morning. >> we speak with the owner of crumble cookie. love those cooks. we start with breaking news from out of here in new york city. a manhunt is under way right now for the gunman who shot and killed the top executive of america's largest private health insurance company. >> the nypd says he was targeted. nbc news obtained surveillance video of the moment of the shooting. we stopped it before the first shot is fired. we'll only show it once. some viewers may find it disturbing. it shows brian thompson wearing the blue jacket. the shooter appears behind him, draws his gun and shoots multiple times. >> video shows the gunman getting away from the scene on an electric bicycle. the shooting scene is blocks away from where we are at rockefeller plaza, which is hosting the tree lighting

ceremony tonight. the suspect was last seen heading into central park. leading us off, nbc news correspondent sam brock. some, sam, you're outside the hotel where this happened. what's the latest? >> reporter: it's sickening and chilling to see that video. the murder which was preplanned, lying in weight is the words law enforcement used to describe how the shooter was approaching this murder. happened over my shoulder. this is next to the hilton downtown, a couple blocks from where you are. it's one of the largest hotels in midtown manhattan. they were hosting an investor conference for united healthcare. it was canceled. it started at 6:45 this morning. that's when law enforcement said the shooter was hiding and then brian thompson, 50 years old, came out and was gunned down.

what is so unsettling about this video, among other things, is the fact you see the shooter walk up. we freeze it when he fires the gun. there's a woman in the corner. you can see earlier in the shot that is just standing there in the doorway. the shooter approaches and clear live goes and guns down thomon, shoots him in the back. there's a woman wondering if she's going to be shot. she staggers away. he had no intention of killing her. it perhaps speaks to the narrative that police are saying it was a targeted attack. after he shoots thompson the first time, the gun jams and then he keeps going. whatever it might be, this 50-year-old man is deceased and police are continuing to canvas the city searching for the murder suspect who was last seen entering central park on an e-bike. >> can we talk about the victim, the 50-year-old brian thompson, do we have any sense of why he

might have been targeted or just tell us a littlemore about him? >> reporter: sure. we know that a lot of peoplele have an ax to grind with insurance companies. it's unclear whether that's relevant in this case. one of my fellow reports, david lee, spoke with thompson's wife. she said they had conversations about the fact that he was being threatened. she did not elaborate but mentioned there was calls made to the minneapolis area police department where they lived. they didn't have any records of calls about 911 or emergency situations of note in the last several years. that is a possibility. we know about mr. thompson, he had two sons. one who is a senior in high school, one a freshman in college. >> so sad, sam. this happened in the middle of midtown manhattan. security everywhere. we have the tree lighting tonight at rockefeller plaza. what officials doing to keep us safe? >> reporter: they say the entire

area is saturated with detectives, counterterrorism police officers, beat cops out on the streets. there's plenty of protection. they don't seem to be alarmed at all that this person is a threat to public safety. for no other reason than it was a targeted attack. he had a specific action in mind and compted it tragically in the middle of the city. >> sam brock, thanks so much. president-elect donald trump's pick to lead the defense department says he's not backing down. >> pete hegseth is facing several allegations of sexual misconduct and drunken behavior which he has denied. hegseth called the accusations against him, quote, ridiculous. >> what you're seeing with me is the art of the smear. take whatever tiny kernels of truth and blow them up about

somebody i'm definitely not. >> nbc news has learned the president-elect is considering replacing hegseth with florida governor ron desantis, according to two sources. >> hegseth met with republican senators again today on capitol hill. he called it, quote, a wonderful process. three gop sources tell nbc as many as six republican senators are not comfortable supporting hegseth. nbc news capitol hill correspondent ryan nobles joins us now. ryan, a lot of moving parts here to keep track of. what do we know right now about talks to potentially replace pete hegseth and what are some of the other names being considered? >> reporter: first off, kate, it's important to keep in mind pete hegseth is insistent he's not going anywhere. i just left him as he was walking into a meeting with joni ernst of iowa who is a republican senator, someone who could potentially be someone skeptical of his candidacy for that top job at the pentagon, particularly because she's

someone who has tried to root out the sexual assault problem and pete hegseth has these allegations of mistreatment of women in his past. the trump transition is exploring options outside of hegseth. you mentioned ron desantis. another one is mike walls. does he slide over and take over at the dod? joni ernst is a possible name, one of the people hegseth is meeting with now. it's important to keep in mind we're not at that stage yet. this nomination has not yet been pulled. hegseth is defiant and using an aggressive media campaign to push back against these accusations against him. >> hegseth aside, he's not the only pick facing scrutiny here. matt gaetz withdrew from consideration for attorney general. what are you hearing from lawmakers about the vetting process we're seeing for the

president-elect's choices? >> reporter: republican senators want to vote yes on donald trump's picks. they believe that he won the election, that he has the right to pick the people that he wants to serve in his cabinet. they also strongly believe that they have a constutional authority to advise and consent in these roles and really to help the president, be an additional screening before the picks are confirmed. they want rigorous background checks and that includes vetting, perhaps fbi vetting. there's some concern the trump transition is not going to agree to that level of vetting which could lead to these picks not getting the votes. >> ryan nobles, thanks so much. the supreme court heard oral arguments for what could be a defining case on transgender rights. >> at issue a tennessee law that bans gender affirming care like puberty blockers and hormone

thererapy. 26 states have passed laws banning gender affirming care for people under the age of 18. antonia hilton joins us now. oral arguments lasted two and a half hours or so this morning. walk us through what we heard from both sides. >> the key question in front of the court this morning was does this ban on gender affirming care in tennessee violate the constitution and discriminate on the basis of sex? what you heard was the biden administration and the people representing three families with transgender minors arguing it does. this is a sex-based form of discrimination. that's because hormones and puberty blockers, the interventions, are still available, but not if you're a minor in the state of tennessee. that's the line that has been drawn here. the state of tennessee is arguing that the state has the right, really the imperative -- moral imperative to act to

protect these children because they say these interventions are not necessary, risky, not studied well enough. what makes it tricky at times to follow is there's a constitutional question in front of the court. the politics, the culture, they all end up bleeding in. the conversation kind of veered at times to, well, we're seeing what they're doing in europe. that's different than here. whether or not what they've done is banned care for minors. that's not the question in front of the court. what the court may decide will have major, profound implications for kids all over the country. >> can we dig into that? what might those implications be depending on how the court rules here for the country? >> it could mean that for about -- thousands of transgender children living in this country, they're not able to access medical care that many of them say is vital to them feeling alive to put it simply. feeling like they're fully human.

feeling like they are themselves when they look in the mirror and go to school. it could mean a path is paved for a national ban. present-elect trump has expressed interest in doing that. it could mean it's not 26 states, but applied all over the country. people who support transgender children and advocates who work with them, psychiatrists say it could have devastating impacts on their mental health. that's really what's at stake here. we will not know until later this summer. that's when a decision will come down. >> antonia hylton, thank you. let's switch gears. time for our money minute. max is cracking down on password sharing. >> there's a familiar face on the forbes 30 under 30. >> reporter: max, warner brothers, says it will send

turmoil in south korea continues today following the president's controversial decision to impose martial law and lift itit six hours later. south korean lawmakers have filed a motion to impeach the president. nbc's janis mackey frayer reports from seoul. >> reporter: opposition parties moved today to impeach president yoon and that vote could happen as eaearly as friday. there are some wmakers threatening to have him arrested if he doesn't resign after this dramatic declaration of martial law that has pushed democracy here into turmoil. there were more protests today. thousands of people marching in the streets, some holding candlelight vigils. we went to the national assembly building where it was different 24 hours before where the military was crashing into the building. one lawmaker scaled a fence to

t back inside for that emergency vote that forced president yoon to reverse that declaration of martial law. why did he do it? he said it was protect constitutional order. this is widely seen as a move against the government. it's no secret that president yoon and the opposition have been locked in a bitter standoff. he saw martial law as a way of breaking the deadlock. it was a risky move and it backfired. the question is what happens next? president yoon finds himself politically isolated. he's had key advisers and ministers now offer to resign. so far he's said nothing. he has remained silent over the past couple days. there are a lot of questions about his political future. >> janis mackey frayer, thank you. americans spent a record $13.3 billion on cyber monday. it is safe to say there are a lot of packages on your doorsteps right now. that means it's important to

transparent transition to a new permanent mayor. now in the plans, she says that on this is what's going to happen. the registrar is expected to certify election results by tomorrow. then, on december 17th, council president nikki fortunato bass. bass resigned her position. city council will meet to certify results and will declare the mayor's seat vacant, and then she will become interim mayor until january 6th. on january 6th, the new council members will be sworn in. they might appoint someone to replace fortunato bass in district two. they will elect a council president who will become the new interim mayor and they will elect a new president pro tem to become the interim council president. then, on april 15th of next year, it will be a special election to elect a new mayor and a new council member for district two. oakland's residents deserve for all of us to come together, for our leadership to be strong and effective, to be focused on our fiscal responsibility, safe communities, as well as our

significant cyber espionage campaign. they say chinese hackers have intelligence operatives have obtained data connected to thousands of people and targeted significant individuals who they listened in on phone calls and got content. they say the hackers are still in the networks. they say they got access to a law enforcement system of court orders for justice department wire taps, which is alarming. they wouldn't say whether classified information was compromised. their advice to every american is to be careful about your communications and use encryption. >> you said encryption. can you give us examples of how to make sure e our messes are encrypted? >> reporter: they're going to encryption by default.

more effective than wegovy in weight loss. we saw that people lost about 50 pounds on average on zepbound versus 33 pounds on wegovy. there's a clear difference and we've seen this as another shu di showing that. >> can you explain the difference between these two medications? it's not as simple as doing an injection and the number going down. >> the dose is over a four-week span. these are injectables. people don't like that. to your point, these are different medications. the active ingrient in zepbound and mounjaro used for weight loss and diabetes. it's a semaglutide for wegovy. confusing, but the active ingredient in zepbound has a dual function.

semaglutide only does one thing. >> this study was funded by eli lilly. it's in line with other studies. would you tell patients to switch to zepbound or mounjaro? >> wegovy is incredibly effective. the question is what are the goals? having said that, if someone is not responding to wegovy or ozempic, yeah, i would think this opens up the conversation should we switch them to something like zepbound. >> what should people consider before starting these medications? >> you know, these are not easy to tolerate, especially upfront. two, we don't know how long you need to be on these medications. i caution everybody. there's a lot of interest in them. know that if you commit yourself to a few doses, you're committing yourself to unclear amounts, maybe years of therapy. we need to figure out who can be

listen up. our consumer team's inbox is stuffed with the same type of complaint over and over. a gift card balance that disappears. here's consumer investigator chris chmura on how to protect your gift cards. protecting a gift card starts at the rack in the store, because that's where many crimils start. before you buy a card, look for tampering. some scammers mess with the barcode. you can feel the sticker. it has

a little bit of a ridge on it. former police officer michelle loss spotted a tampered card and made a viral video on tiktok. here's the scam. that barcode sticker is for a different gift card that the thief has, so any money you load onto that card would actually land on the thief's card. so look for a sticker. take that extra seconds and just kind of feel it. look at it, visually inspect it. you n choose a gift card with extra security. some of them let you set up a pin, especially those used anywhere kind. that might make it tougher for the bad guys to drain your balance. after you get a gift card, use it asap because other criminals are simply hacking to try to drain your balance. there are groups out there that this is all they do, so use your gift card as soon as possible. here's another idea try to cash out your gift card in california. if your gift card has less than $10 on it, state law says the store has to give you cash or a check for the balance. if you have more than $10 on a card, you know you're not going to use, consider selling it on a third
