growing budget concerns for san francisco. the reason city leaders are now sounding the alarm and why new reports say
5:01 am
that the issue may worsen after trump takes office. plus, another presidential cabinet shakeup. the new report that president elect trump is considering a new pick for defense secretary. as pete hegseth faces growing scrutiny. who the president elect is now reportedly getting ready to tap in. also, with new year comes new laws for workers across california. the changes that are going into effect in less than a month. this is today in the bay. thank you. we do want to say good morning to you all on this wednesday. i'm marcus washington. it's a wacky wednesday already. i'm laura garcia. we're going to take a look at the roads with mike in just a moment. but let's start out with a look at the forecast with kari and we're starting out this morning cold once again as we take a look around the bay area. it is 42, in walnut creek. one of the cooler temperatures here with our live cameras. and in san jose 47 as you're getting
5:02 am
up and heading out on this wednesday. but we are back to the nice and mild weather that we've seen from the past couple of days. it continues today with highs in the mid to upper 60s in martinez. look for a high of 66 degrees, 68 in dublin and 69 in san jose, and also in the upper 60s for much of the north bay, with san francisco making it back to 66 degrees. switching it to tomorrow, it looks exactly the same for much of the bay area, and then that continues into friday as well, with low 70s in the south county and 60s for much of the rest of our are. and mike, you've been tracking reports of a wrong-way driver? yeah, in the south bay, folks. look at this. we do have slowing, which i'm glad to see. this is as a result of the activity on the right shoulder of northbound 87. right around capitol expressway. this car is over on the shoulder now. it was going the wrong direction on the northbound side. it was traveling along the shoulder in
5:03 am
the southbound direction. the car is now there without the driver. i think someone took off. chp is there. they're doing some activity there. lots of lights. likely causing the distraction. no incidents. and this vehicle again has stopped. it was just traveling the wrong direction on 87 for a short period of time. things are moving smoothly through the east bay. but over here on san pablo dam road, i'm tracking a crash. i'll bring you those details. that is important. if you're traveling between sunol on san pablo dam road down to highway 24. back to you. thank you very much, mike. a dire financial forecast for san francisco as the city looks to turn a new page with city leadership. things could get worse for the city with threats of a financial showdown from president elect donald trump focused on bay's ginger conejero saab joins us live in san francisco this morning. ginger, we've got a new mayor coming in. he's looking to have this work out for him as well. well, he definitely will have his work cut out for him. laura, good morning to you.
5:04 am
we're little over a month away from the inauguration of mayor elect daniel leary, but he's got a financial forecast that's already going to test his are going to test his administration. the latest fiscal update, which was released on tuesday, shows that dire outlook for the city's budget, punctuated by an $876 million deficit. mayor elect leary took to social media to reassure voters that they made the right vote for change. we cannot simply cut our way out of this crisis, nor can we balance it on the backs of working families. what i commit to you today is to be clear and transparent with you in the coming weeks, and months about the priorities that we need to undertake, and that starts with prioritizing essential services and making sure that we don't jeopardize our economic recover. well, you heard it there. leary called the city's deficit a crisis. he also called it
5:05 am
chronic and consistent as well. so this is how he plans to tackle it head on. he wants to grow and diversify san francisco's economy. he wants to prioritize investments that will lead to a full economic recovery, while also maintaining essential services here in the city. but it may not just be balancing the books locally. leary and san francisco may also be facing cuts from federal funding, and that is if president elect donald trump's threats of withholding federal funds turns into a reality. it's not the first time these threats have happened. a little over a month before the new president takes office, his advisers are reportedly discussing how to unilaterally withhold federal resources from democratic run cities that refuse to participate in deportations of undocumented immigrants. now, san francisco is a sanctuary city, city also relies heavily on federal funding for transportation a housing, just to name a few things. san
5:06 am
francisco's budget could grow or budget deficit, i should say, could grow to $1 billion if the new administration withholds federal funding. now, on immigration, still, attorney general rob bonta is expected to address efforts to safeguard immigrants rights that will take place here in san francisco. although he will be speaking statewide at that news conference, will happen at 11, will be watching for updates from that as well as really, laura, watching how this all unfolds. we're live in san francisco, ginger conejero saab. today in the bay. all right. thank you. ginger. president elect donald trump's pick for secretary of defense, pete hegseth facing fresh controversy this morning. this is over allegations of past behavior. ten current and former fox news employees tell nbc news that headset should not be consi thil due to concerns of alcohol abuse. now, brand new reports overnight say that trump is considering replacing him. two

former fox news employees said on more than a dozen occasions they smelled alcohol on his breath before he went on air. overnight, the wall street journal reporting that trump is considering replacing headset with florida governor ron desantis. that has not been confirmed by nbc news. some republican senators say that they are still open to supporting headset, and believes that he deserves a fair chance. later today, we will get a better idea of when the city of oakland will get a new mayor after voters recalled mayor sheng thao, city council president nikki fortunato bass, along with other city officials, will share a proposed timeline for selecting a new mayor. they also plan to go over a report from the city attorney. that report details when mayor thao will officially be removed from office, as well as how and when an interim mayor will likely be selected until a special election is held. friends of three college students who died in a fiery cybertruck crash in piedmont are returning to school
5:08 am
this week, and sharing their heartache. the victims were all home for the thanksgiving holiday when the truck they were in crashed. one week ago, in the early morning hours, a fourth victim was pulled from the truck in time and survived. the three who died are sean dixon, jack nelson and krista tsukahara. they all are recent graduates of piedmont high school. dixon was a student athlete at usc and a member of lambda chi alpha fraternity. late monday, his friends gathered on greek road to remember him, finding groups to go off campus, go to the beach and go surfing, or go rock climbing. he was always trying to find other people who liked the same stuff he did. piedmont police do believe speed was a factor in this crash, but it's too early to know if a malfunction may have occurred. at this point, the national highway traffic and safety administration is still gathering information about the crash. it has not yet launched an investigation. from minimum wage increases to worries of
5:09 am
immigration raids, there's a lot of california workers and employers to watch out for in 2025. even though prop 32 failed, the minimum wage will jump $0.50 an hour to 1650. january first, due to spikes in the consumer price index that means minimum overtime exempt salaries will also go up to almost $69,000 per year. the ceo and president of the california employers association says employers are keeping close eyes on new state laws, and the incoming trump administration to see what happens with possible tariffs and immigration crackdowns. businesses are kind of just in a wait, you know, holding pattern. wait and see. things like, you know, diversity, equity, inclusivity, waiting to see if some things get rolled back that were put in place and whether things that happen on the federal level, how many of those will really impact us here in california? hard to know. more changes coming in 2025. california employers will no longer be allowed to legally
5:10 am
call mandatory meetings where workers are forced to stay, whether or not they support union organizing. they won't be able to force employees to use accrued vacation time before using paid family leave benefits. sick leave will also be allowed for assisting a family member who is a victim of certain violent crimes or threats. californians applying for work will also not be required to provide a valid driver's license as a requirement for employment, unless the job itself requires driving. 509 for you this morning live, look at christmas in the park in downtown san jose. meteorologist kari hall tracking that forecast for us today. starting out nice and cold, but that's pretty normal for now, right? yeah, and we've just set the weather on cruise control for us as we've seen our morning starting out cold and our afternoon shaping up to be nice and comfortable. there will be some patchy fog in some of the spots, usual spots in the valleys and afternoon hazy skies, especially after seeing the morning fog. but the mild
5:11 am
temperatures continue and the weekend is also looking dry. here's where we're starting this morning. 37 in santa rosa, and it is 48 in oakland. 37 in danville and 47 now in san jose. so really, depending on where you are, we have a colder morning start in concord, where we'll be in the low 40s at 6:00. and then throughout the day, seeing the temperatures recover nicely for this afternoon into the mid to upper 60s and low 70s for the south county for this afternoon. mike, where can we fill up for a little bit less? you know, a lot of places around you might have gone down a little bit overnight, including our dynamic duo in livermore, number two and number three in the state with 319. now that's the low. it's at marathon. still the one on holmes and the one on livermore, south livermore avenue, both have this low price there in livermore in marin county, the best price is in mill valley. 363 at hq fuels on the shoreline highway and in the south bay. the low is 369 right
5:12 am
there in sunnyvale national petroleum on old san francisco road. go ahead and check gasbuddy.com and see what the changes are in your neighborhood. let's get out to the roadways where we still have in the south bay, north 87 showing slow sensor reads after the wrong-way driver. now all activity is over on the shoulder, right around capitol expressway. likely a distraction, but no incidents. thank goodness. over here. this incident is on san pablo dam road at valley view road. that is important to know if you're traveling between el sobrante and orinda on the san pablo dam road. the rest of the east bay looks really good. back to you. all right. let's hope it stays that way. thanks. password crackdown. coming up next on today in the bay. the steps, one popular streaming service is now taking to deter password sharing. when it's set to start. well, maybe go see a movie in a theater. no password needed. the biggest movie theater coming to the biggest mall in the bay area. plus maybe gets you. you're the one i love. you're

5:16 am
outside in dublin. as you're getting up and heading out, it is all clear. no worries about fog through the tri-valley and throughout the day. temperatures will be warming up going from mid 40s to mid 60s with a lot of sunshine. we are going to see more of this weather, but we'll talk about if there is any rain chance farther down the line that's coming up in the full microclimate forecast. and looking here at the golden gate bridge, the overnight crews have removed the cones from the northbound side where we see a smooth drive here. i don't see any delays, but we should see the crews clearing from the north bay from the marin side any second. that might present some slowing sensors, but i'm checking out a crash right now over in the east bay. coming up. well, good morning. very happy wednesday to you. the s&p 500 will open at new records again today. the head of campbell's soup is stepping down to take a new job running the washington commanders football team as team president. that's an interesting move amazon startling the computer world announcing a new

supercomputer to run ai that's made with its own chips. amazon. not just making chips, it's even selling them to apple as well. a group of airline executives will testify this morning in front of a senate committee about seat fees, charging more to sit up front or in exit rows, that kind of thing. airlines made more than 12 billion on seat fees in the last five years. one senator compared passengers to piggy banks being shaken for every last dime. but airlines are getting away from one seat fits all service. case in point frontier airlines, known better for its low prices than its luxury service, is adding first class seats to its airplanes. it's just a change in attitudes, spirit airlines remember the low cost of low cost airlines is bankrupt. southwest is getting rid of its cattle call boarding system passengers in favor of inside seats. and yes, you'll be
5:18 am
able to pay for a better seat. airlines say the add on pricing is critical to survival. speaking of things costing you more money, max, the streaming movie service is going to crack down on password sharing the same way that netflix did. the company will start with a gentle reminder, and max says it's going to start slowly because it's hard to tell the difference between password sharing and someone who maybe travels a lot and works a lot, logs in from different cities at night and good news, the movies are coming back to valley fair mall in santa clara. alamo drafthouse will take over the space vacated by showplace icon. it will also open a new theater in mountain view as well. alamo, one of the first to offer beer and wine and meals at the movies. of course, this is fairly common practice now, but again, everything is upscaling. these movie tickets are very expensive, but you've come to expect when we were kids, it was, you know, sticky floor at the o. do you remember? that's right. that is not something. it's just like
5:19 am
airlines. i would never wear shorts. i would never wear shorts because i don't want it smart. yeah, right. yeah. gross. did you see the lights when they come on. and those old. oh, yeah. and now they have the. now i fall asleep. but it's a nice nap. it's like heaters and everything. and you're like nice. although i'm paying $8 for a nap or however much it is now. hey, we pay for that. sometimes it's worth it. all right. thanks, scott. all right. look. so she's run the music world for nearly 25 years, and now queen bee has a new throne to sit on when i need to make everything stop. finally, you put my love on top. oh, come on, baby. billboard naming beyonce the greatest pop star of the 21st century chose her for her influence impact, evolution over the last quarter of a century and that she is the boss for which all other pop stars are measured. i'm just telling you what they said, all right, beyonce has topped the top 109 times as a solo artist since the turn of the century. top five is
5:20 am
rounded out by taylor swift, rihanna, drake and lady gaga. good thing our writer justin isn't here today because he would put lady gaga way up ther, although she didn't come in first. lady gaga is exactly. now congratulations to all of them. they are certainly making a big influence in the music world. congratulations on number six, marcus. we just i don't want to talk about it, but you know, it is what it is. oh, gosh. i can't follow you on that one today. kari is going to look at our forecast. yeah, it looks great out there. it's been nice to have the mild afternoons to get out, get shopping, put up the decorations, all of this stuff that we're doing for this time of year. but our air quality has been kind of a hindrance for part of the bay area, at least starting out the week. yesterday we saw some improvements and today it looks even better, although it is still moderate as we look across the bay area. but it's not at least in that unhealthy category as we get high pressure. that's putting all those pollutants back down
5:21 am
into the valleys. we are seeing this storm system that is well offshore, moving a little bit closer to the pacific northwest, but it's going to go up and around the bay area, and we are going to stay dry, as we've still seen some well above normal high temperatures. we're back to 68 degrees in milpitas today, and in los gatos 71 degrees 73 for morgan hill and gilroy. and we'll be in the upper 60s for the east bay, with danville reaching 68 and also 68 for much of the inner bay for the east bay, as well as the peninsula with some mid to upper 60s daly city today, 6564 degrees therend 65 in downtown san francisco and 67 in sonoma. so we're all pretty much in the upper 60s, low 70s and looking ahead, we are seeing the storm pattern hitting the pacific northwest and then continuing its way off towards the east. but for us, we're not seeing any rain in the forecast. and the climate prediction center giving their outlook through the middle
5:22 am
of the month still shows the bay area will be dry and even well below average for that rainfall that we're expecting as we go through the next week. so notice that we don't have any significant storms coming in, but there will be a slight drop in temperatures for the middle of next week. mike, you were looking at the east bay. yeah. the good news right now is the bay bridge toll plaza just starting to see a little increase in the volume. and it's right on schedule. they're getting there is no major problem here. we do have that crash i was tracking on san pablo dam road just as they gave you the detail. the good news is that cleared without any further incident. as we're looking down as the cut through from basically el sobrante down in toward orinda is just clear now, northbound 680, this is the new crash. i heard about involving a semi truck. no lanes appear to be blocked and there's no slowing its counter commute north, heading through san ramon into danville. and again, we're watching that right around bollinger canyon on the northbound side, southbound does show a little increase in traffic coming down through
5:23 am
pleasanton, but it's northbound 87, which continues to show slowing the earlier incident still on the grid. the wrong-way driver, which is now all the activities on the shoulder right around capitol expressway. watch for the activity and give those folks who are working there a little extra space back to you. thanks, mike. it is 522 coming up next on today in the bay, nbc bay area responds some criminals soul scam is draining gift cards, so you've got to protect that plastic. i'm consumer investigator chris chmura.
5:24 am
5:25 am
5:26 am
a gift card starts at the rack in the store because that's where many criminals start. before you buy a card, look for tampering. some scammers mess with the barcode. you can feel the sticker. it has a little bit of a ridge on it. former police officer michelle loss spotted a tampered card and made a viral video on tiktok. here's the scam. that barcode sticker is for a different gift card that the thief has, so any money you load onto that card would actually land on the thief's card. so look for a sticker. take that extra seconds and just kind of feel it. look at it, visually inspect it. you can choose a gift card with extra security. some of them let you set up a pin, especially those used anywhere kind. that might make it tougher for the bad guys to drain your balance. after you get a gift card, use it asap because other criminals are hacking to try to drain your balance. there are groups out there that this is all they do, so use your gift card as soon as
5:27 am
possible. here's another idea try to cash out your gift card in california. if your gift card has less than $10 on it. state law says the store has to give you cash or a check for the balance. if you have more than $10 on a card, you know you're not going to use, consider selling it on a third party exchange. they might not give you face value for it, but it's more than zero, which is exactly what the thieves will leave you. i got a good toys r us one i'll sell you. oh. thank you. wait. no. 526 for you this morning.g. next here at the top stories we're following, including the latest in a sheriff office scandal. the reason voters will head back to the polls in san mateo county. plus, whenever somebody hears the title to either of these tracks, they go, oh, i love that song. broadway star megan hilty, one of the performers you'll see on nbc tonight for christmas in rockefeller center live special. we're going to show you what else you can expect as we count

5:31 am
could impact trans people across the country. this is today in the bay. a very good wednesday morning to you. 530 right now, thanks for starting your day with us. i'm laura garcia. and i'm marcus washington. let's get a look at that forecast this morning. meteorologist kari hall tracking what we can expect from those temps outside. not too bad. not too bad. it's cool, but it's going to warm up. so we are going to be on track for another really nice day. starting out with some upper 30s and low 40s across the bay area. we're in the upper 40s for san francisco and in san jose as we get a look at cupertino and what to expect. lots of sunshine going from 48 degrees at 8:00 to a noontime temperature of low 60s and making it into the mid to upper 60s today, with a high of 71 expected in los gatos. that's one of the warmer areas that we'll see across the south bay, but mostly 60s for much of the rest of the bay area. we'll talk about what's ahead coming up for
5:32 am
the rest of the week. but, mike, you're tracking a delay now in the south bay. kari i should point out the one at the top of the screen. we expect that slowing right on schedule, but look at the bottom of the screen. we'll zoom in north 87. one of our buddies is stuck in this backup. he says there's no traffic movement, at least for a few minutes. right around capital expressway on north 87, we talked about the wrong-way driver in the southbound side, and i think the police might be looking for whoever left that vehicle on the wrong side of the freeway, and they're looking on the northbound side at least temporarily. we're still tracking some slowing there. that might be an issue, sfolks may want to join it north of capital expressway, getting over toward downtown san jose. the east bay looks really good. we're slowing highway four and highway 37. your typical slowdowns there, but no surprises at the bay bridge. just the build right on schedule. back to you. thank you. mike. happening today, the u.s. supreme court taking up a case that may change the kind of gender affirming care is available for transgender teenagers. and children. well, the case centers on one state's law, but would likely have an
5:33 am
impact nationwide. today in the bay's kris sanchez joins us with a look at the specifics in this case. well, good morning to you, marcus and laura. so gender affirming care for transgender minors became a really big talking point for politicians during the presidential campaign. but for families of transgender children, this, of course, goes beyond politics. now, we do expect that demonstrators will gather this morning outside the u.s. supreme court building in washington, d.c. that is where the justices will hear a challenge of a tennessee law that went into effect in 2023 that bans the use of puberty blockers and hormone therapy, though the court will not consider the issue of gender affirming surgery because that wasn't covered by the lower court decision. now, anything that the u.s. supreme court decides could have an impact in 23 other states that have similar laws. three trans families and the aclu filed suit on the basis that the tennessee law discriminates on the basis of sex. the justice department echoed that legal complaint, adding that the law also
5:34 am
violates the 14th amendment's equal protection clause. lower courts have been split on laws like this one, with appeals cots blocking the law in arkansas but allowing similar laws in tennessee, kentucky, alabama, and florida. as well. now, as of april, there are about 114,000 trans youth living in states where their care is restricted. according to ucla school of law. now, while this case is about trans care for youth, for minors, it could also impact what's available to adults down the road. the supreme court will hear the case today, and a decision is expected about summer of 2025. laura. very interesting. thank you. chris. 533 right now. excuse me. the stage is now set for an election day showdown to determine future leadership in the san mateo county sheriff's office. as expected, in the second vote yesterday, supervisors signed off on the plan for a spring ballot measure. it would give the board
5:35 am
authority to remove sheriff cristina corpus. she's been at the center of a controversy after an independent report accused her of fostering a culture of fear and retaliation, and suggestions that she had an inappropriate relationship with a top assistant. she's denied all those accusations, calling them politically motivated, and has refused to resign. last night, one deputies union leader expressed support for the board's decision, but not everyone agrees, including half moon bay mayor. we feel like this is a sign that there that our concerns dsa's concerns are being listened to. i support sheriff cristina corpus 100% and no, i do not agree to give you my vote to give you my permission to ask her to resign. now, sheriff corpus did not attend yesterday's meeting, but the board did invite her to appear at next week's meeting. she's also not responded to our request for comment. we are moving you forward this morning,
5:36 am
trying to understand the next steps for the city of oakland after its mayor was recalled today in the bay's bob redell joining us live. and bob, the city actually put out some information later this morning is that right? you are correct. good morning to you, marcus and laura. yes. later this morning at 10:00 at oakland city hall, council president of the city of oakland, nikki fortunato bass, along with other city leaders. they will outline the timeline for selecting someone to replace the current mayor. oakland mayor sheng thao, who was recalled from office during the election this past november by over 60% of voters. city leaders also plan to go over a report from the city attorney that details when may chao will officially be removed from office, as well as how an interim mayor would be selected. that's until a special election is held, which would most likely take place april 15th of next year. that's according to reporting by the mercury news. so need to find someone in the interim before the special election. so who could replace mayor chao on the
5:37 am
interim basis? normally it would be the council president, but council president nikki fortunato bass, she starts her new job as alameda county supervisor in january. the next in line president pro tem dan kalb. he's retiring in january. so the paper also lists the possible interim replacements for mayor chao, a council member. carol fife, council member. ignacio de la fuente, lobbyist isaac reed, former council member lauren taylor, and representative barbara lee. those are, according to mercury news, possible replacements to replace mayor chao in the interim. again meeting later this morning at oakland city hall at 10 a.m, reporting live. bob redell today in the bay. a lot of changes for that city. all right. thank you. well, deliberations begin this morning in the high profile murder trial of nima momeni. this comes after the defense wrapped up its closing arguments yesterday. well, mini is accused of killing cash app co-founder bob lee on the streets of san francisco last april. the defense argued this was not murder, but self-defense. they claim that
5:38 am
lee was high on drugs and attacked mo mini, who then stabbed lee to death to protect himself. we will bring you updates on the deliberations and the verdict on air, as well as online when it happens. members of a british rock band. they are rattled. this is after being held at gunpoint right here in the bay area. get down! lauren! get down! bring the police! ring the police! guys! somebody ring the police! members of the rock band sports team. well, they just arrived monday from england. this is when they stopped at vallejo starbucks. that's when those thieves broke into their sprinter van. when two band members went out to stop them. those thieves drew weapons. they got away with laptops, clothing, nintendo switches, but not their instruments, which they were locked away. band members say that things got worse when vallejo police told them to file a report online. it just felt like it was really normalized for the whole community there. the people in starbucks, the police who we spoke to, i think that's kind of what is almost more shocking and shaken us more
5:39 am
than the incident. perspective that this is not normal. we did reach out to vallejo police department, but they did not respond to our request for comment. band members say the experience actually better connects them to the bay area. they also hope that comes across at their next show saturday night. and this is at the chapel in san francisco. i hope people go out to support them. all right. are you headed out the door this morning? maybe stay a little while. pour a cup of coffee. enjoy the view, because it's a cold start to our morning. kari. it's clear out there. laura, i'm going to get you some hot tea with some hone. we got to help that voice. all right. here's a look at our air quality as we are starting out this morning. it has been improving, but we have seen a hazy sky and a little bit more unhealthy over the weekend into monday. but it looks much better today. but still might want to limit time out there if you're sensitive to it. here's a look at our forecast highs for the north bay. santa rosa 67 for the
5:40 am
high this afternoon after a cold start. we're looking at a lot of mid to upper seconds and sunshine for much of the bay area. and mike you're starting again with 87 in san jose. that's right. northbound 87 is where we see this slowing. now we had a wrong-way driver going the wrong way on the southbound side, but all the slowing we've seen is up across the freeway. my theory, though, no one has told me any confirmation. oh, there we go. we just saw those sensors clear. i believe they were searching for anybody involved with that abandoned wrong-way vehicle. they're now again. northbound. sensors have just cleared up. we'll see if they clear that incident. if their activity is done. just south of capital expressway on 87, north 101 shows a typical pattern. everything else in the south bay is standard again, watching that one section for 87. now, later on during the night, 9 p.m. through 5 a.m. again, we still have parking restrictions because of work going on on el camino between mountain view and palo alto, so keep that in mind. watch for those signs. they may be different than the last time you parked on el camino during the
5:41 am
overnight hours. meanwhile, woodside road highway 84 does have some daytime closures from 9 a.m. to 2 p.m. they're working on portions of that for paving work. everything else looks pretty nice right now. a smooth drive. we're tracking a crash in san ramon for north 680, with no slowing. typical slowing for highway four behind me, coming in through pittsburg and bay point and highway 37 up there a little through richmond and of course, the bill that the bay bridge toll plaza, this happened in just the last five minutes here. back to you. thanks, mike. south korean lawmakers pushed to impeach their president. coming up next on today in the bay, the growing backlash this morning after he briefly declared martial law during south korea's biggest political crisis in decades. a holiday season will likely mean a record amount of spending and more online shopping than ever. so the best ways to protect those packages once they arrive on your doorstep. and pete hegseth nominations always really been in trouble. but it's in deep trouble now. all that ahead. but first, let's check in with
5:42 am
investigative reporter candice nguyen, a san jose special education student who's hard of hearing receives a high school diploma. the problem is, he says he's struggling with basic reading skills, and that diploma now means the county is denying him of services he needs to succeed. he says he's not the only student experiencing this. school officials tell him they can't reverse their decision. watch that report right now on

heading out in oakland this morning. visibility is clear. temperatures are chilly. we are now at 48 degrees and as we go throughout the day, lots of sunshine and a significant jump in our temperatures going from now to 10:00. and throughout the day we're headed for the mid to upper 60s. another nice one. as we go through the forecast, only minor changes. we'll talk about that coming up in a few minutes. and we are looking at 101 northbound in san jose. typical timing for this typical slowdown spot may be a little more traffic because of what was going on for 87. i don't see any more problems for the guadalupe parkway, but we'll track that as well as the build at the bay bridge. thanks so much, kerry and mike. it is 5:45 right now. new developments this morning in south korea, where the president may be facing an impeachment vote as on as friday. if he does not resign from his post. president yoon suk yeol abruptly declared martial law yesterday.
5:46 am
it suddenly plunged the country into chaos. parliament then voted to pull back on the order led by the majority opposition parties, but without citing any specific threats. he claims it was needed to defend the country from pro-north korean forces. six opposition parties are now threatening to hold that impeachment vote. president elect donald trump is comparing his legal problems to hunter biden's, and scott mcgrew is here for us right now. okay, so scott trump wants his felony convictions thrown out. yeah, these are the fraud cases that you're talking about. remember from when he was found guilty in new york city? trump says he was targeted not because he committed fraud, which he did. he says he was targeted for who he is. in that sense, his lawyers say he's like hunter biden. the younger biden and his father think he was targeted not for the crimes, but for who he is. evidence of that, the crimes. hunter biden was accused of or almost always settled, not taken to trial and almost never
5:47 am
result in jail time except in this case, some on the right still want to force hunter biden to testify under oath before congress, despite the fact that he's been pardoned for all crimes by his father. they claim on social media that biden cannot plead the fifth, which is designed to protect you from incriminating yourself because he faces no punishment if he did. he's been pardoned now. eugene uva at stanford's hoover institution says that's not the right take, pointing out biden has been pardoned of all federal crimes, but not state crimes. so hunter biden could claim he risks incriminating himself there. what state crimes did he commit? maybe none. he wouldn't have to say, though, because only he would know. the wall street journal, the first to report pete hegseth nomination for defense secretary, is in trouble, and trump may replace him with florida governor ron desantis. over the weekend, the new york times turned up an email from haig's own mother saying she was concerned about his treatment of women. the new
5:48 am
yorker magazine says it talked with former coworkers who said hegseth was intoxicated at work. nbc news has confirmed by talking to ten staffers and former staffers at fox news that hegseth coworkers there are worried about his drinking. a trump transition team spokesman called the claims completely unfounded and false. now, if trump does change candidates for defense secretary, that'd be good news for women in the armed forces. hegseth has in the past said he wants to end the practice of women fighting alongside men. i'm straight up just saying we should not have women in combat roles. it hasn't made us more effective, hasn't made us more lethal, has made fighting more complicated. the trump transition team has also signed a memorandum with the fbi, allowing it to do background checks on trump's picks for cabinet. this is very normal practice, of course, but trump had resisted some in washington very concerned about what may turn up about some candidates like tulsi gabbard,
5:49 am
who often repeats kremlin talking points. trump picked her to run america's spy agencies. now, we've mentioned that bizarre 24 hours in the republic of korea. the state department says it's fine for americans to travel there. we're also keeping our eye on france there. the legislature is set to break up the government for the first time since the 1950s. no single party holds a majority there, meaning they have to form fragile coalitions. marcus very fragile that it is. all right, scott. thank you. well, online shopping broke records over the thanksgiving holiday weekend. but you know what? there's a new warning about the growing problem of package thefts. security firm safewise estimates last year, thieves in the u.s. stole about 120 million packages. now to better protect yourself, one amazon spokesperson recommends turning on your delivery notifications. also, if possible, update the delivery instructions to a location not visible from the street. you can also require a

signature or pick up from any amazon pickup location. finally, amazon is offering garage delivery. this is through the one time only key and codes, something that we launched a couple of years ago. but essentially you can give your driver a one time code that gives them access to your your garage, and you can have packages and even groceries dropped off right there in your gara. now, if your package is stolen, you should contact amazon's customer service. it's available all hours and someone can assist you. and to figure out what happened there. okay, so everybody seems to have a take on this that happened. it was a recent comment from a bay area startup ceo asking his employees to commit to an 84 hour workweek. yeah, you heard it right. 84 hours. yeah. doctor gupta actually runs reptile. it's an ai related startup in san francisco. and he recently tweeted, telling his applicants that he wants them to work from
5:51 am
9 a.m. to 11 p.m. at least five days a week, and often on the weekends. we actually caught up with him ourselves to get some clarification here. i don't think a 100 hour workweek is for everyone, but that's often what an early stage startup requires. and instead of veiling the fact that that's how much work we do here, i like to be upfront about it. stock options going on at that. yeah, that it is. gupta also says yes, he has faced a lot of blowback ever since he made that comment, but he says he's also receiving numerous new job applications. right. because you could do really well too. yeah. that you can work. it's called work for something. i know. and cha ching, if it works well. trending for you. tonight's holiday tree lighting ceremony in new york city's rockefeller plaza. all right, let's give you a live look this morning. you can see right there looks beautiful. right? put you in the christmas spirit. all right, so you see the tree there ready to rock and roll. and the today show team, they will help light that tree. so ahead of that, kelly clarkson, she's

confirmed, spotify users are speculating that their spotify rap will drop today. so each of the experiences shows subscribers their most played songs, albums, artist of the year for them, and it becomes quite the social media sensation over the years. so apple music also reveals that this year's top music as a whole was kendrick lamar, topping with the single chart song. of course you know, not like us, they not like us, they not like us. all right, so take a look at this. the top replay beyonce there. and this is my list. yeah this is my list. you can see right there because i had to look to make sure that's your list. it's far away. so that's my list there. you can see beyonce jazmine sullivan victoria monet, usher, brandy and number 15 memphis homegrown glorilla. that's where i'm from, if you didn't know. nice. yeah, i kind of perused mine a little bit and it's got a lot of harry styles chapell roan sabrina carpenter. wow, i have

5:55 am
live look at christmas in the park, where if you're going out, it's going to be in the upper 40s on your way out the door, and then it may even cool down a few more degrees before sunrise. the rest of the day it's warming up nicely, headed for again the upper 60s. like what we saw yesterday. this is on repeat and we are going to see this pattern repeating after day, day after day, with highs in the upper 60s, a few low 70s and cool mornings that drop down into the upper 30s and low 40s. and then even looking at friday, there's not much of a change. you see those numbers going up or down a degree or two, and then looking ahead through the next week, we're seeing a lot of rain across the pacific northwest. a few, quite, quite a few storm systems moving that way, but avoiding the bay area. and we're just going to see some slight shifts in our temperatures. taking a look at brentwood and what to expect over the next ten days will be in the mid 60s from now through friday, and then some lower 60s ahead. tuesday may be the coolest day as a cold
5:56 am
front passes and the rain stays just to our north. and we'll look ahead to the weekend where we're looking at a lot of our inland areas in spots like brentwood will be in the low to mid 60s, and san francisco will also be in the 60s. mike, you were talking about a possible shift in the silicon valley community. i was concerned right here, north 101, i saw what looked like a bigger volume of traffic, and it might have been for a short period of time, thought some folks might have shifted because of the issues we had for 87. that has cleared, but we see some slowing into downtown. we'll track that. but so far nothing dramatic for the south bay. a little slowing. we expect that for the nimitz off 238 and the castro valley. why typical builds here through contra costa and alameda county toward the bay bridge toll plaza. back to you. thanks, mike. well, san francisco banking giant wells fargo is vacating its longtime headquarters. the company confirming plans to move from its montgomery street high rise to a more modern building in the financial district. a spokesperson cites recent assessments of the company's real estate and calls it a move to better manage costs. wells
