with "nbc news daily." we get started with breaking news. the deadly wire fire crisis in southern california now stretching into its fourth day. at least ten people have been killed, nearly 10,000 structures destroyed. if there's any good news, the strong winds that have been spreading the fires are expected to die down later today. communities are left trying to sift through what the fires have left behind. this is what it looked like driving through the pacific palisades. you can see smoke rising. there's growing frustration after evacuation orders and alerts were sent out to millions of phones by mistake. county officials are trying to figure out how that happened. >> i want to express my deep frustration with the alert system causing confusion and additional panic for our communities at this time of extreme crisis. whatever the cause, it unacceptable. >> nbc news correspondent steve patterson is in pacific

palisades and meteorologist bill karins is in studio. steve, let's start with you. what are you seeing? give us a sense where things stand right now. >> reporter: i wanted to show you this. you're seeing a fire hydrant gushing out water. this is one of the problems fireghters are dealing with. we don't know how this happened. as you know, firefighters need all the water pressure they can get. one of the things they'll do is try to seal this up. meanwhile, the fire fighting effort continues. hot spots is all over. this is the pacific palisades. it's been wrecked, destroyed. this neighborhood completed bombed out. it appears as if a bomb has gone off as officials have said. major fire fighting efforts continue. we see smoldering in every direction we look. there's another fire burning in the hills. fires are burning in los angeles. i have a fire captain here. your name so. >> adam.

>> nice to meet you, sir. how is the fire fighting effort going? >> right now it's still red flag conditions. we have active firefighters throughout the pacific palisades area. we have over 2,300 firefighters. we're about 20,000 acres, just over that. we have -- we're still under red flag. firefighters are roaming the area. just around the corner we saw some down there. i'm glad you flagged me down. i saw this water and need to get it shut off. like you said, we need all the water pressure we can get. >> thank you. good luck to you. >> reporter: obviously it's an active scene despite all the damage you see. it's not over yet. >> so active. the work of first responders can't be overstated. bill, i want to bring you in. there will be some relief from the winds later today. it will not last long. what should our viewers expect? >> the weekend they'll be putting out hot spots and

flare-ups. early next week we could see the winds increasing. we have a couple areas with gusty winds. where we have the fires that are still burning, the palisades, the winds are light. the eaton fire, the winds are light. the kenneth fire gusts up to 20 to 30 miles an hour. i'm sure it's not easy for the firefighters. with the aerial attacks ongoing, it's helping out. it's makes a world of difference if you have the air support. this is the wind forecast for later this afternoon. everything really improved. red flag warnings will go down about 6:00 p.m. we don't expect them up throughout the day on saturday. this is the map where there's elevated and critical. the mountains outside of san diego, you have a chance for gusty winds. just an elevated risk on saturday. all eyes will be on tuesday. that's when the winds will be highest next. >> meteorologist bill karins and steve patterson on the ground, thank you.

let's bring chad augustine, chief of the pasadena fire department. thank you for being with us. as our meteorologist mentioned, we're expecting a break from the gusty winds. what does that mean for your department department? >> good afternoon. thank you for having me. i'm at the rose bowl. wewe have nice, calm conditions. we'll capitalize on these favorable conditions to get more aircraft in the air and support it with hand crews and additional fire engines to see if we can increase the containment. >> chief, your team has been facing so many obstacles. one was a fire fighting plan that had to be grounded after colliding with a drone. thankfully no one was hurt. that did not belong to your department. walk us through how a drone can impact overall fire fighting efforts. >> at the simplest level it

hinders our ability to fight the fire. at the worst level, it's an incident within an incident. it could have caused a catastrophic injury to that aircraft and caused it to crash. thankfully that didn't happen. we're reminding the community to keep drones out of the air space. let our fire fighting personnel do good work while we have favorable conditions. >> the eaton fire has been burning near your city for days. how's your department holding up? i wonder what your message is for those in your community. >> for those first 48 hours it was all hands on deck. we had full recall of our entire department. almost every member was out actively fighting the fire. they were exhausted. with the request for 60 additional strike teams we were able to get into a good work/rest ratio and rotation. we're doing good. it's just -- many of my members

that michael cohen gave to a porn star in 2016. the president-elect spoke before the sentence was handed down. >> it's been a political witch hunt. it was done to damage my reputation so i would lose the election. obviously that didn't work. the fact is that i'm totally innocent. i did nothing wrong. i got indicted over calling a legal expense a legal expense. it's called a legal expense. >> joining us now nbc news correspondent vaughn hillyard and legal analyst danny cevallos. trump's inauguration is just in ten days. he's the first u.s. president to be convicted of a crime. what are the implications here politically of this sentencing? >> he'll formally be a convicted felon when he's inaugurated. americans voted for him understanding that he was found guilty back in may on these 34 felony counts. donald trump maintained in the

courtroom this morning and a social media post after he left the courthouse virtually -- he was at his mar-a-lago estate and appeared via computer into the courtroom for this. he has maintained he intends to appeal. he's argued that the falsification of business record charges should never have been brought against him. he says it was politically calculated. >> danny, today was remarkable because it was the first time we got audio from inside the courtroom. talk to us about what you make of the judge's ultimate decision not just the sentencing, but his reasoning which he went through in detail. >> when it comes to video and audio, the dam is breaking. jurisdictions never would have contemplated audio or video having it. you won't see it in federal court because a rule in federal court prohibits it. judges have no discretion. nothing about this case was usual. you don't have judges who announce the sentence in vance

of sentencing. you don't have felons appearing by video. lots of things are not traditional. the prosecution and the judge conceded it was the only constitutionally accepted sentence, which is no sentence. that's what an unconditional sentence. it's no jail time, no monitoring, zip. >> the trump team says they plan to appeal. >> yes, and really they should. every conviction has an automatic appeal. they'll get in and challenge it. there are collateral consequences to being a felon. he should appeal it. he gets one appeal. he'll take it. >> danny cevallos and vaughn hillyard, thank you. time for today's cnbc money minute. a new study shows the impact of age at work. uber is helping out teens who flunk their drivers test.

it appears the future of tiktok in america is even more in question. the supreme court heard oral arguments today on the social media platform's efforts to block a law that could lead to a ban in the united states. it appears the majority of the justices agree with upholding the law. by january 19th bytedance needs to divest itself. nbc news now anchor savannah sellers is outside the court in washington, d.c. and danny cevallos is back with us. savannah, you were inside the court for the oral arguments. what were the major cases and arguments made from tiktok and the u.s. government? >> reporter: so let's start with tiktok. i would say their strongest point probably was a question of why congress went as far as it did. they kept using the term over

and over. why didn't they look at less restrictive means? a law that would make it illegal for tiktok to share american data with its parent company bytedance. that didn't get very far with the justices. they pointed out, well, if that's even a possibility, then it's going against everything you're saying, that china has no ability to manipulate, no oversight over tiktok as this company that's incorporated in california. when we talk about the justices, first, both sides of the aisle totally peppering these lawyers with questions and it did not look great for tiktok just the way they -- both sides of the aisle specifically of their argument that is infringement on free speech. justice jackson said it's more like a right to associate case, rather than a freedom of speech case. that's important because it's difficult for the government to ignore a freedom of speech concern in the interest of national security.

the first amendment rights are super strong for all of us. in order for the government to be able to take this app away would take a lot if it were infringing on freedom of speech. >> danny, let's bring you in and talk about the timing of all this. if tiktok is not divested, the law says the ban would take effect one day before president-elect trump's inauguration. when it comes to his view of this, he was in favor of banning the app. now it seems he supports it. walk us through it. >> he was against it's. now he supports it. he filed an amicus brief in the case saying i'm neutral, i'm in the middle, which is probably not the case. the amazing thing is for all the supreme court litigation, it may all be moot by the time trump gets to office. that's why for tiktok it was key to possibly stay this until trump took office. if it was -- if they avoided this argument, trump's doj may have taken a totally different

position. they may have withdrawn from litigating this. you have a lot going on. the supreme court maki a decision before it goes into effect and then the contours afterwards are going to be affected by the degree to which trump wants to enforce this law with his doj. >> avannah, back to you. tiktok has faced accusations that it's giving data to the chinese government. that's been a key argument throughout the case. fact check that for us. what do the facts say about that claim? >> reporter: so part of the reason why it's a difficult question to answer -- this was referenced by ththe tiok lawyer in court. much of what the government uses, evidence they're presenting, is redacted. we don't know what they're saying. to put it bluntly, we do not know if there's a smoking gun. if there is one, we have not seen it. now, has tiktok essentially conceded that, of course, with its relationship with bytedance,

we will have cooler weather in our 7-day forecast. we'll take a look coming up in the next few minutes. thanks, kari. a seismic alarm clock this morning around seven. a 3.7 magnitude quake shook san francisco and parts of the peninsula. then another 3.0 aftershock. nbc bay area's ginger conejero saab says we've received no damage or injury reports. these smaller earthquakes could be a foreshock to a larger earthquake, but we're also told that it is not uncommon for there to be an isolated earthquake or even a series of smaller earthquakes, since the san andreas fault is relatively active. now, this morning it was a bit of a jolt to hear people here in san francisco, those at least, who experienced the 3.7 magnitude quake that happened just past seven this morning. it hit off the coast a few miles near the san francisco zoo on the san andreas fault. we know that fault to be more active, so these small quakes throughout the day are not uncommon. now, we saw the zoo today. there were no reported damages or injuries

bottom of the hour. here are some of the stories making headlines on "nbc news daily." the video in this first story might be distressing. this is security video from australia, showing a suspected arsonist's pants catching on fire while they were apparently trying to start a fire. fire crews in melbourne were called to a group of shops that caught fire christmas day. police say the people in this video set a fire and drove away after it began. the persrson on fi took off their burning clothes while leaving. these arsonists have not been caught. alec baldwinin has fil a civil lawsuit against prosecutors accusing them of defamation saying they misused actor and sought out the actor for professional gain. baldwin was accused of firing the gun that killed halyna hutchins in 2021. baldwin was charged with involuntary manslaughter, but a judge later dismissed that charge due to hidden evidence.

one of the prosecutors responded to that lawsuit saying they look forward to their day in court. a judge is issuing the release of a woman who stabbed her friend several times. in 2014 when 12-year-old morgan geyser lured a friend into the woods in wisconsin where geyser stabbed that friend 19 times. that victim survived. she was granted supervised release from a psychiatric facility in 2021. geyser had been serving a 40-year sentence at a mental hospital. she's expected to move into a group home. let's return to our coverage of those deadly wildfires in california. the scope of the devastation remains staggering, especially in altadena. the eaton fire destroyed much of that community and burned nearly 14,000 acres. that's where ellison barber is in that hard-hit area. we saw the national guard in

altadena today. what is their mission and what are you hearing from people in the community? >> reporter: the governor of california said they've been deployed to alleviate the pressure on police, california highway patrol in terms of aling with check points and preventing any looting. the governor was explicit saying that looting will not be tolerated during this time. that's why he had called for 600 members of california's national guard to be activated. some of them deployed overnight. in the morning hours we saw them stationed in this area this morning. more are expected to come in the next 10 to 12 hours they say. look, some people in the community told us it's good they're here. they're not upset about it. they're frustrated they can't get home, but a lot said look at where i live. there's nothing to lose. one man lived up further in the hills and said his home looks

like what you're seeing here. he said, i'm glad they're here to prevent looting, but there's nothing left in my home for anyone to loot. that's the reality so many are dealing with. a lot of people haven't been able to get back to their homes to see what is left. for many when they do, they will see this. destruion after destruction and very little left of the places they called home. in between all of this, there are stories of resilience, of heros, of neighbors stepping up to help each other. we met at this house one mawho did just that. his name is philippe. he's over here sweeping, cleaning up leaves because he's worried about the wind picking back up come monday and possibly the eaton fire which is in this area and only 3% contained reigniting down towards this area. when the fire broke out here on tuesday, he was standing at the corner of his house over here

wiwith his garden hose. flames were spewing over him. he said it was so bright there was just this glow of orange fire and embers flying every which way. he stood there trying to prevent his house from catching on fire and trying to save his neighbors. he wasn't able to save the house over on that side, but on this side you see where the fence is charred, but the house on the other side is still standing. he said this is one of the homes he stood for five hours dousing with water, trying to help his neighbor and himself. he told us something we heard from a lot of people in this community. they have a lot of questions for the government, the city and the state because he said he did not see a fire truck or other assistance out here until wednesday morning and they still have questions about why there weren't more resources and why their community wasn't better prepared. zinhle? >> more information to come in the coming days.

ellison barber, thank you. we've been talking about this devastation and something that caught our eye was the many animals that have been losing their homes. joining us now is forest gallante. thank you forest for joining us. do we have any sense of how many animals have been impacted by the fires and to what extent? >> well, the extent is massive. like humans are being displaced, animals are. los angeles has urban animals like mountain lions in its neighborhoods. as far as the shear number, i haven't seen any estimates yet. i can tell you it's a lot of creatures that are being displaced. one thing we know is that animals have somewhat of a sixth sense and are likely moving out of the areas before the fires are hitting them. we're more likely to encounter wild animals in urban animals.

>> to that end, what should people do if they see a wild animal appear to come from one of these fire zones? >> obviously let logic dictate. don't pick up a mountain lion. if you want to help, the best thing you can do is put out dishes of water. during high fire times and when the temperatures rise and these big winds, animals are desperate for water. that keeps them alive and allows them to move on. putting a dish out of water out in your front yard or backyard will help. if you see a kitten or fawn stuck behind a fence, do your best to help out where you can. >> we've been talking about wildlife. i've been hearing difficult stories of homeowners trying to get their pets out of their houses because the pets are afraid. do you have any recommendations? >> there are shelters taking in animals currently. there are places internationally

that are offering to house animals. people are caring. there are people out there. google searching as to what the closest to you is and the best you can do would be my best recommendation. it's just as tough. all i can say, try not to leave your pets behind. >> briefly, after these fires are out, which we hope happens soon, what happens to the land? how long before it can be occupied again by animals? >> it's a complex question, zinhle, because this area is naturally an area that should burn every once in a while and we've put so many fire retardants into place. these fires are burning hotter than they're used to. they're killing the oak trees and grass seed and things that are fire resistant because it's such a super fire. the bounceback time is longer than the natural cycle. that being said, we will see green shoots as soon as we get rain. we'll see a rebirth.

[ gunshots ] >> nbc news correspondent priscilla thompson joins me from new orleans. walk us through what we saw in that video. we should note it has been edited by law enforcement. where does the investigation stand at this point? >> reporter: zinhle, we're not far from police headquarters where they released that

13-second video. they say you're seeing the police approach the white pick-up truck the suspect is in and there's a muzzle flash where you see the suspect firing at officers. then you hear the barrage of bullets. it appears several of those officers retreat, a number of them hitting the ground. there were three officers who did fire back and they were able to successfully kill the suspect. we know that two officers did suffer injuries. according to police, they were minor injuries. they've been released from the hospital. those officers were on administrative assignment until today. the officers are back on full duty as the investigation continues. >> priscilla thompson, thanks. >>now to new economic numbers out today. they show 2024 ended on a high

note when it comes to job growth. employers closed out the year with a flurry of hiring, adding 250,000 jobs in december, higher than the 155,000 predicted. the unemployment rate dropped slightly from 4.2% to 4.1%. news business correspondent brian cheung joins us now. brian, what do these numbers tell us about the state of the labor market and the economy overall? >> last report of 2024, the job market is much better than expected. let's rehash those numbers. 256,000 jobs added in the month of december. that was well above what economists were expecting. they were expecting only 155,000 jobs. when you consider the unemployment rate came in at 4.1%, it was a jobs report that shows hiring in this country firing on all cylinders. it's an uptick from the rates we were seeing about a year ago.

better than the higher unemployment we saw during the pandemic. most of these job gains, health care adding 45,000 jobs, leisure and hospitality adding 40,000 jobs. even white collar jobs, that added almost 30,000 jobs. i want to point out manufacturing did contract by about 13,000 jobs. another thing about this economy is inflation, inflation, inflation. price tags rising by 2.7%. wages are increasing on a yearly basis by 3.9%. on an average basis wages are outpacing inflation. that is certainly good news. brian, briefly, talking about these wildfires. they decimated homes and businesses in one of the country's largest cities in the largest state. that could affect job reports?

themselves not just with the beauty of the fire engine or ambulance, but with the beauty and health of the neighborhood. i will ask our members to engage with the public to form bonds that will move our city forward. meanwhile, san francisco fire tells us it has sent nearly two dozen firefighters south to help battle the wildfires in los angeles. oakland police are investigating what appears to be another smash and grab, this one involving a truck plowing a business's doors. we got this video from outside a chevron on grand alongside lake merritt. you can see the white truck with a water tank backed into the store. we have not been able to get any confirmation from police about what happened here. we've been seeing a string of similar thefts since the start of the year. also in oakland, police commissioners plan to discuss potential changes to the city's pursuit policy. the meeting today follows remarks by governor newsom. late last month, he called on oakland leaders to change their restrictive police chase rules, and he's threatening to pull state resources if the police department doesn't comply.
