we have tips for enjoying everything nice without the guilt. we're going to begin this hour with the uproar in walkway sh over the president-elect's choice for washington. gaetz is known as a staunch trump loyalist and a fierce critic of the doj. sources inside of the department tell nbc news the pick is quote truly stunning, laughable, and insane. former trump national security adviser john bolton saying this, quote, it must be the worst nomination for a cabinet position in american history. gaetz has sharply criticized the justice department for years. this is what he had to say four years ago. >> maybe i should serve as attorney general of the united states. >> gaetz had also been the subject of the investigation. gaetz was investigated for sex trafficking. he has denied wrong

doing there trafficking but that case was closed last year without any charges. he has denied any wrong doing. leading us off this hour, nbc news justice and intelligence correspondent, ken dilanian, and nbc news capitol hill correspondent, ryan nobles, ken, let's start with you. gaetz is not just a controversial pick because of the criticism of the justice department in the past, the bigger issues that critics are pointing to, his lack of qualifications for this job, and walk us through what we know about his background as it relates to a job of this stature. >> the attorney general is not only the top law enforcement officer in the united states, he or she is also holding a really important national security job, privy to the most sensitive intelligence, overseeing secret intelligence investigationings, representing the intelligence community, and matt gaetz doesn't have the background of people who have held that job have. he's a career politician, he practiced out of law school, and got elected to the florida legislature. he's the son of wealthy parents and then got elected to

congress, and has been known in congress as an agent of chaos, as a rhetorical bomb thrower, someone who tried to take out and did successfully take out the republican house speaker. then you have the issue of these sex trafficking allegations, the justice department investigated him, but then decided not to move forward with charges. the house ethics committee took over the investigation and apparently has a report that's ready to go but hasn't been released. and you add all of that together, and people are very concerned, and then of course on top of it, threatening to blow up the justice department, accusing the fbi of being unethical and corrupt. people inside this building are concerned. >> julie, talk to me about what you are hearing on capitol hill. i understand you have some new reporting related to matt gaetz and vice president elect j.d. vance working together behind the scenes to gauge or gather support. what can you tell us? >> reporter: the calls they are placing are separate. we are hearing from a

number of senate republicans who have received such calls, separately, again, from vance and his campaign team, getting a temperature check because the uproar is not only in his building, it's also in this building too, among republicans, greatly, and vance and gaetz himself is also calling around, especially senators on the judiciary committee, that will be his first hurdle to cross if he's looking to actually sit atop the department of justice. i just had a back and forth with kevin cramer, a republican senator about this, he had some really harsh words for gaetz. watch this. >> i have concerns that he can't get across the finish line, and we're going to spend a lot of political capital. i say we, a lot of people will spend political capital on something if you got done, you have to wonder if it was worth it. he has a steep hill to climb to get lots of votes, including mine. >> reporter: kramer said he's concerned about the doj investigation that ultimately didn't charge him about the sexual misconduct, elicit drug use. all of that is being looked at by the

house ethics committee and has been for several years. they are meeting just to meet tomorrow, that the report could be released if they decide to do it, tomorrow as well. there is precedent, though, however, for the committee to release the report on the same day that a member of congress decides to leave. that's applicable to gaetz, of course, who handed in his resignation letter, and that was effective as of noon today. a lot to watch in this space here, and i'm assumening ing w going to hear more uproar from republicans as he gets further on. >> julie roginsky on capitol hill, ken dilanian at the department of justice. thank you both. president-elect trump is moving ahead with transition plans in florida. the president-elect is behind closed doors at his mar-a-lago estate today. he has not announced any new cabinet selections so far. nbc news correspondent, dasha burns joins us now in studio. take us inside of mar-a-lago, if you can, in this moment. i mean, these are closed door meetings, but what do we think is happening? what have you been hearing from sources

the last few days? >> "game of thrones," "hunger games," everyone is jockeying from something. it's a hive of activity of decision making, and he has been seeing these picks coming out so fast and furious, and people making their way down there. some people renting places just to be near it all, and try and either have influence in who is chosen or try and get chosen themselves. and so far, we are seeing in picks like matt gaetz, tulsi gabbard, who we'll talk about, even kristi noem and others, people who are not only don't have the traditional resumes for those agencies or those roles, but held positions that were actively at odds with what those agencies are supposed to do, what they are doing, and it's just creating this very different dynamic of a serious shakeup in washington as we look ahead to the new administration. >> tell us a little administrate about tulsi gabbard. she served as a congresswoman in the past. she's the president's

pick for director of national intelligence. what does that mean? >> this is a massive role. i mean, this is a role that overseas 18 intelligence agencies with a budget of $70 billion. a whole lot of our national intelligence infrastructure goes through the director of national intelligence. she's someone that doesn't have that experience. doesn't have anywhere near the resume of people who have held the role previously. she too, she has been at odds with the national intelligence posture of the united states on many issues. she's been accused of parroting russian propaganda. she took a trip to syria back in 2017 to meet with then president bashar al assad at a time when the united states was in a really frigid relationship with that president, and has stepped out of bounds of where the u.s. intelligence committee is. having her step into that role is raising eyebrows from a lot of the people that have been civil servants in that

space for a long time, ellison. >> really interesting stuff. dasha burns, reporting so many details as always. we appreciate it. thank you. the israeli and french national soccer teams are meeting today in a high stakes match that has some people on edge. this was the scene earlier tonight. pro-palestinian protesters demonstrating about a mile and a half away from the french national stadium. there are 4,000 police officers patrolling the city tonight. nbc news international correspondent claudio lavanga is in paris, and joins us now. i understand the french president is expected to attend the match this evening. what have you been hearing? what have you been seeing on the ground? >> reporter: hey, ellison, that game kicked off about 20 minutes ago. no goals but it is not about the score in this game. it is about the security concerns around it, of course. a lot of people stayed away from the stadium because they were afraid what happened in amsterdam last week could happen here in paris tonight. and that's why we

just heard from french media that only 13,000 spectators are attending this game out of a capacity of 80,000. now, if you consider that the police, because this was a game of high risk, at high risk of incidence has deployed almost four times the number of police officers that patrol or guard a supporting event of this kind. out of 4,000, 2,500 will be in and around the stadium. that will make it almost one police officer for every, you know, five or six spectators. that's a lot. other police officers will be around the city. and you see more police officers than soccer fans. the tension is still palpable, still high. there was a protest tonight in paris that was peaceful. we've just seen them flying palestinian flags, and calling for free palestine. there were no clashes so far. >> claudio lavanga, thank you so much.

we appreciate it. it is time now for today's cnbc money minute. ford is facing a record setting fine and t payne has an unusual guest on his latest release. courtney reagan joins us with more. >> well, in most u.s. cities, buying a home requires a six-figure salary, according to oxford economics, it's doubled since 2019's value of around $56,000, and now only 36% of households earn enough to afford a new home. the most affordable cities are located across the midwest. the most expensive are scattered around the west coast. federal regulators fined ford $160 million for moving too slowly on a 2020 recall. ford agreed to a 3-year consent order with the agency for taking too long to recall vehicles with faulty rear view cameras and fail to go give regulators complete information. mark zuckerberg joined forces with t payne to release the

police in indianapolis say a man was found dead inside a tanning bed at a planet fitness gym three days after he first went there. his family wants to know why it took so long to find him. the man left for the gym last friday, they reported him missing later that day. they were finally contacted by police this past monday when his body was discovered. nbc's maya eaglin is following this story for us and joins us on set. i understand there was another person who was at the gym, and reportedly helped

to discover the body. what can you tell us about how this all played out? >> yeah, that's right. other customers at this gym were the first to report it and alert authorities this past monday. that's how the investigation really started. but i spoke with the public information officer at the indianapolis police department this morning. he told me this is all still an ongoing investigation. they're right to get answers for this family. the victim here, 39-year-old derek sink, as you mentioned, he went to the gym on friday. when he didn't come home, his family alerted authorities to report him missing. they confirmed that he has a history of struggling with substance abuse and drugs. we know that a needle was found near that tanning bed where officials found his body but we actually don't know the cause of death. we did, however, spoke to some o.f th people who were at the gym when it happened. let's take a listen. >> lack of attention from the staff members at that

point, which is pretty disappointing because maybe it could have been prevented. the tanning bed has a door, i believe, but why are we not concerned the door has been closed three days in a row, potentially. >> we did reach out to planet fitness a comment. they said in part, at planet fitness we have robust operational brand protocols as safety and well being of our members is our torp priority. we're working closely with our local franchise sees to ensure they are upholding the protocols. the tanning facility has been temporarily close ld. >> maya, thank you, we appreciate it. a mother in georgia is facing misdemeanor charges and jail time because she did not realize her preteen son walked to town alone. the incident is igniting a debate over how much freedom parents should be able to give their children. >> a mother of four, shocked to be arrested in front of her children. >> it was anger and

frustration, of course, because my children were having to witness that. >> reporter: all because her then 10-year-old son was spot walking alone in mineral bluff, georgia, a town with a population of 370. >> it's not even a town hardly. it's not a super dangerous or even dangerous at all stretch of road. >> reporter: brittney patternson lives less than a mine from town with her father and children. on october 30th, she had to take her eldest son to a medical appointment. her youngest son didn't want to come. she left him at home. she received a call from a police officer. >> when you got the phone call from the police officer saying, hey, do you know your kid is in town, what did you think? >> i said no. i didn't know if he was in town. i was not expecting them to say that, but i wasn't terrified for him or scared for his safety. >> reporter: the police officer drove soren home, she says, and made it clear it was problematic brittany didn't know

where soren was. >> they asked me to put my hands behind my back and all that stuff, i realize ld what was going on. >> reporter: she was taken to jail, booked and released on $500 bail. she's facing a charge of reckless comment. if found guilty, she could spend a year in prison and a thousand dollar fine. the d.a.'s office didn't provide us with comment, and we did not hear back from child services. prosecutors asking brittany to sign a safety plan before she consider dropping the charges. >> we want to witness you downloading the app, gps app to your son's phone. okay. and then you've got to epidemic check on is. and he's got to let you or grandma know where he is at all times. >> brittany and her attorney are unwilling to accept this deal. >> this is not right. i did nothing wrong, and i'm going to fight for that. >> the story striking a nerve as technology inundates our lives,

between the two men. now, reactions were written on the faces of those sitting and listening in the courtroom from both sides of this case. nima momeni mom was seen shaking her head when the questioning got to how potentially angry a brother could get after he learns that his little sister was allegedly sexually assaulted. now, members of bob lee's family also scoffing during his testimony while he was skirting some of the answers and sort of skirting some of the questions from prosecutors, i should say. now, this follows the testimony that was given by momeni yesterday when he took the stand for the first time in his own defense. that is when he told his version of the moments leading up to and following the deadly stabbing of bob lee a year and a half ago. he says the two took drugs in the car, and when they got out of the car, lee pulled the murder weapon from his own jacket and lunged at momeni. this morning, a bit more detail into that. prosecutors asking momeni to retell the statement

he said before lee lunged at him. quote, if i knew this was my last night in town, i would spend it with my family. instead of a profanity at a strip club. he testified this is what made lee turn on him. now, prosecutors argue lee was in town for his family and that he has a good relationship with them. momeni previously told jurors he drove off from the scene because he did not realize lee had been stabbed repeatedly and he claims he only found out lee was dead the next day. now, this morning, he also testified, saying that he had received legal advice by april fifth, which is the day after bob lee's death. we expect this cross-examination to continue throughout the day. our sergio quintana is on this story and we'll have the very latest on our evening newscast in san francisco. ginger conejero saab, nbc, bay area news. thanks, ginger, for the update. disgraced san jose city councilman omar torres is expected back in court soon. he's accused of sexually assaulting a young relative.

police are also investigating at least one other possible case. torres resigned last week before his arrest and his arraignment will begin in about an hour from now. nbc bay area's robert honda is there. he will have a full report in our local newscast starting at 430. transit leaders in san francisco are issuing a dire outlook for muni. they say it might need to suspend its cable car service. that's just one of the ideas being floated around in the wake of a new report indicating a massive budget shortfall. leaders tell the chronicle that deficit could amount to $300 million in 2026. muni might also have to drastically reduce bus and light rail services if it cannot get new funding. we're still seeing some showers around the bay area today. here's meteorologist kari hall. we've seen a light rain off and on throughout the day, and it will continue to move through the bay area by the early afternoon and then clearing out later today. for a little while, there still will be a chance of rain in the

forecast on friday, with the north bay seeing the best chance of those showers and temperatures cooler than normal. only a high of 64 in novato today, 62 in san francisco and low 60s for much of the tri-valley, with mid 60s for the south bay and the temperatures drop tomorrow as we get a cold front coming in. highs near 60 degrees and once again, partly to mostly cloudy. slight chance of rain and there's not much of a warm up on saturday, so we'll take a look ahead to another chance of rain in our 7-day forecast coming up in 30 minutes. thanks, gary. well, students in the south bay are celebrating a historic civil rights movement. they gathered outside san jose city hall this morning to take part in the ruby bridges walk to school day. students from notre dame high school honored the walk act walk activists. ruby bridges, once made in 1960 at six years old, bridges was the first african-american student to desegregate her all white school in new orleans. federal marshals escorted her out as she faced an angry and racist white mob. one teacher says she hopes her story

bottom of the hour, here's some of the stories making headlines on nbc news daily. the fbi is offering a 25 thousand dollars reward for any information on three cases of arson at ballot boxes in october. the fires destroyed nearly 500 ballots. two of the incidents were at ballot boxes in vancouver, washington, the other in portland, oregon. the fbi said it now believes one suspect was behind all three incidents. they are describing him as a white male between the ages of 30 and 40. newly released security footage shows the suspect driving an early 2003 to 2004 s 60 volvo sedan with a fake license plate. four ople in california are under arrest to use a bear costume to damage cars in an elaborate insurance fraud plan. the suspects claimed a bear entered their cars, and provided footage of the attack. officials brought the images to fish and wildlife experts who said that is a human

dressed as a bear. the bear costume was allegedly found in one of the suspect's home. the scam cost the insurance companies $142,000. none of those suspects could be reached for comment. exciting news at nbc, this morning, it was announced that our very own craig melvin will replace hoda kotb as coanchor of "today" when she departs in january. craig melvin has been with nbc news for 14 years, covering everything from breaking news to presidential interviews to the olympics to super bowls. very easy to find everyone here, they say we love craig. craig sa mentor. so happy for him. the fourth hour of today is becoming today with jenna and friends. until a someone is named. two astronauts are speaking out after concerns about their health began circulating online. >> i think there's some rumors outside there that i'm losing weight and stuff. no, i'm actually right at the same amount. >> that was nasa

astronaut suni williams. she has been stuck in space with fellow astronaut butch wilmore for more than 150 days after issues with boeing's starliner prevented them from returning to earth. joining us now is emilie ikeda. this is the craziest skoir story all around. let's back up to the health concerns. what initially sparked some o.f the questions of people saying are they okay? >> the first remark says a lot. i think when a mission goes from what's supposed to be a week long to months long, people have been inherently interested in these astronauts well-being because of the course of this trip gone awry. there was release of some photos, some chatter online, are they okay, is their weight loss. here's how the chief medical officer is responding. here's what he told me. >> talk to me about the kinds of strains on the human body, when you're in space. >> the crew is absolutely healthy and in really good

shape. the things that occur in long duration space flight. you have the fluid shift, all the fluid in your lower extremities moves to your head and thorax. you're working out two hours a day. >> you hear him talk about that fluid shift. another important factor here, when you're experiencing weightlessness, floating in space, there's a lot less forces on your muscles and bones. there's concern around muscle loss or bone density loss. exercise is critically important. they do it some two and a half hours every single day to try to prevent that. >> good for them on that. not for me. but one of the things that i think made me and so many people drawn into this story was they were only supposed to be there for a week, and then when they weren't coming back, if i remember correctly, some nasa officials were like, they're not stuck, they're just not coming back right now. that is stuck. so are they going to come home soon? i mean, i know there's this new plan. do we have a date of when this will happen?

>> we don't have an exact date. they say february, and they're going to be coming back on a different spacecraft. that speaks to one of the things they need to know. they need to learn in this interim period, how to operate in the new spacecraft, new space suits. there's a number of other things they're doing. these are experienced astronauts. between both of them, they have been in space prior to this mission for a combined more than 500 days in space. this time around, they're doing a number of things. they're analyzing the problem plague starliner that they came up on. they are looking at the maintenance and helpep up maintenance on the international space station, and they're also conducting research. interestingly some of that research includes loing at how being in space, weightlessness impacts the body and its function. that research can be important intel for how we treat bone loss here on the ground on earth, and maybe for some potential trips and future trips to mars. >> fascinating stuff. emilie ikeda, thank you as always. we appreciate it. we are following

an update on the e. coli outbreak linked to onions served on quarter pounds. senior business correspondent christine romans has this report. >> fewer than 50 cases were reported in october. that number has shot up to more than 100 nationwide including one death in colorado. weeks later, many of the victims of the outbreak are still dealing with the aftermath. >> mcdonald's dealing with ongoing fallout from that deadly e. coli outbreak. the cdc releasing new details on the rising number of cases tied to the iconic fast food chain saying a total of 104 customers have now been sickened across 14 states. 34 have been hospitalized. four developed serious kidney issues. one person has died. the agency is citing the company's flesh slivered onions ass likely source of the outbreak. mcdonald's temporarily stopped selling the quarter pounder in affected states but the popular item is back on the menu. many montana alone,

decadent s. it's easy to over indulge. a national survey released today finds 39% of americans say they worry about how much they eat over the holidays. joining us now is child and family dietitian, allie van gear. this survey found many americans apply quote, misguided and quote, counter productive advice to combat holiday weight gain. i'm not saying i don't feel attacked. i have done the, well, i'm going to eat a bunch of dessert, maybe i skip a meal or two here or there. which is not good, and i know this. what is the good advice on how we can navigate going to the fun parties, eating the things we want to eat. over indulging occasionally, and also not doing counter productive things to preempt a weight gain. >> i feel like people have this all or nothing mentality. they think, oh, i had one treat, and now my day is ruined and i'm just going to indulge the rest of the day,

and start tomorrow. i have done that myself in the past. >> are you reading my diaries, i do it all the time. >> i think that's the first thing to nip in the butt. it's not going to derail you. balance is key there. i also think people only care about call lees. they think that's the only thing that matters, so they try to save calories, like you mentioned, to over indulge later. however, when you're thinking about diet, calories are part of the picture, but you need to think about about balancing your blood sugar, your metabolic health and feeling satisfied and that comes with eating nutrient dense foods, not just a bunch of cookies later. >> how would you suggest, if say we're gearing up to go to a series of holiday parties, we know it's three nights in one week, how do we navigate having a good time, participating in the festivities, and not putting us in a position where don't feed good post . >> eat a light meal

before you go. they have snacks, appetizers, if you're eating protein before you go, you're able to indulge in the appetizers, more savory, the desserts, but you're not going to over indulge. you're not that hungry, you're a little bit hungry. another thing you can do is just make sure you're still being active. exercise alone won't fix everything, but it's a combination. but keeping up the moving when you're really busy during the holiday season is touch. >> yes. >> if you do over indulge, do some of the things online, detox teas, do they work to correct it? >> the first thing is don't dwell on it. if you're criticizing yourself, you're likely to overeat again anyway. refocus on whole, unprocessed foods. stabilize the blood sugar, you want to try to improve your digestion. another thing is when you're eating salty and sugary foods,

consolidation are lucha academy and painter elementary and the chavez. early learning center is up for redesign. families have been pushing back ever since the district announced this plan, but no amount of public pressure will change the fact that alum rock is dealing with declining enrollment, and that's led to a budget deficit of $20 million. the superintendent says schools cost the same to run, whether they're at full capacity or down to fewer than 300 students. you can cut every program. you can cut as many district positions as possible. you're not going to get nowhere near the $20 million deficit that we're in, and it's 20 million per year. the superintendent makes his recommendation today, and the board could vote. but if the vote is pushed back to december, teachers and staff would be notified in january. as we have been reporting, schools around the bay area are struggling with declining enrollment and the end of covid era funds. just last night, oakland was discussing the future of ten of its schools. as for whether you can expect some light rain and
