>> is this expected. the special counsel saying he did this because he is an employee the justice department and' to imply with justice department policy. he asked the legal counsel inside the justice department whether the doj's pols icies th a sitting president can't be prosecuted apply before a president takes office. they said that does apply. he had no choice but to file these motions asking the courts to dismiss donald trump out of both of these historic cases. really, the decision was made when the voters elected donald trump and that was widely known during the campaign that if donald trump won these cases would go away. let's remember we are talking about criminal conspiracy allegations involving donald trump's effort to stay in power after the 2020 election leading up to the january 6th insurrection and separate case donald trump willfully retaining allegedly classified documents at his home in mar-a-lago and

allegedly obstructing justice. we don't expect in in that report. there is a lot of evidence already out there. >> jack moved to dismiss both cases without prejudice. this mean this could come back around after president trump serves his term after he is out of like. is that likely? >> those are the two most important words in either of these filings. it feels they app every third sentence over and over. i think the team is symbolic more than anything. jack smith is saying the default position is these are dismissed without prejudice and in theory could be brought again. whether hey could be brought

acted in self-defense after years of sexual becausely their father. >> today a judge rescheduled a key resentencing hearing that originally had been set for early december. joining us is nbc news correspondent dana griffin. do we know why this hearing from december or for december was rescheduled? what else happened in court today? >> reporter: we do. the judge said that he needs more time to go through several boxes of information that are still coming in to his office. he also acknowledged that new d.a. that gets sworn in on december 2nd, he said it's only fair the d.a. get time to review this information. the new court dates are now january 30 and 31. the judge allowed testimony from two witnesses. we heard from the elder sister of katie menendez and we heard from jose menendez. they are both in favor of having the brothers released saying they serve enough time and that what the boys endured was

unimaginable, even kitty's sister says that she couldn't believe that her sister allowed this to go on, at least she believes she allowed it to go on because she never did anything about if. the big disappointment we were expecting to see the brothers on web cam but did not happen today because of technical issues and somebody with the web x program at the jail. we did hear from the brothers. we are not sure which one spoke but there was a point where the defense attorney asked if they could hear or if they were on. we heard, quote, we are. and we heard another voice say, we have video access the entire time. so they got to see the proceedings. we did not get to see them. but we heard from them briefly. very uneventful except the fact we did hear the key testimony, the two sisters of the victims and the reason the judge allowed them to be heard was because they are both having medical

issues. one is going to be turning i believe 93 tomorrow and both look pretty frail inside that courtroom. >> dana griffin for us, thank you so much. a former sheriff charged with killing a judge inside his chambers has been arraigned in the very same kentucky courthouse where the shooting happened. >> sean steins pleaded not guilty to murder of a public official today and he was indicted last week. he is accused of shooting and killing this district judge kevin mullins at point blank range in september and it was caught on surveillance video. a warning this is appears to be warning. here is the judge trying to hide under his desk and several shots on fired and no audio on the video clip so we don't know what was said in that room. our correspondent is following this for us. maura, a brief court appearance and take us through what happened. >> this was the arraignment

hearing for the former sheriff. it was extremely quick and steins' defense attorneys entering a plea of not guilty. they had indicated that they are not denying that he shot the judge, obviously, you saw how the video played out on your jep. but they are saying that he did so under extreme emotionally dress. ultimately, they are going to argue that this murder of a public official charge goes too far. they want to drop it down to a manslaughter charge potentially. if convicted under that murder for public official charge, the sheriff could face the death penalty, if convicted. so that is something we have to watch if it goes to trial. in terms of next steps, we don't have the next court date appearance on the calendar but steins is held without bond because the judge he is a security safety issue and a security issue because this was a capital offense. >> do we have any side why what the motive might have been? >> there is nothing official on

the record in terms of motive but we do know a little bit more in terms of what might have unfolded just before those moments you saw on your screen when the shooting happened. kentucky state detective testified in a preliminary hearing that just moments before that video started or what we saw, there is other surveillance video from the moments before, but the former sheriff steins came into the judge's chambers and tried to call his daughter from his own cell phone before asking the judge for his phone and attempting to call his daughter from the judge's phone. now, the detective testified that phone records on the judge's phone indicates that there were phone calls to the sheriff's daughter previously. so we, obviously, can't speculate on what that could all mean but this is a very small community. the judge and the sheriff working together in close quarters before. they have been described as friends. obviously, whatever unfold inside those moments before leading up to this day was a very emotional and ultimately violent situation. >> more to come.

chicago o'hare international airport. emily is along i-95 in secaucus, new jersey. gas prices. you look at the numbers today around $3.06 for the national average for a gallon of gas. this is an improvement about 20 cents compared to this time last year. experts say if it dips below $3 and it could later this week that would be the first time since 2021. if you're looking to avoid the worst of ffic don't hit the road tuesday or wednesday afternoons where you'll see the peak congestion for new york, boston, and l.a. experts are advising drivers to check your car's battery, tire prerp and oil before you head out the door.

traveling throughout the airport today and tomorrow and the next day? >> we start with today. the average wait time for the security checkpoint line is between 15 and 20 minutes right now. earlier today, the wait was only five minutes. now this is not the peak travel day, but some travelers who spoke with us say they are trying to get an early start. take a listen. >> i thought a lot of people would be trying to beat the traffic but i guess we really did accomplish the mission. >> it's going to be really busy and i think hopefully there won't be delays but you never know. >> reporter: those folks are getting out early ahead of the crowd because they know starting tomorrow, tsa is expected to screen more than 18 million people starting tomorrow through december 2nd. now right now, airport official at chicago o'hare international airport say things are running smoothly about 94% of the flights are on time here. no severe weather is impacting

travel yet. but we know that storm is expected to make its way through. and since friday, there have been more than 17,000 flights cancelled or delayed. >> adrienne, that you have so much. >> let's bring in nbc news meteorologist bill karins. i got some flights, bill. what are the biggest thanksgiving travel threats? >> likely thursday on thanksgiving day. a lot of people more drive than fly on thanksgiving day and get to that in a second. two storms. one in the great lakes and one on the west coast and nothing compared to the huge storms we had a couple times ago but provide some wet weather and chance for flooding and especially in the mountainous areas. not widespread. right now a little area of rain. san francisco is kind of clearing out. from bakersfield south wards it's trying to shift your way and mountains in the central portions of the sierra range is where we will see some of the heaviest rainfall totals. this storm will move through the intermountain west today and

(♪♪) news daily i'm janelle wang. we're going to begin with a microclimate weather alert one more day and then this atmospheric river is moving out of the bay area. our meteorologist, kari hall, is tracking conditions for us as we take a look at what to expect. the heaviest rain moved through during the morning, and it tapers off to some spotty activity, which continues into tomorrow. mainly in the morning we'll see the best chance of rain. otherwise, cloudy and cool and we're getting ready for some drier weather just in time for the thanksgiving holiday. but this storm system is still impacting the region, and we're seeing the heaviest rain now shifting a little bit farther south and will continue to taper off going into later today with

the north bay still seeing some of the lingering showers moving through later on tonight. it will return for the south bay into the south county and then drying out on tuesday. we'll take a look at our 7-day forecast coming up in about 30 minutes. see you in a bit. thanks, kari. well, the latest round of rain comes as many are still recovering from the deluge last week. as some bay area cities are taking extra steps. our ginger conejero saab joins us with more from daly city. that's right. daly city wanted to make sure it got ahead of any potential impacts of this storm. beefing up personnel. we're joined by the mayor of daly city, justin manalo. i know, mayor manalo. you were watching the north bay and the effects of the storm. what were some of the what were some of the things that daly city did ahead of the continuing rains this week? you know, some precautionary measures for our communities. we made sure that our storm water drains were clear and the catch basins. so our public personnel, you know, public works have been out there making sure also

making sure that there's no debris or trees. we're also raising our fire and police personnel in regards to anything around trees falling down or whatnot. but everyone is basically getting prepared and on on par for this storm as well. and of course, there are sandbag locations here in daly city. a couple actually here in daly city, in case there are some families, some people who still want to prepare ahead of any potential rain after seeing what they saw in the north bay, the russian river over the weekend surged just below moderate flood stage. now, also over the weekend, authorities confirm a fatality in sonoma county, close to highway 116 and maze canyon road. a car was spotted in a flooded roadway saturday morning. first responders recovered the man, who was in that car, but he was pronounced dead at the scene. over in santa rosa, firefighters pulled another man's body from piner creek, though police say it is not clear if his death was

of our biggest issues. we've been out. like i said, for 64 days in some hotels and we're escalating the fight. we now have 2500 workers that are out on strike. the marriott released a statement saying the hotel remains open and management has protocols in place to operate amid any impact to staffing. it also says it remains available to meet with the local union negotiating committee to reach a fair agreement. governor newsom is already pushing back against the incoming trump administration. president elect trump says he plans to eliminate the current federal tax credit for electric cars. governor newsom said if that happens, he'll bring back the state's own vehicle rebate program. right now, about 25% of the cars sold in california are all electric. our robert honda is tracking this story. he'll have a full report in our evening newscast. vice president kamala harris is coming back home to the bay area. it's her first visit since conceding to president elect trump. harris is stopping on her way back to dc. she spent the last week in hawaii with her

>> people in new zealand were able to save pilot whales after washing ashore on wednesday. more than 30 whales in all and hundreds of volunteers gathered sheets and help the animals cool and moist before returning to the ocean and all but four of the whales survived and they new zealand's conservation agency called the effort incredible. a florida woman is facing 30 years in prison for shooting her neighbor to death in june of 2023. susan lorens who is white fatally shot her black neighbor owens who was knocking on her apartment door. sheriff's office said the pair had a longstanding feud over owens' kids playing in the community. multiple neighbors telling nbc news that lorens had a history of harassment and using racial slurs. she was not originally arrested following the crime and followed a public outcry. he was accused guilty in the death of owens and she is set to be sentenced too. in new hampshire, a member

of a dartmouth college sorority and two members after fraternity are facing charles after a student was drowned. his body was found following after off-campus party. people say the night of the party, several went swimming in the rim and jang could not swim. he was found dead the next day. both the fraternity and sorority jang belonged to have been suspended by dartmouth. florida's surgeon general is calling for the state's community water system to stop adding fluoride to its water florida's state top health official is going against mainstream. the florida surgeon general cites research that preliminary and far from definitive and adding to a growing debate. >> reporter: florida surgeon general speaking out against the use of fluoride in the state's water systems claiming there are safe concerns he believes are linked to systemic exposure. >> with the information that we have now to continue adding

cabinet, wrote the following on x. quote. >> i think the faster it goes out the better. >> reporter: a bill was filed last week in buffalo, new york, a different story. nine years ago the city stopped adding fluoride to drinking water and recently brought it back after public pressure and a lawsuit by parents seeking damages for their children's dental surgeries. >> there are many stories of young children who have, you know, ended up needing immediate emergency dental surgery. >> reporter: still some like dr. bruce landfear argue the use of fluoride should be re-examined. >> it's really critical that we need to pause and reassess all of this evidence and make sure that we are adequately protecting children. >> reporter: a study in october found because so many of us have started using toothpaste and mouthwash with added fluoride in recent decades it might not be as necessary to add fluoride to drinking water and one of the things the florida's surgeon general cites as well.

brands that were involved. after a recall of 167,000 pounds of ground beef that minnesota health officials link to a dozen illnesses wolverine packing company says it has notified all customers of that recall. all of that meat was sent to restaurants so they have talked to the restaurants and they are trying to that back. listeria outbreak we have been following, cdc says an infant has died. nine people have been hospitalized. four state outbreak the cdc is linking to ready to meat products from the food on your screen. the recall is active and the cdc says those products are not safe to consume. >> with all of that said, how concerned should we be heading to thanksgiving? >> it's a headline every single day the past six weeks or so. we talked to safety experts. 48 million cases of foodborne illness every single year so we

are always with these things and sometimes the product recalls don't get all of this attention. a reminder that 48 million is a lot. the best thing you can do is cook your meat to the appropriate temperature, especially if it's ground beef. it has to be cooked to 160 degrees and poultry is even higher. produce, you can't watch off e. coli from produce so you've got to really be aware. if in doubt, throw it out, if it's produce. >> especially around the holidays. >> yes. >> christine romans, thanks so much. an exclusive this hour. we are learning more about how families and immigration advocacy groups are preparing for president-elect's plans for mass deportations. >> the trump administration has not disclosed the details of its immigration plans but a recent study by the american immigration council of pro immigration advocacy group founds 4 million mixed status families could be separated under the new administration.

the children to go and making sure they have documentation that they are legally allowed to be here. it's really complicated. we done how these could be carried out. we do know no one will than exempted. if you're eligible for deportation a chance you could be swept up in these. >> so much up known and a lot of unease among these families. i know nonprofits are working to prepare families for the changes likely to come with the next administration. what exactly are they doing? >> reporter: they are trying to get order out to do exactly what the families spoke to are doing. a lot of fear and a lot of people wondering, look. can i take my child to school? can i keep going to work? am i going to be targeted simply from coming outside of my house? they are saying they need to be prepared with a plan if and they could be deported and their child remains behind and to be

and who doesn't love a good throwback? ♪♪ now with vitamin d for the dark days of winter. we're going to begin with new developments in the controversy surrounding a transgender player on the san jose state volleyball team. a federal judge has denied a request to block the spartans from competing in the mountain west tournament. several teams have protested the transgender player by refusing to play the spartans this season, and last week, players from colleges in the conference filed a lawsuit. they were seeking to block the team and the player from competing in that tournament. a current spartans co-captain also joined the lawsuit. today, though, a judge ruled the team can play in the conference starting on wednesday. the spartans will play one of the four teams that refused to play them in the regular season. san jose state responded to the

decision, saying in part, quote, all san jose state university student athletes are eligible to participate in their sports under ncaa and mountain west conference rules. we are gratified that the court rejected an 11th hour attempt to change those rules. our team looks forward to competing in the mountain west volleyball tournament this week. we have reached out to the plaintiffs and have not heard back yet. our amit goss is tracking this story. she will have more in our afternoon newscast. a high school teacher in solano county is in custody this morning charged with possessing child. drake sherman was a teacher, athletic director and baseball coach at rio vista high. that's about 15 miles from antioch. school district officials say sherman was placed on administrative leave back in march amid misconduct allegations involving multiple students. he is set to appear in court tomorrow. rain and clouds will linger today and tomorrow, but that's expected to clear out just in time for thanksgiving. meteorologist kari hall has our seven-day forecast. we are going to see more waves of rain today
