great way to go into the weekend with kelsea. but we are keeping a very close eye on that election countdown. coming up, we're going to have the latest from the trail and the deeper look at the gender divide that could be the deciding factor in this race. we're going to start this morning with this breaking news, that new fallout from a legal bombshell. the los angeles district attorney, the prosecutor, filing a request overnight that could mean erik and lyle menendez, who have spent decades behind bars for killing their parents could soon walk free. >> this is a case that dominated the headlines in the '90s. it's been thrust back into the spotlight by a recent string of documentaries, a new netflix series, and calls for the brothers' release by family and celebrity supporters. >> hi, laura, good morning. >> hi, good morning to you guys. the momentum had been building up to this moment for weeks, what was once viewed as a long shot, to re-examine why the menendez brothers say they committed those grizzly killings, now resulting in this document. a blessing from the d.a. for

their release. >> reporter: this morning, a new path towards freedom for erik and lyle menendez. the top prosecutor in los angeles now recommending that a judge resentence the brothers for killing their parents more than 30 years ago. >> there will be eligible for parole immediately. >> reporter: in a 57-page document filed overnight, the d.a. writing, in part, "the defendants have demonstrated exceptional post-conviction conduct, adding, they no longer present a public safety risk." >> i just wanted it to stop. >> reporter: after last month's netflix series increased celebrity attention and an army of online defenders helped interest in the case -- after suffering abuse at the hands of their father, jose, as children, and their mother, kitty, did nothing to stop it. >> i want to underline, there were horrible acts. there was no excuse for murder, but i understand also how sometimes people get desperate.

i think that often, for cultural reasons, we don't believe victims of sexual assault. >> reporter: the dramatic turn in their fate hinging in part on purported new evidence supporting their past claims of their father's alleged abuse. something raised during their first trials. >> just started with -- after sports practices, he would massage me. >> reporter: but after jurors deadlocked, the judge in their second trial barred what he called the abuse excuse. >> menendez brothers. >> reporter: a recent peacock documentary and two high-profile releases from netflix bringing fresh scrutiny to the case. if there had not been a netflix documentary, would we be having this conversation right now? >> the conversation would have come in, but it probably could have come in another week or two. >> reporter: critics raising questions on the timing of this decision with thursday's announcement coming in the waning days of his re-election bid. >> it has nothing to do with the election. >> reporter: prosecutors

originally argued the brothers killed their parents to get their hands on the family fortune, many menendez family members now support their release, several sitting front row at thursday's announcement. >> this stuff gives us all help. >> reporter: but their uncle milton has maintained they should stay behind bars. his lawyer blasting the d.a.'s timing. >> it's just really offensive, and that's not how the justice system should work. >> it's not the d.a.'s decision, unilaterally, what happens next. >> reporter: it's a lengthy process, and it's going to begin now that they have filed this with the judge. the judge is probably going to set a hearing within the next month or so, and if judge agrees that they should be resentenced, it's not up to even that. it's going to the state parole board, and then even then, it may not be over, because the governor could weigh in and decide to green light the parole or actually to block it, guys. >> interesting. but a key first step for sure. thank you, laura. now to the race for the white house. with just 11 days to go, both campaigns are turning to big names to help make their closing

arguments. vice president harris, joined by former president obama and bruce springsteen at a rally in georgia overnight. former president trump holding a big event in las vegas. meanwhile, early voting is shattering records. we've got complete coverage for you this morning heading into a big week into the race. we're going to start with nbc's garrett haake following the trump campaign. he is in austin, texas, for us. garrett, good morning. >> reporter: hey, craig, good morning to you. yeah, look, voting is under way all around the country. more than 31 million ballots already cast, nearly 3 million of those here in texas alone. and it comes as the candidates are starting to roll out their closing messages and in some cases deploying their biggest celebrity messengers to help. with just 11 days until the election, donald trump appearing to go all in in las vegas, saying a harris presidency would cost people their lives. >> she will obliterate our economy, kill millions of jobs, kill thousands of people, too, by the way, and destroy your family finances, probably

forever. >> reporter: this after he put the spotlight on immigration in an earlier stop in arizona, blaming the vice president for what he calls an invasion at the southern border. >> we're a dumping ground. we're like a garbage can for the world. we're like a garbage can, you know? it's the first time i've ever said that. >> reporter: earlier in georgia, vice president harris turning to star power at a rally, led by bruce springsteen. and former president barack obama joining the vice president for the first time on the trail. >> we do not need four years of a wannabe king, a wannabe dictator running around trying to punish his enemies. >> reporter: and the vice president delivering one of her new closing messages. >> it's either donald trump in there, stewing, stewing over his enemies list, or me, working for

you, checking off my to-do list. >> reporter: while her campaign is also seizing on comments by former trump chief of staff john kelly to "the new york times" in a new ad. >> he certainly falls into the general definition of a fascist. >> reporter: trump on the trail firing back at kelly. >> he was a bully who made up stories. >> reporter: while his campaign also pushes back on new accusations of sexual misconduct. stacey williams, a former model, says in 1993, trump groped her in trump tower while talking to disgraced financier jeffrey epstein. williams, a registered democrat, telling the story on a zoom call this week labeled "survivors for kamala." nbc news spoke to seven people who said williams previously told them about the alleged encounter with trump, most of whom requested anonymity. the first said they were told in 2006. the most recent, in 2022. the trump campaign saying the accusations are "unequivocally false." and today, both candidates detour away from the traditional

rebounds to come to the lone star state. vice president harris will be in houston, joined by pop superstar beyonce, a houston native. trump, touching down later today here in austin to tape a podcast episode with host joe rogan and deliver remarks on immigration. craig? >> lots of action in texas today. garrett, thank you. let's take a deeper dive now and look at one of the defining issues at play in this election, gender. the gap between male and female voters super charged in this election, according to the polls, and it could tip what is a razor-thin race. nbc's senior washington correspondent hallie jackson joins us with a closer look. hi, hallie, good morning. >> hey, savannah, good morning to you. this has become one of the big features of this race so far. more men backing former president trump, more women backing vice president harris as both campaigns try to boost turnout with election day approaching fast.

>> reporter: this election cycle, the 30-point gender gap between men -- >> i feel things were a little better under trump. >> reporter: -- and women is stark. >> ready for a female president. >> reporter: with nbc news polling showing women supporting vice president harris by a 14-point margin. former president trump with a 16-point lead among men, a gap that could be even bigger than 2016 when the first woman nominee of a major party, hillary clinton, was on the ballot. mr. trump, courting men under 30, appearing on podcasts with male-dominated audiences. >> you want a drink? >> reporter: trump surrogates leaning into the hypermasculine. >> trump-mania. run wild, brother! >> reporter: hulk hogan ripping off his shirt at the rnc. tucker carlson, colorfully and crudely casting mr. trump as a father figure.. you've been a bad little girl and you've getting a >> when dad gets home, he says,

you've been a bad girl. ufc -- you have been a bad little girl, and you're getting a vigorous spanking. >> reporter: even mr. trump's language about women -- >> and i will protect women at a level never seen before. >> reporter: vice president harris also reaching out to men, appearing on a popular nba podcast and launching ads on sports betting sites, but boosting turnout among women a could be key for her. like the younger women who tune into the "call her daddy" podcast. and while the campaign sees abortion access as mobilizing across gender lines, our polling show it's the top single voting issue for women, and the vice president is the clear leader among college-educated white women. a who back her by 28 points in our nbc news poll. although the vp herself has downplayed the impact of the gender gap. >> regardless of someone's gender, they want to know that their president has a plan to lower costs, that their president has a plan to secure america. >> men and women are also divided on the really important issue of change this election

cycle with more men seeing former president trump as that better change agent, but more women saying, for them, it's vice president harris who represents change. >> it may all come down to that, hallie. thank you very much. now to some breaking news overnight. russia launching a new wave of drone attacks on ukraine. the latest attacks coming just hours after vladimir putin appeared to acknowledge the presence of north korean troops in russia during a closely watched summit. nbc's chief international correspondent, keir simmons, was at that summit. he joins us now from russia. keir, good morning. >> reporter: craig, good morning to you. this morning, reports say south korean officials will brief nato next week over those reports of north korean troops are here in russia. as u.s. officials worry about what president putin may have promised kim jong un in return. president putin responding for the first time to what south korea says are satellite images of north korean troops at russian bases.

the u.s. says north korea's leader, kim jong un, has sent weapons and now thousands of his soldiers to russia. mr. president, satellite images are said to show north korean tr what are they doing here? wouldn't that be a massive escalation in the ukraine war? far from denying it, putin says russia has a new strategic agreement with north korea to protect each other. "we are in contact with our north korean friends," he told nbc news at a news conference. "we'll see how that process develops." these images show north korean soldiers given uniforms on a russian base. the men speak korean, but it's not possible to confirm when or where the footage was filmed. putin was speaking after a russian summit of emerging nations, including china's xi jinping, who he called a dear friend. india's narendra modi and multiple u.s. strategic

partners, putin declaring new possibilities in a meeting with iran's new president, who described the relationship as strategic. along with north korea, iran has also been supporting russia's ukraine war, western governments say, sending drones and missiles. president putin calling a claim in a new book by journalist bob woodward that he had private phone calls with former president trump after trump left office, nonsense. "nothing like that has ever taken place," he said, in response to a question from nbc news. "nor is anything like this taking place right now." and a report, craig, this morning says elon musk has been in regular contact with president putin. that's according to the "wall street journal," citing current and former u.s., european and russian officials. in a statement this morning, the kremlin calling that an absolutely lie, saying there was only one telephone call about

space and future tech. craig, nbc news has reached out to elon musk's office for comment. >> chief international correspondent keir simmons on the ground in moscow, thank you. lot more to get to, including a long-awaited day in storm-ravaged parts of western north carolina. some schools are finally reopening for the first time since helene tore through that region nearly a month ago. nbc's kathy park joins us with that story. kathy, good morning. >> savannah, good morning to you. yeah, it has been anything but a normal school year for the students. keep in mind, some of these schools here in western north carolina were transformed into disaster recovery centers, but this morning, students and teachers will reunite once again in the classroom to learn, but also to heal. >> reporter: this morning, thousands of students in western north carolina are heading back to school for the first time since hurricane helene brought historic flooding and catastrophic damage to the region last month.

>> it will be really great to check up with everybody, just to be around people again. >> reporter: how have your emotions been throughout the past couple weeks? >> it's been -- my emotions have been all over the place. >> reporter: buncombe county schools plans to ease students back. >> the biggest focus for our school system is grace. we want to make sure our students are okay, and then very quickly, we'll pivot back into our academic work. >> reporter: repairs were done on several damaged buildings, and school bus routes had to be completely remapped. >> there will be many students getting on the school bus at a community stop because our buses cannot safely travel into their neighborhoods. >> reporter: it's been a weeks-long journey just to restore power and running water across the disaster zones, but this week, a much-needed return to normalcy with schools back in session in watauga county. >> so, surreal, but good to get them back in the routine. >> reporter: liz talent and her family say the time away has given them a greater appreciation of the value of their schools.

behavior and are no longer a public safety threat. a hearing for the motion has not yet been set. alameda county district attorney pamela price is now facing the threat of a defamation lawsuit. bay area u.s. representative eric swalwell recently sent a letter to price demanding she retract what he calls malicious and defamatory statements. price posted comments about the congressman on facebook october 2nd, the same day he had endorsed recalling her. congressman swalwell says price has two days to retract her statement or he'll take her to court. let's get a look at the forecast for this friday morning with meteorologist kari hall. it's a beautiful start. we're seeing a few clouds coming in some pink hues to the sky as the sun comes up with a live look outside in san francisco. it's a chilly start, but our temperatures back to what we saw yesterday. mostly upper 70s and low 80s all across the bay area.

this weekend urging fans to buy tickets from verified sellers and beware of scams. >> taking advantage of louisiana residents and tourist visiting our state is wrong. >> reporter: and now, fans nationwide reporting to nbc news that tickets they bought legitimately have disappeared from their ticketmaster accounts. >> tickets were transferred. >> they couldn't get answers from the ticket vendor. they reached out to nbc10 responds. >> reporter: it's unclear how, but scammers are gaining access to user accounts and transferring the digital tickets to strangers. it happened to jessica tanner with her tickets for the toronto eras stop. >> i opened my email to, like, 80 different spam emails. buried beneath all those emails was notification from ticketmaster saying my tickets were transferred. someone had transferred my tickets to someone called a.m. i called customer service and was on hold for 90 minutes.

>> reporter: it's not just swifties. since last month, nearly 100 fans have called or emailed nbc news and nbc stations reporting the same thing happened to their tickets. to see their favorite artists including pink, usher, and post malone. >> passwords were not exposed. >> reporter: ticketmaster declined to be interviewed about these new complaints, but last month, we sat down with the vice president of corporate affairs for the company's first broadcast interview since it suffered a data breach in april. you sent millions of emails to customers telling them that things like their email, phone number, encrypted credit card information, was part of this data breach. why should people continue to trust ticketmaster? >> ticketmaster invests more in security and verification than the rest of the industry combined. people's ticketmaster account passwords were not compromised. that unauthorized activity was limited to a third-party database. >> reporter: eva velasquez leads the identity theft resource center, which keeps track of every data breach in the united states. >> the number of people that are having this experience post-breach, there is something there.

security, but it certainly makes it a smaller window for these scammers to operate. and late last night, ticketmaster gave us a new statement. they said, in part, that they are -- "most fans are getting their confirmation that their tickets are returned within 48 hours. the number of fans waiting for a response has fallen by over 95%, and we have a system in place to prioritize fans with events coming up soon." and ticketmaster really wants to say that they're leading the way in these digital tickets, the bar codes, and that is much more secure than back in the day when you would have a paper ticket that anybody could copy. it was just a pdf that you printed out. that two-factor authentication to alert you would be clutch. >> scammers gonna scam, scam, scam. >> fans know it all too well, savannah. >> you didn't catch it. you guys aren't swifties. >> can i just tell you? i caught it -- it was a beat too late, but i caught it. i get it. do you want to do it again? ♪ scammers gonna scam, scam, scam ♪ >> it was the lack of the tone.

i asked him about the timing here. >> reporter: if there had not been a netflix documentary, would we be having this conversation right now? >> the conversation could have come in, but it probably would have come in another week or two. >> gascon suggesting the attention around the case sped up a process that was already under way as the brothers had been seeking release based on new evidence of their father's alleged abuse. as for what comes next, the judge is going to set a hearing, likely in the next month or so, to decide if they should be resentenced. if the judge agrees, then the brothers become eligible for release immediately, but the state parole board must agree before they can go free, and even then, this might not be over, guys, as the governor will get a chance to green light that parole or he could block it. >> a number of stats still left. >> it could be soon. >> thank you, laura. we move now to the race to the white house.

christmas. beginning last week with its most robust catalog of movies yet. but heading into the holiday season, the network is being hit with accusations of age discrimination against some of its top talent. in a new lawsuit filed by penny perry, a former casting director for the studio, perry claims that hallmark programming executive lisa hamilton daly instructed her not to cast old people in leading roles, saying we need fresh new faces here. named in the lawsuit are two of the network's biggest stars. >> merry christmas eve. >> holly robinson peete has been with the network for nearly a decade. perry alleges that daley said, "no one wants robinson peete because she's too expensive and getting old." lacey chabert, often called the queen of hallmark, has 40 movies under her belt at 42 years old. penny alleges the executive commented about chabert, "we have to find someone like her to replace her as she gets older." in the lawsuit, perry, who is 79, also claims that she was fired from hallmark in april because of her own age.

good morning. it's 8:56 a.m. marcus washington alameda. officer accused of involuntarily killing a man back in 2021 is expected to enter a plea in court. officer eric mckinley is expected to face a judge in just a few minutes. now, family members of mario gonzalez are expected to rally outside of the courthouse. gonzalez died after three alameda officers pinned him to the ground during a scuffle earlier this month. a judge dropped involuntary manslaughter charges against two of those officers in the case. the judge says that the charges were not properly filed within the three year statute of limitations, but because mckinley was out of the country at the time, his charges remained. well, happening wno
