definitely want to stick around for. >> good news today. we begin with the breaking news in the new york hush money case of president-elect donald trump. >> prosecutors are asking a judge to postpone sentencing, however, the manhattan district attorney does not want the entire case dismissed. >> the president-elect was convicted, as you may remember, of 34 felony counts of falsifying business records earlier this year. mr. trump was scheduled to be sentenced one week from today. >> joining us now, nbc news correspondent garrett haake, and nbc news legal analyst, danny cevallos. good to see you both. garrett, let's start with you. what happens next, and how is the trump team reacting to today's news? >> reporter: well, for the trump team, more delay is essentially another victory. they're out with a boastful statement calling this a total and complete victory for donald trump. the reality here is what happens next remains in judge merchan's court. it's not clear when or if he'll issue a substantiative ruling on this. he's going to have to make a decision on sentencing.

the trump team is moving on almost entirely from this case. they have viewed it as a distraction for the president-elect who's even nominated or selected, i should say, one of his defense attorneys from this case to be a nominee, to be a deputy attorney general. no rer sign i can find that they're looking past this and towards his administration next year. >> thank you. danny, prosecutors say they are open to the idea of pausing everything, actually, for four years until mr. trump is no longer the president. any sense how judge merchan might respond to this? >> yeah, the prosecution is being not only reasonable but also practical because they realized, number one, that in all likelihood, the trump defense team's appeals of any decisions at this point, before inauguration would likely result in a stay of sentencing anyway. number two, they probably don't care. for them, a win's a win. so if the sentencing happens after four years of trump's final term, then i guess they've decided that they're okay with that. and then third, they really

don't have the power, justice merchan, if he were to sentence him in the next few weeks, if he proposed something like probation, you likely under the supremacy clause of the constitution can't subject a president with a phone in, you can't have him pick up trash on the side of the road with a yellow vest. >> no ankle monitor, anything like that. >> that's the same as trying to send him to jail. there are scholars who think you can do that. i do not think you can do that under the constitution supremacy clause. probably the manhattan d.a. eets office, if we sentence, him, wait until he's out of office and get it done. >> we know the trump team hat the immunity claim following the supreme court's ruling on presidential immunity. any sense where he might land? >> since the election, the defense team has two opportunities, the first motion was based on the immunity decision. they're arguing, essentially, that the evidence that came in

was evidence from white house sources, his assistant, other people, therefore the immunity decision requires that evidence be thrown out, and at least he gets a new trial. now they're arguing that because of the supremacy clause or because of his immunity while in office, all of this case has to go away. they really now have two opportunities, and they're going to be looking to file the defense a second motion based on that. >> garrett, let me go back to you. you're standing on capitol hill, have you heard any reaction from lawmakers about this big legal development today? >> candidly, kate, not much. the focus up here on exhale is on donald trump's nominations and appointments to be part of the cabinet. that has consumed not just the senate but the house, where members are weighing in and fighting over an ethics complaint over former congressman matt gaetz. that news seems to have blocked out the sun when it comes to a response to donald trump today. >> garrett haake, thank you. >> and danny stay with us for

this next story, and that story is a critical hearing in the sex trafficking case against entertainment mogul sean diddy combs underway in new york. >> prosecutors and coombs' attorneys are facing off in federal court over evidence in this case. prosecutors obtained personal notes and communications from the new york city jail where combs is being held. combs' attorneys call that outrageous and a violation of personal rights. prosecutors are accusing combs of trying to influence witnesses and jurors from prison. >> danny cevallos will be back with us in a moment. let's start with nbc news entertainment correspondent chloe melas. >> reporter: sean diddy combs is going to be back in court for an emergency hearing, all because his legal team claims ederal prosecutors are in possession of privileged information they got from his brooklyn jail cell last week. they have a lot of questions. they know to know who authorized the search of diddy's jail cell. why was that information given to the u.s. attorney's office, and also trial prosecutors.

they claim that this is in violation of his constitutional rights. now, i just want to take a step back. this all started friday night when prosecutors filed an opposition to diddy's latest request for bail. they claim that from behind bars, combs has been witnessing tampering and trying to taint the jury pool. there is supposed to be a hearing on the request for bail on friday. that's left to be seen whether that's going to happen after today's hearing. i want to point out something interesting. the judge has ordered combs be unshackled in today's hearing. i'm going to be in the courtroom and i'll keep you posted on what happens. back to you. let's bring in nbc legal correspondent, danny cevallos, we were just talking to you yesterday about this case. let's say the court rules in favor of combs, saying his constitutional rights were in fact broken. how does that impact this case? >> they need to have an evidentiary hearing first to determine whether the allegations of the defense are true. here's the thing. and this is the exact issue has

happened to me in my cases. on the one hand, someone who is detained has virtually no privacy, and someone like combs, you better believe they're going to find any reason they can to search his cell. they will monitor and listen to every word on his phone calls. what they cannot do is go into his legal materials, and often clients, they have a separate area where they keep legal materials, and every piece of mail, i assume, with my mail to them is marked prominently legal, legal materials, attorney/client communications. so when the investigator went in there on the search of the cell, what did the government do to avoid accessing attorney client privilege materials. normally they use what's called a filter team or taint team. these are walled after prosecutors who are supposedly independent, they're not involved with the trial itself. they give it to them, they review it and decide whether or not it's privileged or nonprivileged material. if you notice a problem with that. i do. it's that those prosecutors,

what side do you think they're rooting for? they're rooting for the prosecution. they're not on the defensive's side. that's a common complaint. if the government intentionally accessed the material, using the taint team can remedy the constitutional violation. that's what the judge has to weigh here. the thornier issue is if there was a constitutional violation, what's the remedy. >> bottom line, for all of us nonlawyers, what could happen today? what could be the end result of today's hearing? >> i have been before judge sub before, he let'ses parties make their arguments. he might hold the decision to do research and consider the issues. the bottom line is this, if he grant's the defense's request for evidentiary hearing, information about what the government did, what they seized and how they decided what was privileged and what was not, then the government is going to be in a tough position here. they're going to have to show that the filter team and their investigator did the right thing

and did not intentionally access constitutionally privileged materials. will that result in diddy being out and getting bail pending trial? not necessarily, and will it result in dismissal of the case, that's highly unlikely. there are other remedies short of that. >> combs' team repeatedly asking for bail and release. >> under the bail reform act, the standards for determining that have been deciding. this may not change that much. >> danny cevallos, thank you so much. time for the cnbc money minute, the price you'll pay for a home still going up. >> that may be why young adults aren't moving out. contessa brewer joins us now. >> can't get rid of them. the justice department reportedly pushed google to sell the chrome browser. the doj is recommending the judge force measures on artificial intelligence and its android operating system. google said the justice department is pushing an agenda that goes beyond the case's legal scope. home prices in the u.s. rose by half a percentage point in

october, according to a report from red fit. that matches september's increase on a year over year basis, home prices rose by nearly 6%. red fin warned an increase of home buyer demand post election, coupled with a shortage of homes on the market could continue to push prices higher. and approximately 33% of adults ages 18 to 34 live with their parents according to data from the u.s. census bureau. prepandemic, the recent serge was between 2005 and 2015, and driving the trend, higher cost of living. a survey from bank of america, 50% don't make enough money to live the life they want because of high costs. how do you save money? live with mom and dad for a while. >> i did it right after grad school, and quickly left. no offense, mom and dad. i'm going to leave it at that.

welcome back, president-elect donald trump has made another choice in his rapid fire selection of his cabinet. >> mr. trump announced he has tapped howard lutnick to be the commerce secretary, ceo of financial giant cantor fitzgerald. >> the president-elect is personally calling senators urging them to support his attorney general pick, matt gaetz. the house ethics committee is expected to meet tomorrow to discuss its report. the panel investigated allegations of sexual misconduct and drug use against gaetz before he resigned from congress. let's bring in hallie jackson, nbc news senior washington correspondent, anchor of "hallie jackson now." always good to see you. a lot going on.

just around matt gaetz's selection. i know nbc news has learned that a hacker gained access to sealed testimony from two women involved in that house ethics committee investigation. what do we know? >> reporter: that's right, kate, and hello to you. and this is just the latest twist in sort of the saga that has surrounded matt gaetz. on the issue of the hacker accessing information, it's our understanding based on a source familiar and an e-mail obtained by nbc news that in fact somebody went in and essentially, like, downloaded from a secure link a bunch of testimony, information, documents, including, as we understand, the testimony of a 17-year-old. she was 17 at the time in 2017 when she said matt gaetz had sex with her at a party in florida in july, as well as the testimony and information from another person who says she witnessed this interaction between gaetz and her friend. the under age sex essentially. now, there's a question mark here as to how this happened,

but attorney john clune, who tells nbc news, an attorney for the girl who was under aged at the time, we were informed by another law firm that an unauthorized user accessed a shared file. nbc news had conducted an interview with the attorney who represents the woman who says she witnessed matt gaetz having sex with a 17-year-old. we should note these are allegations that matt gaetz has long denied. his team doing so again. just over the course of the last 24 hours. the trump transition team continues to stand by him. i want to play a little bit of the conversation between joel leppard, the attorney, and myself, about what his client says she saw. >> she was walking outside to the pool, and she observed to her right, her friend, who was 17 at the time, having sex with representative gaetz, leaned up to what she described as a game table of some type. >> did your client believe that gaetz at the time knew that her friend was under age? >> her belief was that representative gaetz had no knowledge that she was under --

>> so, again, gaetz denies the allegations here. the situation has turned into a question mark as to his confirmation process on the senate side, if he would have enough support to in fact be confirmed to lead the justice department, to be the ag. big pivot point is going to be potentially tomorrow when we understand that the house ethics committee will meet and decide potentially whether to release the report into matt gaetz, and has spent months and months investigating. as a matter of fact, the client said they too testified to the committee this spring. >> that was a great interview and to the point of cabinet confirmations, we mentioned that the president-elect is personally calling senators here. nbc news also learning that the vice president elect, j.d. vance will be on capitol hill tomorrow, trying to garner support for trump cabinet picks. how are lawmakers reacting to all of this political pressure? >> depends on which lawmaker you ask. the rubber will meet the road, once this is actually in front of them, if in fact, this confirmation, the selection continues to be mr. trump's pick to the point where the next senate obviously then votes to confirm.

you can see meeting right now, has been calling on sheriff christina corpus to resign after an independent investigation found that her department allegedly fosters a culture that is racist and homophobic, retaliatory and humiliating. the investigation also points to evidence showing the sheriff and her newly appointed assistant sheriff were involved in a personal relationship with one of the supervisors behind this measure says the need to remove the sheriff is urgent. we continue to hear of people leaving the sheriff's office because of the dysfunction there. it's not something that we would bring to the board if it if we didn't have to. one resident who spoke this morning said this move against the sheriff, who is a woman of color, is racist. the sheriff says this inquiry was politically motivated. one sided and filled with lies. last week, the board was about to consider a resolution to remove the position for her then chief of staff, who she's allegedly

having that relationship with. but sheriff corpus walked into that meeting and promoted him to assistant sheriff. now the county does not believe that that man who is a civilian meets the requirements to be an assistant sheriff. shortly after the previous assistant sheriff, matthew fox, he resigned. in a statement, the sheriff thanked him for his service. i did reach out to the sheriff's office this morning. they said if the sheriff does release a comment, they'll be sure to send it to us. yesterday, lawmakers representing san mateo county at both the state and federal level. they issued a statement calling on sheriff corpus to resign, saying, quote, the turmoil engulfing the sheriff's office continues to damage the organization and its members and jeopardizes public safety. during the public comment this morning, about half or for this measure to remove her about half. again, some of those against a special election would cost too much money here in redwood city, bob redell nbc bay area news. we are learning new developments about an officer involved shooting at a union

city bart station. bart police just wrapped up a news conference about an hour ago and confirmed they shot and injured jasmine gao. the shooting happened last night around 9 p.m. in the station parking lot. that's when officials say they responded to a reckless driver. police stopped the car, but they say the driver assaulted an officer. and that's when officers shot gao. she was taken to the hospital. she's listed in serious condition. once cleared, police say she will be taken to the alameda county jail. she is facing several felony charges, including assault with a deadly weapon on police and resisting arrest. big discussions in oakland today as the city is facing a budget crisis that could lead to some steep cuts in public service. the meeting just wrapped up this hour. city leaders discussing a $93 million budget shortfall. much of the deficit comes from overspending and public safety, but city officials also banked on millions from the coliseum sale to offset the problem. that revenue has been delayed. today, council members called for more guidance from city administrators. since these rules are beyond the council's legal power. because i hear a

lot of problems being stated, but no real solutions, particularly when it comes to what is the administrative suggestions for what we need to do in this moment. mayor sheng thao has said before, the cuts were likely with or without the coliseum deal and just yesterday union leaders rallied against proposed cuts to the police and fire departments. okay, we've got another chilly day in the bay area, but it's expected to stay dry for now. here's meteorologist vianey arana, and we had a chilly start with 30s and 40s for the afternoon. we're going to remain cool and comfortable dry today before that rain moves in tomorrow. upper 50s low 60s throughout. you'll notice the increase in cloud cover. and here's what we're keeping a close eye on. we've got the atmospheric river, one of our first major storms of the season will be making its impact starting tomorrow. and here's a look at what you can expect wednesday into saturday. with the possibility of isolated flooding. the north bay will get hit the hardest, especially with that initial arrival on wednesday. could see anywhere

headlines on "nbc news daily." new video from a doorbell camera shows the moment of a deadly home explosion in ohio today. the blast leveled the home sending debris flying into neighbors' yards. people living in the area say they could feel and hear the explosion for blocks. fire officials say two people were killed, one person was taken to the hospital with burn injuries. the cause of that explosion is still under investigation. and federal investigators are blaming cooking equipment for causing a deadly explosion at a plant in louisville, kentucky, last week. they said in a news conference yesterday that they believe the appliance failed to vent properly, causing it to overheat and th to explode. two people died in that explosion, and nearly a dozen others were hurt. it's not yet clear what the equipment actually was being used for. however, the company that makes products for the food and cosmetics industry. and macy's is giving us a first peek at some of the new floats set to make their debut that this year's thanksgiving

nuclear threats over the course of this war. but what's unique this time around? >> reporter: well, we don't know. i mean that's honestly, part of the concern. there was a deep, deep concern back in october 2022 that russia might use a tactical nuclear weapon in ukraine. didn't happen, but we know that was a fear because we know from western leaders who were in those conversations. so now russia has changed its nuclear doctrine. the key piece that's shifted, can use nuclear weapons against a nonnuclear state if that state is supported by a nuclear state, clearly a message to ukraine and the u.s. that being said, those long ranged atacms missiles five of them were shot down overnight. russia says. one hit a weapons depot. so so far the damage is limited, and perhaps that means that russia won't escalate. i should say too, a kremlin spokesperson saying today that

nuclear weapons remain the last resort, and these nuclear threats have been made many times since the war in ukraine began. and of course so far, nuclear weapons haven't been used by russia. >> and, keir, you alluded to it, but two u.s. officials say ukraine hit russian territory with the u.s. supplied missiles, what might all of this indicate about where this war is going? >> reporter: well, one of the things happening here is that both sides are escalating their battlefield push, if you like, and the rhetoric ahead of negotiations, which are clearly likely to come because, you know, president-elect wants to see a deal done. he has promised that he will bring peace during the election, and he's going to want to try to deliver on that. what you're seeing is the russians using thousands, getting ready with thousands of troops, potentially to push ukraine out of the kursk region, and you're seeing, for example, the ukrainians using these long range missiles as you mentioned to try to stop that. a lot of this is about positioning, the two sides positioning themselves ahead of

talks. >> keir simmons with the latest, thank you. millions of people on the west coast are bracing for some extreme weather conditions. >> we're talking wind, rain, and even up to a foot of snow in some parts of california and the pacific northwest. >> nbc news meteorologist bill cairns is tracking some of that for us. some of the severe weather is coming from a bomb cyclone. it sounds intense. what is it? what should we expect? >> more like a double bomb cyclone. this measures the pressure and has to be a certain intensity. this one doubled what is normally typically for calling anything a bomb cycle. this is about as intense and strong as it gets off the pacific northwest coast. you can see that little curl there. the atmospheric river to the south of it is now parallel and coming into northern california, and that's never a good thing. this atmospheric river is in the extreme category for a few areas. you know a storm is really really strong, and now we're starting to watch the rain

coming in, the winds arriving on the coast also. eventually we'll get the high elevation snows and the rainfall totals. this is the first storm. we're going to get another one in two days, then another one after that on the tail end of the weekend. three storms in six days. this is the rainfall total for the next six days. everywhere you see in orange, it's 5 inches, the darker colors up to 10 inches. the bay area northward, northern california is going to get the worst of it. the snow forecast from mount shasta is 5 feet. everywhere in the cascades and also the sierra, easily over 2 feet, all of the highest elevation. and doing traveling in the peeks, of course that's going to be treacherous if they're open. as far as the high wind warnings, coastal areas could get guests. wind damage is also possible. as far as the storm goes, this one is going to be the strongest of the next three, but the one

behind us in two days, no doozy either. >> bill karins, thank you so much. we are just one week away from the thick of thanksgiving and the travel rush. >> aaa is forecasting a record number of americans packing flights, hitting the roads. what should you expect if you're one of them. nbc news senior correspondent tom costello reports from reagan national airport. >> it's already one of the busiest times of the year to travel. this thanksgiving is shaping up to be a record breaker. aaa says a whopping 71.1 million americans will hit the highways. that's 1.3 million more than last year. the good news, relief at the pump. the national average now 3:06 a gallon, according to gas buddy. a year ago it was 3:30. 12 states right w have averages below 2.75 a gallon. >> what's driving gas prices lower? >> a lot of it is seasonal. gasoline demand declining in the cooler weather, but a global
