the conditions there this midday, and bay area firefighters are heading south to help crews prepare. plus a change in leadership. antioch city leaders announcing a new acting police chief. what we know about the person in charge. as the department looks to move on from its racist text messaging scandal. good morning. thanks for joining us for our midday newscast. i'm marcus washington. and i'm laura garcia. we'll get to those top stories for you in just moments. first, we are following two breaking news stories. the first is happening in the east bay at the hayward bart station. that's where there is some sort of police investigation unfolding. we are being told they are investigating a stabbing nearby. this is video from nbc bay area. sky ranger overhead. the station is closed due to that police activity. you see crews on the scene. trains are currently not stopping there. we're still working to learn more about the investigation that is

continuing. ac busses are stopping to pick people up since those trains are not moving right now. we'll continue to investigate and bring you updates as soon as we get them. also, for the latest 24/7, visit nbcbayarea.com. now to a live look in san francisco, where we're following breaking news on the police department. sfpd has reached milestone goals on reform and is officially leaving state oversight. you may recall the department has been implementing federal reforms since 2016. after several scandals. they had a list of 272 recommendations to meet. today, california attorney general rob bonta says the department has met mos of its goals over 260, with plans to phase in the rest over time. bonta says sfpd has seen a significant decline in the use of force against all racial groups. the report also acknowledges disparities still exist, but use of force against

black people saw the largest decline since 2011. this announcement comes as the mayor's office also celebrates a huge drop in crime. here's a look at those numbers today. mayor london breed and police chief bill scott announced crime stats hit their lowest level since 2001. that includes a 60 year low for homicides and large drops in property crimes and violent crimes. they're crediting better strategies, including new tech, targeting drug markets and prioritizing police staffing and prosecutions. bay area firefighters now on their way to southern california with a growing fire threat due to high winds, potentially life threatening wind, storm conditions may be on the way. we know those wind gusts approaching 100 miles an hour. we just got word all schools in malibu are closed today due to that threat. right now, at least six bay area cal fire engines heading down to help. here is a post from the ccu unit based in

santa clara. teams there planning to be on standby in the event of a wildfire. meteorologist kari hall, of course. here with us. i spoke to some friends down there. they say their power is off right now. and we know that the wind gusts they're adding to that fire danger. yeah. and so they haven't had nearly as much rain as we've had here in the bay area. it is still extremely dry, creating that particularly dangerous red flag warning that we are seeing right now that has been extended through possibly friday morning for some parts of socal for all of those areas shaded in red. and then looking at the bigger picture, there was actually a little bit of rain in the area, and now a lot of that rain is falling apart without making it to the coast. and spots like malibu, where we're still extremely dry and starting to see those winds increasing. here's a look at the forecast for today. looking at 50, possibly 60mph. and it may be even higher for some of those hills in the areas around santa clarita. but then look at 70 to

possibly 80mph. and as we mentioned, it could briefly get as high as 100mph. it is breezy here in the bay area. we have a wind advisory, but we're not as concerned about the fire danger and it will be breezy as we go throughout the day. so we'll continue to watch this and we'll talk about what's ahead coming up in our full microclimate forecast. perfect. we'll check back with you. thank you. kari. well, new at 11. antioch police now have a temporary leader. that's until the city hires a permanent chief. the announcement comes one day after the city's first homicide in less than a week. after settling with the u.s. justice department. nbc bay area's kris sanchez in our newsroom for us this midday. so, kris, what do we know about the new leadership? well, hi there, marcus and laura. this new leader might seem familiar. within the last hour, the city of antioch announced that former acting chief joseph vigil will once again lead the department on an interim basis as the city continues its search for a permanent chief. transparency, community trust and crime

reduction are our priorities. i will update our residents on milestones as we progress on these initiatives. i ask for the community's involvement, feedback, and support as we take onhese challenges together. how acting chief vigil also added an additional priority of recruiting and hiring to bring the department to full staffing within the year by the end of this month. antioch should have 91 sworn officers. now, acting chief joe vigil will also be familiar in the antioch community. he is a former police department captain who was elevated to acting chief in august of 2023. but by november, back then, some critics were calling for his resignation for his role in the department's racist text message scandal. now, acting chief vigil is taking over just one day after the city's first homicide, just after ten yesterday morning, officers found a 26 year old man shot several times on the 3900 block of rockford drive, a

neighborhood of single family homes. the victim died at the hospital, and police are not yet providing any details in that investigation. but as i mentioned, acting chief vigil will take over a troubled department from former chief brian addington, who left retirement to temporarily lead the apd last year. last week, the city took action to put the racist text message scandal in the past by reaching a settlement with the u.s. justice department. the feds found antioch pd engaged in race discrimination and other discrimination after dozens of officers exchanged racist text messages between september 2019 and january of 2022. now, vigil will oversee the hiring of an outside consultant within 90 days to review and update apd policies. also hire a community engagement liaison and will oversee the providing of data collection and reporting to the justice department for

monitoring for a five year period. now, this appointment of vigil is just a temporary one. the city is still conducting a nationwide search for a permanent chief. marcus a lot to follow there. chris. thank you. well, developing now, we are waiting on the decision by alameda county, which could finalize the sale of the oakland coliseum. nbc bay area's bob redell. joining us now. now, bob, we've been talking about this. the city of oakland desperately need money from the sale that has been held up now for some weeks. you are correct, marcus. we're talking about $125 million for the city of oakland. and when you consider their budget deficit is $129 million, this would go a long way in helping to close that. but in order for this deal, the sale of the oakland coliseum to go through the buyer of the coliseum wants sign off from the county of alameda first. which brings us to this morning, the alameda county board of supervisors. they will soon vote on whether or not to approve the a's portion of the coliseum to the african american sports entertainment group, which is

co-founded by ray bobbitt. as you can see by this virtual feed, the board is in closed session right now, but when they come back out, we expect them to be voting on this. the a s e g offered $250 million for the coliseum, 125 of that going to the city of oakland, the other half going to the a's. but this past november, bob, its organization missed a payment deadline to the city of oakland because its investors are waiting for county supervisors to approve the a's half of the sale, which again, is expected today. without that money, the city of oakland has already had to revise its budget and make cuts to key programs. here's ken houston, he's the newly sworn in oakland city council member for district seven, who says he met with ray bobbitt on sunday. i believe in that coliseum deal is going to work. from the numbers that i saw, from what i know personally, some of the council members don't believe it. they think it was smokescreen. i thought it used to be smoke because of how it was moving. but after my meeting with ray bobbitt yesterday, i believe in

that deal. i'm just doing what i'm told. yesterday, oakland firefighters, they stood on the steps of city hall and urged all sides to finish the sale of the oakland coliseum to bring that money into oakland so the city can reopen. the two fire stations temporarily closed yesterday closed to help with oakland's budget gap and saving money, the parties involved in the sale have told us before they're confident that the deal will eventually go through. now. this morning when i was monitoring the board meeting before the board went into recess, there were two men who spoke during the public comment section against the sale of the coliseum. the men are co-founders of acg, who are suing ray bobbitt over a business and financial dispute. among the men. they say baba doesn't have the authority to go through with this purchase. reporting live, bob redell, nbc bay area news wanted to continue to follow bob. thank you. a notorious bay area kidnaper facing new charges. authorities in monterey county seaside today plan to update a new investigation tied to matthew

mueller, convicted in 2015, in the vallejo kidnaping. the new case unfolded in san ramon shortly after the vallejo crime, where police initially accused the victim, denise huskins, of making the whole thing up. she later sued for defamation. seaside's police chief says mueller has confessed to other crimes and letters they exchanged. mueller was recently charged in connection to two separate cases in the south bay. also this afternoon, teachers statewide are awaiting the release of a new report on education salaries. a private firm conducted the survey spotlighting wages and the rising cost of living. more than 2000 public school teachers took part. union leaders are also planning to hold a virtual news conference at noon to present the findings. now to a live look at the u.s. capitol this midday. former president jimmy carter's body will is set to arrive there later today. this is new video of the casket departing dobbins air force base in marietta, georgia. the funeral procession

to the u.s. capitol was supposed to get underway at the top of the hour. however, it has been delayed due to weather. carter has been lying in repose at his presidential center in atlanta since saturday. this is video of his body leaving there earlier this morning. carter center officials say about 23,000 people visited the center during that time to honor the late president. his body now flown to joint base andrews in maryland. from there, he will travel to the navy memorial and then on to the u.s. capitol rotunda. this is where he will lie in state for public to pay their respects. beginning later this evening. a powerful earthquake rattling western china overnight. nearly 100 people are dead, dozens others injured. ahead this midday, an update on the rescue efforts underway. straight ahead. plus, bay area based media now out with new policies when it comes to fact checking its content. the new announcement and what you're likely soon to see less of when

in western china. this was a 7.1 quake happening last night. now this was the center. this is near tib's holiest city, also near the border of nepal. there are now nearly 100 confirmed deaths, with reports of more people trapped as the death toll and injuries mount. officials are searching the rubble for survivors. here's nbc's janis mackey frayer. this was a strong earthquake at a remote, high altitude in the himalayas, with a rescue operation now underway in freezing cold conditions. the epicenter was located in dhingra county, about 50 miles from mount everest. it's near one of tibet's holiest cities called

laura garcia, with a population of nearly 650,000. people say at least 95 people have been killed, more than 100 injured. these are early estimates as rescuers push into the area. the 7.1 magnitude quake, by usgs estimates, was about six miles deep, and it shook buildings in nepal, bhutan and parts of india. more than a thousand houses damaged. some have collapsed, with videos on social media and state broadcasters here showing destroyed homes with walls torn apart and rubble. this area of tibet is home to roughly 60,000 people. it's considered the chinese gateway to mount everest. earthquakes are not uncommon i this part of the himalayas, which lies on a fault line, but this was the most powerful recorded quake there in years. and there are also jolting aftershocks. china's military has launched the rescue operation there, using drones to assess where help is needed most, as those winter temperatures are set to drop.

janis mackey frayer there. well, just coming into our newsroom, a new york appeals court judge is denying donald trump's bid for an emergency order halting the president elect's scheduled sentencing friday on criminal charges in the hush money case. that ruling comes just hours after the president elect held a wide ranging speech from his home in mar-a-lago. among those announcements, he will ask the american government to rename the gulf of mexico as the gulf of america. scott mcgrew has other highlights. mr. trump claimed windmills were hurting whales, and that america had spent trillions of dollars on the green new deal. now the green new deal was never passed. the president elect also claims special counsel jack smith was executing people. he has not. during the question and answer phase, the president elect said he could not promise not to use u.s. forces against panama or denmark in his efforts to take over the panama canal and greenland. now, the original impetus for the speech was not

whales or the special counsel. it was an announcement from trump ally hussain sajwani. the emirati billionaire says he will invest money in american data centers. it's been amazing news for me and my family. when he was elected in november, we've been waiting four years to increase our investments in u.s. to very large amount of money. now from there, mr. trump spoke at great length about heat and wind and water. he promised americans will soon take better showers. no water comes out of the shower. it goes drip, drip, drip. so what happens? you're in the shower ten times as long. you know, no water comes out of the faucet. you want to wash your hands? you. they want to go back to even stronger than what they have right now. as you know, i ended that policy. i can have all the water you want. it makes no difference. it comes. we, especially in certain areas, we have so much water, we don't know what to do with it. as

trump was speaking, judge aileen cannon, who is overseeing the classified documents case and the election interference case against trump, temporarily blocked the justice department from releasing the prosecutor's report in the case, handing that decision to a federal appeals court. back to you. thank you. scott. meta. the company which runs facebook, is dropping all efforts to police lies online. the company says it's moving to a system more like elon musk's x. users on that platform do the work through community notes. in a video, ceo mark zuckerberg is citing a shifting political and social landscape and a desire to embrace free speech. meta is also making changes to its content moderation policies around political topics, and undoing changes that reduce the amount of political content in user feeds. san francisco leadership changing this week as a new mayor takes office. danielle lowry will be sworn in tomorrow. one event is planned for tonight ahead of those

events. lowry is scheduled to attend the interfaith unity service at the congregation emanuel. tomorrow's ceremony is planned for 11:30 a.m. in civic center plaza at 530. a celebration will be held in chinatown, and that event will inude a night market and community festival. and we will have special coverage tomorrow of the mayoral inauguration. you can watch live on nbc bay area at 11:30 a.m, as well as on all of our streaming platforms including roku, pluto and nbc. bay area.com. for right now, how about a look at that forecast? it looks nice outside. it's beautiful. it's sunny, the temperatures have been pretty warm, but the only thing is, once you get out there, you're noticing how windy it is. and so the wind will continue to gust throughout the day into early tomorrow. live. look outside at the clear blue skies that we're seeing in walnut creek right now, and those high winds are also turning up some big waves. so we are under a beach hazard statement until about 9 p.m.

this evening. we are currently seeing those waves at about 8 to 10ft, but it's possible that some of those sneaker waves may come up to about 15 to 20ft. so be very careful if you're along the coastline. we're also seeing some warmer than normal temperatures. so we're headed for the mid 60s for today. 66 in oakland, 64 in novato and san francisco, up to 64 degrees. that will repeat tomorrow and maybe even slightly warmer for some spots. and then we continue that warming trend through thursday as the sunshine continues and the wind calms down as well as we look ahead to see when we could get some more rain here. high pressure in control and not a chance of rain in the forecast through at least the middle of next week. so with this dry weather pattern, we look very closely at these days during the month of january, because usually we're getting most of our rainfall for the year. during the months of december, january and february,

with january measuring the most amount of rainfall. so where do we stand at this point? santa rosa had so much rainfall on the early end of that, with the atmospheric rivers we had in december that we are still 12in above normal, and san francisco is about an inch above what we typically see for this date. while oakland, livermore and san jose are now running a deficit for the rainfall. so we will most likely continue with some very dry conditions, as we don't have any rain in the forecast for at least the next week, and our temperatures are once again a little bit above what we typically see for early january and our morning temperatures dipping down to the low 40s. we're going to see much more of the same in san francisco, with more sunshine through at least the middle of next week. back to you. thank you so much, kari. well, happening now, the first deadly pedestrian accident of the year in san jose under investigation. this happened around 1030 last night near
