federal criminal case against sean "diddy" combs. the music mogul appearing in a new york city courtroom pushing to secure his release from jail. he pushes for freedom after facing charges for racketeering and sex trafficking. it is alleged he was the leader of a criminal enterprise after sexual abuse of men and women in a scheme that spanned decades. homes is disputing the charges against him. let's bring in our nbc news legal analyst who has been following all of this with us. this is the third time now that sean "diddy" combs is asking for bail. the prosecution accused him of intimidating witnesses from behind bars. how does that factor into the decision that the judge has to make now? >> when considering deal, there are two issues at play for one, is the defendant a threat to the community? and number two, will the defendant run away? is he not likely to show up for

trial? what happens here is defendants get into jail and they start intimidating witnesses and the government will say that that means he is a threat to the community. even though he is in jail. the notion that he may be intimidating witnesses is the kind of threat to the community. and colmes, like many federal prisoners, is watched and phone calls are monitored. it is hard to play games with the system and tried to reach out and contact potential witnesses. that is what the government is arguing. that not not only should he remain without bail but because of his behavior, since he has been incarcerated, it shows that keeping him in prison or in detention, is warranted. >> you are a criminal defense attorney. what is the reason they would want him out of jail? is easier to work with him as his defense, right? >> i cannot tell you the difference it makes to have a client out as opposed to in custody. when they are out, i can pick up the phone and send an e-mail and talk anytime i like. if i want to talk strategy with
