cynthia. good morning kira. good morning eveone. we are starting off with some low clouds and fog there as we saw through san jose, but it's dry as we go on throughout the morning, we'll notice some of those high clouds lingering as the system from yesterday makes its exit, and that's leaving behind some cold air. so really, across the map, nobody is going to break out of those upper 50s. as we go on into the first afternoon of our first weekend here of the new year. don't worry, it gets a little bit warmer as we go on into our sunday plans, and that will continue into our nextull workweek here. back to school and back to work. i'll tell you why. i'm also watching the wind coming up in my full forecast in about 15 minutes here. all right, cynthia, thanks. we begin with this breaking news. we are following out of the east bay. there is a heavy police presence in the area of macarthur boulevard at 66th avenue. you can see about a dozen police cars there. that's along the eastern edge of evergreen cemetery. opd police officers have been on scene since about 5

a.m, and we have just learned that about an hour ago, they brought in an armored vehicle. we've reached out to opd. we will continue to follow this story and get more information to you. in other news happening today, the santa cruz wharf will partially reopen much earlier than originally thought. it's been less than two weeks since powerful waves took down 150ft of the end of the wharf, sending it collapsing into the ocean below. today, in the bay's jocelyn moran tells us there's mixed reaction to the wharf reopening so soon. the city says it'safe for people to get back on the wharf. in fact, business owners have been getting ready to reopen, but residents and visitors say they don't feel comfortable quite yet. it's been almost two weeks since disaster struck, sending a part of the santa cruz wharf into the ocean for business owners on the wharf. it's been a long two weeks of missed revenue, and for employees, it's meant no work. a

lot of them have kids, rent and all that, and that has to be paid. so i know they're really happy to be going back to work. lance haggard has felt the impact. he manages fire fish and grill, woody's cafe and gilbert's gift shop. yesterday was just about going and throwing away everything in the restaurant, and today it was kind of going back and making all the sauces, making everything we need to get ready, cleaning the restaurant a little bit. and lance says he feels safe getting back on the wharf. i think that the city did what they did to make it safe for us. there was no way they were going to open it. if they felt that it was going to put anyone in danger. some visitors worry it may be too soon. do you think you may feel comfortable walking on the wharf? sure. i don't know. maybe with a life jacket. what kind of measures do they inspect it with? and whether this quick after that? whether they know the rest isn't going to fall. the city says the wharf has been deemed safe to reopen based on a recently completed sonar and engineering assessment completed by moffatt and nichol. in a press release, santa cruz

parks and recreation director says, quote. moffatt and nichol did not observe any damage to the wharf structure capacity beyond the area affected by storm damage, and noted that it has the same strength it did before the storm. i'm a little apprehensive about opening so soon. you know, i hope that they've done what they can to safeguard, you know, do the safety measures and make sure it's safe for everybody. i'm kind of nervous. i mean, i'm obviously they're not going to open it unless it's safe. but still the previous, the previous things that have happened, i'm not not too excited to walk at the end of the wharf and visit, visit the seals like i used to do. the city of santa cruz is holding a ceremony where city leaders are set to speak more on its reopening in santa cruz. jocelyn moran, nbc, bay area news. the embattled sheriff of san mateo county is striking back at the county that's trying to oust her. sheriff cristina corpus has filed a $10 million

claim against san mateo county back in november. you may recall the county released an independent report that accused sheriff corpus of workplace misconduct. it suggested corpus fostered a culture of fear and retaliation, and that the sheriff may have had a romantic relationship with her chief of staff. sheriff corpus has denied all accusations against her. her attorney says the report was biased and part of a, quote, evil scheme to force her out of office. corpus, his legal team, also alleges she's been targeted because she is the county's first latina sheriff. in march, san mateo county voters will decide in a special election whether to grant authority to the board of supervisors to remove an elected sheriff and across the bay to the embattled antioch police department. the feds are now stepping in to help straighten things out. this federal oversight stems from racist text messaging scandals, which had involved numerous antioch police officers. the

city of antioch has agreed to a 25 page settlement with the u.s. attorney's office within the guidelines. antioch will hire an outside expert consultant to review policies, procedures and training that needs to happen within the next 90 days. antioch also must hire a community engagement liaison. every complaint of officer misconduct will be investigated. we're committed to making sure that police officers don't based on race, and we are. we will use the resources that we have and the legal tools at our disposal to make sure that those who do are held accountable. antioch's new mayor says the city is committed to the reforms, saying in part, quote, this five year settlement agreement reflects our commitment to addressing unacceptable actions and past failures. oakland is facing a massive, nearly $130 million budget deficit, and so the city is making some big cuts

everywhere. that includes closing two fire stations at least for six months. station 25 near joaquin miller park and station 28 near chabot golf. both will be shuttered. station 21 in the middle there will cover for both of those stations while they're closed today in the bay's emma goss explains. oakland's fire chief said data helped the department determine which fire station closures would have the least impact. still, residents who live near one of the stations tell me they're concerned what it could mean for their safety. when emily margolis family moved into their oakland hills home two years ago, the fact that fire station 28 was across the street was a big draw. we know that there is a major wildfire risk being up in the hills, but we felt more safe and comfortable knowing that there was a fire station across the street. that risk feels heightened for her now that the station on grass valley road is closing for the next six months. it's a huge negative for us and for everyone

in the neighborhood. thankfully, she's yet to have a major emergency requiring the fire department. the announced closure of the station on grass valley road, along with station 25 near joaquin miller park, means delays in responding to 911. oakland's fire chief said friday there are going to be delays in our delivery, but when you call 911, an engine is going to show up for sure. the fire station on skyline boulevard will handle most of those calls, assisted by four other fire stations, to keep delays to a minimum. the closures are part of a contingency budget adopted by oakland city council earlier this year to address a $129 million deficit. each station closure saves the city $2.5 million. david phillips lives down the road from fire station 28. they had to make some big changes and some drastic changes to, you know, make us all, you know, the city as a whole, better. and so there's going to be some sacrifices. and i get it. i get the big picture. and i overall i'm okay with it. a third oakland fire station is

also closed while it undergoes renovations, and more closures may be coming for more stations are being considered for closure, while the city administrator seeks other forms of revenue to keep them open, the city is threatening to close an additional four for a total of seven, which is 30% of our engine companies. and that's unthinkable. i mean, there's no way we can responsibly respond to emergencies like that. emma goss for today in the bay. it has been more than a week since a rape conviction was overturned for a former san francisco 49ers. but dana stubblefield will have to sit in jail for another two weeks. stubblefield was back in court yesterday as his attorneys pushed for his release. a judge said more time is needed to review the case and continued it until january 17th. an appeals court overturned stubblefield's rape conviction the day after christmas, finding that prosecutors violated the california racial justice act of 2020. that measure bars

prosecutors from seeking a criminal conviction o imposing a sentence on the basis of race. one year after a massive menorah was destroyed at lake merritt. another crime investigation is now underway. oakland police say officers responded to reports that the giant menorah had been vandalized with graffiti. it happened around one yesterday afternoon at 12th street and lake merritt boulevard. but when opd responded, they say it appeared the graffiti had already been removed from the jewish religious symbol. this, as mentioned, coming one year after a similar crime in december of 2023, vandals targeted the lake merritt menorah on the seventh night of hanukkah. they dismantled it and threw it into the lake. this morning, we are learning more about the decorated army veteran who died in a cybertruck explosion outside the trump hotel in las vegas on new year's day. police say that matthew

lyles burger shot himself before the cybertruck exploded. lyles burgers, military id and passport were found inside the truck. investigators say they also found a note on his phone that said, quote, this was not a terroristt attk. it was a wake up call. he also described the united states as, quote, terminally ill and headed towards collapse. and he added, quote, i need to cleanse my mind of the brothers i've lost and relieve myself of the burden of lives i took. meantime, president joe biden and first lady jill biden will head to new orleans on monday. they will meet with families and community members affected by the deadly attack on new year's day, when a man intentionally sped his truck down bourbon street, killing 14 people. police say the entire french quarter, including bourbon street, is now back open, but the city has increased security measures in place with the hopes to avoid a repeat. as families grieve, the governor of

look outside from our emeryville camera toward san francisco, completely shrouded in fog. cinthia pimentel will have your full microclimate forecast in just a few minutes. and i heard her say, sunshine. today, the nation prepares to say one final goodbye to former president jimmy carter. we have a live look for you this morning at at phoebe sumter medical center in georgia. today. a pcession will start any minute now. it looks like they are just arriving to begin that procession. it will go from the medical center and will go through plains, georgia, carter's hometown. the former president will then lie in repose at the carter presidential center in atlanta. on tuesday, the former president is expected to lie in state at the u.s. capitol in washington,

d.c. carter's funeral is scheduled for a week from today at the national cathedral in washington, dc. a private funeral and interment will follow in plains, georgia. carter will be buried beside his wife of 77 years, rosalynn, officially sworn in yesterday marked the beginning of the 119th term of the united states congress. new members took their oath of office, and among them was former san jose mayor sam liccardo. liccardo is taking over for former congresswoman anna eshoo. her former seat covers parts of santa clara and san mateo counties. liccardo says he is going to aim to focus on issues like homelessness, crime and the cost of living. also sworn in yesterday, lateefah simon simon takes over her longtime mentor barbara lee's seat. simon will represent much of alameda county in the

last two decades, simon has largely focused on equity initiatives as a civil rights advocate and nonprofit organizational leader. meanwhile, president elect donald trump is set to be sentenced in his hush money case on friday. that's less than two weeks before his inauguration day. a manhattan supreme court judge rejected the president elect's request to dismiss the case yesterday, and instead set the sentencing for january 10th. the judge also wrote he is, quote, not inclined to sentence trump to any prison time. trump, as you may recall, was convicted of 34 felony counts of falsifying business records in connection with an alleged scheme to hide a hush money payment to adult film star stormy daniels before the 2016 election. trump maintains he did nothing wrong. meanwhile, the surgeon general says alcoholic beverages should have a cancer risk warning label on them. the

recommendation is part of a health and human services report. it claims there is a direct link between alcohol consumption and at least seven types of cancer, like breast and colorectal. the report also says alcohol is the third leading cause of cancer in the u.s, behind tobacco and obesity. but fewer than half of americans know the risk of drinking related cancers. we spoke to one doctor at ucsf who says there are multiple studies swing moderate alcohol consumption is okay. this report is looking at kind of the byproducts of alcohol and what they do in the laboratory to cells, and that doesn't give the whole picture. and so what we have to look at for humans is what we call systematic reviews or meta analyzes. and the data has been really mixed. drinking alcohol in moderation is defined as one drink a day for women and two for men. the surgeon general believes we should reassess those guidelines. meanwhile, a

doctor with the distilled spirits council also told nbc news they believe consumers are well informed of the risks of alcohol alcohol consumption and that no further warning is needed. back here in california, governor gavin newsom issuing an executive order in hopes of making california healthier. the order requires state agencies to recommend ways to limit harm associated with products like soda, candy and other ultra processed food and drinks. the new plan also incentivizes low income people enrolled in the calfresh program to buy fresh foods. newsom's office says the goal is to support healthy yet affordable living in an effort to reduce the impact of chronic illnesses across our state. oh, that's a much nicer look at san francisco cotton candy, pink skies, and a live look at the city where mayor elect daniel lurie is planning a weekend of service leading up to his

inauguration day. today, the mayor elect will participate in several neighborhood cleanups. the events are hosted by refuse, refuse and the civic joy fund. the first cleanup will be at ocean beach at 10:00 this morning, and then he'll head to the ingleside neighborhood, fillmore south, and a cleanup in the bayview. tomorrow, the mayor elect will be in the lower nob hill neighborhood, as well as the tenderloin for a cleanup, and then head to the mission district. you may have heard by now there's an unusual patient being treated in the east bay. it's a spider monkey. well, it's a baby spider monkey, we should say. the chp says it found this little guy during a traffic stop. you can see it was in a onesie there. primates are illegal to own as pets in california. so the monkey was taken to the oakland zoo.

veterinarians there say she's about 5 or 6 months old, and that she is sick and severely malnourished. oh my goodness. but her care team is hopeful she'll make a full recovery. the zoo says primate infants are often illegally traded as exotic pets, but most don't survive the first year due to poor care. we're so glad she was rescued. going to rn now to this wild winter. did you hear about this? a tornado moving across your screen? this is the latest storm for parts of shasta county. this happened yesterday evening. fortunately, no word of any damage. and we're going to take you to the sierra this morning. a live look along interstate 80, where yesterday, spinouts forced the chp to shut down. all lanes 80 and 50 are now back open. chain controls remain in effect. back here in the bay area, though, two large trees fell, crushing a car and part of a home. it happened near guerneville in monte rio on

starret hill road. a pg&e power pole also was damaged. fortunately, no one was hurt. much calmer conditions, hopefully for the first weekend of the year. cinthia pimentel is here with our microclimate forecast. yeah, we thought it would be raining after yesterday, but it was quick and it was pretty much out of here into the afternoon, giving way to a nice weekend ahead. let's go outside right now. we do see some fog and cool numbers though behind this front. 39 in pleasanton and petaluma. even seeing some fog right there up there in the north bay. but we get into some microclimates getting near those upper 40s right there through san carlos and san jose. now you will notice those high clouds drifting around as we push the system out of here, going into the middle part of the day and maybe into tonight, we could see a pretty sunrise. so share your sunset. excuse me. share your pictures with us. they could end up on air tomorrow if they get into my inbox. let's go in and talk about our temperatures with this colder day. not many of us

will be breaking it out of the 60s today. we're going to keep those upper 50s there through santa rosa out towards dublin, only getting a little bit mild as we go on into parts of santa cruz and gilroy at 59 degrees. now, speaking of santa cruz and the coast, we still have to be careful. i know lots of our resolutions are getting out, maybe getting into nature, going on a walk, but we have this high surf advisory through the coast until tomorrow. already seeing those waves upwards of 14ft right now through parts of bodega bay. so that will continue. it will be really choppy. just keep that safe distance from the coast the next couple of days, we are really going to start to wind things down. as far as any rain systems go, we are going to be drying out and seeing some systems kind of collide with each other. here's what i mean. we go on into tuesday, notice what's happening here as we go on into parts of nevada. and compared to what's going on out west, we do see kind of a clash of systems where we want to dry out. but way that they interact togethere

is going to draw up the winds once again. now, as far as fire concerns, we've gotten a lot of beneficial rainfall. so that risk is low. but we could see some really gusty winds as we go on into late monday. on into tuesday, 25 to 35 mile an hour winds and that will continue throughout the day. i see it getting better on into wednesday, and with the movement of those winds bringing in air from the inland portions of the state, we can actually see those numbers bumping up a bit. so after a cool day today, we'll get into some low 60s into tomorrow, much more sunshine and then get into some mid to upper 60s as we go into the middle portion of the week. san francisco should also enjoy some nice sunny days as we get those routines back in order. love it! cynthia. thanks. 24 past the hour. we have much more ahead on today in the bay. coming up, an entire community rallying around a cat. ahead on today in the bay. the great lengths his neighbors went to get him down from a tree where he had

thom jensen has the story. the cat was at least 35ft up in the tree after being chased there by a neighbor's dog. since last saturday afternoon early afternoon. just crying for help. meowing. yeah, it's been up there. just trapped. the cat that rhonda named whitey is one of about a dozen or so feral

cats living in this vacaville apartment complex. whitey had recently been mauled by a dog and just started to recover before he went up the tall tree, and then began crying day and night for five days. my son was the first one over here with a 20 foot ladder, and we couldn't quite reach it. it was ten more feet above him. local firefighters couldn't get up that high because their ladder truck was down, so tenants hired this tree trimmer to give it a try to get up there and get him. but when he finally reached the cat in one tree, it leapt to another tree. and he gave up because it was too dangerous. oh, yes. finally, after seeing the saga unfold on facebook and hundreds of people commenting over the past five days, a local man with a cherry picker truck volunteered his services and used a net and got him in the net and got him down while he was still in the net. when he was placed in an animal crate and taken to a nearby animal hospital, where he's expected to recover from his wounds. rhonda said she really appreciates all

in those fluffy clouds as we welcome a brand new weekend and a brand new year. thank you so much for starting it with us. i'm kira klapper cinthia pimentel has a peek at our microclimate forecast. good morning carol. good morning everyone. the fog and low clouds wanted to start the weekend with us, and that visibility is a problem up there in the north bay, santa rosa, we see that cloud and those fog and the cold temperatures up there in the upper 30s. now, while we will get some breaks here with the cloud cover getting some peeks of sunshine, it will be a cool day as we get rid of yesterday's rain pushing in and out of the way. tomorrow i see a sunnier boost and a little bit mild that will carry us into next week. not only will it be dry and will boost those numbers a little bit, but i'm also watching the wind situation. we'll talk about it coming up in about ten minutes. back to you. all right cynthia, thanks. we want to take you back out live to the phoebe sumter medical center in georgia, where just now the nation is beginning to say a

first time since 2019, republicans have control of both chambers. but yesterday didn't come without some last minute drama. nbc's alice barr reports. reporter as a new year ushers in a new congress, echoes from the last one, with house republicans tussling briefly over who should be house speaker before unitingg to reelect mike johnson. this congress will renounce the status quo, and we will listen to the voices of the people. we will act quickly, and we will start by defending our nation's borders. president elect trump gave johnson a boost, writing on social media a win for mike today will be a big win for the republican party, but johnson earned skeptics over his support for ukraine aid and his willingness to work with democrats to pass key legislation with such a narrow majority, johnson could only afford to lose one republican vote, and one made his stance clear well before the first ballot. you can pull all my

fingernails out. you can shove bamboo up in them. you can start cutting off my fingers. i am not voting for mike johnson. the pushback recalling kevin mccarthy's 2023 battle for the speaker's gavel that took 15 rounds of voting in an extended first round of voting, two republican holdouts changed their votes under pressure from their party to give speaker johnson the win. house democrats firmly united behind their minority leader, the pride of brooklyn, the gentleman from new york, hakeem jeffries. and with razor thin margins in the new congress, republicans will need so help from across the aisle for must pass bills. it's time for us to come together, not as democrs or republicans, but as americans, democrats looking for any leverage they can find with republicans in control in the house and senate, where members were sworn in, and president elect trump preparing to return

to the white house with the house speaker now elected, congress can move ahead with the rest of its business, including certifying president elect trump's win on monday, january 6th. security will be stepped up substantially at the capitol for that big day in washington. alice barr, nbc news. we're going to turn now to this live look in new orleans, where faith leaders and community members will gather for a call to pray following that tragedy on bourbon street. leaders there say the event will be a unified moment of prayer and hope, bringing together voices to heal and inspire collective action for a better future. plus, new images of victims families walking hand in hand down bourbon street to a memorial there. as we are hearing from some of those directly impacted by the attack. nbc's gadi schwartz has their stories. reporter when the gunshots rang out new years morning on bourbon street, alexis scott windham was

there. she had just been hit by the speeding truck, then hit by gunfire. i tried to run, but i couldn't. that's when i noticed something was wrong with my foot. i thoug it was just a broken bone or something, but it wasn't. my feet had started leaking. but as i'm getting up, i'm seeing the dead bodies on the side of me. so it's like going on this side and it's like one on this side. it's one man on this side. i'm like, jesus, jesus, please just let me make it home. now back home in alabama, she remembers that in the chaos, her friend called her mother. so somebody called your mom, and she said, you got to make a tourniquet out of your sock. yes. i mean, your mom. it sounds like your mom was trying to save you from. from afar. yes. she already knew to call my mama. so my mom was like, calm down, stop the bleeding. because i was bleeding a lot. and after that, they tied it tight. among the dozens of people hurt. she's one of the lucky ones already released from the hospital. she's thankful for the stranger that picked her up and rushed her to the emergency room. and

been closed. originally, the city said it could take weeks, if not months to partially reopen the wharf. but now city leaders say they will reopen today. the portion of the wharf impacted by that collapse will obviously remain closed. in san francisco, mayor elect daniel lurie will be sworn in as the 46th mayor. it will happen wednesday morning at civic center plaza. and then come inauguration night, chinatown will be the place to be with an evening full of events with the new mayor, today in the bay gia vang has more celebrations in chinatown. hocker. celebrate a new mayor. the big boss. hello. lily lo, founder of the nonprofit be chinatown, is busy walking through chinatown, making sure small businesses know about the festivities on inauguration night. lo organized nine night markets in chinatown last year. wednesday's market will be three blocks along grant

avenue between sacramento to jackson streets. there will be 18 vendors and a stage for live music. i don't mind, you know, to continue, you know, you know, doing the night market, we bring a lot of young people to chinatown to enforce. you know, the bottom line is, you know, create jobs and bring it bring income to this small business. it's exciting. of course, you know, for my for me, you know, i i'm not i'm not looking for a job. i'm not running for an office. i will not ask him for money. so i, you know, i'm happy to help. at the same time, a sold o dinner at far east cafe, one of chinatown's last remaining banquet halls, is being organized by asian american community groups. they estimate up to 800 attendees. it's going to happen. mark young is the founder of the nonprofit stand with asians. there will be lion dancers, dragons, firecrackers, 100,000 firecrackers. the inauguration events coincide with an auspicious date. it's january

with a bit of a gloomy feel under that dense fog. up towards the north bay, parts of san carlos. the livermore valley and down in morgan hill. we should get some breaks of the sunshine and enjoy a dry first weekend of the year. but it will be cool with the mix of those high clouds rolling around. only at 57 up there in wine country, through parts of the east bay shoreline out towards livermore. maybe a shopping day for you. finally doing those returns, and only a high of about 58 down here in san jose. i see it getting warmer into tomorrow, and definitely as we go on into the start of our brand new week

here. getting back to hool and back to work. a little bit of the boost in those numbers into some mid to upper 60s down here for the south bay. we'll get that routine going. now, aside from what's going on into the next couple of days with the drying out pattern, there's going to be a little bit of a situation with the wind, and i'll show you why we're trying to build this ridge of high pressure here through the state, but out towards parts of nevada and parts of colorado, utah, they're going to be dealing with a low pressure system. now, when these two things mix, it kind of makes a clash with the ingredients and picks up the wind speeds. so that could be something that we're dealing with as we go on into tuesday and wednesday. the winds will be blowing in from the inland, and so that will ramp up the numbers just a little bit. then after that, the rest of the week looks good and we will bump up those numbers. so here's what's going to happen in san francisco and along the peninsula over the next couplple of days. we'll wah for the morning fog, but enjoy a dry weekend. and those numbers will gradually warm up into some nice, comfortable low 60s there through the week. the day that

private funeral and interment will follow in plains, georgia. carter will be buried beside his wife of 77 years, rosalynn. back here locally, here's a quick look at the top stories we're following, including that breaking news out of the east bay, where there continues to be a heavy police presence in the area of macarthur boulevard at 66th avenue in oakland. this is right along the edge o of evergreen cemetery. dozens of police cars there. opd officers have been on scene since about 5 a.m. and then an hour later at six, they brought in an armored vehicle. we're waiting to hear back from opd. we have reached out. we will update our website and our app as this story develops. back out. live to the glowing sunshine of santa cruz may be a good sign, as the wharf is set to partially reopen today. this, after that large section of the end of the wharf collapsed into t ocean during a strong storm last week. 17

businesses have been closed since then. originally, the city said it could take weeks, if not months to partially reopen the wharf. but now city leaders say it will happen today. of course, the portion of the wharf affected by the collapse will remain closed. and cynthia has one last look at the forecast before we go. looks nice out in santa cruz. it does, but a little bit of caution. there is still that surf advisory there, so maybe give it a couple of days to finally get back into santa cruz. overall, we will be seeing a cool day with some high clouds here and there. a littl bit warmer though as we head on into tomorrow and the rest of our week there. the only thing we'll be watching is the wind come tuesday. could get pretty gusty 15 to maybe 40 mile an hour gusts there, but then into the second half looks calm and those sunshine icons give way to some mid to upper 60s by the end of the week. so i was happy to not put any rain icons. yeah, good way to start. i know we always need the rain, but not a bad way to start a new year.
