"early today" starts right now. good morning. glad you're with me. i'm frances rivera. there is chaos on the hill a day after congressional leaders agreed on a bipartisan short-term bill to fund the government. president-elect trump is throwing a wrench in the works by publicly coming out against it. republicans have a majority in the house, and mr. trump's opposition makes it far less likely that the bill will pass. without action from congress, a shutdown will happen one minute past midnight on saturday. here's alice barr. >> reporter: in an end-of-year push, lawmakers are scrambling to prevent a government shutdown after midnight friday. a bipartisan agreement now in

jeopardy after president-elect trump and vice president-elect vance put out a statement slamming some of the short-term funding bill's add-ons it includes $100 billion in disaster relief for hurricanes helene and milton along with money to rebuild baltimore's collapsed key bridge. $10 billion to help farmers and a provision that could help lure washington commanders' football back to rfk stadium in d.c. some republicans echoing the president-elect's concerns that too much is crammed into the bill. >> it's bigger than a costco. >> reporter: at the same time, nbc news has learned the house ethics committee has voted to secretly release the results of its investigation into matt gaetz over allegations of sexual misconduct and illicit drug use he's long enied. he pointed out he was never charged after a lengthy justice department investigation and

added, quote, it's embarrassing, though not criminal, that i probably partied, womanized, drank and smoke more than i should have early in my life. i live a different life now. it burst to the forefront when he was named as trump's attorney general. he resigned his house seat to pursue the job, touching off debate whether to publicly reveal the report about a former congressman. gaetz then withdrew his attorney general bid when it became clear he didn't have the votes to be confirmed. lawmakers bracing for a potentially explosive report and racing to keep the govnment open. in washington, alice barr, nbc news. now to breaking news overnight in the ceo murder case. federal prosecutors are now looking into possible charges against suspect luigi mangione, according to two sources familiar with the matter. they also say if federal charges are filed, the charges filed by the manhattan district

attorney's office would have priority. mangione was indicted tuesday on first degree murder in furtherance of terrorism, plus counts of second degree murder and more. a spokesperson for the southern district of new york and the federal prosecutor's office in manhattan declined to comment. also breaking, the fbi has detained a man in san diego in connection with a suspected shooter at a madison, wisconsin school. according to a protective order filed by local police, the fbi stopped the man after learning that he and the alleged shooter spoke online about a gun and bomb attack on an unspecified government building. a judge has since ordered the man to give up his weapons and ammunition. it is unclear what charges he might be facing or whether he is currently in custody. the fbi declined to comment to nbc news' request for comment. meanwhile, police in wisconsin are looking into whether bullying may have played a role in the school shooting,

15-year-old natalie rupnow shot and killed a student monday before turning the gun on herself. two students are still hospitalized in life-threatening condition. top security leaders are putting out a warning about a large-scale chinese hacking operation into u.s. phone calls and texts. it could be a threat to people across the country of the government saying anyone can be a victim. brian cheung looks at how you can protect your devices. >> reporter: a massive ongoing chinese hack of telecom companies that's possibly intercepting phone calls and text messages in the u.s. right now. leading to an unprecedented fbi warning to consumers. the head of homeland security calling the threat in his words very, very serious. >> it's a very sophisticated hack. i can't speak publicly to how it occurred, but the telecom providers are focussed intensely on it. >> reporter: officials from the cyber security and infrastructure security agency or cisa, says americans need to

protect what they say on their phones with encryption. if you're an iphone user texting someone on an android, there's a good chance your messages are unprotected from hackers. the work around, using end-to-end encryption apps like signal or whatsapp. the fbi calling it an espionage campaign. >> this is the most persistent campaign to break in. and it was a matter of time, really. >> reporter: the fbi saying china was possibly listening in on calls from chuck schumer's office in both the trump and harris campaigns. the chinese government denied the accusation. >> phone calls were tapped. text messages were read, voice mails were read as well as call records. >> reporter: verizon said when the hack was revealed it is committed to assisting law enforcement in this investigation. at&t saying it will continue to comply with our obligations to notify affected parties. but most people who had call meta data hacked may not even

know it because the feds or their phone provider haven't told them. cisa says senior government officials are among the highly targeted that should assume their communications are at risk of interception. every day citizens could be exposed too. the advice is to be aware of when your calls or messages are safe and when they're not. when you send an encrypted message to me or vice versa, it goes to the telecom, but it's just gibberish. they'll see something was sent is, maybe, but they won't be able to read it. >> reporter: using signal or whatsapp offs that protection. but, when you're messaging between different types of phones, encrypting is now recommended. if we all use encrypted apps, does that mean we're totally good from future hacks from perhaps the scale of the chinese one? >> as it stands right now, your messages are believed to be safe. >> our thanks to brian for that report.

the supreme court has agreed to hear a challenge to the upcoming tiktok ban. the court, however, will not block the ban in the meantime. it is set to go into effect on january 19th. oral arguments are happening on january 10. and only after that will justices decide whether to put the ban on hold. a bipartisan law requires the app's chinese owner bytedance to sell to an american company or be banned. tiktok says it violates free speech rights. the dow plummeted 1100 points in the red for the tenth day in a row, which is its longest losing streak in 50 years. the nasdaq dropped 716 points. the selloff spurred by the fed. the central bank cut rates by a quarter of a point but signaled it would slow the pace of interest rate cuts next year. the fed chief said the economy is strong overall. but we've been moving sideways

resources to carry them out. our gabe gutierrez got an inside look at one operation far from the southern border. >> reporter: the operation begins before dawn. agents with i.c.e., immigration and customs enforcement, who asked us to conceal their identities gearing up at a parking lot in suburban boston. we're along for the ride. >> we don't do large scale roundups. every individual here today has come to our attention because they've been arrested by a local municipality for felony or egregious crime. >> reporter: so, after several hours of waiting, they've just found one of their targets, and we're on the move. when we arrive, we see an immigrant from the dominican republic who i.c.e. says is here illegally and is a convicted sex ofnder. [speaking in a global language] he tells me he came to the u.s. for a better way of life and denies the charges against him. he's led away in handcuffs. i.c.e. agents have been watching

this particular subject for at least a week. on this day, it took about 16 i.c.e. agents to arrest five immigrants who i.c.e. says are undocumented, have criminal records and had been released on bail by local jurisdictions instead of being turned over to i.c.e. each requiring 40 to 80 hours of surveillance before hand. do you have enough resources to do this? >> no. no, we don't. that's one of the problems that, you know, when jurisdictions don't cooperate with us, we have to go out into the community, which puts our officers at risk. >> reporter: but these are the waning days of the biden administration, president-elect planning to do much more, including mass deportation. and after democratic city and state officials vow to block the deportation plan, tom lman is doubling down. >> i'm c concernedf what a mass deportation would look like. >> reporter: attorney valerie napier is an advocate who says
