there are many hurdles between a victim reporting an incident like this to the police and so that doesn't always act lynn arly. the medical exception is extremely restrictive. it is only if it is necessary to prevent the death of the pregnant woman. >> it's interesting because the idaho attorney general who is a defendant said, the current law allows the doctor to perform an abortion if he or she has a subjective good faith belief there's a risk of death to the mother if it is not done. that has a lot of legal room. in this case specifically, what are the plaintiffs asking? >> i agree here with the plaintiffs' attorney who said the attorney general was really misstating the law. the law says necessary to prevent the death. not if there is a risk of death. the a.g. is mischaracterizing this. the actual exceptions they are asking for. first, if the pregnant person has a medical condition that could worsen with the pregnancy.
12:17 pm
second if there's a medical complication that could make it unsafe. third as is the case with many of the women who testified, if the fetus is unviable, meaning if it's more likely than not that the fetus would not survive either the pregnancy or the birth. these are the exceptions. they're asking the court to allow into idaho law. >> briefly, do you think we could see this escalate all the way up to the supreme court? >> it's unlikely they would take it again given how clearly they've come down on how this is a state issue but it's always possible. >> it's always possible. it's interesting to see the imindications these laws are having on women's health across the board. not just in idaho. we've seen it elsewhere. >> yes, exactly. even though each state is different, all of these groups are certainly looking to other states to see how they are reacting and which arguments are working, which ones are progressing successfully to the supreme court. these are the movements that these women are working towards. >> an interesting case for people to pay attention to in idaho. thank you for explaining all of that. we appreciate it. we'll be right back.
