those gifts give you anxiety. you are not alone. how you can enjoy the season of giving without stress. hard to believe the holidays are around the corner but here we are and we are going to begin with the growing scrutiny of of some of president-elect donald trump's cabinet picks. three names that we're watching. former congressman matt gaetz, the president-elect's pick for attorney general. there are now bipartisan calls for the house ethics committee to release its report on gaetz. second, robert f. kennedy jr., the noted vaccine skeptic was chosen to be lead the department of health and human services. the reaction from lawmakers is well mixed. >> committees are going to be conducting hearings and there will be plenty of scrutiny once the time comes. >> a lot of things i hear him say are lifted from my speeches, but there are other things he has said that give me great concern. >> and third former fox news host pete hegseth, the president-elect choice for

defense secretary, releasing information with a police report showing hegseth was investigated over an alleged sexual assault in 2017 he was not charged with a crime and his lawyer told nbc news it did not happen. released a statement saying mr. hegseth has vigorously denied any and all accusations and no charges were filed. nbc news health reporter has a closer look at rfk jr. but start with congressional correspondent julie tsirkin. the house ethics committee canceled a planned hearing and they were expecting to discuss that highly anticipated gates report. so where do things stand right now and what are you hearing from lawmakers? >> not only but perhaps deciding and voting whether to release the matt gaetz report was on the agenda and that is something mike johnson has put a full stop to this morning after he got back from his visit to mar-a-lago last night where he did meet with the president-elect although did not specify what came up in theirs

conversation. take a listen to what he said today. >> the rules of the house have always been that a former member is beyond the jurisdiction of the ethics committee. i'm going to request strongly, request that the ethics committee not issue the report. >> transparency is always the best course of action, particularly when it relates to high-ranking government officials. >> reporter: now, obviously, you see that juxtaposition from the top republican in the house and the top democrat. the thing is, though, the ethics committee has always been bipartisan. however, republicans are in control of the house so certainly if johnson messages that to the republican chairman of the panel he will follow suit although he did say the meeting was not canceled indefinitely just postponed. >> as you showed us we've heard from a few senators about rfk jr. how does his path to confirmation compare to matt

gaetz and some of those other cabinet picks? >> rfk is an interesting one because i think he's somebody who is drawing equal scrutiny on both sides of the aisle and could potentially see crossover. he is a noted conspiracier thattist. i'm sure your medical experts will go into that. from the senate and political perspective you heard from people like cory booker who said i agree with him on some things, especially the food comments he's made. other things like the vaccine comments, misinformation, disinformation or lies are going to be concerning for democrats. however you also heard from some republicans talking about mike pence for example doesn't have a big influence on senate republicans anymore, but he was in the senate and he was a member of the house before he was the president of the senate as the vice president in the administration. he had a lot of influence, and he doesn't want republicans to support him because of his positions on abortion. a lot to watch in this space. >> you'll be watching it. julie tsirkin from washington thanks so much. speaking of rfk jr., his nomination for hhs secretary

will likely prove to be a shutdown in the senate. here to dig into it we've got nbc news health reporter aria bendix. can you walk us through rfk jr.'s record here on health as we heard in julie some people are a fan of some of his stances specifically around processed foods but many are raising eyebrows when it comes to his vaccine conspiracy, flour rid in water. what's the record? >> yeah. as you mentioned some of his policies or agenda is based in the scientific origin. others steeped in conspiracy. let's take a look at where he stands. obviously, the one most familiar to folks is the idea that vaccines cause autism, a patently false claim, debunked, and someone who lost his medical license the originator of that theory. so we can toss that out. he's promoted covid conspiracy theory saying the virus targeted certain groups, white and black

folks over jews and chinese people. scary claims there suggested that cell phones and wi-fi cause cancer, that fluoride in the water is linked to iq loss or various diseases. dubious claims there. the one glimmer of hope here is he doesn't like processed foods or synthetic dyes in lunches and those aren't great for kids so there's that. >> as these sort of cabinet picks are coming forward it leads to the question how much power to these people have. health and human services has a wide scope. this is not unilateral power. what could rfk jr. do and not do? >> hasn't been confirmed. need the senate for him to do anything. let's assume he's confirmed as hhs secretary. he would have oversight over 13 different federal agencies. that's the cdc, the fda, the nih, and addiction and mental health. so pretty sweeping oversight that could affect the health of everyone in the country

essentially. obviously, the the ig that people are most concerned about what can he do with vaccines? we don't think he will have a ton of authority to pull vaccines from the market completely. he has told nbc news he doesn't want to do that. remains to be seen. but we do know there are some step wise measures he could take. he could appoint anti-vaxxers to the fda, cut funding, dissolve departments, all of that could really change our guidelines and mandates that help us maintain our vaccination levels. the wild west ahead of us. >> all of that as you said conditional on those confirmations. thanks so much. in missouri two former police officers are facing federal charges both are accused of stealing nude or intimate photos and videos off women's cell phones during traffic stops. the two cases are separate and unconnected. let's dig in with correspondent shaquille brewster. first ask you about that case against a former police officer. what is he accused of doing. >> zinhle, prosecutors are

saying that during traffic stops and under the guise of confirming insurance information or vehicle registration, the former officer would take the phones of more than 20 women and search those phones for explicit images and when he found them he would use his personal phone to take a picture before returning it. in one instance prosecutors say he found an explicit video and texted himself from the woman's phone and deleted evidence of that text. now the police department is saying they were completely unaware of these allegations before they were brought to them and released a statement saying they're essentially disgusted at this behavior which is a betrayal of the values we uphold and no way reflects the professionalism and integrity of our dedicated officers. they talk about it being a brief of trust which is a similar tone you heard from one of the woman involved who said she was

humiliated and now has to be treated for the trauma she's experiencing. >> and shaq, a former missouri state highway patrol trooper is facing similar charges. what are we hearing from both men? >> both are pleading not guilty in federal court. in this instance with the missouri state trooper, you see him on screen there, david mcknight, 39-year-old, involving nine women with a pretty similar fact pattern. both are charged with deprivation of rights or destroying records, one is charged with destroying records involved in a federal investigation. we've reached out to attorneys for both and we have not heard back. >> shaq brewster, thanks so much. time for today's cnbc money minute. a car repair chain closing hundreds of stores and kraft mac and cheese the subject of a class action lawsuit. kate rooney joins us now. >> hi, zinhle.

start with advanced auto parts closing more than 500 stores and 200 of its independent locations by mid 2025. that comes as it tries to turn around its struggling business. advanced auto did not share which locations would close and how many xwlis would be impacted. a judge ruled wednesday kraft heinz must face a nationwide class action lawsuit that alleges the company defrauded customers by claiming its macaroni and cheese contained no artificial preservatives. an ingredient used was a synthetic version making that claim false. kraft heinz say its mac and cheese had no artificial additives that it's going to look forward to defending itself at trial. if you thought returning items was burdensome retailers feel the same. 59% of retailers said in a survey from returns management company return pro they had policies for refund for customers for items that don't make sense financially to ship

chew on a new detales this hour on the menendez fight for freedom. they were convicted of killing their parents three decades ago. recently calls to resentence the brothers but the incoming district attorney for l.a. says the renewed attention surrounding the case will have no effect on his decision. he's liz kreutz. >> reporter: new details in the menendez brothers' bid for freedom revealing eric and likely's attorneys will go to prison employees as the district attorney is preparing to make his own recommendation on the case. criticizing those who have formed an opinion based on the netflix series about the murders. >> i know for a fact none of these people have actually done the hard work to put themselves in a position to understand all the facts involved in a resentencing. >> i wanted it to stop. >> reporter: the show recently

propelling eric and likely's story back into the public spotlight after they murdered their parents in their beverly hills mansion. the brothers who argue they acted in self-defense after years of sexual abuse by their father gaining sympathy from celebrities and tiktokers joining several of the family members who want them released. >> together we can make sure eric and likely receive the justice they deserve and come home. >> reporter: the filing includes personal statements from both brothers outlining how prison has changed them, correctional officers also writing in support, with one describing how eric constantly conducts welfare checks on fellow inmates. another officer writing they strongly urge the resentencing of lyle who wrote in his letter he works to help survivors of sexual abuse. >> do you believe the brothers were sexually abused. >> i have not done a thorough review and not going to base my review on a netflix documentary or limited series as many people

have. >> reporter: the d.a. elect saying he will review arguments against their release like those made by the original prosecutor who spoke out to dateline. >> if you use rationale thought on this case they should stay in prison for life without parole. if you use emotion oh, my god, why are they still there today. let them out tomorrow. >> reporter: what do you say to those who say wait a second, there's a lot of people who have maybe committed heinous crimes that are rehabilitated decades later. >> that's the point. menendez get no special treatment. they will get equal treatment. >> reporter: liz kreutz, nbc news. the new questions today about unexplained encounters in the sky that could be signs of alien life. a former department of defense official says in no uncertain terms unadernts fide phenomena are real and the government has the technology to prove it. this is what he said earlier this week. >> let me be clear. uap are real.

advanced technologies not made by our government or any other government are monitoring sensitive military installations around the globe. furthermore the u.s. is in possession of uap technologies as some of our adversaries. >> morgan chesky joins us now. the government released a new report on encounters with these phenomena. what did it find and is there life out there? >> yeah. it is certainly a question that we all ponder from time to time, zinhle, but this report took a look at these unidentified objects that were reported from june of 2023 to june of 2024 and they examined about 750 reports of these ufos per se and what they found, zinhle, they were able to find actual identifications on about 300 of them saying in many cases these were birds, balloons, or drones, but they were not able to

explain about 350 other of these cases. these cases important to note, zinhle, came from all over the world and were reported to the u.s. agency who conducted this study. one other important note here, zinhle, is that in an increasingly high number of these reports, were linked to elon musk's starlink satellite that, of course, is many more are going over the earth's surface there. so they did say that more study needs to be done to figure out what the 350 other reports are and when as much these reports are coming in from the ground, they're described pretty interestingly, zinhle. one person saying, quote, that it looked like it was a floating jellyfish with flashing lights in the sky. that was something viewed from the ground looking up above. another important note, zinhle, these reports were all in the sky, none under water, and it definitely gets you thinking when you have that many reports

that cannot be specifically explained here. >> always so many questions with these stories. i wonder if someone thinks they see something where should they go? are people calling police? >> some cases they may be doing that. what we found out in looking at this report is that these were reports coming from all over the world, from military pilots, commercial pilots and people on the ground, they were reporting them in some cases to their local authorities but the key part here is that these numbers we're looking at what this department to agency was aware of, so there are likely reports not reported to them but this really honed in on the 750 reports that were gathered by that u.s. agency here under the pentagon umbrella. >> fascinating stuff. morgan chesky ank you. th

relationship with her chief of staff. there's also allegations of misconduct and intimidation. sheriff corpus, however, has refused to resign. our ian cull is following this story. he'll have updates in our afternoon newscast. the nonprofit maintaining a popular community garden in san jose is getting the boot, but not without some harsh words from the city of san jose. nbc bay area's bob redell is at prusch farm with what this means for visitors. prusch farm here in east san jose is still prusch farm will still be open to the public. the dispute only involves the small part of the park. we're looking at about a third of an acre. it's called emma's kitchen garden. it's basically a community garden and playground for chickens. it's maintained by the prusch farm foundation, who has been ordered to evacuate the kitchen garden by monday. ordered by the city, you can see people with the foundation wheeling out some of their books and other belongings. earlier this morning, and then they'll start the big move out tomorrow. so what happened? well, officially,

the city of san jose, which runs this farm, says the foundation couldn't come to an agreement on a memorandum of understanding, an mou that the city said was needed for both sides to continue this relationship. during a news conference within the past couple of hours, sharon mcrae. she's the head of the foundation. she showed posted emails indicating that her group was willing to sign an mou, but that the city never followed up on their request for tweaks to the agreement. mcrae also showed financial documents from the city. she believes this eviction stems from the fact that her foundation questioned the suspected misappropriation of funds by the city's park and rec department. we agreed with everything, everything that was in that that proposed agreement. so your understanding is that this comes back to what you said initially. you think this is a personal vendetta. it is retaliation for us speaking out. absolutely. the san jose department of parks, rec and neighborhood services, they issued this statement, quote, while we are not moving forward

with a formal agreement for the exclusive use of the kitchen garden foundation, members can continue to volunteer at the park despite over a decade of negotiations. we require collaboration and transparency from all partners to ensure responsible use of public spaces. we're confident the park will remain a valuable hub for urban agriculture, and emma prussia's legacy will continue to shine again. the farm is still open and as far as emma's kitchen garden goes, once the foundation vacates, the city says that it will in the short term, have their park staff out here to maintain the space while they develop plans for the long term. here in east san jose, bob redell, nbc, bay area news. and a sad update. mourners are holding a vigil tomorrow for four boaters swept out to sea in the north bay earlier this month, five people were crabbing in bodega bay when their boat capsized in rough waters. only a 13 year old boy survived. search teams never found his father, his uncle and two cousins. the vigil is scheduled for tomorrow

at 6 p.m. in bodega bay at westside regional park on west shore road. we have chilly temperatures that will continue through the bay area. meteorologist kari hall has our details. here's a look at our highs for today. mainly upper 50s to low 60s. and this is cooler than normal. only 60 degrees in san jose. at least it will be sunny. and we'll have a light wind. and much of the east bay looking at highs up to 59 in pleasanton and livermore and 62 in concord, in oakland. we're going to see a high of 62 and 60 in redwood city. half moon bay in the upper 50s. and a lot of upper 50s in san francisco. while downtown and in the mission district will make it up to the lower 60s and low 60s as well for the north bay, with an increase in cloud cover as we go toward the end of the weekend. some of us may see some rain, so i'll be tracking that, and we'll take a look at the cooler than normal weather in our microclimate forecast coming up in the next 30 minutes. see you soon. thanks, kari. california's coastal commission is moving

grow what feels good. here are some of of the sto making headlines. the faa said he helped an american airlines flight avoid crashing into a mountain. it happened on a flight from honolulu to los angeles. the air traffic controller intervened after the pilot did not make an assigned turn. >> 298 turn right and expedite your climb and turn right. >> american airlines is defending its pilot releasing a statement there was no issues with terrain clearance. the faa is investigating. and the texas supreme court has ruled that the state can move forward with the execution of death row inmate robert robertson. last month a group of bipartisan lawmakers had issued an 11th hour subpoena for robertson to testify. robertson has maintained his innocence from his 2-year-old's daughter from shaken baby syndrome. today the court ruled the

lawmakers had exceeded their power. robertson set to become the first person in the united states to be executed in a shaken baby case. the academy of motion picture arts and sciences announced comedian conan o'brien as the host for the 2025 oscars. he is known for previously hosting late night talk shows on nbc and cbs and for writing the simpsons and on "snl." this will mark the first time he hosted the oscars. o'brien has hosted the emmys twice. the ceremony will take place in march. the fbi says it prevented a possible terror attack in houston and now a 28-year-old man facing charges. anas said was arrested and according to an indictment charged last month with attempting to provide material support to the group isis. he has pleaded not guilty. joining us law enforcement and intelligence correspondent tom winter. so tom, said i understand was born in the united states, but

did spend times overseas. >> he's been here since at least 2017 when the fbi initially opened their investigation. he was posting things and had ordered some bumper stickers that appeared to be more pro terrorism than pro religion. that's something they started to raise concerns over the last seven years they've interviewed him on at least a half dozen occasions and they've conducted a number of different searches. at one point he had 12 different facebook . through the course of their investigation, said has pleaded not guilty, they found a number of isis materials not only that he was consuming and reading an engaging with, but also making propaganda. that's a little bit unusual not something that we see very often as far as these individuals that become self-radicalized. since the war between hamas and

israel he's become a lot more anti-israeli, jewish and looked up jewish community centers in the houston area and i think that's one of the big reasons why prosecutors joined the fbi and became so concerned. >> this comes not one month after a foiled terror plot by isis planned for election day. foilds as we said. are they concerned about what seems to be a pattern from isis. >> isis is a growing concern. in the case of said and the houston case, that's somebody believing what they're reading in the propaganda and then engaging with it. in the case of the individual arrested for the election day plot from oklahoma city that's a situation where according to federal charging documents they're communicating directly with somebody overseas. the u.s. has seen a lot of this material over the past several months as you might remember we've talked about it, the foiled taylor swift concert potential attack, another instance of an individual making communications overseas and an investigation coming up as a

result. >> tom winter, thanks so much. opening statements today in a murder trial that has become a national flashpoint in the fight over immigration in the country. immigrant jose ibarra is accused of killing nursing student laken riley while she was jogging on the campus of the university of georgia in february. ibarra entered illegally in 2022. priya is outside the courthouse in athens, georgia. lots of evidence shown in court today. walk us through what we've heard from the prosecution and the defense. >> reporter: hey will, zinhle. that's right. we heard opening statements from the prosecution and defense and the prosecution says they have digital forensic and video evidence that proves it was jose ibarra who committed this brutal murder of laken riley in february and they were able to recover dna from underneath laken riley's fingernails they can tie to ibarra and say they recovered a fingerprint from her cell phone which she used to

has people signing off for good. the site owned by elon musk updated its terms of service and the terms say by using x users agree to let therapy posts be use -- let their posts be trained to train artificial intelligence. joining us brian and legal analyst angela. thank you for being here. first, brian let's start with you and these new terms. what are they and a what should we know? >> when it comes to ai the idea you can feed in all my tweets on the platform and use the platform to say generate something that brian would say on x. it needs to see and use your tweets or xs whatever they're calling it to make that happen. it's copying, reproducing, adapting, modifying, a number of verbs x says they have the right to use under this new terms of agreement and has gotten scrutiny. plenty of other companies in the ai space probably doing the same thing as well. >> lot of people are leaving but i've been on twitter or x for a

long time. i'm sure you as well. what does it mean for old posts. >> anything that's been used on the platform or that's been posted on the platform would be subject to this under the new terms of use. i want to point out at least up until today i checked there's a functionality you can go in and uncheck a block where their ai tool would scrape and use their data. data sharing and a blue check box that says allow your posts and interaction, inputs to be used for training and fine tuning. uncheck that box. with the terms of agreement it is unclear whether they would continue to offer that option seems to go against the point much what they're trying to do here. that is something you can do right now. >> something people can do today. what about rights? what rights do users have? i think of the mom who posted a cute picture of her family or screenwriter who posts an excerpt from their play. what should they keep in mind? >> i would say first of all you still have copyright over that

artwork, that poetry, whatever you were putting on. you are only giving x a license to use it. if you want to sell it for money that is only yours. however if as brian said the setting goes away you do not have a right to prevent x from using using your data and scraping it. this is really an industrywide trend really not just x. we saw similar update with meta and also any company out there right now using ai is having this same consent issue. >> given how broad terms and conditions are, could a user actually take elon or x to court? >> so a terms of service like this is a contract with a user, so in the same way with a contract you could sue based on two reasons, is any part of that illegal or violate a law out there you could. two, are they in any way breaching their own side of the contract? those are really the only ways in which you could take elon musk and x to court and in this case you would have to take him

holiday planning and shopping, which means financial anxiety already creeping up. caleb, any tips for tackling that? >> talk about it with your family and set a budget together as a family for this season. we don't want to overspend. live within our means and set a limit but think about things other than things you can buy. maybe experiences. experiences sometimes are much better than an actual gift which doesn't have the permanency of it. think about if you are going to buy the gifts setting price alerts for the gifts you are thinking about buying. when you do the spending, credit card, credit card rewards use those. feels good to buy something with rewards points than laying out the credit or cash. >> bang for your buck. it is ironic the holidays are meant to center piece and joy and giving and yet it brings out a lot of stress if people. so jen, any tips for that? what is it that brings out so much anxiety? >> we've lost what the delay is about. we've gotten into what's the

biggest, the best, how can we show it off. connection, peace, love, kind of bringing that joy back in. we've forgotten that an if we can get back to that the stress will come down. >> you recommend people use credit cards for holiday spending, is that right if? >> if you have rewards or the cash back, nice to get cash back putting out for those gifts. think about how much you will be able to spend and also a great time, i know it's stressful, think about resetting yourself for the next year before the big holiday spend and before the shame spending that goes on. you don't need to feel that way. know what it costs to be you during the course of this year and set yourself up for a good start to the new year. you're going to enjoy the holidays more. >> you mentioned investing in experiences. i think people know about the tangible gifts. >> take the family ice skating, go bowling, a hike, something different that you wouldn't normally do together as part of

the celebration versus your box is over there, yours er there and yours over there. do something you will remember together and take cool pictures create that type of an environment versus the expectation that you're going to get something like a present or toy. >> create memories. things don't get shoved on a shelf and forgotten. the memory you hold on to for a long time. >> i love that. you mentioned shame spending, and i am mindful sometimes you might get a gift you can't afford and you might feel a little awkward about it. how do we overcome the guilt. >> guilt and same are not the same but use them interchangeably and guilt is how we feel about what we did to somebody else. if we're over spending that's our shame. if i feel like i'm doing it because i had to or because you expected it of me and i didn't do it there's the giltsz. how can you say no. what do you need to do to center yourself and say what is it possible to do. no is a full sentence. what are my limits and boundaries and be okay with

that. you can give me something expensive because it works for you but doesn't have to work for me. >> people shouldn't feel pressure if they get something pricey, notice it and say i appreciate what you gave me i can't reciprocate in kind here's what i can do. >> you talked about high cost. we can use the credit card. i love shopping sometimes when you see the balance that's not fun. how do we manage credit card debt? >> have the preset spending limit or get the card that has the preset spending limit so you don't go above it and set up alerts if you're drifting outside of your budget for the holiday season whether it's for a trip, for gifts or putting a dinner together, be aware of that. it's okay to do it, just be aware of it so you can adjust in other ways and don't feel bad. you will hear how much we're all expected to spend. spend what you can. create an awesome experience and don't let the financial shame and guilt drag you down. >> i feel like as you get older the circle of gift giving gets
