begin your spending spree? consumer investigator chris chmura has a word of warning about returns. good evening. merchandise returns can go sideways. just two days ago, i stood right here and told you about joann and hercules stress returning her massage chair and now card rates.com is predicting returns will ramp up over the holidays. the website says it recently surveyed 1000 shoppers. we found that nearly half of survey respondents said they anticipate for this holiday season, returning 1 to 3 gifts. jenna did not misspeak. almost half of shoppers will return 1 to 3 gifts each. that's a lot of back pedaling merchandise. the good news is many stores actually loosen their policies and extend their return windows this time of year. but you're not automatically entitled to a refund or exchange. the california attorney general's office says refunds and exchanges are not required by law. when a store has a no return policy, the ag says they

store for passengers on southwest airlines flights starting wednesday. cabin services will end earlier than usual. what that means is flight attendants will stop serving drinks and prepare the cabin for landing earlier than before. passengers will also have to fasten their seat belts and return their seats to the original upright position. earlier as well. the airline says the goal is to reduce the risk of injuries from turbulence for crew members and passengers. well, elon musk does not want openai to become a fully to become a fully for profit business. attorneys for musk and his ai startup, x ai, filed for a preliminary injunction against openai on friday. now, essentially, they are asking federal a federal court to stop openai from converting into a for profit business. the injunction would also stop the service from reportedly requiring investors not to fund competitors. the latest filings are an escalation in an ongoing legal feud between musk, openai and its ceo sam altman. musk originally filed suit against

openai in a san francisco state court before withdrawing and refiling in federal court this week. san mateo county supervisors will again vote on holding a special election in march to possibly remove the elected sheriff from office. last month, county supervisors unanimously approved an amendment to hold a special election on march 4th. now, voters would weigh in on whether supervisors should be given power to remove sheriff cristina corpus from office. corpus is accused of fostering a culture of fear and retaliation in the sheriff's office and according to an independent report, she may have also had a romantic relationship with her chief of staff. corpus vigorously denies the accusations and says she has no plans to resign. on tuesday, if county supervisors again vote for a special election, the process to hold the election will be triggered. meantime, we're expecting a clearer timeline on the special election to replace disgraced san jose city councilman omar torres. torres represented district three. hresigned last month, hours before police arrested him

on child molestation charges. city council then voted 8 to 2 to hold a ecial election in april. it's expected to cost between 2 million and $3 million,im representative will fill the role until the election. on tuesday, the council will discuss and finalize a timeline for the special election and the interim appointment process. a day of remembrance as people worldwide marked world aids day. since 1988, world aids day has been dedicated to raising awareness about the aids epidemic in san francisco. people commemorated the day in color in the castro. the 10th annual inscribe event invited people to reflect and remember the friends, loved ones and neighbors who died from aids. they inscribed their names on the sidewalks from 17th to 19th streets using bright chalk. and if today is the only day of the year that you think about those people that you have died over this long period of time, it's just a short amount of time to write their names and just think about them and just send them

some love. in other parts of the city, people came together for the world aids day observance near the national aids memorial grove. they honored the lives lost and they highlighted the changemakers working to end the epidemic. here's nbc bay area's christie smith. we, as a community here gather. the national aids memorial ceo john cunningham addressed people gathered in san francisco's golden gate park sunday. today, we cmemorate world aids day as the national memorial to hiv and aids. it is a solemn responsibility that we have to ensure that we honor and remember those lives cut short, but also that we redouble our effort to lean in and to ensure that we continue to fight for health, equity and social justice. robert mansfield came here today and says it's important to keep sharing stories. i came to san francisco in the 1970s. i was here in the 80s into the 90s. i was part of

when it first hit. i went through all that. i lost so many friends. there was praise for progress that has been made, discussions and recognition. i work for the san francisco aids foundation. i've worked in hiv and aids in some capacity since 1985. vince crisostomo received an award today. i've been working with long term survivors, people both positive and negative, who survived the hiv aids epidemic. and you know, nobody expected us to be alive this award. it's called the unsung hero award. and i feel that it's not just about me. it's about all those folks who we have lost who did not get their stories told. state senator scott wiener also spoke, addressing potential concerns with the incoming federal administration. we are going to do everything in our power in community and to support access to health care and to support those living with hiv and those at risk of hiv. an observance of the past, present, and an eye to

the future in san francisco. christie smith, nbc bay area news. well, an arctic blast is dropping a ton of snow in the northeast and midwest. and it is not just the temperature, but the timing here. that's brutal. highways and runways are buried on what's expected to be one of the busiest travel days of the year. forecasters are now warning of more snow stretching into tomorrow, even for people well south of this system. like georgia and florida. freeze alerts are now in place. all of it making travel tricky and dangerous as millions are headed home, or at least are trying to head home after thanksgiving. nbc's george solis is outside buffalo with the latest. reporter tonight, a life threatening monster storm hitting in the great lakes region. blizzard like conditions from ohio across new york. travel. treacherous. nearly four feet of snow and counting. sometimes i shovel the steps off. it looked like a complete whiteout. you couldn't see anything in front of you. the

roads. you couldn't even see nothing. so much snow. it even shocked residents. used to big winters. this snow appears to be more. a lot more dense, a lot more heavy. you know, it's heavier and it's just my snowblower won't even move it. a nightmare in neighboring erie county, pennsylvania two. the governor declaring a disaster emergency for communities already buried in 2.5ft of snow with more on the way. officials there with this dire warning. my message to the public is simple don't travel. stay home, stay home, stay home. and it's not just snow. bitter cold, sweeping the plains and southeast in the days ahead. back in western new york on football's biggest weekend, heavy machinery and fans rushing to dig out highmark stadium here ahead of tonight's bills game. some fans braving the elements and getting here hours ahead of kickoff to dig out their tailgate spots. we just get ready, got to dig out all the gear and layer up. we

knew it was coming eventually, so i just got to get ready. that was george solis reporting. quite a different scene here though. and this i know we just could not get enough of it. a spectacular sunset captured from our emeryville traffic camera this evening. and, tara, you loved this. it was spectacular. and also you loved it because you kind of. she dressed for it. it was exactly almost to the tee, guys. there was something so red sky at night. sailor's delight. yes, i g guess so. ande meteorologists saw mid-level clouds think, oh, great sunset. yeah, yeah. there you go. and wearing orange, you know, the temperatures today. you know, shane, we couldn't have had the game played here. yeah. oh, yeah. the outcome might have been different, but let's talk about first the weather for you as we go outside in san jose. it is actually still pretty mild outside at christmas in the park. you're about to see san jose today. look at the high temperature 70. we talked about this last couple of days. we had a chance of upper 60s and low 70s and. well, there it is.

livermore, 66 degrees 64, in san francisco, 61 in santa rosa. and in december, now that we're officially in december, it's not often that you can still be at 60 degrees here just after 9:00. so picture perfect conditions, dry conditions around downtown san jose, dublin right now 50 degrees. you'll notice we're not as cold as the last few nights. the frost advisories have moved on as you can see over towards san rafael. we're at 53 right now and still 58 degrees in san francisco. now the issue moving forward is high pressure locks in is not enough wind to push out some of that smoke pollution and particulate matter pollution. so we're now in winter spare the air mode. we had it today. we're going to have it again tomorrow. areas of dense fog could be possible for those inland valleys, maybe out towards the north bay and the inland east bay. and as you no doubt noticed, it's a dry start to december. so in terms of the air quality, north bay valleys, the central coast and the inner bay areas here and the santa clara valley will have the worst of the smoke pollution. and no

doubt you'll notice it, especially in the morning, that sort of that thin layer of haze that settled down below the mountaintops. it's the inversion caused by high pressure and not enough wind to push it out. technically, we have a light offshore breeze at times tomorrow, which might try to bring in some fog into solano county or napa county, but not enough wind to push that smoke in the particulate matter. pollution out. so hopefully the winds pick up a little bit more to avoid those spare the air days into tuesday and wednesday. tomorrow morning we've got 40s and 50s to start some patchy, dense fog possible for some of the inland valleys. hazy sunshine and high clouds for the afternoon. and if you like today's temperatures, which did not feel like december. round two coming up tomorrow, upper 60s to near 70 from san jose southward. mid to upper 60s in those east bay valleys, even mid 60s again around san francisco and oakland. so you can see here we've got more high clouds. so the pontial for pretty sunrises and sunsets will be ongoing. and fortunately there's really no rain in the forecast. and this is sort of unusual when you consider december is one of

and if you're a chocolate lover, you're going to want to hear this. cocoa prices have more than doubled this year, which could mean smaller packaging, even a different taste. the problem is harvesting issues in west africa. the largest cocoa producing region in the world. here's nbc's clay essamuah. danielle amponsah comes from a long line of cocoa farmers. so we have lived on cocoa money till now. but in recent years, the 66 year old says cultivating the crop is getting harder. the climate change started to come in. things became different. why? it was like hell for cocoa farmers. they yield, you know, dropped, reduced drastically and poverty was everywhere. ghana is the world's second largest cocoa producer. here, farmers say erratic rain is leading to crop rot and rampant deforestation is causing dramatic water loss in

the soil. experts say changing weather patterns continue to have a negative impact on the cocoa supply. the price of cocoa has more than doubled since the start of 2024. for consumers, buying chocolate in the u.s. will likely be more expensive this year. to adapt, farmers like danielle and bay fc are teaming up with nonprofit fair trade to learn new climate forward ways to farm, like using fruit bearing trees to provide moisture and shade to the cocoa crop from excessive heat. because there is no protection for the cocoa. but if you see this one, this cocoa. oh, it's protected by this. and this is plantain. yeah, this is plantain. me? i was ilona bay fc sharing that training with other farmers in her community. today, experts are hopeful a better fall weather forecast and sustainable farming practices will help the cocoa supply rebound. this season. while amponsah credits cocoa and the new farming techniques for his livelihood, he believes more must be done to mitigate climate

change. the hope for the future depends on all of this. we, the cocoa farmers, are the foundation. we have the bias. we have this a chocolate manufacturing. so let's all come together and see the way forward. zena asamoah, nbc news, gozo, ghana. new video of a dramatic rescue at sea. look at this. it happened friday off the california coast. coast guard says a 66 year old woman was experiencing stroke symptoms on board a cruise ship. the ship was almost 300 miles south of the u.s. mexico maritime boundary. so coast guard crews from both san diego and sacramento helped evacuate the woman onto a helicopter. she was flown to a hospital near san diego, where she is recovering. wow. happening tomorrow. the three men accused of killing retired bay area police officer kevin are going to be formally charged in court. lauren gilbert, herschel haile and khadijah mitchell are going to be arraigned in oakland tomorrow

morning. three are charged with murder, attempted robbery and assault with a deadly weapon. all three also face gun and gang enhancements. was killed while working as a security guard for a television news crew in downtown oakland in november of 2021. well, the disappearance of 30 year old hawaii native hana kobayashi continues to make national headlines. a family is upset about how los angeles police characterized an update in the case tuesday. the police chief announced that kobayashi intentionally missed her connecting flight from lax to new york. kobayashi's phone last pinged at lax on november 11th. that's where she was seen talking to an american airlines agent. her sister fears the new information might discourage people from keeping an eye out for her. the way that it kind of seems like it's bending is that she did it on purpose. and, you know, she's just going out and about to do her own thing. it's just very it's very discouraging. i don't want to bash the lapd. i don't want to

with you. when amanda aguilar saw this video, she was stunned. it looked just like her, but it wasn't her. i love the video you sent. you look amazing. it was a deepfake, the work of a scammer. someone who had taken a real video. amanda had posted on instagram. hello everyone. oh my gosh. and then used artificial intelligence to create a fake video in hopes of catfishing someone. for someone to go out of their way and make a deepfake of me is just like what i knew deepfakes were a thing i just never thought i would be a victim of them. amanda interned at nbc in college, then went on to work in tv news in california. her friends informed her a few weeks ago, someone had made a facebook page posing as her, using her real instagram pictures. the scammer then messaged a viewer named john pulido. john says for several weeks he thought he was talking to the real amanda. just be careful. it just sounds too good to be true. known to be talking to a celebrity that reaches out

to you. john says he got suspicious when the person asked how much money he made. that's when he asked for video proof and got the deepfakes in response. john pulido i just finished washing the dishes and i was like, oh my god, this is her. it was pretty scary because on how good it was, it was so convincing. he also received this fake video. hello, john pulido, i just want to let you know that i am disappointed at you for not trusting me. i loved you, it was nice knowing you. thank you. this was the real video from amanda's instagram story. that's why i booked that uber, because for some reason, it was $7 cheaper than a regular uber. i just think about someone can take my video and put it out in the public and, you know, say something that maybe i didn't say or do, something that i didn't do. and that is scary. pulido says he messaged a friend who knew the real amanda, and that's when he learned the whole thing was a scam. we're seeing a 1,400% explosion in the amount of deepfake attacks. vijay

balasubramanian founded a digital security company called pindrop. they developed a software that can instantly detect deepfakes by looking for mistakes in the file. for example, when you say hello, paul, your mouth is wide open when you say hello and it shuts down when it says paul, there's a certain speed with which you can do that because you're human. machines don't care about these speeds. he says, unfortunately, there's not really much people can do to prevent their public online content from being stolen. the onus is on the platforms to start providing abilities to detect when something is generated by amanda, and when it is ai generated without her consent. and as for amanda, i think i am going to be a little more picky about what i share. no the ai expert i spoke with says if you ever need to verify someone is who they say they are, ask them to hop on a live video call like a zoom or facetime. don't just settle for a p-taped video because those are way easier for scammers to fake. and then on the live vide,

flights. about a two week trip. arthur rouda and his wife, lori recently toured italy and croatia. just a fabulous place with great wines. in addition to learning about new reds and whites, they got an airline education that cost them greenbacks. we were in kind of a pickle. the couple booked lufthansa for the flight home from milan to frankfurt to san francisco. well, the day of their flight, they learned the hard way that milan has two airports, an hour apart. on the way, we realized we were really going to the wrong airport, so we had to rush over to the correct airport. but arthur and lori missed their flight. that set off a costly domino effect. first, lufthansa made the couple pay for a new ticket from milan to frankfurt at sky high. last minute fares. they charged us an extra $460 each. arthur and lori flew to frankfurt in time to make their original connection

to sfo, but then they decided that they had the right to charge us an extra $277 each. arthur was miffed. we got there in time. we didn't miss our flight. same flight, but a new charge. what was going on? it's the airline that is dictating everything. that's la travel agent pamela irwin, who's on the american society of travel advisors board. she helped us understand the 47 pages of lufthansa conditions and 24 pages of jargon laden fare rules we reviewed for the couple's flights. she says arthur and lori should have called lufthansa and told them they were running late. you have to advise the airline ahead of time otherwise you're a no show. and when you're a no show, even one minute past your departure time, many airlines cancel the value of your missed flight. for example, lufthansa's terms say we have the right to cancel your booking if you fail to arrive at the boarding gate

in time. that's what cost the couple $460 each. in milan. they had to buy new tickets to frankfurt. so what about the money? lufthansa demanded in frankfurt. that's another $277 per person. turns out that's a bit of a repricing penalty. all because the couple didn't fly their flights in order. and that's required in the fine print of the airline's fare rules. irwin told us that's actually a common catch of most airline tickets. if you have to change any portion of it, you have to change the whole ticket. so and it reprices it when you change one part, it reprices the entire ticket. arthur and lori admit their one mistake, but felt lufthansa pinched them twice. we were really unhappy about it. we thought they could have been a little bit more hospitable, so they contacted us. we contacted lufthansa. it did not reply to our request for comment, but lufthansa did send arthur and his wife partial refunds. that totaled $217. in

you order the snapper or the swordfish, but that's not what ends up on your plate. new testing shows it's happening a lot in parts of the country. nbc's pj randhawa reports from chicago. if you pay for something, you expect to get what you ask for. but when it comes to seafood in chicago, these dominican university students are learning. that's not always true. i was like, really shocked at how much fish is mislabeled. a 2019 study by ocean conservation group oceana found about 1 in 5 fish samples across the country are mislabeled. i thought, oh, can do this. i'd love to try this with my students. this fall, professor irina kaylyn jagger invited nbc five response to join her biology class as the students fact check the labels on their seafood through dna

sequencing. here, you can do this one, and i'll do this one. okay. we'll do cod. you have cod or is it or is it or is it? each student brought in two fish samples, most from a local grocery store or their favorite sushi restaurants around the chicagoland area. so one of the things with our study is that it has to be a raw fish, so we can't use cooked fish. mine was about $3 because i bought the whole fish because i'm going to eat it later. are you still going to eat it if it's not what you thought it was? yes i will. okay. we have a lot of really cool samples. look at this. we've got red snapper and catfish and swordfish. swordfish. woo hoo! first, the students work to isolate dna from their fish samples. yeah, the smell is a little smelly. i definitely don't think i'm going to be a fish fan after this. no, i wasn't a fish fan before, and i don't plan on being one after. the goal is to isolate what's called a barcoding gene. now go ahead and put it in the 55 degrees, which irina says is the standard used to identify different species. then the samples are sent off to a dna

sequencing lab for identification. we can then put it in a this these nationally available internationally available databases. and we can say what does it match? fast forward one month and the results are in. so altogether we were able to evaluate 84 samples which is really exciting. overall, it was bad news for fish with white flesh like red snapper. red snapper is always something else other than red snapper, especially when you get it from a restaurant. i bought a sea bass and i bought a red snapper sample, and i thought they looked completely different. it turns out they were the exact same fish and all the student samples of white or super white tuna actually turned out to be escolar. so escolar is not tuna. it's a completely different species of fish. and it actually has really, really high mercury levels. it can be dangerous for pregnant women and it's banned from selling in a lot of europe and in japan. but there was good news for the cod and ocean perch samples my lab partner emma brought in. i think some of us were kind of

disappointed. we were like, oh, we wanted to find something that wasn't, but it was supposed to be. but overall, that is a good thing. also good news for salmon and regular tuna. salmon is almost always salmon. tuna is very often tuna. although this testing was done on a much smaller scale than oceana study year after year, irina says the results show chicago fish samples are mislabeled up to 30% of the time. she says she's adjusted her dining habits accordingly. i would personally stick to tuna and salmon myself if you're adventurous. obviously there are lots of other fish you can try at sushi restaurants, but it's both good news and bad news, right? that was pj randhawa reporting. here are a few key takeaways from the testing. if you want an expensive fish like red snapper, your chances of getting the real deal are much better. if you buy it at a grocery store and get the full fish. if you really want to avoid being duped. also be thoughtful about where you buy your fish. a lot of grocery

can see we've got the clear skies 52 right now in walnut creek. so not too chilly overnight. i think we'll drop into the low to mid 40s around some of the inland valleys. 52 currently in san rafael and still seeing upper 50s closer to san francisco. as you can see there, with partly cloudy skies and moving forward, it's air quality and patchy fog. the two things we'll be watching over the next couple of days. winter time spare the air alert, which is tied into banning of those wood burning appliances. unless it's your primary source of heat that's in effect for tomorrow. may get extended to tuesday. the fog inland and yes, a dry start as we're now officially into december. so the worst of the wood smoke pollution likely to set up for some of the interior valleys of the north bay, santa clara valley to the south, and the central coast and the inner bay, we'll have to have the wind pick up and preferably some rain chances to come back to really get that air quality looking better for tomorrow morning. we got 40s and 50s to start some patchy, dense fog possible, especially out towards solano

county early in the day. hazy sunshine and more of those high clouds which will make for some pretty sunrises and sunsets again tomorrow. and on into tuesday. and look at these highs from downtown san jose southward, a chance of 70s again tomorrow. mid 60s bayside out towards the north bay and east bay valleys. and there's a look at the high clouds, not rain producing clouds. we'll see those from time to time for tomorrow and tuesday, and watch how the rain chances just bypass the bay area. in fact, for the most part, they kind of avoid part of the north coast to really focused on the pacific northwest and that's where the jet stream is going to hang out for much of the week. high pressure, acting a bit like a shield, sending those rain chances tohe north underneath that high. we'll have to watch some patchy, dense fog at times, maybe some ongoing air quality issues until the winds pick up. but right now, all the way through next sunday, right now, it doesn't look like we're going to have any rain chances in the forecast. so lock in the days of some hazy sunshine and mild temperatures. as you see there in san francisco, mid 60s through the middle part of the

welcome back i'm anthony flores, live in orchard park, new york tonight. the 49ers lost a game and one of their best players and best running backs in the nfl, as they battled mother nature and the buffalo bills on sunday night football. a lake effect snow storm dumped two feet of snow at highmark stadium in orchard park. the niners grabbed an early three nothing lead on a 33 yard field goal by jake moody, but the game turned on the niners with the bills leading seven three in the second quarter. the niners were driving. christian mccaffrey goes down without any contact.

he limps off the field with a knee injury. he did not return. the drive ends in a missed field goal onhe first play of the bills ensuing possession, james cook breaks free. he races 65 yards for the touchdown. the bibills led three at half time. any hope of a comeback ended on the niners first possession of the third quarter. on first and goal inside the five, kyle juszczyk fumbles, the bills returned it 44 yards before brock purdy makes the tackle. wild play. later in the third quarter, fireball native josh allen throws it to amari cooper as he's being tackled. he flips it back to allen, who dives for the end zone and scores. allen gets credited with a touchdown n on the same play. the niners would eventually find the end zone late in the third quarter on a 15 yard touchdown run by isaac galindo. but it's not nearly enough. the bills blow out the 49ers 35 to 10. i'm r rl
