12:03 pm
president biden's last trips as what you could call consoler in chief. what are we expecting to see and hear from the president and first lady today? >> the point of these sorts of visits us for the president on behalf of all americans, to show respect to the families who have been through something this tragic especially when the context is something as unexpected and awful as a terror attack during a holiday. we've also seen the president do this after natural disasters and other kinds of tragedies that rise to capture that national attention for an extended period of time and raise questions about lots of legitimate issues about safety and being in public places and all of the things, to represent the country and do so on a personal way where the president can convey his own sense of sympathies and condolences of course, we know grief is something that he

unfortunately is an expert at, with losing two of his own children, his first wife in the car accident 50 years ago. it's something the president talks about a lot, that he understands what it's like to suffer sudden loss and that, he can help to convey to people that are going through it right now. most of all, beyond the personal sense, is a chance to simply show up when people are going through a crisis, when a community is going through a crisis and that's the point of this. we won't see him on camera, these are private meetings where he has a chance to talk to the families and he's spoken to some of them by phone in advance of the trip but this is the demonstration of using the power of the office to say that the people who are experiencing this have been seen and their loss is understood and felt by a much broader community, the whole country. >> the mayor of new orleans said that she cannot guarantee the city is fully prepared to host the super bowl next month.
12:05 pm
what are the biggest concerns that e seems to have right now? >> in the wake of this attack, safety and security in new orleans has been under the microscope and we have new reporting that the replacement bollards that were supposed to be here ahead of the super bowl, they were not here before the attack and can only stop a vehicle going 10 miles per hour so the mayor told us they are bringing in a tactical expert to do a full security analysis of what they have in place right now and determine if any changes need to be made. she added that and infrastructure plan will go intoeffect starting today ahead of the super bowl. >> kathy, we mentioned all of the victims have been identified. what are some of the stories you've been hearing about them? >> these were mothers, young adults, who really have their

sentencing in the hush money case which is scheduled for this friday. >> a jury convicted mr. trump on 34 felony counts of falsifying business records around the hush money payment made to adult film star stormy daniels. but his attorneys argue that nothing should happen until their immunity appeals are resolved, the sentencing was pushed back over the summer after the historic presidential immunity hearing. >> danny, what do you make of the argument that we are hearing from mr. trump's lawyers and in your experience, what does it take to get a sentencing thrown out entirely? >> we can't know for sure because that decision has raised more questions than it answers but it appears that president trump may be entitled to a stay in other words, a pause while he seeks an appeal.
12:08 pm
you don't normally get to pause proceedings in the criminal case while you appeal it because otherwise everybody would raise an appeal and no criminal cases whatever go to trial. immunity might be an exception. >> president-elect trump is set to become president trump in two weeks. the judge said that jail time is off the table but what could sentencing look like? >> people are talking about how no jail time appears to be the story but that's only half the story, the judge signaled in advance that he's going to give him an under -- unconditional discharge, that means a sentence of no jail time but that also means no probation, no community service, nothing, your sentence is you have no sentence. that is arguably, the only sentence that judge merchan can give that doesn't run into constitutional problems because anything else would last more than 10 days and would be in existence once he takes office. lawmakers in both houses of congress have just certified president-elect trump's victory.
