that, they can go and see, live animals over here in the barn, but then go and play with a great park. lots of space to frolic and be kids. the park spans 46 acres, but recently there was a dispute between the city of san jose and how the emma prusch farm park foundation was handling this small area known as emma's kitchen garden. our concerns around fundraising and communication and operational practices have made it difficult to maintain an effective partnership, and that's why we've decided to conclude those negotiations. the city of san jose has not had an agreement with the farm park foundation for more than a decade, so the city said it would no longer negotiate with the foundation and gave notice to volunteers to remove their equipment. by november 18th. some thought that meant the entire park was getting evicted and posted on social media concerns it would close. we reached out to the park foundation for comment, but have not yet received a response. so
7:08 am
what happens next? in the short term, our park maintenance staff will take over maintenance of the small garden at the park to make sure nothing goes to waste while we develop long term plans. the city says the park will remain open and no scheduled public events will be impacted. absolutely thrilled to hear that the park will be staying as is. maybe even getting better. who knows what they're going to do? marianne favro today in the bay. more controversy for san jose state's volleyball team. the university says its associate head coach is, quote, not with the team at this time. melissa bates smoosh told the conservative outlet she was suspended indefinitely after filing a title nine complaint against sjsu. patti smith spoke with a different outlet, revealing specifics about the complaint in response to the original story. sjsu said it had, quote, significant concerns

about breaches of student and employee privacy. this all stems from reports there is a transgender woman on the spartans squad. the team has not said whether the player in question has come out publicly as trans. but the spartans co-captain joined a lawsuit against the ncaa challenging rules allowing trans athletes in women's sports. since then, at least five teams have refused to play san jose state. this week, boise state said it would forfeit against the for team the second time this season. the controversy has drawn concerns of transphobia and led to san jose state stepping up security around the team. we have more ahead on today in the bay. we can give you a live look at the white house. the top prize in decision 2024. next, we'll chat live with meet the press moderator krten welker aboutis

7:12 am
and welker. live from new york. christian. good morning. who do you have on the show this morning? hey, chris. well, great to be with you. we are going to be talking to governor doug burgum of north dakota and senator raphael warnock of the great state of georgia. we're going to talk to them about the closing days of this race. both candidates closing messages where they think the state of the race stands, and then we're going to be hearing from the great steve kornacki. he's going to break down the results of our latest nbc news poll. why is our poll so significant? well, it's the last poll heading into election day. we had pollsters in the field as late as yesterday. kris so you can't get more urgent poll results heading into that final race. and i can tell you the top line is that this race is still all tied up at the national level. so a lot
7:13 am
to unpack. today on meet the press, kristen, what do you think about the polls compared to four years ago? how much do you think the pollsters behind the scenes have been tweaking their questions and their methods to ensure they get it right? well, look, i think that that's always mission critical for every pollster to make sure that they are getting it right, to make sure that they have an accurate accounting of voters, for example, in 2016. of course, pollsters said that they undercounted trump voters. that's in part because some people weren't reporting how they planned to vote. so there have been a lot of attempts to try to correct for that. and i would just tell you, in addition to our poll, there's a really fascinating poll out of iowa today which shows kamala harris leading 47 to 44%. that's a jump from last month when trump was leading by four points. what's significant? just taking away those top line numbers is the fact that she got that surge based on a rise and increase in

support from older women voters and politically independent women voters. so the question becomes, what does that mean for other states that are demographically similar? those are one of the questions we'll be watching for in election day. chris. chris, let me ask you one more question, a beltway question. what's the tone like in d.c. right now compared to four years ago? oh, i think that everyone is watching waiting. there is obviously a sense of anticipation and urgency. this has been an unprecedented and historic election, quite frankly. donald trump has faced two assassination attempts. joe biden was at the top of the ticket. he stepped down from the top of the ticket, effectively passing the torch to his vice president, kamala harris. for so many reasons, this is an unprecedented moment. so everyone watching and waiting to see what will happen on election day, and you'll be there to document it for us. kristen, thank you so very much. please join christian for meet the press right here at 8 a.m. right

after today in the bay, coming up in about 30 minutes. we'll talk with nbc bay area political analyst larry gerston. we'll take a look at the early voting process and what to expect, or maybe what not to expect on election night. 49ers defensive end nick bosa is not off the hook yet for what he did after sunday night's game. bosa interrupted a reporter's postgame interview with a teammate wearing a make america great again hat. nfl rules ban players from wearing or displaying items related to political activities, causes and non-football events. the rule is in effect the entire time a player is visible to a stadium or tv audience, including postgame interviews. bosa forgive me was not on the list of players. it's early find for week eight behavior, but the league says the league sources are telling us that the nfl might be taking more time to weigh to how discipline bosa. a

celebration of life. now that a new north bay park is open in memory of a seven year old boy. a rolling gate crushed and killed alex kwon back at his san rafael school in 2019. well after the accident, his family wanted to celebrate his life, so they built a park in greenbrae with some of his favorite things. it features a lego structure, a playground, and a garden. the kwon family held a grand opening yesterday with firefighters and first responders who tried to save alex's life. the kwon say they wanted to create a space for the community and to channel their grief into joy and action. this place is actually a bit serendipitous because we used to live up the hill on almanor, and we'd stop by when we'd ride bikes to marin country mart, and we quickly realized that there was no place for children to play. there was obviously a huge grass area, but no, you know, bespoke park. and so we wanted to do this in his honor. just so kids who are at that age where they're so curious and just want
7:17 am
to have fun discovering the world around them, could also participate. the family also says they initially wanted to sponsor a bench, but felt a park offered more to the community. hi guys. check out davies. a packed house at san francisco's davies symphony hall last night to celebrate the day of the dead through music. our own raj mathai was in attendance recording some of that video for us. the orchestra played both traditional and contemporary latin american music, with the audience waving colorful balloons. the festivities included a living altar called frida of the mission, featuring an artist who looks like the late mexican artist frida kahlo, painting in front of an easel. happening now in san francisco. a live look at the golden gate bridge, where you might be able to see a runner or two, or maybe several hundred eventually, because the 23rd annual golden

gate marathon and five-k are underway. there they are. organizers say 7000 people from around the world in total are running right now. the five-k just started the half marathon, kicked off about 20 minutes ago. marathon route goes from van ness avenue to beach street near ghirardelli square. all right. all those runners are up early, being active, showing off. and a study shows. well, we the rest of us might not be getting enough sleep. that's according to the cdc, the centers for disease control and prevention. the agency ranked bay area counties based on the percentage of people who are sleep deprived. so who's that? well, that's anyone sleeping fewer than seven hours each night. cynthia is raising her hand. solano county has the highest rate. 38% of people in solano are sleep deprived. go back to bed, solano. 32% of san francisco residents don't get enough sleep. about the same down here in the south bay. san mateo county has the lowest sleep deprivation level. still
7:19 am
pretty high, though, 28%. experts say a factor for many in the bay area not getting enough sleep is that commute time. how many hours a night for you, cynthia? i don't remember when the last time i got seven was a good night will be like five and a half. six. i can attest to that. solano county one. my grandpa commutes from vallejo down into the city, so he's out the door before 5 a.m. poor guy. love him so much. but solano county, we need to work on that bedtime. at least one extra hour of sleep tonight. last night that i should say, because of the time change. i woke up and i was like, is it really this time? yeah, i think it is this time. and i was, you know, well rested. i guess, for our standards. i was out at oak hill cemetery in san jose yesterday for dia de los muertos. it was a beautiful day, wasn't it? we got another day like that today. stunning. i mean, look, right now, santa rosa, clear blue skies. but the absence of that cloud and moisture from yesterday is bringing down those numbers a little bit. low 50s. they're beautiful through the
7:20 am
city. for those runners, 54, i hope they're wearing an extra layer and of course, more layers needed under that beautiful sunshine though in walnut creek 47 to start our sunday funday. and down here in san jose, a few clouds making their way through the city. but not bad. we should be clearing out of them. not only for today, but the next couple of days as we turn things a little bit more sunny and breezy, though, that's going to pick up as we go on into our afternoon temperatures. a bit more mild than what we had yesterday. we have some low 70s up through wine country 69 in livermore for today, 70 down here in san jose. we're going to keep the mix of 60s and 70s for the inner bay 70 for you there in hayward. we already like i talked about at the start of the show, are in this wind advisory for solano county. notice those offshore winds 20 to 30 miles an hour at times, even through parts of napa county. and really extending through the rest of the bay. so today, if you haven't done so already, bring down those halloween decorations or the wind is going to do it for you. as we go on into the evening hours, everybody tapping
7:21 am
into that 20 to 30 mile an hour wind gusts, especially towards our higher elevations. and that's going to continue as high and low pressure kind of battle it out. i'll explain in just a second. and not really a good day to go out towards the beach. if we're going to be along the water, we do have that beach hazard statement as that northwest swell brings up some breakers up to 10 to 14ft. so if you're going out there with your kids and your pups, make sure you keep an eye on them. here's where high and low pressure are battling it out as those two come together, the pressure gradients in our upper atmosphere kind of become too tightly packed. wind speeds pick up, and that's going to continue through our election day. there on tuesday, even on into wednesday. and watch how those contours here bring up some wind speeds going on into tuesday night. wednesday a lot of purple on our maps, winds drying us out and also bringing slightly warmer temperatures to the beaches. aside from the fire concerns, you're also going to start to be feeling really dry skin. so watch the 7-day forecast here 70 as i mentioned, we get some warmer temperatures.
7:22 am
windy though over the next couple of days. sunny skies throughout the bay area, but san francisco will also be a windy spot to be for those runners later on today. hanging out in the city post run and into the next couple of days, 60s and 70s. so even though we've got those beautiful skies and things are pretty calm, we do have to keep an eye for those fire concerns. the rain yesterday not enough to bring us out of those concerns for the time being. a good day though, to take down the halloween decorations, which you need to do before the winds kick in. yeah, but maybe not put up the thanksgiving and christmas decorations early just way too early. thank you so much. all right. we have more ahead on today in the bay coming up. it's a win. for the record books. we'll show you how bay fc made history in houston with a victory in the team's regular

larry gerston joins us. all right, larry, will we learn the election results faster this time? you're on the spot. yeah. you know what? it's a mixed deal. kris. we're going to learn faster in some states that have sped up their processing new equipment. we're going to learn slower, learn slower. in other states, which have imposed more restrictions on the way that they count the votes. so it's a mixed bag. one thing we know for sure there will be major laggards, and we're not going to like who they are. pennsylvania, wisconsin, arizona, all battleground states will be laggards. in arizona's case, it's because that maricopa county, which is of course, the largest county in arizona, has got a tremendous ballot, two two page ballot, which is going to make it very hard, but the others are just going to take a lot of time because of when they start counting. why is it that some states are more efficient than others? we have no national rules. we have no national rules when it comes to the voting throughout the country. it's state by state, by state. and so

because of that, you've got things like absentee voting, which in some states is easy to get, other states not easy. smaller windows, larger windows mail in ballots. again, some states allow them frequently. other states have cut back on the mail in boxes post election receipt for the ballots. some states say we want them within a day or two of the election. other states allow up to two weeks, depending upon where they're coming from. and then, of course, the recount rules and the processes, these things get very, very cumbersome, especially in this era of conspiracy where people think if a vote comes in late, something has gone wrong. no, usually, almost always, it's just the way things are going. people talk all the time about hidden ballots, about rigged elections. it just doesn't occur. are there countries around the world that do it the same as we do where there's local control? or do other countries do it where there is a national standard for

how votes are cast and counted? yes to both, yes to both. there are there are. does it right. oh gosh. you know some of the countries great britain does it pretty quickly. yeah. okay. but but it really it so depends on some of these countries. you know they have great rural areas and so things can collect, get collected for many many days, weeks sometimes. so it just varies. interesting. all right i'll put you on the spot again. realistically tuesday night or wednesday morning. when will we know if we have a blowout? you know, an election where, you know, it all falls into place? we could know late tuesday night. wednesday morning blowouts are unlikely. if we're going to have an election that's close, it could drag on as long as two weeks before we get all the results, probably by the weekend when we have a good idea. okay. bonus question what's your gut? do you think the pollsters got it right this time? or do you think they're going to have a little bit of humble pie again, like they have the past two elections? the
7:51 am
pollsters got it right because they're close. they're calling a very even election a very even election. and an even election means flip a coin. you don't know. there's going to be perhaps ten, 20, 30,000 votes in each state. several states that could make the difference. and you know what? when you got that kind of thing going, that's tough. and tens of thousands out of millions, that's that's razor thin out of 150, 160 million. yeah, yeah. you're going to be here tuesday night. all night. thank you. we appreciate it. we invite you to join us, too. all right, doctor christian. thank you so much. yes, sir. coming up next, a quick look at our top stories. a new twist for san jose state's volleyball team caught up in controversy
