right now at six. an overnight shooting briefly shutting down lanes on the caldecott tunnel. new details. this morning on that investigation. plus a car plows into a security guard booth in a gated community. the deadly crash was captured all on camera. the dramatic video that may play a role in that investigation. and we are on verdict. watch as deliberations resume in the high profile murder trial of nima momeni. this after a mysterious delay last week due to a juror. the outlook this morning from experts who are closely following the case. this is today in the bay. good monday morning. thanks for making us a part of your morning. i'm marcus washington, and i'm laura garcia. we'll get a look at that morning commute with mike in just a little bit, but there's certainly a chill in the air this morning. bundle up if you're headed out the door. yes, it will be a cold morning cold the next few mornings and then mild weather for the afternoons.
6:02 am
this is a live look outside in dublin where we are seeing those temperatures now in the mid 40s, and we will have another chill for the next several hours. and then looking at a beautiful day as it warms up nicely for the afternoon. headed up to about 62 degrees. yes, these temperatures are a little bit cooler than what we had over the weekend. for some of us while in the south county, it will be in the upper 60s today and mid 60s for much of the north bay, and really there's not much change tomorrow as well, but it may be a little bit cooler in some of those inland valleys. so we'll talk more about the changes ahead right now. mike, you've got some unexpected delays as well as the expected. the expected is the bay bridge toll plaza. but let's look at the bigger view of the east bay. typical slowing for richmond 37 here. highway four as well. unusually slow from early on. southbound 242 continues with the jam. there is a crash at the 680 merge there, and that's forcing perhaps some more folks to take this highway four over to 680 junction. taking that corner instead of cutting the

because those jurors are going to head back into their room and figure something out. right? correct. that's the idea. good morning to you, marcus. jurors were off on friday later this morning, they will return to superior court in san francisco for what would be day three of deliberations in the trial of nima momeni. nima momeni is accused of stabbing to death bob lee in april of last year. lee, if you'll recall, is a former tech exec who co-founded cash app. the defense has argued that lee was the one who actually brandished the knife, which he then used in self defense. the jury is considering a single count of murder with an enhancement for using a deadly weapon. legal analyst stephen clark says they have to unanimously agree on that charge to find him guilty, but if they don't, if the jury does not, the judge has advised them they can consider lesser charges, meaning second degree murder or manslaughter. but they typically do. is do is handle the case in

a stair step fashion that they will not get to second degree murder unless they all agree that he is not guilty of first degree murder, and they would not get to voluntary manslaughter unless they all agreed that mr. nima momeni was not guilty of second degree murder as well. on thursday, something unusual did happen with the jury that left 11 of the 12 jurors sitting in a hallway for nearly an hour at a time. they were supposed to be in the jurors room deliberating. our own sergio o quintanalso noticed that the lead defense attorney was sitting outside the courtroom. then the prosecution team with the judge, legal analyst steven clark says the judge was likely asking something of one of those jurors, perhaps what, if anything, did they come into contact with? or is there something going on that they need to talk about with the judge? but the jury did reconvene. they continued deliberating on thursday. that was day two. day three expected to resume around 930 this
