6:00 am
right now at 6:00. the battle for the gavel. mike johnson, facing an election today to remain hououse speaker. we're le with why? it could mean an uphill battle despite a republican majority. plus, i did not want to be one of them parents. they called me to. to bury my baby. i that's what i don't that's what i really want to see. honoring victims and survivors. ahead, we hear from the victims families who are still coming to terms with their tragic loss. following the deadly new year's attack in new orleans also, sounds of explosions rocked an east bay neighborhood. the close call after a gas station goes up in flames. this is today in the bay. well, good morning everyone. very good friday to you. i'm scott mcgrew. marcus has the day off and i'm laura
6:01 am
garcia. let's start out with a look at the forecast. cinthia pimentel i was going to say you usually bring the sunshine, but not today. and it's not your fault. you know, i if i could bring the sunshine every day, i would. you do, you do anyway i bring the rain, which is not bad. i mean, we need it. of course. it always adds up to our totals. we see it already raining through the north bay, east bay and the peninsula, so it is a slick commute for people driving around parts of richmond, concord, approaching that line there through danville and hayward. the bay bridge i showed you moments ago is looking soggy right now up into the north bay to we see a little bit heavier line of showers through parts of healdsburg, out towards guerneville and out towards the coast of marin county. the rest of us are still staying dry from fremont down into san jose and los gatos, but that will change as the morning goes on. it will be raining and get some breezy winds in there, but not all day long. i'll give you that outlook. we'll also talk about what's going on with the sierra and the winter storm. the best timing to get you up there to enjoy the fresh powder
6:02 am
that's coming down. but into next week, prepare to get out that those sunglasses and the short sleeves. i am looking at a drying and warming trend. we'll talk about it coming up. all right. well, new year, new congress, busy january ahead. house republicans must first elect a speaker. the man who currently holds that position, mike johnson, may have to fight to hold on to that position today in the bay's chris pallone joins us live from washiton. chris, speakership battle comes as washington is really preparing for a lot of high security events. yeah, scott, it's going to be a big month here in washington. there's already fencing up around the capitol behind me. you know, the current house speaker, mike johnson, is projecting confidence that at the end of today, he will be the house speaker again for the new congress. but his reelection is anything but guaranteed a new congress in the new year. and house republicans are hoping to avoid a repeat of what happened two years ago. a speaker has not been elected when he took 15
6:03 am
votes over four days to hand kevin mccarthy the gavel, the current speaker, mike johnson, can afford to lose just one republican vote and still win a majority. it's a numbers game. we have the smallest margin in u.s. history. we'll have a margin of probably two votes tomorrow during that, so can only afford to lose 1 or 2. but i think we'll get it done. but several republicans have expressed doubts about johnson's leadership. i remain undecided, as do a number of my colleagues, because we saw so many of the failures criticizing johnson for cooperating with democrats to pass key bills as factions of republicans fought over spending and aid to ukraine. at least one republican, thomas massie of kentucky, is already on the record. oh, no. you can pull all my fingernails out. you can shove bamboo up in them. you can start cutting off my fingers. i am not voting for mike johnson, but johnson has one key backer to get a successful vote. he's a good man. he's a very he's a wonderful person and that's what you need. the contentious transition is playing out as
6:04 am
washington braces for several high profile events that could strain security efforts, including the january 6th vote certification, the funeral for former president jimmy carter, and the inauguration of donald trump. now, the house does have a few days to get this done, but if there is no speaker in place on monday, that would delay the certification of the november election, the election of donald trump, and could push back the timeline for the transition of power. scott. all right. ironic. well, chris, if not mike johnson, who are they thinking? it's hard to say because no names have been floated as an alternative candidate per se. you saw thomas massie in the piece there saying he would never vote for johnson. he says he knows who he's going to vote for, and it is a current member of the house, but he has not said who that is just, you know, among speculation, people have said maybe ohio's jim jordan, who is created the freedom caucus. and h heas put up when
6:05 am
kevin mccarthy was struggling two years ago. but there's no consensus here on the hill that there's an alternative candidate that would get everyone to coalesce. it's more likely than not that johnson is going to get it. the question is, how long is it going to take a nail biter? all right, chris, thank you. 604 right now, the investigation continues in new orleans after the deadly new year's day terror attack in the french quarter. the man who investigators say plowed into the crowd with a truck was an army veteran employed by deloitte. the attack killed 14 people and injured 30 high school friends of the suspect, shamshuddin jabbar, described him as a quiet student with a bright disposition. it's a far cry from the man police now say was a supporter of isis. this morning, for the first time since the tragedy, we're hearing from family members of the victims, the family of tiger bakht and 13 other victims are struggling with a profound sense of loss right now. beck was just 27 years old when he was killed
6:06 am
during that deadly attack. his family, now reflecting on his life, cut too short. he's been a shining star, a bright boy, a clever boy. he was my role model, my whole family's role model, our inspiration. and now everything we do will be for him and through him. the fbi has now posted fliers like this one throughout the city, featuring two images of the suspect. a little more than an hour before the attack, as well as a picture of one of the coolers that had an ied in it, which he placed in the french quarter. they want to talk to anyone who may have seen either he or that cooler. investigators are now sure the cybertruck explosion in las vegas is not connected to new orleans. we know more about that cybertruck driver as well. police say they found military id card and passport belonging to matthew lyles burger of colorado springs, in the truck's wreckage. he was an active duty special forces soldier. however, investigators can't say for sure
6:07 am
the body inside the truck matches the id until dna evidence comes back. lyles burgers motive remains unclear. seven other people suffered minor injuries in the blast. across the country. police departments are looking to up their security here in the bay area. there were two large events in san francisco yesterday the warriors game at chase center and first thursday, a street event downtown. a spokesperson for the san francisco police department says they were in close communication with state and federal authorities about any threats. incoming mayor daniel danielle lurie creating a new city hall position to address safety issues. retired sfpd commander paul yep will become the city's chief of public security. we need to step up our game. what we learned from incidents like that are kind of new tactics that terrorists use, and we incorporate those into our game plan. yep. we'll oversee eight

power to the business had also been shut off. the food mart owner says he's had the business since 2023, and believes the fire started at a separate auto repair shop, which he does not own. mechanic shop everywhere is oil. you know, the floor, the walls and everywhere is oil for now. as i see, everything is gone. he says he plans to work with his insurance company and the city of antioch to figure out if a rebuild is possible. we reached out to the owners of andy's auto repair, but we did not hear back. it is 609 on your friday morning. taking a live look outside downtown san jose. christmas in the park is still up for you to enjoy. maybe bring an umbrella if you're headed out there today. cinthia pimentel is in for kari, and she's got a look at our forecast. it's sad to see that they took down the rides, though, by the museum. what a beautiful event. everything has to come to an end. it does. but the rain. not right now in mill valley. it is still going. we are going to keep an eye on it as we go on
6:10 am
into the middle part of the morning. could get some heavier downpours before it starts to clear out. i'd say right around noon. we'll continue to watch that, of course, as we go on into our midday show towards gilroy and the south bay. it's going to take a little while for that rain to get here. we'll say maybe nine, nine, 30 and then continuing into our lunchtime hour where we could see those heavier showers right there around 1:00 this afternoon. but then into the evening time, we do go into drying mode and the weekend too, and even into next week. so i think you'll like the 7-day forecast. i'll be back with that in just a few minutes. back to you. sounds good. all right. is siri spying on you? still ahead on today in the bay. the amomount iphe owners could get after apple settles a suit over privacy. and the way apple is responding to that settlement. now to the futures this morning. we've had a good string in the green lights. continue. and we're certainly cruising into 2025. coming up, the new features set to make waves on board some of the most popular cruise lines in the new year. stay with us. you're

get a little bit of some more rainfall right there through santa rosa. could be that heavy cell approaching into petaluma, too. and parts of novato. we go down and check along 280 down approaching the south bay. some light rain right now through parts of stanford, los gatos, and just making a little bit of an approach right there as we go on into parts of milpitas and san jose, we will all get some of that beneficial rain as we go on into the next couple of hours. still keeping it pretty heavy through the north bay until about 8:00 and then into the mid morning hours, pushing east into parts of the tri-valley parts of the peninsula also getting wet, and our lunchtime hour down here in the south bay also looks like you want to keep that indoors, but then you can go outdoors. as we go on into the afternoon, i am looking at those skies starting to clear. we will go into drying mode. just be careful. maybe a shower or two that decides to stray right around dinner time for the north bay. how much rain are we talking about really keeping those higher totals up there for parts of mill valley? napa

looking at about half an inch there for the region, everybody else, maybe a quarter if we do get lucky with this storm system up into the sierra, i mentioned that there is a small window to get up there, because those alerts start to go into effect around 7:00 this morning and continue until later tonight. so maybe your better bet is to wait it out until tomorrow. we are looking at 1 to 4in lake level, higher totals up into the peaks, maybe about a foot with those gusty winds that could be howling at around 100 miles an hour. so be careful with that. practice putting on the chains before you head up there. now as we go on and take a look. long range into the weekend, those showers will continue for the pacific northwest as if they needed more, and then we go on and actually dry things out out west into next week, our first full week back to school and to work and into our routines. i said, you might like that 7-day forecast. and here's why. san jose over the next couple of days, hopefully this does verify because we go on into those mid to upper 60s starting on monday, and then maybe getting into

bay. good friday morning to you. 630 right now. thanks for starting your day with us. i'm laura garcia. and i'm scott mcgrew. marcus has this friday off. let's get a look at the forecast. cinthia pimentel with a look ahead at the weekend. we're looking at santa rosa right now. it is slippery, and i know it's the new year's. and people want to get that exercise. but today, it's going to have to be indoors at the gym, at least for the next couple of hours. we go on and take a look at the rain line together. it will still be raining up there in the north bay around eight 9:00, and then pushing on into the east bay. i'd say for our lunchtime hour and really much out of here as we go on into the evening, so that will look good to get the weekend started. first one of the new year. we'll be here to talk about that. and of course some weekend events going on back to you. all right. thank you very much. well, breaking news, the u.s. surgeon general is raising an alarm about the link between drinking and cancer. he released an advisory within the last two hours. it says the more alcohol consumed,

city of san francisco. and that is going the opposite direction of where it wants to be. the goal of vision zero sf has been to eliminate all traffic death that goal marked ten years last year, and it's going the opposite way. now, the city ended the year with several crashes, including a deadly car crash on crossover drive that's in golden gate park, crossed over connects park presidio and 19th avenue here in the city, which is a pretty major street or thoroughfare. police say it was a single car crash and a car caught fire. one person died from that crash, but it was a fatal car crash that killed a family of four in san francisco's west portal neighborhood that marked 2024. mary fong lieu faces felony vehicular manslaughter charges in connection to that crash. it happened at a bus stop at harbor and lennox way back in march of last year. a mother, a two year old boy and an infant all died as a result. lao's next court

date is set for later this month. now, california is looking to change the course of traffic fatalities. ab six. 45 recognizes that speed is a major factor in these traffic collisions that result in injuries or fatalities. now, as such, the bill legalizes surveillance cameras to help catch speeding drivers. there's a five year pilot program that says it will install cameras in six cities, including san francisco. the pilot program also includes san jose and oakland. and that will or that has been authorized to run through january 2032. hopefully, scott will see things going in the right direction with more tools at hand. we're live in san francisco, ginger conejero saab. today in the bay. yeah, we certainly hope so. all right, ginger, thank you. we are just getting word this morning that president joe biden and his wife will visit the tragic site in new orleans, where so many were killed on new year's day. this

as the fbi continues to investigate this attack on bourbon street. at least 15 people were killed, dozens of others hurt. the suspect in the attack has been identified as 42 year old shamsuddin jabar from texas. according to the fbi, jabar also placed two explosive devices in coolers near the scene of the attack. he died after and getting into a shootout with police. one witness, who broke his legs afte the truck knocked him to the ground. cops are looking at me and i know at this time that they were looking at me because i was still alive and they weren't worried. they knew i was still alive. so i'm screaming. and finally somebody came over to me and just looked at me and said, listen, we know you're hurt, but you're alive. that's what they said to me. you're alive. authorities now searching jabar houston home, as well as the residence where he stayed in new orleans. they have located three cell phones and laptops.
6:36 am
he was an army veteran who at one point deployed to afghanistan. he recently posted videos expressing his desire to kill and his inspiration from isis. jabar also appeared to struggle financially, going through a divorce several years ago. the younger brother of jabar is speaking out following the tragic incident, saying he is shocked. it was is a tragedy and you know, to understand that we're all grieving about this. this wasn't the man i knew. this wasn't the father of the son that i knew, and that also this isn't any representation of al islam or muslims or the muslim community. the family says jabar was raised christian but converted to islam and recently had been barred by his ex-wife from spending time with their two daughters after acting erratically. the fbi says jabar claimed to have joined isis
6:37 am
before the summer of 2024. we have a live look along bourbon street, which is now back open. this comes as tens of thousands descended on the superdome to witness college football's sugar bowl yesterday. all of this happening under the shadow of a massive police presence following the attack in new orleans. there's growing concerns about security really across the country. joining us now live this morning is michael linenger. he's a local security consultant. he's got decades of experience also with 28 years with the san jose police department. mike, good to see you. thanks so much for joining us this morning. let's talk. you know, so many people are asking the question, if better security could have played a little role here in helping to stop these attacks in new orleans. i know that they had bollards. i guess they're working on it for the super bowl. but what really could have been done, if anything? well, the bollards weren't present and those definitely would have helped. absent that, large equipment can be used literally. dump trucks,
6:38 am
busses, garbage trucks could have been placed there. instead, they chose to place parked police vehicles. and in the video, shockingly, you can see the suspect simply driving around those police vehicles and going on to the rampage that he committed. so there were, i believe, there were substantially more that could have and should have been done in the new orleans incident. yeah. and no doubt, i mean, we can all learn something from this event, i would imagine. things are certainly going to change in a lot of areas where you're going to get dense packs of people as well. they should. you know, this is a very sad reminder that these events are, well, public events are here to stay. and sadly, active shooter events appear to be here to stay as well. so it's important for communities across the country to partner with law and law enforcement to make sure their operational plans are up to date, that they've taken every opportunity to negate entry to
6:39 am
suspects of this type. you know, unfortunately, you cannot prevent pedestrians from entering scenes like this at if you've gone to a 49ers game or any other professional sports game, you've seen that they've minimized that threat substantially with metal detectors. it's very difficult to get in. you won't get in without a ticket. and this particular instance, it was an event open to the public. however, it's my opinion that security was woefully inadequate and it allowed the vehicular traffic. i'm not saying that he wouldn't have gotten in on his own. i believe he had a plan b, if you will, and that was to open fire to use the ieds he had planted. however, he was simply able to just drive into the crime scene. very, very tragic day. yeah, completely. and of course, you know, concerns across the country for security. there are so many outdoor events and venues, and you want people to continue to be able to live life. you know, the super bowl is coming up here in the bay area as well in 2026. and i know

they really go into big preparations for that when it comes to security. absolutely. and i think that may have been part of the problem is they focused their energy on upcoming events instead of the event at hand. you know, if you if you want to see how it's done correctly, go to go to levi's stadium and go to a 49ers game or any other event there. you'll see large equipment blocking driveways and possible pathways. you're not getting into that stadium without being carefully checked. you will notice that a distinct difference law enforcement will absolutely increase their presence. they'll be better partnerships with the feds, and it's critical to stay on top of homeland security intelligence. so all these things will come together at these major events, and i believe they will be safe to attend. however, there's always a risk at any large event, and i would just consider everyone to go to these events, enjoy themselves. but just just take a brief moment to take a look around and ask the what if question, how would i get out of here? just take a couple seconds
6:41 am
and then go enjoy yourself. unfortunately, this event, this guy was coming at him at a substantial rate of speed. it was heavily crowded. there was nowhere for them to go, nor would they have anticipated a vehicle in that area. so i think things will improve. they have to improve. and there's also a mental health aspect to this that has to be addressed at some point as well. you're right on so many ways. all right, mike, so much. thanks so much for joining us this morning. a pleasure having you. and we of course, will continue to bring you updates as we get them as this investigation continues to unfold in new orleans when we're not on the air. you can get the latest information on our website, nbcbayarea.com, or by downloading our free nbc bay area app. 641 this morning, the santa cruz wharf will partially reopen tomorrow, far earlier than originally thought. this comes after a section collapsed into the ocean last week during a storm. 17 businesses have been closed since then. originally, the city said it could take weeks, if not months to partially reopen the wharf, but

correct. good morning to you, laura and scott at 9:00 this morning. so just over a couple of hours from now in the building behind me, that's the hall of justice, santa clara county superior court. that's where a judge will hold a hearing to release where the lawyer for dana stubblefield will ask the judge to release his client from prison. this after last week, a california appellate court overturned the 2020 rape conviction of stubblefield, who, as you mentioned, used to be a defensive tackle for the san francisco 49ers and the then oakland raiders in july of 2020. stubblefield was sentenced to 15 years to life in prison after being convicted of raping a woman who was interviewing for a babysitting job at his morgan hill home. the california appellate court determined that stubblefield did not get a fair trial, and prosecutors violated the 2020 racial justice act by making him making racially biased comments about him being black. now, the woman claims that stubblefield used a gun, but police never searched the house for that gun. prosecutors
6:49 am
say the home wasn't searched, in part because stubblefield was a famous, quote, black man on trial during the george floyd protests. here was stubblefield attorney last week after the court overturned his client's conviction. was it long overdue? it was. are we thankful? yes. or did we expect it? we absolutely expected this case to be overturned. the court did not say mr. stubblefield was innocent, only that he did not get a fair trial due to the violation of the racial justice act. stubblefield's attorneys say they are also going to try to get the case against their client completely dismissed. again, the hearing to release stubblefield takes place here at the hall of justice behind me at 9:00. reporting live here in san jose, bob redell. today in the bay. all right, bob, thank you. well, now to a live look in san francisco, where mayor elect daniel lurie is going to plan a weekend of service leading up to his inauguration day tomorrow. he'll do several neighborhood

6:52 am
detected now into san jose. so this storm is pushing on here as we go on and we'll track it together. we will see those showers continuing through mid morning. north bay finally gets a break around lunchtime, but it is the rest of the bay that is still going to be looking at that wet lunchtime hour, but then into dinner time i see it clearing. maybe we even get a rainbow or two in here as we go on into clear mode later on this afternoon. if you get any pictures, make sure to share it with us. listen, that will be all about the rain for now because we go on and take a look into next week. already jumping back into our routines, we will see a warmer west coast bumping up those numbers and then the east and the south. we could be looking at some snow stretching further south as we get into some cold arctic air. so if you have any friends or family members out that way, give them a call. that's some really cold air is coming. let's go up to the north bay. calistoga. finally getting a break from the rain. we go on and see those warmer temperatures. as i was talking about into the middle part of the week, upper 60s, 68, maybe on thursday. so we'll see how these numbers verify as the
