atmospheric river that's been affecting the central coast to the south bay, but also sending some waves of rain farther northward and affecting some of the areas that are trying to dry out and recover from all the rain we had last week. we are seeing the rain now, moving back into marin county and santa rosa, but where we see the yellows and reds on storm ranger is now moving across the bay and heading northward. as we are going to see some times of this rain affecting not only your way out the door and your morning commute, but as well, we are going to see that rain into later today. our hour by hour outlook does show that we are going to see those showers moving through parts of the east bay, with some breaks later today. so this latest storm comes with much of the bay area still trying to recover from that rain that moved through parts of the bay area on friday. so our ginger conejero saab is live on the peninsula where the flooding concerns are still front and center right now. well, flooding may be on people's minds as the wet

weather continues to head south from the peninsula, which is where we are. we're close to downtown palo alto along university. it's not raining all too much right now. you can kind of see the slippery roads or the slick roads. i should say, but it has been a little bit on and off as far as the rain is concerned this morning. people, however, are bracing themselves for the rain because of the amount of rainfall that we saw in the past days in the north bay. let's take a look at some of what happened there. the russian river surged just below moderate flood stage this weekend. also over the weekend, authorities confirm a fatality in sonoma county close to highway 116 and maze canyon road. a car was spotted in a flooded roadway saturday morning. first responders recovered the man, who was in that car, but he was pronounced dead at the scene in santa rosa, firefighters pulled another man's body from piner creek, though police say it is not clear if his death was storm related. now going into the

weekend, san francisco got soaked. a flash flood warning went into effect for a couple of hours on friday. a couple of the neighborhoods really saw the effects of that. the mission district saw flooded streets and gutters. the western addition underpasses looked like pools, and the marina district saw flooded gutters and stalled trucks. now, as the wet weather begins to return, a business in san francisco is ready in case the rains cause more minor flooding. luckily, we have lots of soil in bags, which basically double as sandbags, so we were able to like put those around and kind of divert water from coming in as much as we could. and as the trees on university avenue are so beautifully lit this morning, it's a reminder that the holiday season is upon us. it is the start of the thanksgiving holiday week, which triple a as far as travel plans are concerned, will start counting tomorrow. choose the tuesday before thanksgiving. an estimated 80 million people are expected to travel more than 50

no surprise here because this assistance really is needed because youth homelessness we're seeing here in california. back to those pre-pandemic levels. unfortunately, you are correct. good morning to you, marcus and laura. most california students, they're excited to have this week off so they can go be at home with their family. but sadly, there are more than 200,000 k through 12 students here in the state of california who do not have a place to go, do not have a home to go to. this week. this is a sad statistic that we are reminded of as this is the last week of youth homeless awareness month. according to the public policy institute of california, the number of students in k through 12 without a place to live here in the state of california has returned to pre-pandemic levels. the number fell to around 3.7% during covid. then in 2022, 23 bumped up back to 4.1%. that represents just under 250,000 kids here in the state.

right, bob, thank you. turning back to our weather coverage this morning, we're under a microclimate weather alert. we have a live look at our storm ranger mobile doppler radar scanning the skies up on san bruno mountain. another round of rain moving into the south bay. it's here. it's wet out there. kari. and it's mostly moving across the south bay with the heaviest rain. but we've also seen that rain spreading northward and affecting parts of the north bay as they try to dry out the yellows and the reds on storm ranger, indicating some really heavy rain. moving into sausalito, parts of southern marin county, as well as over the contra costa county. as you're heading out driving on 680, you may encounter some of that really heavy rain coming down and a steady rain elsewhere. so as we head down to gilroy, this is one of the areas that may see the rain continue for a lot longer throughout the day compared to areas to the north. so the rain will be heavy through 11:00, getting lighter with some breaks in the activity, but the high temperature staying in the 50s for today. we'll be tracking the

cooler weather and eventually talk about some drier conditions in time for thanksgiving. that's coming up in a few minutes. mike's been tracking where we can find lower gas prices. yeah, we'll talk about that rain, but let's start with the gas prices. contra costa county today. the low is in concord. 359 at bond fair market on willow pass road. the next price in line in the middle here in marin county, we got mill valley with the low of 367 at arco on redwood highway. and the last number, it's much higher if we head down to the south bay. sunnyvale's low is 379 at national petroleum on old san francisco road. there have been some changes over the weekend and likely through this week of a lot of driving. let's check with gasbuddy.com. no matter where you go, let's get out to the roadways though, where you're going pretty much everywhere at a good speed, but tougher conditions, of course. wet roadways this one section may be a concern. south 101 between fair oaks and lawrence expressway. we've had two crashes in those demarcated areas. there may still be a traffic break after they try to clear vehicles, and in fact,
6:13 am
they successfully cleared vehicles to the right shoulder in both cases, i believe we're looking at northbound 101. the volume pretty steady, relatively light right now, and the conditions still slick in san jose. back to you. thanks, mike. 612 this morning. and you know what? holidays are here. and that means you need to x off those items on the shopping list. even with prices at record highs, americans plan to spend more than ever. we're going to break down the math when we return. plus, happy holidays, merry christmas. whoa, whoa. santa ready? there's a new twist on the south bay tradition. we're going to take you for a ride. see all the lights and the sights and sounds. even the pooches are out there. not on four wheels, but two. keep it here. you won't want to miss it. coming u

than it typically builds to this capacity full at the toll plaza for all lanes. we'll show you those conditions and the commute coming into the area. good morning. wall street is set to open higher as the markets kick off. this holiday shortened weekend. investors react to president elect trump's pick for treasury secretary. hedge fund manager scott bessent. now he's seen as someone who would be supportive of the stock market and may favor a more gradual approach on tariffs. the markets are coming off a winning week, with the dow rising about 2% to record highs, and the s&p 500 and the nasdaq gaining more than 1.5%. now in focus this week, we get down on housing, consumer confidence, inflation, durable goods and gdp and shoppers are expected to spend an average of $650 between black friday and cyber monday. that's up 15% from last year, and that's according to a new survey out today from

deloitte. now, for the entire holiday shopping season, consumers are projected to spend just under $1,200. that's up 8% from 2023. and they say they're willing to spend more, even as higher costs continue to weigh on their wallets. about 80% of retailers expect sales growth this season, helped by traffic both in store and online. and krispy kreme is bringing whoville to life this holiday season. it's rolling out a mary grinch miss donut collection for a limited time starting on black friday. it has three new donuts based on the characters from the iconic doctor seuss book the grinch, grinchy claus and cindy lou who and customers can get a six pack or dozen at participating stores or through the krispy kreme app as well as at select grocery stores. with your cnbc morning business report, i'm silvana henao. those are pretty adorable. yeah. yum yum. well, here's a live look for you this morning over at the

6:21 am
northward. we also have a wave of rain that's moving through alameda county and moving into the delta, where we are also seeing some rain picking up for the san mateo bridge and moving down toward palo alto. lighter showers elsewhere, but this activity will continue, at least for the near term as this storm system is moving through. and i know it's a big travel day, so you're probably checking ahead to those delays that rainfall in san francisco is leading to about two hour delays right now. and in dc we have about 30 minute delays. but elsewhere we're not seeing a lot of those travel delays as of yet. but i do think that sfo is going to continue to see those problems. as we are looking at some off and on rain throughout the morning, but notice how we're not seeing as much of the activity going into today. so it could be in the tri-valley as well as the peninsula where we're seeing just a cloudy sky for most of the day. every now and then, some light rain coming through, but it's mainly going to be the south bay down to the south county. that gets the heavier rainfall and chances
6:22 am
will continue into tomorrow morning. and then we start to see things clearing out. so between now and tomorrow morning we could see another 2:45 tenths of an inch of rainfall. and it could be a little bit heavier for morgan hill and areas just farther to the south. but then once this system pushes out by late tuesday into wednesday, it's looking dry for thanksgiving and even thereafter, for much of the bay area, we could start to see some scattered showers for southern california by the end of the week. but it looks like that stays away from us. so taking a look at our 7-day forecast, we're in the brunt of this storm for what we are seeing right no. tapering off between today and tomorrow and then going into the rest of the holiday week looks much better. and mike, the commute is a little slower to form. yeah, because it's a lighter volume this week. likely to be a monday, tuesday, wednesday. and then of course thursday and friday. of those folks, we thank whoever's working those days. most are off on vacations. we're looking at the wet commute, though damp roadways, slick roadways, blue

shows where there's likely puddling and ponding through many areas. we're still seeing standing water in many intersections coming through san francisco, having just seen more rain on many of our cameras, we're looking toward the richmond bridge, where there's a slick roadways and also some flashing lights. i'll check on those back to you. thanks, mike. coming up next on today in the bay, nbc bay area responds. she bought a product that's supposed to relieve stress, but her purchase is actually increasing it. i'm consumer investigator chris chmura. nbc bay area responds next

6:27 am
and gave joanne her $1,564 back. we asked walmart for a comment, but it only told us it resolved this directly with the customer. joanne actually asked about the return policy for that chair before she purchased it, and that's a savvy move, especially if you're ever buying a large or expensive item. if you think a company is sitting on your refund, let us know. snap the qr code on screen right now to fill out our consumer complaint form online. thank you very much, chris. 626 we do have a lot ahead for you. coming up at 630 this morning, south bay getting drenched this morning. meteorologist kari hall is tracking a new wave of rain hitting the bay area. and just how long it will last this holiday week. and the menendez brothers, who you might know from the small screen, will be appearing on screen in a courtroom today for the first time in years. we'll tell you what's at stake. you're w

elect donald trump fills out the final top positions of his administration over the weekend. but can they survive the confirmation battle? well, we're breaking down what's next for trump's most controversial choices. this is today in the bay. good morning. on this wet monday. i'm marcus washington and i'm laura garcia. we are under a microclimate weather alert. check out all these cameras across the south bay this morning where the rain has been coming down overnight. and this is, in fact, what it looked like overnight in palo alto. new video just coming in. within the past hour, as the new storm has been making its way through. but the question is on everyone's mind will that rain stick around for thanksgiving? meteorologist kari hall, of course, has the answers for us this morning. how is it looking for a dry thanksgiving? it looks very good for thanksgiving, but we have to get there. and there's several more days between now and then. so of course, the travel is the other issue. so we are starting out with some soggy conditions,
6:32 am
looking at upper 40s and low 50s, as you're heading out with a breezy wind. but this atmospheric river is targeting the central coast down to socal and extending up towards the bay area, with the south bay in line for the highest amount of rainfall totals. even though we are seeing rain pretty much everywhere across the bay, as we get a closer look with storm ranger, that's our mobile doppler radar. the area is trying to recover from the historic rainfall that we had last week in the north bay. is still going to see some waves of showers, at least some light to moderate rain, but the focus where we're seeing the yellows and the reds has been the peninsula, the east bay and extending down toward the south bay. but once again, you can see the rain is pretty much everywhere. as we are looking all across the bay area and then going into today, it's mostly throughout the morning, and then we start to see some breaks in the activity. but a chance of showers continues into early tomorrow, so we'll take a look at your travel forecast and thanksgiving coming up. but mike, it's a wet drive through san jose. yeah. this is our live

camera. 101 northbound typically where we see a little more slowing at about 632 in the morning. we should be seeing that second build. but look at the water kicking off those cars as they travel by. that's the big concern. northbound 101 right where the arrow is. the curved arrow that should be showing a little more slowing on your typical monday. we'll see that build, but overall a lighter volume. the green highlighting all over the bay. those conditions a slicker roadways. watch that san mateo bridge seeing more traffic coming off the east bay. nothing dramatic. again, lighter volume this week, especially monday, tuesday, wednesday and holiday traffic thursday and friday. likely for the morning commute. but we are having the buildups through the east bay and the backup at the bay bridge toll plaza can't escape that. right now we do have the water on the lens again and watch those slick roadways, especially the on and off ramps and those intersections back to you. thank you very much. well, the fate of two brothers convicted of murdering their parents in their home will be in the hands of a california judge today. the menendez brothers will appear in court for the first time in years. today in the bay's kris

sanchez shows us what the judge in southern california will consider. kris. good morning to you, laura and marcus. we expect to see the brothers in the courtroom, but via live stream. now, while there have been calls for the brothers to be resentenced for the murders of their parents, this hearing is related to their petition to have their convictions overturned altogether. eric, who is now 53, and lyle, who is now 56, are asking that their murder convictions be overturned on the grounds of new evidence. this is evidence not considered in their original murder trial, and it includes a letter from the younger brother eric to a cousin detailing sexual abuse by their father. the brothers were just 18 and 21 years old when they shot and killed their parents in their beverly hills home. after two trials, the brothers were convicted and sentenced to life without parole. while the hearing is today, the judge has until tomorrow to respond to that habeas corpus petition, which is the inmate's challenge of their conviction. the judge
6:35 am
is set to tackle a couple of issues the habeas corpus petition, based on the new evidence that's emerged. but also there's a special law in california for resentencing. if there's new evidence or if there's childhood trauma or if, in fact, they have been rehabilitated. all of those things could result in them being sprung from prison. now, this is separate from the brothers other request, which is that they be resentenced and that is scheduled for december 11th. now, between now and december 11th, a new district attorney will take office. the current da, george gascon. you might recognize him. he's former san francisco da. he recommended clemency, a shortening of their sentence, and that they be eligible for parole. now, the menendez brothers are serving their sentences in a san diego prison, which is why they are going to appear virtually. and while they won't be there in the flesh, the court still has to hold a lottery for the seats in the courtroom because of the strong public interest. laura, we will be watching. thank you. kris 635 right now. happening
6:36 am
today, vice president kamala harris arrives in san francisco for her first bay area visit since losing the presidential election. harris is headed back to dc from hawaii, where she's been vacationing for the past week. we know at this point that she and her husband, doug emhoff, are scheduled to arrive sometime tonight. no further details are being released on their stay. well, capitol hill will no doubt be experiencing some monumental change in the coming weeks, starting with a hot button selection president elect trump is making to fill out his cabinet, along with some growing questions about qualifications for some of his picks. some wonder if there is enough being done in the vetting process. well, joining us this morning to talk more about this is frank figliuzzi. he is the former assistant director of the fbi and current senior national security and intelligence analyst for nbc news. frank, thanks for being with us this morning. so let's get right to it here. why are some arguing with these background checks? because some of the people, the nominees there don't necessarily have the qualifications in the
6:37 am
departments that they will head, but that's not necessarily uncommon with other administrations as well. well, i think there's a combination of things going on here. first, it appears that president elect trump is desiring to do away with fbi background investigations for his nominees. that's a significant break with history. fbi has been doing the backgrounds on white house nominees since at least president dwight eisenhower. so you've got that break with law tradition. masai executive orders dating many, many decades back that say you need to do a background investigation and we like the fbi to do it. but the second thing you mentioned is really important as well. we've got some nominees here who not only are allegedly lacking the qualifications for their positions, but also have baggag, serious baggage that the media has caught on to and has been reporting that may disqualify them from the job. and so the concern here, regardless of what your party affiliation is, is
6:38 am
that the senate judiciary committee could be flying blind with regard to their advice and consent powers over these nominees. if they don't have all the nitty gritty details of the baggage of the allegations of a foreign entanglements, sexual assault allegations, then they're making a decision and they're doing it without all the facts. well, some critics believe trump's transition team may be trying to bypass the vetting process entirely for some of his cabinet nominees. can you talk a little, frank, about the checks in place to ensure it is transparent, the whole process? well, i can tell you what works in a normal administration, but there's nothing about this that appears to be normal. normally, the fbi will do that background investigation and importantly, people need to know the fbi doesn't make the call on a nominee. they don't say thumbs up, thumbs down. they say, here's what we found, here's what troubles us. and they hand it to the senate, to the white house first. and then ultimately it goes to the senate judiciary committee. so they are equipped
6:39 am
with that information and now what president trump is saying is i'm going to use a private investigative firm. well, that's a problem because the firm is, of course, is loyal to whoever's paying their invoice. they don't want to upset the person paying their bill, and they don't have the powers the fbi has to have to look at classified files, wiretaps, intercepts, interview people about very sensitive things, and grant them anonymity. that's not what a private investigative firm can do. and you just brought it up. the fbi there. this is your area of expertise there. and i know trump's choice for fbi director is still open right now. and some people are wondering if trump team may be ready to play politics here. can you talk to us a little bit about what may happen here, especially given the importance of the position and trump's own past legal history? yeah, all indicators are that trump is prepared to fire the current fbi director, chris wray, by the way, that would be the second time that a president trump has fired an fbi director. he fired, as you know,
6:40 am
jim comey, because comey was refusing to take a loyalty pledge. and he was investigating the russia involvement in the campaign. but fbi directors are supposed to serve a ten year term to avoid politics, to straddle presidential administrations. the concern, of course, is if we put people who are loyal to trump in one of the most powerful positions in government, fbi director, they can use the power of the bureau. the gun and the badge and all their investigative tools to target trump's enemies. that's a concern. and if it can, if all of that change dribbles down to the field office, like the fbi field office in san francisco, and we have politicians telling them what cases to open or close, then we all have a problem. all right. frank figliuzzi, former assistant director of the fbi. thanks for taking the time this morning to join us. thank you. 640 for you this morning. want to take a look out this morning? look, this camera has been kind of fuzzy. you can't see much out there, but this is over at
