we are live this morning with new calls to action following the arrest and subsequent resignation of san jose council member omar torres. trump transition. the president elect's new cabinet taking shape. we break down the latest appointments in washington and the big names snapping up high profile positions. and as trump's new team gears and gains momentum, governor newsom heads to the nation's capital. his down to the wire push for critical regulations ahead of the transition of power. this is today in the bay. and good morning to you on this tuesday. i'm marcus washington. and i'm laura garcia. we're going to get to a look at that morning commute with mike in just a moment. he will show us how tuesday is going. sometimes it picks up right. okay. what about the forecast, though? no rain in the works today. no rain. it's going to be nice and sunny. we're starting out cool. and it will be a cool afternoon as well. so we are now starting out with temperatures in the upper 40s 50s. and we'll see a mix of sun and clouds. and we're also

going to see tomorrow another system dropping in that could bring us some rain. and as of today, it's looking all good as you're heading out the door. let's get a look at morgan hill. it is humid. we've seen some patches of fog developing and it is now 43 degrees. very chilly start and as we go throughout the day, we'll see a mostly cloudy start. but then clearing out and temperatures going from the 40s to the upper 50s by early in the afternoon, eventually making it up to 64 degrees for the high, as well as 64 in san francisco, 66 in santa rosa. and tomorrow, even though we are going to see more clouds, temperatures will remain the same. we'll talk more about the timeline of that rain coming up. and mike, you're still seeing that damp pavement. that's right. so just a note. watch out folks. there may be a little slick where you drive here at the bay bridge. we've had plenty of traffic flowing all night, but we still see the damp pavement here, so we did just hear about a new crash. in fact, i want to point out here the highlighted yellow. that means

there may be some fog throughout the north bay, which happens when we get rain soaked soils here. but north. 680 traveling north up toward two. 42 right at that split. reports of a crash there getting more detail from chp. but it's opposite your main commute very early. lighter traffic will watch contra costa county, but there's no slowing that shows up on any of these sensors just yet, except for out of the altamont pass. we do see more slowing than we did yesterday, indicating a little more traffic. as laura was saying. we should pick up today. back to you. thanks, mike. 502 right now, this morning, a group of san jose residents are pushing for an election to replace omar torrez. the disgraced council member resigned after he was arrested last week on three counts of sexual assault by force against a minor. today in the bay's bob redell joining us live from outside city hall this morning. and, bob, what's the process for replacing torrez at this point? good morning to marcus and laura. we've learned that there will be a special election, possibly within the next few weeks. right now, the rules committee here at san jose city hall, they are going through the

process to replace district three councilmember omar torres. and in the process, moves to the full city council. that's expected on november 19th next week. and we'll expect more details then. people in san jose's district three are asking for an election, obviously to replace omar torres, who resigned after he was arrested last week on three counts of sexual assault by force against a minor. we spoke with kira cassandra. she is district three's chief of staff, even though the council member is gone, the district three office is still up and running with six employees working for the district who are being overseen by the mayor and his office. our focus keeps being the same helping the community. our district three residents, our small businesses and making sure downtown thrives. we have forgotten. they forgot about us. that was luis mendoza. he is a small business owner who's had

his food truck called mister shrimp on 13th street for the last two years. he's been frustrated with the leadership of former council member torres. he wants whoever replaces him to fix the issues that have plagued him over the past couple of years, namely break ins, fights and the problems associated with people who are unhoused. that's according to that small businessman, luis mendoza. reporting live here outside san jose city hall. bob redell. today in the bay. yeah. the process, the city and that certain that area is going through. all right. thanks so much, bob. it is 504 right now. happening today. a suspected drunk driver accused of striking and killing a san jose community service officer is expected to appear in court. long pham died in august when police say juan huerta palacios struck him. and another officer, who was seriously injured. it happened as they conducted traffic control for a separate accident on monterey road in south san jose. huerta palacios is due in court for a preliminary hearing. he's facing felony dui and gross vehicular manslaughter charges.

merchants in san jose's alum rock neighborhood today will receive free security cameras as promised, all part of a new pilot safety program. back in september, the alum rock village business association announced that program. it came during the string of break ins and armed robberies. 35 previously registered businesses are expected to receive the new four camera security systems monitored by police. the handout event is scheduled for 9:00 this morning. as the nation anticipates president elect donald trump's transition back to the oval office. governor gavin newsom is in washington, d.c. as well. he's meeting with white house officials this week, pushing for things which require federal approval. this includes disaster relief funding, climate regulation, waivers and health care policies. last week, the governor called a special session of california lawmakers scheduled for next month. this is all aimed at making sure certain issues are protected amid potential legal challenges

by the trump administration. in meantime, the president elect is announcing even more members of his cabinet tomorrow. president joe biden is expected to host trump at the white house today in the bay's brie jackson, following it all from washington. a week after election day. and president elect trump is filling his cabinet. mr. trump is expected to tap senator marco rubio for secretary of state, although sources say he could still change his mind. trump is also seeking to fulfill one of his top campaign promises, naming tom homan as the border czar who will lead his mass deportation efforts. if you're in the country illegally, you shouldn't feel comfortable. absolutely not. i won't feel comfortable if i'm in the country illegally. homan sending a stern warning to governors opposed to the plan. they better get the hell out of the way. either you help us or get the hell out of the way. homan's message a possible sign of things to come under trump's second term, the president elect meets with president biden wednesday to discuss a peaceful

transition of power. meanwhile, democrats on capitol hill are preparing to fight back against policies proposed under trump's second term. stephen miller and tom homan were the architects of a lot of the first trump administration, horrific immigration policies, and so family separation, mass detentions, those kinds of things is what was promised and by the trump administration. and i think what we're going to have to fight. senator elect ruben gallego won arizona. the gop has an edge in both the senate and the house. senate republicans are gearing up for a leadership battle. president elect trump urging those vying for majority leader to allow recess appointments where he could install certain positions without senate confirmation. this preemptive effort to install cabinet members by recess appointments. this is a trump feature. senators will vote on a majority leader wednesday in washington, brie jackson nbc news for at least

the next 24 hours. high surf forecast to pound the bay area coastline. the national weather service issuing a 24 hour high surf advisory starting at 6:00 this morning. some of those waves are expected to reach 15ft. meteorologist kari hall has been tracking conditions, including updated rain outlook for us. yes, so we do see an atmospheric river moving across the pacific northwest. and that's what's churning up those big waves along our coastline for today. and that's not expected to really affect our weather. but we can see the active storm pattern that's happening out over the pacific and causing those big waves that will be coming in. as of right now, we're already seeing 16 foot waves up near bodega bay. and keeping in mind that the water temperature is only at about 55 to 59 degrees, and we're seeing about ten foot waves off the coast of san francisco for pacifica. today starts out at 45 degrees, and it's going to be a cool day overall. our high temperatures only in the low 60s for this

afternoon. while we'll see some mid 60s for the inland valleys. we'll talk about that rain coming back to the bay area coming up. mike's been tracking where we can find some lower gas prices. yeah, even lower. the price went down and the rank went up from yesterday. 345 at the second best price in the entire state reported in livermore. springtown gas. we talked about it yesterday. it's on bluebell road just off 580. next up in marin county, the best there is, over a quarter higher than that price in mill valley. it's 377. the best we can do at arco on redwood highway. and then cupertino clings on to their spot as best in the south bay. 385 at great gas on north deanza boulevard. that's your third number here. and these are all reported through gasbuddy.com. you can track those changes. i hope you find pleasant news where you are. let's look at the roadway. unpleasant news in concord. i need to go back to the crash. we talked about. this is north 680 at the 242 split. you see some slowing sensors already? just at that split. reports of a crash that had at one point, all lanes

talk about the crash and the progress coming up. well, good morning. in a very happy tuesday to you. record stock markets again. the republicans will say this is because of trump. and that's possible. the democrats will point out we've had record days on the stock market over and over. and over this year, even long before the election. you know, the investors, they just say, ka ching, look at lift here. moving up the ride share company turning in much better than expected profits. people flocked to buy the stock. bitcoin sank a bit yesterday. but that number is wrong there. but this should be closer to $90,000 per coin. president elect trump, who once called bitcoin a fad and a fraud, embraced crypto during his campaign. his family created their own crypto coin service. he named his 18 year old son barron as chief visionary officer and has promised to relax restrictions and regulations on crypto coin. there are some hints. maybe the

president elect is not fully grasped. how crypto works for instance, he says he wants all bitcoin mining to be limited to the united states. but bitcoin mining is just a math problem. it's a really difficult math problem, but it can be done on a computer anywhere. the blog macrumors says apple is suspending production of its augmented reality goggles. apple vision pro primarily because very few people can afford them or want to buy them. there's talk that apple is working on a much less expensive version. a number of store chains have announced they're starting black friday sales early. black friday, of course, the day after thanksgiving that's still 17 days away. but in this day and age of internet shopping, stores have been bumping that date up. well, coming up on the today show, our good friend vicky nguyen will take a look at cash back apps, ways to earn money back on your holiday purchases. coming up at seven right after

yeah, it's been very chilly out there. we have even colder weather ahead going into the weekend, but before we get there, we're going to have some rain. so let's talk about all the changes and what we measured yesterday. it was great to see all of the rain that moved through, and most of us had about a quarter or two close to a half inch of rain for san francisco. it was a little bit more for mill valley, with three quarters of an inch of rainfall and we have more rain on the way. this next system will be dropping in, but mainly affecting parts of the bay area, with some off and on scattered showers. but looking at what's ahead with that rainfall, it could possibly be another few hundredths of an inch of rain south of the golden gate bridge, north up to a quarter inch of rainfall. so we're not talking about a major dumping here. and then as we go toward the weeken, it is dry. but next monday, another system will be coming in, possibly with some more widespread rain and sierra snow. that one looks a little bit stronger compared to the off and

on spotty showers. we'll see over the next couple of days. and the cierra this weekend before we get to the weekend, we'll have another 2 to 5in of snow. it really made for some slippery road conditions yesterday, so we're planning on that once again. and then next week we could have some additional snowfall that in total could reach close to 9 to 10in for some of those higher elevations for the north lake. so we're going to see over the next several days, our rain chances off and on, very spotty chances until about early next week. but look at how chilly it's going to be. and for some of our inland areas this weekend, we could have some upper 30s san francisco. also looking at some off and on showers starting again tomorrow and then some times of rain on thursday into friday. not raining the entire time. we're not expecting the system to be very strong. and then for the most part this weekend it will be mainly dry all the way up until sunday evening into early monday. and mike, now you're seeing more traffic. another traffic break. second traffic

break. look, i want to show you there has started the volume build up there on highway 37. typical timing. so we talked about more traffic flow than yesterday. also here a couple of things happening in concord. we're looking at northbound 680. that crash still at 242 where it is. there's only one lane that gets by and the two lanes on the right are blocked. there may be a poll, a telephone or a power pole. not sure which, and there may be some injuries. so this crash is going northbound on 680. folks are taking 680 this way. so that's why there's more slowing instead of trying to get past the crash, which would take you to 242 opposite direction, the southbound side, that's the commute direction. that typically shows a little slowing, a little bit later. but this distraction and the build at the same time adding to that slowing coming off of highway four and cutting that corner there. so both issues going on for both directions of 680 just off 242. the rest of contra costa county looks all right. we do have a new disabled vehicle reported in sunol. we'll track that and let you know if it's a problem. but the south bay and the peninsula and those bridges all moving smoothly. back to

global climate conference, or cop 29. our conference of parties is being held in the united nations in azerbaijan, and 197 countries, including the us, look at their progress toward the goals of the us. paris agreement and limiting global warming by 1.5°c, or about 2.5°f. now, despite the progress in things like clean energy such as solar, wind, electric cars, the world is still projected to go over that warming limit and current figures show us hovering just under 1.5°c. noaa estimates that this year will be one of the warmest on record. a big topic at the conference this year will be on financing those climate goals. un climate change

know if you're headed to the coast. this is today in the bay. don't turn your back on that water. all right? but turn towards the tv. good morning. it's tuesday morning now. thanks for joining us. i'm laura garcia. i'm marcus washington. let's get a look at that forecast for you today. meteorologist kari hall tracking the high surf. that is something we've been talking about this morning. yeah, that's the main thing we have to talk about, because today will be sunny and a lot of people will be heading out and about, and we are going to see some big waves all because of an atmospheric river that we're seeing hitting the pacific northwest that will not affect the bay area as far as rain today, but we are seeing those waves already coming up to 15ft around bodega bay, and they could be as high as 16ft between this morning and tomorrow morning. a look at our temperatures in pacifica. it's going to be a very chilly start. we're in the mid 40s and then we'll see a mix of sun and clouds heading toward the upper 50s by early in the afternoon,

and around the bay area will mainly see 60s for highs mid 60s with a light wind and a partly cloudy sky. tomorrow the rain comes back so we'll be tracking that for you and today in the bay's ginger conejero saab is live in pacifica and ginger. authorities are reminding people just how dangerous the water can be. that's right. good morning. kari. there is a high surf advisory that is out that will take effect in about half an hour from now. it will extend till until 6 a.m. tomorrow morning, and it covers a wide area. it covers the area that we're in, which is the pacifica pier. that's the san francisco peninsula, san francisco county. it also covers point reyes national seashore, northern monterey bay, big sur, and as well as in the north bay. now you can't see much behind me, but just moments ago, one of the waves actually broke through the barriers. i know, laura just said, don't turn your back to the water. i'm trying to keep a little pivot here as i talk to you, because the national weather service does expect

waves to come up to 12 to 15ft high. we're kind of seeing some of those tall waves now. they do classify it as moderate, but they do say that these conditions can make it dangerous for those who want to be in the water, those who are looking to swim or surf. so they're saying, stay out of the water. the u.s. coast guard is also reminding people that their bodies can go into shock, making quick reactions difficult. when you are in the water. never surf alone, never go to the beach alone. always have somebody there with you to kind of making sure that you're okay and everyone stays safe. that those those surf conditions, even for experienced swimmers, can catch them off guard and very easily drag them out with the undercurrents. and we have had several reminders of just how dangerous weather conditions can play out on the water. a bay area family is in shock and mourning after experiencing the fatal dangers of being out in the water. 13 year old june

karma puni is the sole survivor of a crabbing boat that capsized in the frigid waters of bodega bay a couple weeks ago. he was with his dad, his uncle and his cousins. now, authorities ended their search for the missing group. one body was recovered. a vigil is scheduled this saturday to honor the missing boaters. that is happening at westside regional park in bodega bay at 6 p.m. now, the coast guard says it is monitoring weather conditions by the hour. they are ready to respond to any search and rescue missions if needed. we're live in pacifica, ginger conejero saab. today in the bay. ginger thank you. and to get updates on the forecast, make sure you download our redesigned nbc bay area app. that way, it's going to keep you updated on the weather in your neighborhood. this is all thanks to the information from our team of meteorologists. all you have to do is scan that qr code right there on your screen. if you haven't already downloaded the app. that way you can get to the app. it's going to get you to

the information that you need to know. all right. so let's check in right now with that commute. i'm mike inouye standing by with that. how's it looking out there, mike? we have more traffic volume out there than yesterday. being the holiday. it was light. light drive. today. we do have highway 37 showing the slowing. there's some fog that's creeping across in toward vallejo. keep that in mind for the north bay. the build for highway four. so these are all signs we didn't have yesterday. but this is what i'm tracking. this crash reading by the speed sensors. they've actually cleared up northbound. but the crash still reported north. 680 at 242, a pole on the side of the road was involved. and so they have the right lanes blocked until they can judge the integrity of that pole. the distraction from all the activity has the southbound side slowing, but the northbound slowing has cleared. they may have opened one or possibly all lanes. we'll check on that when chp gives us the update. i'll pass that along to you. concerned about this? this is a crash in the commute direction. southbound vasco road right there at dalton. just before you get to all the shops and everything like that, there is a crash reported and that's slowing you down. the northbound side is open. the southbound side may have to go over to the

shoulder. watch for chp. they have arrived. and there's that slowing out of the altamont, which we didn't have yesterday. the rest of the bay, outside of that portion of the alameda county drive, is showing a smooth flow of traffic for those speed sensors. back to you. all right. thanks, mike. well, happening today in san francisco, the unidentified teen accused of shooting niners receiver ricky pearsall is due in juvenile court for a preliminary hearing. that shooting happened in august near union square. police say that the 17 year old from tracy fire tried to rob pearsall. during the struggle, his gun went off and struck pearsall in the chest. the suspect faces attempted murder and robbery charges. graduate workers at stanford are reportedly putting their strike plans on hold for at least 24 hours to allow for more contract talks. union originally vowed to go on strike this morning, but the stanford daily reports the plan is being postponed, with the union citing encouraging progress in negotiations. the union is still threatening to strike tomorrow if a deal cannot be reached. stanford is telling students one

way or the other, all classes will continue as usual. fremont leaders today are scheduled to hold a final vote. this is on their recently approved plan to limit rv parking. council members last month unanimously approving that measure. it requires people to move their vehicles after 72 hours in residential areas. the new ordinance does not apply to construction and delivery truck. police in the east bay are announcing the arrest of nine people following a large sideshow over the weekend. investigators say it happened on canal boulevard in richmond late saturday night. police say when they arrived, they found 200 people and 50 cars blocking the street. officers used spike strips to disable one of the vehicles. in addition to the arrests, four cars were impounded for 30 days. take a live look outside over interstate 80 near truckee so we can tell you all chain restrictions have now been lifted. this is after the latest wave of snow in the sierra. now for some last night turned into a long and slow ride. this is over the summit. the snowstorm

strained drivers after caltrans closed both directions. people who were struck near the colfax area just tried to roll with the punches. i gambled and i lost. i had eight dates to pick from and i picked this date, so such is life. there's a lot of concerns. am i going to have enough gas? there's gas stations here. but how? it's going to be the road. these caltrans guys are saints. you're like with the stuff that they put up with. they just don't, like, freak out on people. thank you for all what you do out there. all right. so chp reminding everyone if you do plan to head that way, you should still expect to encounter some icy patches and slick roadways. meteorologist kari hall of course tracking those conditions for us out there. so things have led up weather wise, but still an issue. yeah, there will be some more snow going that way, so at least for today, things have cleared up. but look at how beautiful it is as we take a look at this live view of palisades tahoe. you can see the

snow kind of weighing down the tops of the trees there and the lights. and as the sun rises, we'll be able to see a lot more of that snow. and going into the weekend, we will have a couple of more rounds of snow coming in. if you are planning to head there between now and friday, there will be some off and on snow showers coming back tomorrow, and then a bit of a break on saturday before we get more rain or snow on sunday. so we are going to see between now and saturday another 2 to 5in of snow. so you don't want to be caught off guard on those roads. you don't want to go up there without the tire chains because really at any point you could need it. and we're also seeing those overnight lows dipping down into the teens and 20s. so whatever melted throughout the day will be freezing and becoming very icy during those nighttime hours. so we'll be watching that. we'll talk about bay area rain coming up. and mike, you've been watching the roads that so far seems like it's been fairly quiet. yeah, it has been quiet. we have more volume, more traffic than yesterday. of course, yesterday being the holiday. so we have slowing out of the altamont. we

still have the crash southbound vasco road over there near dalton. i want to show you the travel times here. vasco road has jumped up to almost 40 minutes. now, as you're traveling out of the area because of that crash. as you're coming down toward 580 highway four. all right. but there's more slowing in 580 to show that out of the altamont as well. again, more than we had yesterday. here's the bay bridge toll plaza. we're seeing a backup. we didn't see this this time yesterday. again indicating the volume coming back to normal for a tuesday should show a heavier volume. we see slowing through. richmond, highway 37 and highway four both showed that early slowdown as well. do want to talk about what's going on in the city tonight. we do mention klay thompson is coming back home or his previous home. he's coming back with the mavericks. but it's klay day. everybody will be wearing their captain's hats i put the wrong time. it's actually 7 p.m. i think i was subconsciously trying to make sure klay didn't get there on time. so we don't have his three pointers. so you guys know it's at seven and there will be crowds inside chase center. back over to you. always working for the team. he's covering it up. the

morning. and you know what? dub nation, be ready for a lot of emotion tonight over at chase center. that's when the beloved star is set to return for the first time since he parted ways. and with his legendary splash brothers. we're talking about klay thompson now playing for the dallas mavericks. well, tonight the mavs visit the warriors. not like you need these images for proof. but klay was and still a warriors legend for an early season game. this one certainly an unusually hot ticket. you can be sure. at least before the game fans will give him a huge ovation. as for the game itself, klay says he'll be focused first on winning. it'll be good to see people that you grinded with, obviously, but to me it's just another regular season game in november. obviously there's bigger implications with the nba cup, so that's what's on our mind is in my mind is just to win that. as klay mentioned, tonight's game also the first in a series of nba cup games. the league launched the cup last year as sort of an in-season tournament.

little bit of a breeze picking up. and it's going to overall be a cool day behind the rain that moved through yesterday. let's talk about how much we measured across spots in the bay area. mill valley. one of the higher rainfall totals that we had about three quarters of an inch of rain. there were some spots in the upper elevations that did have more rainfall, while in san francisco there is 4/10 of an inch of rainfall in oakland, almost there. and for san jose, 3/10 of an inch of rainfall. danville a little bit more than a quarter inch of rainfall, a little bit less than a quarter inch of rain for palo alto. we're not done with the wet weather just yet, so we're taking a break for today. it's going to be dry, but then we'll start to see this system making its way, dipping into the bay area, and will be kind of on the outer edge of that atmospheric river, not expecting a lot of rain, but there may be some passing showers every now and then. and looking currently as you're heading out the door, we're in the upper 40s to low 50s, and as we go into the afternoon, partly cloudy tomorrow in the north bay, we'll start to see some of those showers moving in. and it's

going to be very spotty, very light for the most part. and not everyone will see that rain on thursday. also, some hit or miss showers mainly targeting the north bay. so that's where we are expecting the highest rainfall totals over the next couple of days. possibly about a quarter inch of rainfall, but much less for the rest of the bay area. if you measure any rain, it may be a few hundredths of an inch. and as far as temperatures, we're going to reach 64 degrees in los gatos today, up to 66 in gilroy, and also some mid 60s for much of the east bay. oakland today, 64 degrees 63, in redwood city and for san francisco, 63, in the mission district, 59 in the marina district and in the mid 60s in the north bay, clear lake holly making up to about 60 degrees going ahead into the weekend. it looks dry, but it will be cool and we may have a more significant storm system coming in early next week, with some more widespread rain and sierra snow, and then looking at the active pattern that we'll

see continue into next week with every few days watching some rain coming into the bay area. so we see the rain icons here. it's not going to be raining the entire time. in fact, there may be times where you don't see rain at all throughout the day, just depending on your location, and it's going to be in the low 60s. check out the weekend as you make plans. it will only be in the low 60s for highs in the morning. starting out in the upper 30s, san francisco will see mid 60s for the next few days, and then we'll drop it back to 58 on friday. mike, you're seeing more slowing now in the east bay. yeah. one obvious spot is the bay bridge toll plaza. yesterday the holiday kept things light here, but today we're at tuesday and we see the backup hov. big advantage. damp pavement, but not a major concern. not a lot of spinouts reported. we see more slowing through richmond and holding steady for highway 37. actually. that's great. over here. northbound 680 opposite your main commute in concord, right at the 242 split. there's still activity. still have your right lanes blocked again. that's north 680. so you'll find unusual slowing heading up
