and temperatures today will match what we had yesterday for the most part. looking at some mid to upper 60s. a little bit warmer in concord with a high of 71 and 69 today in gilroy. so we'll get a look at what's ahead. more temperatures like this in the microclimate forecast coming up. back to you. sounds good. we'll check back with you. today, the man convicted of brutally attacking nancy pelosi's husband could learn how long he'll spend behind bars. the sentencing is in connection to the state charges against him. today in the bay's kris sanchez joins us. and, kris, david depapes team of lawyers will first motion for a new trial. yes, they will do that. so before david depape is sentenced for the brutal attack of nancy pelosi's husband in their own home, he will have a chance to address the judge and the pelosi family. but as you said first, his attorneys will move for a new trial. it was two years ago yesterday that david depape broke into the pelosi home looking for then speaker of the house nancy pelosi, who he said he wanted to kidnap and

hold hostage. we won't show you that brutal attack, but this is when san francisco police tried to move in and depape beat paul pelosi savagely with a hammer for that, david depape is already serving a 30 year sentence in federal prison. u.s. attorney general merrick garland said that the sentence was a warning that violence against those who serve the public and their families will not be tolerated. his legal team, now expected to ask the judge for a new trial in the state case. our legal analyst says that if the judge denies that request, the case will continue on to sentencing. david depape will have an opportunity to show remorse to the court and to the pelosi family, which could be critical for him in any future court dealing. that will be very important if he is trying to get out on parole at a later date. he needs to express remorse and show that he understands the magnitude of what he did to mr. pelosi and his family, and to

america. our legal analyst tells us that while long federal and state sentences might seem redundant, they serve as a legal safety net in the event that something changes on appeal. already, depapes legal team said they would appeal the state case, saying his conviction on state and federal charges amounts to double jeopardy. our legal analyst also says an appeals court might take issue with something else. what never came through in this trial was mr. depapes mental state. and will an appellate court look at this case and ask why wasn't his mental health problems brought to light during this trial? to reflect on what he did and whether that affected his behavior. so again today. david depapes legal team will move for a new trial if that's denied, then the judge might move forward with sentencing. we expect that he could serve up to life in prison. lauren marcus. all right. chris, thank you. 504

her. both were killed at the scene and 2019 jones made headlines after she helped a homeless woman through the delivery of twins. well, the woman who adopted those twins was at that vigil last night. we went camping together. she was at our house the other day playing board games. she's an amazing person. she cares for everybody, works crazy hours and shifts to support the family and the business. jones and her family own a churro shop in hollister. flowers are now there in her memory. chp is still looking into what caused the man's car to veer off the side of the road. happening today, san jose leaders present a new strategy to boost safety along a busy corridor in east san jose. hundreds of businesses along tully road near eastridge mall recently formed their own improvement district. the group has already taken steps to beautify the area. later today, mayor matt mahan will announce a new plan to roll out two new portable camera trailers. that's

when cameras are mounted on small trailers to deter crime. today's news conference is scheduled for noon. also today in san jose, city council members will take the next step in approving new speed, safety cameras. the $10 million plan calls for 33 cameras to be installed in some of the highest risk areas. violators caught speeding will receive their tickets through the mail. today, the council is expected to sign off on an impact report required by state law and agree on plans to find a service provider. the cameras are not expected to roll out until sometime next year. san francisco leaders are weighing a plan to making sober a financial incentive and help ease the drug crisis. in july, supervisors introduced a plan for a new program called cash, not drugs. so it's a proposed sobriety and recovery program, which would allow people on public assistance to receive $100 a week in gift cards or ebt funds by continuously testing negative for drug and alcohol.

the measure already has the backing of mayor london breed. the board may hold a vote on those plans as soon as today. taking a live look in the east bay in walnut creek, kari has got a look at our tuesday forecast. i was surprised by a little bit of rain yesterday. yeah, it was nice to see those showers moving through. now all of that has cleared out. we are all dry today, but there is another system that's approaching that will bring in another chance of rain late tomorrow night into early thursday morning. so as we time it out, we are going to see sunshine for today. but by 11:00 tomorrow night we are going to see that rain coming back to the north bay and quickly sweeping through the bay area. we're also looking at more rain for the weekend, so i'll talk more about that in a few minutes. mike, you've been tracking some of those gas prices around the bay. yeah, we'll go to contra costa county because they have the best price in the bay in specifically in concord is 369 at valero on willow pass road. that's your top number right here. now san jose has the best in the south bay. it's 3.95, a

be a crash nearby. we'll check on the updates coming up. well good morning. very happy tuesday to you. a lot of big tech earnings this week. we get google today meta microsoft tomorrow apple comes on thursday. apple releasing its new ios giving newer iphones some ai power new mac computers as well. starbucks starbucks asking its office workers to come into the office more often or face dismissal. this despite the fact that starbucks ceo doesn't even live in seattle or washington state for that matter. he has a satellite office at home in southern california. last week. so moody's downgraded san francisco's credit rating in part because of the lack of people returning to the office. empty office buildings, lower rent could mean lower tax income for the city. one bright spot in tech has been artificial intelligence, new companies opening locations and this week, a lot of other companies are getting a taste of the city as

techcrunch disrupt gets underway, the yearly conference gives startups a chance to show off and brings hi tech leaders from all over into one spot. there is a lot of excitement, and there's also a lot of excitement about being in san francisco. specifically, i think. i think the city gets sort of a hard a knock in the national press. but, you know, it's very clear that everyone wants to be in san francisco. we're seeing all kinds of excitement. and the fintech app robinhood is now going to let you bet on the election by buying an option. this is not a new idea. financial markets make bets on all kinds of things, from the price of wheat to the chances of a catastrophe. the thing is, these bets tend to be super accurate. people make very careful decisions when money is on the line. here's what the robinhood app looks like with your choices to put money on harris or trump, you get a payout if your candidate wins. now, these can be gamed. there

awake. a little more coffee. that was a good one, though. marcus was still checking his pocket for. how's this forecast shaping up for us? there is lots of change here. we're going to see a cooler. temperatures keep that trend going. all right. now this is where we're starting this morning. upper 30s napa. you've dropped down to 39 degrees right now. it is a cold start there. and 49 in san mateo. we're also seeing a lot of 40s on the map here. this morning. and so as you're getting up heading out there is a chilly start behind the cold front that moved through over the weekend. and then looking at the next cold front that's on the way. and that will be arriving tomorrow evening. so here's a look at what to expect for this afternoon. really nice weather, upper 60s for a lot of spots. 67 in cupertino and 68 degrees for morgan hill, and also for parts of the east bay. upper 60s, low 70s concord, 71

today and 66 in hayward and 67 in redwood city, san francisco in the mid 60s for this afternoon and 66 in mill valley, 68 today in sonoma. so we're seeing a lot of those 60s for highs. but then tomorrow we're going to see the same temperatures, but then more clouds coming in and late tomorrow night into early thursday there will be some rain sweeping from north to south. and then starting to taper off by thursday evening. i know that's so important. it looks good for trick or treating, but it will be cool and kind of still damp as we get that early morning rain, and it looks like we could see anywhere from a quarter inch of rain to 3/10 of an inch of rain for parts of the north bay, and then a few hundredths of an inch of rain for areas south of the golden gate bridge. and while we get rain, the sierra gets snow. this could be the first decent amount of snowfall we get of the season, with up to 15in possible. we'll have to see how things trend as we get closer,

shoreline. they say we need to think outside of the box with property rules and ensure environmental justice. part of their recommendations include establishing community land trusts and planning sites around the bay that accommodate residents displaced from flood prone areas. property is a big part of the inequalities that we see in our cities around us, right? so some groups of people have had access to building wealth through property for generations or centuries, and others have been systematically sort of marginalized and excluded from that process. and we think as we rethink property for the age of climate change, we really need to focus on how to redress those inequalities and those injustices as part of that story. we do have time, but but only if we start now and only if we can bring all of the innovative thinking to the bay area is famous for to bear in thinking about how do we create a more, just a more just bay as we adapt to sea level rise, sea level rise will require our attention for a very long time, and that means working together

and i'm laura garcia. let's start out with a look at that forecast because changes in the works meteorologist kari hall is tracking what we can expect. we can already feel it. it's cooler. some of us got some rain yesterday. and there's more rain on the way. so we are going to see this changing day by day. look for a lot of sunshine for the afternoon, but it's such a cool start and a lot of areas that it will be a while before it feels a little bit more comfortable today. so take a look at napa at 8:00. it is only 42 degrees at noon it's 64, but we're headed for 74 this afternoon. it's going to be nice for a few hours. and we're also looking at more of those same temperatures all across the bay area with upper seconds and a few low 70s. mike, you have a look at some slowing in dublin. yeah, i was seeing a lot more slowing a few minutes ago. these taillights, we flip our camera around. we saw them kind of jamming up, passing by hacienda as folks take a closer look at the screen, you can see actually good spacing. now a chp just cleared the scene as well. we couldn't find the actual

incident, the disabled vehicle, but we still see some slowing on the sensors. west 580 approaching hacienda from about fallon. so do watch that area. that's el charro as well. you might know that exit the rest of the bay shows a little slowing northbound 680 from a crew that's still there, with some paving work. we have a lane open coming out of sunol. everything else. standard build. back to you. thank you. so much, mike. 531 right now. later this morning, a group of business owners are striking in oakland to try to send a message to the mayor. they say she's not doing enough to fight crime. today in the bay's bob redell joins us live this morning. and, bob, this strike comes just a week before that vote to recall the mayor from office. you are correct. good morning to you, laura. so later this morning at 11:00, a handful of businesses in oakland, they will go on a symbolic strike, which means they'll shut down their business for a number of hours, and they'll gather at oakland city hall again at 11:00 this morning to protest the ongoing problem of crime in their city. you might recall the first business strike in september of last year, when more than 200 small

business owners closed their doors for several hours, which organizers believe was the catalyst catalyst for the recall effort of both oakland mayor sheng thao and alameda county district attorney pamela price. now, the people behind this morning's strike say this is a call to action for citizens if they want to see an end to this crime wave. this is their words. they need to look at the city's leadership. don't make this general election just about the president and those higher office. but let's keep in mind how important it is to take care of these local issues, because these local issues have not been addressed properly and now is our time to make that differenc. yesterday in a news conference, oakland mayor sheng thao announced the biden-harris administration has granted our city $2 million to address gun violence. the mayor says oakland is already on the right track when it comes to crime reduction, with opd reporting a 33% decrease in the homicide rate compared to this time last year. but the mayor was asked

about the fact that many oaklanders still don't feel safe in their own city. at the end of the day, of course, there's a sense of feeling safe, and that is incredibly important. and all of us, we all have a responsibility in ensuring that our community feels safe. i can tell you that crime is down, crime is down, and you cannot hide bodies. so we know that those numbers are accurate. but at the same time, we have to promote the great positive stories of oakland. i don't believe that we do enough justice in promoting that positive narrative of oakland. as we've been reporting, governor newsom has sent in chp officers to help opd fight crime over the past year, according to the state, chp has made more than 300 arrests, seized 600 cars and removed dozens of illegal guns in oakland over the past two months. reporting live, bob redell today in the bay. all right. thank you very much, bob. we are now just one week away. we keep saying it until election

day. scott mcgrew here. and you've been reminding us, scott, that's not when voting starts, but it's really when voting ends at the end of election day, it's over, right? so tens of millions of americans have already turned in their ballot. so next tuesday is the last chance to vote, either by dropping off your ballot or showing up in person. used to be we all went to the polls on election day. these days, many americans get it done early. looking at the campaigns this morning, the trump campaign distancing itself from some of the speakers at trump's madison square garden rally, particularly the speaker who called puerto rico a floating island of garbage. while puerto rico is part of america, it does not have electoral votes. but americans of puerto rican descent are going to be important in places like pennsylvania. here's vice presidential candidate jd vance. i think that we have to stop getting so offended at every little thing in the united states of america. i'm just i'm so over it. georgia going to be a key state as well. that's

where donald trump was campaigning monday in atlanta. he said several times. he is not a nazi. the newest line from kamala and her campaign is that everyone who isn't voting for her is a nazi. we're nazis. you know, years ago, my father, i had a great father. he's tough guy. he used to always say, never use the word nazi, never use that word. and it's a never use the word hitler. don't use that word. it's like, i don't even know why. don't use that word. and then i understood it. and yet they used that word freely. both words they use it. he's hitler. and then they say he's a nazi. i'm not a nazi. i'm the opposite of a nazi. to be clear, harris has never called trump a nazi or hitler. trump's chief of staff. you'll recall last week made news by saying trump fit the definition of a fascist. but he didn't say nazi

either. preparations are underway just outside the white house for vice president harris speech tonight on the ellipse. this is the same spot where trump declared he and his supporters were going to march on the capitol. earlier, harris campaigned in ann arbor, michigan, while bruce springsteen and barack obama campaigned for her in philadelphia. here's a good rule if somebody does not respect you, if somebody does not see you as fellow citizens with equal claims to opportunity, to the pursuit of happiness, to the american dream, you should not vote for them. and jeff bezos this morning defending his instruction to the newspaper he owns the washington post, telling the editorial board there not to publish their presidential endorsement. a number of highly regarded reporters quit over that decision, and the post is reportedly lost more than

trial. if that is denied, depape will have a chance to address the judge and the pelosi family. depape is already serving a 30 year sentence in federal prison. kris sanchez is talking to a legal analyst ahead of today's proceedings. she'll join us with a live report coming up in our next half hour. well, developing in san francisco, a man is struggling to survive. this is after police believe that he may have been stabbed on a muni bus. it happened just before five last night near geary and 14th avenue in the richmond district. there's no word yet on how that victim is doing, but his injuries are described as life threatening. if you saw what happened. sfpd, they would like you to give them a call. well, two east bay and tri-valley congressmen joined forces to bring more than $16 million to help move the bay area forward into a cleaner and safer future. this morning, congressman mark desaulnier, as well as eric swalwell, are announcing funding for the livermore amador valley transit authority. this is to

add a hydrogen fueling tank to further their goal of zero emission for their transit agency. all the busses running in the east bay in this instance, in the 685 80 corridor, are transitioning and have been for some time. amongst the leaders in the country, really away from first diesel and the natural gas. and now to hydrogen fuel which is emission, the emissions are zero. that's one of 15 projects across contra costa and alameda counties that will benefit from a $15.2 billion grant from the u.s. congress community benefits program. the city of dublin will also get more than $1 million to purchase and install cameras near public parks and schools. congressman desaulnier and swalwell are scheduled to attend the announcement in dublin at noon. it is 540 right now. taking a live look, we're in the south bay overlooking downtown san jose. kari is keeping tabs on the forecast, finally feeling like fall because it's, you

know, chilly out there. yes. and it will be cool throughout the day. starting out all clear. this morning, which is different from yesterday morning at this time. and we are going to see a lot of sunshine throughout the day. temperatures going from 52 to seeing it around 60 degrees at 11:00. it's going to be a while before it really starts to warm up, but we are headed for the upper 60s for today. for much of the south county, as well as the inland east bay 66 in dublin, 71 in concord and napa will be in the upper 60s. let's take it to tomorrow. there's really not much of a change temperature wise, but we will start to see a lot more clouds coming in and a chance of rain late tomorrow night and by thursday we're also seeing more of those 60s for highs. mike, you are tracking the build up at the bay bridge. pretty predictable for a tuesday. we have a bigger volume and it kicks in right away in the morning here. so it's only been about ten minutes with the metering lights on. and we filled in the toll plaza all the way on the 880 overcrossing as well. no surprises, but we do

appeals court to overturn his convictions. this is after they were upheld by a previous appeals court panel. turning back to our decision 2024 coverage, state assemblyman evan low just picked up a key endorsement in his quest to fill the congressional seat left vacant by anna eshoo. governor newsom is now backing him in the hotly contested bay area district 16 political race. low is running against former san jose mayor sam liccardo. both are democrats. nbc bay area political analyst larry gerston says the endorsement comes as a bit of a shock. you rarely go ahead in an intraparty contest and pick one, leaving the other out. i mean, it's sort of like an unwritten law, if you will. gerston says low's opposition of proposition 36th may have been a factor here. it aims to increase punishments for retail theft and drug crimes. governor newsom also opposes it. we reached out to liccardo's campaign, which,

in response to the endorsement says, quote, sam is endorsed by the people and organizations serving this district, including the mercury news, san francisco chronicle, san mateo daily journal, palo alto post, and hundreds of local leaders. because sam will deliver solutions for our local communities. a federal judge is allowing pro-palestinian activists at uc berkeley to present their side of the story in a lawsuit accusing cal of anti-semitism. last year, jewish organizations filed the suit claiming that the university has repeatedly failed to protect jewish students. the legal findings also detail a student group that allegedly adopted a bylaw which banned supporters of zionism from speaking at its events. it claims 22 other uc student groups followed suit in june, the university filed a motion to dismiss that case. a decision is still pending. now an attorney for the student coalition of pro-palestinian protest group says that the

lawsuit has the federal courts to make any criticism of israel illegal. the group says that it plans to present evidence and witnesses as part of the case covered. california's open enrollment is just days away. and later today, u.s. secretary of health. javier becerra will be launching a new campaign highlighting assistance or highlighting assistance that's available. he'll be joined by the ceo of covered california for that announcement for 2025. daca recipients in california will also be eligible to enroll in covered california. enrollment starts on friday. new this morning, prepare to pay a little less if you take the ferry from richmond to san francisco every friday through the end of the year, you'll be able to take it for free. ferry officials made that announcement yesterday. they say the new incentive for people to go on board made it possible, through a partnership with the contra costa transportation authority. well, happening today, raising cane's is opening a new restaurant in fairfield. the

possibly some snow. looking ahead. so we are starting out all dry, all clear behind the chance of rain that we had yesterday that brought parts of the bay area some showers and today it's all dry. but then looking at the next system that will be arriving late tomorrow afternoon into the evening in concord, it's going to be a chilly start. that's what we're seeing across much of the bay area, with upper 40s and low 50s. and then here we are at noon and it's 64 degrees, so it's starting to feel a little bit better. we can at least take off the jacket, and it's going to be a comfortable day. and then tomorrow clouds will start to roll in during the afternoon. and then early on thursday morning we're going to see that rain first coming into the north bay. and then quickly spreading its way across much of the rest of the bay area. and i know we've been watching this forecast, so closely because we don't want it to rain on the trick or treaters, but most of the rain will be early on thursday and then a bit of a chance for the sidewalks to dry out before they go out and get

some of that candy. so we're going to see a possibly up to a 10th of an inch of rain in san francisco with higher amounts for the north bay, about a quarter inch or slightly more for napa, just really depending on where some of those heavier downpours come through. and then for the weekend, we're watching the cierra for a decent amount of snow in the forecast, and we're starting to see the models really grabbing on to this potential that we could see up to a foot of snow in kingvale and possibly a little bit more for twin bridges and kirkwood. so that's going to be the first decent snow of the season. while the bay area gets a decent amount of rainfall. so we'll be watching for that after we get past this next system that will be coming in tomorrow night. and it does stay on the cool side for even this time of year, with upper 60s for highs, morning lows in the 40s, and in san francisco it will be 64 today and low 60s for much of the rest of the week. mike, you are seeing lanes slowly moving out of oakland. yeah, they are

we're moving the bay area forward with a new age in crime fighting, drones are being used to avoid putting officers or the public lives at risk. san francisco police showed off the new technology yesterday. they launched the drone program a few months back. officers are using it largely to find or track down car burglary suspects without the risk of a chase. mayor breed, who helped start the program, invited san jose's mayor and police chief to the

demonstration. she says the technology has helped lead to a 34% drop in crime. san jose mayor matt mahan plans to propose the drone use during the city's next budget cycle. getting there with eyes on the scene faster makes a lot of sense, and it's something i want, san jose to explore. we do use drones today, but we have not deployed them as a first responder. the way that san francisco has. new san jose police chief paul joseph was also impressed, but says he would have to make some changes so it fits his department. max mcdonnell says it's planning to bring back the quarter pounder. this is after an e coli outbreak forcing the fast food chain to pull that burger option last week. the outbreak has sickened 75 people across the country, killing one. mcdonald's believes it's linked to onions from a taylor farms facility in colorado. the farm is headquartered in salinas. mcdonald's is confident that it has removed all contaminated products from stores. for those customers affected, you have my
