ahead, the latest on conditions crews are facing as winds keep picking up. plus a blow to local residents. another san francisco business announcing its closing. the reason behind the decision. also up for vote. the possible school merger decision. leaders are weighing today in the east bay and the negative impacts it may have on students in that school district. this is today in the bay. 5:00 on your wednesday morning. thanks for starting your day with us. i'm laura garcia. and i'm marcus washington. we do begin with breaking news out of southern california this morning. the franklin fire is forcing thousands of evacuations in malibu. the flames have burned more than 3800 acres so far. evacuations are still underway this morning. reporter brittany hope with our sister station in los angeles is near the front lines, with more on the work underway to contain the flames. good morning everyone. we're here on pch between pepperdine

and point dume. i can tell you, in our more than 36 hours of reporting on this fire, this is the furthest west that we have seen. flames yesterday. really? that border was at pepperdine university. now it has pushed well west of that. so this morning the heart of this firefight is these ridges, these hills that you're looking at right now. overnight we've still been dealing with really powerful gusts of wind. but more than 1500 firefighters still working this on the ground in the air. luckily conditions have been favorable enough where fire crews were able to do water drops from helicopters overnight and into this morning, and we have been seeing that. but you can see it seems that the flames are starting to push south kind of coming up that ridge. the goal is to stop that from happening. talking about all of the crews that we have, if you look down here on pch, we have a massive circle of firefighters who were huddled up all together figuring out their tactical plan this morning. oh, in fact, you

know what? we have another helicopter that's arriving just above us right now. i believe that that that this is the same helicopter we've seen doing those water drops on this new western head of the fire. these air drops are so critical when you have terrain like this. that's so hilly. it's really hard for ground crews to get to because road access is so limited. having resources in the sky from the state, the federal and the local level has proven critical. today. the big priority is protecting homes, of course, and property, but also stopping the spread of these flames as they continue to push west toward point dume. we can tell you since yesterday that eastern flank of the fire has really improved. we weren't able to see any glow just east of us. back to you. all right, brittany, thank you. i want to check in with forecaster cinthia pimentel. i know you've been monitoring those conditions there. when has certainly been a big factor in fueling the spread of that fire. yeah, because they have the santa ana winds down there. marcus. so what happens as you approach the santa monica

mountains is that wind comes over the hills. it comes closer to ground level. so as it's doing so, it's compressing and it's warming and it's ramping up those gusts. we see 15 to 30 gusts possible as we go on into this morning. maybe an element overnight that helped firefighters was the cooler temperatures. but it is still a particularly dangerous situation. so aside from the red flag warning some terminology that we're used to, this one right here, the particularly dangerous situation issued by the national weather service when we're looking at a very strong and critical situation over the next couple of hours. so that will be something to watch as we go on into the evening and the pattern starts to change. a little bit more of that pattern will come here into the bay area with the storms that we're watching. hopefully some of that does push down into southern california and helps the firefighters there. as far as starting the morning here we are bundling up and watching for the visibility changes. with that patchy fog through the valleys, we'll talk about the rain that is on the way. first storm is tonight, but there is a second storm much more powerful

that i'm watching for the weekend, coinciding with the king tide. so some situations that we're watching, i'll break it down for you coming up in my full forecast in just a few minutes. but right now i want to go over to mike, who's also been busy right now tracking a couple of slower spots. yeah, nothing like yesterday. we don't have any major crashes, but we did have some overnight worork which has been clearing up. you see the green sensors here, but i want to take you to oakland. there was a crash that cleared about a half hour ago, but we still had slowing eastbound 580 around 35th. there was a lot of damage to the attenuator. i think there's a barrier repair work that has to go on later today. i'll let you know, but they typically do that after the morning commute. meanwhile, over here, southbound 680 does still show some slowing, despite the fact that all crews have cleared from the caltrans grid. as you're heading south down past las positas and bernal, that should continue to ease up as crews, whoever remains over on the shoulder starts to clear out of the area. so far, that's the only slowdown you have out of the east bay. and there is some fog that cynthia was talking about similar to the last couple of days. back to you. thanks so

much, mike. 505 right now. later today, parents and students in oakland will learn about the fate of their schools as the district tries to close a major budget deficit. today in the bay's bob redell joins us live. and bob oakland unified about to decide on the merger of actually several campuses. correct. good morning to you, laura. at its meeting this afternoon, the oakland unified school district board, they will meet to consider a recommendation by staff. this would be a vote of the recommendation to merge ten of their schools into five. now, the ten schools are already located on shared campuses. the proposal calls for the following combinations the new mergers international community school and think college. now manzanita community school would merge with manzanita seed, acorn, woodland and compass. esperanza and korematsu discovery academy and united for success academy and life academy students would continue their classes as normal on these new combined campuses,

but the district estimates that by merging these schools, they'll be able to cut down on administrative costs by an estimated 2 to $3 million, which is a small step towards closing the district's budget gap. that's projected to be $95 million next year. last month, there was a big crowd of concerned parents at one school board meeting when they heard about the proposal. at the time, one teacher told us these mergers were a bad idea that would take away services from students. oakland. the main thing is how do we save the quality of the education? that's my concern, so that we're just not making cuts and turning kids into these schools, into low performing danielle lama believes school restructuring needs to happen, but says students success must be a priority. he doesn't anticipate layoffs, but says administrators could be reassigned or moved to other locations if the board approves the mergers. at their meeting this afternoon, they would be going to effect next

fall. reporting live bob redell today in the bay. all right. we'll follow and see what happens. thanks, bob. another san francisco business closing its doors because of crime. safeway shutting down its store in the fillmore district after 40 years. the grocery chain originally planned to close the location on webster street earlier this year, but a spokesperson says it stayed open to give the community time to adjust. safeway says all employees will be reassigned to other stores in the area. the new closure date is february 7th. now, in a statement, the company says in part the decision to close the store was made after careful consideration due to ongoing concerns about associate and customer safety, as well as persistent issues with theft. happening today, south bay health care workers will hit the picket lines. health care professionals from valley medical center and o'connor hospital in san jose are calling for better working conditions. the county public health office and workers have been negotiating employment contracts since july. union health care workers say the

county has not offered them a fair contract. a planned picket starts at 7:00 this morning. we've reached out to both hospitals for comment. 508 right now, as we take a live look out at the golden gate bridge, a few cars on the road, and i'm sure those in the cars bundled up because it is cold out there and heater all the way up. i turn it up to 80 sometimes. if it's possible, i i'm in a loaner right now and i was trying to figure it out. i was freezing. isn't that complicated? it is so cold out there. so we have to really bundle up and also start to get some of our rain gear ready for the next couple of days. we start our morning right now, 30s and 40s, 31 in santa rosa right now. also watching for that fog through 101. so careful there, busy already through san carlos, but we bump it up a few more degrees. 47 there and 40 right now in san jose as we look towards 280 and 17. now, aside from that patchy fog and the frost this morning, we are going to look at a mostly sunny day dry that will change as we go on into tonight, where we're tracking the rain first

sweeping on through parts of the north bay, becoming heavier as we go on into the overnight hours. i'm looking at that storm mainly as we're sleeping, but of course the early commuters will watch that for you as well. there's a second storm that i'm watching that could ruin our weekend plans. if you have outdoor plans, if you want to stay inside and maybe decorate for the holidays, that's not too bad. but a lot of things are coming with this one that i'm watching, so i'll track that for you coming up in my full forecast. but now mike is helping people get out the road with some cheaper gas prices. to give you some pleasant news, perhaps today we're going to check our contra costa county best. that's 349 at concord. concord super stoon willow pass road is that spot for that price in the north bay. it's 359 for the low mill valley. they have arco on redwood highway. that's no stranger to us. and in the south bay, sunnyvale is among the best listed, with the south bay's 369 best price. that's a national petroleum on old san francisco road. you can check your areas. there are some lower prices coming up day by day, few cents at a time. gasbuddy.com on the roadways, we'll look at mostly green sensors and that highlighted

and cvs have been closing stores, some stores with very little on the shelves. after billions and billions of dollars, general motors is giving up on cruze. it will fold the self-driving taxi company into its other work on driver assist. its departure leaves waymo as the only self-driving taxi service in the city, though tesla constantly promises it, too, will have self-driving taxis showing off. a cyber cab prototype in october, it said would be on the road by 2026. tesla had previously promised a million cabs by the year 2020. and yes, 2020 has come and gone. the ftc says it won't allow albertsons and kroger to merge, saying it would be anti-competitive and would raise grocery prices. one of the last antitrust victories for president biden's ftc chief. president biden spoke about the reminding the brookings tuesday, institution and america he's

including nbcbayarea.com. he had to google who is simone biles? you might have needed help learning how to use google, or just how many medals does she actually have? wow. all right, well, here we are. it feels like winter. not winter just yet, but it's a cold start to our morning. i think winter officially starts the 21st, so next saturday. wow. yeah. and those temperatures really feeling winter-like this morning. let's give ourselves a couple of minutes to warm up the car, especially up there in the north bay below freezing right now in santa rosa. and we talked about those changes in visibility that i'm also starting to peek over here towards walnut creek 38 out there in the east bay, a chilly 40 right now in san jose. and we go to the city where mostly clear to start this morning and slightly higher in those morning temperatures at 47. we're going to head for a mix of sun and clouds later on today. you'll feel a little bit cooler up there in the north bay. upper 50s and 60s similar feel out there towards the east bay, a high of about 64, in livermore. well, you'll find the more mild

numbers are down here in the south bay. we'll do 69 in san jose, 65 palo alto, with that storm coming in later on tonight. so if you can and have the time later on today, we're going to start preparing for those storms. also finding our rain gear here. we go on and take a look at the models starting to bring in some of the rain as we go on later on tonight. so the evening commute looks fine. it is until the overnight hours into our thursday early morning commuters that could be met with some heavy downpours at times. and really, that's the that's it for this activity. we'll take it into some spotty showers for our thursday. so as far as totals for storm number one, we're looking at anywheree from about half an inch down here in the south bay to about an inch for our where it's been really heavy over the last couple of storms in the north bay, nearing that one inch where we could boost those totals for everybody as as we go on into this weekend, starting to change those plans already as we watch here with me, that storm arriving, getting that atmospheric river boost right now, pushing towards parts of the north bay where we see

those colors starting to turn into those oranges and yellows we're seeing at some higher totals. and that could continue on into saturday, dumping some more fresh powder into the sierra and then starting to break apart as we go on into sunday. and that's when we get more places going into that 1 to 2 inch rain as we go on and take a look at some early estimates. we'll see how we get rain shadow down here into the south bay. now, the storms aren't the only thing that are coming in and changing. look at those temperatures starting to drop as we go on and enjoy a pretty mild day today. coming down into the 50s over the next couple of days in our inland valleys, and those chances of showers into the 49ers game later tomorrow and the weekend, rain that will continue and a couple of showers chances into next week. so that storm door is swinging wide open and the commute is moving well this morning. mike, where are we looking? we're looking at we'll start with the bay bridge toll plaza, where things are starting to get a little more busy here. no slowing at the toll plaza itself. maybe a little on the incline coming up. and those

look at the forecast. another chilly start. cinthia pimentel is in for kari this morning. nice to see you. nice to see you guys. i know we're all, you know, moving the jackets aside to get on tv, but as you step out the door, going to school or work, grab those heavier coats. we are starting with a frost advisory up towards the north bay, the east bay valleys. we see some upper 30s and some low 40s right now on the map. only places that are slightly warmer 45 in oakland, 47 in san francisco. this is what may be our last dry and bright day for a couple, as we track some rain moving in later on tonight for sweeping on through the north bay, becoming heavier into the overnight hours, and then kind of fizzling out as we go on into later on this afternoon. but there are more storms behind that. we'll talk about it coming up. mike, you want to warn some people about changes in visibility? yes. chp is talking about this portion of contra costa county and also in san joaquin county. notice above the antioch bridge. now we get this

yellow highlighting, because cynthia and my computer systems combine the data and they can tell you what it might be like on the ground as well. again watching for the fog. chp confirming that might be a factor over here though. highway 4 does show traditional slowing coming into concord and out of pittsburgh and bay point. highway 37 at the top of the screen out of vallejo, moving over toward novato. look at the bottom of the screen, slowing into san francisco as you get into the city. i believe there might have been one overnight crew that is clearing from the bridge, because there are no problems reported at the bay bridge. getting into san francisco over at ninth, and we're looking at the toll plaza with a little build right now. we should see the wait start in the next few minutes. we'll show you again in a few. back to you. thanks, mike. well, developing right now, a possible shooting in is under investigation. this is in concord. it happened last night near oak grove road and monument boulevard. it's a busy area near costco. now, a portion of oak grove road was shut down for the investigation. witnesses telling our crew there at the scene that they heard five gunshots and saw a bicycle in the middle of the street. we

have reached out to police about more details. of course, we will bring you those updates as soon as we get them. the attorney for the man suspected of killing the unitedhealthcare ceo says he hasn't seen any evidence against his client, while luigi mangione fights to stay out of new york. investigators are building that case against him. today in the bay's kris sanchez joining us now with more from his attorneys. kris. good morning to you, marcus and laura. luigi mangione is in a pennsylvania jail and will remain there, likely for as many as three weeks as he is fighting his return to new york as a completely out of touch. and it's an insult to the intelligence of the american people and his experience. that was yesterday afternoon, after mangione shouted at reporters and struggled with deputies outside that courthouse. inside, he reportedly sat mostly quietly in the courtroom, where he faces firearms and false id charges. when he began to respond to the court discussion, his lawyer quieted him while fighting

extradition to new york, where he is charged with murder. already will delay his transfer, but it won't stop it. on the today show this morning, the 26 year old's attorneyays he has yet to see any evidence record. he's pleading not guilty to those. and i've seen zero evidence at this point. now, while mangione's attorney may not have seen any evidence, it appears to be piling up. when mangione was arrested, investigators say he had a gun similar to the one used in thompson's murder. a fake id, a three pa handwritten note. and according to nbc news, nypd investigators are looking into whether this was a symbolic takedown. two senior law enforcement agents also say they are examining the x ray of a spine posted on mangione's social media account to see if it is his and if it could point to a motive. investigators are also talking with law enforcement anywhere. mangione spent time including san francisco, though san francisco police chief bill scott would not specify what that conversation is about. mangione,

as we mentitioned, was denied bail. his attorney, though, says that as he is charged in pennsylvania, he does not face any capital charges, and under pennsylvania law, any law, any charge that does not carry a capital punishment does mean that he could be eligible for bail. so he will be challenging that. he will also be filing a writ of habeas corpus, challenging the legality of his client's detention. he has 14 days to do that. laura, certainly the world is watching this one. thank you very much, chris. deliberations continue into day five after no verdict has been reached in the murder trial of nima nima momeni. yesterday was the jury's longest day of deliberations so far. the defense team now trying to declare a mistrial. no word on when the judge will rule on that motion. he is facing a single count of murder for stabbing cash app founder bob lee on a san francisco street last year. deliberations start up again at 930 this morning. when the jury

finally reaches a decision. we'll break into programing to bring you. that verdict will also send out a breaking news alert on our nbc bay area app, along with complete coverage at nbcbayarea.com. also today, the oakland unified school district will meet to discuss school mergers. the district announcing that proposal to merge ten schools which currently share campuses. so right now the district is facing a $95 million budget deficit. at the last meeting, many of those members of the school community, they said that that move would have a negative impact on the students. the school board says that the mergers will cut costs and create more collaborative teaching environments. if passed, the proposed merger would take place next fall. the meeting is at 4:00 tonight. there's new warnings about the growing number of bird flu cases in california. a possible new case linked to a child who drank raw milk in marin county is being investigated. docto peter chin-hong of ucsf says there's a very low threat to the general

population, but the virus is mutating. grocers recently pulled fresno based rau farms products from shelves following the detection of the virus. the bird flu is also affecting the nation's egg production. a uc davis economic agricultural professor says you can expect higher egg prices in the new year if that virus is not contained. so if there's not 1 % the eggs are not in the market, the price has to go up a lot to get people overall to cut back by 10%. there have been 32 confirmed blue bird flu cases in the state so far this year, but almost all of them have been poultry and dairy workers handling sick animals. let's take a live look outside at the bay area commute this morning, which looks not too bad, but believe it or not, soon enough they will be packed those roads with holiday travelers. according to triple a. a record 119 million travelers are expected to hit the roads, take trains and fly through the new

year triple a, even saying that the increase is because christmas falls on a wednesday. record breaking travel numbers are expected the weekend before and then the weekend after the holiday. 107 million americans are expected to drive to their holiday destination. more than 7 million people will fly, and more than 4 million will take a train, bus or cruise. low lying coastal areas of marin will experience some flooding over the next few days. king tides are returning starting today, and they're expected to last for the next week. forecaster cinthia pimentel is tracking the timeline for us this morning. yeah, and king tides are a preview of what we can see as we experience sea level rise with climate change and all those factors coming together in the next couple of years. but for the immediate future, right now, anybody living near the coast, fishermen, people that like to frequent the beach, we need to watch this for the next couple of days. we paired this together. the incoming waves, all of that energy and the waves ineasing from the storms that

are coming in are definitely going to be something to watch as we go on into the weekend and even into next week, with the chance of seeing those king tides causing some flooding, minor at times and places that are usual to see that low lying area turn into a little bit of a waterway. so always a good time to revisit what to do. as we prepare for the next couple of days, you need to know if your home is in a king tide area, in a flood zone with the incoming zones, and also have those emergency plans ready so that you are ready to go in a moment's notice. we don't drive over flooded roads. i've mentioned in the past that it just takes a couple of inches for it to sweep you away or to cause some trouble. so just make sure that you stay with us over the next couple of days as we track those incoming systems. and who could get the bulk of these incoming storms. but for now, mike, you are looking at the traffic building at the bay bridge. yeah, pretty predictable pattern here. but we will talk about those king tides in a second. cynthia, we're over here at the bay bridge. not a flood of cars, but a typical build.

the metering lights should be on. we did have that slowing into san francisco and it continues to build. i'm not sure what exactly is going on at the end of the skyway. getting into the city itself. west 80 does show more slowing after treasure island than we typically see at this time of day, so we'll continue to track that. that's critical getting into the city over here. highway 37 continues to build as you get in through the north bay, over in toward novato, and then south on 101, you pass by this low of the manzanita parking lot. the lower lot is closed, as is tradition, when those king tides come in. so they closed off the lower section of that park and ride. and that's going to be, again, as laura mentioned, for the next week through the area. another note here in highway 92. this is not because of water. it's because of trees. they're doing tree work along this stretch of 92 between half moon bay and 280 in skyline. so we're going to watch for traffic control through 3 p.m. that should be clear by the evening commute and just after the morning commute. so hopefully if you have day plans watch for that. in san jose, we have our second night of the billie eilish concerts over at sap. important note if you're going to the concert

agree. the courts look backed up so the question is why veto? it's a very good question. the person nominating many of those judges would end up being donald trump. so that's why the white house is worried. white house says the timing of this bill is suspect. the senate passed this bill to authorize 66 more judges unanimously last summer, before anybody knew who the next president would be. they saw that as fair. but house republicans said on the bill until after it knew that trump had won. president biden spoke at the brookings institution yesterday listing off his economic accomplishments, including more jobs created than any president in history, plus faster economic growth than any other western country. post pandemic, biden spoke in a weak, raspy voice as he once again fights a cold and then surprised the audio operator with a sudden burst of emotion. put it this way if we're not leading the world, who does? not a joke. i'm

30s and 40s frost advisory with us until 9 a.m. as we go on into lunchtime. gradual warming, but we'll notice more clouds that start to come into the picture as we track that rain on the way. first into the north bay later on this evening, where we're going to see those temperatures take a dip into the upper 50s the rest of the bay. second half going into those low to mid 60s out towards livermore, the more mild numbers down here, 68 in morgan hill. so it will first sweep on through as we go on into our evening hours. north bay first turning a little bit heavier as we go on into the overnight hours. so if you're really not a fan of the rain, that will be as we go on into tonight. but it could be heavy at times. maybe waking you up as we go on into those overnight hours, but really fizzling on out of here as we go on into tomorrow morning's commute. so something to watch now. early estimates for that are between half an inch to an inch. but where i see us boosting those totals and getting into definitely some more tricky situations. frightful as i mentioned, or as we go on into this weekend, late friday on into saturday, we get

an atmospheric river boost and more widespread rain where it could turn heavy at times as we go on into saturday, seeing that chance of sierra snow as well, and maybe starting to clear things out onto sunday. but storm door right there, back open as we go on into next week. so we're really into the more rainy month here in the bay area, december, january and february and watch this as we go on and track the estimates. right now into the sierra, we're looking at maybe 1 to 2ft, definitely helping the operations up there. give the snow makers a little bit of a break. so if you're starting that early travel, just be careful of that into the mountains and overall into the bay area. the next couple of days, the peninsula san francisco 50s rain mix of sun and clouds here and there and our inland valleys. also taking a hit with the numbers and the chances of rain. count them one, two, three, four out of the next seven days. mike. oh, my. all right. we can't count these cars because there's so many of them on the bay bridge. things are really bogging down. look, i

checked the chp reports repeatedly. nothing new over on the san francisco side. caltrans registers. no problems or delays or lane restrictions getting into the city. but look how slow this westbound commute is. the backup quickly filled in the toll plaza. we thought maybe those metering lights are slowed down. i think that's the case. so that will be a delay getting all the way into the city and continuing south past the merge with 101 and heading down in through the city, past the skyway and the hospital curve. we're looking at the rest of the bay and everything else looks pretty smooth and predictable. again, the big slowdown is from oakland into san francisco and through the city. back to you. all right. thanks, mike. happening now. help is on the way for domestic violence survivors in san mateo county. supervisors approved a new pilot program which will give victims with children $1,000 a month in support. now, it's limited to 20 eligible individuals. there will be no spending restriction for the recipients. the board says that the group community overcoming relationship abuse will run the program through 2026. the center for women's
