today is monday, december 23, 2024. breaking news. bob bombshell report. the house ethics committee finds former congressman matt gaetz committed statutory rape. how gaetz is responding. blake lively lays out explosive allegations against "it ends with us" co-star justin baldoni. how baldoni is responding. tens of millions of americans are dashing out the door. a blast of winter weather could cause some delays from coast to coast. we're tracking what you need to know. that's the spirit, christmas and hanukkah falling on the same day this year. a first in nearly two decades. how the rare overlap is amping up the holiday fun.

we begin this hour, though, with breaking news out of washington. the house ethics committee has released its explosive report on former republican congressman matt gaetz of florida. it cites that gaetz engaged in sexual activity with a 17-year-old girl, possibly violating florida state law. the report also accuses gaetz of regularly paying for sex from 2017 to 2020 and using illegal drugs on multiple occasions. earlier today gaetz attempted to block the report's release by suing the ethics committee. he's denied any wrongdoing. the ethics committee voted to release the report earlier this month. gaetz resigned from congress on november 13th after president-elect donald trump tapped him to be the next attorney general, but you'll remember he withdrew from coideration for the post a week later. joining me now, nbc news correspondent julia ainsley in

washington. julia, there's a lot to digest in this report. what more does it have. >> reporter: investigators followed the money. they found between 2017 and 2020, gaetz paid more than $90,000 to 12 different women. they concluded the payments were likely tied to sexual activity or drug use. the biggest bombshell is he did engage in sexual activity with a 17-year-old girl and his use and possession of illegal drugs. they accused him of using his house account trying to come up with a fake pseudonym to get drugs while he was a congressman and accepting gifts that go over permissible amounts. there's a lot to unpack here. it's a long report, but in short, these are a lot of details we've been hearing about for years. now they're all in one place in writing from a government entity. gaetz was not successful in blocking them from coming out

despite years of back and forth and a last-minute request for a temporary restraining order. >> julia, have we heard any response from gaetz himself and could he now face any new legal trouble because of all these details in the report? >> reporter: well, on the legal trouble, kate, we'll say the doj did decline to bring prosecution. senior doj officials say the house ethics committee is a lower bar. they didn't believe they would be successful in a prosecutor. it was career prosecutors who made the decision not to bring the case. as for gaetz himself, we heard from him today saying that the house ethics committee brought this on christmas eve eve, not allowing him to respond to it in court. >> julia ainsley, thank you so much. the holiday week officials is here. it is off to a bitter cold start for millions in the eastern half of the country. snow and freezing temperatures already caused issues at the

airports and on the roads in the midwest and the northeast over the weekend. since friday more than 26,000 flights have been delayed or canceled. it wasn't any better over the weekend on the rails. a lot of people got stuck waiting for their amtrak trains on sunday after downed power lines caused delays from new york down to washington, d.c. meteorologist bill karins is tracking the winter weather. let's start with nbc news correspondent adrienne broaddus at chicago's o'hare airport. it doesn't look as crowded as i would have thought the day before christmas eve. what are travellers telling you today? what do people need to know? >> reporter: kate, they're saying the same thing. many of the travellers who talked to us this morning saying, hey, i thought it would be busier. one woman showed up three hours before her flight and a woman traveling with two kids told me, i would rather be eaearly than rushing and running through the

airport. what travellers need to know, you still should get to the airport early because we could see delays based on that weather that bill is going to tell us about a little bit later. keep in mind, you will not be alone. tsa says more people are traveling this holiday compared to last year. they're estimating nearly 40 million people will pass through security check points through january 2nd. so travellers who spoke with us say they're more worried about their return trip home. take a listen. >> well, we did arrive three hours early. not that concerned about time, but i mean, definitely the bag -- we were ten pounds overweight. >> living in chicago, it's going to be a mess. i'm hoping everyone that's here gets home safe. i've been stuck on the holidays a couple years ago. i hope everyone makes it home safe. >> reporter: that is the hope,

everyone wants to make it home safely. tsa has added an additional 600 security agents to help handle the holiday surge, kate. >> thank you. bill, i usually get to the airport at the last minute. i've been tellg my kids to get there early. ththere is ow and cold. what's on the west coast as well? >> the west coast will see the worst weather anywhere in the country the next three or four days. we have a storm moving along the coast, bringing rain in as we go throughout the evening. you can see another one coming on to the screen. we have one after another. these are atmospheric river events. they won't be high-level events, but they'll have a good deal of rainfall with them. tomorrow, the cold front moves on shore. the rain comes in tonight and by tomorrow afternoon it moves to the interior. christmas morning we're dry, but

christmas evening that's where the precipitation comes in. traveling interstate 5, definitely weather late in the day on christmas. if there's any chance of isolated flooding, it's through the southern portions of the cascades. snowfall totals will be pretty high. >> does look wet, although the totals are ski resorts. adrienne broaddus, bill karins, thank you both. we are following new fallout from allegations made by one of hollywood's biggest stars. in a newly filed legal complaint, blake lively accuses justin baldoni, her co-star and director of "it ends with us" of sexual harassment. lively alleges baldoni orchestrated a pr effort to destroy her reputation after she expressed concerns. an attorney for justin baldoni denied the allegations, calling

them categorically false. chloe melas has been following all this. she's with me onset. chloe, happy holidays to you. walk us through what lively's alleging in this -- it's not a complaint, it's a precursor. >> this is a story consuming the internet right now and social media. there's really two things that blake is alleging. she says that filming the movie "it ends with us" was a nightmare. she claims that justin baldoni improvised kissing scenes, that he walked into her trailer while she was changing, that at one point he and a producer pressured her to do a full frontal nudity scene and it wasn't the project she signed up for. she says in this complaint that they actually had an all hands on deck meeting that her husband ryan reynolds was present for and an intimacy coordinator was hired. justin baldoni and his team said

we don't agree with the allegations you're making, but we want a safe celt. his team is denying these allegations and saying it's a cherry picked version of events and it never happened. in this complaint there are shocking text messes between publicists working for justin baldoni at the time that talk about wanting to bury blake lively and do a smear campaign against her because baldoni was worried that blake was going to go public with her allegations about what happened onset and they wanted to beat her to the punch. again, justin baldoni and the pr team are saying, we might have had conversations behind the scenes, but we never engaged in any attempt. that was the internet doing the internet's thing. we didn't have anything to do with that. as you can see, both sides have very different stories right now. >> night and day. his team saying we deny all the allegations as well. what are other people saying? the author of the book that the movie was based on has spoken.

>> colleen hoover is picking a side and that's blake lively's. she said she always enjoyed working with blake. "the sisterhood of the traveling pants," her co-stars putting out a statement saying they knew about the issues blake was having because blake was telling them and they fully support blake. again, justin baldoni very popular guy, very popular podcast. you would expect he's going to share more of what he claims happened onset. >> all right, chloe melas, thank you. time for today's cnbc money minute. honda and nissan talking about merging and "sonic the hedgehog" is the box office champ. julia borstein joins us now.

>> reporter: let's start with honda and nissan. they started discussing a merger. leaders from the two companies say they need greater scale to compete in new development for electric vehicles and intelligent driving amid threats from tesla and chinese companies. discussions are likely to end in june of next year and the two brands hope to complete the merger in august of 2026. also, telegram is set to be profitable for the first time according to a "new york times" report. the app has been subject to intense scrutiny over its privacy and lack of moderation. the founder was arrested in france last year for allegedly allowing criminal activity on the platform. "sonic the hedgehog" movie took the top spot at the box office. the ramount movie debuted with $62 million in sales beating "mufasa." the two previous sonic movies together made more than $700 million worldwide. a fourth in the series is in development. back to you. >> julia borstein, thank you.

has pleaded not guilty to state charges against him. 26-year-old luigi mangione walked into the manhattan supreme court this morning for an arraignment. mangione's state charges including first degree murder. he made his initial court appearance last week to face federal charges. nbc news legal analyst danny cevallos is in studio. let's start with steven romo in manhattan. there were protesters outside court supporting mangione. what was their message and what happened inside court today? >> reporter: yeah, kate, a huge crowd of protesters, supporters of mangione were out here with signs and noise makers. they were chanting things like eat the rich, free luigi, health care for all. really trying to get their voices heard. meanwhile, it was the flip side of publicity talked about inside the courtroom today. namely, mangione's attorneys

were talking about some potential prejudice that the jury could have after seeing some of the images that we've seen of mangione being escorted by these heavily-armed guards. we see him here surrounded by several officers today in the courthouse. it's this video that she was referencing there, when he first arrived to new york surrounded by heavily-armed officers, nypd and federal. the mayor was there as well. she said it's absolutely unnecessary. she blamed this on the mayor. the mayor said he's trying to show that violence is not welcome in the city. the judge saying he has little control of what happens outside the courtroom. kate? >> thank you. danny, his attorney suggested he's been overcharged. what's the argument? >> it's an interesting argument. i see her point. on the state class, second degree murder is general murder.

terrorism is a stretch. courts id incidents that cause fear are not enough for terrorism. then you have to ask does the federal really need to charge him? they have an internal policy that says unless there's substantial federal interest, they shouldn't add on. it's not enforceable by a defendant. they can break that rule if they want. they're the government. >> danny cevallos, steven romo. thank you. officials in texas are investigating a chaotic scene over the weekend where a driver crashed into a mall. this happened saturday in kaline, texas. police say officers shot and killed a man after he drove his pick-up truck into that jcpenney store. joining me now nbc correspondent jesse kirsch.

this started with a police chase. how did it end up with a pick-up truck going into a mall and shots s fired by officers? >> reporter: authorities tell us they received a report from someone on a roadway, someone driving erratically. police tried to pull someone over for a possible dwi. we're told that allegedly sped up and drove into a mall parking lot and drove into a doors of that jcpenney. glass according to authorities the individual continued to drive for several hundred yards and in the process struck multiple people ranging from children to those in their 70s. at least one person in their 70s. the injuries minor to severe. thankfully none of these innocent bystanders were killed. authorities seeing this driver continuing through the store opened fire. multiple officers shooting at the individual who we're told was killed in the midst of this.

arrested 42 year old tristan arfi last month. he runs wahab fitness gym in downtown san jose. prosecutors say he touched two of his female clients inappropriately during massages, and he attempted to extort an employee, demanding she send him nude pictures of herself. prosecutors also note that arfi is a convicted sex offender. in 2019, he was found guilty of lewd acts against a minor. holidays are almost here and so is some stormy weather, and that is creating dangerous conditions near the coast. here's meteorologist kari hall with the details. as the storm system approaches, we will have a high surf warning in effect, as well as a coastal flood warning. some of those waves may possibly reach over 30ft, and that will create some flooding for those coastal areas. we'll also have a slight chance of showers today, with a stronger storm system coming in tonight into early tomorrow morning, but overall, it looks like it's going to be a cloudy day. jusust peeksf

the ocean. honestly, just seeing people getting soaked out in the streets sometimes that's one. do you think a lot of people don't realize? i know, so i've seen it for years. the fountains have stayed dry but empty handed. danielle fallon and his twin sons drove from lathrop in hopes of catching crab off the end of the pier. unfortunately, the gate was closed. yeah, so? so what? now we're just enjoying the waves. i guess a little bit. we're probably going to try to find somewhere else to fish. it's just fun, you know, spending time with my family. yeah. yeah. nothing better. thank you. bob. bay area travelers hoping for a stress free holiday season. but the weather might have other plans. bay area airports had a busy weekend, and fortunately, few cancellations. but airlines expect the busiest days are still ahead. just as the next storm system passes through. triple a also predicts a record 119 million people will drive 50 plus miles from now until new year's day. chp says bay area drivers may want to plan for slick roads when more rain arrives later this week. the

additional travel that we're we're going to see, and we are currently seeing and adding in storms and things like that. it's going to be very busy for us. the chp will also be out in full force starting tomorrow, with more officers on the roadways between christmas eve and new year's day. well, grinch in san francisco is getting in the way of the holiday spirit and the salvation army's christmas deliveries. a thief stole two car batteries from delivery trucks early this morning. both were parked in a gated lot. the salvation army says it discovered the batteries were missing when volunteers went to start the trucks this morning, and nothing happened. they are working to get replacements in time for christmas day. you know, we've got great folks, good volunteers, good staff who are able to help, you know, make, make us get across the finish line. but it slowed things down more than anything. it's just disheartening to know that folks would would try and steal from an organization that's trying to do so many great things, especially at this time of year, for sure. volunteer delivery drivers are needed to deliver meals to seniors across the

woods, made his first ever hole in one. he did it playing alongside his father at the pnc championship in florida. the tournament is an annual two-person competition for pro golfers and their sons. tiger and charlie woods finished as runners up. people on hawaii's big island are on high alert after a volcano started to erupt. it's one of the most active volcanos in the world. it's closed to public. scientists say the lava is flowing rapidly. the big concerns right now are around the carbon dioxide in the gas which can pose serious health risks for people. president biden has commuted the death sentences of 37 inmates, leaving only 3 people on death row in federal prisons. according to the white house the commuted sentences will be reclassified to life sentences without parole.

the president said, quote, i'm more convinced now than ever we must stop the use of the death penalty on the federal level. of the three inmates still on federal death row, two are mass shooters and the third is one of the 2013 boston marathon bombers. a scary situation for nearly 200 skiers and snowboarders at a colorado ski resort. adrienne broaddus has the story. >> it was pretty scary.

>> so many what ifs going through your mind i would imagine? >> and pretty nervous about it. >> reporter: the ski patrol was ready. >> you're going to use the rope we have here. >> reporter: one by one lowering each person with ropes. a spokesperson for winter park confirms there were no injuries, but says this crack caused the lift to malfunction. it remains closed. the carr family shaken, but back on the slopes. >> there's no way i'll take a gondola for a long time. >> reporter: adrienne broaddus, nbc news. a light show that was meant to be full of family fun turned into horror in orlando after multiple drones fell from the sky. a young boy remains in the hospital after being hit. morgan chesky has more.

>> reporter: we've learned the city canceled a second planned drone event after the first one clearly went off the rails. a 7-year-old boy hospitalized after getting hit by a drone at a light show in florida. the scary incident captured in this video you're seeing on your screen right now. according to the faa, several drones collided in the air and you see them. city officials say paramedics provided aid to an injured individual on scene.

the mother spoke to our affiliate in orlando and described what happened the moment that the drone impacted her son. >> my daughter found my son on the floor unconscious. the drone hit him so hard in his chest that it messed up one of the valves in his heart. >> reporter: the faa is investigating what caused the drone disaster. the city of orlando releasing a statement writing, our thoughts are with the family and all those impacted. the vendor behind the drone show, sky elements, writing the well being of our audience is our utmost priority. we regret any inconvenience caused. a worried mother is now hoping for a christmas miracle. >> this should not happen. no family should be going through this off trying to watch a show and have a good time. >> reporter: sky elements said, quote, it's working diligently with the faa to investigate the cause. among two of the key pieces of

they say it's working with package thefts down 22% this month. >> the items that they usually steal will be just about anything. >> reporter: lieutenant fred kazata is one of the city's officers cracking down on holiday thefts. >> they'll target whatever they believe is the easiest target. whether it's a quiet area or a busy area and they won't be noticed. >> what's the most common excuse you'll hear when you catch porch pirates? >> they'll try to say, they made a mistake, they changed their delivery location to there. a lot say, i'll give it back, i'll give it back. it's obviously too late at that point. >> reporter: according to a new report from security.org, one in four americans have had a package stolen by porch pirates. to fight back, yonkers police are using decoy packages and they say it's working with package thefts down 22% this month. so, here's how it goes. police place a gps tracker in a normal shipping box, with a high-value item, like an iphone. but the iphone box is empty. with the help of homeowners, the

for mental health. that's finding a therapist or psychologist in your insurance network. according to a new survey, a third of the psychologists surveyed are not accepting any form of health insurance. it's not because they don't want to, but because the barriers they face when they're trying to work with insurance companies. joining me now is the american psychological association senior practice. what are the hurdles people are talking about? >> when we asked psychologists there were two main reasons people weren't accepting insurance anymore. one, they felt like reimbursement rates were really low and not keeping cost with the pace of doing business.

two, it felt like the at administrative hassles were greater and greater with each passing year. some hassles are things we're all familiar with, preauthorizations or denials of care. >> i've experienced this. every behavioral health specialist in the new york area is out of network. is that just a big city thing or nationwide? >> i wish it were just a big city thing. we're seeing it everywhere, cities, rural areas as well. i want to stress, this is not an issue that there aren't enough mental health providers. if people can afford to pay out of pocket, they can find somebody. it's really finding providers that are taking your insurance or in network. >> there's the rub. the demand for mental health

treatment is going up. more than half of psychologists are not taking more patients. are you worried people are giving up because they cannot afford it? >> we absolutely worry about that. psychologists want to take insurance. we want to work with everyone. we don't want people delaying care. i think all of us can relate. you're trying to find someone in network. you call office after office and either people are not accepting your insurance, the list on your insurance website was not updated, somebody retired, the list isn't current. these are the hassles people are facing. >> if someone is looking for maemt treatment and running into barriers, what do you suggest? >> there's a few things you can do. if you're having trouble finding someone in network, reach out to your insurance company. they will also try to find you someone in network. what a lot of people don't know
