show them once and for all that this nation does not belong to them. this nation belongs to you. and let's be clear, we are all here because we are fighting for a democracy. one week to go both presidential candidates are making their final pitch to voters. we're live in washington with their closing arguments in san jose, investing in cameras from cracking down on crime to speeding drivers to catch them. the new tech being introduced to the south bay city. this is today in the bay. good morning. on this tuesday. i'm marcus washington and i'm laura garcia. we're going to check that morning commute with mike in just a little bit. but let's talk about the forecast. finally feels like fall. yes. jacket weather. and today we can leave umbrellas at home. we will need sunglasses as it will be a bright and sunny day and just taking a while to really warm up. so here's a look at walnut
6:01 am
creek. and the way we're starting is upper 40s. we're seeing a lot of those 40s on the map right now, and we are going to see a lot more 40s over the next few hours before we see 50s at 10:00, and then low 60s from then on, at least into the early afternoon. we're going to stay in the 60s for a high today for a lot of areas with in santa rosa, a high of 69 degrees expected, 64 in san francisco and 66 in san jose tomorrow. not much of a change temperature wise, but we will start to see clouds rolling in ahead of some rain. and right now, mike, you are tracking a crash in oakland. yeah, i'll be honest. i don't know if it's the same one that we were tracking or a different one in the similar location approaching macarthur to right lanes were reported blocked, and we saw a lot of slowing. the sensors actually are lighting up a little better now. but just as we look at this map, there's another one looking farther north around park, and there's no slowing. but we'll check on both of those as that is the commute direction heading toward the maze, the maze, the berkeley curve all moving smoothly.
6:02 am
there's more build through richmond and also across the bridge from richmond over on 580, slowing for 880 as well as the well. this is easing up now. north 101. that first burst in san jose. back to you. thank you mike. today the man convicted twice of attacking the former house speaker's husband in their own san francisco home will be back in court. two things will happen today. david depapes legal team will move for a new trial. and as today in the bay's kris sanchez reports, david depape could actually speak on his own behalf. right. so before david depape is sentenced for the brutal attack of nancy pelosi's husband in their own home, he will have a chance to address the judge and the pelosi family. but first, as you said, his attorneys will ask for a new trial. it was two years ago yesterday that david depape broke into the pelosi home looking for then speaker of the house nancy pelosi, who he said he wanted to kidnap and hold hostage. we are stopping the video here. this is police video. but the that is the moment when san francisco police tried to move in and david depape beat paul pelosi savagely
6:03 am
with a hammer for that, david depape is already serving a 30 year sentence in federal prison. u.s. attorney general merrick garland said that sentence was a warning that violence against those who serve the public and their families will not be tolerated. today, in the state case, his legal team is expected to ask the judge for a new trial. our legal analyst says that if the judge denies that request, the case will continue on to sentencing. david depape will have an opportunity to perhaps show remorse to the court and to the pelosi family, which will be critical for him in any future court dealings. that will be very important if he is trying to get out on parole at a later date. he needs to express remorse and show that he understands the magnitude of what he did to mr. pelosi and his family, and to america. now, while long federal and state
6:04 am
sentences might seem redundant, our legal analyst adds that they serve as a safety net in the event that something does change in the case on appeal. already, depapes legal team said they will appeal the state case, saying depapes conviction on state and federal charges amounts to double jeopardy. and because the case weighed so heavily on depapes conspiracy theory connections. our legal analyst says an appeals court might take issue with something else as well. what never came through in this trial was mr. depapes mental state. and will an appellate court look at this case and ask why wasn't his mental health problems brought to light during this trial? to reflect on what he did and whether that affected his behavior. now, if the judge denies the motion for a new trial today. today's sentencing could go on as planned or could be rescheduled for a later date. depape faces a possible life sentence. laura. all right. continue to follow. thank you
6:05 am
very much, kris. 604 right now, there's officially one week to go until polls open across the u.s, election day 2024 is almost here. the presidential candidates are making their final pitch to voters. vice president kamala harris gearing up for a speech tonight near the site of the january 6th insurrection. and former president donald trump heading to the battleground state of pennsylvania today in the bay's alice barr joins us live from washington. here we go, alice, one week away, down to the final week. at this point, laura. and in this stretch, this is still an incredibly tight race. the nominees are pushing down to the wire. former president trump says that he is feeling enthused and inspired. vice president harris preparing to sum up her case for the oval office. one week until election day and the nominees are zeroing in on their closing arguments. vice president harris preparing for a speech tonight at the site where former president trump spoke

directly before the january 6th capitol attack, looking to drive home her case that he's a threat to democracy. and now he wants unchecked power. the former president pushing back against what he called the most sinister and corrupt forces on earth. with your vote. this election, you can show them once and for all that this nation does not belong to them. this nation belongs to you. mr. trump also accused the harris campaign of casting him as a nazi, following recent claims from past trump administration staffers that he said hitler did some good thing, too, claims he strongly denies. i'm the opposite of a nazi that as the campaign works to distance itself from bipartisan backlash over a comedian's racist remarks at the trump, madison square garden rally sunday, including calling puerto rico a floating island of garbage, the campaign saying that does not reflect former president trump's views, his running mate adding this i'm not
6:07 am
going to comment on the specifics of the joke, but i think that we have to stop getting so offended at every little thing in the united states of america. i'm just i'm so over it. while at her rally in michigan last night, vice president harris responded to protests over the war in gaza. i hear you on the subject of gaza. we all want this war to end as soon as possible. a critical issue threatening democrats support in a must win state for the harris campaign is expecting upwards of 40,000 people there now anticipating for her speech tonight here in d.c. that is expected to have a focus on turning the page. that's a key message from her. and as she's delivering that, former president trump will be rallying supporters in pennsylvania. laura. all right. here we go. final stretch. alice, thanks so much. and nbc news reminds you to get out to vote this november fifth. for more information on how and where you can vote, visit our website nbcbayarea.com

crazy hours and shifts to support the family and the business. jones and her family own a churro shop in hollister. flowers are now there in her memory. chp is still looking into what caused that man's car to cross the center line. happening today, san jose leaders present a new strategy to boost safety along a busy corridor in east san jose. hundreds of businesses along tully road near eastridge mall recently formed their own improvement district. the group is already taking steps to try to beautify the area. later today, mayor matt mahan will announce a new plan to roll out two new portable camera trailers. that's when cameras are mounted on small trailers to try to deter crime. today's news conference is scheduled for noon. also today in san jose, city council members will take the next steps in approving a new speed safety cameras. they will happen across the city. now, the $10 million plan calls for 33 cameras to be installed in some of the highest risk areas. violators caught speeding
6:10 am
will receive their tickets through the mail. today, the council is expected to sign off on an impact report. this is required by state law and agree on plans to find a service provider. those cameras are not expected to roll out until sometime next year. well, let's roll out our own little camera. taking a live look at san francisco from mount san bruno mountain this morning. kari has got a look at our forecast waiting for the sun's arrival. but will it warm things up that much? no, it's going to be kind of a cool day. and mainly this morning we are going to have those cool temperatures, and we're also going to be dry behind the system. that brought some of us some rain yesterday. now that has moved off to the east, we turn our attention to the next one coming in. and this one arriving by tomorrow night into early thursday morning. let's time it out here. hour by hour. we're at midnight on thursday and it's going to start out with some rain in the north bay. and then quickly make its way its way across much of the rest of the bay area, clearing
6:11 am
out before those trick or treaters hit the streets on thursday night. and we're looking at more of the same temperatures with highs in the mid 60s. i'll be tracking all of the changes for you. there's more rain ahead for the weekend. that's in a few minutes. mike's been seeing where we can find some lower gas prices. yeah, we have a little bit of change even lower in contra costa county. has the best price still in the bay, but it's now 369 at concord. valero on willow pass road at the top here. san jose has the next with the best in south bay. 395 at dimond gas and market on winchester boulevard. and then the last number here in the north bay. fairfield has solano county's best. that's 405 at bonfire on walters road. remember, you can always go to gasbuddy.com to report or to read those reports on the maps. we're reading the sensors mostly green still, but building. and it's tuesday, so the volume bigger. we're continuing to track this crash. west 580. the cars have been removed from the freeway, but there was debris that actually was involved in the crash that might be being cleared. there's still some slowing heading toward macarthur. clear. by the time
6:12 am
you pass by, high street. the other incident was a roadside. not not fire, but smoke reported in the area. so i'll track that as the reports have no lanes blocked, a smooth flow toward your bridges. richmond bridge, the bay bridge. show the backup. there's the richmond bridge heading over toward the north bay. more popular now. back to you. thanks, mike. all right. well, it once hosted celebrities and politicians, and now it could be part of yours. yes. next year, the massive estate now up for sale in tahoe. and how actually, you could get in on a piece of this historic ranch. and if you think you know who's going to win the presidential election, there are new ways to bet on it. let's go out to the futures. essentially, a bet that traders make on the open. and they're never wrong. looks like we're going to trade to the to the downside. calling all chefs. okay. not really. only ones that look like jeremy allen white. the competition now set to get underway inspired by the bear actor. and you won't believe the prize for the winner. keep it here. you're

san francisco is in crisis and we need real experienced leadership. we need mark farrell. our interim mayor who got things done. who showed we can clear tent encampments, fight crime, and address the drug crisis. who will make the tough choices for our city's future. "i'm mark farrell. i'm running for mayor because san francisco deserves better." "i'm ready to deliver that change on day one." mark farrell. a proven leader with the experience we need. at 9:00. we're still in the 50s. it will be a cool morning and only headed for the mid 60s for this afternoon. enjoy the sunshine tomorrow. more clouds roll in. we'll get a look at
6:16 am
some rain on the way. coming up in a few minutes. and right now the peninsula picks up the volume on the southbound side. those headlights were pretty scarce until just a minute or two ago. now we're seeing both sides with more traffic flowing. tail lights smooth in towards san francisco. we'll show you how the rest of the bay is shaping up this traffic tuesday. well good morning. very happy tuesday to you. a lot of big tech earnings this week. we get google today meta microsoft tomorrow apple that comes on thursday. apple has released its newest ios giving newer iphones some ai power. new mac computers to. starbucks is asking its office workers to come into the office more often, or face dismissal. this despite the fact the starbucks ceo doesn't even live in seattle or washington state for that matter. he has a satellite office at his house in southern california. last week, moody's downgraded san francisco's credit rating in part because of the lack of people returning to the office. empty office buildings, lower
6:17 am
rents could mean lower tax income for the city. one bright spot, though, has been tech and artificial intelligence. in particular, new companies opening locations. and this week, a lot of companies are getting a taste of the city as techcrunch disrupt gets underway in san francisco. the yearly conference gives startups a chance to show off and brings hi tech leaders from all over into one spot. there is a lot of excitement, and there's also a lot of excitement about being in san francisco. specifically, i think. i think the city gets sort of a hard a knock in the national press. but, you know, it's very clear that everyone wants to be in san francisco. we're seeing all kinds of excitement. and the fintech app robinhood will now let you bet on the election by buying an option. now, this is not a new idea. financial markets make bets on all kinds of things, from the price of wheat to the chances of a catastrophe. the thing is, these bets tend to be
6:18 am
super accurate. people make very careful decisions when money is on the line. here's what the robinhood app looks like with your choices to put money on harris or trump, you get a payout. if your candidate wins. now these can be gamed. there are other systems that have been gamed with lots of money just to make one candidate look good. but again, these tend to be very accurate. shortly after the nine over 11 attacks, the government flirted with the idea of creating a terrorism marketplace where you could bet on terrorist attacks, and everyone realized that would be tacky and insensitive. but the idea was it would have worked. probably people doing their research. yep. all right. thanks, scott. well, new at six. if you ever dreamed of owning an exclusive piece of lakefront tahoe property, now is your chance. do we even have to say this though? it's going to cost you. realtors are now listing an enclave known as shakespeare ranch, which spans 132 acres on the nevada
6:19 am
side in glenbrook. this is tahoe's only gated lakeside golf course community, and it can all be yours for a mere $188 million. the property actually includes 17 residences and cabins, but they also list those separately. and those prices start at 10 million bucks. so there you go. get yourself a little something. okay. we could be neighbors as well as anchors. yeah, let's work on that. yeah. work a long time. well, speaking of work, some bittersweet news here for the warriors as they take on new orleans tonight at chase center. so steph will miss the next two games against the pelicans. this is due to his ankle injury. he actually heard it on sunday night as the warriors lost to the clippers. now here's the upside here. it's only an ankle sprain. he will be reevaluated on friday. this is before the team heads over to houston on saturday. well tony for you this morning following the wild success of that recent

timothee chalamet lookalike contest this weekend, there's now a call out for all the jeremy allen white lookalikes. that's right. so look at this poster that's being circulated throughout new york city. a lookalike competition supposedly set for november 17th at washington square park. the winner gets two packs of cigarettes and a seven day metro card. okay. by comparison, the winner of this week's shamier little lookalike contest received 50 bucks, and they were very surprised there, as the oscar nominated actor himself, he crashed the event walking on through. no word yet if white will show up in november. i kind of like all these contests popping up, especially the prizes. they're great. i mean, i guess i think if you really do look like him, you know, it doesn't cost you anything to just go and, like, look at me. do i think he looks like gene wilder? yeah. a lot of people are saying there was a rumor that he was the nephew, but he's apparently not. yeah, they should have done the contest in. that ties the two contests
6:21 am
together. they should have done the contest in chicago where the bear is set. that's where the oh is that where they do? i haven't seen the show. and he smokes like a fiend. that might be why they. oh, there you have it. hopefully they have a permit this time. yeah. police! don't clear it out. so okay. timothee chalamet did not have a permit. that's why we say that. but he didn't put on the event. no he did not. that contest i'm saying but yeah. all right well back here at home dealing with something we don't need a permit for this forecast. yeah. it's fall. and so it's like this is what we're supposed to see. this finally, finally. it starts out chilly. we're at 43 now in walnut creek. 49 in san francisco. and also upper 40s for san mateo and 51 now in san jose. now we're headed back to the mid to upper 60s for this afternoon, which is actually a little bit cooler than normal. so we're going to see this weather over the next few days with upper 60s and los gatos for the east bay, it will be up to 71. in antioch and concord and 66 in hayward. we can leave the windows open through the afternoon, enjoying the milder weather and it's going to be in
6:22 am
the mid 60s for much of the peninsula into san francisco. a little breezy at times, not as windy as it got yesterday, but we're still looking at a light northwesterly wind in the north bay. 69 in santa rosa and 68 in sonoma. tomorrow, clouds will start to move in and we're getting ready for more rain. much needed rain at this point, especially for the north bay where we will have the best chance of at least measuring something. it's in and out of here before you can go trick or treating on thursday night. that's the good news, is that we're mostly looking at the rain early. early thursday morning. and as far as the totals, about a quarter inch to 3/10 of an inch of rain for the north bay, a 10th of an inch of rain from san francisco on southward for the sierra. another system coming in this weekend could possibly bring in a decent amount of snow. check out what the computer models are showing now. the possibility of nine inches of snow for south lake tahoe and 15in of snow for
6:23 am
kirkwood. so that's going to be really exciting to see that getting going right in time for november. and we are going to see for halloween cool temperatures. keep in mind it's going to drop very fast on thursday evening. we're headed down to the low 40s, and then there will be another chance of rain on saturday with highs in the mid 60s. mike, you're tracking that east bay buildup. yeah. no surprise. we have the backup at the bay bridge that's held steady. the good news is those hov lanes continue to mov. well so does the span. it's the metering lights that holds folks up over here. got all this traffic coming down the east shore freeway. now a steady bit of tapping on the brakes from pinole all the way down to the berkeley curve. smooth drive through the maze. still watching the crash at macarthur, but no more slowing for westbound 580 approaching the area. i think they might have cleared up the debris. this may be cleared from the chp report in the next few minutes. meanwhile, 880 moves very smoothly northbound and southbound, with slowing over by the san mateo bridge. and that second build for san jose is on for 101. back to you. thank you mike. 623 this morning,

there is fair adaptation. adaptation across the region. researchers from next i-10, an independent, nonpartisan organization along with uc berkeley students, studied six at risk neighborhoods in san rafael, san francisco, alameda and parts of the east bay shoreline. they say we need to think outside of the box with property rules and ensure environmental justice. part of their recommendations include establishing community land trusts and planning sites around the bay area that accommodate residents displaced from flood prone areas. property is a big part of the inequalities that we see in our cities around us, right? so some groups of people have had access to building wealth through property for generations or centuries, and others have been systematically sort of marginalized and excluded from that process. and we think as we rethink property for the age of climate change, we really need to focus on how to redress those inequalities and those injustices as part of that story. we do have time, but
6:28 am
but only if we start now, and only if we kind of bring all of the innovative thinking of the bay area is famous for to bear. in thinking about how do we create a more, just a more just bay as we adapt to sea level rise, sea level rise will require our attention for a very long time, and that means working together for solutions that help everybody. we're going to put this link up to this report on our website if you'd like to read it and share. visit our website nbcbayarea.com and click on the climate in crisis tab. and we'll have more right back after this break.

i'm sam liccardo, and i approve this message. evan low. caught again. his tactics called "outrageous" and "self-serving." slapped with charges that he illegally used banned corporate money for his campaign. low's already under investigation for running a corrupt scheme to give political access to big money donors. but when it comes to fighting for us... low's missed nearly 1,000 votes...
6:31 am
and you look around, it's just dirty and dingy and crime everywhere right now. at 630, oakland business owners fed up and going on strike. the way they plan to protest the city's response to ongoing crime, we are now one week away from election day, and the candidates are making their final arguments to voters. and governor newsom weighing in on a tight race in the south bay. the candidate he's now throwing his support behind. this is today in the ba. here we go tuesday morning. thanks for starting your day with us. i'm laura garcia. and
6:32 am
i'm marcus washington. time to get a look at that forecast for you. meteorologist kari hall is tracking what we can expect outside this morning. cold temperatures indeed. saw a little bit of rain yesterday. what about today? and today? we're all dry. tomorrow rain chances come back. so a lot of changes as we go throughout the rest of the week. and wow. yeah. take a look at these temperatures and what you're stepping out the door to it is 39 in calistoga. it's 40 in danville. and we're seeing a lot of 40s on the map this morning. so we do need a heavier jacket. it is 46 in morgan hill, and we're in for a lot of sunshine and a very gradual, warm up as we go throughout the day. it's going to stay below normal with a high of 68 degrees in morgan hill, 64 in fremont and 69 today in napa, and also some mid 60s for san francisco. tomorrow we'll be watching those clouds rolling in with more showers, but will it affect your halloween plans? we'll talk about that. but mike, cocoa county seeing more snow. yeah. on your side of the map. the typical out of pinole and in through richmond, out of richmond, across the bridge and
6:33 am
into walnut creek, right there on 680 southbound. in fact, let's time out some of those routes getting over here through contra costa county, out of pittsburgh and down into walnut creek itself. even taking kirker pass road sees a lot more slowing now. so that means ignacio valley road going to have much more traffic through that diagonal cut there. meanwhile, the rest of the bay pretty standard for your bills sunol as well as the 880 corridor down through hayward and across the san mateo bridge. just the last few minutes have seen a lot more westbound traffic. no incidents. that's just your commute, right now. back to you. busy out there. thank you. mike. 633 right now, with one week left in the effort to recall oakland mayor sheng thao, local businesses are protesting her handling of crime in the city. today in the bay's bob redell joins us live this morning with more on a strike that's planned for later this morning. these are local business owners, and they're pretty fed up. you are correct. good morning to you, laura. later this morning at 11:00, a handful of businesses in oakland will go on this symbolic strike. they'll be shutting down their
6:34 am
businesses for several hours, and then they will gather at the oakland city hall again at 11, at the plaza in front to protest what they say is the ongoing problem of crime in their city. you might recall the first business strike in september of last year, when more than 200 small business owners closed their doors for several hours, which organizers believe was the catalyst catalyst for the recall effort of both oakland mayor sheng thao and alameda county district attorney pamela price. the people behind the strike say this is a call to action for citizens to, in their words, if they want to see an end to this crime wave, they need to look at the city's leadership. don't make this general election just about the president and those higher office. but let's keep in mind how important it is to take care of these local issues, because these local issues have not been addressed properly and now is our time to make that difference. yesterday, at a news conference, oakland mayor sheng thao announced the biden-harris
6:35 am
administration has granted her city $2 million to address gun violence. the mayor says oakland is already on the right track when it comes to crime reduction, with opd reporting a 33% decrease in the homicide rate compared to this time last year. but the mayor was asked about the fact that many oaklanders still don't feel safe in their own city. at the end of the day, of course, there's a sense of feeling safe, and that is incredibly important. and all of us, we all have a responsibility in ensuring that our community feels safe. i can tell you that crime is down, crime is down, and you cannot hide bodies. so we know that those numbers are accurate. but at the same time, we have to promote the great positive stories of oakland. i don't believe that we do enough justice in promoting that positive narrative of oakland. as we've been reporting, governor newsom has sent in chp officers to help opd fight crime over the past year. according to the state, chp has made more
6:36 am
than 300 arrests, seized 600 cars and removed dozens of illegal guns in oakland over the past two months. later tonight, the oakland city council is holding a special meeting to discuss violence prevention and the shotspotter gunshot detection system. leaders recently approved renewing a contract for the system, a dispute growing concerns that false positives could be overwhelming. the city's dispatch system. reporting live bob redell today in the bay. all right. thank you for the very latest there, bob. well, a man in san francisco struggling to survive after police believe he may have been stabbed on a muni bus. it happened just before five last night near geary and 14th avenue in the richmond district. there's no word yet on how the victim is doing, but those injuries are described as life threatening. if you saw what happened. sfpd would like to hear from you. and just into our newsroom, longtime ally to former president donald trump, steve bannon is now out of prison. bannon was sentenced to
6:37 am
four months behind bars for defying a subpoena. and the congressional investigation into the january 6th insurrection on the u.s. capitol. he was released early this morning from a federal facility in connecticut. bannon is also expected to resume his podcast later today. he is asking a full appeals court to overturn his convictions after they were upheld by a previous appeals court panel. 636 for you this morning and we are now just one week away from election day. here we go. scott mcgrew you're reminding us that's not when voting starts. it's when voting ends. right at the end of election day. it is over tens of millions of americans have already turned in their ballot. next tuesday is the last chance to vote, either by dropping off a ballot or showing up in person. used to be we all went to the polls on election day. these days, many americans get it done early. looking at the campaigns this morning, the trump campaign trying to distance itself from some of the speakers at trump's madison square garden rally, particularly the speaker who called puerto rico a floating

island of garbage. while puerto rico is part of america, it does not have a vote in the presidential election. but americans of puerto rican descent are going to be important in places like pennsylvania. here's vice presidential candidate jd vance. i think that we have to stop getting so offended at every little thing in the united states of america. i'm just i'm so over it. now, georgia is going to be a key state as well. that's where donald trump was campaigning monday in atlanta. he said several times he is not a nazi. the newest line from kamala and her campaign is that everyone who is in voting for her is a nazi. we're nazis. you know, years ago, my father, i had a great father. he's a tough guy. he used to always say, never use the word nazi. never use that word and say never use
6:39 am
the word hitler. don't use that word. it's like i didn't even know why. don't use that word. and then i understood it. and yet they used that word freely. both words. they use it. he's hitler, and then they say he's a nazi. i'm not a nazi. i'm the opposite of a nazi. now, to be clear, harris has not called trump a nazi or hitler. trump's chief of staff did make news last week, saying trump fit the definition of a fascist. but he didn't say nazi either. preparations are underway just outside the white house for vice president harris's speech tonight on the ellipse, the same spot where trump declared he and his supporters were going to march on washington and the capital. earlier, harris campaigned in ann arbor, michigan, while bruce springsteen and barack obama campaigned for her in philadelphia. here's a good rule if somebody does not respect yo, if somebody does not see you as
