tonight. we'll start with the presidential campaign now in its final week, election day is a mere seven days away. >> vice president kamala harris is set to deliver her closing argument as she calls it tonight in washington, d.c., she'll be speaking at the same location where former president donald trump rallied his supporters on january 6th, 2021, before the attack on the capitol. the former president is campaigning today in the battleground state of pennsylvania. >> tens of millions of americans have already voted early in this election and both campaigns are now focused on making their final pitches to voters especially in those key swing states. let's start our coverage with gabe gutierrez, he's on the national mall, or actually at the white house in washington, d.c., gabe, vice president harris is expected to urge voters to quote turn the page on the trump era, what else is the campaign saying about her expected speech tonight on the national mall? >> reporter: hi, there, actually

heading over the ellipse within the next few moments, but yes here at the white house for now, but the location of this speech tonight will be very significant the harris campaign believes that choosing such a location in the shadow of the white house near the national mall, really will speak to the gravity of the office and vice president harris is trying to make that case. that she's better suited to be president than donald trump. and she plans to establish this contrast, right, between what she plans to do and what former president trump would do if he were in office and the second reason they chose this location is because the former president did speak at the ellipse on january 6th just shortly before some of his supporters attacked the u.s. capitol. now the vice president previewed some of her speech tonight with interview with popular radio show the breakfast club. listen. >> i asked people to imagine the

oval office, it's either going to be donald trump sitting behind that desk writing out his enemies list or it's going to be me working on behalf of the american people. >> reporter: that's an argument that the harris campaign really plans to hit over this last week that donald trump in their view has a hit list while vice president harris has a to-do list. >> gabe, while the vice president is in washington, d.c. the former first lady michelle obama is going to be holding a rally in atlanta, they appeared together in michigan over the weekend, what too we need to know about this event with michelle obama and what's the strategy. >> reporter: look, it's a star-studded event according to the campaign, and this is just shows that the former first lady is now taking a more active role in this campaign in this last week as you said, she was involved in that rally in michigan over the weekend, this

event in atlanta will include other stars, really part of this last-minute effort to get to those persuadable voters and those voters that democrats feel may not perhaps turn out to vote, they're hoping people like michelle obama, former president obama, in this battleground blitz that vice president harris is undertaking over the next couple of days will be enough to convince them. at the same time as the vice president's speech, the former president will be holding a rally in allentown. >> after 48 hours after a speaker at really in madison square garden. garrett haake covers the trump campaign.

garrett, mr. trump reportedly said he didn't even know the comedian who made those remarks, what is the campaign doing to try to stave off criticism ahead of this rally tonight. >> reporter: they made a halfhearted effort to separate this comedian from this campaign, his views or at least that joke didn't reflect the views of the campaign. but the campaign is mostly trying to push past this whole controversy, trump described the entire event at msg as a love fest in his earlier remarks earlier today and running mate j.d. vance said that people need to let jokes be jokes. and not be offended if they don't like what they hear. there's something else we'll be talking about by tomorrow and they don't have to really deal

with this in a head-on kind of way. >> reporter: the former president held an event earlier today at mar-a-lago that focused heavily on migrants and crime, to your point of trying to shift the focus here, what did trump say there? >> reporter: yeah, donald trump believes that immigration and what he calls migrant crimes sort of combining the migration issue and crime will be the issue that decides this race, the message he was trying to put forward at mar-a-lago. he did bury one new policy idea that was a boiler plate series of remarks, another way to go after cartels and transnational gangs. listen. >> today, i'm announcing that for the first time under my administration we'll be seizing the assets of the criminal gangs and the drug cartels. and we'll use those assets to

time. one week out from the election day, safety of election officials and workers is top of mind. >> they're facing increased threats as november 5th does draw closer. stephanie gosk shows us the new measures to keep people safe. >> reporter: with early voting under way nationwide. a growing list of alarming incidents in the buildup to election day. multiple ballot box fires in portland, oregon and vancouver, washington, where hundreds of ballots were destroyed. authorities say this suspect vehicle was spotted at both sites, but they haven't made any arrests. >> acts like this are part of it, and they're intentional, and we're concerned about that intentional act trying to affect the election process. >> reporter: in a texas voting center where campaign materials are not allowed by law, a man allegedly assaulted an election clerk who told him to remove a

maga hat. >> i can't think of anything like this happening during my time here as sheriff, and i certainly hope to never see it again. >> reporter: with election worker safety among their concerns, state and local election officials say they put in a range of new security measures since 2020. there is bulletproof glass. at the hartford board of election committee. and in maricopa county, arizona, snipers will be set up on the tabulation center's rooftop. in philadelphia, mail-in ballots will be counted in this warehouse outside the city center. >> count all legal votes. >> reporter: four years ago, the count looked like this at the convention center downtown. >> we will have a very heavy law enforcement presence. >> reporter: the city commissioner says this time around they have more control with gates, fences topped with barbed wire and multiple checkpoints. do you feel like you need that security? for this election. >> unfortunately, i think it's necessary. we have to be prepared for the

addresses it at the rally tonight remains to be seen. >> a critical swing state, too. george, thank you. immigration and abortion rights are two of the key issues for voters this election and in the swing state of arizona, they're motivating voters on both sides. liz kruetz shows how these could impact the presidential race. >> reporter: in arizona, two issues are shaping two sides of one very divided political race. >> this is the first election that you have done what you're doing. >> absolutely. >> reporter: outside phoenix abortion access advocates going door to door targeting registered democrats who don't always vote, thinking this is the issue that might change that. >> arizonians from across the political spectrum, they degree with us that pregnant patients should have the freedom to make

when you throw them back. and who doesn't love a good throwback? ♪♪ now with vitamin d for the dark days of winter. news daily. i'm audrey asistio and just into our newsroom, david depape, the man who attacked nancy pelosi's husband in their san francisco home, was sentenced to life without parole on his state conviction. it was two years ago yesterday that david depape broke into the pelosi home looking for nancy pelosi, saying he wanted to kidnap and hold pelosi hostage. we are stopping the video, but this is the moment when san francisco police tried to move in and depape hit pelosi's husband, paul pelosi, with a hammer. our legal analyst tells us that with this sentence, the judge intends to send a message.

this is on the eve of our election, and what occurred here was an assault on american democracy, not just mr. pelosi. and the message is being sent that we are going to take this kind of behavior very seriously. and mr. depape will spend the rest of his life in prison for what he did. and i think that's the message being sent not just to mr. depape, but to the community and to the country as a whole. and that was the same message. u.s. attorney general merrick garland sent after a federal court sentenced to 30 years in prison while two long federal and state sentences might seem redundant, our legal analyst says they serve as a safety net in the event something changes on appeal. already, depapes legal team said they will appeal the state case. they said his conviction on state and federal charges amounts to double jeopardy. and because the case weighed so heavily on depapes conspiracy theory connections. our legal

analyst says an appeals court might take issue with something else as well. what never came through in this trial was mr. depapes mental state. and will an appellate court look at this case and ask, why wasn't his mental health problems brought to light during this trial? to reflect on what he did and whether that affected his behavior and before the sentencing for his attack on paul pelosi, depape had a chance to address the court and the pelosi family. san francisco leaders are considering a plan to pay people to stay sober. back in july, city supervisors proposed a new program called cash, not drugs. it would be a sobriety and recovery program. people on public assistance would receive $100 a week by continuously testing negative for drugs and alcohol. mayor london breed has already voiced her support of this idea. the board could hold a vote on the measure as soon as today. all right. well, it looks like the

cooler weather is here to stay. here's meteorologist kari hall with the details. high temperatures today matching yesterday's highs in the mid to upper 60s. but we won't have to deal with clouds or any spotty showers expected to top out at 68 in morgan hill and 67 in danville. 71 in concord and oakland, 66 half moon bay will stay in the 50s today. a little chilly there and along the coast, while san francisco will be in the mid 60s and for the north bay some mid to upper 60s for highs this afternoon. we're also going to see the cooler than normal temperatures continue into tomorrow, but there will be some more clouds coming in before we make it to the weekend. and we're going to talk about all of that and what to expect in our 7-day forecast coming up in about 30 minutes. all right, kari, thank you. san jose city council will take the next step today in approving new speed safety cameras. the $10 million plan calls for 33 cameras to be installed in some of the highest risk areas. drivers caught speeding will receive their tickets through

the mail. the council is expected to sign off on an impact report required by state law and agree on plans to find a service provider. cameras are expected to roll out sometime nextear, and city leaders also have aew strategy to boost safety along a busy road in east sajose. hundreds of businesses along tully road near eastridge mall recently formed their own improvement district. the group has already taken steps to beautify that area as well. and now the district is getting some new technology to help reduce crime. mayor matt mahan is announcing a new plan to roll out two new portable camera trailers. so basically, their cameras mounted on small trailers, which the city says will help deter crime. mayor's press conference is going on right now. our marianne favro is covering the story. she's going to have more details for us in our evening newscasts. okay. it took ten games, but the sharks finally got their first win of the season last night. with less than five minutes remaining, they were still down 4 to 1 to utah, but a magical run of goals

on a scale of 1 to 10, how anxious are you about this election. >> i would vote eight. >> a new survey shows 69% of americans now say the election is a significant source of stress in their lives. >> i'm not sleeping real well at night right now. >> reporter: a whopping 72% say they're worried the election could lead to violence. 73% are stressed about the economy, with women more likely than men to be stressed about how their lives will be impacted by the election. >> i just wake up every day with a pit in my stomach. >> reporter: here in the crucial battleground state of georgia, democratic voter alicia simpson says election stress has affected her day-to-day life. >> i'm in the best shape i have ever been in in my life because i exercise like crazy to get rid of this anxiety. exercising indoors because outdoors there are political signs everywhere. >> reporter: so you have to exercise indoors to avoid seeing the yard signs? >> yes. >> reporter: while this entrepreneur, a republican, says his stress is tied to his

jpmorgan chase is suing those who withdrew the highest amounts directly. brian, jpmorgan chase has filed these lawsuits, what exactly are they seeking here. >> reporter: they're going after individuals they alleged committed check fraud through this trend that was going viral on tiktok, infinite money trend. they were depositing a check for $300,000 but then before the company and the bank recognized that money and that check wasn't legit they would try to withdraw it from the atm before the check bounce. now, the nation's largest financial institution it's not about the money but sending a statement, don't commit check fraud it's illegal and violates their term of service. >> civil suit going, could there be criminal charges and can we expect to see people maybe who

dangerous some viral trends can be. this is what social media can do, it amplifies, gets a lot of enga engagement, this is one example. >> brian, thank you so much. subway is being accused of misleading customers with its sandwiches. now leading to class-action lawsuit. here's christine romans. >> you wanted a spicy deal? subway delivers. >> reporter: the plaintiff accusing the restaurant chain of grossly misleading customers after she bought a steak and cheese sandwich that the suit says contained 200% less meat than the heroes depicted in subway's ads, her suit arguing that subway's actions are especially concerning now that inflation, food and meat prices are very high, adding many consumers are struggling financially. >> wait.

subway did what? >> reporter: and the suit says other subway customers noticed shrinkage. >> this one looks really, really skimpy compared to the picture. >> reporter: similar lawsuits filed against wendy's, mcdonald's were dismissed last year. this is not the first time subway has come under fire. for not meeting customers' expectations. like this mystery meat lawsuit filed in 2021. >> two california residents sued the restaurant chain claiming that an independent test of the ingredients revealed that the sandwiches are made from, quote, anything but tuna. >> always a bad day when you have to launch an independent test to prove your tuna is, in fact, tuna. >> reporter: the famous foot long sandwiches weren't actually a foot long. both of those cases were eventually dismissed. >> where the chicken at? >> reporter: over the summer, chipotle receiving criticism

she taught us to have patience, trust and a positive outlook on life. well, you see right here, leaders of the latino community are rallying in oakland today in support of proposition six. prop six would end forced labor in california prisons. california is one of only 16 states to allow this practice. the supporters of prop six say it would push prisons to provide rehabilitative work. opponents of the bill have cost concerns. they say the state might have to pay prisoners more for their work. currently, most prisoners earn between 16 and $0.74 an hour. california state assembly member liz ortega spoke at today's rally in support of the measure. so i'm here to urge every californian and especially i'm going to say it one more time. latinos must vote yes to make sure that we pass prop six and that we end this injustice for a brighter future in
