and phone records to help jar her memory. but she's also accused prosecutors of trying to intimidate her and trying to get her to lie under oath. a lot of conflicting images and pictures being presented by both the prosecution and the defense. a lot of spider webs to untangle here for any jury. and you have to wonder, this is a one day strike that's planned right now. but the union says it could be prolonged. they plan to go back tomorrow, but if the court management doesn't come back in
6:06 am
good faith, they say this could be a prolonged strike. and you have to wonder how that might affect the outcome in a trial like this and others moving forward. we're live in san francisco. thom jensen today in the bay. a prolonged strike would certainly shake things up there. all right, tom, thank you. 605. now to a live look at the state capitol in sacramento, where in just a few hours, governor gavin newsom will host a virtual press conference to provide an update on the state's efforts to crack down on crime. the meeting starts at 1130 this morning. we'll, of course, continue to follow this story, bring you updates on the progress of the crime crackdown. another surprise twist in a case that is rocking san jose city hall. embattled councilman omar torres is now asking for a leave of absence through november 5th, in the wake of an ongoing investigation. he is battling allegations he may have committed sexual misconduct with a minor claims he vigorously denies. but he's also been a no

show ever since. word of that investigation got out and he's missed the past two council meetings. new video from torres, obtained by now asking for contd leave following a doctor's and citing his mental health. some of his constituents now question whether he can effectively do his job. there's nobody representing the district, you know, and i don't you know, it's hard to say whether what kind of votes are going on that that we're not being represented right now. we need representation for district three. and i definitely believe that he, mr. omar thomas, cannot represent us. the council will still have to approve his request. it's not clear if that will happen this week. they stripped him of his committee assignments and called for him to resign. now to decision 2024. one day after former president donald trump's former chief of staff called him a fascist. vice

president kamala harris echoing those same sentiments, trump now hitting back today in the bay's alice barr live in washington. for us, this morning. and alice both campaigns here really trying to gain support on those voters who are still on the fence. marcus. and as they're battling down to the finish line, these new comments from a former trump staffer are roiling the race in the final stretch. this morning, both presidential nominees responding to new comments from former president trump's one time chief of staff, john kelly, telling the new york times his old boss is surely an authoritarian, admires people who are dictators. he has said that. so he certainly falls into the into the general definition of fascist, for sure. let me ask you tonight, do you think donald trump is a fascist? yes, i do, yes i do, and i and i also
6:09 am
believe that the people who know him best on this subject should be trusted. the retired four star general also claiming the former president, said complimentary things about nazi leader adolf hitler. he commented more than once that, you know, hitler did some good things too. it is deeply troubling and incredibly dangerous that donald trump would invoke adolf hitler. former president trump firing back on social media accusing vice president harris of going so far as to call me adolf hitler because he says she's losing and calling her a threat to democracy. also accusing john kelly of making up a story out of pure trump derangement syndrome hatred. the trump campaign calling the kelly stories debunked and fabricated while the former president campaigned in battleground georgia, encouraging christians to vote in a faith based town hall. we've really energized a lot of people this time because they've seen how bad it is. this last four years has been it's

been a horror show. before talking immigration at a rally as the nominees make their final push. former president trump campaigns today in arizona and nevada. vice president harris in georgia, alongside former president obama and bruce springsteen. and we're also learning from a senior campaign official that vice president harris is preparing for a closing argument speech this coming tuesday. one week before election day, at the site where former president trump spoke directly before the january 6th capitol riot. marcus. all right. alice barr in washington this morning for us. alice. thank yo. 609 for you right now. and people in one east bay neighborhood who never received mail in ballots are now learning a possible reason why it was likely part of a stolen mail haul. voters who live in berkeley, near ashby and king say the mail in ballots never arrived for the upcoming election, and they recently learned about a theft involving their mail carrier. now, this

all happened in october. october ninth, to be exact. berkeley police confirming some ballots and other election materials were actually found inside the truck when they investigated. let's take a peek outside on this now. thursday morning, baby. friday, right. friday eve, little friday, baby friday. all right. live. look in the east bay in walnut creek. folks making their way out the door. we'll check in with mike for that morning commute, but let's talk about the crispness we are feeling in the air. these days. kari. yeah. makes you think about, you know, having your pumpkin spice and your, you know, apple cider, all of that stuff. it feels like fall outside and that continues today. we do have a cool morning once again. it's in the low 40s in sonoma, but it's 51 in oakland and it's 61 in fremont. so the way we're starting the morning really depends on your location will be in the upper 50s through the next few hours for fremont. mainly clear and lots of sunshine. today it's going to be another nice one.

basically a repeat of yesterday where we're headed into the mid to upper 70s for much of the bay area, some mid 70s in san francisco and a few low 80s in the south county tomorrow. also very much like today. and that continues into saturday as well as we are going to have a nice steady weather pattern, but we are going to see a cold front moving in on sunday. so we'll talk about the changes that will bring coming up. mike, are you seeing any changes for prices at the gas pumps a little bit. i mean locally. anecdotally, i passed a couple of price drops over the last week. we're going to start, though, with the very lowest we see on bay area charts. contra costa county today their low is 3.89. it shows up in richmond as well. and that's quick serve on carl carlson boulevard just off the east shore freeway. south bay still stuck at 3.99. they've been there for about ten days for their low. san jose shines brightly with diamond gas and market on winchester boulevard. this morning. last price is here at san mateo county. the only station with the lowest price in that county for 19 is the low,
6:13 am
and that's at elite gas and mart on marsh road in menlo park. check gasbuddy.com for your area or you can update the system as well. updates for your traffic flow show that things are still slow as you're traveling down the east shore freeway. the biggest holdout is a richmond bridge. the backup there approaching the toll plaza. no incidents there, just a good volume of traffic out of contra costa county. back to you. thank you. mike. well, you know, they say everyone needs a sick day every once in a while, but. oh, okay. but how about one for your dog or even your cat? well, next we're going to tell you this new law being considered in the u.s. state and a u.s. state, i should say, to ease the stress of pet owners. well, if you do have to go to the vet, maybe you could take an air taxi. we are one step closer, and it's the most important step for that to become a reality. out to the futures. this morning on a thursday looks like a bit of a mixed market, but nasdaq is going to do well. did you say his name? three times? he will appear. beetlejuice. the juice

boeing aircraft mechanics turned down a contract offer. mcdonald's. we'll talk more about them in a minute. but you can see that stock really sinking. tesla absolutely caught off guard. everyone's caught off guard with tesla's much better than expected quarterly financial report making more money per car. and it's making a lot of money on credits because tesla doesn't make cars that pollute, it can sell carbon credits to automakers like ford who do make cars that pollute. this has been very important for tesla. $739 million in just the last three months alone. the department of justice, meantime, has warned tesla ceo elon musk that his million dollar a day handouts to some of the people who signed his petitions in battleground states may break

million for misleading customers about the apple card. agency says apple didn't pass customer complaints about incorrect charges onto the bank, and that consumers were misled about interest free charges. apple says it disagrees, but it will pay. and finally, the faa has finalized rules around air taxis and air taxi pilot training. bottom line, that was the last major step before we can finally have air taxis. this, by the way, is the bay area's joby flying around. so this is going to be something we've always talked about, the jetsons sort of thing, where it's actually apparently going to happen. talk to air traffic controllers. yea, there's lots to be worked out. a lot of it will be automated, which will be interesting to watch. scary. yeah, a little bit, but interesting too, right? i can't wait. yeah. thanks, scott. you first though. all right. all right. 619 for you this morning. new at six. big apple may be ready to follow in

the footsteps of, believe it or not, emeryville. yeah. maybe we should say emeryville, pawsteps. that is because right now that is the only city in the u.s. that allows workers to take paid sick time to care for their pets. and in emeryville's case, it's only for guide dogs or even service animals. but this week, new york city's council, they are actually weighing a similar measure to amend the current sick time policies for all businesses to include pet care. supporters argue that it would help boost mental health. opinions are mixed. i guess that's fair. it depends how sick, right? yeah, people take time off for kids that are sick. pets are not people and you love your pet. of course i love my pet. but i don't know if you can take your time off to take care of your pet. that's a little bit of a stretch. now, it's still yet to be determined. what kind of dog would actually be covered by the city's new ordinance?
6:21 am
something to take account. all right, so trendy for you this morning. if the name delilah ditz means anything to you, we have the deets on the airbnb booking that you might not want to miss. is it an immersive experience inside a home? recreating the deets residence featured in the beetlejuice films. the home is located in hillsborough, new jersey, and you'll have to pay your own airfare to get there. but airbnb is now offering a three hour immersive experience between november 16th and november 27th. you can bring no more than six people. the home features artwork inspired by the character delia deetz and a model of the town in the attic. the booking period closes on november 4th, so if you're a big fan of the movie, there you go. that makes sense, though, for marketing. for a lot of these movies coming out to have some type of immersive experience to really, yeah, get it out on social media and people, of course, want to take some cool
6:22 am
pictures. yeah. there you go. all right. are you going? yeah. no, a little too far for me. yeah. okay. but i got to stay home and take care of my dog. yeah. all right. so, yeah, let's get out this morning. we've had some cool weather, and it's going to be another nice day. here's a look at our high temperatures for this afternoon. 78 in los gatos and 80 in morgan hill. a lot of these temperatures are very much like what we had yesterday. so expect that to repeat for today as we head for the upper 70s for oakland. it will be 76 in vallejo and 80 in livermore and in antioch, 75 for redwood city today and 71 in half moon bay. we'll even be in the mid 70s in parts of san francisco, downtow, 75 degrees, 73 in mill valley and 77 in napa for today. but there will be changes ahead going toward the end of the weekend. we're going to see some rain rolling in across northern california. this is sunday afternoon. and notice that some of that rain makes it into at
6:23 am
least parts of the north bay and parts of our coastal areas. but then a lot of that rain just falls apart. so we're going to be watching this closely to see if we can at least get some spotty sprinkles. it looks like, though, the north bay will have the best chance of seeing some very light, measurable rain. unfortunately, this is not significant enough to really help us out with the dry vegetation, but we will have cooler temperatures coming in behind that front and our high temperatures will drop down to the low 70s for some of our warmer spots inland. we're going to feel that in the morning. it's going to be in the mid 40s and this weather continues into halloween as well. as we look way ahead before this weekend looks nice and mild with highs in the low 70s in san francisco. mike, how's it looking now in the east bay? no surprises right now on the commute and no big surprises, at least. typical pattern at the bay bridge hov lanes. big advantage. things move smoothly across the span. we're holding steady with the build out of richmond and through richmond. as well. other than that, no major problems. north 680 still slow. that crew

like, no, not again. well, i was going to date myself and say, i remember when it was a dollar to cross the bay bridge. back in the good old days. it's far from that. well, good morning to you on this thursday, i'm marcus washington, and i'm laura garcia. let's get a look at that forecast. you're feeling that chill in the air? a little bit in the mornings now. we are in fall. it is fall and it feels nice. and it's going to be a comfortable afternoon once again. we do have to start out wearing a jacket, but then short sleeves later today. take a look at san jose. that is all clear as you head up and out the door on this thursday morning. we're going from 60 degrees at 9:00 to seeing those temperatures trending toward the upper 70s for later today, and that's what we'll see. pretty much all around the bay area with some mild weather and this continues into much of the weekend. but we do see some changes ahead for sunday. i'll have more on that coming up in a few minutes. laura sounds good. we'll check back with you. 632. right now, the chp sideshow operation in oakland seems to be paying off just this weekend. dozens of people were arrested and dozens
6:33 am
of vehicles impounded. but as the state program is set to actually wind down, agencies big and small are working to maximize their enforcement. even if they can't put more officers on the streets. today, in the bay's kris sanchez joins us live from morgan hill this morning where the department there is using ai to help kris. right. i mean, ideally all departments would have as many officers as they needed on the streets, but that is not always possible. even when we know how impactful it can be. i want to show you what happened in oakland over the weekend. the chp deployed 60 officers there as part of an unannounced surge operation. 22 people were arrested, five of them connected to sideshows. then on sunday, another 16 people were arrested at a different sideshow. now, since the four-month operation started in oakland, the governor's office says more than 300 people have been arrested and more than 600 stolen cars recovered. when
6:34 am
we can bring more resources to the table and respond to these incidents, we have more personnel that we can utilize to either shut down sideshows as well as ultimately detain and arrest people. tow vehicles and our smaller agencies like morgan hill pd, they are maximizing their reach through technology, through ai and machine learning. agencies like morgan hill pd can integrate existing audio detection technology like shotspotter and put those together with video cameras and license plate readers that many departments already use. when flock safety's raven system detects the screeching of tires, it determines whether the it's a momentary sound of a crash or the sustained screeching of a sideshow, then notifies officers while also starting to gather evidence. it actually triggers the cameras to capture vehicle evidence at the scene. law enforcement can then see all of
6:35 am
this evidence together and piece together a case, so it gives them that additional situational awareness. now, because sideshow detection can be deployed in an area as small as a quarter mile, smaller departments like morgan hill pd and media departments like vallejo can use it, but it's also already in use in large departments like san jose and san francisco. and in fact, because of a state grant, the chp and oakland pd are also using this ai tool. now, the chp four month operation in oakland is coming to an end next month. so this technology will definitely try to fill the gaps when that happens in morgan hill. kris sanchez today in the bay. yeah, because some of those shows have been so dangerous to the onlookers as well. thanks, chris for the latest. totally. well, things are getting heated inside and outside the courtroom in the murder trial of nima momeni. he is the man accused of fatally stabbing cashapp founder bob lee in san francisco yesterday. defense wrapped up
6:36 am
the cross-examination of his sister césar, which included her firing off accusations prosecutors were trying to intimidate her to get her to lie under oath. later, outside the courtroom, lee's widow used explicit expletives to slam cazares testimony. meanwhile, san francisco court clerk this morning there on strike. now, it's not yet clear if the trial will be impacted. and of course, our entire team will continue to follow the twists and turns and testimony in this case until there is a verdict. you can watch complete coverage of this case on our home page. nbcbayarea.com. well, vice president kamala harris is not mincing words about donald trump. certainly not. scott mcgrew joins us now. she called him a fascist, at least at last night's town hall. yeah. this is the vice president of the united states. a word partizans have been throwing around for a while, but not the vice president. this comes after trump's former chief of staff
6:37 am
once again warned trump would act as a dictator. here's harris last night. do you think donald trump is a fascist? yes i do. yes, i do. and i and i also believe that the people who know him best on this subject should be trusted. people who know him best. he's talking about john kelly and mike pence and mark esper and john bolton and rex tillerson, but mostly kelly, who, as you will remember, told the new york times that trump was not fit to be president. the former four star marine general, also discussing trump's apparent admiration for german generals of the second world war and their allegiance to hitler. here's audio of that conversation with the new york times commented more than once that, you know, hitler did some good things, too. well, i tell him that. i said, you know, it's very easy if you first of all, you should never say that nothing you did, you could argue was good. it is deeply troubling and incredibly dangerous that donald trump would invoke adolf
6:38 am
hitler, the man who was responsible for the deaths of 6 million jews and hundreds of thousands of americans. meantime, donald trump rallied fans in the battleground state of georgia, speaking before a town hall and later, at this turning point rally. together, we're going to fix our nation, and we're going to fix our nation fast with your support on november 5th, america will be bigger, better, bolder, richer, safer, and stronger than ever before. now, there are a lot of clips from that rally on social media this morning, but they're not trump clips. they're tucker carlson, who is introducing trump at the rally and comparing him to a dad who came home from work to be met by unruly children. and when dad gets home, you know what he says you've been a bad girl. you've been a bad little girl, and
6:39 am
you're getting a vigorous spanking right now. and no, it's not going to hurt me more than it hurts you. no it's not. i'm not going to lie. it's going to hurt you a lot more than it hurts me. and you earned this. you're getting a vigorous spanking because you've been a bad girl. well, america is still split. the latest wall street journal poll shows nationwide trump slightly ahead of harris, but this is within the two point margin of error. laura, thank you very much, scott. 638 right now, here's a live look at the bay bridge. be glad you're not sitting in that. if you thought transit leaders were done with plans to raze bay area bridge tolls, sorry. think again. the toll authority unveiling a new proposal to phase in a series of hikes over five years starting in 2026, at which point fast track users would pay $8.50 for all bridges excluding the golden gate. tolls would then increase by $0.50 each year over the

following four years, meaning the toll would be $10.50 in the year 2030. drivers without fast track will pay slightly more before a final decision is made. a series of public hearings will be held. the exact decision date is not yet known. as we take a live look out for you. more people on the road over in dublin this morning. meteorologist kari hall tracking what folks can expect as they head out today. i'm sure those folks who left out early kari they had a jacket of some sort. this morning. yes, we've had these chilly mornings and that's that reminder that we have to get out to the pumpkin patch. enjoy some time for the weekend as it now finally feels like fall, but we're still headed to 80 degrees. if you're going to smith family farm in brentwood this weekend, it will be a little bit cooler on sunday and still nice for those pictures as our highs will be in the low 70s. this is actually a great time of year to head to the beach, and we are going to see upper 60s and low 70s a mix of
6:41 am
