know it. let's try to answer the when question with chuck todd. chuck, good to see you. you just wrote a really extensive and thoughtful piece for nbcnews.com and it was about where we are in these final days of the race. what you're thinking about as we head into next week. where do you see the state of the race right now? do you think we'll know the winner by election night. >> all the data points to obviously that it's a tie and i think there's no new data that will tell me anything because i think the final undecided voters is an unpollable voter, i do think especially when you have two candidates who are not popular, you'll have a slice of voters who don't either, who won't decide until election day, it's an unpollable piece of that electorate, if this is a decisive margin for either one of them we have to accept the

premise polls can be right they can't poll that late deciding voter who shows up and decides, okay, i'm going in this direction, so it's just a reminder that there's different ways this could break out. different ways the polls can be right and wrong at the same time. or they could have been wrong from the get-go. as far as election night itself, lot of folks are wondering, last time it took a week, it still might take a week, if we're waiting, if arizona and nevada are going to be the decisive states to see who gets to 270 that will take a week because of how they count their ballots. if you want to pull one-nighter with us, stick around with us until sunrise, i think we'll know who won pennsylvania and north carolina. the same candidate wins, check mate. if they split it, okay, go get

for the other. it's just the way statistics work, what's a very important piece, and again you may have to go back to college math, but it's just statistically almost impossible to get all of these polls to conform within a three-point margin, and so what they're speculating, and it's possible pollsters are afraid of looking like they're off so instead they're quote hurting and they weigh things, i can give you -- i have noticed weird cross-tabs. you'll see a poll that's 50/50, but somehow harris will only be leading younger voters by four but leading seniors by like 15. you're like something's wrong there. >> all right, chuck, we'll be there together with the coffee. good to see you. >> i won't need coffee. come on, we got all that data

bit of an ankle injury clearly not a problem on the sport's biggest stage. unbelievable. morgan chesky, thank you so much. significant new developments in the federal criminal case against music mogul sean "diddy" combs, nbc news has learned a new. >> reporter: new york grand jury is going to be hearing evidence this afternoon as part of their ongoing federal investigation into sean "diddy" combs, we know it's a man who's going to be testifying before the grand jury, we don't know his name on what he'll be saying. earlier this month at a hearing for combs i was actually in that courtroom in manhattan where we heard a u.s. attorney and one of the prosecutor said there might

be a superseceding indictment, that means combs could face more criminal charges, he's set to face this trial on may 5th, the trial could last a little bit longer or gets moved back, currently he's behind bars awaiting trial at the metropolitan detention center in brooklyn. the civil cases against him, he's facing over a dozen different civil cases, and some of those lawsuits have been filed by an attorney out of texas, he just filed two more cases on monday and all of the accusers in his civil suits are anonymous and we've seen that with other civil suits that have been filed over the last several months. combs has denied the accusations against him, both criminal and civilly. what's interesting last night a u.s. district court judge ruled that one of the accusers in one of buzby's civil suits who's

today. simply walking in your neighborhood shouldn't be one of them. here's nbc bay area's kris sanchez with some reminders. i'm in downtown willow glen, which will be packed later on today, as it's a tradition for businesses here to hand candy out to the kids. this is a known spot. another known spot is santana row in san jose, and these are areas where people expect to see a lot of foot traffic. but of course, kids of all ages are expected to be out in neighborhoods all around the bay area, and some of them might be in costumes that make it hard for drivers to see them, especially when they're not

using crosswalks. children are 3.5 times more likely to be hit and killed by a car on halloween than any other day throughout the year, so it's really important that we're hyper vigilant, not only as drivers, but as we're taking our kids out into the community just to make sure we're extra aware. kids get excited, they may dart out, and we just want to make sure we're keeping everybody safe. san jose police and other agencies remind us to watch for tripping hazards, especially the bottom of those costumes. use flashlights and reflective tape to make your trick or treater more visible, and use the crosswalks. make sure also that you make eye contact with drivers so that you know that they see you. and for the grown ups, it goes without saying don't drink and drive. as for the candy folks at poison control say to inspect your child's candy before they eat it. throw away any candy without wrappers, labeling or which you don't recognize, and avoid the homemade treats unless you know for sure who made them. check for choking hazards for the little ones and put medicine out of reach, because some of it can

and we just said he's still giving the money away. >> there's a hearing this morning, last night the musk team filed some paperwork to move the case to a federal court instead saying, look, we're a political action committee, now that means the case is essentially on hold right now, it cannot move forward. there was a hearing earlier today that musk was ordered to attend. he doesn't show up. they called that cowardly. the musk team doesn't care right now because they were successful effectively moving it to federal court and given that delay. there won't be a resolution until after the election. they're still giving it away. we asked for a response from the team, from counsel, they're not responding they're pointing to those posts on x.

as we get closer to election day, conspiracy theories, misinformation and disinformation are rapidly spreading online surrounding our vote. >> one example that's gone viral is in battleground pennsylvania. video posted to x claims to show an illegal harvesting of ballots in reality the local county executive shows a 25-year veteran of the postal service lawfully dropping off ballots at the election office. we're tracking stories like this. jane, you're doing such important work. part of confusion and misinformation being spread online lot of people aren't familiar with the process of collecting and tabulating ballots, bottom line, have we seen any proof yet of irregularities. >> no, nothing that's going to task outcome of the election, we've seen some bad voter

registration applications that were fraudulently done, they were caught by routine processes in the election that look, when people register to vote they are who they say they are. >> we told viewers yesterday, jane x about how law enforcement officials are concerned about the role of foreign actors in spreading false information, what are local officials doing to combat that this cycle. >> election workers are trying to get ahead of everything and pre-bunk, talking about putting things on, you know, official websites, getting out ahead if there's confusion or misunderstanding about a process. election officials are doing a lot to make sure there isn't

room for con sspiracy theories. explain them to themselves as they watch. >> we heard from chuck at start of the show, chances we won't get a projected winner on election night. what information should people prepare for. >> knowing that it might take a little while to count the results. close elections tend to be harder to call and it takes time to count those ballots. election officials say they're in the business of getting correct answers not jumping the gun. >> all right, jane, thanks so much. the menendez brothers could be even closer to a potential release from prison after the los angeles county district attorney said yesterday he backs

the bid for the brothers' clecl cle clemency. on monday, attorneys for the brothers submitted requests for clemency to california's governor. a week ago the d.a. recommended that the pair be resentenced. there's been renewed thanks to multiple documentaries and a scripted netflix tv show. joining me now is dana griffin who's been following this, explain what clemency would mean for the menendez brothers and what the d.a. is now saying about the case. >> reporter: absolutely, so clemency is essentially reducing a person's sentence who was serving time in prison and in this case think of it a -- they tried different avenues to get out of prison, one petition that was long shot, the d.a. absolutelied a resentencing still on the table and clemency is another way by asking the governor to reduce their sentencing.

this is why they're asking for this, because we got an election coming up, the current d.a. is already down double-digit points we could have a new d.a. sworn in on december 2nd, he's vowed to take another look and review the evidence and if he tries to revoke that recommendation it kind of leaves the brothers hanging, this option would give the governor a chance to grant them clemency. the d.a. wrote a statement, i strongly support clemency for erik and lyle menendez who are currently serving sentences of life without the possibility of pa parole. they've worked to current new programs to support the rehabilitation of fellow inmates. the governor isn't required to consider the application and no deadline for a review. kate. >> dana, separately, there's resentencing hearing scheduled for december, what could happen on that track in.

>> reporter: if everything goes according to plan it will be a status hearing, lawyers will give arguments but the judge will likely set another hearing date to hear from some of those prosecutors in the d.a.'s office who are against this resentencing recommendation, if the judge agrees it goes to parole board and that is a lengthy months-long process where the parole board will decide if they're eligible. it's up to the governor to put his stamp of approval, we haven't heard from his office. they're not commenting. now to today's daily health the cdc have identified 15 new cases of e. coli linked to onions in mcdonald's quarter pounders. so, how can you keep yourself safe? joining us is dr. john torres.

over the last year protesters across the country have been chanting demands for universities to disclose and divest. >> the demands are coming from students condemning what they say is their schools' financial support for israel during the israel/hamas war. demonstrations gained popularity across campuses and social media. what are divestments and how do they work. here are divestments simply explained. >> reporter: for decades students have called on their schools to divest. put simply -- >> colleges and universities have invested funds that are called endowments. divestment means taking out a piece or a part of the endowment. >> reporter: quick history lesson, the first calls began in the 1970s.

holiday gift, but scammers are targeting them. consumer investigator chris kamara shows us how to protect ourselves. protecting a gift card starts at the rack in the store, because that's where many criminals start. before you buy a card, look for tampering. some scammers mess with the barcode. you can feel the sticker. it has a little bit of a ridge on it. former police officer michelle law spotted a tampered card and made a viral video on tiktok. here's the scam. that barcode sticker is for a different gift card that the thief has so any money you load onto that card would actually land on the thief's card. so look for a sticker, take that extra 20s and just kind of feel it. look at i, visually inspect it. you can choose a gift card with extra security. some of them let you set up a pin, especially those used anywhere kind. that might make it tougher for the bad guys
