election and this race is razor tight. the final poll from nbc news has the candidates tied with 2% of registered voters undecided. and there is a gender divide. donald trump is winning over more male voters, while more women prefer vice president harris. we will be with jay gray in just a moment with the latest from the state that could make all the difference. meantime, elon musk is expected in a philadelphia courtroom this morning over the million dollar give aways he's been offering every day until the election. musk's lawyers have tried to have the case moved to federal court but prosecutors say this is not about the federal laws over vote buying. they argue that musk is operating on the illegal lottery and deceiving customers. musk's super pac has not responded to multiple requests for comment. israeli authorities are investigating after the suspected leak of classified gaza intelligence allegedly involving an aide to prime minister benjamin netanyahu. an israeli court saying sunday

the leak compromised security sources and could have harmed efforts to release hostages. it comes the same day the idf announced a special operation in syria led to the detainment of, quote, iranian terror network operative. let's go live to nbc's claudio lavanga. good morning. >> reporter: good morning, frances. well, that leaked document on gaza first appeared on a german newspaper billed on september 6th and it appeared to contain the detailed information about the negotiation strategy of hamas during that time. now, more information about these documents are slowly coming out because an israeli court lifted the gag order on sunday. in the meantime the idf, the israeli defense forces, did confirm that sensitive and confidential information was leaked to the media and that israeli courts said that that information could have caused great harm not only to israel's state security but also to the negotiations to make sure that those hostages that are still in

gaza will return home. now, as you mentioned one of the four suspects for that leak is a media adviser for the israeli prime minister benjamin netanyahu. leading critics to claim that it was done so -- that leak was done so to provide a political cover for benjamin netanyahu at a time when negotiations for the ceasefire and the release of hostages between israel and hamas ground to a halt. in the meantime on the same day, as you mentioned, the israeli defense forces issued a statement saying that in the recent months they carried out a special ground operation in syria during which they detained an iranian terror network operative, this is what they call him, accusing him of gathering information on israeli troops along the border, frances. >> okay. claudio, thank you. let's turn now to our top story. one day to election day and the candidates still crisscrossing battleground states.

nbc's jay gray join me live from bucks county, pennsylvania. jay, that state, that county, could make all the difference tomorrow. >> reporter: yeah, good morning, frances. yeah, look, the leaves here are a beautiful fall, amber and gold, but make no mistake, this county and much of pennsylvania purple right now, split between republicans and democrats, and it is vital for the campaigns. they are both spending a lot of time in these few cross-over states, these states where we don't have a clear idea of who may win here, the swing states as they are called. both campaigns acknowledging that they likely can't win a race that will be decided perhaps by tens of thousands of votes without pennsylvania. so they are courting swing state voters very heavily in the final hours. >> we stand on the verge of the four greatest years in american history. you watch. it's going to be so good.

visiting pennsylvania today, he will have support on the ground as well. he's also going to be in a battleground state of north carolina as well as michigan. should be a busy closeout to what's been a crazy campaign. >> absolutely. crazy is the word. their work is winding down. it will be up to the voters. jay, thank you. now to two white ohio police officers who have been charged in the death of a black male. the entire encounter was captured on body camera video. maggie vespa has the story with a warning, some of the images are disturbing. >> please get him out of here now. >> reporter: criminal charges against two ohio police officers who prosecutors say killed frank tyson in a canton, ohio, bar. body camera video shows officers camden burch and beau schoenegge wrestling the 53-year-old to the ground back in april, one kneeling on him. >> i can't breathe. i can't -- i can't -- you're on my neck.

>> what is he -- >> he's screaming at our members. he won't leave. >> reporter: an autopsy report obtained by wkyc showed tyson died of cardiopulmonary arrest in association with physical altercation and prone restraint. a push to hold police accountable. maggie vespa, nbc news. millions are at risk this morning as severe storms barrel across the plains. let's turn to nbc meteorologist michelle grossman who is tracking the system for us. good morning. >> good morning, frances. it was a stormy weekend for many in the south, south central states as well, and it's a stormy start to the week. we're going to see storms flaring up especially as we go throughout the later part of today. you can see heavy rain falling throughout the south, up to the midwest, where you see darker colors that's where we are looking at the heaviest rain. back behind the system it's chilly, we are looking at mountain snow in portions of the rockies, that's going to taper throughout the day. we have another storm system on shore in the pacific northwest that will bring heavy mountain snow over the next several days.

after abruptly closing dozens of stores last week. but first, is the end of the boeing strike near? union workers are once again voting today on a new contract. cnbc's karen gilchrist is here. good morning, karen. any indication whether this boeing vote will go differently than the last one? >> good morning, frances. yes, it's certainly been a long, drawn-out saga for the embattled plane maker which has been hemorrhaging millions of dollars over the course of the last more than seven weeks as a result of these strikes. but there could be a glimmer of hope today as machinists vote on this latest contract. now, under the new proposals boeing workers are being offered a pay raise of 38%, as well as a $12,000 ratification bonus and a 100% 401(k) offer as well. so this is potentially more appealing for these workers and the representative union has endorsed this deal. now, it may be slightly shy of the 40% pay increase they

originally proposed, but it's certainly more than 35% originally offered by boeing. so this union has suggested that the workers vote on this offer now, saying that further negotiations could actually result in a lesser -- a lesser deal for these workers. but also secondarily, tgi friday's has filed for bankruptcy in the u.s. citing the pandemic and just a lack of return of consumer spending going to this restaurant. so it will mean that these restaurants will be up in the u.s. and they listed their liabilities around $100 million to $500 million. so not quite such positive news over the weekend for tgi fridays. >> what a shifts. karen, thank you. let's turn to sunday night football where the vikings righted their ship. >> first and goal for the vikings. darnold throws on the run t, di

here we are, just got one more day to go before election day and early voting turnout is reaching record levels. so what early voting trends are starting to emerge? let's turn to our richard lui with more on that. so what's the breakdown? what are you seeing, richard? >> as we get closer we get more data. good morning, frances. early voters are our consistent or super voters, if you will, and this year we are setting a record of them. i just checked our database as of 1:00 a.m. this morning, we are at 76 million so far and it's the most ever if you remove the covid phenomenon year of 2020. that covid year of course pushing many of us to early voting. in 2012 and 2016 early votes by the way those consisted of about 36% of all the votes casted for those elections. in 2020 it was 64%, so the question might be we could see

another record year this year maybe. well, according tour nbc news poll just out that might be possible. we are looking at 65% saying they have or will vote early. one-third saying they will vote on election day. and when you vote seems to say who you favor on average. if early, voters are favoring harris by 7 percentage points according to our nbc news poll. and, frances, if you vote on election say that is trump by 16 percentage points. >> wow. so whether you are red, you're blue, you're purple, how does that break down when it comes to the parties? >> let's look at the parties in terms of the early votes that we have the data on as of 1:00 a.m. this morning. again, when we look at in the seven core battleground states it is still super close. just like our poll was showing that you were mentioning at the top of the show. four states had more registered republicans voting early, arizona, georgia, north carolina and nevada. in the three other states there

democrats voting early more often, michigan, pennsylvania, wisconsin. now, all the leads here are in the low to middle single digit percentages except for pennsylvania. here we are seeing plus 24% for democrats. that's a big advantage there. now, nationwide it still remains, yeah, unbelievable. look at just as close as our polls are showing, republicans and democrats almost exactly the same at 39 to 41%. you would see typically more democrats voting early, but you can see in this total right now republicanscoming on strong, some days that we've been watching the data the democrats -- the republicans, rather, still surpassing democrats. now, the wild card of course here when we look at it is the 20%, frances. which way did they vote? your guess will have to wait until tomorrow. >> can make all the difference. >> big difference, exactly. >> maybe beyond tomorrow. >> wednesday, thursday, friday.
