charges that he's now facing. >> reporter: i can tell you about that right now, because we have a producer in the courtroom, in the federal courtroom around the corner, there are no cameras in that courtroom, but we are allowed to get information. one thing we know the proceeding has just gotten under way. mangione i should tell you he has traded out his orange prison jump suit and he's now in a pair of tan slacks, a sweater, and a black v-neck sweater to go before the judge, the judge has entered the courtroom and is informing him of the mplaint against him, as you know there are four federal complaints against him, one murder charge for the use of firearms, two stalking accounts. the judge is saying to him, you have the right to your own attorneys, which he does. mangione reaffirmed in the positive yes. as to the charges being filed

against him and to his rights for representation. we thought there would be the case presented on the new york manhattan courtside in this courtroom, instead the charges against him on the federal -- we were expecting there could be federal charges, didn't know that those charges would be brought before him in court. in realtime right now, mangione is in a federal courtroom, in front of a judge, he's being read these complaints against him and responding to them in realtime. ladies, back to you. >> there have been a lot of changes and developments in this story. today it began in pennsylvania, now mangione is in new york, walk us through what happened today. >> reporter: yeah, it's been a very busy day for mangione. as you point out, it was early this morning when he went into a courtroom in pennsylvania, he

quickly waived his right to extradition and then he was transported by car to an airport where he got on a plane for about an hour and a half ride new york. from long island he took a helicopter the helicopter landed in lower manhattan. and it was a different look of mangione. he was clean shaven, looked as though he had a haircut. it was in preparation to face a judge. we thought it was going to be in the manhattan district court. but instead it's the federal court. he has 11 counts against him, if convicted he could the spend the rest of his life in prison. >> thank you. right now, congress is scrambling to come up with a new spending bill to avoid a government shutdown that would happen in less than 36 hours. >> lawmakers were set to vote on

a bipartisan bill yesterday, but president-elect donald trump and elon musk both opposed the deal. forcing house republicans to scrape the plan. no clear plan b unless lawmakers come up with one. the government will shut down tomorrow. garrett, you spoke with president-elect trump today about this looming shutdown, he told you he wants to get rid of the debt ceiling which i understand wasn't initially on the table at all. >> reporter: there are two different sets of complaints about this bill from republicans, from elon musk and some conservatives who believe it's so bloated and spends too much money and for donald trump who believes it doesn't lift or suspend the debt ceiling which he's worried about coming up in the middle of his first year next year when he's trying to pass a host of other things that could democrats some leverage over him. he's okay with the shutdown now on joe biden's watch.

he wants to see this get sorted out by this congress before they go home for the year. >> just to make sure we understand, garrett, so the debt ceiling is this artificial thing that the congress put in place a long time ago and he doesn't want it to be there he wants to spend on things like stopping immigration. >> reporter: the way the debt ceiling has been used by minority party is kind of an opportunity to extract concessions from majority party or from the president over the last couple years. republicans have used it aggressively against democratic presidents. donald trump believes it's not real. it's done almost nothing to constrain spending or lower the debt in its entirety of its history. he rather get rid of it entirely. there's no deadline for this. this isn't anissue for congress until june or july next year. donald trump wants it taken care of now. >> garrett at issue is

on monday. morgan chesky joins us now. morgan, what are authorities about saying this man they detained in california and the possibility that he was communicating with the alleged shooter in wisconsin. >> reporter: yeah, kate, zinhle, certainly a brand-new wrinkle in this ongoing investigation, what we have heard from authorities fbi agents were able to question a 20-year-old man they were able to meet up outside san diego in the last 24 hours or so and they've identified him as alexander palindorff, in this emergency protective order, we learned that this 20-year-old had been communicating with that 15-year-old female gunman in that wisconsin shooting and not only that, contained in this order he admitted to the fbi that he told the 15-year-old he planned to arm himself with

explosives and a gun and then target a government building. was there a specific government building mentioned? we do not know that. but that was at least exchanged between those two individuals. be some sort of communication, although we don't know the duration of time he was communicating with that gunman, 15-year-old female before she went into that high school and opened fire. >> morgan, of course, two lives were lost. the names of the two victims killed on monday. >> reporter: we do. here they are. erin west, 42-year-old teacher of the school and rubi vergara, a 14-year-old student. they're being mourned by that community there. in addition to that, we've learned two others wounded in this shooting are still very much fighting for survival. i'd like to hear from one school official who had this to say. >> you can't believe the horror

holding strikes outside of amazon facilities as the holiday delivery season hits the home stretch. the union is demonstrating in four states, california, illinois. the teamsters want better play and working conditions. amazon said it does not expect it to any impact on its. what is the teamster s union. >> reporter: yeah, the teamsters just wrapped up for the day, we asked them if they have plans to come back tomorrow and they wouldn't tell us just yet. essentially from what i was hearing from them they're asking for better pay and better working conditions. they say they have extremely long days, sometimes they're delivering up to 400 packages in all kinds of different weather conditions and it's very taxing and it takes a toll on their bodies and they feel they should

be compensated fairly and also get better benefits and have some kind of safety programs. they say amazon missed a deadline on december 15th to come to a table to bargain for a new labor contract. amazon is saying none of that is true. they said in statement to us, for more than a year, the teamsters have continued to intentionally misled the public, and this is another attempt to push a false narrative. so the question to a lot of consumers are asking, given we're less than a week away from christmas and hannukah, how is this going to impact the holiday shippingseason, waiting for some packages, right now it's hard to say, the people who are picketing are hoping it may have some trickle-down effect to consumers to get amazon's attention but amazon as you mentioned it will have a minimal impact on it operations. >> thanks so much.

the warehouse, there could be a problem. we will find out soon. this is video from this morning at an amazon warehouse on toland street in san francisco, not far from bayview hunters point, where around 6:00 this morning, members of the teamsters union who work there, they went out on strike. the teamsters union that represents delivery drivers for amazon and workers at amazon facilities and warehouses, says thousands of its members at seven amazon facilities nationwide went on strike this morning. the union authorized a strike earlier this week because it says amazon is refusing to negotiate for a fair contract. that, quote, guarantees the wages, health care and safety for its workers and also says amazon won't recognize them as union employees. and so i know there's a lot of people that might be anxious about their gifts, but i just want to remind everybody it's amazon who is keeping this from happening. all they would have to do is come out to negotiate. they don't have to they don't have to give us a contract today. they just have to tell us when they're going to negotiate. amazon tells the ap that the teamsters delivery drivers are not their

employees, that they work for a third party business that amazon contracts with. in a statement, quote, amazon wrote, the teamsters have continued to intentionally mislead the public, claiming that they represent thousands of amazon employees and drivers. they don't. and this is another attempt to push a false narrative. the teamsters argue that amazon should be classified as their employer, since the e-commerce giant controls everything that their members do. according to the union, an amazon spokesperson tells nbc news, christmas is not getting ruined for anyone because of the strike. if customers are worried, they can track their delivery dates and times o on te amazon website, the company says it does have hundreds of fulfillment centers in the united states, and for some perspective, the teamsters say they represent only about 10,000 workers at amazon. that's just a small fraction of the roughly 1.5 million people who work at amazon facilities throughout the united states. bob redell, nbc bay area news. thank you, bob.

and as that strike begins, another could be coming to an end. hotel workers in san francisco have been striking for nearly three months now, and we just got word marriott workers are voting on a new contract today. the union says that agreement would preserve health insurance. benefits, include raises and provide protections against understaffing. about a thousand workers at hyatt and hilton hotels will remain on strike. don't hang up your political hat just yet. oakland leaders want congresswoman barbara lee to run for mayor of oakland. lee is leaving congress next month after three decadades a state lawmaker and house representative. business owners, union leaders and the current interim mayor, nikki fortunato bas are among those who signed the letter. it reads in part, quote, we need a mayor who can restore the integrity to the office, unite us in a time of division, and address critical issues around the budget, housing, public safety and inequity. residents voted to recall former mayor sheng thao last month. bass will leave her temporary mayoral role for the

appealed to the georgia supreme court. >> danny cevallos. but let's begin with vaughn hillyard in west palm beach, florida, vaughn, the issue that was raised by the appellate is about a conflict of interest between the d.a. and special prosecutor, not the merits of the allegations in this case, how did the court explain the decision? >> reporter: right, there's a disagreement between the initial judge who was overseeing this case and timately determined that willis would be able to say as long as nathan wade, the special prosecutor resigned and left the case, that's what led to the appeal from now president-elect trump's team and this georgia appeals court making the determination that, that the appearance of a conflict of interest was so high and so paramount to this case that it required her to be

dismissed and disqualified from overseeing it. in the appeals court decision, while we recognizing a appearance of improp ryety generally is not enough to -- this can be appealed to the georgia supreme court. so we should note the appeals court made the decision to not toss the indictment in its entirety against donald trump and other defendants, so this case still lives on to a certain extent at least for now. >> danny, let's bring you in, to vaughn's case, this case is not dismissed entirely, what does it mean to donald trump and his co-defendants. >> the case is not dismissed. . the entire d.a.'s office that's prosecuting this case is now kicked off the case, this case while still alive is adrift with

nobody at the helm, yes it's technically, the indictment is still living but who's going to take this up? according to what's been reported a kind of search within georgia to find a prosecutor's office to handle this case. that's had so many problems. it's hard to see this case surviving even though it deck any cally survived. >> vaughn, have we heard any reaction from the president-elect or any of the co-defendants. >> reporter: we've heard the spokesmen from the president-elect who wrote in a statement the american people decided on november 5th that they wanted an end to political weaponization of the government. those were the words of the spokesman indicating that this is another step in what's now several successful legal weeks on the front. not only the doj, the special

counsel dropping its cases of federal election interference and classified documents against donald trump, the new york hush-money trial the sentencing date may be pushed back until after he were to leave office in 2029. this is the latest at the least bit this is going to be a delay of this case proceeding. but potentially this could be the beginning of the end of the fulton county indictment in a trial that never even began against donald trump. >> thank you both. in today's daily health there's growing concern over the spread of bird flu here in the u.s. california governor gavin newsom has declared a state of emergency over the outbreak in cattle there, allowing them to get more resources for it and in louisiana, a person has been hospitalized with a severe case of bird flu, and while most other human cases have involved commercial farm workers the louisiana sere case is the
