industry forever. we begin with breaking news. a major break in the case of the health care ceo's murder in midtown manhattan. police arrested a person of interest in pennsylvania. he's been identified as 26-year-old luigi mangione. new york city mayor eric adams said mangione matches the description of the photos and videos released by police. to be clear, he's not being called a suspect at this point. new york city's police commissioner says mangione was taken into custody at a mcdonald's in altoona pennsylvania, after a work who recognized him called police. the commissioner said he had a gun similar to the one used in the murder of brian thompson. you're looking at a photo here. a a senior law enforcement person tells nbc this is the photo. the commissioner said several other items linking mangione to the shooting were discovered.

>> there was a fraudulent new jersey i.d. matching the i.d. our suspect used to check into his new york city hostile before the shooting. additionally, officers recovered a handwritten document that speaks to his motivation and mindset. >> brian thompson was killed outside of a manhattan hotel. that was last wednesday in what police say was a targeted attack. a private funeral service was held for him today. sam brock joins me now from outside that hotel in midtown manhattan where thompson was killed. sam, what more do we know about luigi mangione? >> reporter: we have a limited amount of information from what police provided earlier today about luigi mangione. 26 years old, they say he's from the baltimore, maryland, area. went to college in pennsylvania. we learned within the last hour, kate, chief of staff for the

maryland legislature said this is his cousin and a statement will be forthcoming. it seems like luigi mangione is a prominent one in maryland and it's remarkable when you think this has been going on for almost six days, pictures flooded everywhere. lots of conversations in households and dinner tables about how it's possible to have someone's entire face and no see word from friends or family as to who this might be. we found out from the police day it was an employee at that mcdonald's in altoona who called the police at 9:15 this morning because he had seen pictures or they, the employee, had seen pictures like this. saw suspicious activity, called altoona police . police arrived and spoke with him.

they learned he had a fake i.d. and that gun you described. police saying it's a ghost gun possibly manufactured by a 3d printer. then you see the fake i.d. we shared. here's another huge connective tissue. that i.d. has the same fake name provided to the hostile when the person of interest checked in. same name as what was found on the person today in pennsylvania. there's all these things that are overlapping right now. he has not been charged with any crime, certainly not in connection with the shooting yet. >> sam brock, thanks so much. rap icon jay-z is fighting back against allegations that he raped a teenager 20 years ago. jay-z whose real name is sean carter was named by an anonymous accusers. it's alleged that jay-z raped

her when she was 13 years old. she recalls receiving a drink that made her woozy and light headed. the lawsuit was filed against combs in october refiled sunday to add carter's name to it. combs is scheduled to go on trial next year on federal sex trafficking and racketeering charges. he's pleaded not guilty. chloe milas was first to report about this lawsuit and also with us legal analyst danny cevallos. chloe, in his statement, sean carter is accusing the woman's attorney of blackmail. what else is he saying and how is the attorney responding? >> reporter: kate, jay-z's response is truly unprecedented. i've been an entertainment reporter for nearly 20 years.

jay-z is a very private person. this was a very lengthy statement. you read part of it. i want to read some more. he says i implore you to file a criminal complaint, not a civil one. whoever would commit such a crime against a minor should be locked away. he talked about the fact that some of his children, meaning blue ivy carter, are old enough to read the news and know about what's happening in the media and he and beyonce have to sit down with their children and talk about the allegations being made against him. on the flip side, you have tony busby the civil litigator in houston saying demand letters get sent all the time. i didn't extort him or ask for money. i just tried to have mediation with him and then jay-z filed an anonymous suit against me. now we know that this suit that was filed just a few weeks ago by a well-known anonymous male celebrity was actually jay-z fighting back against these

claims just a couple weeks ago. the plot thickens here. just a few hours ago jay-z's attorney filing a motion demanding the judge require this accuser, this female jane doe to reveal her identity or have the case thrown out. >> dan, let me turn to you. that seems unlikely a judge would say we'll reveal the identity of a jane doe in a suit, yes? >> it's interesting. it's a gray area. i have some of these cases. generally speaking whether you're on the defense, no matter what, most of the time these are people -- you don't want to be the one to say i demand this person's identity become public. often they're child victims. there is no hard and fast rule, especially in state court. you have a better shot in federal court. jane doe pleading is not a guarantee for the most part. a judge could have something to say about it. >> chloe described a lot of legal back and forth on both sides.

this is a 24-year-old allegation -- the alleged crime happened 24 years ago. how is this coming up now? >> because the united states is following a trend, including the state of new york, of enacting statutes that allow for greater look back periods or lengthening of statute of limitations. so unsurprisingly new york is one of those states. they expanded their statute. these games, especially for minors, their clock doesn't start ticking until they're adults. that's how you get back so many years in a case like this. >> lots to watch. danny cevallos and chloe, i know you eel stay on it. the man charged with putting a man in a deadly chokehold on a new york city subway has been found not guilty. jurors acquitted daniel penny of criminally negligent homicide in

the death of jordan neely. jordan died after penny placed him in a chokehold. the judge dropped the manslaughter charge against penny after jurors said they couldn't reach a consensus. rehema ellis joins us from outside the courthouse in new york city. she's been following this since the beginning. because of this verdict, daniel penny will not face any jail time. any chance there could be an appeal or is he clear of all cases? where do we stand? >> reporter: doesn't look like there will be an appeal from the district attorney's office. it was the prosecutor's office that asked the judge to dismiss the manslaughter charge against jordan -- against daniel penny when the jurors said they couldn't reach an agreement about whether he was guilty or innocent. they don't get to double dip on that. that's off the table. now they found him not guilty of this. it's very unlikely he would face anymore criminal charges. civil charges, yes.

the father of jordan neely has filed a civil suit against mr. penny. he did that just last thursday. that's just been put on the file. so he will have to deal with that. his legal troubles are not over civilly, but the criminal ones appear to be over for now. >> there's been so much public debate about this case. i wonder what the reaction was like inside and outside the court today. >> reporter: let me tell you about outside. we have video of it. there was an altercation when there were competing demonstrators, those in favor of penny, those in favor of neely, jordan neely. they got into a clash with one another to the point where police were called in. when the verdict was read inside the courtroom, there was an outpouring of emotion on both sides. some people had to be escorted out of the courtroom. the district attorney is really asking for all people to be calm and respect the decision of the

jury. he put out a statement saying there have been some threats on social media against his folks. he's asking everyone to please accept the verdict of the jury. >> rehema ellis, thanks so much. time for today's cnbc money minute. tiktok is asking a court to put a hold on a potential ban in the u.s. courtney reagan joins us now. >> reporter: tiktok asked a lower court today to pause an impending ban on the app in the u.s. until the supreme court can weigh in. the company's been given until january 19th to divest from its chinese owner or shut down. tiktok warned that u.s. small businesses and social media creators will lose $1.3 billion in earnings in just one month if the app is banned. nvidia under pressure after a chinese regulator opened an

the family have fled the country and given political asylum in russia. what comes next for syria is uncertain. rebel forces face the prospect of governing and western and regional powers looking to secure their interest. allie raffa is in washington for us and matt bradley is in beirut. matt, let me begin with you. there's been so much news over the weekend. what is the latest now and what do we know about rebel forces that have taken control of damascus? >> reporter: with astonishing speed, kate. i don't think the rebels knew they were going to quite successful. now things are moving fast still. we're seeing the appointment of a new prime minister, a man who was the prime minister of the area that hgs controlled in northwestern syria based. it was from there they launched

their lightning dash across western syria and took damascus in short order. this new prime minister, he peacefully is taking over the leadership of the country from a prime minister appointed by bashar. only a couple months ago both men were seen speaking with -- he is the man in control of hts, the group that led the charge. now we're seeing this new prime minister. he's making all the right noises about inclusion, about allowing for a different sex and different ethnicities in syria. it's something a lot of minority groups were all worried about. previously it was a fundamentalist group. there were concerns.

this man, the leader, his real name he's going by, he has made all the right noises as well. he said he's going to create a government more inclusion and more democratic. >> matt bradley, a lot happening, thank you so much. allie, let me bring you in. there are 900 u.s. service members on the ground in syria. how is the biden administration responding to the end of the assad regime and what's at stake for the u.s.? >> reporter: we heard from president biden yesterday. he struck a cautiously optimistic tone in a speech he delivered. in that speech he saidhe was clear eyed about not just the connections that the rebel groups have to terrorist organizations, but also clear eyed about the window of opportunity that this gives isis to resurge in this region. after his speech we learned the u.s. military conducted strikes on over 75 isis targets in syria

suspicious and called police when they took him into custody. investigators say they found a gun similar to the one used in last week's shooting. officials say the 26 year old was born and raised in maryland, has ties to the san francisco bay area and his last known address honolulu, hawaii. brian thompson was shot and killed last wednesday morning in front of the new york hilton midtown. his death sent shock waves through the health care industry and corporate world. we'll continue to follow this breaking news and bring you updates as they come in locally. day three of jury deliberations in the murder trial of nima momeni. he's the man accused of killing cashapp co-founder bob lee. our bob redell is at the courthouse in san francisco with the latest. reporter. after taking off friday, the jurors have resumed deliberating here this monday morning at the hall of justice in san francisco to try to determine the fate of nima momeni. momeni is accused of stabbing to death bob lee in april of last year. lee, of course, being the former tech exec who co-founded cash app.

the defense has argued that lee actually is the one who brandished a knife, which many then used in self-defense. again, that's the defense's argument. the ry is considering a single count of murder with an enhancement for using a deadly weapon. legal analyst stephen clark says they have to unanimously agree on that chargee to find him guilty. but if they don't, the judge has advised them they can consider lesser charges, meaning second degree murder or manslaughter. what they y typicall do is do is handle the case in a stair step fashion that they will not get to second degree murder unless they all agree that he is not guilty of first degree murder, and they would not get to voluntary manslaughter unless they all agreed that mr. momeni was not guilty of second degree murder as well. on thursday, something unusual did happen with the jury that left 11 of the 12 jurors sitting in a hallway for nearly an hour at a time. they were supposed to be in the jurors room deliberating.

breezy wind. and for the north bay it will be 64, in napa, sonoma and in novato. moving ahead throughout the week, we are going to see some changes. the return of rain in the forecast. so we'll take a look at that coming up in about 30 minutes. thanks, kari. state lawmakers have a new way to protect children online. california attorney general rob bonta and assembly member rebecca bauer-kahan proposed a new bill today.t's called ab 56. it would require social media apps like instagram and facebook to come with warning labels. lawmakers compared it to the warning labels that come with cigarettes or alcohol. they say it would appear when users first sign up and once a week after that, the labels would advise people about the mental health risks associated with using social media. attorney general rob bonta spoke about some of those risks earlier today. studies have shown that more time on social media tends to be correlated with depressio, anxiety, body image issues, susceptibility to addiction, bonta says. adolescents who spend more than three hours a

day products. known as tce and perk are found in common manufacturing and dry cleaning products. the ban comes after the epa found the substances present an unreasonable risk of injury to human health. the epa says tce is associated with various cancers and is tock iks to the nervous, immune and reproductive systems even at low levels of exposure. it says perk is toxic to the same systems and pollutes the environment. we are getting a clearer picture of president-elect donald trump's first priorities when he returns to the white house in just 42 days. the president-elect sat down exclusively with "meet the press" moderator kristen welker for his first broadcast interviewing since winning the election last month. >> reporter: in our interview president-elect trump laid out a

saw from the fda. >> red three presents an interesting example for us. it's actually known to be cancer in laboratory animals, rats. the scientific consensus is the mechanism is not applicable in humans. >> if red dye number three is known to cause cancer in laboratory animals, why is it allowed in food for humans? >> kate, the fda is going to have a lot of explaining to do no matter what decision they come down on. in 1990 the fda actually denied a petition the allow red dye three in cosmetics, as well as to topical medications based on the delaney clause. it prohibits the fda from designating any additive as safe if it's found to cause cancer in

either humans or animals. i do agree that data in animals and lab rats does not necessarily extrapolate to humans. we know that and we see that all the time. at a minimum red dye three should have a black box warning label on it stating that, in fact, it causes cancer in lab rats. >> doctor, is it just cancer or are there other potential risks? does it apply to all food colors or just red dye number three? >> to the second part first, red dye three is not the only dye implicated. there are many different food additives that are approved by the fda, nine of which are synthetic. red dye 40, yellow five and six, through the rainbow, blue and green dyes are also being flagged as potentially associated with hyper activity and other behavioral disorders. that data is a little more

conclusive to the point of many researchers and experts who analyzed the data have said, yeah, in the right child exposure to these different dyes and synthetic dyes can contribute to hyper activity in the form of adhd and otherwise. that's science that's been accepted at this point. >> i'm sitting here as a mom that cooked with red food coloring and given kids the candy, should we let our kids eat these foods or dial back? >> so, you know, as a consumer, as a parent, as someone who doesn't want to expose themselves or their children to these things, now is a good time to take stock of what's in your kitchen cabinets. reading labels is really important. when something's obviously bright colored, you can assume there's synthetic dye there. there are other things too. ironically even an inactive

didn't have dedicated officers for that. we had to pull resources from patrol. the oakland fire department is also facing cuts. crews are stretched thin and this proposal includes closing two fire stations and possibly another for next year. oakland city councilman kevin jenkins told us the city wants to also dip into the emergency reserve and self-insurance fund. there's no cuts that are going to be fixed and anytime we are brownley out fire stations, it's going to be a challenge, right? some of the cuts rely on the sale of the city's share of the oakland coliseum to the african american sports entertainment group. investors are waiting for alameda county supervisors to approve the a's half of the deal. that discussion is s set r tomorrow. we've got sunny skies today, but rain is just around the corner. here's meteorologist kari hall with our extended forecast. today, look for a lot of sunshine and well above normal temperatures with highs in the mid 60s. but then it cools down quickly and we're

while he was out of town, and lyft couldn't find a tow for two days. he says lyft told him to go ahead and tow it himself and save his receipts. well, he says the tow plus two nights in a hotel totaled $1,447. sam submitted that for reimbursement, but says lyft and its towing contractor simply kept pointing fingers at one another. after more than a year of that, he contacted us to break the cycle. we contacted lyft. it then sent sam a check for $1,347.99. we reached out to lift for comment, but it did not respond. the way we see it, sam did everything right here. he tried to follow lyft's normal procedure. then he followed its backup plan. yet lyft still didn't pay him until we stepped in. we're glad sam had good documentation to show he was just dng what they told him. if you need help getting a consumer issue on the road, just
