administration. >> this as biden takes one of his last final trips as president. we have both angles covered for you. let's begin with allie raffa outside of mar-a-lago. >> good morning. the trump team is willing to do anything possible to get the picks across the finish line quickly including potentially confirming nominees without a senate vote, only adding to the growing fallout over the president-elect's cabinet choices. >> reporter: this morning, new pressure on the house ethics committee to release the report on former florida congressman matt gaetz. new testimony emerging from a woman who says she saw gaetz having sex with a minor at a house party in orlando in 2017. her loif says the woman testified before the committee in april. a gaetz spokesperson responding saying, merrick garland's doj cleared matt gaetz and didn't charge him. are you alleging garland is part

of an a cover up? gaetz is donald trump's pick for attorney general and faces allegations of sexual misconduct and illicit drug use which he denies. the house ethics investigation effectively ended this week when he resigned from congress, following trump's announcement. lawmakers now calling on the committee to release the vote before a confirmation vote. >> i'm going to demand release of the ethics committee report. >> there should not be any limitation on the senate judiciary investigation. >> reporter: house speaker mike johnson argues that it stays buried. >> it is important to maintain the house's tradition of not issuing ethics reports on people who are no longer members of congress. it would open a pandora's box. >> reporter: half of republicans privately say they don't see a path for gaetz to be confirmed.

but the trump team remains confident he will be. trump's pick for defense secretary, pete hegseth is facing sexual misconduct questions as well. police in monterey, california say he was investigated in 2017 for an alleged sexual assault after a gathering at a hotel hosting an event for republican women. he was not arrested and no charges were filed. hegseth's attorney telling nbc news he was cleared, it didn't happen. the trump team saying hegseth has vigorously denied all accusations and no charges were filed. there is a new voice speaking out against robert kennedy jr. for health secretary. pence calling it an abrupt deparching from the pro-life administration.

make headway on the jennings creek fire. officials cautioning the wildfire risk for more than 40 million remains. forecasted 30-mile-per-hour winds could spark new flames this weekend with crews from across the country now joining the fight. it is welcomed help amid an unrelenting fire season. of the roughly 1300 wildfires in new jersey this year, nearly half of them have broken out in the last six weeks including this one encroaching on homes 50 yards from here. all while crews are still battling fires from months before. >> have you ever seen a fire burn this long? >> i have not, no. >> reporter: woe followed fire warden ben brick into the state forest to monitor a fire that has been burning since july, thriving in parched roots and debris underground. >> we never got the rainstorms or the tropical moisture that we rely on for the summer months. so we have this on our hands now amongst other incidents.

february. >> he went hunting for females on the university of georgia's campus. and when laken riley refused to be his rape victim, he bashed her skull in with a rock. >> reporter: 26-year-old ibarra is an up documented migrant from venezuela. the case has become a flashpoint for the national debate over immigration. the prosecution revealed body cam video from the police officer who discovered laken's body. only the audio was publicly shared. >> i found her. ma'am, ma'am, ma'am. >> reporter: prosecutors also played a 911 call that riley tried to make, and pointed to an array of digital evidence including her smart watch which tracked her until the moment her heart beat was no longer detected. they say ibarra's dna was found

under riley's fingernails and fingerprints on her phone. the defense calling the allegations of sexual assault allegations. >> evidence that jose ibarra killed laken riley is circumstantial. >> reporter: and taking issue with how the case has become political. >> people have used this case for their own personal dpan, financial gain, political gain. >> reporter: earlier this year, royally 's dad told nbc news he is also frustrated that his daughter's death became intertwined with politics. >> it makes me angry. i feel like they are just using my daughter's name for that. she was an angel. >> reporter: there was no jury in the courtroom on day one. that is because earlier this week, jose ibarra waived his right to a jury trial. his fate and potential sentencing is in the hands of the judge. >> thank you so much. a scary scene overnight at dallas love field airport after

a gunshot hit an american airlines plane while f it was on runway. no one was hurt but it comes with a number of other incidents this week as americans prepare to take to the skies. tom costello has more. >> reporter: sas flight 937 was west of greenland when it hit severe turbulence, backpacks and cups thrown about the cabin. one engine shut down and the pilots guided the plane down as they restored the engine. no significant injuries but any plane must be inspected on landing. the crew turned back and landed in copenhagen. in honolulu, an air traffic controller ordered a departing american airlines flight to climb fast to avoid a mountain after the crew failed to make a

right turn fast enough. american says the crew requested and received right turn clearance and complied with controller instruction. >> the crew was late making the turn but they did not receive a ground proximity warning alert so it says they were well above the terrain at all times. >> reporter: meanwhile, children braced before an emergency landing on an alaskan airlines flight at l.a.x. after blowing a tire from takeoff at washington dulles. the scares come a week before the thanksgiving rush that kicks off with airlines expecting to carry record numbers of flyers paying higher prices and leaving few open seats. back to you. >> thank you so much. it is time for a first check of the forecast. for that we turn it over to angie lassman. >> hello. we have to talk about the fire weather because it is ongoing and something the folks in the northeast are dealing with and

it lasts through the weekend as well. we have 42 million people under fire alerts. notice how expansive the red flag warnings are from boston to philadelphia. we have all of the ingredients to see the fires start and spread quickly. one of the things we will see today is dry air in place. we are talking 10% to 20% humidity, bone dry air that has settled in from new jersey to boston. on top of that, gusty winds that we have been dealing with for days and days continue. wind gusts up to 28 miles per hour for boston, close to 30 for new york city. if you are looking ahead to when we will get the next rain to help with drought conditions, it will be a while. this takes us through wednesday. not a lot of rain. finally by thursday into friday, we could see some of that much needed rain working into the region, maybe an inch to two inches in spots. essentially the big picture look of the drought cros the country is still ongoing. about half of the country is still under a moderate drought.

i'm kira klapper. we have new developments in the troubled san mateo county sheriff's office. one of the sheriff's top assistants, whom she promoted just weeks ago, has now stepped down. acting assistant sheriff matthew fox resigned thursday night. fox had spent 25 years in law enforcement, mostly in daly city, before stepping down in san mateo county. sheriff christina corpus had just promoted fox to assistant sheriff in september. it's not clear why fox stepped down, but it comes just days after that independent report accused corpus administration of multiple lies, conflicts of interest and abuse of authority. you have to go ahead and ask yourself why is command staff continuing to leave? and i think that has a lot to do with the dysfunction that we've seen in the department that was outlined in that 400 page report. san mateo county supervisors say they forwarded the report to the district attorney, the attorney general and a civil grand jury

into silence or testimony in his favor. combs pleaded not guilty in september to charges that he coerced and abused women for years. the fbi says reports are growing of the racist and offense text messages from anonymous phone numbers with messages peag sent to high school students, latinos, and members of the lgbtq community. some people received texts saying they were selected for deportation or they should report to a re-education camp. now the agency began investigating the offensive messages last week when black americans were targeted with texts saying they were quote slethed to pick cotton at the nearest plantation. some of the messages were sent from text now which says it is shutting down the accounts. the university of kentucky women's basketball coach gino aeroiuma has put his name in the record books. he won his 1216th victory when his yukon huskies topped north carolina and tied him for the

most basketball wins in division one history, originally set by stanford's tara vandermeer. he has a chance to break the record saturday night. bryan kohberger, tha man accused of stabbing four university of idaho students to death is trying to get evidence thrown out. dana griffin is here to explain. >> good morning. in a lengthy new motion, kohberger's defense team hoping to keep out the most critical evidence to the prosecution's case including the dna evidence that allegedly links him to the crime as well as his digital footprint. his lawyers say his constitutional rights were violated when police used dna evidence they say was obtained illegally from garbage outside of kohberger's parents' home in pennsylvania a month after the murders and said there was a genetic match to the single source of male dna found on the knife sheath left at the crime

scene. the suppression preef arguing that without the dna, there is no case, no surveillance of the home, no dna taken from the garbage out front. they want that evidence and his phone and google records kept from the jury. kohberger is accused in the november 2022 quaduple stabbing deaths of university of idaho students kaylee goncalves, ethan chapen, and xana curnoegal. he was studying criminology at a nearby university. the judge entered a not guilty plea on kohberger's behalf. a hearing is scheduled in january to address this latest legal battle. kohberger's defense was successful in getting the trial moved from moscow where the murders occurred to a county with a larger jury pool. they are fighting to take the death penalty off the table. we are awaiting a judge's decision on that motion. >> thank you so much. laura, you know this case incredibly well. one key question is whether

authorities found a murder weapon. >> they didn't and that is part of making it unusual. they found what they believe to be his dna on the knife sheath that was found next to a victim but they never found the murder weapon, the knife. so they used public genealogy data bases which is controversial here, and the law is untested in the area and it is part of what he is using to challenge the evidence and try to get it thrown out. it will be interesting to see what the judge does with that since it is this area of the law that is undergoing testing. >> so many interesting things that will come out of this case. >> and so many people watching the case. let's get a check with angie on the forecast. what's going on? >> hello, hello. we have mild conditions east of the rockies. if you like the warm weather, you will see temperatures in places like dallas, low 70s. that's nice for outdoor activities. we have upper 60s in portions of the plains. even chicago, not warm by any means but a little above normal for this time of year with temperatures in the low 50s.

west of the rockies, a different story. that's where more of the cooler air has spread in. and then by the time we get to tomorrow, upper 50s for washington d.c., upper 60s and folks to the west get to the 70s. this system will leave us with unsettled weather for folks in the plains. texas dealing with heavy rain and we will see the potential for severe risk, so heads up especially west texas. by the time we get to our work week, this system will track to the central plains and it will be a busy commute for folks in central texas. that heavy rain will work to the east as we get

hi. i'm kira klapper, a surprising resignation within the troubled san mateo county sheriff's office. as sheriff christina corpus fights calls for her to resign instead. won her high ranking employees. has stepped down. acting assistant sheriff matthew fox resigned thursday night. fox worked for 25 years in law enforcement, mostly in daly city, san mateo county. sheriff corpus had just promoted fox to assistant in
